			 authorities to select individuals from competitive service
			 certificates.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
 <section commented="no" display-inline="no-display-inline" id="H5A82B28231144B5B8743154FC8802E9F" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Competitive Service Act of 2015</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="HB0CBE3EE7EDC4A7C9E7958EF975BCAF0" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Additional appointing authorities for competitive service</header> <subsection commented="no" display-inline="no-display-inline" id="HCC480247EE564FBE8D8EE619C653BB8E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 3318 of title 5, United States Code, is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H6A6AF1AF1CD24C0882EB02D95069A6CA"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (b) and (c) as subsections (c) and (d), respectively; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9E2D79C8FCC04E5097B18073DCA6707D"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the following:</text>

						<subsection commented="no" display-inline="no-display-inline" id="H83B27033E9E34EE6AE8433DE0DA21B7D"><enum>(b)</enum><header display-inline="yes-display-inline">Other appointing authorities</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H3ADA66515259470895975556CF6CA0D6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">During the 240-day period beginning on the date of issuance of a certificate of eligibles under section 3317(a), an appointing authority other than the appointing authority requesting the certificate (in this subsection referred to as the <quote>other appointing authority</quote>) may select an individual from that certificate in accordance with this subsection for an appointment to a position that is—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H6E9FE6BAFC974EBC80183C906D8ED57B"><enum>(A)</enum><text display-inline="yes-display-inline">in the same occupational series as the position for which the certification of eligibles was issued (in this subsection referred to as the <quote>original position</quote>); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6945C3A1F8DA437FAE4197F2116578BD"><enum>(B)</enum><text display-inline="yes-display-inline">at a similar grade level as the original position.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE7BA4BD4D3424AF982200C7499C53D72"><enum>(2)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">An appointing authority requesting a certificate of eligibles may share the certificate with another appointing authority only if the announcement of the original position provided notice that the resulting list of eligible candidates may be used by another appointing authority.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBE6CD1B225B742BAB45AAB0C5075E3A9"><enum>(3)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The selection of an individual under paragraph (1)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H988BA343A3994CFA8F1487B11272976C"><enum>(A)</enum><text display-inline="yes-display-inline">shall be made in accordance with subsection (a); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC4CDB11A26C14B649DFC9CF2AD1A39D3"><enum>(B)</enum><text display-inline="yes-display-inline">subject to paragraph (4), may be made without any additional posting under section 3327.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H02C3ECE3F10643B48A2328C14AE4CE16"><enum>(4)</enum><header display-inline="yes-display-inline">Internal notice</header><text display-inline="yes-display-inline">Before selecting an individual under paragraph (1), and subject to the requirements of any collective bargaining obligation of the other appointing authority, the other appointing authority shall—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H32FCA0A7885C48798AD4505BE650E3D9"><enum>(A)</enum><text display-inline="yes-display-inline">provide notice of the available position to employees of the other appointing authority;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H61B66DD47DED45779B7EA31780805D93"><enum>(B)</enum><text display-inline="yes-display-inline">provide up to 10 business days for employees of the other appointing authority to apply for the position; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD7391CE6382646E2833D11A8E936B2B1"><enum>(C)</enum><text display-inline="yes-display-inline">review the qualifications of employees submitting an application.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H999D815223034800BD61FF16F148DA92"><enum>(5)</enum><header display-inline="yes-display-inline">Collective bargaining obligations</header><text display-inline="yes-display-inline">Nothing in this subsection limits any collective bargaining obligation of an agency under chapter 71.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5A62AB55721E47CAA01D7138FF50E623"><enum>(b)</enum><header display-inline="yes-display-inline">Alternative ranking and selection procedures</header><text display-inline="yes-display-inline">Section 3319 of title 5, United States Code, is amended by striking subsection (c) and inserting the following:</text>

					<subsection commented="no" display-inline="no-display-inline" id="HC2A8D5D9A99949C8B231F15D4DA61E79"><enum>(c)</enum><header display-inline="yes-display-inline">Selection</header>
