<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d82587e62" identifier="/us/bill/114/s/2425/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Patient Access and Medicare Protection Act</shortTitle>”.</content></section>
<section id="d82587e72" identifier="/us/bill/114/s/2425/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>NON-APPLICATION OF MEDICARE FEE SCHEDULE ADJUSTMENTS FOR WHEELCHAIR ACCESSORIES AND SEAT AND BACK CUSHIONS WHEN FURNISHED IN CONNECTION WITH COMPLEX REHABILITATIVE POWER WHEELCHAIRS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d82587e76" identifier="/us/bill/114/s/2425/s2/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Non-application</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e83" identifier="/us/bill/114/s/2425/s2/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>Notwithstanding any other provision of law, the Secretary of Health and Human Services shall not, prior to January 1, 2017, use information on the payment determined under the competitive acquisition programs under section 1847 of the Social Security Act (<ref href="/us/usc/t42/s1395w–3">42 U.S.C. 1395w–3</ref>) to adjust the payment amount that would otherwise be recognized under section 1834(a)(1)(B)(ii) of such Act (<ref href="/us/usc/t42/s1395m/a/1/B/ii">42 U.S.C. 1395m(a)(1)(B)(ii)</ref>) for wheelchair accessories (including seating systems) and seat and back cushions when furnished in connection with Group 3 complex rehabilitative power wheelchairs.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e98" identifier="/us/bill/114/s/2425/s2/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Implementation</inline>.—</heading><content>Notwithstanding any other provision of law, the Secretary may implement this subsection by program instruction or otherwise.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d82587e106" identifier="/us/bill/114/s/2425/s2/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">GAO Study and Report</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e113" identifier="/us/bill/114/s/2425/s2/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Study</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d82587e120" identifier="/us/bill/114/s/2425/s2/b/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><heading><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Comptroller General of the United States shall conduct a study on wheelchair accessories (including seating systems) and seat and back cushions furnished in connection with Group 3 complex rehabilitative power wheelchairs. Such study shall include an analysis of the following with respect to such wheelchair accessories and seat and back cushions in each of the groups described in clauses (i) through (iii) of subparagraph (B):</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d82587e128" identifier="/us/bill/114/s/2425/s2/b/1/A/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>The item descriptions and associated HCPCS codes for such wheelchair accessories and seat and back cushions.</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d82587e132" identifier="/us/bill/114/s/2425/s2/b/1/A/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>A breakdown of utilization and expenditures for such wheelchair accessories and seat and back cushions under title XVIII of the Social Security Act.</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d82587e136" identifier="/us/bill/114/s/2425/s2/b/1/A/iii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">(iii) </num><content>A comparison of the payment amount under the competitive acquisition program under section 1847 of such Act (<ref href="/us/usc/t42/s1395w–3">42 U.S.C. 1395w–3</ref>) with the payment amount that would otherwise be recognized under section 1834 of such Act (<ref href="/us/usc/t42/s1395m">42 U.S.C. 1395m</ref>), including beneficiary cost sharing, for such wheelchair accessories and seat and back cushions.</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d82587e147" identifier="/us/bill/114/s/2425/s2/b/1/A/iv" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iv">(iv) </num><content>The aggregate distribution of such wheelchair accessories and seat and back cushions furnished under such title XVIII within each of the groups described in subparagraph (B).</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d82587e151" identifier="/us/bill/114/s/2425/s2/b/1/A/v" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="v">(v) </num><content>Other areas determined appropriate by the Comptroller General.</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d82587e155" identifier="/us/bill/114/s/2425/s2/b/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><heading><inline class="smallCaps">Groups described</inline>.—</heading><chapeau>The following groups are described in this subparagraph:</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d82587e163" identifier="/us/bill/114/s/2425/s2/b/1/B/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>Wheelchair accessories and seat and back cushions furnished predominantly with Group 3 complex rehabilitative power wheelchairs.</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d82587e167" identifier="/us/bill/114/s/2425/s2/b/1/B/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>Wheelchair accessories and seat and back cushions furnished predominantly with power wheelchairs that are not described in clause (i).</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d82587e171" identifier="/us/bill/114/s/2425/s2/b/1/B/iii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">(iii) </num><content>Other wheelchair accessories and seat and back cushions furnished with either power wheelchairs described in clause (i) or (ii).</content></clause></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e175" identifier="/us/bill/114/s/2425/s2/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Report</inline>.—</heading><content>Not later than June 1, 2016, the Comptroller General of the United States shall submit to Congress a report containing the results of the study conducted under paragraph (1), together with recommendations for such legislation and administrative as the Comptroller General determines to be appropriate.</content></paragraph></subsection></section>
