 <subsection id="id66D618FA94BC4A908EB2B0563446201C"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Securing America’s Future Energy: Protecting our Infrastructure of Pipelines and Enhancing Safety Act</short-title></quote> or the <quote><short-title>SAFE PIPES Act</short-title></quote>.</text>
 </subsection><subsection id="id443D8A5708824A34BDD45E5122EB498B"><enum>(b)</enum><header>References to title 49, United States Code</header><text>Except as otherwise expressly provided, wherever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of title 49, United States Code.</text>
			</subsection></section><section changed="deleted" committee-id="SSCM00" id="id924BF18461C045FB8785A2547590E3E0" reported-display-style="strikethrough"><enum>2.</enum><header>Authorization of appropriations</header>
 <subsection id="id0F0E1E53FA3F4069A9ED8D25B811EBD1"><enum>(a)</enum><header>Gas and hazardous liquid</header><text>Section 60125(a) is amended—</text> <paragraph id="id830B8A78A74C4482B7E9E6C4862BB224"><enum>(1)</enum><text>in paragraph (1), by striking <quote>there is authorized to be appropriated to the Department of Transportation for each of fiscal years 2012 through 2015, from fees collected under section 60301, $90,679,000, of which $4,746,000 is for carrying out such section 12 and $ 36,194,000 is for making grants.</quote> and inserting the following:</text>

 </subparagraph><subparagraph id="idA096B011278A4272889D47CD65C95736"><enum>(B)</enum><text>$129,671,000 for fiscal year 2017, of which $9,418,000 shall be expended for carrying out such section 12 and $42,941,000 shall be expended for making grants;</text>
 </subparagraph><subparagraph id="id431C8D3D35FC48E88720C41565DB871A"><enum>(C)</enum><text>$132,334,000 for fiscal year 2018, of which $9,512,000 shall be expended for carrying out such section 12 and $43,371,000 shall be expended for making grants; and</text>
 </subparagraph><subparagraph id="id83167E1234384638A344562FE8A042A1"><enum>(D)</enum><text>$135,051,000 for fiscal year 2019, of which $9,607,000 shall be expended for carrying out such section 12 and $43,805,000 shall be expended for making grants.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id8ED6DE41D87D4BA082ED6F3F80BF7D30"><enum>(2)</enum><text>in paragraph (2), by striking <quote>there is authorized to be appropriated for each of fiscal years 2012 through 2015 from the Oil Spill Liability Trust Fund to carry out the provisions of this chapter related to hazardous liquid and section 12 of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/355">Public Law 107–355</external-xref>), $18,573,000, of which $2,174,000 is for carrying out such section 12 and $4,558,000 is for making grants</quote> and inserting the following:</text>

 </subparagraph><subparagraph id="id7CE09CEB791B4273884F17513AA693C7"><enum>(D)</enum><text>$21,108,000 for fiscal year 2019, of which $3,203,000 shall be expended for carrying out such section 12 and $8,972,000 shall be expended for making grants.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idc21e4f2a61f84936bc6c0dbb741e8974"><enum>(b)</enum><header>Emergency response grants</header><text>Section 60125(b)(2) is amended by striking <quote>2012 through 2015</quote> and inserting <quote>2016 through 2019</quote>.</text> </subsection><subsection id="idbad24e4460cc434f9ad65e9959a0fe75"><enum>(c)</enum><header>One-Call notification programs</header><text>Section 6107 is amended—</text>
 <paragraph id="idcf97a65eaf534cd3a9e7f98be51e0568"><enum>(1)</enum><text>in subsection (a), by striking <quote>$1,000,000 for each of fiscal years 2012 through 2015</quote> and inserting <quote>$1,060,000 for each of the fiscal years 2016 through 2019</quote>; and</text> </paragraph><paragraph id="id7639f18dc6ed49c5a4487d49b8dec3d5"><enum>(2)</enum><text>in subsection (b), by striking <quote>2012 through 2015</quote> and inserting <quote>2016 through 2019</quote>.</text>
 </paragraph></subsection><subsection id="idc8bac245de9547d38025d98be57d5268"><enum>(d)</enum><header>State damage prevention programs</header><text>Section 60134(i) is amended by striking <quote>2012 through 2015</quote> and inserting <quote>2016 through 2019</quote>.</text> </subsection><subsection id="id9f4fcd6cd5bf4303add55e9b85a3cf86"><enum>(e)</enum><header>Community pipeline safety information grants</header><text>Section 60130(c) is amended by striking <quote>2012 through 2015</quote> and inserting <quote>2016 through 2019</quote>.</text>
 </subsection><subsection id="idB95E33C878164A3DA5140189B47C9C5E"><enum>(f)</enum><header>Pipeline integrity program</header><text>Section 12(f) of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note) is amended by striking <quote>2012 through 2015</quote> and inserting <quote>2016 through 2019</quote>.</text>
			</subsection></section><section changed="deleted" committee-id="SSCM00" id="id8e5e91e895934a29bc3b3df2e5ff96c7" reported-display-style="strikethrough"><enum>3.</enum><header>Regulatory updates</header>
 <subsection id="id0e5a1b2ee0674e72b6edccaf05362e34"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this Act, and every 90 days thereafter until a final rule has been issued for each of the requirements described under paragraphs (1), (2), and (3), the Secretary of Transportation shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> regarding the status of a final rule for—</text>
 <paragraph id="id2f6d9c0a7eb848d3bd7ecc16d7aa5fcf"><enum>(1)</enum><text>regulations required under the Pipeline Safety Regulatory Certainty and Job Creation Act of 2011 (<external-xref legal-doc="public-law" parsable-cite="pl/112/90">Public Law 112–90</external-xref>; 125 Stat. 1904) for which no interim final rule or direct final rule has been issued;</text>
 </paragraph><paragraph id="id2df1a9fd20c44e9b9193c7d2245adc0b"><enum>(2)</enum><text>any regulation relating to pipeline safety required by law, other than a regulation described under paragraph (1), for which for more than 2 years after the date of the enacting statute or statutory deadline no interim final rule or direct final rule has been issued; and</text>
 </paragraph><paragraph id="id41BFBC9D68144212BCB3BF8F1F87D9B5"><enum>(3)</enum><text>any other rulemaking categorized as significant.</text> </paragraph></subsection><subsection id="id9dfec9c7c0034c8c90626b41515c690d"><enum>(b)</enum><header>Contents</header><text>Each report under subsection (a) shall include—</text>
 <paragraph id="idA6461C3D7FF4415A8853658B8778F95C"><enum>(1)</enum><text>a description of the work plan for the outstanding regulation;</text> </paragraph><paragraph id="idE64C2F7F527343B9A341D71582429D1A"><enum>(2)</enum><text>an updated rulemaking timeline for the outstanding regulation;</text>
 </paragraph><paragraph id="idB8DC1AC85AC34E1D85F01BB3B6D6EB58"><enum>(3)</enum><text>current staff allocations;</text> </paragraph><paragraph id="idBE966C80E48A434D9DDC7768BCDFE585"><enum>(4)</enum><text>current data collection or research relating to the development of the rulemaking;</text>
 </paragraph><paragraph id="idF23B9977325D40A7B9DA201B369552FE"><enum>(5)</enum><text>current collaborative efforts with safety experts and other stakeholders;</text> </paragraph><paragraph id="id3E70CCF2B65A4B20A4DA5BF1A0BE0A5B"><enum>(6)</enum><text>any resource constraints impacting the rulemaking process for the outstanding regulation; and</text>
 </paragraph><paragraph id="id1BE0F82BA1E143BFB815E9D4DFF7312A"><enum>(7)</enum><text>any other details associated with the development of the rulemaking that impact the progress of the rulemaking.</text>
 </paragraph></subsection></section><section changed="deleted" committee-id="SSCM00" id="ide9ed699a4c634e0d95be603fb06dc48f" reported-display-style="strikethrough"><enum>4.</enum><header>Statutory preference</header><text display-inline="no-display-inline">The Administrator of the Pipeline and Hazardous Materials Safety Administration shall prioritize the use of Pipeline and Hazardous Materials Safety Administration resources for the completion of each outstanding statutory requirement for a rulemaking described in a report under section 3 before beginning any new rulemaking required after the date of the enactment of this Act unless the Secretary of Transportation certifies to Congress that there is a significant need to move forward with a new rulemaking.</text>
		</section><section changed="deleted" committee-id="SSCM00" id="id81511350a62b4231b491be1620b33c38" reported-display-style="strikethrough"><enum>5.</enum><header>Natural gas integrity management review</header>
 <subsection id="id41D10D2F5D764CA982B61FAF76394295"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 18 months after the publication of a final rule regarding the safety of gas transmission pipelines (76 Fed. Reg. 53086), the Comptroller General shall submit a report to Congress regarding the natural gas integrity management program.</text>
 </subsection><subsection id="id136EABE8D2B9461CAEB35618F941CF0C"><enum>(b)</enum><header>Contents</header><text>The report under subsection (a) shall include—</text> <paragraph id="id7830816e469e4cc59486e41894290cb4"><enum>(1)</enum><text>an analysis of the extent to which the natural gas integrity management program under section 60109(c) of title 49, United States Code, has improved the safety of natural gas transmission pipelines;</text>
 </paragraph><paragraph id="idfc7abb1a85874a518bcd871637d04a37"><enum>(2)</enum><text>an analysis or recommendations regarding changes to the program that would prevent inadvertent releases from pipelines and mitigate any adverse consequences of an inadvertent release, including changes to the current definition of high consequence area, or would expand integrity management beyond high consequence areas;</text>
 </paragraph><paragraph id="id4D9B62082C6740B09A02D6394C93B124"><enum>(3)</enum><text>a review of the cost effectiveness of the legacy class location regulations;</text> </paragraph><paragraph id="id39b318b9055848738b8e1e84926c3859"><enum>(4)</enum><text>an analysis of and recommendations regarding what impact the age of a pipeline should have on risk analysis of a particular pipeline;</text>
 </paragraph><paragraph id="id7b11d1c8e0d844bc96dfc9f2b1ae3fc0"><enum>(5)</enum><text>a description of any challenges affecting Federal or State regulators in their oversight of the program and how the challenges are being addressed; and</text>
 </paragraph><paragraph id="id5046E771AAC244AEB000CF19AF664133"><enum>(6)</enum><text>a description of any challenges affecting the natural gas industry in complying with the program, and how the challenges are being addressed.</text>
 </paragraph></subsection><subsection id="id80C30160C1C04825BE062BEB3D653128"><enum>(c)</enum><header>Definition of high consequence area</header><text>In this section and in section 6, the term <term>high consequence area</term> means an area described in section 60109(a) of title 49, United States Code.</text>
			</subsection></section><section changed="deleted" committee-id="SSCM00" id="idECFAE85C32BE427DAA6BCB0CA206752B" reported-display-style="strikethrough"><enum>6.</enum><header>Hazardous liquid integrity management review</header>
 <subsection id="id17D0B18058EF4E9C88A1A23B896B5BB8"><enum>(a)</enum><header>Safety study</header><text display-inline="yes-display-inline">Not later than 18 months after the publication of a final rule regarding the safety of hazardous liquid pipelines (80 Fed. Reg. 61610), the Comptroller General shall submit a report to Congress regarding the hazardous liquid integrity management program.</text>
