			 Trafficking Victims' Fund</header>
			<subsection id="id0427E339594C4E7D935B06381040EF49"><enum>(a)</enum><header>In
 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/201">Chapter 201</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

					<section id="id45F5C465A9704F92B651E3BEC60512BB"><enum>3014.</enum><header>Additional
				special assessment</header>
 <subsection id="id2AAFDA4C2F6F439482E07C1E4A300557"><enum>(a)</enum><header>In general</header><text>In addition to the assessment imposed under section 3013, the court shall assess an amount of $5,000 on any non-indigent person or entity convicted of an offense under—</text>
 <paragraph id="idA7849487EDF64128AADBE4A823977290"><enum>(1)</enum><text>chapter 77 (relating to peonage, slavery, and trafficking in persons);</text>
 </paragraph><paragraph id="id530910B6AB904EAE893CD1D17B415C91"><enum>(2)</enum><text>chapter 109A (relating to sexual abuse);</text>
 </paragraph><paragraph id="id423D28CE7A5E44C7872A3B70C5F53A9D"><enum>(3)</enum><text>chapter 110 (relating to sexual exploitation and other abuse of children);</text>
 </paragraph><paragraph id="idEF8CCBC13057444FB17473F9FCBC72F2"><enum>(4)</enum><text>chapter 117 (relating to transportation for illegal sexual activity and related crimes); or</text>
 </paragraph><paragraph id="idA156633C170649C299941BEAB2E82D0F"><enum>(5)</enum><text>section 274 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324</external-xref>) (relating to human smuggling), unless the person induced, assisted, abetted, or aided only an individual who at the time of such action was the alien’s spouse, parent, son, or daughter (and no other individual) to enter the United States in violation of law.</text>
 </paragraph></subsection><subsection id="idD801AE004D7348C69C46DBD75744C8A7"><enum>(b)</enum><header>Satisfaction of other court-Ordered obligations</header><text>An assessment under subsection (a) shall not be payable until the person subject to the assessment has satisfied all outstanding court-ordered fines and orders of restitution arising from the criminal convictions on which the special assessment is based.</text>
 </subsection><subsection id="id78ECB56F582B447C98E25614504FEC39"><enum>(c)</enum><header>Establishment of Domestic Trafficking Victims' Fund</header><text>There is established in the Treasury of the United States a fund, to be known as the <quote>Domestic Trafficking Victims' Fund</quote> (referred to in this section as the <term>Fund</term>), to be administered by the Attorney General, in consultation with the Secretary of Homeland Security and the Secretary of Health and Human Services.</text>
 </subsection><subsection id="id81BFAE1B6688414191328EC9D8B0970C"><enum>(d)</enum><header>Deposits</header><text>Notwithstanding section 3302 of title 31, or any other law regarding the crediting of money received for the Government, there shall be deposited in the Fund an amount equal to the amount of the assessments collected under this section, which shall remain available until expended.</text>
						</subsection><subsection id="id07A8B6CBC387425184DF0E2CEE4A5411"><enum>(e)</enum><header>Use of funds</header>
 <paragraph id="idA87F3FB266564E1EAA75DE6117AEADB9"><enum>(1)</enum><header>In general</header><text>From amounts in the Fund, in addition to any other amounts available, and without further appropriation, the Attorney General, in coordination with the Secretary of Health and Human Services shall, for each of fiscal years 2016 through 2020, use amounts available in the Fund to award grants or enhance victims' programming under—</text>
 <subparagraph id="idC3040A73E96649C1AC13F609A7246DC3"><enum>(A)</enum><text>sections 202, 203, and 204 of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/14044a">42 U.S.C. 14044a</external-xref>, 14044b, and 14044c);</text>
 </subparagraph><subparagraph id="idB444E003311C41A9BA4F966C39B08DEE"><enum>(B)</enum><text>subsections (b)(2) and (f) of section 107 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105</external-xref>); and</text>
 </subparagraph><subparagraph id="id4E618D9C733746D0811E2B4867DA5143"><enum>(C)</enum><text>section 214(b) of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13002">42 U.S.C. 13002(b)</external-xref>).</text> </subparagraph></paragraph><paragraph id="idF5B05DA7BC874CCB8E99FFB582A7351E"><enum>(2)</enum><header>Grants</header><text>Of the amounts in the Fund used under paragraph (1), not less than $2,000,000 shall be used for grants to provide services for child pornography victims under section 214(b) of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13002">42 U.S.C. 13002(b)</external-xref>).</text>
 </paragraph><paragraph id="id8C7D4B78F11E4103A1A8CED0E28862FE"><enum>(3)</enum><header>Limitations</header><text>Amounts in the Fund, or otherwise transferred from the Fund, shall be subject to the limitations on the use or expending of amounts described in sections 506 and 507 of division H of the Consolidated Appropriations Act, 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/76">Public Law 113–76</external-xref>; 128 Stat. 409) to the same extent as if amounts in the Fund were funds appropriated under division H of such Act.</text>
							</paragraph></subsection><subsection id="id3dc0ca2a221b4d32af0208b598bbe3a8"><enum>(f)</enum><header>Transfers</header>
 <paragraph id="id5DA4B880C4B54E6C94B11DD7ABFA9ADB"><enum>(1)</enum><header>In general</header><text>Effective on the day after the date of enactment of the <short-title>Justice for Victims of Trafficking Act of 2015</short-title>, on September 30 of each fiscal year, all unobligated balances in the Fund shall be transferred to the Crime Victims Fund established under section 1402 of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/10601">42 U.S.C. 10601</external-xref>).</text>
 </paragraph><paragraph id="idBF2A29467DC3430DB1683B56C1FBA000"><enum>(2)</enum><header>Availability</header><text>Amounts transferred under paragraph (1)—</text>
 <subparagraph id="id75F363B372CE442682AEA032D58B979D"><enum>(A)</enum><text>shall be available for any authorized purpose of the Crime Victims Fund; and</text>
 </subparagraph><subparagraph id="id756458A545044A65A13165286C1FC12E"><enum>(B)</enum><text>shall remain available until expended.</text>
 </subparagraph></paragraph></subsection><subsection id="id8695604682FB40C5B18D78E71600273B"><enum>(g)</enum><header>Collection method</header><text>The amount assessed under subsection (a) shall, subject to subsection (b), be collected in the manner that fines are collected in criminal cases.</text>
 </subsection><subsection id="id810CDD9ECFAD4E50A0D61B41FD6A7545"><enum>(h)</enum><header>Duration of obligation</header><text>The obligation to pay an assessment imposed on or after the date of enactment of the <short-title>Justice for Victims of Trafficking Act of 2015</short-title> shall not cease until the assessment is paid in full.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idCC8158EF68124ABCA711298054CC790F"><enum>(b)</enum><header>Technical and
 conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/201">chapter 201</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/3013">section 3013</external-xref> the following:</text>
				<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id56E93FCEDA6F4E1D8E5F470124F0366E" reported-display-style="strikethrough" style="OLC"><toc changed="deleted" committee-id="SSJU00" reported-display-style="strikethrough"><toc-entry bold="off" level="section">3014. Additional special
				assessment.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section changed="deleted" committee-id="SSJU00" id="idC55FFF20213B4066AF6A357B0DC98FBC" reported-display-style="strikethrough"><enum>3.</enum><header>Official recognition  of
 American victims of human trafficking</header><text display-inline="no-display-inline">Section 107 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105</external-xref>) is amended—</text> <paragraph id="id4EECA202C5154F21BFA8BA5D4759A701"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (f) (as originally enacted), as subsection (h); and</text>
 </paragraph><paragraph id="idC8C6FFC6A08D40AEB1E0D0A35E9B20D1"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (f) (as added by section 213(a)(1) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/457">Public Law 110–457</external-xref>)), by adding at the end the following:</text>
				<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="idca26cb666d1444e7aba9f4165d96ed78" reported-display-style="strikethrough" style="OLC">
					<paragraph id="id7d392617e7ce41e5b6f3836414980dd6"><enum>(4)</enum><header>Official recognition of american victims of human trafficking</header>
 <subparagraph id="id73a76c79a83c433791f6165141593648"><enum>(A)</enum><header>In general</header><text>Upon receiving credible information that establishes, by a preponderance of the evidence, that a covered individual is a victim of a severe form of trafficking and at the request of the covered individual, the Secretary of Health and Human Services shall promptly issue a determination that the covered individual is a victim of a severe form of trafficking. The Secretary shall have exclusive authority to make such a determination.</text>
 </subparagraph><subparagraph id="idf9da4469f92643a28becfe08912a406d"><enum>(B)</enum><header>Covered individual defined</header><text>In this subsection, the term <term>covered individual</term> means—</text> <clause id="iddca9725fed134789a517fb40ddeb7e84"><enum>(i)</enum><text>a citizen of the United States; or</text>
 </clause><clause id="id622c9595eaf74266b7400f2195bc5ff2"><enum>(ii)</enum><text>an alien lawfully admitted for permanent residence (as defined in section 101(20) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(20)</external-xref>)).</text>
 </clause></subparagraph><subparagraph id="id69a596c5b6684ac9ab271bee84a30bdd"><enum>(C)</enum><header>Procedure</header><text>For purposes of this paragraph, in determining whether a covered individual has provided credible information that the covered individual is a victim of a severe form of trafficking, the Secretary of Health and Human Services shall consider all relevant and credible evidence, and if appropriate, consult with the Attorney General, the Secretary of Homeland Security, or the Secretary of Labor.</text>
 </subparagraph><subparagraph id="id39b649ebef1d42078a5171b093094eda"><enum>(D)</enum><header>Presumptive evidence</header><text>For purposes of this paragraph, the following forms of evidence shall receive deference in determining whether a covered individual has established that the covered individual is a victim of a severe form of trafficking:</text>
 <clause id="idb711778b093a4b3dbd45e85a7140e7d2"><enum>(i)</enum><text>A sworn statement by the covered individual or a representative of the covered individual if the covered individual is present at the time of such statement but not able to competently make such sworn statement.</text>
 </clause><clause id="id8e9162bfdca0472b9df48ee3b1599b49"><enum>(ii)</enum><text>Police, government agency, or court records or files.</text> </clause><clause id="idb453a15f2e7e405ca003a5e43f9e090a"><enum>(iii)</enum><text>Documentation from a social services, trafficking, or domestic violence program, child welfare or runaway and homeless youth program, or a legal, clinical, medical, or other professional from whom the covered individual has sought assistance in dealing with the crime.</text>
 </clause><clause id="id6a813b2cdc3a42aa8dff06c88d4ac28d"><enum>(iv)</enum><text>A statement from any other individual with knowledge of the circumstances that provided the basis for the claim.</text>
 </clause><clause id="id6c5ef8c173d04ebf92280db9c0a0df1e"><enum>(v)</enum><text>Physical evidence.</text> </clause></subparagraph><subparagraph id="id233c516e8f4242efa700f72c901a5578"><enum>(E)</enum><header>Regulations required</header><text>Not later than 18 months after the date of enactment of the <short-title>Justice for Victims of Trafficking Act of 2015</short-title>, the Secretary of Health and Human Services shall adopt regulations to implement this paragraph.</text>
 </subparagraph><subparagraph id="id9b2e2c9cee7d49d796779f8751c15478"><enum>(F)</enum><header>Rule of construction; official recognition optional</header><text>Nothing in this paragraph may be construed to require a covered individual to obtain a determination under this paragraph in order to be defined or classified as a victim of a severe form of trafficking under this section.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="deleted" commented="no" committee-id="SSJU00" id="idD9414939A3FA4903B8F0EE3A6DD31A7E" reported-display-style="strikethrough"><enum>4.</enum><header>Victim-centered
			 child human trafficking deterrence block grant program</header>
 <subsection commented="no" id="idDC8521FAA58C4FFD8263D417BB9E76A0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 203 of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/14044b">42 U.S.C. 14044b</external-xref>) is amended to read as follows:</text>

