<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Representative Payee Fraud Prevention Act of 2015</short-title></quote>.</text> </section> <section commented="no" display-inline="no-display-inline" id="id2CAA1623CD9E4321BAC37C9C29BC4B2F" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Representative Payee Fraud</header> <subsection commented="no" display-inline="no-display-inline" id="id6F08A9BF627542DFBA740E4A9A291961"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header> <paragraph commented="no" display-inline="no-display-inline" id="idC1405F2051E74DC5B0F30F6923BC6364"><enum>(1)</enum><header display-inline="yes-display-inline">CSRS</header><text display-inline="yes-display-inline">Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/83">chapter 83</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/8345">section 8345</external-xref> the following:</text>

<section commented="no" display-inline="no-display-inline" id="id83201d41ae064628841c5ebbfb6fee08" section-type="subsequent-section"><enum>8345a.</enum><header display-inline="yes-display-inline">Embezzlement or conversion of payments</header> 
<subsection commented="no" display-inline="no-display-inline" id="id09d066dd20174f3ba46ad41ebd02f495"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">It shall be unlawful for any person that is authorized by the Office under section 8345(e) to receive payments on behalf of a minor or an individual mentally incompetent or under other legal disability to embezzle or in any manner convert all or any part of the amounts received from such payments to a use other than for the use and benefit of such minor or individual.</text> </subsection> <subsection commented="no" display-inline="no-display-inline" id="id2AD7BB7C9ABD4554BE28998CAA19D373"><enum>(b)</enum><header display-inline="yes-display-inline">Penalty</header><text display-inline="yes-display-inline">Any person who violates subsection (a) shall be fined under title 18, imprisoned for not more than 5 years, or both.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="ida218bdf915b54a0ba38e4d725dd9bb40"><enum>(c)</enum><header display-inline="yes-display-inline">Prima facie evidence</header><text display-inline="yes-display-inline">Any willful neglect or refusal to make and file proper accountings or reports concerning the amounts received from payments authorized under section 8345(e) as required by law shall be taken to be sufficient evidence prima facie of the embezzlement or conversion of such amounts.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idAD6B450212F24E61B11C8A3D5473B5B8"><enum>(2)</enum><header display-inline="yes-display-inline">FERS</header><text display-inline="yes-display-inline">Subchapter VI of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/8466">section 8466</external-xref> the following:</text>

<section commented="no" display-inline="no-display-inline" id="id6026E879E4FD433DB82881BF6650F382" section-type="subsequent-section"><enum>8466a.</enum><header display-inline="yes-display-inline">Embezzlement or conversion of payments</header> 
<subsection commented="no" display-inline="no-display-inline" id="id315F9C1E8EE440DD8F33BC54FE993AF6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">It shall be unlawful for any person that is authorized by the Office under section 8466(c) to receive payments on behalf of a minor or an individual mentally incompetent or under other legal disability to embezzle or in any manner convert all or any part of the amounts received from such payments to a use other than for the use and benefit of such minor or individual.</text> </subsection> <subsection commented="no" display-inline="no-display-inline" id="id250E655632AE498A86FD0BEDFF8ADF29"><enum>(b)</enum><header display-inline="yes-display-inline">Penalty</header><text display-inline="yes-display-inline">Any person who violates subsection (a) shall be fined under title 18, imprisoned for not more than 5 years, or both.</text> </subsection>

Embezzlement or conversion of payments.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id4313ff4c2fe64ad28129ea7913a04093"><enum>(b)</enum><header display-inline="yes-display-inline">Limitations on appointments of representative payees</header> <paragraph commented="no" display-inline="no-display-inline" id="idA3580B5F6B884BC78CBC44977EF05F38"><enum>(1)</enum><header display-inline="yes-display-inline">CSRS</header><text display-inline="yes-display-inline">Section 8345 of title 5, United States Code, is amended by inserting after subsection (e) the following:</text>

<subsection commented="no" display-inline="no-display-inline" id="id502ee1bb19c6408aad6bbeac663d8487"><enum>(f)</enum><text display-inline="yes-display-inline">The Office may not authorize a person to receive payments on behalf of a minor or individual of legal disability under subsection (e) if that person has been convicted of a violation of—</text> <paragraph commented="no" display-inline="no-display-inline" id="id4EAD034B29BE4D7C9B0A7F7EF6A9F5A9"><enum>(1)</enum><text display-inline="yes-display-inline">section 8345a or 8466a;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="id153AC86CD72343DA9A34D745BA5B704F"><enum>(2)</enum><text display-inline="yes-display-inline">section 208 or 1632 of the Social Security Act (42 U.S.C. 408 and 1383a); or</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idC2CAE0ADC4584A838CA77D1B1675A31B"><enum>(3)</enum><text display-inline="yes-display-inline">section 6101 of title 38, United States Code.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="id004D6456010345CAA944D94B78B0DBFC"><enum>(2)</enum><header display-inline="yes-display-inline">FERS</header><text display-inline="yes-display-inline">Section 8466 of title 5, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id65275857656D48C0B06DA056CFBE5C05" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="id67D06686932A4B6F9F844DD8727F3A37"><enum>(d)</enum><text display-inline="yes-display-inline">The Office may not authorize a person to receive payments on behalf of a minor or individual of legal disability under subsection (c) if that person has been convicted of a violation of—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="idC0EC3DB41C2444AD83C53EA7A5E169D6"><enum>(1)</enum><text display-inline="yes-display-inline">section 8345a or 8466a;</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id33F0D23A3F0C4CF799BF3432267CA956"><enum>(2)</enum><text display-inline="yes-display-inline">section 208 or 1632 of the Social Security Act (42 U.S.C. 408 and 1383a); or</text> </paragraph>