 </subsection><subsection id="idF4A7022F9DBA4540BF80A9A72CA7FEEB"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The report under subsection (a) shall include—</text> <paragraph id="id6ED9792AE02A4A12BE3081C7CEE6F03A"><enum>(1)</enum><text>an analysis of the extent to which liquid pipeline integrity management in high consequence areas for operators of certain hazardous liquid pipeline facilities, as regulated under sections 195.450 and 195.452 of title 49, Code of Federal Regulations, has improved the safety of hazardous liquid pipelines;</text>
 </paragraph><paragraph id="id3E7B03B7DD10495B996DDE8B9A9CACD7"><enum>(2)</enum><text display-inline="yes-display-inline">recommendations, including consideration of technical, operational, and economic feasibility, regarding changes to the program that could prevent inadvertent releases from pipelines and mitigate any adverse consequences of an inadvertent release, including changes to the current definition of high consequence area;</text>
 </paragraph><paragraph id="id0BB3DC3426DE48E68CDCA3C1C87AB009"><enum>(3)</enum><text display-inline="yes-display-inline">an analysis of how surveying, assessment, mitigation, and monitoring activities, including real-time hazardous liquid pipeline monitoring during significant flood events and information sharing with other Federal agencies, are being used to address risks associated with the dynamic and unique nature of rivers, flood plains, and lakes;</text>
 </paragraph><paragraph id="id230A5F018165483DA1B0DF86F4AD5507"><enum>(4)</enum><text>an analysis of and recommendations regarding what impact pipeline features and conditions, including the age, condition, materials, and construction of a pipeline should have on risk analysis of a particular pipeline and what changes to the definition of high consequence area could be made to improve pipeline safety; and</text>
 </paragraph><paragraph id="idE9CCFF9D16A14D9BA23C791EE3B88453"><enum>(5)</enum><text>a description of any challenges affecting Federal or State regulators in their oversight of the program and how the challenges are being addressed.</text>
 </paragraph></subsection></section><section changed="deleted" committee-id="SSCM00" id="id6DB780E8637743869B20117AF57647EE" reported-display-style="strikethrough"><enum>7.</enum><header>Technical safety standards committees</header><text display-inline="no-display-inline">Section 60115(b)(4)(A) is amended by striking <quote>State commissioners. The Secretary shall consult with the national organization of State commissions before selecting those 2 individuals.</quote> and inserting <quote>State officials. The Secretary shall consult with national organizations representing State commissioners or governors when making a selection under this subparagraph.</quote>.</text>
		</section><section changed="deleted" committee-id="SSCM00" id="id0172642327434c3baa3ba53a3ed3309a" reported-display-style="strikethrough"><enum>8.</enum><header>Inspection report information</header>
 <subsection id="idBEDA5ACFEE0042A18D2C84ED9652E256"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the completion of a pipeline safety inspection, the Administrator of the Pipeline and Hazardous Materials Safety Administration, or the head of the agency leading the inspection, shall—</text>
 <paragraph id="idDBA12664E4AE40038AE6DED86D58C0EA"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a post-inspection briefing with the operator outlining concerns, and to the extent practicable, provide written preliminary findings of the inspection; or</text>
 </paragraph><paragraph id="id2E835CCEF56548A2A0EADE91AD957F11"><enum>(2)</enum><text display-inline="yes-display-inline">issue to the operator a final report, notice of amendment of plans or procedures, safety order, or corrective action order.</text>
				</paragraph></subsection><subsection id="id8F1A29854DFF4479BA7CF51363CD5731"><enum>(b)</enum><header>Report</header>
 <paragraph id="id5D231272719240999586BE418582A18F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall submit an annual report to Congress regarding—</text> <subparagraph id="idAA8C2A0A03F14BC0B0BED165DF3AB43C"><enum>(A)</enum><text>the actions that the Pipeline and Hazardous Materials Safety Administration has taken to ensure that inspections by State authorities provide effective and timely oversight; and</text>
 </subparagraph><subparagraph id="id5D267EAB2F0348BEA36676D68DA76868"><enum>(B)</enum><text display-inline="yes-display-inline">statistics relating to the timeliness of the actions described in paragraphs (1) and (2) of subsection (a).</text>
 </subparagraph></paragraph><paragraph id="id53243206148948518E82322A0B3C305F"><enum>(2)</enum><header>Cessation of effectiveness</header><text display-inline="yes-display-inline">Paragraph (1) shall cease to be effective on September 30, 2019.</text> </paragraph></subsection></section><section changed="deleted" committee-id="SSCM00" id="idFF24F32569A346B5891096628E7BF1BA" reported-display-style="strikethrough"><enum>9.</enum><header>Improving location mapping technology</header> <subsection id="id0fbbd9a5fe944a52a4fd8d05334bd7c6"><enum>(a)</enum><header>Study</header><text>The Secretary of Transportation, in consultation with stakeholders, shall conduct a study on improving damage prevention through technological improvements in location and communications practices to prevent accidental excavation damage to a pipe or its coating, including considerations of technical, operational, and economic feasibility.</text>
 </subsection><subsection id="idb78e77501ae84569a50ecd077b48d3c6"><enum>(b)</enum><header>Contents</header><text>The study under subsection (a) shall include—</text> <paragraph id="id4daf82334f73486ca85b8e99f24369c6"><enum>(1)</enum><text>an identification of any methods that could improve damage prevention through location and mapping data in an effort to reduce unintended releases caused by excavation;</text>
 </paragraph><paragraph id="id1c1fe79823694feb8c7e155421156a18"><enum>(2)</enum><text>an analysis of how increased use of GPS digital mapping technologies, predictive analytic tools, public awareness initiatives, including one-call initiatives, the use of mobile devices, and other advanced technologies could supplement existing one-call notification and damage prevention programs to reduce the frequency and severity of incidents caused by excavation damage;</text>
 </paragraph><paragraph id="id26dab11ba8d34901983c47a7fa647cce"><enum>(3)</enum><text>an analysis of the feasibility of a national data repository for pipeline excavation accident data that creates standardized data models for storing and sharing pipeline accident information; and</text>
 </paragraph><paragraph id="id0143037E7C9E4BFFB7DA1B5E3EAD6921"><enum>(4)</enum><text>an identification of opportunities for stakeholder engagement in preventing excavation damage.</text> </paragraph></subsection><subsection id="idd1335afabc2543f5a1e77c0283100cce"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of Transportation shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> regarding the study under this section, including recommendations, that include the consideration of technical, operational, and economic feasibility, on how to incorporate technological improvements and practices that may help prevent accidental excavation damage.</text>
			</subsection></section><section changed="deleted" committee-id="SSCM00" id="id24a511a9c42740b6b4046ff0725dcf0f" reported-display-style="strikethrough"><enum>10.</enum><header>Workforce of Pipeline and Hazardous Materials Safety Administration</header>
 <subsection id="idC3250341381944E1B39431FDA7A4AE2A"><enum>(a)</enum><header>Review</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Administrator of the Pipeline and Hazardous Materials Safety Administration shall submit to Congress a review of Pipeline and Hazardous Materials Safety Administration staff resource management, including geographic allocation plans, hiring challenges, and expected retirement rates and strategies. The review shall include recommendations to address hiring challenges, training needs, and any other identified staff resource challenges.</text>
			</subsection><subsection id="idD7E3808D179E4DA88BA147E13F850F97"><enum>(b)</enum><header>Critical hiring needs</header>
 <paragraph id="id172E811D28974BD189D0EBEEDF87B2D6"><enum>(1)</enum><header>In general</header><text>Beginning on the date on which the review is submitted under subsection (a), the Administrator may certify to Congress, not less frequently than annually, that a severe shortage of qualified candidates or a critical hiring need exists for a position or group of positions in the Pipeline and Hazardous Materials Safety Administration.</text>
 </paragraph><paragraph id="idEE58176C202D4F50BBE8797D3DE4E1A7"><enum>(2)</enum><header>Direct hire authority</header><text>Notwithstanding sections 3309 through 3318 of title 5, United States Code, the Administrator, after making a certification under paragraph (1), may hire a candidate for the position or candidates for the group of positions, as applicable.</text>
 </paragraph><paragraph id="id5860CB25750D447CB4880C25793EC91C"><enum>(3)</enum><header>Terminations of effectiveness</header><text>The direct hire authority provided under paragraph (2) shall terminate on September 30, 2019.</text> </paragraph></subsection></section><section changed="deleted" committee-id="SSCM00" id="id653e98cae97c4ed3a37622b64ba0169b" reported-display-style="strikethrough"><enum>11.</enum><header>Research and development</header> <subsection id="idD0ABE3F591F4456FA13C7129684C270B"><enum>(a)</enum><header>In general</header><text>In developing a research and development program plan under paragraph (3) of section 12(d) of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note), the Administrator of the Pipeline and Hazardous Materials Safety Administration, in consultation with the Assistant Secretary for Research and Technology, shall—</text>
 <paragraph id="id7CD98356B0E54A40A04834AA3BE05044"><enum>(1)</enum><text>detail compliance with the consultation requirement under paragraph (2) of such section;</text>
 </paragraph><paragraph id="idB393735396A2413D8778B4E557A2BE3B"><enum>(2)</enum><text>provide opportunities for joint research ventures with non-Federal entities, whenever practicable and appropriate, to leverage limited Federal research resources; and</text>
 </paragraph><paragraph id="idC213FC302FDD494FAEC8C0559F6EC0EC"><enum>(3)</enum><text>permit collaborative research and development projects with appropriate non-Federal organizations.</text> </paragraph></subsection><subsection id="id83d749f732e449b1a305aacd07158fbc"><enum>(b)</enum><header>Collaborative safety research report</header><text>Section 60124(a)(6) is amended—</text>
 <paragraph id="idE0012C84B4E241A89BEA7CCBC477CCEB"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="idF1BDE706CEE9494ABB2EE8A5962EC647"><enum>(2)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="id1103237F56794F7C87F36AAFBF01E72E"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="idC04B2EBA8E814BFEB571D017E3E8CA2B" reported-display-style="strikethrough" style="OLC"> <subparagraph id="id211BD41D2CC149099F093DC9179C66E5"><enum>(C)</enum><text>research activities in collaboration with non-Federal entities, including the intended improvements to safety technology, inspection technology, operator response time, and emergency responder incident response time.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSCM00" id="id3E80CE8D5D9B4A56B363822811E8EEBA" reported-display-style="strikethrough"><enum>12.</enum><header>Information sharing system</header>