					<section id="id2BCCD7B660404A878A79227B30A6B380"><enum>203.</enum><header>Victim-centered
				child human trafficking deterrence block grant program</header>
						<subsection id="id8CBD496FD86947D9BE2F24B25ACE876F"><enum>(a)</enum><header>Grants
 authorized</header><text>The Attorney General may award block grants to an eligible entity to develop, improve, or expand domestic child human trafficking deterrence programs that assist law enforcement officers, prosecutors, judicial officials, and qualified victims' services organizations in collaborating to rescue and restore the lives of victims, while investigating and prosecuting offenses involving child human trafficking.</text>
						</subsection><subsection id="id9A40DF8A01DB42FA9A1D696FA5C1C4C6"><enum>(b)</enum><header>Authorized
 activities</header><text>Grants awarded under subsection (a) may be used for—</text>
 <paragraph id="id580f3509618a44cfa0b87a023dcebc2a"><enum>(1)</enum><text>the establishment or enhancement of specialized training programs for law enforcement officers, first responders, health care officials, child welfare officials, juvenile justice personnel, prosecutors, and judicial personnel to—</text>
 <subparagraph id="id857c8f71c651485f9dbd418c2dc13cff"><enum>(A)</enum><text>identify victims and acts of child human trafficking;</text>
 </subparagraph><subparagraph id="idde0125e85ff3453890636692252f8031"><enum>(B)</enum><text>address the unique needs of child victims of human trafficking;</text>
 </subparagraph><subparagraph id="id1965d96b717c452487a00a407c68f9e4"><enum>(C)</enum><text>facilitate the rescue of child victims of human trafficking;</text>
 </subparagraph><subparagraph id="id964f93d007514052bdb0af7800cc2b9d"><enum>(D)</enum><text>investigate and prosecute acts of human trafficking, including the soliciting, patronizing, or purchasing of commercial sex acts from children, as well as training to build cases against complex criminal networks involved in child human trafficking;</text>
 </subparagraph><subparagraph id="idb26fff67add74baaa67b97914bd01874"><enum>(E)</enum><text>use laws that prohibit acts of child human trafficking, child sexual abuse, and child rape, and to assist in the development of State and local laws to prohibit, investigate, and prosecute acts of child human trafficking; and</text>
 </subparagraph><subparagraph id="id7add5ccbe5f7456d879f5b41b913a9bf"><enum>(F)</enum><text>implement and provide education on safe harbor laws enacted by States, aimed at preventing the criminalization and prosecution of child sex trafficking victims for prostitution offenses;</text>
 </subparagraph></paragraph><paragraph id="id53fac74e436844d4ac6cd31c9d1e6380"><enum>(2)</enum><text>the establishment or enhancement of dedicated anti-trafficking law enforcement units and task forces to investigate child human trafficking offenses and to rescue victims, including—</text>
 <subparagraph id="idda9b16035cf448c4beff7ff252e1fd5e"><enum>(A)</enum><text>funding salaries, in whole or in part, for law enforcement officers, including patrol officers, detectives, and investigators, except that the percentage of the salary of the law enforcement officer paid for by funds from a grant awarded under this section shall not be more than the percentage of the officer’s time on duty that is dedicated to working on cases involving child human trafficking;</text>
 </subparagraph><subparagraph id="id51e3aba2fb274cf0876e65812e374f77"><enum>(B)</enum><text>investigation expenses for cases involving child human trafficking, including—</text>
 <clause id="idc9e7143b2fe746dc99ae7fc3779eda89"><enum>(i)</enum><text>wire taps;</text> </clause><clause id="id9a20c8ab5be94fd0b99d29fae6343e05"><enum>(ii)</enum><text>consultants with expertise specific to cases involving child human trafficking;</text>
 </clause><clause id="id1e596b0881574f619eae2ae15dfa332d"><enum>(iii)</enum><text>travel; and</text>
 </clause><clause id="id7ee4878955334470b76f7bea836bdd47"><enum>(iv)</enum><text>other technical assistance expenditures;</text>
 </clause></subparagraph><subparagraph id="id0d6f609d3b574c58933875ff4b6c5ebd"><enum>(C)</enum><text>dedicated anti-trafficking prosecution units, including the funding of salaries for State and local prosecutors, including assisting in paying trial expenses for prosecution of child human trafficking offenders, except that the percentage of the total salary of a State or local prosecutor that is paid using an award under this section shall be not more than the percentage of the total number of hours worked by the prosecutor that is spent working on cases involving child human trafficking;</text>
 </subparagraph><subparagraph id="id61cee2440fb44028a131ef10d90bfe3f"><enum>(D)</enum><text>the establishment of child human trafficking victim witness safety, assistance, and relocation programs that encourage cooperation with law enforcement investigations of crimes of child human trafficking by leveraging existing resources and delivering child human trafficking victims’ services through coordination with—</text>
 <clause id="idc104783c2da2441fb1d36e328b2791be"><enum>(i)</enum><text>child advocacy centers;</text>
 </clause><clause id="idbaaee5f6f7804d99aab9f325aa0e49d2"><enum>(ii)</enum><text>social service agencies;</text>
 </clause><clause id="id8f9318d88bdc403b970798a6a84034c7"><enum>(iii)</enum><text>State governmental health service agencies;</text>
 </clause><clause id="idf7c3c3465d7341d4aa8b01dc25518610"><enum>(iv)</enum><text>housing agencies;</text>
 </clause><clause id="id22d25553aa5e41468b1da230e849e9cf"><enum>(v)</enum><text>legal services agencies; and</text>
 </clause><clause id="id71c01bf922bc428d882f5a1500c6970a"><enum>(vi)</enum><text>nongovernmental organizations and shelter service providers with substantial experience in delivering wrap-around services to victims of child human trafficking; and</text>
 </clause></subparagraph><subparagraph id="id54D953402B534C79A5E1D0FF528FF356"><enum>(E)</enum><text>the establishment or enhancement of other necessary victim assistance programs or personnel, such as victim or child advocates, child-protective services, child forensic interviews, or other necessary service providers; and</text>
 </subparagraph></paragraph><paragraph id="id1d1ac15fd1ad48f5929153e8c452a489"><enum>(3)</enum><text>the establishment or enhancement of problem solving court programs for trafficking victims that include—</text>
 <subparagraph id="id0ab7a1532e764392a2a4f114522fa027"><enum>(A)</enum><text>mandatory and regular training requirements for judicial officials involved in the administration or operation of the court program described under this paragraph;</text>
 </subparagraph><subparagraph id="id1997fa7120804c2ea6b6c6d131780728"><enum>(B)</enum><text>continuing judicial supervision of victims of child human trafficking who have been identified by a law enforcement or judicial officer as a potential victim of child human trafficking, regardless of whether the victim has been charged with a crime related to human trafficking;</text>
 </subparagraph><subparagraph id="id74b9926275c046d7b2230de87372b79a"><enum>(C)</enum><text>the development of a specialized and individualized, court-ordered treatment program for identified victims of child human trafficking, including—</text>
 <clause id="id9bc9875d270248aa9c44c3ac5e78cfb6"><enum>(i)</enum><text>State-administered outpatient treatment;</text>
 </clause><clause id="idc6eb3eee616142609202553580d05827"><enum>(ii)</enum><text>life skills training;</text>
 </clause><clause id="idf09dcd60d18c4e23b36de47cea0f7d0a"><enum>(iii)</enum><text>housing placement;</text>
 </clause><clause id="ida3c0d29ee34b44d5b72a1a439ae8fd82"><enum>(iv)</enum><text>vocational training;</text>
 </clause><clause id="id735e86910ce34e48b745611472740034"><enum>(v)</enum><text>education;</text> </clause><clause id="id7457db3a2bc04e90992ac26108ca2ade"><enum>(vi)</enum><text>family support services; and</text>
 </clause><clause id="idabdeab095adc4862b7ad1654fc6c3bcf"><enum>(vii)</enum><text>job placement;</text>
 </clause></subparagraph><subparagraph id="ida409c4862ad0480e9d7047fa65e07e1e"><enum>(D)</enum><text>centralized case management involving the consolidation of all of each child human trafficking victim’s cases and offenses, and the coordination of all trafficking victim treatment programs and social services;</text>
 </subparagraph><subparagraph id="idec761acbfb584a80acf58b8a0d512f3d"><enum>(E)</enum><text>regular and mandatory court appearances by the victim during the duration of the treatment program for purposes of ensuring compliance and effectiveness;</text>
 </subparagraph><subparagraph id="ida928d084000441dc8cb159851e8d4b52"><enum>(F)</enum><text>the ultimate dismissal of relevant non-violent criminal charges against the victim, where such victim successfully complies with the terms of the court-ordered treatment program; and</text>
 </subparagraph><subparagraph id="id7fcbaab4e68d4725ae6c259a86641f29"><enum>(G)</enum><text>collaborative efforts with child advocacy centers, child welfare agencies, shelters, and nongovernmental organizations with substantial experience in delivering wrap-around services to victims of child human trafficking to provide services to victims and encourage cooperation with law enforcement.</text>
								</subparagraph></paragraph></subsection><subsection id="idCD11D951E6B54FF2BB96CBAB3E492BC0"><enum>(c)</enum><header>Application</header>
							<paragraph id="id23190698F80A42A9B3D4BB76EC794CDD"><enum>(1)</enum><header>In
 general</header><text>An eligible entity shall submit an application to the Attorney General for a grant under this section in such form and manner as the Attorney General may require.</text>
							</paragraph><paragraph id="id5830A7E48BB34FDBB527A8E347B891CE"><enum>(2)</enum><header>Required
 information</header><text>An application submitted under this subsection shall—</text>
 <subparagraph id="id700F8A0D31F4453591ED4F9BE747F73D"><enum>(A)</enum><text>describe the activities for which assistance under this section is sought;</text>
 </subparagraph><subparagraph id="id5a7b1dacd58e41bd949f4475c4090195"><enum>(B)</enum><text>include a detailed plan for the use of funds awarded under the grant;</text>
 </subparagraph><subparagraph id="id7a035f2b03a349ca9fbdde08a5404911"><enum>(C)</enum><text>provide such additional information and assurances as the Attorney General determines to be necessary to ensure compliance with the requirements of this section; and</text>
 </subparagraph><subparagraph id="idB68CF05A0C3C43E08CBFA90483A634A2"><enum>(D)</enum><text>disclose—</text> <clause id="id93BE1C69D4AD4F85BDCB07C7564F3FFB"><enum>(i)</enum><text>any other grant funding from the Department of Justice or from any other Federal department or agency for purposes similar to those described in subsection (b) for which the eligible entity has applied, and which application is pending on the date of the submission of an application under this section; and</text>
 </clause><clause id="id28114D3801E74C68991CF6380D6F7BBB"><enum>(ii)</enum><text>any other such grant funding that the eligible entity has received during the 5-year period ending on the date of the submission of an application under this section.</text>
 </clause></subparagraph></paragraph><paragraph id="id1ace81bd07ae4319851198e13c6c3454"><enum>(3)</enum><header>Preference</header><text>In reviewing applications submitted in accordance with paragraphs (1) and (2), the Attorney General shall give preference to grant applications if—</text>
 <subparagraph id="id2acdc1abb23641c798b247d5cd408d4c"><enum>(A)</enum><text>the application includes a plan to use awarded funds to engage in all activities described under paragraphs (1) through (3) of subsection (b); or</text>
 </subparagraph><subparagraph id="idc95779886805411aa0298e8b78cd2fd0"><enum>(B)</enum><text>the application includes a plan by the State or unit of local government to continue funding of all activities funded by the award after the expiration of the award.</text>
								</subparagraph></paragraph></subsection><subsection id="id1c9762c5e164480fa9f0cbb428029183"><enum>(d)</enum><header>Duration and
				renewal of award</header>
							<paragraph id="id9498719415e9438a95f4ebcc86f355e6"><enum>(1)</enum><header>In
 general</header><text>A grant under this section shall expire 3 years after the date of award of the grant.</text>
 </paragraph><paragraph id="id66a2e422dc2c4d4b95ec605a728cd332"><enum>(2)</enum><header>Renewal</header><text>A grant under this section shall be renewable not more than 2 times and for a period of not greater than 2 years.</text>
 </paragraph></subsection><subsection id="idC4B2123BB37A42838F319959A2492363"><enum>(e)</enum><header>Evaluation</header><text>The Attorney General shall—</text>
 <paragraph id="id7DBB418A0AF846D68B31B59E304D706B"><enum>(1)</enum><text>enter into a contract with a nongovernmental organization, including an academic or nonprofit organization, that has experience with issues related to child human trafficking and evaluation of grant programs to conduct periodic evaluations of grants made under this section to determine the impact and effectiveness of programs funded with grants awarded under this section; and</text>
 </paragraph><paragraph id="id03CC8B555E7C4AD5B66C616675E47281"><enum>(2)</enum><text>submit the results of any evaluation conducted pursuant to paragraph (1) to—</text> <subparagraph id="id0E8AA9AE12B0417F861F9D3EC3544C1D"><enum>(A)</enum><text>the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>; and</text>
 </subparagraph><subparagraph id="id97F27761343D468EB1CA65C5D40C360D"><enum>(B)</enum><text>the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>.</text> </subparagraph></paragraph></subsection><subsection id="ide20e78c58c2744d1a4ebc118d7ae4226"><enum>(f)</enum><header>Mandatory exclusion</header><text>An eligible entity awarded funds under this section that is found to have used grant funds for any unauthorized expenditure or otherwise unallowable cost shall not be eligible for any grant funds awarded under the block grant for 2 fiscal years following the year in which the unauthorized expenditure or unallowable cost is reported.</text>
						</subsection><subsection id="id27ea229783f54ff3b9beccffd4fd0b53"><enum>(g)</enum><header>Compliance
 requirement</header><text>An eligible entity shall not be eligible to receive a grant under this section if within the 5 fiscal years before submitting an application for a grant under this section, the grantee has been found to have violated the terms or conditions of a Government grant program by utilizing grant funds for unauthorized expenditures or otherwise unallowable costs.</text>
						</subsection><subsection id="idede6f3869c4340c486103016983f9478"><enum>(h)</enum><header>Administrative
 cap</header><text>The cost of administering the grants authorized by this section shall not exceed 5 percent of the total amount expended to carry out this section.</text>
						</subsection><subsection id="id2325bd1bf7a54b2d86315c0feb934a59"><enum>(i)</enum><header>Federal
 share</header><text>The Federal share of the cost of a program funded by a grant awarded under this section shall be—</text>
 <paragraph id="idF7961D520B8946B78AF2FF3EA033DF89"><enum>(1)</enum><text>70 percent in the first year;</text>
 </paragraph><paragraph id="idB411C41D03EB4402B6F764BF3AA3F789"><enum>(2)</enum><text>60 percent in the second year; and</text>
 </paragraph><paragraph id="id75FD9E4718A240C1A998990A9FFC4B0D"><enum>(3)</enum><text>50 percent in the third year, and in all subsequent years.</text>
							</paragraph></subsection><subsection id="id66168e15e2114194870c245bef74ef0a"><enum>(j)</enum><header>Authorization
 of funding; fully offset</header><text>For purposes of carrying out this section, the Attorney General, in consultation with the Secretary of Health and Human Services, is authorized to award not more than $7,000,000 of the funds available in the Domestic Trafficking Victims’ Fund, established under section 3014 of title 18, United States Code, for each of fiscal years 2016 through 2020.</text>
 </subsection><subsection id="id0eaef3f730b9436bb66cc7a65026cb15"><enum>(k)</enum><header>Definitions</header><text>In this section—</text>
 <paragraph id="id5871dd6c90d04ecd80ed1703846686cd"><enum>(1)</enum><text>the term <term>child</term> means a person under the age of 18;</text>
 </paragraph><paragraph id="id609e36fc5e47458cb8ee7f71cd368628"><enum>(2)</enum><text>the term <term>child advocacy center</term> means a center created under subtitle A of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13001">42 U.S.C. 13001 et seq.</external-xref>);</text>
 </paragraph><paragraph id="id291eecc35b0d42abba58cc7a810f0f41"><enum>(3)</enum><text>the term <term>child human trafficking</term> means 1 or more severe forms of trafficking in persons (as defined in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>)) involving a victim who is a child; and</text>
 </paragraph><paragraph id="idb05e4faefd3241d6b7fe15da85eb3d4d"><enum>(4)</enum><text>the term <term>eligible entity</term> means a State or unit of local government that—</text>
 <subparagraph id="id68e0752aa9114fdca67deab98fc57a43"><enum>(A)</enum><text>has significant criminal activity involving child human trafficking;</text>
 </subparagraph><subparagraph id="id13e05e569c974b77a183998e1f7eac21"><enum>(B)</enum><text>has demonstrated cooperation between Federal, State, local, and, where applicable, tribal law enforcement agencies, prosecutors, and social service providers in addressing child human trafficking;</text>
 </subparagraph><subparagraph id="idaf1b90468c044eaa89dab3ca5add2914"><enum>(C)</enum><text>has developed a workable, multi-­disciplinary plan to combat child human trafficking, including—</text>
 <clause id="id2aca9260db1d41a892829ddb3498a309"><enum>(i)</enum><text>the establishment of a shelter for victims of child human trafficking, through existing or new facilities;</text>
 </clause><clause id="id0b3657f051e04c0196bb4fdef1c7de1d"><enum>(ii)</enum><text>the provision of trauma-­informed, gender-responsive rehabilitative care to victims of child human trafficking;</text>
 </clause><clause id="idde0549d131c34807857a937b453f5c5d"><enum>(iii)</enum><text>the provision of specialized training for law enforcement officers and social service providers for all forms of human trafficking, with a focus on domestic child human trafficking;</text>
 </clause><clause id="idc408c70204af4296bc4a7dc51f1bd671"><enum>(iv)</enum><text>prevention, deterrence, and prosecution of offenses involving child human trafficking, including soliciting, patronizing, or purchasing human acts with children;</text>
 </clause><clause id="idcd0b8d56d30b4dc699c5915e850286fa"><enum>(v)</enum><text>cooperation or referral agreements with organizations providing outreach or other related services to runaway and homeless youth;</text>
 </clause><clause id="idf6c0112534c14f93a95a654066ed3437"><enum>(vi)</enum><text>law enforcement protocols or procedures to screen all individuals arrested for prostitution, whether adult or child, for victimization by sex trafficking and by other crimes, such as sexual assault and domestic violence; and</text>
 </clause><clause id="idf786e0a8589e4ecc98095ee0ddf1a8df"><enum>(vii)</enum><text>cooperation or referral agreements with State child welfare agencies and child advocacy centers; and</text>
 </clause></subparagraph><subparagraph id="idf597bf03156444348198055007fba3c8"><enum>(D)</enum><text>provides an assurance that, under the plan under subparagraph (C), a victim of child human trafficking shall not be required to collaborate with law enforcement officers to have access to any shelter or services provided with a grant under this section.</text>
 </subparagraph></paragraph></subsection><subsection id="id95c24095b8064204adb00b05f06b95fc"><enum>(l)</enum><header>Grant accountability; specialized victims’ service requirement</header><text>No grant funds under this section may be awarded or transferred to any entity unless such entity has demonstrated substantial experience providing services to victims of human trafficking or related populations (such as runaway and homeless youth), or employs staff specialized in the treatment of human trafficking victims.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="id2FEE96DC1870458C9C2ADE63ED6225AF"><enum>(b)</enum><header>Table of contents</header><text>The table of contents in section 1(b) of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/22/7101">22 U.S.C. 7101</external-xref> note) is amended by striking the item relating to section 203 and inserting the following:</text>

 <paragraph commented="no" id="idC541C4F35B0E4E47ABCED9B311C3FC10"><enum>(1)</enum><text display-inline="yes-display-inline">in section 212(5) (<external-xref legal-doc="usc" parsable-cite="usc/42/13001a">42 U.S.C. 13001a(5)</external-xref>), by inserting <quote>, including human trafficking and the production of child pornography</quote> before the semicolon at the end; and</text>
 </paragraph><paragraph id="id9171b6313e8b4bb78d8047aa66f164b9"><enum>(2)</enum><text>in section 214 (<external-xref legal-doc="usc" parsable-cite="usc/42/13002">42 U.S.C. 13002</external-xref>)—</text> <subparagraph id="idc5adcdbc6cff49af82fe988ae2a3afa5"><enum>(A)</enum><text>by redesignating subsections (b), (c), and (d) as subsections (c), (d), and (e), respectively; and</text>

 <subsection id="id2d733447c40046caad82b88ba122a170"><enum>(a)</enum><header>Amendments to title 18</header><text>Section 1594 of title 18, United States Code, is amended—</text>
 <paragraph id="ida76f2eee3eef4be19a73494161e49383"><enum>(1)</enum><text>in subsection (d)—</text> <subparagraph id="id81bbd707059d4eeeb3668c1be2d92f7a"><enum>(A)</enum><text>in paragraph (1)—</text>
 <clause id="id7cc4eda46f1b4b85b1d75450623c939f"><enum>(i)</enum><text>by striking <quote>that was used or</quote> and inserting <quote>that was involved in, used, or</quote>; and</text> </clause><clause id="idfc63ba51c56149629e2ab961b74d71e5"><enum>(ii)</enum><text>by inserting <quote>, and any property traceable to such property</quote> after <quote>such violation</quote>; and</text>