<section id="d82587e184" identifier="/us/bill/114/s/2425/s3" style="-uslm-lc:I650141"><num value="3">SEC. 3. </num><heading>TRANSITIONAL PAYMENT RULES FOR CERTAIN RADIATION THERAPY SERVICES UNDER THE MEDICARE PHYSICIAN FEE SCHEDULE.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d82587e188" identifier="/us/bill/114/s/2425/s3/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 1848 of the Social Security Act (<ref href="/us/usc/t42/s1395w–4">42 U.S.C. 1395w–4</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e203" identifier="/us/bill/114/s/2425/s3/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (b), by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="11">“(11) </num><heading><inline class="smallCaps">Special rule for certain radiation therapy services</inline>.—</heading><content>The code definitions, the work relative value units under subsection (c)(2)(C)(i), and the direct inputs for the practice expense relative value units under subsection (c)(2)(C)(ii) for radiation treatment delivery and related imaging services (identified in 2016 by HCPCS G-codes G6001 through G6015) for the fee schedule established under this subsection for services furnished in 2017 and 2018 shall be the same as such definitions, units, and inputs for such services for the fee schedule established for services furnished in 2016.”</content></paragraph></quotedContent>; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e221" identifier="/us/bill/114/s/2425/s3/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>in subsection (c)(2)(K), by <amendingAction type="add">adding</amendingAction> at the end the following new clause:<quotedContent><clause class="indentUp3 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iv">“(iv) </num><heading><inline class="smallCaps">Treatment of certain radiation therapy services</inline>.—</heading><content>Radiation treatment delivery and related imaging services identified under subsection (b)(11) shall not be considered as potentially misvalued services for purposes of this subparagraph and subparagraph (O) for 2017 and 2018.”</content></clause></quotedContent>.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d82587e239" identifier="/us/bill/114/s/2425/s3/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Report to Congress on Alternative Payment Model</inline>.—</heading><content>Not later than 18 months after the date of the enactment of this Act, the Secretary of Health and Human Services shall submit to Congress a report on the development of an episodic alternative payment model for payment under the Medicare program under title XVIII of the Social Security Act for radiation therapy services furnished in nonfacility settings.</content></subsection></section>
<section id="d82587e249" identifier="/us/bill/114/s/2425/s4" style="-uslm-lc:I650141"><num value="4">SEC. 4. </num><heading>ENSURING FLEXIBILITY IN APPLYING HARDSHIP EXCEPTION FOR MEANINGFUL USE FOR 2015 EHR REPORTING PERIOD FOR 2017 PAYMENT ADJUSTMENTS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d82587e253" identifier="/us/bill/114/s/2425/s4/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Eligible Professionals</inline>.—</heading><content>Section 1848(a)(7)(B) of the Social Security Act (<ref href="/us/usc/t42/s1395w–4/a/7/B">42 U.S.C. 1395w–4(a)(7)(B)</ref>) <amendingAction type="amend">is amended</amendingAction>, in the first sentence, by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(and, with respect to the payment adjustment under subparagraph (A) for 2017, for categories of eligible professionals, as established by the Secretary and posted on the Internet website of the Centers for Medicare &amp; Medicaid Services prior to December 15, 2015, an application for which must be submitted to the Secretary by not later than March 15, 2016)</quotedText>” after “<quotedText>case-by-case basis</quotedText>”.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d82587e271" identifier="/us/bill/114/s/2425/s4/b" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Eligible Hospitals</inline>.—</heading><chapeau>Section 1886(b)(3)(B)(ix) of the Social Security Act (<ref href="/us/usc/t42/s1395ww/b/3/B/ix">42 U.S.C. 1395ww(b)(3)(B)(ix)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e286" identifier="/us/bill/114/s/2425/s4/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in the first sentence of subclause (I), by <amendingAction type="delete">striking</amendingAction> “<quotedText>(n)(6)(A)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(n)(6)</quotedText>”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e297" identifier="/us/bill/114/s/2425/s4/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>in subclause (II), in the first sentence, by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(and, with respect to the application of subclause (I) for fiscal year 2017, for categories of subsection (d) hospitals, as established by the Secretary and posted on the Internet website of the Centers for Medicare &amp; Medicaid Services prior to December 15, 2015, an application for which must be submitted to the Secretary by not later than April 1, 2016)</quotedText>” after “<quotedText>case-by-case basis</quotedText>”.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d82587e305" identifier="/us/bill/114/s/2425/s4/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Implementation</inline>.—</heading><content>Notwithstanding any other provision of law, the Secretary of Health and Human Services shall implement the provisions of, and the amendments made by, subsections (a) and (b) by program instruction, such as through information on the Internet website of the Centers for Medicare &amp; Medicaid Services.</content></subsection></section>