 <subsection id="idB4906DDC090A4A9D8D5211B0C9AFEE6E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Transportation shall convene a working group to consider the development of a voluntary no-fault information sharing system to encourage collaborative efforts to improve inspection information feedback and information sharing with the purpose of improving natural gas transmission and hazardous liquid pipeline integrity risk analysis.</text>
 </subsection><subsection id="idDC7935BFEAD04D9880F05BD6B8BC7BE0"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">The working group described in subsection (a) shall include representatives from—</text> <paragraph id="idDF4B24A395834CDBB4D9AD1ADBB5FBEA"><enum>(1)</enum><text display-inline="yes-display-inline">the Pipeline and Hazardous Materials Safety Administration;</text>
 </paragraph><paragraph id="id1017EDDD1CD540D889385CAF7C680A9B"><enum>(2)</enum><text display-inline="yes-display-inline">industry stakeholders, including operators of pipeline facilities, inspection technology vendors, and pipeline inspection organizations;</text>
 </paragraph><paragraph id="id33436899108C48E1861A6F97B724F0B1"><enum>(3)</enum><text display-inline="yes-display-inline">safety advocacy groups;</text> </paragraph><paragraph id="idF2D5596C01F64EF2A21D37AAE3CB5B20"><enum>(4)</enum><text display-inline="yes-display-inline">research institutions;</text>
 </paragraph><paragraph id="id8E4B2DE39E834DBF8123F002189A9528"><enum>(5)</enum><text display-inline="yes-display-inline">State public utility commissions or State officials responsible for pipeline safety oversight;</text> </paragraph><paragraph id="id38F2E5FA53D04FB9BE2ABC965E465D48"><enum>(6)</enum><text display-inline="yes-display-inline">State pipeline safety inspectors; and</text>
 </paragraph><paragraph id="id3B8A5A57E85148648AAD3F9D09E2A242"><enum>(7)</enum><text display-inline="yes-display-inline">labor representatives.</text> </paragraph></subsection><subsection id="idAF73C1C81FAA4D30A9DEB5AB5DA1B49C"><enum>(c)</enum><header>Considerations</header><text display-inline="yes-display-inline">The working group described in subsection (a) shall consider and provide recommendations, if applicable, to the Secretary on—</text>
 <paragraph id="id9565F493C9BB43D9872766328E3D0E64"><enum>(1)</enum><text>the need for and the identification of a system to ensure that dig verification data is shared with inline inspection operators to the extent consistent with the need to maintain proprietary data in a confidential manner to improve pipeline safety and inspection technology;</text>
 </paragraph><paragraph id="id04F6C9EC656C489EA965EA9CABFAEA9B"><enum>(2)</enum><text display-inline="yes-display-inline">ways to encourage the exchange of pipeline inspection information and the development of advanced pipeline inspection technologies and enhanced risk analysis;</text>
 </paragraph><paragraph id="idFC40F2AE633943BE9D671BEF5AE3EF8F"><enum>(3)</enum><text display-inline="yes-display-inline">opportunities to share data, including dig verification data between operators of pipeline facilities and in-line inspector vendors to expand knowledge of the advantages and disadvantages of the different types of in-line inspection technology and methodologies;</text>
 </paragraph><paragraph id="id1BCDE203F17641E69A42F293B6786616"><enum>(4)</enum><text display-inline="yes-display-inline">options to create a secure system that protects proprietary data while encouraging the exchange of pipeline inspection information and the development of advanced pipeline inspection technologies and enhanced risk analysis; and</text>
 </paragraph><paragraph id="id03334ADAA0C346048D5B2D16F3C4FC2F"><enum>(5)</enum><text display-inline="yes-display-inline">regulatory, funding, and legal barriers to sharing the information described in paragraphs (1) through (4).</text>
 </paragraph></subsection><subsection id="id459AEFC1147B4C89BEB6D0DA671CF6AF"><enum>(d)</enum><header>FACA</header><text display-inline="yes-display-inline">The working group shall not be subject to the Federal Advisory Committee Act (5 U.S.C. App.).</text> </subsection><subsection id="idBD0559CD463C44608679EC1517C64D2F"><enum>(e)</enum><header>Publication</header><text>The Secretary shall publish the recommendations provided under subsection (c) on a publicly available website.</text>
			</subsection></section><section changed="deleted" committee-id="SSCM00" id="id0BD39C98F79A4B2D95A807360929E0B5" reported-display-style="strikethrough"><enum>13.</enum><header>Nationwide integrated pipeline safety regulatory database</header>
 <subsection id="id2678075F141D4EF3A80ED3647A15C59C"><enum>(a)</enum><header>Report</header><text>Not later than 18 months after the date of the enactment of this Act and subject to subsection (c), the Secretary of Transportation shall submit a report to Congress on the feasibility of a national integrated pipeline safety regulatory inspection database to improve communication and collaboration between the Pipeline and Hazardous Materials Safety Administration and State pipeline regulators.</text>
 </subsection><subsection id="idB18B9FCF5FAE482CB0244E0133580511"><enum>(b)</enum><header>Contents</header><text>The report under subsection (a) shall include—</text> <paragraph id="id14BC8D5C830A44E98CC98E6E31BAB239"><enum>(1)</enum><text>a description of any efforts currently underway to test a secure information-sharing system for the purpose described in subsection (a);</text>
 </paragraph><paragraph id="idEF837E7EBD7D4646B535A0BF78462F17"><enum>(2)</enum><text>a description of any progress in establishing common standards for maintaining, collecting, and presenting pipeline safety regulatory inspection data, and a methodology for the sharing of the data;</text>
 </paragraph><paragraph id="idDDA28D71B78D4C01B9BB069560869331"><enum>(3)</enum><text>a description of any existing inadequacies or gaps in State and Federal inspection, enforcement, geospatial, or other pipeline safety regulatory inspection data;</text>
 </paragraph><paragraph id="id26DAC77487E347698B442BE910A30AEE"><enum>(4)</enum><text>a description of the potential safety benefits of a national integrated pipeline database; and</text>
 </paragraph><paragraph id="id78860A7ECE174E989C721962E104E587"><enum>(5)</enum><text>recommendations for how to implement a secure information-sharing system for the purpose described in subsection (a).</text>
 </paragraph></subsection><subsection id="id2470B49691AA4BB3B7A1ECB0FB4C8B5E"><enum>(c)</enum><header>Consultation</header><text>In preparing the report under subsection (a), the Secretary shall consult with stakeholders, including each State authority operating under a certification to regulate intrastate pipelines under section 60105 of title 49, United States Code.</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SSCM00" id="ide17688bcae9c4fde8440f9622160ba4f" reported-display-style="strikethrough"><enum>14.</enum><header>Underground natural gas storage facilities</header>
 <subsection commented="no" id="id6EA061AAFCB04B45A1573D581BD555D5"><enum>(a)</enum><header>Definition of underground natural gas storage facility</header><text>In this section, the term <term>underground natural gas storage facility</term> means a gas pipeline facility (as defined in section 60101 of title 49, United States Code) that stores gas in an underground facility, including—</text>
 <paragraph commented="no" id="id1F7F797FF62542A28356D9BDCD2E607B"><enum>(1)</enum><text>a depleted hydrocarbon reservoir;</text> </paragraph><paragraph commented="no" id="idEFEDBCC287994D409444FDBFAE48D1F3"><enum>(2)</enum><text>an aquifer reservoir; or</text>
 </paragraph><paragraph commented="no" id="idDC4EFA28682F471CB20BFF42C049E642"><enum>(3)</enum><text>a solution mined salt cavern reservoir.</text> </paragraph></subsection><subsection commented="no" id="id9F8D0BA9AFE84E49893FB1FAA0840BE0"><enum>(b)</enum><header>Minimum uniform safety standards</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Secretary of Transportation, in consultation with the heads of other relevant Federal agencies, shall issue minimum uniform safety standards, incorporating, to the extent practicable, consensus standards for the operation, environmental protection, and integrity management of underground natural gas storage facilities.</text>
 </subsection><subsection commented="no" id="id2529E4B00E504E60836B105C0913ACCB"><enum>(c)</enum><header>Considerations</header><text>In developing the uniform safety standards under subsection (b), the Secretary shall—</text> <paragraph commented="no" id="id062D000C098849EEAF498C39A92FAE38"><enum>(1)</enum><text>consider the economic impacts of the regulations on individual gas customers to the extent practicable;</text>
 </paragraph><paragraph commented="no" id="id8F7377DED17B4983A2911096F00CBEBA"><enum>(2)</enum><text>ensure that the regulations do not have a significant economic impact on end users to the extent practicable; and</text>
 </paragraph><paragraph commented="no" id="id2908A12969C7405A8BBCA09B3821B6B1"><enum>(3)</enum><text>consider existing consensus standards.</text> </paragraph></subsection><subsection commented="no" id="idBC5DB05479E64F63864A710FAF96F761"><enum>(d)</enum><header>Certifications</header><text>The Secretary may authorize an intrastate underground natural gas storage safety program by a State authority that annually submits a certification to the Secretary in the same manner as provided under subsections (b) and (c) of section 60105 of title 49, United States Code.</text>
			</subsection><subsection commented="no" id="idFD36326189CA494083DD5332D5A58547"><enum>(e)</enum><header>Agreements</header>
 <paragraph commented="no" id="id9565CA0ED6D84803BE296747A5E18E33"><enum>(1)</enum><header>In general</header><text>The Secretary may make an agreement, in the same manner as provided in section 60106 of title 49, United States Code, with a State authority authorizing the State authority to take necessary action to provide or participate in the oversight of interstate underground natural gas storage facilities.</text>
 </paragraph><paragraph commented="no" id="idEB98E28CEB6049DAA0BE51C72CACA4B8"><enum>(2)</enum><header>Rule of construction</header><text>Notwithstanding the limitation under section 60104(b) of title 49, United States Code, to the extent a State has oversight of the wellbore piping and hole drilled to connect the surface wellhead with the underground reservoir, the standards adopted under subsection (b) may be enforced by the State.</text>
 </paragraph></subsection><subsection commented="no" id="id6A6628200B27444EB79358CCF3AC4140"><enum>(f)</enum><header>Grants</header><text>If a State authority with responsibility for regulating gas pipelines in that State under a certification under section 60105 of title 49, United States Code, an agreement under section 60106 of that title, or both, files an application in such form and manner as prescribed by the Secretary not later than September 30 of a calendar year, the Secretary shall pay not more than 80 percent of the cost of the personnel, equipment, and activities the authority reasonably requires during the next calendar year—</text>