 <paragraph id="id28BE5D2F5D22496F892990A6B134FDD0"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Attorney General shall transfer assets forfeited pursuant to this section, or the proceeds derived from the sale thereof, to satisfy victim restitution orders arising from violations of this chapter.</text>
 </paragraph><paragraph id="id4F507DC19F884EEE9444AD4C77965DEB"><enum>(2)</enum><header>Priority</header><text>Transfers pursuant to paragraph (1) shall have priority over any other claims to the assets or their proceeds.</text>
 </paragraph><paragraph id="id4A31CD8A399A409283FF4DD7A8346CD9"><enum>(3)</enum><header>Use of non-forfeited assets</header><text>Transfers pursuant to paragraph (1) shall not reduce or otherwise mitigate the obligation of a person convicted of a violation of this chapter to satisfy the full amount of a restitution order through the use of non-forfeited assets or to reimburse the Attorney General for the value of assets or proceeds transferred under this subsection through the use of non-forfeited assets.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id57072843577d4a1684aa3f806cd36e02"><enum>(b)</enum><header>Amendment to title 28</header><text>Section 524(c)(1)(B) of title 28, United States Code, is amended by inserting <quote>chapter 77 of title 18,</quote> after <quote>criminal drug laws of the United States or of</quote>.</text>
			</subsection><subsection id="id25225fc32de640de9f81be6cce8f84b2"><enum>(c)</enum><header>Amendments to title 31</header>

 </paragraph><paragraph id="id6C739ED80A5140AB8B13CAEC9F735F5F"><enum>(2)</enum><text display-inline="yes-display-inline">all components and task forces with jurisdiction to detect, investigate, and prosecute cases of child labor trafficking engage in activities, programs, or operations to increase the capacity of such components to deter and punish child labor trafficking.</text>

 <paragraph id="id4C34E7CC3CD342E5B5D55BAD24CB9BBB"><enum>(1)</enum><header>In general</header><text>Section 3771(d)(3) of title 18, United States Code, as amended by subsection (a)(2) of this section, is amended by inserting after the fifth sentence the following: <quote>In deciding such application, the court of appeals shall apply ordinary standards of appellate review.</quote>.</text>

 <subsection id="idF8F54985AE3F41A4BE1B929A2A7AC3F0"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote>Combat Human Trafficking Act of 2015</quote>.</text> </subsection><subsection id="idE8852DBED5D54788B94BE0725F9D5227"><enum>(b)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="id20e43e398554483cb5e02b3df163a865"><enum>(1)</enum><header>Commercial sex act; Severe forms of trafficking in persons; State</header><text>The terms <term>commercial sex act</term>, <term>severe forms of trafficking in persons</term>, and <term>State</term> have the meanings given those terms in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text>
 </paragraph><paragraph id="idd9b532205c33462f8c457e6d9db2163e"><enum>(2)</enum><header>Covered offender</header><text>The term <term>covered offender</term> means an individual who obtains, patronizes, or solicits a commercial sex act involving a person subject to severe forms of trafficking in persons.</text>
 </paragraph><paragraph id="id086FA656F3DE4A7D98DD9FF3CD62DDA0"><enum>(3)</enum><header>Covered offense</header><text>The term <term>covered offense</term> means the provision, obtaining, patronizing, or soliciting of a commercial sex act involving a person subject to severe forms of trafficking in persons.</text>
 </paragraph><paragraph id="idfd050956d49d4565a4ccf7a664df86bc"><enum>(4)</enum><header>Federal law enforcement officer</header><text>The term <term>Federal law enforcement officer</term> has the meaning given the term in section 115 of title 18, United States Code.</text> </paragraph><paragraph id="id220d6674805645ebaadd0b9a1a656c23"><enum>(5)</enum><header>Local law enforcement officer</header><text>The term <term>local law enforcement officer</term> means any officer, agent, or employee of a unit of local government authorized by law or by a local government agency to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of criminal law.</text>
 </paragraph><paragraph id="id25c1788dfe31454bb97442ac0f989a9d"><enum>(6)</enum><header>State law enforcement officer</header><text>The term <term>State law enforcement officer</term> means any officer, agent, or employee of a State authorized by law or by a State government agency to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of criminal law.</text>
				</paragraph></subsection><subsection id="id744C41635F3B4182A09C846DCCD287CE"><enum>(c)</enum><header>Department of justice training and policy for law enforcement officers, prosecutors, and judges</header>
				<paragraph id="id8b82e9408d744e3188605dd91f4669e7"><enum>(1)</enum><header>Training</header>
 <subparagraph id="id993f06a398924e5c8cf49399cf0094e1"><enum>(A)</enum><header>Law enforcement officers</header><text>The Attorney General shall ensure that each anti-human trafficking program operated by the Department of Justice, including each anti-human trafficking training program for Federal, State, or local law enforcement officers, includes technical training on—</text>
 <clause id="idf68ae912e0a24d3895c3bb5d90b22982"><enum>(i)</enum><text>effective methods for investigating and prosecuting covered offenders; and</text> </clause><clause id="id1eee6ef0830946e684b07d1ed0329340"><enum>(ii)</enum><text>facilitating the provision of physical and mental health services by health care providers to persons subject to severe forms of trafficking in persons.</text>
 </clause></subparagraph><subparagraph id="id2a41b74d3eb042118f4d08e266e4c282"><enum>(B)</enum><header>Federal prosecutors</header><text>The Attorney General shall ensure that each anti-human trafficking program operated by the Department of Justice for United States attorneys or other Federal prosecutors includes training on seeking restitution for offenses under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/77">chapter 77</external-xref> of title 18, United States Code, to ensure that each United States attorney or other Federal prosecutor, upon obtaining a conviction for such an offense, requests a specific amount of restitution for each victim of the offense without regard to whether the victim requests restitution.</text>
 </subparagraph><subparagraph id="id52a9cbd8ac9b49be97f5eb0de135bb58"><enum>(C)</enum><header>Judges</header><text>The Federal Judicial Center shall provide training to judges relating to the application of section 1593 of title 18, United States Code, with respect to ordering restitution for victims of offenses under chapter 77 of such title.</text>
 </subparagraph></paragraph><paragraph id="id24ed184f3fee42b8be0df9a562b58804"><enum>(2)</enum><header>Policy for Federal law enforcement officers</header><text>The Attorney General shall ensure that Federal law enforcement officers are engaged in activities, programs, or operations involving the detection, investigation, and prosecution of covered offenders.</text>
 </paragraph></subsection><subsection id="idb761ec6bc95a462d85e5421f52365184"><enum>(d)</enum><header>Minimum period of supervised release for conspiracy To commit commercial child sex trafficking</header><text display-inline="yes-display-inline">Section 3583(k) of title 18, United States Code, is amended by inserting <quote>1594(c),</quote> after <quote>1591,</quote>.</text> </subsection><subsection id="ide63ef917c3224d37846641d789583c2a"><enum>(e)</enum><header>Bureau of justice statistics report on state enforcement of human trafficking prohibitions</header><text>The Director of the Bureau of Justice Statistics shall—</text>
 <paragraph id="idba89eb204a9046b283681a5ba8122b79"><enum>(1)</enum><text>prepare an annual report on—</text> <subparagraph id="id4fcd56cec9064056a33d4fac6ce30c4d"><enum>(A)</enum><text>the rates of—</text>
 <clause id="id7fafe2d0d3624e4c8835a6b263f5131a"><enum>(i)</enum><text>arrest of individuals by State law enforcement officers for a covered offense;</text> </clause><clause id="id156bab91fa424c988d29b9925aa60f1f"><enum>(ii)</enum><text>prosecution (including specific charges) of individuals in State court systems for a covered offense; and</text>
 </clause><clause id="id2300b1d60786424cb8574ade4a0cea2f"><enum>(iii)</enum><text>conviction of individuals in State court systems for a covered offense; and</text> </clause></subparagraph><subparagraph id="idb624842986ff4345b529a1c9fb65e4b6"><enum>(B)</enum><text>sentences imposed on individuals convicted in State court systems for a covered offense; and</text>
 </subparagraph></paragraph><paragraph id="id104203d558404d7e9cf260996ace4a31"><enum>(2)</enum><text>submit the annual report prepared under paragraph (1) to—</text> <subparagraph id="idaeb307a4a1cf488cb5d73bb7d352babd"><enum>(A)</enum><text>the Committee on the Judiciary of the House of Representatives;</text>
 </subparagraph><subparagraph id="id178dbf551ffb47f387ebfab1b44d3f65"><enum>(B)</enum><text>the Committee on the Judiciary of the Senate;</text> </subparagraph><subparagraph id="id6ef774bfeeb947d2add33f2874949a60"><enum>(C)</enum><text>the Task Force;</text>
 </subparagraph><subparagraph id="iddaafb975130f483daf21e81d21754c26"><enum>(D)</enum><text>the Senior Policy Operating Group established under section 105(g) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(g)</external-xref>); and</text>
 </subparagraph><subparagraph id="id02f1ebd428c1459ca5cc042895778ff8"><enum>(E)</enum><text>the Attorney General.</text> </subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSJU00" id="id9cd61404f72142e7aa204d0b42e4f89f" reported-display-style="strikethrough"><enum>15.</enum><header>Grant accountability</header> <subsection id="idB7E0FD26E079432E87568C9F543956B4"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>covered grant</term> means a grant awarded by the Attorney General under section 203 of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/14044b">42 U.S.C. 14044b</external-xref>), as amended by section 4.</text>
 </subsection><subsection id="id5844848911934092A80B541909FC769A"><enum>(b)</enum><header>Accountability</header><text display-inline="yes-display-inline">All covered grants shall be subject to the following accountability provisions:</text>
				<paragraph id="idf756f30956c1480da1f89d80d23d561a"><enum>(1)</enum><header>Audit requirement</header>
 <subparagraph id="id3af50bfbf6714b21898f02e1d20a013d"><enum>(A)</enum><header>In general</header><text>Beginning in the first fiscal year beginning after the date of enactment of this Act, and in each fiscal year thereafter, the Inspector General of the Department of Justice shall conduct audits of recipients of a covered grant to prevent waste, fraud, and abuse of funds by grantees. The Inspector General shall determine the appropriate number of grantees to be audited each year.</text>
 </subparagraph><subparagraph id="id97d47f9b5d35412db5fe1d1d9838d627"><enum>(B)</enum><header>Definition</header><text>In this paragraph, the term <term>unresolved audit finding</term> means a finding in the final audit report of the Inspector General that the audited grantee has utilized grant funds for an unauthorized expenditure or otherwise unallowable cost that is not closed or resolved within 12 months from the date when the final audit report is issued.</text>
 </subparagraph><subparagraph id="id5f57882a676e479992d5abdf720b7133"><enum>(C)</enum><header>Mandatory exclusion</header><text>A recipient of a covered grant that is found to have an unresolved audit finding shall not be eligible to receive a covered grant during the following 2 fiscal years.</text>
 </subparagraph><subparagraph id="ida4a0a064d16448be8e8ea1edf79f640b"><enum>(D)</enum><header>Priority</header><text>In awarding covered grants the Attorney General shall give priority to eligible entities that did not have an unresolved audit finding during the 3 fiscal years prior to submitting an application for a covered grant.</text>
 </subparagraph><subparagraph id="id6c2248d167bc4d13a5f36fff4969be8b"><enum>(E)</enum><header>Reimbursement</header><text>If an entity is awarded a covered grant during the 2-fiscal-year period in which the entity is barred from receiving grants under subparagraph (C), the Attorney General shall—</text>
 <clause id="id69184565fc034ce38c2d967aab45b12d"><enum>(i)</enum><text>deposit an amount equal to the grant funds that were improperly awarded to the grantee into the General Fund of the Treasury; and</text>
 </clause><clause id="idac8fdcc2fa504d218eabf88cc6755262"><enum>(ii)</enum><text>seek to recoup the costs of the repayment to the fund from the grant recipient that was erroneously awarded grant funds.</text>
						</clause></subparagraph></paragraph><paragraph id="idfb96d92cbf974a04b0d4f3f41440c0ac"><enum>(2)</enum><header>Nonprofit organization requirements</header>
 <subparagraph id="id1467071834e7465db96d324bec065b7b"><enum>(A)</enum><header>Definition</header><text>For purposes of this paragraph and covered grants, the term <term>nonprofit organization</term> means an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code.</text>
 </subparagraph><subparagraph id="idb70d47b295184390aeb3a7877c1272e0"><enum>(B)</enum><header>Prohibition</header><text>The Attorney General may not award a covered grant to a nonprofit organization that holds money in offshore accounts for the purpose of avoiding paying the tax described in <external-xref legal-doc="usc" parsable-cite="usc/26/511">section 511(a)</external-xref> of the Internal Revenue Code of 1986.</text>
 </subparagraph><subparagraph id="id402ded203c31442eb2e355d04ed5e768"><enum>(C)</enum><header>Disclosure</header><text>Each nonprofit organization that is awarded a covered grant and uses the procedures prescribed in regulations to create a rebuttable presumption of reasonableness for the compensation of its officers, directors, trustees and key employees, shall disclose to the Attorney General, in the application for the grant, the process for determining such compensation, including the independent persons involved in reviewing and approving such compensation, the comparability data used, and contemporaneous substantiation of the deliberation and decision. Upon request, the Attorney General shall make the information disclosed under this subsection available for public inspection.</text>
					</subparagraph></paragraph><paragraph id="idcb96f4ce42fb4d61abbc4d178848b10e"><enum>(3)</enum><header>Conference expenditures</header>
 <subparagraph id="idbba0b903c78e419e9e53916a87640eda"><enum>(A)</enum><header>Limitation</header><text>No amounts transferred to the Department of Justice under this Act, or the amendments made by this Act, may be used by the Attorney General, or by any individual or organization awarded discretionary funds through a cooperative agreement under this Act, or the amendments made by this Act, to host or support any expenditure for conferences that uses more than $20,000 in Department funds, unless the Deputy Attorney General or such Assistant Attorney Generals, Directors, or principal deputies as the Deputy Attorney General may designate, provides prior written authorization that the funds may be expended to host a conference.</text>
 </subparagraph><subparagraph id="ide3d46e800d034165a1c7cdf9f91b41ed"><enum>(B)</enum><header>Written approval</header><text>Written approval under subparagraph (A) shall include a written estimate of all costs associated with the conference, including the cost of all food and beverages, audiovisual equipment, honoraria for speakers, and any entertainment.</text>
 </subparagraph><subparagraph id="id9b1502069ae14975911d3e184718b13a"><enum>(C)</enum><header>Report</header><text>The Deputy Attorney General shall submit an annual report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives on all approved conference expenditures referenced in this paragraph.</text>
 </subparagraph><subparagraph id="id1c52adb20b6e42249b731d58266f5112"><enum>(D)</enum><header>Annual certification</header><text>Beginning in the first fiscal year beginning after the date of enactment of this Act, the Attorney General shall submit, to the Committee on the Judiciary and the Committee on Appropriations of the Senate and the Committee on the Judiciary and the Committee on Appropriations of the House of Representatives, an annual certification that—</text>
 <clause id="id28913c8740a545fba2c31bc307883406"><enum>(i)</enum><text>all audits issued by the Office of the Inspector General under paragraph (1) have been completed and reviewed by the appropriate Assistant Attorney General or Director;</text>
 </clause><clause id="id71008442d61248d08cc09db266ea1c75"><enum>(ii)</enum><text>all mandatory exclusions required under paragraph (1)(C) have been issued;</text> </clause><clause id="id1751882f801e400a870bb6575c71e38a"><enum>(iii)</enum><text>all reimbursements required under paragraph (1)(E) have been made; and</text>
 </clause><clause id="id94b0a11f8d7f42acbb33bf42653a208e"><enum>(iv)</enum><text>includes a list of any grant recipients excluded under paragraph (1) from the previous year.</text> </clause></subparagraph></paragraph><paragraph id="id8a78f9b5935a4cdb89c8625d130d4f79"><enum>(4)</enum><header>Prohibition on lobbying activity</header> <subparagraph id="iddc29418108214d35a95bd6bbcb601bb2"><enum>(A)</enum><header>In general</header><text>Amounts awarded under this Act, or any amendments made by this Act, may not be utilized by any grant recipient to—</text>
 <clause id="id8f590de8d45f4a5a934c2f026b849f26"><enum>(i)</enum><text>lobby any representative of the Department of Justice regarding the award of grant funding; or</text>
 </clause><clause id="id9fb72deb8a414e02baac2a2801a8564d"><enum>(ii)</enum><text>lobby any representative of a Federal, State, local, or tribal government regarding the award of grant funding.</text>
 </clause></subparagraph><subparagraph id="idd2e93b1b8bbc4f4ba79b095c2e6c98b6"><enum>(B)</enum><header>Penalty</header><text>If the Attorney General determines that any recipient of a covered grant has violated subparagraph (A), the Attorney General shall—</text>
 <clause id="idfa4395aa6e974730b91036addcabf8d8"><enum>(i)</enum><text>require the grant recipient to repay the grant in full; and</text> </clause><clause id="id240b8fb085d9481eb1888e9c1d42267e"><enum>(ii)</enum><text>prohibit the grant recipient from receiving another covered grant for not less than 5 years.</text></clause></subparagraph></paragraph></subsection></section></legis-body>

