 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Diné College Act of 2016</short-title></quote>.</text>
 </section><section id="idA3E5828738F34504A6B7E9992BC46195"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph id="idc4743047847e41c58e79a8f5b75e2428"><enum>(1)</enum><text>the Treaty between the United States of America and the Navajo Tribe of Indians, done at Fort Sumner, New Mexico, June 1, 1868 (15 Stat. 667), provides for the education of the citizens of the Navajo Nation;</text>
 </paragraph><paragraph id="id3EA0B4C522154DA1934EAC7E1D273CD8"><enum>(2)</enum><text>the Navajo Nation created and chartered the Navajo Community College by Resolution CN– 95–68 as a wholly owned educational entity of the Navajo Nation;</text>
 </paragraph><paragraph id="idD2E73E38A6E84F80B6E402B4CE1B8EAB"><enum>(3)</enum><text>in 1971, Congress enacted the Navajo Community College Act (<external-xref legal-doc="usc" parsable-cite="usc/25/640a">25 U.S.C. 640a et seq.</external-xref>);</text> </paragraph><paragraph id="id9F4FAF176634423EABF60FBE8A67937A"><enum>(4)</enum><text>the Navajo Nation officially changed the name of the Navajo Community College to <quote>Diné College</quote> by Resolution CAP–35–97; and</text>
 </paragraph><paragraph id="id604C3725FFF84847AC959A6950974AE0"><enum>(5)</enum><text>the purpose of Diné College is to provide educational opportunities to the Navajo people and others in areas important to the economic and social development of the Navajo Nation.</text>
 </paragraph></section><section id="id72FF55A329B34F0FB8C05EE812C1D0DA"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to ensure that the Navajo Nation and Navajo people—</text> <paragraph id="idf2e956a508ef4060a250c0ed506c3bcb"><enum>(1)</enum><text>exercise their right to self-determination, particularly in matters relating to the internal and local affairs of the Navajo Nation;</text>
 </paragraph><paragraph id="id9e3991abf2824bbc9caba8d8b2fb995b"><enum>(2)</enum><text>maintain and strengthen distinct institutions of higher education through the teaching of the Navajo language, culture, traditions, and history; and</text>
 </paragraph><paragraph id="id949e9b41f9fb46c298cb70571fa30246"><enum>(3)</enum><text>improve the economic and social conditions of the Navajo Nation and Navajo people through higher education and postsecondary vocational training.</text>
 </paragraph></section><section id="idA8740665292A4007BF53C3AA7BC50F45"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="idEE1B30AE706E4678BA767A6FF139CBAB"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text>
 <subparagraph id="idD09AC9428F304DFBB303E2A012C8BC1F"><enum>(A)</enum><text>the Committee on Indian Affairs and the Committee on Appropriations of the Senate; and</text> </subparagraph><subparagraph id="id1beb12fdd00e4d8f8854c89a5333ea57"><enum>(B)</enum><text>the Committee on Natural Resources, the Committee on Education and the Workforce, and the Committee on Appropriations of the House of Representatives.</text>
 </subparagraph></paragraph><paragraph id="id659719F43410452D9F4B14D587D5CF0F"><enum>(2)</enum><header>College</header><text>The term <term>College</term> means Diné College.</text> </paragraph><paragraph id="id4cbdd0b2462b4bcea177f3eb59faacee"><enum>(3)</enum><header>Infrastructure</header> <subparagraph id="id06B3D43C930E4ED39BE8B9942918B99D"><enum>(A)</enum><header>In general</header><text>The term <term>infrastructure</term> means the buildings, water and sewer facilities, roads, and information technology and telecommunications infrastructure of the College.</text>
 </subparagraph><subparagraph id="idBAE7109BEB3F45C49CD3DAA93197F516"><enum>(B)</enum><header>Inclusions</header><text>The term <term>infrastructure</term> includes classrooms and external matters such as walkways.</text> </subparagraph></paragraph><paragraph id="idFDDA6D8AD7AA41A4BFA9C876830868CC"><enum>(4)</enum><header>Operation and maintenance</header><text>The term <term>operation and maintenance</term> means—</text>
 <subparagraph id="id77204A72DAB94532B7364A62747F63E4"><enum>(A)</enum><text>costs and expenses associated with the customary daily operation of the College; and</text> </subparagraph><subparagraph id="id25B4C8E0A85C4D01943167539E12FD17"><enum>(B)</enum><text>necessary maintenance costs of the College.</text>
 </subparagraph></paragraph><paragraph id="idBE0C06B9838646BC92CB18500860E14A"><enum>(5)</enum><header>Renovation and repair</header><text>The term <term>renovation and repair</term> means modernization and improvement to the infrastructure.</text> </paragraph><paragraph id="id9FB653F2FBEE47BFA302482FA2E8EA28"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph></section><section id="id3E807C8F6CDA4FF5875CD3A6E9A2276B"><enum>5.</enum><header>Survey, study, and report</header>