 <paragraph commented="no" id="id77AEFC8E810249BCBE85EB9A384AF612"><enum>(1)</enum><text>to carry out an intrastate underground natural gas storage safety program under a certification under subsection (d); or</text>
 </paragraph><paragraph commented="no" id="id6978F11B2CFD45FCBEE1F44B92E267C0"><enum>(2)</enum><text>to act as an agent of the Secretary on interstate underground natural gas storage facilities under an agreement under subsection (e).</text>
				</paragraph></subsection><subsection commented="no" id="idF7443FC3C95B4D53B193728F673F3AF7"><enum>(g)</enum><header>User fees</header>
 <paragraph commented="no" id="idCE3557EB95E14B4E9A38DF98161D39D9"><enum>(1)</enum><header>In general</header><text>A fee shall be imposed on an entity operating an underground natural gas storage facility to which this section applies. Any such fee imposed shall be collected before the end of the fiscal year to which it applies.</text>
 </paragraph><paragraph commented="no" id="id41082E9FAACB4EE6B08560A8282A4DCF"><enum>(2)</enum><header>Means of collection</header><text>The Secretary shall prescribe procedures to collect fees under this subsection. The Secretary may use a department, agency, or instrumentality of the United States Government or of a State or local government to collect the fee and may reimburse the department, agency, or instrumentality a reasonable amount for its services.</text>
				</paragraph><paragraph commented="no" id="id9744c6e337ac4050ad254a45969049c2"><enum>(3)</enum><header>Use of fees</header>
 <subparagraph commented="no" id="id00708282E9E346868783E6C5D98DA446"><enum>(A)</enum><header>Account</header><text>There is established an underground natural gas storage facility safety account in the Pipeline Safety Fund established under section 60301 of title 49, United States Code, in the Treasury of the United States.</text>
 </subparagraph><subparagraph commented="no" id="id42DB638516CC4DA0AB958082D1EFA15E"><enum>(B)</enum><header>Use of fees</header><text>A fee collected under this subsection—</text> <clause commented="no" id="idDF7072BC03924E35BBEADE57CFDDDCD8"><enum>(i)</enum><text>shall be deposited in the underground natural gas storage facility safety account; and</text>
 </clause><clause commented="no" id="idfb225aeefafa4c4594e3b30fd8024fa4"><enum>(ii)</enum><text>if the fee is related to an underground natural gas storage facility, may be used only for an activity related to underground natural gas storage safety under this section.</text>
 </clause></subparagraph><subparagraph commented="no" id="idc677e9eac3074766a03c3c55406537b9"><enum>(C)</enum><header>Limitation</header><text>Amounts collected under this subsection shall be made available only to the extent provided in advance in an appropriation law for an activity related to underground natural gas storage safety.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="idD2CA339961DF4E90B6DCEDA325799601"><enum>(h)</enum><header>Rules of construction</header>
 <paragraph commented="no" id="id1EEAC3D68BD74B6083CCF91306292456"><enum>(1)</enum><header>In general</header><text>Nothing in this section may be construed to affect any regulation relating to gas pipeline facilities that is in effect on the day before the date of enactment of this Act.</text>
 </paragraph><paragraph commented="no" id="id7477B83CF94743DE935CC16241AE3B1C"><enum>(2)</enum><header>Limitations</header><text>Nothing in this section may be construed to authorize the Secretary to prescribe the location of an underground natural gas storage facility or to require the Secretary’s permission to construct such a facility.</text>
				</paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SSCM00" id="id842B007317464221B2BB7249AF6D7D7B" reported-display-style="strikethrough"><enum>15.</enum><header>Response plans</header>
 <subsection commented="no" id="idC6DDE82B99E34E5D83FD69B28F0ED0BA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In preparing or reviewing a response plan under part 194 of title 49, Code of Federal Regulations, the Administrator of the Pipeline and Hazardous Materials Safety Administration and an operator shall each consider, to the maximum extent practicable, the impact of a worst-case discharge of hazardous liquid, or the substantial threat of such a discharge, into or on any navigable waters or adjoining shorelines that may be covered in whole or in part by ice.</text>
 </subsection><subsection commented="no" id="id9F58990725FA482BBD24A900A243FE17"><enum>(b)</enum><header>Definitions</header><text>In this section, any applicable definitions set forth in section 194.5 of title 49, Code of Federal Regulations (as in effect on the day before the date of enactment of this Act), shall apply.</text>
 </subsection></section><section changed="deleted" commented="no" committee-id="SSCM00" id="idD4FCD39C527F461D95A843444AD4A69E" reported-display-style="strikethrough"><enum>16.</enum><header>High consequence areas</header><text display-inline="no-display-inline">The Secretary of Transportation shall revise section 195.6(b) of title 49, Code of Federal Regulations, to explicitly state that the Great Lakes are a U.S.A. ecological resource (as defined in section 195.6(b) of that title) for purposes of determining whether a pipeline is in a high consequence area (as defined in section 195.450 of that title).</text>
 </section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="idF4A1812DE4EB4B9F94E8CA7667EF0799" reported-display-style="strikethrough" section-type="subsequent-section"><enum>17.</enum><header>Surface transportation security review</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Comptroller General shall submit a report to Congress on the staffing, resource allocation, oversight strategy, and management of the Transportation Security Administration’s pipeline security program and other surface transportation programs. The report shall include information on the coordination between the Transportation Security Administration, other Federal stakeholders, and industry.</text></section></legis-body>

			</subsection></section><section changed="added" committee-id="SSCM00" id="ide84fe0f6-5244-4f75-9447-3e1135931226" reported-display-style="italic"><enum>3.</enum><header>Regulatory updates</header>
 <subsection id="idb991503e-9b8f-429a-928f-54cfd4d8af2a"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this Act, and every 90 days thereafter until a final rule has been issued for each of the requirements described under paragraphs (1), (2), and (3), the Secretary of Transportation shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> regarding the status of a final rule for—</text>
 <paragraph id="ida44b6336-4cc6-4c4d-a2ff-7f637e17c453"><enum>(1)</enum><text>regulations required under the Pipeline Safety Regulatory Certainty and Job Creation Act of 2011 (<external-xref legal-doc="public-law" parsable-cite="pl/112/90">Public Law 112–90</external-xref>; 125 Stat. 1904) for which no interim final rule or direct final rule has been issued;</text>
 </paragraph><paragraph id="iddc5c1152-b480-4ff6-b694-41af82ddfea6"><enum>(2)</enum><text>any regulation relating to pipeline safety required by law, other than a regulation described under paragraph (1), for which for more than 2 years after the date of the enacting statute or statutory deadline no interim final rule or direct final rule has been issued; and</text>
 </paragraph><paragraph id="ide639fcae-ba37-4295-812a-06a2fcad3b53"><enum>(3)</enum><text>any other pipeline safety rulemaking categorized as significant.</text> </paragraph></subsection><subsection id="id657e5f2f-3a90-4d6b-b2b8-d11f029e522e"><enum>(b)</enum><header>Contents</header><text>Each report under subsection (a) shall include—</text>
 <paragraph id="idb228db60-298c-4f0c-aca4-72c8749d8092"><enum>(1)</enum><text>a description of the work plan for the outstanding regulation;</text> </paragraph><paragraph id="id42265a78-3347-4dea-bc49-b43785c8cb61"><enum>(2)</enum><text>an updated rulemaking timeline for the outstanding regulation;</text>
 </paragraph><paragraph id="iddc373269-4215-458a-a3a7-cb61fdd9c948"><enum>(3)</enum><text>current staff allocations;</text> </paragraph><paragraph id="idBE0D3BB5B8C946D487C1B8A1954BF544"><enum>(4)</enum><text>any other information collection request with substantial changes;</text>
 </paragraph><paragraph id="idfd62f261-8056-413d-ac97-9db488d67022"><enum>(5)</enum><text>current data collection or research relating to the development of the rulemaking;</text> </paragraph><paragraph id="id81ff7a13-c1fd-45d5-953c-c546ebd426a8"><enum>(6)</enum><text>current collaborative efforts with safety experts and other stakeholders;</text>
 </paragraph><paragraph id="ide5e5a3ab-6148-4b23-be76-3ac9933ec053"><enum>(7)</enum><text>any resource constraints impacting the rulemaking process for the outstanding regulation; and</text>
 </paragraph><paragraph id="id713d21d5-893d-48e5-86b3-f60f537c4e5f"><enum>(8)</enum><text>any other details associated with the development of the rulemaking that impact the progress of the rulemaking.</text>
 </paragraph></subsection></section><section changed="added" committee-id="SSCM00" id="id532E00F70850485AB82F6275E0D73F1B" reported-display-style="italic"><enum>4.</enum><header>Hazardous materials identification numbers</header><text display-inline="no-display-inline">The Administrator of the Pipeline and Hazardous Materials Safety Administration shall—</text> <paragraph id="id955CDA1B1DF947CBA5C2A4D5D3F3218C"><enum>(1)</enum><text>rescind the implementation of the June 26, 2015 PHMSA interpretative letter (#14-0178); and</text>
 </paragraph><paragraph id="id7474CE9C9F274BAEABD40ADD9202ECFC"><enum>(2)</enum><text>reinstate paragraphs (4) and (5) of section 172.336(c) of title 49, Code of Federal Regulations, without the reference to <quote>gasohol</quote>, as was originally intended in the March 7, 2013 final rule (PHMSA–2011–0142).</text>
 </paragraph></section><section changed="added" committee-id="SSCM00" id="id3676ed0e-56a0-4492-a200-c8af0e1080aa" reported-display-style="italic"><enum>5.</enum><header>Statutory preference</header><text display-inline="no-display-inline">The Administrator of the Pipeline and Hazardous Materials Safety Administration shall prioritize the use of Pipeline and Hazardous Materials Safety Administration resources for the completion of each outstanding statutory requirement, including requirements for rulemakings and information collection requests, for a rulemaking described in a report under section 3 before beginning any new rulemaking required after the date of the enactment of this Act unless the Secretary of Transportation certifies to Congress that there is a significant need to move forward with a new rulemaking.</text>
		</section><section changed="added" committee-id="SSCM00" id="ida06f66f7-1683-4975-a008-d2050fdbdac5" reported-display-style="italic"><enum>6.</enum><header>Natural gas integrity management review</header>
 <subsection id="id6c31bf4d-f1b5-4c82-a7e6-5961ac60ea37"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 18 months after the publication of a final rule regarding the safety of gas transmission pipelines (76 Fed. Reg. 53086), the Comptroller General of the United States shall submit a report to Congress regarding the natural gas integrity management program.</text>