						<section id="idf0ca4e24-42b4-46bf-968c-c6f81bb5bdaa"><enum>3014.</enum><header>Additional
				special assessment</header>
 <subsection id="id6e78394c-477a-4139-80b2-4f62de0b1bee"><enum>(a)</enum><header>In general</header><text>Beginning on the date of enactment of the <short-title>Justice for Victims of Trafficking Act of 2015</short-title> and ending on September, 30 2019, in addition to the assessment imposed under section 3013, the court shall assess an amount of $5,000 on any non-indigent person or entity convicted of an offense under—</text>
 <paragraph id="id1878544f-c9de-42cc-8d31-0a72aceed5bc"><enum>(1)</enum><text>chapter 77 (relating to peonage, slavery, and trafficking in persons);</text>
 </paragraph><paragraph id="idf1f72a1c-f873-43b4-ba39-1d7800a42c8e"><enum>(2)</enum><text>chapter 109A (relating to sexual abuse);</text>
 </paragraph><paragraph id="idfd0a0335-cf8b-4012-be51-21dab85d9dc2"><enum>(3)</enum><text>chapter 110 (relating to sexual exploitation and other abuse of children);</text>
 </paragraph><paragraph id="id152fa2e9-abe7-4831-9b85-becc20c97551"><enum>(4)</enum><text>chapter 117 (relating to transportation for illegal sexual activity and related crimes); or</text>
 </paragraph><paragraph id="idffb8c951-8e32-4e8a-a894-969da2a84717"><enum>(5)</enum><text>section 274 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324</external-xref>) (relating to human smuggling), unless the person induced, assisted, abetted, or aided only an individual who at the time of such action was the alien’s spouse, parent, son, or daughter (and no other individual) to enter the United States in violation of law.</text>
 </paragraph></subsection><subsection id="id0eec1da2-3153-4dcc-a171-852cdb8bcad7"><enum>(b)</enum><header>Satisfaction of other court-Ordered obligations</header><text>An assessment under subsection (a) shall not be payable until the person subject to the assessment has satisfied all outstanding court-ordered fines and orders of restitution arising from the criminal convictions on which the special assessment is based.</text>
 </subsection><subsection id="id9c307f8a-f670-4218-be1c-b51f74b4d592"><enum>(c)</enum><header>Establishment of Domestic Trafficking Victims' Fund</header><text>There is established in the Treasury of the United States a fund, to be known as the <quote>Domestic Trafficking Victims' Fund</quote> (referred to in this section as the <term>Fund</term>), to be administered by the Attorney General, in consultation with the Secretary of Homeland Security and the Secretary of Health and Human Services.</text>
 </subsection><subsection id="id5c111764-242a-4fd5-a5d0-565d0266ee4d"><enum>(d)</enum><header>Deposits</header><text>Notwithstanding section 3302 of title 31, or any other law regarding the crediting of money received for the Government, there shall be deposited in the Fund an amount equal to the amount of the assessments collected under this section, which shall remain available until expended.</text>
							</subsection><subsection id="id67f839f7-910b-4db4-afea-a4f478678332"><enum>(e)</enum><header>Use of funds</header>
 <paragraph id="id4e376c04-28d1-451f-8d01-495185f312bc"><enum>(1)</enum><header>In general</header><text>From amounts in the Fund, in addition to any other amounts available, and without further appropriation, the Attorney General, in coordination with the Secretary of Health and Human Services shall, for each of fiscal years 2016 through 2020, use amounts available in the Fund to award grants or enhance victims' programming under—</text>
 <subparagraph id="ida28967e9-e82d-4691-82fc-6b3af2411117"><enum>(A)</enum><text>sections 202, 203, and 204 of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/14044a">42 U.S.C. 14044a</external-xref>, 14044b, and 14044c);</text>
 </subparagraph><subparagraph id="id5586982c-e0c1-4643-a1dc-f6611fdaba7c"><enum>(B)</enum><text>subsections (b)(2) and (f) of section 107 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105</external-xref>); and</text>
 </subparagraph><subparagraph id="id1a7bc67f-456c-4cfc-8618-94b314c2d79f"><enum>(C)</enum><text>section 214(b) of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13002">42 U.S.C. 13002(b)</external-xref>).</text> </subparagraph></paragraph><paragraph id="ida0dbeaa0-896e-4995-994e-3b65d1c3ac6f"><enum>(2)</enum><header>Grants</header><text>Of the amounts in the Fund used under paragraph (1), not less than $2,000,000, if such amounts are available in the Fund during the relevant fiscal year, shall be used for grants to provide services for child pornography victims under section 214(b) of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13002">42 U.S.C. 13002(b)</external-xref>).</text>
 </paragraph><paragraph id="ide194f60c-203d-4944-b4f9-d02ae9343064"><enum>(3)</enum><header>Limitations</header><text>Amounts in the Fund, or otherwise transferred from the Fund, shall be subject to the limitations on the use or expending of amounts described in sections 506 and 507 of division H of the Consolidated Appropriations Act, 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/76">Public Law 113–76</external-xref>; 128 Stat. 409) to the same extent as if amounts in the Fund were funds appropriated under division H of such Act.</text>
								</paragraph></subsection><subsection id="id6b7b9a9f-a9e3-4b18-87a0-41eb46738ec8"><enum>(f)</enum><header>Transfers</header>
 <paragraph id="idda8ffd19-c5eb-45a0-b780-c6e18fec54f6"><enum>(1)</enum><header>In general</header><text>Effective on the day after the date of enactment of the <short-title>Justice for Victims of Trafficking Act of 2015</short-title>, on September 30 of each fiscal year, all unobligated balances in the Fund shall be transferred to the Crime Victims Fund established under section 1402 of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/10601">42 U.S.C. 10601</external-xref>).</text>
 </paragraph><paragraph id="idc9508c76-9dca-4b2b-b997-e588ff717561"><enum>(2)</enum><header>Availability</header><text>Amounts transferred under paragraph (1)—</text>
 <subparagraph id="iddaeed2f2-9f6b-4d6f-b271-e0845235d973"><enum>(A)</enum><text>shall be available for any authorized purpose of the Crime Victims Fund; and</text>
 </subparagraph><subparagraph id="id878cccd6-d397-4bca-9fdc-c33efb927e1b"><enum>(B)</enum><text>shall remain available until expended.</text>
 </subparagraph></paragraph></subsection><subsection id="id973f83e6-8aa4-48d2-b4e0-66b4457eb86a"><enum>(g)</enum><header>Collection method</header><text>The amount assessed under subsection (a) shall, subject to subsection (b), be collected in the manner that fines are collected in criminal cases.</text>
 </subsection><subsection id="id6c77fab6-500c-430a-b194-22d23814ce74"><enum>(h)</enum><header>Duration of obligation</header><text>Subject to section 3613(b), the obligation to pay an assessment imposed on or after the date of enactment of the <short-title>Justice for Victims of Trafficking Act of 2015</short-title> shall not cease until the assessment is paid in full.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id23c3be89-94ea-4767-b3e0-c0f054aa7d5c"><enum>(b)</enum><header>Technical and
 conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/201">chapter 201</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/3013">section 3013</external-xref> the following:</text>

 </subsection></section><section id="id66e3d00c-4010-4d32-9116-97d102e881e5"><enum>102.</enum><header>Clarifying the benefits and protections offered to domestic victims of human trafficking</header><text display-inline="no-display-inline">Section 107(b)(1) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105(b)(1)</external-xref>) is amended—</text>
 <paragraph id="idC42A9CF3A09D48FE91A2078EC3A291D9"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (F) and (G) as subparagraphs (G) and (H), respectively;</text> </paragraph><paragraph id="idDBD6ECB377F94A73927A75915A2A3B02"><enum>(2)</enum><text>by inserting after subparagraph (E) the following:</text>

 </paragraph><paragraph id="idA789BCC27289428085C644F3E32C96C3"><enum>(3)</enum><text>in subparagraph (H), as redesignated, by striking <quote>subparagraph (F)</quote> and inserting <quote>subparagraph (G)</quote>.</text> </paragraph></section><section commented="no" id="idb081257e-014a-4524-93b0-fd1282c9fa41"><enum>103.</enum><header>Victim-centered child human trafficking deterrence block grant program</header> <subsection commented="no" id="idc3ee328a-b875-43d7-9cc7-afa33bb44078"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 203 of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/14044b">42 U.S.C. 14044b</external-xref>) is amended to read as follows:</text>