<section id="d82587e314" identifier="/us/bill/114/s/2425/s5" role="instruction" style="-uslm-lc:I650141"><num value="5">SEC. 5. </num><heading>MEDICARE IMPROVEMENT FUND.</heading><content style="-uslm-lc:I650120">  Section 1898(b)(1) of the Social Security Act (<ref href="/us/usc/t42/s1395iii/b/1">42 U.S.C. 1395iii(b)(1)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>$5,000,000</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>$0</quotedText>”.</content></section>
<section id="d82587e333" identifier="/us/bill/114/s/2425/s6" role="instruction" style="-uslm-lc:I650141"><num value="6">SEC. 6. </num><heading>STRENGTHENING MEDICAID PROGRAM INTEGRITY THROUGH FLEXIBILITY.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 1936 of the Social Security Act (<ref href="/us/usc/t42/s1396u–6">42 U.S.C. 1396u–6</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e345" identifier="/us/bill/114/s/2425/s6/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, or otherwise,</quotedText>” after “<quotedText>entities</quotedText>”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e353" identifier="/us/bill/114/s/2425/s6/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (e)—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d82587e357" identifier="/us/bill/114/s/2425/s6/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>in paragraph (1), in the matter preceding subparagraph (A), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(including the costs of equipment, salaries and benefits, and travel and training)</quotedText>” after “<quotedText>Program under this section</quotedText>”; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d82587e365" identifier="/us/bill/114/s/2425/s6/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>in paragraph (3), by <amendingAction type="delete">striking</amendingAction> “<quotedText>by 100</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>by 100, or such number as determined necessary by the Secretary to carry out the Program,</quotedText>”.</content></subparagraph></paragraph></section>
<section id="d82587e377" identifier="/us/bill/114/s/2425/s7" style="-uslm-lc:I650141"><num value="7">SEC. 7. </num><heading>ESTABLISHING MEDICARE ADMINISTRATIVE CONTRACTOR ERROR REDUCTION INCENTIVES.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d82587e381" identifier="/us/bill/114/s/2425/s7/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 1874A(b)(1)(D) of the Social Security Act (<ref href="/us/usc/t42/s1395kk–1/b/1/D">42 U.S.C. 1395kk–1(b)(1)(D)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e396" identifier="/us/bill/114/s/2425/s7/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText><headingText class="smallCaps">quality</headingText>.—The Secretary</quotedText>” and <amendingAction type="insert">inserting</amendingAction> <quotedContent>“<headingText class="smallCaps">quality</headingText>.—<clause class="indentUp3 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>Subject to clauses (ii) and (iii), the Secretary”</content></clause></quotedContent>; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e424" identifier="/us/bill/114/s/2425/s7/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after clause (i), as added by paragraph (1), the following new clauses:<quotedContent><clause class="indentUp3 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading><inline class="smallCaps">Improper payment rate reduction incentives</inline>.—</heading><content>The Secretary shall provide incentives for medicare administrative contractors to reduce the improper payment error rates in their jurisdictions.</content></clause><clause class="indentUp3 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading><inline class="smallCaps">Incentives</inline>.—</heading><chapeau>The incentives provided for under clause (ii)—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>may include a sliding scale of award fee payments and additional incentives to medicare administrative contractors that either reduce the improper payment rates in their jurisdictions to certain thresholds, as determined by the Secretary, or accomplish tasks, as determined by the Secretary, that further improve payment accuracy; and</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>may include substantial reductions in award fee payments under cost-plus-award-fee contracts, for medicare administrative contractors that reach an upper end improper payment rate threshold or other threshold as determined by the Secretary, or fail to accomplish tasks, as determined by the Secretary, that further improve payment accuracy.”</content></subclause></clause></quotedContent>.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d82587e458" identifier="/us/bill/114/s/2425/s7/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Effective Date</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e465" identifier="/us/bill/114/s/2425/s7/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The amendments made by subsection (a) shall apply to contracts entered into or renewed on or after the date that is 3 years after the date of enactment of this Act.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e473" identifier="/us/bill/114/s/2425/s7/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Application to existing contracts</inline>.—</heading><content>In the case of contracts in existence on or after the date of the enactment of this Act and that are not subject to the effective date under paragraph (1), the Secretary of Health and Human Services shall, when appropriate and practicable, seek to apply the incentives provided for in the amendments made by subsection (a) through contract modifications.</content></paragraph></subsection></section>
<section id="d82587e482" identifier="/us/bill/114/s/2425/s8" role="instruction" style="-uslm-lc:I650141"><num value="8">SEC. 8. </num><heading>STRENGTHENING PENALTIES FOR THE ILLEGAL DISTRIBUTION OF A MEDICARE, MEDICAID, OR CHIP BENEFICIARY IDENTIFICATION OR BILLING PRIVILEGES.</heading><content class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 1128B(b) of the Social Security Act (<ref href="/us/usc/t42/s1320a–7b/b">42 U.S.C. 1320a–7b(b)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">“(4) </num><content>Whoever without lawful authority knowingly and willfully purchases, sells or distributes, or arranges for the purchase, sale, or distribution of a beneficiary identification number or unique health identifier for a health care provider under title XVIII, title XIX, or title XXI shall be imprisoned for not more than 10 years or fined not more than $500,000 ($1,000,000 in the case of a corporation), or both.”</content></paragraph></quotedContent>.</content></section>