 </subsection><subsection id="idd9a0b238-278b-42a6-b645-3d15b966604b"><enum>(b)</enum><header>Contents</header><text>The report under subsection (a) shall include—</text> <paragraph id="idaab55773-a788-4c0e-926f-a8b927a56918"><enum>(1)</enum><text>an analysis of the extent to which the natural gas integrity management program under section 60109(c) of title 49, United States Code, has improved the safety of natural gas transmission pipelines;</text>
 </paragraph><paragraph id="id665a788e-13aa-44b8-8347-422c4cccdc61"><enum>(2)</enum><text>an analysis or recommendations, including consideration of technical, operational, and economic feasibility, regarding changes to the program that would prevent inadvertent releases from pipelines and mitigate any adverse consequences of an inadvertent release, including changes to the current definition of high consequence area, or would expand integrity management beyond high consequence areas;</text>
 </paragraph><paragraph id="id96c21498-f67d-4c9a-a39f-d0a464cbe075"><enum>(3)</enum><text>a review of the cost effectiveness of the legacy class location regulations;</text> </paragraph><paragraph id="id0a0acda8-3bdb-4bd0-b8c0-0dbeafba8049"><enum>(4)</enum><text>an analysis of and recommendations regarding what impact pipeline features and conditions, including the age, condition, materials, and construction of a pipeline, should have on risk analysis of a particular pipeline;</text>
 </paragraph><paragraph id="ide12f1d8c-6a1e-49e1-ab3b-4bec31296417"><enum>(5)</enum><text>a description of any challenges affecting Federal or State regulators in their oversight of the program and how the challenges are being addressed; and</text>
 </paragraph><paragraph id="id61b42630-89ff-4fe4-862e-ed91d5fd4dd6"><enum>(6)</enum><text>a description of any challenges affecting the natural gas industry in complying with the program, and how the challenges are being addressed.</text>
 </paragraph></subsection><subsection id="idcc6c5ebf-c95c-4f27-b750-7ae5730f8745"><enum>(c)</enum><header>Definition of high consequence area</header><text>In this section and in section 7, the term <term>high consequence area</term> means an area described in section 60109(a) of title 49, United States Code.</text>
			</subsection></section><section changed="added" committee-id="SSCM00" id="id218d025c-5435-4c07-99b4-21ca9852fd84" reported-display-style="italic"><enum>7.</enum><header>Hazardous liquid integrity management review</header>
 <subsection id="id7d6c2eb1-5434-4914-a161-f92cb2ab0f01"><enum>(a)</enum><header>Safety study</header><text display-inline="yes-display-inline">Not later than 18 months after the publication of a final rule regarding the safety of hazardous liquid pipelines (80 Fed. Reg. 61610), the Comptroller General of the United States shall submit a report to Congress regarding the hazardous liquid integrity management program.</text>
 </subsection><subsection id="idc5c56df2-cc66-49b4-9c85-ececede0f62a"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The report under subsection (a) shall include—</text> <paragraph id="id5b11efca-10a5-43af-b36b-9e5de2157613"><enum>(1)</enum><text>an analysis of the extent to which liquid pipeline integrity management in high consequence areas for operators of certain hazardous liquid pipeline facilities, as regulated under sections 195.450 and 195.452 of title 49, Code of Federal Regulations, has improved the safety of hazardous liquid pipelines;</text>
 </paragraph><paragraph id="id623989ec-042f-4d40-b033-05b498aa3137"><enum>(2)</enum><text display-inline="yes-display-inline">recommendations, including consideration of technical, operational, and economic feasibility, regarding changes to the program that could prevent inadvertent releases from pipelines and mitigate any adverse consequences of an inadvertent release, including changes to the current definition of high consequence area;</text>
 </paragraph><paragraph id="id0e355d30-0f07-4fab-ac6f-0c2cef6dd838"><enum>(3)</enum><text display-inline="yes-display-inline">an analysis of how surveying, assessment, mitigation, and monitoring activities, including real-time hazardous liquid pipeline monitoring during significant flood events and information sharing with other Federal agencies, are being used to address risks associated with the dynamic and unique nature of rivers, flood plains, and lakes;</text>
 </paragraph><paragraph id="id835ae67f-cb4b-4783-a1c8-19e5e70d7dae"><enum>(4)</enum><text>an analysis of and recommendations regarding what impact pipeline features and conditions, including the age, condition, materials, and construction of a pipeline, should have on risk analysis of a particular pipeline and what changes to the definition of high consequence area could be made to improve pipeline safety; and</text>
 </paragraph><paragraph id="id49bd0bf1-5df8-40b0-95b7-79d7322cfc26"><enum>(5)</enum><text>a description of any challenges affecting Federal or State regulators in their oversight of the program and how the challenges are being addressed.</text>
 </paragraph></subsection></section><section changed="added" committee-id="SSCM00" id="id32602d01-8870-4179-a7ff-4e570155500c" reported-display-style="italic"><enum>8.</enum><header>Technical safety standards committees</header><text display-inline="no-display-inline">Section 60115(b)(4)(A) is amended by striking <quote>State commissioners. The Secretary shall consult with the national organization of State commissions before selecting those 2 individuals.</quote> and inserting <quote>State officials. The Secretary shall consult with national organizations representing State commissioners or governors when making a selection under this subparagraph.</quote></text>
		</section><section changed="added" committee-id="SSCM00" id="idaa713c93-85ab-412c-88c8-1090a52f7875" reported-display-style="italic"><enum>9.</enum><header>Inspection report information</header>
 <subsection id="id7f9f27ac-0484-4cb7-a95c-a63986c71590"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the completion of a pipeline safety inspection, the Administrator of the Pipeline and Hazardous Materials Safety Administration, or the State authority certified under section 60105 of title 49, United States Code, shall—</text>
 <paragraph id="id2c8d0a7c-678e-44c7-8952-eb990dba6563"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a post-inspection briefing with the operator outlining concerns, and to the extent practicable, provide written preliminary findings of the inspection; or</text>
 </paragraph><paragraph id="id42312e8c-85e5-4283-8817-6477809880bf"><enum>(2)</enum><text display-inline="yes-display-inline">issue to the operator a final report, notice of amendment of plans or procedures, safety order, or corrective action order, or such other applicable report, notice, or order.</text>
				</paragraph></subsection><subsection id="ide0b191c1-0422-4039-a625-c3b39e7c1a04"><enum>(b)</enum><header>Report</header>
 <paragraph id="ided30b1c9-8150-4d42-94df-e6c6d8924e1a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall submit an annual report to Congress regarding—</text> <subparagraph id="id0167eb78-6fb7-4f7a-b43d-f52c32102b82"><enum>(A)</enum><text>the actions that the Pipeline and Hazardous Materials Safety Administration has taken to ensure that inspections by State authorities provide effective and timely oversight; and</text>
 </subparagraph><subparagraph id="ida5c59782-ab79-4a73-9e88-e8a4c67b8ca2"><enum>(B)</enum><text display-inline="yes-display-inline">statistics relating to the timeliness of the actions described in paragraphs (1) and (2) of subsection (a).</text>
 </subparagraph></paragraph><paragraph id="id9d80500a-7283-4b11-bfbb-80a75325d350"><enum>(2)</enum><header>Cessation of effectiveness</header><text display-inline="yes-display-inline">Paragraph (1) shall cease to be effective on September 30, 2019.</text> </paragraph></subsection></section><section changed="added" committee-id="SSCM00" id="id6F3703A2FDEB486F9157EFCFD8CAC003" reported-display-style="italic"><enum>10.</enum><header>Pipeline odorization study</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> that assesses—</text>
 <paragraph id="ideece5894fa9c4150bb7a0530166d4570"><enum>(1)</enum><text>the feasibility of odorizing all combustible gas in transportation;</text> </paragraph><paragraph id="id7b37cc5ff8944302be68f43e9ae92a63"><enum>(2)</enum><text>the impacts of the odorization of all combustible gas in transportation on manufacturers, agriculture, and other end users; and</text>
 </paragraph><paragraph id="id6423DFFE9C2F43BEB29E73B14D83AC47"><enum>(3)</enum><text>the relative benefits and costs associated with odorizing all combustible gas in transportation compared to using other methods to mitigate pipeline leaks.</text>
			</paragraph></section><section changed="added" committee-id="SSCM00" id="id45f301e2-74da-483f-8468-7e0fc43f5028" reported-display-style="italic"><enum>11.</enum><header>Improving damage prevention technology</header>
 <subsection id="id09d86428-bbe7-4efb-b6c1-d5681e07d2b1"><enum>(a)</enum><header>Study</header><text>The Secretary of Transportation, in consultation with stakeholders, shall conduct a study on improving existing damage prevention programs through technological improvements in location, mapping, excavation, and communications practices to prevent accidental excavation damage to a pipe or its coating, including considerations of technical, operational, and economic feasibility and existing damage prevention programs.</text>
 </subsection><subsection id="idab253d68-29fd-4963-a618-68c072687b14"><enum>(b)</enum><header>Contents</header><text>The study under subsection (a) shall include—</text> <paragraph id="id87b8ac32-396f-4d97-be56-fb4120c9d72f"><enum>(1)</enum><text>an identification of any methods that could improve existing damage prevention programs through location and mapping practices or technologies in an effort to reduce unintended releases caused by excavation;</text>
 </paragraph><paragraph id="id4b86a90b-037a-49a4-a6ba-5fa4ab75db93"><enum>(2)</enum><text>an analysis of how increased use of GPS digital mapping technologies, predictive analytic tools, public awareness initiatives including one-call initiatives, the use of mobile devices, and other advanced technologies could supplement existing one-call notification and damage prevention programs to reduce the frequency and severity of incidents caused by excavation damage;</text>
 </paragraph><paragraph id="ida6da0cb5-7664-4f8d-815c-06612ba1c004"><enum>(3)</enum><text>an identification of any methods that could improve excavation practices or technologies in an effort to reduce pipeline damages;</text>
 </paragraph><paragraph id="id929914A8F4F343A2AA78A8208E1FCEE7"><enum>(4)</enum><text>an analysis of the feasibility of a national data repository for pipeline excavation accident data that creates standardized data models for storing and sharing pipeline accident information; and</text>
 </paragraph><paragraph id="idb53ad62c-c457-47db-b2e6-47df3da953ce"><enum>(5)</enum><text>an identification of opportunities for stakeholder engagement in preventing excavation damage.</text> </paragraph></subsection><subsection id="id6f9fb049-f014-4516-a81b-adf1808a85ec"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of Transportation shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> regarding the study under this section, including recommendations, that include the consideration of technical, operational, and economic feasibility, on how to incorporate, into existing damage prevention programs, technological improvements and practices that may help prevent accidental excavation damage.</text>