						<section id="id41686b19-757f-4fe0-b976-d35a16f80a38"><enum>203.</enum><header>Victim-centered
				child human trafficking deterrence block grant program</header>
							<subsection id="id5e5e3639-61bd-4f0d-a6df-485e3998d822"><enum>(a)</enum><header>Grants
 authorized</header><text>The Attorney General may award block grants to an eligible entity to develop, improve, or expand domestic child human trafficking deterrence programs that assist law enforcement officers, prosecutors, judicial officials, and qualified victims' services organizations in collaborating to rescue and restore the lives of victims, while investigating and prosecuting offenses involving child human trafficking.</text>
							</subsection><subsection id="idb034f858-1bbe-4a79-a478-a4c41a2fd615"><enum>(b)</enum><header>Authorized
 activities</header><text>Grants awarded under subsection (a) may be used for—</text>
 <paragraph id="id0b32a4da-da77-4adc-9f52-8c0d3d84b427"><enum>(1)</enum><text>the establishment or enhancement of specialized training programs for law enforcement officers, first responders, health care officials, child welfare officials, juvenile justice personnel, prosecutors, and judicial personnel to—</text>
 <subparagraph id="id97aaffd5-6f46-4fae-8f27-478868df323e"><enum>(A)</enum><text>identify victims and acts of child human trafficking;</text>
 </subparagraph><subparagraph id="ide290efca-af28-45af-a38c-52bb152ebf02"><enum>(B)</enum><text>address the unique needs of child victims of human trafficking;</text>
 </subparagraph><subparagraph id="idb3204392-f4bf-4cfd-8af4-1948eb3d15c8"><enum>(C)</enum><text>facilitate the rescue of child victims of human trafficking;</text>
 </subparagraph><subparagraph id="id067fd96f-ab57-4dfe-b6a1-a77e8de4a416"><enum>(D)</enum><text>investigate and prosecute acts of human trafficking, including the soliciting, patronizing, or purchasing of commercial sex acts from children, as well as training to build cases against complex criminal networks involved in child human trafficking; and</text>
 </subparagraph><subparagraph id="id4ee20a2f-445a-493d-a296-e182143ad962"><enum>(E)</enum><text>utilize, implement, and provide education on safe harbor laws enacted by States, aimed at preventing the criminalization and prosecution of child sex trafficking victims for prostitution offenses, and other laws aimed at the investigation and prosecution of child human trafficking;</text>
 </subparagraph></paragraph><paragraph id="idfd6c95cc-6571-48d3-975d-0abc7c129ad0"><enum>(2)</enum><text>the establishment or enhancement of dedicated anti-trafficking law enforcement units and task forces to investigate child human trafficking offenses and to rescue victims, including—</text>
 <subparagraph id="idc50a26fc-6c3d-43bd-a0d1-2091e0a6d6be"><enum>(A)</enum><text>funding salaries, in whole or in part, for law enforcement officers, including patrol officers, detectives, and investigators, except that the percentage of the salary of the law enforcement officer paid for by funds from a grant awarded under this section shall not be more than the percentage of the officer’s time on duty that is dedicated to working on cases involving child human trafficking;</text>
 </subparagraph><subparagraph id="id5502cfbb-efc0-4838-81f8-ff8551d7b7d0"><enum>(B)</enum><text>investigation expenses for cases involving child human trafficking, including—</text>
 <clause id="idbb48370a-cd8a-447d-ac5d-2cd20557aca9"><enum>(i)</enum><text>wire taps;</text> </clause><clause id="idb7b18e75-a650-4edc-8e54-fd16233f4c72"><enum>(ii)</enum><text>consultants with expertise specific to cases involving child human trafficking;</text>
 </clause><clause id="id4111d293-3690-4205-978c-ef934be753da"><enum>(iii)</enum><text>travel; and</text>
 </clause><clause id="idc53a0779-b7bd-4209-8ecb-76b5ae68d0ed"><enum>(iv)</enum><text>other technical assistance expenditures;</text>
 </clause></subparagraph><subparagraph id="iddcfdbc34-10a7-4f28-8e89-815e87cd7ef6"><enum>(C)</enum><text>dedicated anti-trafficking prosecution units, including the funding of salaries for State and local prosecutors, including assisting in paying trial expenses for prosecution of child human trafficking offenders, except that the percentage of the total salary of a State or local prosecutor that is paid using an award under this section shall be not more than the percentage of the total number of hours worked by the prosecutor that is spent working on cases involving child human trafficking;</text>
 </subparagraph><subparagraph id="id913d0b96-d161-4bb0-8aab-30e0fb522f6b"><enum>(D)</enum><text>the establishment of child human trafficking victim witness safety, assistance, and relocation programs that encourage cooperation with law enforcement investigations of crimes of child human trafficking by leveraging existing resources and delivering child human trafficking victims’ services through coordination with—</text>
 <clause id="ide3621040-0336-4b02-a382-86da0cdf0b39"><enum>(i)</enum><text>child advocacy centers;</text>
 </clause><clause id="id1b6d2713-8a3e-44ee-907b-381934a9f08b"><enum>(ii)</enum><text>social service agencies;</text>
 </clause><clause id="id9f3d2f24-66d1-4602-b3aa-777892007285"><enum>(iii)</enum><text>State governmental health service agencies;</text>
 </clause><clause id="id5a95416a-a90a-4ee5-8ebe-827ecd570e8b"><enum>(iv)</enum><text>housing agencies;</text>
 </clause><clause id="id2d01a387-ec48-41ff-8569-ef437792db84"><enum>(v)</enum><text>legal services agencies; and</text>
 </clause><clause id="idab225fdb-ceb4-4e35-b77d-581d9fab9d66"><enum>(vi)</enum><text>nongovernmental organizations and shelter service providers with substantial experience in delivering wrap-around services to victims of child human trafficking; and</text>
 </clause></subparagraph><subparagraph id="ide46d7249-5fb1-4090-870c-371383d5984b"><enum>(E)</enum><text>the establishment or enhancement of other necessary victim assistance programs or personnel, such as victim or child advocates, child-protective services, child forensic interviews, or other necessary service providers; and</text>
 </subparagraph></paragraph><paragraph id="id111dc720-3429-404c-aacf-f70ef47dc6a6"><enum>(3)</enum><text>the establishment or enhancement of problem solving court programs for trafficking victims that include—</text>
 <subparagraph id="idfdb5d3c1-5894-4028-b2e0-5c863597e28f"><enum>(A)</enum><text>mandatory and regular training requirements for judicial officials involved in the administration or operation of the court program described under this paragraph;</text>
 </subparagraph><subparagraph id="id5a296726-db35-4124-b50d-1c818842f9b6"><enum>(B)</enum><text>continuing judicial supervision of victims of child human trafficking, including case worker or child welfare supervision in collaboration with judicial officers, who have been identified by a law enforcement or judicial officer as a potential victim of child human trafficking, regardless of whether the victim has been charged with a crime related to human trafficking;</text>
 </subparagraph><subparagraph id="id4e6c9b68-9d86-47e7-9ed4-a374450a1da2"><enum>(C)</enum><text>the development of a specialized and individualized, court-ordered treatment program for identified victims of child human trafficking, including—</text>
 <clause id="id5ad7628a-2e3f-4778-b1d5-f07c9aff0a4c"><enum>(i)</enum><text>State-administered outpatient treatment;</text>
 </clause><clause id="id12c50a28-99fd-49f9-91a1-8b06d642bd5b"><enum>(ii)</enum><text>life skills training;</text>
 </clause><clause id="id279f48e9-5377-410e-9d30-ec33ff46105c"><enum>(iii)</enum><text>housing placement;</text>
 </clause><clause id="id186339ac-8c96-40e7-888d-e93060fcc9d0"><enum>(iv)</enum><text>vocational training;</text>
 </clause><clause id="id2155a070-e683-4db4-8306-786eb1b4a2b1"><enum>(v)</enum><text>education;</text> </clause><clause id="id6f0a2b81-319a-459b-a8ba-29f405402964"><enum>(vi)</enum><text>family support services; and</text>
 </clause><clause id="id940b9052-3100-4cee-a75d-47ddb92c4f9d"><enum>(vii)</enum><text>job placement;</text>
 </clause></subparagraph><subparagraph id="id5af662f3-82da-43f9-be35-6dc239e01c47"><enum>(D)</enum><text>centralized case management involving the consolidation of all of each child human trafficking victim’s cases and offenses, and the coordination of all trafficking victim treatment programs and social services;</text>
 </subparagraph><subparagraph id="ide91218bc-2243-475d-8f4b-276abbe830b5"><enum>(E)</enum><text>regular and mandatory court appearances by the victim during the duration of the treatment program for purposes of ensuring compliance and effectiveness;</text>
 </subparagraph><subparagraph id="id87c44e32-22d1-4d87-aac1-ee2a3b4fcb77"><enum>(F)</enum><text>the ultimate dismissal of relevant non-violent criminal charges against the victim, where such victim successfully complies with the terms of the court-ordered treatment program; and</text>
 </subparagraph><subparagraph id="ideacd0758-0f26-4b3f-afd1-2698f1cd2f1b"><enum>(G)</enum><text>collaborative efforts with child advocacy centers, child welfare agencies, shelters, and nongovernmental organizations with substantial experience in delivering wrap-around services to victims of child human trafficking to provide services to victims and encourage cooperation with law enforcement.</text>
									</subparagraph></paragraph></subsection><subsection id="id16b373bf-dfc3-4441-ba71-6c3c73fcb05e"><enum>(c)</enum><header>Application</header>
								<paragraph id="id3ed81adc-7383-48be-9361-0467572884ce"><enum>(1)</enum><header>In
 general</header><text>An eligible entity shall submit an application to the Attorney General for a grant under this section in such form and manner as the Attorney General may require.</text>
								</paragraph><paragraph id="ided9c3a9e-6b3a-4f99-91f8-e891f1fc468c"><enum>(2)</enum><header>Required
 information</header><text>An application submitted under this subsection shall—</text>
 <subparagraph id="id280eafa8-9249-4d09-8eea-192726f099a6"><enum>(A)</enum><text>describe the activities for which assistance under this section is sought;</text>
 </subparagraph><subparagraph id="id05c9ef57-1d11-4ebe-8f8e-b1b5393f1604"><enum>(B)</enum><text>include a detailed plan for the use of funds awarded under the grant;</text>
 </subparagraph><subparagraph id="id9a9642b4-aeec-427e-9dff-01f4fba1b13a"><enum>(C)</enum><text>provide such additional information and assurances as the Attorney General determines to be necessary to ensure compliance with the requirements of this section; and</text>
 </subparagraph><subparagraph id="id6f4635fc-d672-4fa3-bc36-29618547b6d9"><enum>(D)</enum><text>disclose—</text> <clause id="id09efc39e-8ca2-4cf1-b323-ca1920daeab7"><enum>(i)</enum><text>any other grant funding from the Department of Justice or from any other Federal department or agency for purposes similar to those described in subsection (b) for which the eligible entity has applied, and which application is pending on the date of the submission of an application under this section; and</text>
 </clause><clause id="id119d3470-4762-4a53-8e75-3126eea02c1d"><enum>(ii)</enum><text>any other such grant funding that the eligible entity has received during the 5-year period ending on the date of the submission of an application under this section.</text>
 </clause></subparagraph></paragraph><paragraph id="idf7017e4d-8a35-4617-84a2-9a812d0e365c"><enum>(3)</enum><header>Preference</header><text>In reviewing applications submitted in accordance with paragraphs (1) and (2), the Attorney General shall give preference to grant applications if—</text>
 <subparagraph id="idc052f829-4514-4c40-94e3-6c4e45d44f54"><enum>(A)</enum><text>the application includes a plan to use awarded funds to engage in all activities described under paragraphs (1) through (3) of subsection (b); or</text>
 </subparagraph><subparagraph id="id02b14ffd-36aa-44d6-96a4-ede6b256b7e6"><enum>(B)</enum><text>the application includes a plan by the State or unit of local government to continue funding of all activities funded by the award after the expiration of the award.</text>
									</subparagraph></paragraph></subsection><subsection id="idd374921d-2fdc-49c8-8380-49a890b40acc"><enum>(d)</enum><header>Duration and
				renewal of award</header>
								<paragraph id="id4ef00c13-f5cb-4465-9d09-8003f1ec39eb"><enum>(1)</enum><header>In
 general</header><text>A grant under this section shall expire 3 years after the date of award of the grant.</text>
 </paragraph><paragraph id="ide3b6d0c6-e7b8-44ae-9166-c39fa47bcdbf"><enum>(2)</enum><header>Renewal</header><text>A grant under this section shall be renewable not more than 2 times and for a period of not greater than 2 years.</text>
 </paragraph></subsection><subsection id="idb50528e4-ea4d-4cce-8776-afbcd0d7cf8a"><enum>(e)</enum><header>Evaluation</header><text>The Attorney General shall—</text>
 <paragraph id="id92a7c0cc-7fd1-4154-9446-1b9ec282a10b"><enum>(1)</enum><text>enter into a contract with a nongovernmental organization, including an academic or nonprofit organization, that has experience with issues related to child human trafficking and evaluation of grant programs to conduct periodic evaluations of grants made under this section to determine the impact and effectiveness of programs funded with grants awarded under this section;</text>
 </paragraph><paragraph id="id47BB782E80FE4005BC22AD419178E43B"><enum>(2)</enum><text>instruct the Inspector General of the Department of Justice to review evaluations issued under paragraph (1) to determine the methodological and statistical validity of the evaluations; and</text>
 </paragraph><paragraph id="idd5d59f17-53b7-48ee-b3b8-749c5eb6e3b5"><enum>(3)</enum><text>submit the results of any evaluation conducted pursuant to paragraph (1) to—</text> <subparagraph id="idd760d040-7966-4bc2-ac42-b024c4a3ef13"><enum>(A)</enum><text>the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>; and</text>
 </subparagraph><subparagraph id="idb84fe947-8c1f-4507-9036-f883dc55a465"><enum>(B)</enum><text>the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>.</text> </subparagraph></paragraph></subsection><subsection id="idc552e553-7b9d-4ba1-9108-791f9ab9e7b8"><enum>(f)</enum><header>Mandatory exclusion</header><text>An eligible entity awarded funds under this section that is found to have used grant funds for any unauthorized expenditure or otherwise unallowable cost shall not be eligible for any grant funds awarded under the block grant for 2 fiscal years following the year in which the unauthorized expenditure or unallowable cost is reported.</text>
							</subsection><subsection id="iddbc552b5-4f5a-4ec2-a0ad-5b71fbc2a6e3"><enum>(g)</enum><header>Compliance
 requirement</header><text>An eligible entity shall not be eligible to receive a grant under this section if within the 5 fiscal years before submitting an application for a grant under this section, the grantee has been found to have violated the terms or conditions of a Government grant program by utilizing grant funds for unauthorized expenditures or otherwise unallowable costs.</text>
							</subsection><subsection id="id8f69ee12-648e-45ea-87e9-5e79b6e1ff9a"><enum>(h)</enum><header>Administrative
 cap</header><text>The cost of administering the grants authorized by this section shall not exceed 5 percent of the total amount expended to carry out this section.</text>
							</subsection><subsection id="id96f0efb4-5215-4cdd-a1a1-ee27d2d2f992"><enum>(i)</enum><header>Federal
 share</header><text>The Federal share of the cost of a program funded by a grant awarded under this section shall be—</text>
 <paragraph id="ida3d5d1e1-7597-4fba-bfd0-c7243e5bf16b"><enum>(1)</enum><text>70 percent in the first year;</text>
 </paragraph><paragraph id="id439b56d9-fda6-456a-9014-d9ea0cbc25e8"><enum>(2)</enum><text>60 percent in the second year; and</text>
 </paragraph><paragraph id="id7d06bbb1-9b10-4174-9cb8-aabe19b44d3f"><enum>(3)</enum><text>50 percent in the third year, and in all subsequent years.</text>
								</paragraph></subsection><subsection id="id1764f01a-55a8-40bd-9419-7baadeeb5c11"><enum>(j)</enum><header>Authorization
 of funding; fully offset</header><text>For purposes of carrying out this section, the Attorney General, in consultation with the Secretary of Health and Human Services, is authorized to award not more than $7,000,000 of the funds available in the Domestic Trafficking Victims’ Fund, established under section 3014 of title 18, United States Code, for each of fiscal years 2016 through 2020.</text>
 </subsection><subsection id="id6cb6346c-ae45-4bef-a1f7-22d3ca199f7f"><enum>(k)</enum><header>Definitions</header><text>In this section—</text>
 <paragraph id="idc7d3ed5a-b357-45b8-baa5-13d35c385b50"><enum>(1)</enum><text>the term <term>child</term> means a person under the age of 18;</text>
 </paragraph><paragraph id="idbbd6f120-3dcf-4829-adff-4994fa9d1ec8"><enum>(2)</enum><text>the term <term>child advocacy center</term> means a center created under subtitle A of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13001">42 U.S.C. 13001 et seq.</external-xref>);</text>
 </paragraph><paragraph id="id46d92bc1-8564-4358-b5fe-ec6864996e71"><enum>(3)</enum><text>the term <term>child human trafficking</term> means 1 or more severe forms of trafficking in persons (as defined in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>)) involving a victim who is a child; and</text>
 </paragraph><paragraph id="id2946017e-5ac5-48a7-9863-c2bc013a239d"><enum>(4)</enum><text>the term <term>eligible entity</term> means a State or unit of local government that—</text>
 <subparagraph id="id359b7095-cd23-4710-8db1-384713eb834f"><enum>(A)</enum><text>has significant criminal activity involving child human trafficking;</text>
 </subparagraph><subparagraph id="id42097312-0c0a-42d5-b2bb-4f0f586dd627"><enum>(B)</enum><text>has demonstrated cooperation between Federal, State, local, and, where applicable, tribal law enforcement agencies, prosecutors, and social service providers in addressing child human trafficking;</text>
 </subparagraph><subparagraph id="id22be1e99-c824-4c58-97d9-8b4e680b4073"><enum>(C)</enum><text>has developed a workable, multi-­disciplinary plan to combat child human trafficking, including—</text>
 <clause id="id87451e35-0c8f-466a-b0ff-03a750f144f6"><enum>(i)</enum><text>the establishment of a shelter for victims of child human trafficking, through existing or new facilities;</text>
 </clause><clause id="id79f737e2-7f3b-4bbe-bc1a-a2382c10ed0d"><enum>(ii)</enum><text>the provision of trauma-­informed, gender-responsive rehabilitative care to victims of child human trafficking;</text>
 </clause><clause id="id9f52761e-3cad-43f6-a9ed-38bcf780e32e"><enum>(iii)</enum><text>the provision of specialized training for law enforcement officers and social service providers for all forms of human trafficking, with a focus on domestic child human trafficking;</text>
 </clause><clause id="id20058786-781c-4e2e-b5e8-f7d8b34b240c"><enum>(iv)</enum><text>prevention, deterrence, and prosecution of offenses involving child human trafficking, including soliciting, patronizing, or purchasing human acts with children;</text>
 </clause><clause id="idb9165c7d-586f-4fe5-9e10-6f114915f300"><enum>(v)</enum><text>cooperation or referral agreements with organizations providing outreach or other related services to runaway and homeless youth;</text>
 </clause><clause id="idb3df3a69-4abf-472f-aa50-28434ff1a385"><enum>(vi)</enum><text>law enforcement protocols or procedures to screen all individuals arrested for prostitution, whether adult or child, for victimization by sex trafficking and by other crimes, such as sexual assault and domestic violence; and</text>
 </clause><clause id="id52846de2-d20c-488d-890a-dfa073d84630"><enum>(vii)</enum><text>cooperation or referral agreements with State child welfare agencies and child advocacy centers; and</text>
 </clause></subparagraph><subparagraph id="id4cb4af63-05b7-472c-a565-4bb831c202d4"><enum>(D)</enum><text>provides an assurance that, under the plan under subparagraph (C), a victim of child human trafficking shall not be required to collaborate with law enforcement officers to have access to any shelter or services provided with a grant under this section.</text>
 </subparagraph></paragraph></subsection><subsection id="idab1affb0-8fce-4a74-a2eb-370ed1fac6f6"><enum>(l)</enum><header>Grant accountability; specialized victims’ service requirement</header><text>No grant funds under this section may be awarded or transferred to any entity unless such entity has demonstrated substantial experience providing services to victims of human trafficking or related populations (such as runaway and homeless youth), or employs staff specialized in the treatment of human trafficking victims.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="id2593a693-2a22-4df7-8019-861ceb08f28d"><enum>(b)</enum><header>Table of contents</header><text>The table of contents in section 1(b) of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/22/7101">22 U.S.C. 7101</external-xref> note) is amended by striking the item relating to section 203 and inserting the following:</text>

 <paragraph commented="no" id="id302b87a8-86f0-41fa-a26e-683609b1cbce"><enum>(1)</enum><text display-inline="yes-display-inline">in section 212(5) (<external-xref legal-doc="usc" parsable-cite="usc/42/13001a">42 U.S.C. 13001a(5)</external-xref>), by inserting <quote>, including human trafficking and the production of child pornography</quote> before the semicolon at the end; and</text>

 </paragraph><paragraph id="id5f6a5c44-16b0-4aed-833a-5b30549a0539"><enum>(3)</enum><header>Use of nonforfeited assets</header><text>Transfers pursuant to paragraph (1) shall not reduce or otherwise mitigate the obligation of a person convicted of a violation of this chapter to satisfy the full amount of a restitution order through the use of non-forfeited assets or to reimburse the Attorney General for the value of assets or proceeds transferred under this subsection through the use of nonforfeited assets.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

 </subsection><subsection commented="no" id="idb2aa6f93-1062-42f6-9384-ffc18472c3dc"><enum>(c)</enum><header>Purpose</header><text>The purpose of the amendments made by this section is to clarify the range of conduct punished as sex trafficking.</text>
 </subsection></section><section commented="no" id="id61B89651A655472AAEB3A1FB7F8FBE3D"><enum>109.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="id08a40d7424f440c7b8ea2af1c636193c"><enum>(1)</enum><text>section 1591 of title 18, United States Code, defines a sex trafficker as a person who <quote>knowingly…recruits, entices, harbors, transports, provides, obtains, or maintains by any means a person…knowing, or in reckless disregard of the fact, that means of force, threats of force, fraud, coercion…or any combination of such means will be used to cause the person to engage in a commercial sex act, or that the person has not attained the age of 18 years and will be caused to engage in a commercial sex act</quote>;</text>
 </paragraph><paragraph id="id314ca3f34fbc4ac7b3832d784de1c0eb"><enum>(2)</enum><text>while use of the word <quote>obtains</quote> in section 1591, United States Code, has been interpreted, prior to the date of enactment of this Act, to encompass those who purchase illicit sexual acts from trafficking victims, some confusion persists;</text>
 </paragraph><paragraph id="idb11e3672c5204f11a9a4d088a5160c85"><enum>(3)</enum><text>in United States vs. Jungers, 702 F.3d 1066 (8th Cir. 2013), the United States Court of Appeals for the Eighth Circuit ruled that section 1591 of title 18, United States Code, applied to persons who purchase illicit sexual acts with trafficking victims after the United States District Court for the District of South Dakota erroneously granted motions to acquit these buyers in two separate cases; and</text>
 </paragraph><paragraph id="idea6342932cce430dbaf39bedc18b9573"><enum>(4)</enum><text>section 108 of this title amends section 1591 of title 18, United States Code, to add the words <quote>solicits or patronizes</quote> to the sex trafficking statute making absolutely clear for judges, juries, prosecutors, and law enforcement officials that criminals who purchase sexual acts from human trafficking victims may be arrested, prosecuted, and convicted as sex trafficking offenders when this is merited by the facts of a particular case.</text>
				</paragraph></section><section id="idbeff3c54-20e1-4257-a7e3-1dd3d5c220be"><enum>110.</enum><header>Using existing
 task forces and components to target offenders who exploit children</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Attorney General shall ensure that—</text>
 <paragraph id="ida79f56f2-17e6-400a-aee3-548a7bfcfd81"><enum>(1)</enum><text display-inline="yes-display-inline">all task forces and working groups within the Innocence Lost National Initiative engage in activities, programs, or operations to increase the investigative capabilities of State and local law enforcement officers in the detection, investigation, and prosecution of persons who patronize, or solicit children for sex; and</text>
 </paragraph><paragraph id="id155a1a95-a69a-4c33-86a9-d8caedd4a1e7"><enum>(2)</enum><text display-inline="yes-display-inline">all components and task forces with jurisdiction to detect, investigate, and prosecute cases of child labor trafficking engage in activities, programs, or operations to increase the capacity of such components to deter and punish child labor trafficking.</text>
				</paragraph></section><section id="id0928ee7d-19eb-429d-9a1d-8ce26b48736a"><enum>111.</enum><header>Targeting child predators</header>
 <subsection id="iddba1d47b-e6e7-4589-9a52-dcd12cd130a2"><enum>(a)</enum><header>Clarifying that child pornography producers are human traffickers</header><text display-inline="yes-display-inline">Section 2423(f) of title 18, United States Code, is amended—</text> <paragraph id="idc32108c7-dfe9-498b-90a4-08ba478d6bdf"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>means (1) a</quote> and inserting the following: “means—</text>