<section id="d82587e505" identifier="/us/bill/114/s/2425/s9" style="-uslm-lc:I650141"><num value="9">SEC. 9. </num><heading>IMPROVING THE SHARING OF DATA BETWEEN THE FEDERAL GOVERNMENT AND STATE MEDICAID PROGRAMS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d82587e509" identifier="/us/bill/114/s/2425/s9/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary of Health and Human Services (in this section referred to as the “Secretary”) shall establish a plan to encourage and facilitate the participation of States in the Medicare-Medicaid Data Match Program (commonly referred to as the “Medi-Medi Program”) under section 1893(g) of the Social Security Act (<ref href="/us/usc/t42/s1395ddd/g">42 U.S.C. 1395ddd(g)</ref>).</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d82587e521" identifier="/us/bill/114/s/2425/s9/b" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Program Revisions To Improve Medi-Medi Data Match Program Participation by States</inline>.—</heading><chapeau>Section 1893(g)(1)(A) of the Social Security Act (<ref href="/us/usc/t42/s1395ddd/g/1/A">42 U.S.C. 1395ddd(g)(1)(A)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e536" identifier="/us/bill/114/s/2425/s9/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in the matter preceding clause (i), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or otherwise</quotedText>” after “<quotedText>eligible entities</quotedText>”;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e544" identifier="/us/bill/114/s/2425/s9/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in clause (i)—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d82587e548" identifier="/us/bill/114/s/2425/s9/b/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>to review claims data</quotedText>” after “<quotedText>algorithms</quotedText>”; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d82587e556" identifier="/us/bill/114/s/2425/s9/b/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>service, time, or patient</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>provider, service, time, or patient</quotedText>”;</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e567" identifier="/us/bill/114/s/2425/s9/b/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>in clause (ii)—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d82587e571" identifier="/us/bill/114/s/2425/s9/b/3/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>to investigate and recover amounts with respect to suspect claims</quotedText>” after “<quotedText>appropriate actions</quotedText>”; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d82587e579" identifier="/us/bill/114/s/2425/s9/b/3/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>; and</quotedText>” and <amendingAction type="insert">inserting</amendingAction> a semicolon;</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e590" identifier="/us/bill/114/s/2425/s9/b/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>in clause (iii), by <amendingAction type="delete">striking</amendingAction> the period and <amendingAction type="insert">inserting</amendingAction>“<quotedText> ; and</quotedText>”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e601" identifier="/us/bill/114/s/2425/s9/b/5" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">(5) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new clause:<quotedContent><clause class="indentUp3 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iv">“(iv) </num><chapeau>furthering the Secretary’s design, development, installation, or enhancement of an automated data system architecture—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>to collect, integrate, and assess data for purposes of program integrity, program oversight, and administration, including the Medi-Medi Program; and</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>that improves the coordination of requests for data from States.”</content></subclause></clause></quotedContent>.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d82587e623" identifier="/us/bill/114/s/2425/s9/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Providing States With Data on Improper Payments Made for Items or Services Provided to Dual Eligible Individuals</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e630" identifier="/us/bill/114/s/2425/s9/c/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall develop and implement a plan that allows each State agency responsible for administering a State plan for medical assistance under title XIX of the Social Security Act access to relevant data on improper or fraudulent payments made under the Medicare program under title XVIII of the Social Security Act (<ref href="/us/usc/t42/s1395/etseq">42 U.S.C. 1395 et seq.</ref>) for health care items or services provided to dual eligible individuals.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d82587e642" identifier="/us/bill/114/s/2425/s9/c/2" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Dual eligible individual defined</inline>.—</heading><content>In this section, the term “<term>dual eligible individual</term>” means an individual who is entitled to, or enrolled for, benefits under part A of title XVIII of the Social Security Act (<ref href="/us/usc/t42/s1395c/etseq">42 U.S.C. 1395c et seq.</ref>), or enrolled for benefits under part B of title XVIII of such Act (<ref href="/us/usc/t42/s1395j/etseq">42 U.S.C. 1395j et seq.</ref>), and is eligible for medical assistance under a State plan under title XIX of such Act (<ref href="/us/usc/t42/s1396/etseq">42 U.S.C. 1396 et seq.</ref>) or under a waiver of such plan.</content></paragraph></subsection></section>