			</subsection></section><section changed="added" committee-id="SSCM00" id="id3187b469-a4ae-44c5-9e67-d5ae9556a1c6" reported-display-style="italic"><enum>12.</enum><header>Workforce of Pipeline and Hazardous Materials Safety Administration</header>
 <subsection id="id61a927e5-49eb-4c19-9202-94c62188e1b7"><enum>(a)</enum><header>Review</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Administrator of the Pipeline and Hazardous Materials Safety Administration shall submit to Congress a review of Pipeline and Hazardous Materials Safety Administration staff resource management, including geographic allocation plans, hiring challenges, and expected retirement rates and strategies. The review shall include recommendations to address hiring challenges, training needs, and any other identified staff resource challenges.</text>
			</subsection><subsection id="idfc3ab240-3de8-42df-8721-584d0c4c77e4"><enum>(b)</enum><header>Critical hiring needs</header>
 <paragraph id="ideb3ee250-100a-44c7-b05b-baa8251df933"><enum>(1)</enum><header>In general</header><text>Beginning on the date on which the review is submitted under subsection (a), the Administrator may certify to Congress, not less frequently than annually, that a severe shortage of qualified candidates or a critical hiring need exists for a position or group of positions in the Pipeline and Hazardous Material Safety Administration.</text>
 </paragraph><paragraph id="id9aad8d23-3ca2-40ad-94bb-31343e90ec02"><enum>(2)</enum><header>Direct hire authority</header><text>Notwithstanding sections 3309 through 3318 of title 5, United States Code, the Administrator, after making a certification under paragraph (1), may hire a candidate for the position or candidates for the group of positions, as applicable.</text>
 </paragraph><paragraph id="idd922ef20-55c4-4711-9e9b-765ce220965c"><enum>(3)</enum><header>Terminations of effectiveness</header><text>The direct hire authority provided under paragraph (2) shall terminate on September 30, 2019.</text> </paragraph></subsection></section><section changed="added" committee-id="SSCM00" id="ida4d47ea5-8a1a-469e-a194-98054cfd558a" reported-display-style="italic"><enum>13.</enum><header>Research and development</header> <subsection id="id595014f7-ad10-455b-9d1b-b74d8ee2b9bb"><enum>(a)</enum><header>In general</header><text>In developing a research and development program plan under paragraph (3) of section 12(d) of the Pipeline Safety Improvement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/49/60101">49 U.S.C. 60101</external-xref> note), the Administrator of the Pipeline and Hazardous Material Safety Administration, in consultation with the Assistant Secretary for Research and Technology, shall—</text>
 <paragraph id="idb70aa69c-faee-4d4b-844e-d6697a8e9aa1"><enum>(1)</enum><text>detail compliance with the consultation requirement under paragraph (2) of such section;</text>
 </paragraph><paragraph id="id26667a21-cece-4232-a5f4-107ebd44535d"><enum>(2)</enum><text>provide opportunities for joint research ventures with non-Federal entities, whenever practicable and appropriate, to leverage limited Federal research resources; and</text>
 </paragraph><paragraph id="id58c6c77f-20af-4bb8-b480-2fd4d8814f1b"><enum>(3)</enum><text>permit collaborative research and development projects with appropriate non-Federal organizations.</text> </paragraph></subsection><subsection id="id1418f962-98e6-4916-8200-2309529e26cc"><enum>(b)</enum><header>Collaborative safety research report</header><text>Section 60124(a)(6) is amended—</text>
 <paragraph id="id07591491-2452-41c8-8c1a-dca92f720a4c"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="idc3a3bfb3-b6f1-4f2e-8dc5-264eeb9a6a07"><enum>(2)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="id9de841eb-d688-44c6-bb38-e243c9adb23b"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id48f93203-8d6a-4963-bdd5-2d4a35c70f2f" reported-display-style="italic" style="OLC"> <subparagraph id="id5ca1beca-dfe0-4870-b759-c8f71ed38efe"><enum>(C)</enum><text>research activities in collaboration with non-Federal entities, including the intended improvements to safety technology, inspection technology, operator response time, and emergency responder incident response time.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section changed="added" committee-id="SSCM00" id="idbfd6631b-73cc-406f-92df-c1782e10b414" reported-display-style="italic"><enum>14.</enum><header>Information sharing system</header>
 <subsection id="ida7103560-f458-441e-9c9d-41e4e6a2c6e8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Transportation shall convene a working group to consider the development of a voluntary no-fault information sharing system to encourage collaborative efforts to improve inspection information feedback and information sharing with the purpose of improving natural gas transmission and hazardous liquid pipeline integrity risk analysis.</text>
 </subsection><subsection id="idf6ae204a-653b-47e7-83f5-8da192857eb7"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">The working group described in subsection (a) shall include representatives from—</text> <paragraph id="id05cd1242-3525-43bd-9f13-b51b0c334110"><enum>(1)</enum><text display-inline="yes-display-inline">the Pipeline and Hazardous Materials Safety Administration;</text>
 </paragraph><paragraph id="id0d9d74e5-1fbf-4188-b393-18fb07267497"><enum>(2)</enum><text display-inline="yes-display-inline">industry stakeholders, including operators of pipeline facilities, inspection technology vendors, and pipeline inspection organizations;</text>
 </paragraph><paragraph id="id543a14a3-bc83-49d9-ae78-dea4099fd0ba"><enum>(3)</enum><text display-inline="yes-display-inline">safety advocacy groups;</text> </paragraph><paragraph id="idc772f035-e92d-4677-9d87-420f33a0ea10"><enum>(4)</enum><text display-inline="yes-display-inline">research institutions;</text>
 </paragraph><paragraph id="id5dcba712-aeec-4b95-ac5d-9f636d51ef4f"><enum>(5)</enum><text display-inline="yes-display-inline">State public utility commissions or State officials responsible for pipeline safety oversight;</text> </paragraph><paragraph id="id5cce4624-bd15-4f5f-a531-db0361cd2eae"><enum>(6)</enum><text display-inline="yes-display-inline">State pipeline safety inspectors; and</text>
 </paragraph><paragraph id="idee7e8dbf-5244-4167-abd8-044ac3613ca1"><enum>(7)</enum><text display-inline="yes-display-inline">labor representatives.</text> </paragraph></subsection><subsection id="id4cb6fb63-773d-4b7a-b161-370bd0455875"><enum>(c)</enum><header>Considerations</header><text display-inline="yes-display-inline">The working group described in subsection (a) shall consider and provide recommendations, if applicable, to the Secretary on—</text>
 <paragraph id="id945aa1b0-e7a3-454f-ba5e-46ef134ac4b3"><enum>(1)</enum><text>the need for and the identification of a system to ensure that dig verification data is shared with inline inspection operators to the extent consistent with the need to maintain proprietary and security sensitive data in a confidential manner to improve pipeline safety and inspection technology;</text>
 </paragraph><paragraph id="ide3fe6570-d7aa-4105-bce5-fb7d3ff1f734"><enum>(2)</enum><text display-inline="yes-display-inline">ways to encourage the exchange of pipeline inspection information and the development of advanced pipeline inspection technologies and enhanced risk analysis;</text>
 </paragraph><paragraph id="id7dc8419d-5e5e-47d4-a918-211142dc1aae"><enum>(3)</enum><text display-inline="yes-display-inline">opportunities to share data, including dig verification data between operators of pipeline facilities and in-line inspector vendors to expand knowledge of the advantages and disadvantages of the different types of in-line inspection technology and methodologies;</text>
 </paragraph><paragraph id="id5a49ea3b-50b7-47a3-817f-a11d9cca4721"><enum>(4)</enum><text display-inline="yes-display-inline">options to create a secure system that protects proprietary data while encouraging the exchange of pipeline inspection information and the development of advanced pipeline inspection technologies and enhanced risk analysis; and</text>
 </paragraph><paragraph id="id4c425977-5875-4f03-9ab4-a0d646ed0384"><enum>(5)</enum><text display-inline="yes-display-inline">regulatory, funding, and legal barriers to sharing the information described in paragraphs (1) through (4).</text>
 </paragraph></subsection><subsection id="id1dced78b-94ac-4ca4-a200-fdf8f98e8713"><enum>(d)</enum><header>FACA</header><text display-inline="yes-display-inline">The working group shall not be subject to the Federal Advisory Committee Act (5 U.S.C. App.).</text> </subsection><subsection id="ida8ceb722-9dcb-4f5f-8b3c-6515d4efbc73"><enum>(e)</enum><header>Publication</header><text>The Secretary shall publish the recommendations provided under subsection (c) on a publicly available website.</text>
			</subsection></section><section changed="added" committee-id="SSCM00" id="id9d262f6f-3b08-4359-8f8a-3726b527573a" reported-display-style="italic"><enum>15.</enum><header>Nationwide integrated pipeline safety regulatory database</header>
 <subsection id="id88cddcc1-1be0-423e-b486-e8b0f6836910"><enum>(a)</enum><header>Report</header><text>Not later than 18 months after the date of the enactment of this Act, the Secretary of Transportation shall submit a report to Congress on the feasibility of a national integrated pipeline safety regulatory inspection database to improve communication and collaboration between the Pipeline and Hazardous Materials Safety Administration and State pipeline regulators.</text>
 </subsection><subsection id="id3bc25205-d0a3-4a0b-84c2-1c07982b78db"><enum>(b)</enum><header>Contents</header><text>The report under subsection (a) shall include—</text> <paragraph id="id63f221f3-764f-4181-8d84-f6771108e6aa"><enum>(1)</enum><text>a description of any efforts currently underway to test a secure information-sharing system for the purpose described in subsection (a);</text>
 </paragraph><paragraph id="idb100dfff-205d-4450-80bc-b822fb03373e"><enum>(2)</enum><text>a description of any progress in establishing common standards for maintaining, collecting, and presenting pipeline safety regulatory inspection data, and a methodology for the sharing of the data;</text>
 </paragraph><paragraph id="id17faa750-29f9-4003-bb7c-6d4f362e2290"><enum>(3)</enum><text>a description of any existing inadequacies or gaps in State and Federal inspection, enforcement, geospatial, or other pipeline safety regulatory inspection data;</text>
 </paragraph><paragraph id="id49f9b107-2f70-4e84-a1de-9446bcb7355c"><enum>(4)</enum><text>a description of the potential safety benefits of a national integrated pipeline database; and</text>
 </paragraph><paragraph id="id1670bbb1-7433-4172-aaf3-f370554dfe04"><enum>(5)</enum><text>recommendations for how to implement a secure information-sharing system that protects proprietary and security sensitive information and data for the purpose described in subsection (a).</text>
 </paragraph></subsection><subsection id="idc2b68c4f-edfd-44da-b26f-3034b876547a"><enum>(c)</enum><header>Consultation</header><text>In preparing the report under subsection (a), the Secretary shall consult with stakeholders, including each State authority operating under a certification to regulate intrastate pipelines under section 60105 of title 49, United States Code.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSCM00" id="id4951089f-af74-486d-8c2f-0b8bf44c612f" reported-display-style="italic"><enum>16.</enum><header>Underground natural gas storage facilities</header>