 </subsection></section><section id="idcc726418-ea86-4eec-b10c-33ec00696557"><enum>112.</enum><header>Monitoring all human traffickers as violent criminals</header><text display-inline="no-display-inline">Section 3156(a)(4)(C) of title 18, United States Code, is amended by inserting <quote>77,</quote> after <quote>chapter</quote>.</text> </section><section id="id8b145601-0e16-4d09-827a-b19ef0b0c12d"><enum>113.</enum><header>Crime victims' rights</header> <subsection id="id4d1f3a60-2273-49cd-895c-9206d50875d5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3771 of title 18, United States Code, is amended—</text>

 <paragraph id="idb55dfb3c-7e61-4f94-8a55-c3ee0c87a858"><enum>(1)</enum><header>In general</header><text>Section 3771(d)(3) of title 18, United States Code, as amended by subsection (a)(2) of this section, is amended by inserting after the fifth sentence the following: <quote>In deciding such application, the court of appeals shall apply ordinary standards of appellate review.</quote>.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id496e96f8-e575-463f-a50f-5ad3e9b850f7"><enum>(2)</enum><header>Application</header><text>The amendment made by paragraph (1) shall apply with respect to any petition for a writ of mandamus filed under section 3771(d)(3) of title 18, United States Code, that is pending on the date of enactment of this Act.</text>
					</paragraph></subsection></section><section id="ide924ce0f-6ac5-47e9-a16f-139af5724159"><enum>114.</enum><header>Combat Human Trafficking Act</header>
 <subsection id="id2a592974-8895-4d8c-93f9-b61c042dde02"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote>Combat Human Trafficking Act of 2015</quote>.</text> </subsection><subsection id="id75c46fd0-2870-46c6-a3f0-881eb8e03858"><enum>(b)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="id7dc529c7-3ba2-468d-bef1-5a877aef56b1"><enum>(1)</enum><header>Commercial sex act; Severe forms of trafficking in persons; State; Task Force</header><text>The terms <term>commercial sex act</term>, <term>severe forms of trafficking in persons</term>, <term>State</term>, and <term>Task Force</term> have the meanings given those terms in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text>
 </paragraph><paragraph id="idab0d4fb3-b3df-4f2d-991c-54d3a77defc8"><enum>(2)</enum><header>Covered offender</header><text>The term <term>covered offender</term> means an individual who obtains, patronizes, or solicits a commercial sex act involving a person subject to severe forms of trafficking in persons.</text>
 </paragraph><paragraph id="id0f84112d-d1f8-41e9-b98a-877af62889e4"><enum>(3)</enum><header>Covered offense</header><text>The term <term>covered offense</term> means the provision, obtaining, patronizing, or soliciting of a commercial sex act involving a person subject to severe forms of trafficking in persons.</text>
 </paragraph><paragraph id="idc0ec85e0-e2c3-415f-bc05-659593700feb"><enum>(4)</enum><header>Federal law enforcement officer</header><text>The term <term>Federal law enforcement officer</term> has the meaning given the term in section 115 of title 18, United States Code.</text> </paragraph><paragraph id="idb95a0b84-12ce-4c19-88f1-2b911acc8089"><enum>(5)</enum><header>Local law enforcement officer</header><text>The term <term>local law enforcement officer</term> means any officer, agent, or employee of a unit of local government authorized by law or by a local government agency to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of criminal law.</text>
 </paragraph><paragraph id="ide8cacca9-c354-45aa-93b6-26b4a2721644"><enum>(6)</enum><header>State law enforcement officer</header><text>The term <term>State law enforcement officer</term> means any officer, agent, or employee of a State authorized by law or by a State government agency to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of criminal law.</text>
					</paragraph></subsection><subsection id="ida09278b0-47bb-4d2a-bee2-ba4e5fedb80c"><enum>(c)</enum><header>Department of justice training and policy for law enforcement officers, prosecutors, and judges</header>
					<paragraph id="idc683db85-774b-4368-91ee-b0e4fa0e3d3b"><enum>(1)</enum><header>Training</header>
 <subparagraph id="ide13cfe55-9f1a-4982-8a93-ec4d20460c1d"><enum>(A)</enum><header>Law enforcement officers</header><text>The Attorney General shall ensure that each anti-human trafficking program operated by the Department of Justice, including each anti-human trafficking training program for Federal, State, or local law enforcement officers, includes technical training on—</text>
 <clause id="idc02f83c5-9543-4579-b918-16cd00fa20f2"><enum>(i)</enum><text>effective methods for investigating and prosecuting covered offenders; and</text> </clause><clause id="idc779b408-c43a-40d9-8fcd-5d738b7112f6"><enum>(ii)</enum><text>facilitating the provision of physical and mental health services by health care providers to persons subject to severe forms of trafficking in persons.</text>
 </clause></subparagraph><subparagraph id="ida25cfec4-57ea-430a-b626-799a469b5752"><enum>(B)</enum><header>Federal prosecutors</header><text>The Attorney General shall ensure that each anti-human trafficking program operated by the Department of Justice for United States attorneys or other Federal prosecutors includes training on seeking restitution for offenses under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/77">chapter 77</external-xref> of title 18, United States Code, to ensure that each United States attorney or other Federal prosecutor, upon obtaining a conviction for such an offense, requests a specific amount of restitution for each victim of the offense without regard to whether the victim requests restitution.</text>
 </subparagraph><subparagraph id="iddafb030d-3cfa-4ed0-9559-986476a213fa"><enum>(C)</enum><header>Judges</header><text>The Federal Judicial Center shall provide training to judges relating to the application of section 1593 of title 18, United States Code, with respect to ordering restitution for victims of offenses under chapter 77 of such title.</text>
 </subparagraph></paragraph><paragraph id="id64d1f933-3758-45a0-8443-60b271446eb8"><enum>(2)</enum><header>Policy for Federal law enforcement officers</header><text>The Attorney General shall ensure that Federal law enforcement officers are engaged in activities, programs, or operations involving the detection, investigation, and prosecution of covered offenders.</text>
 </paragraph></subsection><subsection id="id4fbedd24-f410-4f83-a616-06f1d941535d"><enum>(d)</enum><header>Minimum period of supervised release for conspiracy To commit commercial child sex trafficking</header><text display-inline="yes-display-inline">Section 3583(k) of title 18, United States Code, is amended by inserting <quote>1594(c),</quote> after <quote>1591,</quote>.</text> </subsection><subsection id="ida484a58c-76ef-4d46-8914-3df2257f1287"><enum>(e)</enum><header>Bureau of justice statistics report on state enforcement of human trafficking prohibitions</header><text>The Director of the Bureau of Justice Statistics shall—</text>
 <paragraph id="id419f7d0a-52a8-42f1-ae7f-6077122eaaed"><enum>(1)</enum><text>prepare an annual report on—</text> <subparagraph id="id28b1577a-69cf-4924-a29a-fa1c00aa9d20"><enum>(A)</enum><text>the rates of—</text>
 <clause id="id97af4d29-ee48-43b4-a56e-9cbf4d7a8cfa"><enum>(i)</enum><text>arrest of individuals by State law enforcement officers for a covered offense;</text> </clause><clause id="id95797096-8cec-4ca8-a8be-3643001d1440"><enum>(ii)</enum><text>prosecution (including specific charges) of individuals in State court systems for a covered offense; and</text>
 </clause><clause id="id235bfb54-7bf5-49a2-b869-f749a5ba1e88"><enum>(iii)</enum><text>conviction of individuals in State court systems for a covered offense; and</text> </clause></subparagraph><subparagraph id="idd38b74fb-2453-42ce-a625-372e8f463c43"><enum>(B)</enum><text>sentences imposed on individuals convicted in State court systems for a covered offense; and</text>
 </subparagraph></paragraph><paragraph id="iddcd327dc-3581-4556-84c0-6f06f45436be"><enum>(2)</enum><text>submit the annual report prepared under paragraph (1) to—</text> <subparagraph id="id5cfd7417-0200-4b54-91a5-83625fbebb52"><enum>(A)</enum><text>the Committee on the Judiciary of the House of Representatives;</text>
 </subparagraph><subparagraph id="id55c7f2e7-7af6-4095-8922-b05ac58974f9"><enum>(B)</enum><text>the Committee on the Judiciary of the Senate;</text> </subparagraph><subparagraph id="id021b53ab-3192-4de4-9568-bd00186b947c"><enum>(C)</enum><text>the Task Force;</text>
 </subparagraph><subparagraph id="id2e1145f2-97f9-4813-924f-34d1d75bd283"><enum>(D)</enum><text>the Senior Policy Operating Group established under section 105(g) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(g)</external-xref>); and</text>
 </subparagraph><subparagraph id="id45303fb7-1be6-4f0c-9812-fd08088d69e1"><enum>(E)</enum><text>the Attorney General.</text> </subparagraph></paragraph></subsection></section><section id="id2E6737F6F0F549F7AC33F479751E3BF9"><enum>115.</enum><header>Survivors of Human Trafficking Empowerment Act</header> <subsection commented="no" id="idC80667933BAD47E0BFB6B7E2A9F455A0"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <term>Survivors of Human Trafficking Empowerment Act</term>.</text>
 </subsection><subsection commented="no" id="id88164F7913AB45FFBB8ADB87F0E38C6B"><enum>(b)</enum><header>Establishment</header><text>There is established the United States Advisory Council on Human Trafficking (referred to in this section as the <term>Council</term>), which shall provide advice and recommendations to the Senior Policy Operating Group established under section 105(g) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(g)</external-xref>) (referred to in this section as the <term>Group</term>) and the President's Interagency Task Force to Monitor and Combat Trafficking established under section 105(a) of such Act (referred to in this section as the <term>Task Force</term>).</text>
				</subsection><subsection commented="no" id="id4FD51722A0134142A6966AF8256DBDF9"><enum>(c)</enum><header>Membership</header>
 <paragraph commented="no" id="idEA99E5898B234C9B83897741212275D6"><enum>(1)</enum><header>Composition</header><text>The Council shall be composed of not less than 8 and not more than 14 individuals who are survivors of human trafficking.</text>
 </paragraph><paragraph commented="no" id="id01722E1C0EF04CC3B0E5C3E3ADBAC1CC"><enum>(2)</enum><header>Representation of survivors</header><text>To the extent practicable, members of the Council shall be survivors of trafficking, who shall accurately reflect the diverse backgrounds of survivors of trafficking, including—</text>
 <subparagraph id="id13185c3f2e3f4d46b9bff0abd80ecfb1"><enum>(A)</enum><text>survivors of sex trafficking and survivors of labor trafficking; and</text> </subparagraph><subparagraph id="id3b9848b9ac5843d5b6d5e5eb1dfac0ab"><enum>(B)</enum><text>survivors who are United States citizens and survivors who are aliens lawfully present in the United States.</text>
 </subparagraph></paragraph><paragraph commented="no" id="id5FEF3A3E7F544758B5923519620E7B05"><enum>(3)</enum><header>Appointment</header><text>Not later than 180 days after the date of enactment of this Act, the President shall appoint the members of the Council.</text>
 </paragraph><paragraph commented="no" id="idC5E0BE16078445D98291C776FC6D94D3"><enum>(4)</enum><header>Term; reappointment</header><text>Each member of the Council shall serve for a term of 2 years and may be reappointed by the President to serve 1 additional 2-year term.</text>
 </paragraph></subsection><subsection id="id80549e020c49473e950b5aebf5f14e40"><enum>(d)</enum><header>Functions</header><text>The Council shall—</text> <paragraph id="idd184875b81a04a8785e161f0be0dcb3b"><enum>(1)</enum><text>be a nongovernmental advisory body to the Group;</text>
 </paragraph><paragraph id="id74315f4f3f124919b3532712205fe74b"><enum>(2)</enum><text>meet, at its own discretion or at the request of the Group, not less frequently than annually to review Federal Government policy and programs intended to combat human trafficking, including programs relating to the provision of services for victims and serve as a point of contact for Federal agencies reaching out to human trafficking survivors for input on programming and policies relating to human trafficking in the United States;</text>
 </paragraph><paragraph id="id6df8e7a1e7934609b9f181e2513edb26"><enum>(3)</enum><text>formulate assessments and recommendations to ensure that policy and programming efforts of the Federal Government conform, to the extent practicable, to the best practices in the field of human trafficking prevention; and</text>
 </paragraph><paragraph id="idca77f6274b2c4d809a209a48bd7768cc"><enum>(4)</enum><text>meet with the Group not less frequently than annually, and not later than 45 days before a meeting with the Task Force, to formally present the findings and recommendations of the Council.</text>
 </paragraph></subsection><subsection id="idb747600d68df451a8235bbe460de733f"><enum>(e)</enum><header>Reports</header><text>Not later than 1 year after the date of enactment of this Act and each year thereafter until the date described in subsection (h), the Council shall submit a report that contains the findings derived from the reviews conducted pursuant to subsection (d)(2) to—</text>
 <paragraph id="idD874A8EBBA264E798A560D0C0808D552"><enum>(1)</enum><text>the chair of the Task Force;</text> </paragraph><paragraph id="idFECAC77D21F84740BE982ED8EA6A15D4"><enum>(2)</enum><text>the members of the Group;</text>
 </paragraph><paragraph id="id5FEE14502EA14A64B6563C7A154378E1"><enum>(3)</enum><text>the Committees on Foreign Affairs, Homeland Security, Appropriations, and the Judiciary of the House of Representatives; and</text>
 </paragraph><paragraph id="idF1BBE4ADE831400D91188D2273D43BA0"><enum>(4)</enum><text>the Committees on Foreign Relations, Appropriations, Homeland Security and Governmental Affairs, and the Judiciary of the Senate.</text>
 </paragraph></subsection><subsection id="id2751a92d5c1349408937cab21d725510"><enum>(f)</enum><header>Employee status</header><text>Members of the Council—</text> <paragraph id="idd033ce0e40a441348d9913e3c79b4957"><enum>(1)</enum><text>shall not be considered employees of the Federal Government for any purpose; and</text>
 </paragraph><paragraph id="id3f86ec2cc7084d74a0af0aff5af980a8"><enum>(2)</enum><text>shall not receive compensation other than reimbursement of travel expenses and per diem allowance in accordance with section 5703 of title 5, United States Code.</text>
 </paragraph></subsection><subsection commented="no" id="ida700504bd4ad420b98329174fa818de7"><enum>(g)</enum><header>Nonapplicability of FACA</header><text>The Council shall not be subject to the requirements under the Federal Advisory Committee Act (5 U.S.C. App.).</text>
 </subsection><subsection id="idda763164326448df82cdef6602b4049d"><enum>(h)</enum><header>Sunset</header><text>The Council shall terminate on September 30, 2020.</text> </subsection></section><section id="id152B0B8E405B46E1A1405D0BF58E7291"><enum>116.</enum><header>Bringing Missing Children Home Act</header> <subsection id="id3E08CDAC6A034FFFB83C6F08C9D0F89D"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote>Bringing Missing Children Home Act</quote>.</text>
 </subsection><subsection commented="no" id="idE22515A7C4DF49D2B722BB3C3E6D40A9"><enum>(b)</enum><header>Crime Control Act amendments</header><text>Section 3702 of the Crime Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/5780">42 U.S.C. 5780</external-xref>) is amended—</text> <paragraph commented="no" id="id49A670D5AA88414D9B5C5B56A6416FD0"><enum>(1)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text>