			<subsection id="id6dac29fdbc51428bafb0507da18f5859"><enum>(a)</enum><header>In general</header>
 <paragraph id="idA40D10DAA31C444395376276111AE7D8"><enum>(1)</enum><header>Survey, study, and report</header><text>Not later than January 31, 2017, in accordance with subsection (b), the Secretary shall conduct, and submit to the appropriate committees of Congress a report on the results of, a detailed survey and study of all capital projects and facility needs of the College.</text>
 </paragraph><paragraph id="id0A5242AC3136434DA9564DDF478B3EAE"><enum>(2)</enum><header>Inclusions in report</header><text>The report described in paragraph (1) shall include—</text> <subparagraph id="id7DA50AE6B795403BAC879FC5E4DD0BE0"><enum>(A)</enum><text>recommendations by the Secretary; and</text>
 </subparagraph><subparagraph id="idA955485E32DD4E54A6123E7035A77C64"><enum>(B)</enum><text>any recommendations or views submitted by the College or the Navajo Nation regarding the capital projects and facility needs of the College.</text>
					</subparagraph></paragraph></subsection><subsection id="id4A2C249416E64AE08806E2B795E3D5BF"><enum>(b)</enum><header>Inventory</header>
 <paragraph id="id22356B311A9C40B2914776D8F44EEFCC"><enum>(1)</enum><header>In general</header><text>Not later than August 1, 2016, the College shall prepare and submit to the Secretary an inventory that identifies the renovations and repairs necessary to meet—</text>
 <subparagraph id="id6F9895F2E2834A18A4ED18743EBD3969"><enum>(A)</enum><text>health and safety standards; and</text> </subparagraph><subparagraph id="id309FF31E2E0F4BF9AC5CDA0C2326CEEF"><enum>(B)</enum><text>any other requirements the College determines necessary.</text>
 </subparagraph></paragraph><paragraph id="idECABCFDBA4434809943054715B506D66"><enum>(2)</enum><header>Use of inventory</header><text>The Secretary shall use the inventory described in paragraph (1) as baseline data to inform the survey, study, and report under subsection (a).</text>
 </paragraph></subsection><subsection id="id491dcaf386ee46079cce270c0c3dc81b"><enum>(c)</enum><header>Administrative expenses</header><text>The Secretary may use to carry out this section amounts made available to the Secretary in general administrative appropriations.</text>
			</subsection></section><section id="idC395D50354354C94B6D2B43697C2A903"><enum>6.</enum><header>Grants authorized</header>
			<subsection id="idEF9971438F5E4B52A18BE9B575A36843"><enum>(a)</enum><header>Construction grants</header>
 <paragraph id="idB312712C64B249ACA6F8C0AA979F9389"><enum>(1)</enum><header>In general</header><text>The Secretary shall make grants to the College for construction activities, including the renovation and repair or construction of buildings, water and sewer facilities, roads, information technology and telecommunications infrastructure, classrooms, and external structures (such as walkways) identified in the survey, study, and report under section 5.</text>
 </paragraph><paragraph id="id51C524400D084D7B9BADD4ABC338BA7F"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out paragraph (1) $2,000,000 for each of fiscal years 2017 through 2020, to remain available until expended unless otherwise provided in an appropriations Act.</text>
				</paragraph></subsection><subsection id="idD3E4896793C3455E8EC100A50E4D7D69"><enum>(b)</enum><header>Operation and maintenance grants</header>
 <paragraph id="idA4F60D388B9F419F9E95760CF51A9EA1"><enum>(1)</enum><header>In general</header><text>The Secretary shall make grants to the College for operation and maintenance activities, including—</text> <subparagraph id="id9309c52c14ac4a868d7cfdf161d52054"><enum>(A)</enum><text>basic, special, developmental, vocational, technical, and special handicapped education costs;</text>
 </subparagraph><subparagraph id="id98349555770b4f3d9939052c2b900837"><enum>(B)</enum><text>annual capital expenditures, including equipment needs, minor capital improvements and remodeling projects, physical plant maintenance and operation costs, and an exceptions and supplemental needs account;</text>
 </subparagraph><subparagraph id="id1d656a2c7ae740369c5537aeab33f0cd"><enum>(C)</enum><text>summer and special interest programs;</text> </subparagraph><subparagraph id="id981974835eeb426db5d132cb1896dfbc"><enum>(D)</enum><text>major capital improvements, including internal capital outlay funds and capital improvement projects;</text>