 <paragraph commented="no" display-inline="no-display-inline" id="HE5A2909F78BE4C3FA855797F8BE898CF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An appointing official may select any applicant in the highest quality category or, if fewer than 3 candidates have been assigned to the highest quality category, in a merged category consisting of the highest and the second highest quality categories.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H441E51E3BE4741F881684FA209BBB7A3"><enum>(2)</enum><header display-inline="yes-display-inline">Use by other appointing officials</header><text display-inline="yes-display-inline">Under regulations prescribed by the Office of Personnel Management, appointing officials other than the appointing official described in paragraph (1) (in this subsection referred to as the <quote>other appointing official</quote>) may select an applicant for an appointment to a position that is—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H029A09D2FB7F44B795F0B87951B08F46"><enum>(A)</enum><text display-inline="yes-display-inline">in the same occupational series as the position for which the certification of eligibles was issued (in this subsection referred to as the <quote>original position</quote>); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H04608E3FE1EF4FF4936BE4537E0B617C"><enum>(B)</enum><text display-inline="yes-display-inline">at a similar grade level as the original position.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H670A7C28492A4E2EA36DF398947DDB26"><enum>(3)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">An appointing authority requesting a certificate of eligibles may share the certificate with another appointing authority only if the announcement of the original position provided notice that the resulting list of eligible candidates may be used by another appointing authority.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE061A275A9BD450EB703756235863AF8"><enum>(4)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The selection of an individual under paragraph (2)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HC46EA57DA8534371B02664E6B2F9E646"><enum>(A)</enum><text display-inline="yes-display-inline">shall be made in accordance with this subsection; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF1EF3D7CE06A43998FC1F8BB6259AA31"><enum>(B)</enum><text display-inline="yes-display-inline">subject to paragraph (5), may be made without any additional posting under section 3327.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H78E20197CDE5428B8CFA01621C112B91"><enum>(5)</enum><header display-inline="yes-display-inline">Internal notice</header><text display-inline="yes-display-inline">Before selecting an individual under paragraph (2), and subject to the requirements of any collective bargaining obligation of the other appointing authority (within the meaning given that term in section 3318(b)(1)), the other appointing official shall—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HB14DD447355D4BAE8ED406911399F835"><enum>(A)</enum><text display-inline="yes-display-inline">provide notice of the available position to employees of the appointing authority employing the other appointing official;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H57580E9771E74020985D2C73B6E47181"><enum>(B)</enum><text display-inline="yes-display-inline">provide up to 10 business days for employees of the other appointing authority to apply for the position; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H841B3DE1CE8E476BB4C3E94D7B4DCBDA"><enum>(C)</enum><text display-inline="yes-display-inline">review the qualifications of employees submitting an application.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H42BC118D526943C4AF62D2DF710E7D69"><enum>(6)</enum><header display-inline="yes-display-inline">Collective bargaining obligations</header><text display-inline="yes-display-inline">Nothing in this subsection limits any collective bargaining obligation of an agency under chapter 71.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF5FF4065FF6C4483B6981E74A262D232"><enum>(7)</enum><header display-inline="yes-display-inline">Preference eligibles</header><text display-inline="yes-display-inline">Notwithstanding paragraphs (1) and (2), an appointing official may not pass over a preference eligible in the same category from which selection is made, unless the requirements of section 3317(b) and 3318(c), as applicable, are satisfied.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H76AC7E02C0AD4393B8D1273027CF8294"><enum>(c)</enum><header display-inline="yes-display-inline">Technical and conforming amendment</header><text display-inline="yes-display-inline">Section 9510(b)(5) of title 5, United States Code, is amended by striking <quote>3318(b)</quote> and inserting <quote>3318(c)</quote>.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="HB02724F20689445FA695EB96EABAC0C3"><enum>(d)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Director of the Office of Personnel Management shall issue an interim final rule with comment to carry out the amendments made by this section.</text></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