 <subsection commented="no" id="idFE55E91F0B6943D38207E441FA4A8E09"><enum>(a)</enum><header>Defined term</header><text>Section 60101(a) is amended—</text> <paragraph commented="no" id="id88861088FCBB45A78A411CF9546E0646"><enum>(1)</enum><text>in paragraph (21)(B), by striking the period at the end and inserting a semicolon;</text>
 </paragraph><paragraph commented="no" id="idA74843BD98C04C4DBB6E10F3DA3DD3C0"><enum>(2)</enum><text>in paragraph (24), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph commented="no" id="id97C4E3B7C0D04BA6BB5890C98B11727D"><enum>(3)</enum><text>in paragraph (25), by striking the period at the end and inserting a semicolon; and</text>
 </paragraph><paragraph commented="no" id="id141F7FB45B694E5DA60AC33BFDC848A7"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id2FBE4852FB324A2795A43338C762149D" reported-display-style="italic" style="OLC"> <paragraph commented="no" id="idCDDFBA1E97234F388D4FF9653FB2BDE2"><enum>(27)</enum><text><term>underground natural gas storage facility</term> means a gas pipeline facility that stores gas in an underground facility, including—</text>
 <subparagraph commented="no" id="idd94d2cfc-b76c-479a-b15e-f560964767b6"><enum>(A)</enum><text>a depleted hydrocarbon reservoir;</text> </subparagraph><subparagraph commented="no" id="id947f60b2-2520-4540-8063-a5b646483d89"><enum>(B)</enum><text>an aquifer reservoir; or</text>
 </subparagraph><subparagraph commented="no" id="idfa2d874c-f197-4f72-89ff-ffd928bb90cf"><enum>(C)</enum><text>a solution mined salt cavern reservoir.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection commented="no" id="id4a50b263-c397-46c1-9ee1-b7e6b446aa25"><enum>(b)</enum><header>Standards for underground natural gas storage facilities</header><text>Chapter 601 is amended by inserting after section 60103 the following:</text>
				<quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id2DCDC9E0809B4B49831F6CCDBBEECBE4" reported-display-style="italic" style="USC">
					<section commented="no" id="idA86EE0BB4A7D4DF4B167C2299A014BF5"><enum>60103A.</enum><header>Standards for underground natural gas storage facilities</header>
 <subsection commented="no" id="idF767DA502794445C93D4B17498D82896"><enum>(a)</enum><header>Minimum uniform safety standards</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of the <short-title>SAFE PIPES Act</short-title>, the Secretary of Transportation, in consultation with the heads of other relevant Federal agencies, shall issue minimum uniform safety standards, incorporating, to the extent practicable, consensus standards for the operation, environmental protection, and integrity management of underground natural gas storage facilities.</text>
 </subsection><subsection commented="no" id="id64ade5fc-f972-4b5d-9f0e-fbed309b97f3"><enum>(b)</enum><header>Considerations</header><text>In developing uniform safety standards under subsection (a), the Secretary shall—</text> <paragraph commented="no" id="id324a16bc-1ace-4440-aca8-26371187c0c0"><enum>(1)</enum><text>consider the economic impacts of the regulations on individual gas customers to the extent practicable;</text>
 </paragraph><paragraph commented="no" id="id3cecf021-5d56-47e4-904d-f37537d7ab8c"><enum>(2)</enum><text>ensure that the regulations do not have a significant economic impact on end users to the extent practicable; and</text>
 </paragraph><paragraph commented="no" id="id197dda6a-02fb-42c8-9ec4-9030110bf425"><enum>(3)</enum><text>consider existing consensus standards.</text> </paragraph></subsection><subsection commented="no" id="id7c9f86dc-7d06-4162-b460-d790ec578fcf"><enum>(c)</enum><header>User fees</header> <paragraph commented="no" id="id091ffcf7-82d8-49aa-b015-4aa6c7f486df"><enum>(1)</enum><header>In general</header><text>A fee shall be imposed on an entity operating an underground natural gas storage facility to which this section applies. Any such fee imposed shall be collected before the end of the fiscal year to which it applies.</text>
 </paragraph><paragraph commented="no" id="id356e621a-7664-4f3c-8025-b3f8bbdbcc75"><enum>(2)</enum><header>Means of collection</header><text>The Secretary shall prescribe procedures to collect fees under this subsection. The Secretary may use a department, agency, or instrumentality of the United States Government or of a State or local government to collect the fee and may reimburse the department, agency, or instrumentality a reasonable amount for its services.</text>
							</paragraph><paragraph commented="no" id="id887e6260-5459-48fb-981c-cf107ed40184"><enum>(3)</enum><header>Use of fees</header>
 <subparagraph commented="no" id="id5f8d8d62-7e36-4856-900b-fb84b6615128"><enum>(A)</enum><header>Account</header><text>There is established an underground natural gas storage facility safety account in the Pipeline Safety Fund established under section 60301, in the Treasury of the United States.</text>
 </subparagraph><subparagraph commented="no" id="id74e9ee77-52ef-4764-b1e6-288732483a8f"><enum>(B)</enum><header>Use of fees</header><text>A fee collected under this subsection—</text> <clause commented="no" id="id97e5cb45-4a47-458e-b3ba-9e3250a265a2"><enum>(i)</enum><text>shall be deposited in the underground natural gas storage facility safety account; and</text>
 </clause><clause commented="no" id="id78f2bbeb-63d3-4609-8a2b-470089e0bfb0"><enum>(ii)</enum><text>if the fee is related to an underground natural gas storage facility, may be used only for an activity related to underground natural gas storage safety under this section.</text>
 </clause></subparagraph><subparagraph commented="no" id="id7fe4c494-e65f-445b-939f-cd48c1088720"><enum>(C)</enum><header>Limitation</header><text>Amounts collected under this subsection shall be made available only to the extent provided in advance in an appropriation law for an activity related to underground natural gas storage safety.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" id="id94b2c80a-c9d2-4679-a532-def5c9453955"><enum>(d)</enum><header>Rules of construction</header>
 <paragraph commented="no" id="id52c8284d-9150-4653-8767-d62643b5054e"><enum>(1)</enum><header>In general</header><text>Nothing in this section may be construed to affect any Federal regulation relating to gas pipeline facilities that is in effect on the day before the date of enactment of the <short-title>SAFE PIPES Act</short-title>.</text>
 </paragraph><paragraph commented="no" id="idcbcf8be6-54d9-4bc4-9453-4c728071bfab"><enum>(2)</enum><header>Limitations</header><text>Nothing in this section may be construed to authorize the Secretary—</text> <subparagraph commented="no" id="idF92E267EB24741E59F0E258876ABB524"><enum>(A)</enum><text>to prescribe the location of an underground natural gas storage facility; or</text>
 </subparagraph><subparagraph commented="no" id="idA549C3AA354F4739B6FC217F7CA537D7"><enum>(B)</enum><text>to require the Secretary’s permission to construct a facility referred to in subparagraph (A).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="idB52B3D129EA84384A5873219B61CC9FB"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for chapter 601 is amended by inserting after the item relating to section 60103 the following:</text>
				<quoted-block changed="added" committee-id="SSCM00" id="idafdd20c0-35e3-4a91-8d76-86161c90a7a2" reported-display-style="italic" style="USC"><toc changed="added" committee-id="SSCM00" reported-display-style="italic"><toc-entry idref="idA86EE0BB4A7D4DF4B167C2299A014BF5" level="section">60103A. Standards for underground natural gas storage facilities.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section changed="added" committee-id="SSCM00" id="idC246C22128204E9698881CA1AEE9AAB6" reported-display-style="italic"><enum>17.</enum><header>Joint inspection and oversight</header><text display-inline="no-display-inline">To ensure the safety of pipeline transportation, the Secretary of Transportation shall coordinate with States to ensure safety through the following:</text>
 <paragraph id="idF98F2C1BFE2945E0B764D0F7364EA9AA"><enum>(1)</enum><text display-inline="yes-display-inline">At the request of a State authority, the Secretary shall allow for a certified state authority under section 60105 of title 49, United States Code, to participate in the inspection of an interstate pipeline facility.</text>
 </paragraph><paragraph id="id07785223AEF443D9A4E5B1A630FEB9BC"><enum>(2)</enum><text display-inline="yes-display-inline">Where appropriate, may provide temporary authority for a certified State authority under that section to participate in oversight of interstate pipeline safety transportation to ensure proper safety oversight and prevent an adverse impact on public safety.</text>
 </paragraph></section><section changed="added" commented="no" committee-id="SSCM00" id="id0295e8c1-d402-46fb-85e6-7f48a5f1dad8" reported-display-style="italic"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">18.</added-phrase></enum><header>Response plans</header><text display-inline="no-display-inline">In preparing or reviewing a response plan under part 194 of title 49, Code of Federal Regulations, the Administrator of the Pipeline and Hazardous Materials Safety Administration and an operator shall each consider, to the maximum extent practicable, the impact of a worse case discharge of oil, or the substantial threat of such a discharge, into or on any navigable waters or adjoining shorelines that may be covered in whole or in part by ice.</text>
 </section><section changed="added" commented="no" committee-id="SSCM00" id="id79bff810-b262-4520-b516-3ee0f64bc35e" reported-display-style="italic"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">19.</added-phrase></enum><header>High consequence areas</header><text display-inline="no-display-inline">The Secretary of Transportation shall revise section 195.6(b) of title 49, Code of Federal Regulations to explicitly state that the Great Lakes are a USA ecological resource (as defined in section 195.6(b) of that title) for purposes of determining whether a pipeline is in a high consequence area (as defined in section 195.450 of that title).</text>
 </section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="id31c9e418-a78d-44e9-8cb0-2c1d7f4e9aea" reported-display-style="italic" section-type="subsequent-section"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">20.</added-phrase></enum><header>Surface transportation security review</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Comptroller General of the United States shall submit a report to Congress on the staffing, resource allocation, oversight strategy, and management of the Transportation Security Administration’s pipeline security program and other surface transportation programs. The report shall include information on the coordination between the Transportation Security Administration, other Federal stakeholders, and industry.</text>
		</section><section changed="added" committee-id="SSCM00" id="id4e23f683757c463eb72ea03148a3b1be" reported-display-style="italic"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">21.</added-phrase></enum><header>Small scale liquefied natural gas facilities</header>
 <subsection id="idd3c27d5ae3d64264a45f21a5702a752a"><enum>(a)</enum><header>Defined term</header><text>Section 60101(a), as amended by section 16, is further amended by inserting after paragraph (25) the following:</text>