						</subparagraph></paragraph></subsection></section><section id="id74688de9-10cd-49b8-8ccb-03920c3ea173"><enum>117.</enum><header>Grant accountability</header>
 <subsection id="id84c6730a-e31e-4d5f-86f8-733d3efc24bd"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>covered grant</term> means a grant awarded by the Attorney General under section 203 of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/14044b">42 U.S.C. 14044b</external-xref>), as amended by section 103.</text>
 </subsection><subsection id="id47800a2e-99bb-4f89-9199-d55bc4396148"><enum>(b)</enum><header>Accountability</header><text display-inline="yes-display-inline">All covered grants shall be subject to the following accountability provisions:</text>
					<paragraph id="idbbbcfad4-b625-425a-87a6-cb9c9c5b7535"><enum>(1)</enum><header>Audit requirement</header>
 <subparagraph id="idcc549b44-24a3-4c22-bee4-717584d2dc45"><enum>(A)</enum><header>In general</header><text>Beginning in the first fiscal year beginning after the date of enactment of this Act, and in each fiscal year thereafter, the Inspector General of the Department of Justice shall conduct audits of recipients of a covered grant to prevent waste, fraud, and abuse of funds by grantees. The Inspector General shall determine the appropriate number of grantees to be audited each year.</text>
 </subparagraph><subparagraph id="id82dc6a06-cce3-4ce2-bb66-4c9cc4ce24b9"><enum>(B)</enum><header>Definition</header><text>In this paragraph, the term <term>unresolved audit finding</term> means a finding in the final audit report of the Inspector General that the audited grantee has utilized grant funds for an unauthorized expenditure or otherwise unallowable cost that is not closed or resolved within 12 months from the date when the final audit report is issued.</text>
 </subparagraph><subparagraph id="id7006f2e3-b43a-4f8a-94e7-941fc94aaf22"><enum>(C)</enum><header>Mandatory exclusion</header><text>A recipient of a covered grant that is found to have an unresolved audit finding shall not be eligible to receive a covered grant during the following 2 fiscal years.</text>
 </subparagraph><subparagraph id="idac4db016-b819-4cd7-ba18-19033ae528c6"><enum>(D)</enum><header>Priority</header><text>In awarding covered grants the Attorney General shall give priority to eligible entities that did not have an unresolved audit finding during the 3 fiscal years prior to submitting an application for a covered grant.</text>
 </subparagraph><subparagraph id="id097414b6-c26a-4d62-b7eb-ee3937a840eb"><enum>(E)</enum><header>Reimbursement</header><text>If an entity is awarded a covered grant during the 2-fiscal-year period in which the entity is barred from receiving grants under subparagraph (C), the Attorney General shall—</text>
 <clause id="idec6ebc08-40bd-4b9e-9dd3-3c64b08eca91"><enum>(i)</enum><text>deposit an amount equal to the grant funds that were improperly awarded to the grantee into the General Fund of the Treasury; and</text>
 </clause><clause id="id91a2cc35-ec8e-49cb-b704-b2a57509e756"><enum>(ii)</enum><text>seek to recoup the costs of the repayment to the fund from the grant recipient that was erroneously awarded grant funds.</text>
							</clause></subparagraph></paragraph><paragraph id="id58111688-5cab-440c-a414-099f31976b02"><enum>(2)</enum><header>Nonprofit organization requirements</header>
 <subparagraph id="id2066b6a1-c8ae-4c1d-ada6-7ef8d5ef547e"><enum>(A)</enum><header>Definition</header><text>For purposes of this paragraph and covered grants, the term <term>nonprofit organization</term> means an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code.</text>
 </subparagraph><subparagraph id="id1c020ac8-d156-4818-aed1-7f3bf64b2d04"><enum>(B)</enum><header>Prohibition</header><text>The Attorney General may not award a covered grant to a nonprofit organization that holds money in offshore accounts for the purpose of avoiding paying the tax described in <external-xref legal-doc="usc" parsable-cite="usc/26/511">section 511(a)</external-xref> of the Internal Revenue Code of 1986.</text>
 </subparagraph><subparagraph id="id08a98d36-9fb2-4d9c-99f0-6399bc8a694e"><enum>(C)</enum><header>Disclosure</header><text>Each nonprofit organization that is awarded a covered grant and uses the procedures prescribed in regulations to create a rebuttable presumption of reasonableness for the compensation of its officers, directors, trustees and key employees, shall disclose to the Attorney General, in the application for the grant, the process for determining such compensation, including the independent persons involved in reviewing and approving such compensation, the comparability data used, and contemporaneous substantiation of the deliberation and decision. Upon request, the Attorney General shall make the information disclosed under this subsection available for public inspection.</text>
						</subparagraph></paragraph><paragraph id="idb3a73526-39bd-445c-a1aa-51bc12db8807"><enum>(3)</enum><header>Conference expenditures</header>
 <subparagraph id="ide2ef6a18-8a5e-4659-af65-e909cf5bd38a"><enum>(A)</enum><header>Limitation</header><text>No amounts transferred to the Department of Justice under this title, or the amendments made by this title, may be used by the Attorney General, or by any individual or organization awarded discretionary funds through a cooperative agreement under this title, or the amendments made by this title, to host or support any expenditure for conferences that uses more than $20,000 in Department funds, unless the Deputy Attorney General or such Assistant Attorney Generals, Directors, or principal deputies as the Deputy Attorney General may designate, provides prior written authorization that the funds may be expended to host a conference.</text>
 </subparagraph><subparagraph id="id75a94468-0146-4717-9070-b189937d3873"><enum>(B)</enum><header>Written approval</header><text>Written approval under subparagraph (A) shall include a written estimate of all costs associated with the conference, including the cost of all food and beverages, audiovisual equipment, honoraria for speakers, and any entertainment.</text>
 </subparagraph><subparagraph id="ide75e90cf-6b2a-4235-81c7-dc22751ea590"><enum>(C)</enum><header>Report</header><text>The Deputy Attorney General shall submit an annual report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives on all approved conference expenditures referenced in this paragraph.</text>
 </subparagraph><subparagraph id="id71117abf-46b2-4292-9dc7-8fad45f86036"><enum>(D)</enum><header>Annual certification</header><text>Beginning in the first fiscal year beginning after the date of enactment of this title, the Attorney General shall submit, to the Committee on the Judiciary and the Committee on Appropriations of the Senate and the Committee on the Judiciary and the Committee on Appropriations of the House of Representatives, an annual certification that—</text>
 <clause id="id1b7cb5ca-e501-4078-bd38-54aeeb095fe2"><enum>(i)</enum><text>all audits issued by the Office of the Inspector General under paragraph (1) have been completed and reviewed by the appropriate Assistant Attorney General or Director;</text>
 </clause><clause id="id6e0d4979-b50a-4a3c-bf01-23d4127179c8"><enum>(ii)</enum><text>all mandatory exclusions required under paragraph (1)(C) have been issued;</text> </clause><clause id="idc3b600ba-e45a-4dc7-b117-b547f868d8d6"><enum>(iii)</enum><text>all reimbursements required under paragraph (1)(E) have been made; and</text>
 </clause><clause id="id398a52c2-083a-4544-a230-361b65c560c0"><enum>(iv)</enum><text>includes a list of any grant recipients excluded under paragraph (1) from the previous year.</text> </clause></subparagraph></paragraph><paragraph id="id971c6454-faf4-45df-a2b3-ccf7eacfa475"><enum>(4)</enum><header>Prohibition on lobbying activity</header> <subparagraph id="idbae85998-84d9-48c6-b843-2de20c02bfb2"><enum>(A)</enum><header>In general</header><text>Amounts awarded under this title, or any amendments made by this title, may not be utilized by any grant recipient to—</text>
 <clause id="ida594442f-7329-4cea-99fd-99079ed28906"><enum>(i)</enum><text>lobby any representative of the Department of Justice regarding the award of grant funding; or</text>
 </clause><clause id="ide3038d60-940b-4428-93e3-7e0269adb097"><enum>(ii)</enum><text>lobby any representative of a Federal, State, local, or tribal government regarding the award of grant funding.</text>
 </clause></subparagraph><subparagraph id="id6084f90a-ca15-4f83-8e46-c6d97d347b80"><enum>(B)</enum><header>Penalty</header><text>If the Attorney General determines that any recipient of a covered grant has violated subparagraph (A), the Attorney General shall—</text>
 <clause id="idc154029d-ef1d-4e1c-b409-1e5faaaad28e"><enum>(i)</enum><text>require the grant recipient to repay the grant in full; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="idaed3515a-fb2c-4adc-a0f1-245068314147"><enum>(ii)</enum><text>prohibit the grant recipient from receiving another covered grant for not less than 5 years.</text>
							</clause></subparagraph></paragraph></subsection></section></title><title changed="added" committee-id="SSJU00" id="id64746784D4994FEAB09F779FB6254C37" reported-display-style="italic" style="OLC"><enum>II</enum><header>Combating Human Trafficking</header>
			<subtitle id="idB97E37732B5D48B88A2B9C60C2BE41CD" style="OLC"><enum>A</enum><header>Enhancing Services for Runaway and Homeless Victims of Youth Trafficking</header>
 <section id="H47E1BD4D607E48DEA226EE580BED5F17" section-type="subsequent-section"><enum>201.</enum><header>Amendments to the Runaway and Homeless Youth Act</header><text display-inline="no-display-inline">The Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5701">42 U.S.C. 5701 et seq.</external-xref>) is amended—</text> <paragraph id="HB594DFC7991B44FAB587865F53BC697E"><enum>(1)</enum><text>in section 343(b)(5) (<external-xref legal-doc="usc" parsable-cite="usc/42/5714-23">42 U.S.C. 5714–23(b)(5)</external-xref>)—</text>

					</paragraph></section></subtitle><subtitle id="id86BB8D20C30C4EBB9B3426F8401B8DE2" style="OLC"><enum>B</enum><header>Improving the Response to Victims of Child Sex Trafficking</header>
 <section commented="no" display-inline="no-display-inline" id="idF260F30D174C4D4899F501DB4D54A8A4" section-type="subsequent-section"><enum>211.</enum><header display-inline="yes-display-inline">Response to victims of child sex trafficking</header><text display-inline="no-display-inline">Section 404(b)(1)(P)(iii) of the Missing Children’s Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5773">42 U.S.C. 5773(b)(1)(P)(iii)</external-xref>) is amended by striking <quote>child prostitution</quote> and inserting <quote>child sex trafficking, including child prostitution</quote>.</text> </section></subtitle><subtitle id="id822FBC201EEC425AAFC75A9377D73586" style="OLC"><enum>C</enum><header>Interagency Task Force to Monitor and Combat Trafficking</header> <section commented="no" display-inline="no-display-inline" id="H8F6F87D35328459F8F38D7FEFDDD8880" section-type="subsequent-section"><enum>221.</enum><header display-inline="yes-display-inline">Victim of trafficking defined</header><text display-inline="no-display-inline">In this subtitle, the term <term>victim of trafficking</term> has the meaning given such term in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text>
				</section><section id="HBB0D4F1028B64C4ABE5EC1FF97DD4A83"><enum>222.</enum><header>Interagency task force report on child trafficking primary prevention</header>
 <subsection id="H9F23C4AFC8474D6E9AC31A8B5A157AF3"><enum>(a)</enum><header>Review</header><text>The Interagency Task Force to Monitor and Combat Trafficking, established under section 105 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103</external-xref>), shall conduct a review that, with regard to trafficking in persons in the United States—</text>
 <paragraph id="H858329EC255E485FB18794473B8EEE92"><enum>(1)</enum><text>in consultation with nongovernmental organizations that the Task Force determines appropriate, surveys and catalogs the activities of the Federal Government and State governments—</text>
 <subparagraph id="id13498632B9694736BD1CB225313BE341"><enum>(A)</enum><text>to deter individuals from committing trafficking offenses; and</text> </subparagraph><subparagraph id="idEEB6F855CB6E4AEC9EC61A80744F3BF6"><enum>(B)</enum><text>to prevent children from becoming victims of trafficking;</text>
 </subparagraph></paragraph><paragraph id="H0DB87D0F7E2743B2B85869BD0AC84B87"><enum>(2)</enum><text>surveys academic literature on—</text> <subparagraph id="id7277FB56D8F642B29EAFFD082A83624B"><enum>(A)</enum><text>deterring individuals from committing trafficking offenses;</text>
 </subparagraph><subparagraph id="id567B0BE3730449779EB8892DEA8B8F18"><enum>(B)</enum><text>preventing children from becoming victims of trafficking;</text> </subparagraph><subparagraph id="id04E734049CB54E52BEF30C3BD36DF972"><enum>(C)</enum><text>the commercial sexual exploitation of children; and</text>
 </subparagraph><subparagraph id="id31A9B60AB5074A09A7D8F92E1CEE11D2"><enum>(D)</enum><text>other similar topics that the Task Force determines to be appropriate;</text>
 </subparagraph></paragraph><paragraph id="H246327A324CF42D7B523155BDF322623"><enum>(3)</enum><text>identifies best practices and effective strategies—</text> <subparagraph id="id6908DE6CE8B54CF3880F33864A8403A9"><enum>(A)</enum><text>to deter individuals from committing trafficking offenses; and</text>
 </subparagraph><subparagraph id="id55BABF870BF64BCEAA34C596CE2B79D3"><enum>(B)</enum><text>to prevent children from becoming victims of trafficking; and</text> </subparagraph></paragraph><paragraph id="HA5E4D9396A6B471BB83467D39371E8F5"><enum>(4)</enum><text>identifies current gaps in research and data that would be helpful in formulating effective strategies—</text>
 <subparagraph id="id4E0F3953155045EE9FF184CAD5B2EF74"><enum>(A)</enum><text>to deter individuals from committing trafficking offenses; and</text> </subparagraph><subparagraph id="id60DCFBB8F0FE4B4384C6259469C831E5"><enum>(B)</enum><text>to prevent children from becoming victims of trafficking.</text>
 </subparagraph></paragraph></subsection><subsection id="H94FA919AE2F14C3898E25B6CDC9CAA8D"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Interagency Task Force to Monitor and Combat Trafficking shall provide to Congress, and make publicly available in electronic format, a report on the review conducted pursuant to subparagraph (a).</text>
 </subsection></section><section id="H727B2C4580DB413DBF90B5D3452B4F68"><enum>223.</enum><header>GAO Report on intervention</header><text display-inline="no-display-inline">On the date that is 1 year after the date of the enactment of this Act, the Comptroller General of the United States shall submit a report to Congress that includes information on—</text>
 <paragraph id="H5EA6E177D9BC46338E4F7693E1889726"><enum>(1)</enum><text>the efforts of Federal and select State law enforcement agencies to combat human trafficking in the United States; and</text>
 </paragraph><paragraph id="H4A915C0FC3454C01B84A597FCB32E40F"><enum>(2)</enum><text display-inline="yes-display-inline">each Federal grant program, a purpose of which is to combat human trafficking or assist victims of trafficking, as specified in an authorizing statute or in a guidance document issued by the agency carrying out the grant program.</text>
 </paragraph></section><section commented="no" display-inline="no-display-inline" id="HFEC02BD9959B41E9912933C3B7A2DEDD"><enum>224.</enum><header>Provision of housing permitted to protect and assist in the recovery of victims of trafficking</header><text display-inline="no-display-inline">Section 107(b)(2)(A) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105(b)(2)(A)</external-xref>) is amended by inserting <quote>, including programs that provide housing to victims of trafficking</quote> before the period at the end.</text> </section></subtitle></title><title changed="added" committee-id="SSJU00" id="id7CE9BD974DCD4B8DB329120AE9B65BD5" reported-display-style="italic" style="OLC"><enum>III</enum><header>HERO Act</header> <section id="idba0449f37c20451cb4c0135c758e6a82" section-type="subsequent-section"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Human Exploitation Rescue Operations Act of 2015</short-title></quote> or the <quote><short-title>HERO Act of 2015</short-title></quote>.</text>
			</section><section id="id2A8CE7A29019495D97115FB533910093"><enum>302.</enum><header>HERO Act</header>
 <subsection id="idB2E31DF9BB214ACEB0A111586BEC0413"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text> <paragraph id="id41c2815731ba4051bda9b108bf01c9d0"><enum>(1)</enum><text>The illegal market for the production and distribution of child abuse imagery is a growing threat to children in the United States. International demand for this material creates a powerful incentive for the rape, abuse, and torture of children within the United States.</text>
 </paragraph><paragraph id="id49379776922c487da5268969414ddad2"><enum>(2)</enum><text>The targeting of United States children by international criminal networks is a threat to the homeland security of the United States. This threat must be fought with trained personnel and highly specialized counter-child-exploitation strategies and technologies.</text>
 </paragraph><paragraph id="idb494881e1db449c7864165c6c406cff3"><enum>(3)</enum><text>The United States Immigration and Customs Enforcement of the Department of Homeland Security serves a critical national security role in protecting the United States from the growing international threat of child exploitation and human trafficking.</text>
 </paragraph><paragraph id="ide251d153de4041e389c61cd60b59e423"><enum>(4)</enum><text>The Cyber Crimes Center of the United States Immigration and Customs Enforcement is a vital national resource in the effort to combat international child exploitation, providing advanced expertise and assistance in investigations, computer forensics, and victim identification.</text>
 </paragraph><paragraph id="ida5a8dcb63f504058be7adc7d1940c111"><enum>(5)</enum><text>The returning military heroes of the United States possess unique and valuable skills that can assist law enforcement in combating global sexual and child exploitation, and the Department of Homeland Security should use this national resource to the maximum extent possible.</text>
 </paragraph><paragraph id="id908da2dc81db46eaae28339372b4d7b2"><enum>(6)</enum><text>Through the Human Exploitation Rescue Operative (HERO) Child Rescue Corps program, the returning military heroes of the United States are trained and hired to investigate crimes of child exploitation in order to target predators and rescue children from sexual abuse and slavery.</text>
					</paragraph></subsection><subsection id="idc716b562208946dc930508efb4ea2ca1"><enum>(b)</enum><header>Cyber crimes center, child exploitation investigations unit, and computer forensics unit</header>
 <paragraph id="id22E8CA521319482E83105D5E770FD4DA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle H of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/451">6 U.S.C. 451 et seq.</external-xref>) is amended by adding at the end the following:</text>

