<distribution-code display="yes">II</distribution-code><congress>114th CONGRESS</congress><session>1st Session</session><legis-num>S. 23</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20150106">January 6, 2015</action-date><action-desc><sponsor name-id="S057">Mr. Leahy</sponsor> (for himself, <cosponsor name-id="S369">Mr. Markey</cosponsor>, <cosponsor name-id="S337">Mr. Coons</cosponsor>, <cosponsor name-id="S316">Mr. Whitehouse</cosponsor>, <cosponsor name-id="S332">Mr. Franken</cosponsor>, and <cosponsor name-id="S223">Mrs. Boxer</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 17, United States Code, with respect to the definition of <quote>widow</quote> and <quote>widower</quote>, and for other purposes.</official-title></form><legis-body id="HE80C42D84FB5446BBA20F13BA6F1683C" style="OLC"><section id="id653351551CD1439C9318CC8C3E776D37" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Copyright and Marriage Equality Act</short-title></quote>.</text></section><section id="HCCCA0C0101BD4FB1A36E836496406307"><enum>2.</enum><header>Definition of widow and widower in title <enum-in-header>17</enum-in-header>, United States Code</header><subsection id="H10808CEACF414C4EA0A7F23468973783"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/101">Section 101</external-xref> of title 17, United States Code, is amended by striking the definition of <quote><quote>widow</quote> or <quote>widower</quote></quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HD1BDE343CC71430EAF96CEF9AB34DFA2" style="OLC"><paragraph id="HB01FED31A0504CEDBA49369C20469EDD"><enum></enum><text display-inline="yes-display-inline">An individual is the <quote>widow</quote> or <quote>widower</quote> of an author if the courts of the State in which the individual and the author were married (or,
			 if the individual and the author were not married in any State but were
			 validly married in another jurisdiction, the courts of any State) would
			 find that the individual and the author were validly married at the time
			 of the author’s death, whether or not the spouse has later remarried.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0721444B5A374EBD9CA7D8C8418CACFB"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to the death of any author that
			 occurs on or after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