 <paragraph id="idbc06e32298964428b434d541896087bf"><enum>(26)</enum><text><term>small scale liquefied natural gas facility</term> means an intrastate liquefied natural gas facility (other than a peak shaving facility) that produces liquefied natural gas for—</text>
 <subparagraph id="id484E55D9564D4DB582A911C772159F1A"><enum>(A)</enum><text>use as a fuel in the United States; or</text> </subparagraph><subparagraph id="idB5A18A79C9124838ACF9CDB89C04632C"><enum>(B)</enum><text>transportation in the United States by a means other than a pipeline facility; and</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id8b1526b13da0455c94ccd2ef31513365"><enum>(b)</enum><header>Siting standards for small scale liquefied natural gas facilities</header><text>Section 60103(a) is amended to read as follows:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id8CEB232603534682A49D98671269924C" reported-display-style="italic" style="OLC"> <subsection id="id0376600E6BD248C389F309EB6E17E406"><enum>(a)</enum><header>Location standards</header> <paragraph id="id3890F9707D4740E0AE9EB1770163F5E1"><enum>(1)</enum><header>In general</header><text>The Secretary of Transportation shall prescribe minimum safety standards for deciding on the location of a new liquefied natural gas pipeline facility or small scale liquefied natural gas facility.</text>
 </paragraph><paragraph id="id2e517cc0045145e8a659dca1e7fe306b"><enum>(2)</enum><header>Liquefied natural gas facilities</header><text>In prescribing a minimum safety standard for deciding on the location of a new liquefied natural gas facility, the Secretary of Transportation shall consider—</text>
 <subparagraph id="idc1f509f4b3444cf4b04b059d5234c0be"><enum>(A)</enum><text>the kind and use of the facility;</text> </subparagraph><subparagraph id="id296cfdb8f0a64d978e71f8fedb4e896f"><enum>(B)</enum><text>the existing and projected population and demographic characteristics of the location;</text>
 </subparagraph><subparagraph id="idb3fb374e78bb4b0ab20b44e31f8e8007"><enum>(C)</enum><text>the existing and proposed land uses near the location;</text> </subparagraph><subparagraph id="idde5d51988ca44b1ea696664596403e01"><enum>(D)</enum><text>the natural physical aspects of the location;</text>
 </subparagraph><subparagraph id="id8fef6d1156324de7984a3de6abb198c1"><enum>(E)</enum><text>medical, law enforcement, and fire prevention capabilities near the location that can cope with a risk caused by the facility; and</text>
 </subparagraph><subparagraph id="idd3e61ac67fb84221b9b67cab86658f7c"><enum>(F)</enum><text>the need to encourage remote siting.</text> </subparagraph></paragraph><paragraph id="id0773227f91954432b934bfeb535b3a59"><enum>(3)</enum><header>Small scale liquefied natural gas facilities</header> <subparagraph id="id8E595ACD1BBB497CA1D2D0486073C871"><enum>(A)</enum><header>In general</header><text>Not later than 18 months after the date of the enactment of the <short-title>SAFE PIPES Act</short-title>, the Secretary of Transportation shall prescribe minimum safety standards for small scale liquefied natural gas facilities.</text>
 </subparagraph><subparagraph id="id82b1609fe2474e74ac990af580eaa1c1"><enum>(B)</enum><header>Considerations</header><text>In prescribing minimum safety standards under this paragraph, the Secretary shall consider—</text> <clause id="id0271a3b5193443bfaabf7c747f98207d"><enum>(i)</enum><text>the value of establishing risk-based approaches;</text>
 </clause><clause id="id05ff0b2f2ceb48fbb063aed823102f9e"><enum>(ii)</enum><text>the benefit of incorporating industry standards and best practices;</text> </clause><clause id="id5079d2bf21f647e4a048505399484c55"><enum>(iii)</enum><text>the need to encourage the use of best available technology; and</text>
 </clause><clause id="id7d85bfaa40da4df2bfa83c6cbf2c286a"><enum>(iv)</enum><text>the factors prescribed in paragraph (2), as appropriate.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section><section changed="added" committee-id="SSCM00" id="id88D39ACF5E494A23916AAE0CFBECBDE6" reported-display-style="italic"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">22.</added-phrase></enum><header>Report on natural gas leak reporting</header> <subsection id="id6a443299474e4e7f8e583bb2e5389f02"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Administrator of the Pipeline and Hazardous Materials Safety Administration shall submit to Congress a report on the metrics provided to the Pipeline and Hazardous Materials Safety Administration and other Federal and State agencies related to lost and unaccounted for natural gas from distribution pipelines and systems.</text>
 </subsection><subsection id="id49005ddcaa354971b7dadef1fdf169c4"><enum>(b)</enum><header>Elements</header><text>The report required under subsection (a) shall include the following elements:</text> <paragraph id="id7ee20b4e6bc2499facfd02c2efe7ee23"><enum>(1)</enum><text>An examination of different reporting requirements or standards for lost and unaccounted for natural gas to different agencies, the reasons for any such discrepancies, and recommendations for harmonizing and improving the accuracy of reporting.</text>
 </paragraph><paragraph id="idff258ea838d04ba081437e8bc704ff5d"><enum>(2)</enum><text>An analysis of whether separate or alternative reporting could better measure the amounts and identify the location of lost and unaccounted for natural gas from natural gas distribution systems.</text>
 </paragraph><paragraph id="id85353ac222d84e28aad307aa8c2314e2"><enum>(3)</enum><text>A description of potential safety issues associated with natural gas that is lost and unaccounted for from natural gas distribution systems.</text>
 </paragraph><paragraph id="id9A82370B1FC64025AE1BE622E21A2DF9"><enum>(4)</enum><text>An assessment of whether alternate reporting and measures will resolve any safety issues identified under paragraph (3), including an analysis of the potential impact, including potential savings, on rate payers and end users of natural gas products of such reporting and measures.</text>
 </paragraph></subsection><subsection id="id261B4E35BB0B4707B4AA64611D8F3F4D"><enum>(c)</enum><header>Consideration of recommendations</header><text>If the Administrator determines that alternate reporting structures or recommendations included in the report required under subsection (a) would significantly improve the reporting and measurement of lost and unaccounted for gas or safety of systems, the Administrator shall, not later than 180 days after making such determination, issue regulations, as the Administrator determines appropriate, to implement the recommendations.</text>
			</subsection></section><section changed="added" committee-id="SSCM00" id="id059fd507483f4fa08ac9fdcb8df6915e" reported-display-style="italic"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">23.</added-phrase></enum><header>Comptroller General review of State policies relating to natural gas leaks</header>
 <subsection id="id9a5d9db411da464ab372aa3d4fc6d206"><enum>(a)</enum><header>Review</header><text>The Comptroller General of the United States shall conduct a State-by-State review of State-level policies that—</text>
 <paragraph id="idc947d03014894e468c75cadf0e393148"><enum>(1)</enum><text>encourage the repair and replacement of leaking natural gas distribution pipelines or systems that pose a safety threat, such as timelines to repair leaks and limits on cost recovery from ratepayers; and</text>
 </paragraph><paragraph id="idcc3627e014214961a18fbeb4f357b003"><enum>(2)</enum><text>that may create barriers for entities to conduct work to repair and replace leaking natural gas pipelines or distribution systems.</text>
 </paragraph></subsection><subsection id="id15a6deb05f0a4efca56fe15444195b6f"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Comptroller General shall submit to Congress and the Pipeline and Hazardous Materials Safety Administration a report summarizing the findings of the review conducted under subsection (a) and making recommendations on Federal or State policies or best practices that may improve safety by accelerating the repair and replacement of natural gas pipelines or systems that are leaking or releasing natural gas, including policies within the jurisdiction of the Pipeline and Hazardous Materials Safety Administration. The report shall consider the potential impact, including potential savings, of the implementation of its recommendations on ratepayers or end users of the natural gas pipeline system.</text>
 </subsection><subsection id="id2d6894cb45ff45749f701462a8c62717"><enum>(c)</enum><header>Consideration of recommendations</header><text>If the Comptroller General makes recommendations in the report submitted under subsection (a) on Federal or State policies or best practices within the jurisdiction of the Pipeline and Hazardous Materials Safety Administration, the Administrator shall, not later than 90 days after such submission, review such recommendations and report to Congress on the feasibility of implementing such recommendations. If the Administrator determines that the recommendations would significantly improve pipeline safety, the Administrator shall, not later than 180 days after making such determination and in coordination with the heads of other relevant agencies as appropriate, issue regulations, as the Administrator determines appropriate, to implement the recommendations.</text>
			</subsection></section><section changed="added" committee-id="SSCM00" id="idF12C13764A124F7FA1356B4EBE8A2B40" reported-display-style="italic"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">24.</added-phrase></enum><header>Provision of pipeline oil spill response plans to congressional committees</header>
 <subsection id="id813F95394A1D47CDA81EBE20290CF935"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Administrator of the Pipeline and Hazardous Materials Safety Administration shall, upon request of the Chairman or Ranking Member of an appropriate congressional committee, provide to such committee full and unredacted copies of oil spill response plans.</text>
 </subsection><subsection id="idDEAB1F82DAB440E793115C76AF6CBF40"><enum>(b)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text> <paragraph id="id634282FE1C9A4A1F9363A00B7EC6CBB1"><enum>(1)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; and</text>
 </paragraph><paragraph id="id7444D6A7D01B4D02AD8F1B5214EE9C71"><enum>(2)</enum><text>the Committee on Transportation and Infrastructure and the Committee on Energy and Commerce of the House of Representatives.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSCM00" id="id773833AA8F334828A1F4B6FCB04F475A" reported-display-style="italic"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">25.</added-phrase></enum><header>Consultation with FERC as part of pre-filing procedures and permitting process for new natural gas
 pipeline infrastructure</header><text display-inline="no-display-inline">The Administrator of the Pipeline and Hazardous Materials Safety Administration shall consult with the Federal Energy Regulatory Commission during its pre-filing procedures and permitting process for new natural gas pipeline infrastructure to ensure the protection of people and the environment from the risks of hazardous materials transportation.</text></section></legis-body><endorsement><action-date>February 24, 2016</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