 </subparagraph><subparagraph id="idbd11327895084638b741795e3bf3ec18"><enum>(E)</enum><text>mandatory payments, including payments due on bonds, loans, notes, or lease purchases;</text> </subparagraph><subparagraph id="id29b9c8a2d08a47f4816d9e1decd26d3c"><enum>(F)</enum><text>supplemental student services, including student housing, food service, and the provision of access to books and services; and</text>
 </subparagraph><subparagraph id="id8b77cd798cb44c0ba2ae5537480ad0f0"><enum>(G)</enum><text>improving and expanding the College, including by providing for the Navajo people and others in the community of the College—</text>
 <clause id="id3585e1ac98ee43a998ac92821a96c648"><enum>(i)</enum><text>higher education programs;</text> </clause><clause id="id2c67d288991a4a889bb2c5c4719fbfc8"><enum>(ii)</enum><text>career and technical education;</text>
 </clause><clause id="id26f8790297b54fbfaca101404d01f3aa"><enum>(iii)</enum><text>activities relating to the preservation and protection of the Navajo language, philosophy, and culture;</text>
 </clause><clause id="id4fd6e42e4d264bd595fa0f54cbc8440c"><enum>(iv)</enum><text>employment and training opportunities;</text> </clause><clause id="id24a4f02179c6450ba65f6a63ff9093c4"><enum>(v)</enum><text>economic development and community outreach; and</text>
 </clause><clause id="id5cb156edb02946f4b799b23a59559f19"><enum>(vi)</enum><text>a safe learning, working, and living environment.</text> </clause></subparagraph></paragraph><paragraph id="idFE5013C44AB643BD8D686E89FA8F0C64"><enum>(2)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary to carry out paragraph (1) such sums as are necessary for each of fiscal years 2017 through 2020, to remain available until expended unless otherwise provided in an appropriations Act.</text>
 </paragraph></subsection></section><section id="id1a9611861fee40288203b12deff45ea9"><enum>7.</enum><header>Status of funds</header><text display-inline="no-display-inline">Amounts made available to the College under this Act may be treated as non-Federal, private funds of the College for purposes of any provision of Federal law that requires that non-Federal or private funds of the College be used in a project for a specific purpose.</text>
 </section><section id="id8F2E6B7DB4624EF0BDD3D042DE02FB2B"><enum>8.</enum><header>Effect on other laws</header><text display-inline="no-display-inline">This Act supersedes—</text> <paragraph id="id1f959742e27e475a92fc7cafe4a4d8df"><enum>(1)</enum><text>the Navajo Community College Act (<external-xref legal-doc="usc" parsable-cite="usc/25/640a">25 U.S.C. 640a et seq.</external-xref>);</text>
 </paragraph><paragraph id="id796040fa41484615b64e858ed92f62a0"><enum>(2)</enum><text>the Navajo Community College Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/640a">25 U.S.C. 640a</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/95/471">Public Law 95–471</external-xref>); and</text> </paragraph><paragraph id="id706fbf7d025943cea2ba49e19d7d12f0"><enum>(3)</enum><text>the Navajo Nation Higher Education Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/25/640a">25 U.S.C. 640a</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/110/315">Public Law 110–315</external-xref>).</text>
 </paragraph></section><section id="id0fdf2424b5294d18b97a951be2c1fb76"><enum>9.</enum><header>Continuing eligibility for other Federal funds</header><text display-inline="no-display-inline">Except as explicitly provided in other Federal law, nothing in this Act precludes the eligibility of the College to receive Federal funding and resources under any program authorized under—</text>
 <paragraph id="id483615A948024CCCB4BA45C733C5F7E4"><enum>(1)</enum><text display-inline="yes-display-inline">the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>);</text> </paragraph><paragraph id="idCE11A5B2A3F74835BCD795765198066C"><enum>(2)</enum><text display-inline="yes-display-inline">the Equity in Educational Land-Grant Status Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/382">Public Law 103–382</external-xref>); or</text>
 </paragraph><paragraph id="id24C587C3B1A1438D8F4D2D9741EF55A5"><enum>(3)</enum><text display-inline="yes-display-inline">any other applicable program for the benefit of institutions of higher education, community colleges, or postsecondary educational institutions.</text></paragraph></section></legis-body><endorsement><action-date>November 15, 2016</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
