 for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H45E0874E661740ACA573674CEF5ABC91" style="OLC"><section commented="no" display-inline="no-display-inline" id="HD045723A3E464514871AF79A8AB1305A" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">National Estuary Program reauthorization; competitive awards</header><text display-inline="no-display-inline">Section 320 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idD9FB6DCF3F9A4B969083B362AF0825BC"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (g), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H2810AD682F2541E989E7DB713F67E691" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="HD1FEC02A9F494BA28038255F028D2272"><enum>(4)</enum><header display-inline="yes-display-inline">Competitive awards</header><subparagraph commented="no" display-inline="no-display-inline" id="HBA8D923D6E684D909BE858CF06F2A3A0"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Using the amounts made available under subsection (i)(2)(B), the Administrator shall make competitive awards under this paragraph.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9FC9AA195456442788A7351A6877B1CC"><enum>(B)</enum><header display-inline="yes-display-inline">Application for awards</header><text display-inline="yes-display-inline">The Administrator shall solicit applications for awards under this paragraph from State, interstate, and regional water pollution control agencies and entities, State coastal zone management agencies, interstate agencies, other public or nonprofit private agencies, institutions, organizations, and individuals.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC055488AF49A4E34975278DA07C67898"><enum>(C)</enum><header display-inline="yes-display-inline">Selection of recipients</header><text display-inline="yes-display-inline">The Administrator shall select award recipients under this paragraph that, as determined by the Administrator, are best able to address urgent and challenging issues that threaten the ecological and economic well-being of coastal areas, including—</text><clause commented="no" display-inline="no-display-inline" id="H0217D96A51AC4374BDFEC6EBE62DD410"><enum>(i)</enum><text display-inline="yes-display-inline">extensive seagrass habitat losses resulting in significant impacts on fisheries and water quality;</text></clause><clause commented="no" display-inline="no-display-inline" id="HC3EAA0B8A4994B8EB9AE3E26E50CF801"><enum>(ii)</enum><text display-inline="yes-display-inline">recurring harmful algae blooms;</text></clause><clause commented="no" display-inline="no-display-inline" id="H2E54F10EC72F4D9EB4DFE0A4A363B392"><enum>(iii)</enum><text display-inline="yes-display-inline">unusual marine mammal mortalities;</text></clause><clause commented="no" display-inline="no-display-inline" id="H4B0394A8D00F425DB843061741543981"><enum>(iv)</enum><text display-inline="yes-display-inline">invasive exotic species that may threaten wastewater systems and cause other damage;</text></clause><clause commented="no" display-inline="no-display-inline" id="H23CB310E0E5F44D3BFA193F632F932FF"><enum>(v)</enum><text display-inline="yes-display-inline">jellyfish proliferation limiting community access to water during peak tourism seasons;</text></clause><clause commented="no" display-inline="no-display-inline" id="H515E05B0461840F5839E3FE4382D1F86"><enum>(vi)</enum><text display-inline="yes-display-inline">flooding that may be related to sea level rise or wetland degradation or loss; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H667E021595FF448E81DF104369DD41D9"><enum>(vii)</enum><text display-inline="yes-display-inline">low dissolved oxygen conditions in estuarine waters and related nutrient management.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA084308363554E4BA76BB8082240F4B5"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (i) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H6DC3C301D629405D9EB80252ED808A5A" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H0F1BD9C6B9354BFC92D371B527AC2B4C"><enum>(i)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><paragraph commented="no" display-inline="no-display-inline" id="H3534C847A9C3425DBD25F4A6683DFA31"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Administrator $26,000,000 for each of fiscal years 2016 through 2020 for—</text><subparagraph commented="no" display-inline="no-display-inline" id="H09FB5C2355C949B89CAC4D6273AC53A9"><enum>(A)</enum><text display-inline="yes-display-inline">making grants and awards under subsection (g); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE1477C6457BE4682BF35C80763C8F8A9"><enum>(B)</enum><text display-inline="yes-display-inline">expenses relating to the administration of grants or awards by the Administrator under this section, including the award and oversight of grants and awards, subject to the condition that such expenses may not exceed 5 percent of the amount appropriated under this subsection for a fiscal year.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC7B1A3D22C634A90924D67C55FB01423"><enum>(2)</enum><header display-inline="yes-display-inline">Allocations</header><subparagraph commented="no" display-inline="no-display-inline" id="HF018FD9B212A479782730E516A895211"><enum>(A)</enum><header display-inline="yes-display-inline">Conservation and management plans</header><text display-inline="yes-display-inline">Not less than 80 percent of the amount made available under this subsection for a fiscal year shall be used by the Administrator for the development, implementation, and monitoring of each conservation and management plan eligible for grant assistance under subsection (g)(2).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H834400EF5A084CD0B608D70F63A803AE"><enum>(B)</enum><header display-inline="yes-display-inline">Competitive awards</header><text display-inline="yes-display-inline">Not less than 15 percent of the amount made available under this subsection for a fiscal year shall be used by the Administrator for making competitive awards under subsection (g)(4).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><attestation><attestation-group><attestation-date chamber="Senate" date="20150805">Passed the Senate August 5, 2015.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