							<section id="idf13e6d6b108d4fefb9d0c3fdb92cfa1c"><enum>890A.</enum><header>Cyber crimes center, child exploitation investigations unit, computer forensics unit, and cyber
			 crimes unit</header>
								<subsection id="id7682c1a9902a47db9f2ceeba9f775ee2"><enum>(a)</enum><header>Cyber crimes center</header>
 <paragraph id="id9be48a1f8f3246e995c812a10086086f"><enum>(1)</enum><header>In general</header><text>The Secretary shall operate, within United States Immigration and Customs Enforcement, a Cyber Crimes Center (referred to in this section as the <quote>Center</quote>).</text>
 </paragraph><paragraph id="id2858ee864c7f44ebb57ca24bba458f2c"><enum>(2)</enum><header>Purpose</header><text>The purpose of the Center shall be to provide investigative assistance, training, and equipment to support United States Immigration and Customs Enforcement’s domestic and international investigations of cyber-related crimes.</text>
									</paragraph></subsection><subsection id="idd87d82b0013046ca9579ff8cd2e21ac9"><enum>(b)</enum><header>Child exploitation investigations unit</header>
 <paragraph id="id5002f5c467934126ab2ac5646b6c18da"><enum>(1)</enum><header>In general</header><text>The Secretary shall operate, within the Center, a Child Exploitation Investigations Unit (referred to in this subsection as the <quote>CEIU</quote>).</text>
 </paragraph><paragraph id="id393563217ce541be93b41b199be43364"><enum>(2)</enum><header>Functions</header><text>The CEIU—</text> <subparagraph id="id949491a4d99e45d6bcc3cc0769beb3c6"><enum>(A)</enum><text>shall coordinate all United States Immigration and Customs Enforcement child exploitation initiatives, including investigations into—</text>
 <clause id="ide758c10a97824a9b8df74949b4793156"><enum>(i)</enum><text>child exploitation;</text> </clause><clause id="idb2b00c4c74de49e9a5c9ab384b899f5c"><enum>(ii)</enum><text>child pornography;</text>
 </clause><clause id="id9ddd6172d5ac4430aee96b430aa86036"><enum>(iii)</enum><text>child victim identification;</text> </clause><clause id="idc26e4e6dc8e048909e604d6171aa37b7"><enum>(iv)</enum><text>traveling child sex offenders; and</text>
 </clause><clause id="id44ba0a9d3f7448749ecfdb35d9e27b22"><enum>(v)</enum><text>forced child labor, including the sexual exploitation of minors;</text> </clause></subparagraph><subparagraph id="ida611aa6f60524a6fba49ba426c43ef1f"><enum>(B)</enum><text>shall, among other things, focus on—</text>
 <clause id="id75b576e4982442c99daeecd92a54506d"><enum>(i)</enum><text>child exploitation prevention;</text> </clause><clause id="id5486b63efc614012ae6fc51b8bc9ef60"><enum>(ii)</enum><text>investigative capacity building;</text>
 </clause><clause id="id2ae9e0ea1c99429aa3a17b0998c94056"><enum>(iii)</enum><text>enforcement operations; and</text> </clause><clause id="id2df3124d319349aa89b5b500c8de0bd9"><enum>(iv)</enum><text>training for Federal, State, local, tribal, and foreign law enforcement agency personnel, upon request;</text>
 </clause></subparagraph><subparagraph id="ida54eae3836cb420cab3e376b8628e84a"><enum>(C)</enum><text>shall provide training, technical expertise, support, or coordination of child exploitation investigations, as needed, to cooperating law enforcement agencies and personnel;</text>
 </subparagraph><subparagraph id="id5cef996b31a14820a13d906449c69363"><enum>(D)</enum><text>shall provide psychological support and counseling services for United States Immigration and Customs Enforcement personnel engaged in child exploitation prevention initiatives, including making available other existing services to assist employees who are exposed to child exploitation material during investigations;</text>
 </subparagraph><subparagraph id="idedb21a6eec2f461abc804c19c585c357"><enum>(E)</enum><text>is authorized to collaborate with the Department of Defense and the National Association to Protect Children for the purpose of the recruiting, training, equipping and hiring of wounded, ill, and injured veterans and transitioning service members, through the Human Exploitation Rescue Operative (HERO) Child Rescue Corps program; and</text>
 </subparagraph><subparagraph id="id363fa422d2b14eeaacf08c5423436c75"><enum>(F)</enum><text>shall collaborate with other governmental, nongovernmental, and nonprofit entities approved by the Secretary for the sponsorship of, and participation in, outreach and training activities.</text>
 </subparagraph></paragraph><paragraph id="iddaef2c017711454c99a4e4d63f775a5d"><enum>(3)</enum><header>Data collection</header><text>The CEIU shall collect and maintain data concerning—</text> <subparagraph id="ida04c7d6798f34f0692e8324241d8eff6"><enum>(A)</enum><text>the total number of suspects identified by United States Immigration and Customs Enforcement;</text>
 </subparagraph><subparagraph id="id3f98ccde48474de8a474f57ea62e5930"><enum>(B)</enum><text>the number of arrests by United States Immigration and Customs Enforcement, disaggregated by type, including—</text>
 <clause id="id2c851d35f40f41b7aff935dc698ee9ca"><enum>(i)</enum><text>the number of victims identified through investigations carried out by United States Immigration and Customs Enforcement; and</text>
 </clause><clause id="ide73786fbdf1b4856a2ec448af8f842b9"><enum>(ii)</enum><text>the number of suspects arrested who were in positions of trust or authority over children;</text> </clause></subparagraph><subparagraph id="ide8f14148750247e08d5e5404661b6b47"><enum>(C)</enum><text>the number of cases opened for investigation by United States Immigration and Customs Enforcement; and</text>
 </subparagraph><subparagraph id="id7f0ee14bf3194703872aa55cb6afebf2"><enum>(D)</enum><text>the number of cases resulting in a Federal, State, foreign, or military prosecution.</text> </subparagraph></paragraph><paragraph id="idf9fcde62eb04448db93f06136ec9804f"><enum>(4)</enum><header>Availability of data to Congress</header><text>In addition to submitting the reports required under paragraph (7), the CEIU shall make the data collected and maintained under paragraph (3) available to the committees of Congress described in paragraph (7).</text>
 </paragraph><paragraph id="idc90207883fa94931841fae60d9064c1e"><enum>(5)</enum><header>Cooperative agreements</header><text>The CEIU is authorized to enter into cooperative agreements to accomplish the functions set forth in paragraphs (2) and (3).</text>
									</paragraph><paragraph id="id4121b0684713443791c1e6456b6cf129"><enum>(6)</enum><header>Acceptance of gifts</header>
 <subparagraph id="id6b287d7df5254f54a4959babc33eb4aa"><enum>(A)</enum><header>In general</header><text>The Secretary is authorized to accept monies and in-kind donations from the Virtual Global Taskforce, national laboratories, Federal agencies, not-for-profit organizations, and educational institutions to create and expand public awareness campaigns in support of the functions of the CEIU.</text>
 </subparagraph><subparagraph id="id683349e29e0a49099fa5db2b040c977b"><enum>(B)</enum><header>Exemption from Federal acquisition regulation</header><text>Gifts authorized under subparagraph (A) shall not be subject to the Federal Acquisition Regulation for competition when the services provided by the entities referred to in such subparagraph are donated or of minimal cost to the Department.</text>
 </subparagraph></paragraph><paragraph id="id48106638329e4ceabdc4577916b55121"><enum>(7)</enum><header>Reports</header><text>Not later than 1 year after the date of the enactment of the <short-title>HERO Act of 2015</short-title>, and annually for the following 4 years, the CEIU shall—</text>
 <subparagraph id="id33a9bb4c90b64723ac9c6647315d61fe"><enum>(A)</enum><text>submit a report containing a summary of the data collected pursuant to paragraph (3) during the previous year to—</text>
 <clause id="id426d8f48b94a43e785460acc8065f60d"><enum>(i)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text> </clause><clause id="idb99126d0773949cb96d3ef2abf782b2f"><enum>(ii)</enum><text>the Committee on the Judiciary of the Senate;</text>
 </clause><clause id="id45384a3d718e4abaa2439a576cad2ea6"><enum>(iii)</enum><text>the Committee on Appropriations of the Senate;</text> </clause><clause id="id075df676c7f649f68a55468652f9cb24"><enum>(iv)</enum><text>the Committee on Homeland Security of the House of Representatives;</text>
 </clause><clause id="id10d3fac171364a66955612c4f6fbff3c"><enum>(v)</enum><text>the Committee on the Judiciary of the House of Representatives; and</text> </clause><clause id="idae9c228ab5e44262ac9632a984e91461"><enum>(vi)</enum><text>the Committee on Appropriations of the House of Representatives; and</text>
 </clause></subparagraph><subparagraph id="id6389300c911f41cf84590e562a227461"><enum>(B)</enum><text>make a copy of each report submitted under subparagraph (A) publicly available on the website of the Department.</text>
										</subparagraph></paragraph></subsection><subsection id="id8e1c088115ae49ba92299ab1e7ecadfc"><enum>(c)</enum><header>Computer forensics unit</header>
 <paragraph id="id7d09cab020d047f48a041f32e5e8b7dd"><enum>(1)</enum><header>In general</header><text>The Secretary shall operate, within the Center, a Computer Forensics Unit (referred to in this subsection as the <quote>CFU</quote>).</text>
 </paragraph><paragraph id="id2de8ff8dfaff4807b2b5054d506f6923"><enum>(2)</enum><header>Functions</header><text>The CFU—</text> <subparagraph id="id1d0a1aeb681149458bea5f00e75ab317"><enum>(A)</enum><text>shall provide training and technical support in digital forensics to—</text>
 <clause id="id5f87dd720a2a4587a931bf29616e6897"><enum>(i)</enum><text>United States Immigration and Customs Enforcement personnel; and</text> </clause><clause id="id76eea9167508455d93aa6a681d4b6315"><enum>(ii)</enum><text>Federal, State, local, tribal, military, and foreign law enforcement agency personnel engaged in the investigation of crimes within their respective jurisdictions, upon request and subject to the availability of funds;</text>
 </clause></subparagraph><subparagraph id="id19d9bc2ce2814da8bd876d457d0ec9e9"><enum>(B)</enum><text>shall provide computer hardware, software, and forensic licenses for all computer forensics personnel within United States Immigration and Customs Enforcement;</text>
 </subparagraph><subparagraph id="id91f17fb4cd3a47598f8b50982b913523"><enum>(C)</enum><text>shall participate in research and development in the area of digital forensics, in coordination with appropriate components of the Department; and</text>
 </subparagraph><subparagraph id="id956e68b5aa434db9b8df0c7c1d4eb5e8"><enum>(D)</enum><text>is authorized to collaborate with the Department of Defense and the National Association to Protect Children for the purpose of recruiting, training, equipping, and hiring wounded, ill, and injured veterans and transitioning service members, through the Human Exploitation Rescue Operative (HERO) Child Rescue Corps program.</text>
 </subparagraph></paragraph><paragraph id="id1aa788bb483d4e8ea672846d74d2237a"><enum>(3)</enum><header>Cooperative agreements</header><text>The CFU is authorized to enter into cooperative agreements to accomplish the functions set forth in paragraph (2).</text>
									</paragraph><paragraph id="idff3fa0bf28a94ff2bc831c0bf7a6c6ea"><enum>(4)</enum><header>Acceptance of gifts</header>

 <paragraph id="id56a64595629f4739a2618558e766e24f"><enum>(1)</enum><header>In general</header><text>The Secretary shall operate, within the Center, a Cyber Crimes Unit (referred to in this subsection as the <quote>CCU</quote>).</text>
 </paragraph><paragraph id="id45398ac968c54f14b47419dce8a17b96"><enum>(2)</enum><header>Functions</header><text>The CCU—</text> <subparagraph id="id8b12fb31715f4e06899838aeb5526d8c"><enum>(A)</enum><text>shall oversee the cyber security strategy and cyber-related operations and programs for United States Immigration and Customs Enforcement;</text>
 </subparagraph><subparagraph id="id6436d033f21642279bfb337801ca6655"><enum>(B)</enum><text>shall enhance United States Immigration and Customs Enforcement’s ability to combat criminal enterprises operating on or through the Internet, with specific focus in the areas of—</text>
 <clause id="id8098a8a2c8034d7d92eb72eedc33f6de"><enum>(i)</enum><text>cyber economic crime;</text> </clause><clause id="idcbd0f20c64bf4c188b424701b0f9b830"><enum>(ii)</enum><text>digital theft of intellectual property;</text>
 </clause><clause id="id1bba373648d64942b9f302c67cf95810"><enum>(iii)</enum><text>illicit e-commerce (including hidden marketplaces);</text> </clause><clause id="id8357f47b10c44c8789866cd015e150d8"><enum>(iv)</enum><text>Internet-facilitated proliferation of arms and strategic technology; and</text>
 </clause><clause id="id1fb50e0625284b18a2be2da29834a19e"><enum>(v)</enum><text>cyber-enabled smuggling and money laundering;</text> </clause></subparagraph><subparagraph id="id8d0a1c0f542b408e940749ab4e242564"><enum>(C)</enum><text>shall provide training and technical support in cyber investigations to—</text>
 <clause id="id52a3be0e09394205aea69559f7fec078"><enum>(i)</enum><text>United States Immigration and Customs Enforcement personnel; and</text> </clause><clause id="id06c56e81a96243cc9502bfa5fa41c3cc"><enum>(ii)</enum><text>Federal, State, local, tribal, military, and foreign law enforcement agency personnel engaged in the investigation of crimes within their respective jurisdictions, upon request and subject to the availability of funds;</text>
 </clause></subparagraph><subparagraph id="ida09831b7f264429bafe2f59c4bdb85f6"><enum>(D)</enum><text>shall participate in research and development in the area of cyber investigations, in coordination with appropriate components of the Department; and</text>
 </subparagraph><subparagraph id="idb2f90d1a61d84a48a5d0ca99e5119a20"><enum>(E)</enum><text>is authorized to recruit participants of the Human Exploitation Rescue Operative (HERO) Child Rescue Corps program for investigative and forensic positions in support of the functions of the CCU.</text>

 </paragraph></subsection><subsection id="idcd9be04c1ad14713b805943306472dc3"><enum>(c)</enum><header>HERO corps hiring</header><text display-inline="yes-display-inline">It is the sense of Congress that Homeland Security Investigations of the United States Immigration and Customs Enforcement should hire, recruit, train, and equip wounded, ill, or injured military veterans (as defined in section 101, title 38, United States Code) who are affiliated with the HERO Child Rescue Corps program for investigative, intelligence, analyst, and forensic positions.</text>
 </subsection><subsection id="id8e9fde5732cc45179506c169a17ff752"><enum>(d)</enum><header>Investigating child exploitation</header><text display-inline="yes-display-inline">Section 307(b)(3) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/187">6 U.S.C. 187(b)(3)</external-xref>) is amended—</text> <paragraph id="id2ed4cfb2370543849b9f14ce93eeb739"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text>
 </paragraph><paragraph id="id0e3e7054568649e58e9a5dff16221603"><enum>(2)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph><paragraph id="ida274922365844f7596a1b0eece065338"><enum>(3)</enum><text>by adding at the end the following:</text>
