<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend title 38, United States Code, to direct the Secretary of Veterans Affairs to issue, upon request, veteran identification cards to certain veterans.</official-title>

<section id="HFC8F4CA07F894C128347410A352FFD81" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Identification Card Act 2015</short-title></quote>.</text></section> <section id="H4DDB5B54FDE948FFB2A4860C0547E3B1" section-type="subsequent-section"><enum>2.</enum><header>Veterans identification card</header> <subsection id="HBD792061C84944608E4BACC634DC9108"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress makes the following findings:</text>
<paragraph id="H39DA4C73740E4A9A926C9EAF873A9FAD"><enum>(1)</enum><text display-inline="yes-display-inline">Effective on the day before the date of the enactment of this Act, veteran identification cards were issued to veterans who have either completed the statutory time-in-service requirement for retirement from the Armed Forces or who have received a medical-related discharge from the Armed Forces.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H29C3D1074BDE4642A7744B991E774395"><enum>(2)</enum><text display-inline="yes-display-inline">Effective on the day before the date of the enactment of this Act, a veteran who served a minimum obligated time in service, but who did not meet the criteria described in paragraph (1), did not receive a means of identifying the veteran’s status as a veteran other than using the Department of Defense form DD–214 discharge papers of the veteran.</text></paragraph>
<paragraph id="H51420563361140C095BF81C51BBBD1B8"><enum>(3)</enum><text display-inline="yes-display-inline">Goods, services, and promotional activities are often offered by public and private institutions to veterans who demonstrate proof of service in the military, but it is impractical for a veteran to always carry Department of Defense form DD–214 discharge papers to demonstrate such proof.</text></paragraph> <paragraph id="HFF7F7FFDD7D84BDB8F719C2DDDB76511"><enum>(4)</enum><text display-inline="yes-display-inline">A general purpose veteran identification card made available to veterans would be useful to demonstrate the status of the veterans without having to carry and use official Department of Defense form DD–214 discharge papers.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3F9313D7C0304FEBB60C61022318BBCC"><enum>(5)</enum><text display-inline="yes-display-inline">On the day before the date of the enactment of this Act, the Department of Veterans Affairs had the infrastructure in place across the United States to produce photographic identification cards and accept a small payment to cover the cost of these cards.</text></paragraph></subsection> <subsection id="H7780A3D02F10406887554FB6C872F89C"><enum>(b)</enum><header>Provision of veteran identification cards</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/57">Chapter 57</external-xref> of title 38, United States Code, is amended by adding after section 5705 the following new section:</text>

<section id="HC9829BB5B9D9441AAFEAC7E1081A92C5"><enum>5706.</enum><header>Veterans identification card</header>
<subsection id="H4AA95C0BB4644490B8AF523373816986"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall issue an identification card described in subsection (b) to each veteran who—</text> <paragraph id="H1B2248B056644FCCABDDB6C3E913BB89"><enum>(1)</enum><text>requests such card;</text></paragraph>
<paragraph id="H6B8B2EDF6FED4A9E9067EE840FA4CB3F"><enum>(2)</enum><text display-inline="yes-display-inline">presents a copy of Department of Defense form DD–214 or other official document from the official military personnel file of the veteran that describes the service of the veteran; and</text></paragraph> <paragraph id="HDD388F3B344B4ECC99FB4DE7CA4C0712"><enum>(3)</enum><text>pays the fee under subsection (c)(1).</text></paragraph></subsection>
<subsection id="HD3BC02429FAE463284364881AF839830"><enum>(b)</enum><header>Identification card</header><text>An identification card described in this subsection is a card issued to a veteran that—</text> <paragraph id="H63E3571F927D4D5BB0082B900CF9422F"><enum>(1)</enum><text>displays a photograph of the veteran;</text></paragraph>
<paragraph id="HF85E20FC29AC4847956633440D67B688"><enum>(2)</enum><text>displays the name of the veteran;</text></paragraph> <paragraph id="HD927643CD48A4BCEB33C3C599FA80764"><enum>(3)</enum><text>explains that such card is not proof of any benefits to which the veteran is entitled to;</text></paragraph>
<paragraph id="HA52521B77D6F4E9A8717B5D44D19767F"><enum>(4)</enum><text>contains an identification number that is not a social security number; and</text></paragraph> <paragraph id="H561289ACE200496E91B78B1677E4CE21"><enum>(5)</enum><text>serves as proof that such veteran—</text>
<subparagraph id="H5086ED15B6C2446A81F88AFEA05F6B54"><enum>(A)</enum><text>served in the Armed Forces; and</text></subparagraph> <subparagraph id="H8680A8A4BC3145CC96269D6CD2BDF87F"><enum>(B)</enum><text display-inline="yes-display-inline">has a Department of Defense form DD–214 or other official document in the official military personnel file of the veteran that describes the service of the veteran.</text></subparagraph></paragraph></subsection>
<subsection id="H3BDC4CA8B4C8404C909D4C76E4E56896"><enum>(c)</enum><header>Costs of card</header>
<paragraph commented="no" display-inline="yes-display-inline" id="H9BBA4B1A170A4009BB23BCD6C56457AA"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall charge a fee to each veteran who receives an identification card issued under this section, including a replacement identification card.</text></paragraph> <paragraph display-inline="no-display-inline" id="H2B6A93D7367E49E29033FCCDE51E01FC" indent="up1"><enum>(2)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H3A9D189D59CF4039B3A03D49F2672478"><enum>(A)</enum><text>The fee charged under paragraph (1) shall equal such amount as the Secretary determines is necessary to issue an identification card under this section.</text></subparagraph>
<subparagraph id="H6B3E5D8889C248C78F3EB3EACCF8ADA4" indent="up1"><enum>(B)</enum><text>In determining the amount of the fee under subparagraph (A), the Secretary shall ensure that the total amount of fees collected under paragraph (1) equals an amount necessary to carry out this section, including costs related to any additional equipment or personnel required to carry out this section.</text></subparagraph> <subparagraph id="H72B1618C00FA4F1FBE6FD0497B79F113" indent="up1"><enum>(C)</enum><text>The Secretary shall review and reassess the determination under subparagraph (A) during each five-year period in which the Secretary issues an identification card under this section.</text></subparagraph></paragraph>
<paragraph id="HEE787383A1954FBBA98BCDD9616B9DC5" indent="up1"><enum>(3)</enum><text>Amounts collected under this subsection shall be deposited in an account of the Department available to carry out this section. Amounts so deposited shall be—</text> <subparagraph id="HF29E533708514F8197D2EA404F1682D1"><enum>(A)</enum><text>merged with amounts in such account;</text></subparagraph>
<subparagraph id="HFC4AD811E9064FBCA0623ABD4300A9DA"><enum>(B)</enum><text>available in such amounts as may be provided in appropriation Acts; and</text></subparagraph> <subparagraph id="HD35146E80B56498DBFEBA9D8028BC04D"><enum>(C)</enum><text>subject to the same conditions and limitations as amounts otherwise in such account.</text></subparagraph></paragraph></subsection>
<subsection id="HDD744A37914E48B79C9C3BA33CCFCF3B"><enum>(d)</enum><header>Effect of card on benefits</header>
<paragraph commented="no" display-inline="yes-display-inline" id="H0AAE1866CCC047A0A977FE42D14957A4"><enum>(1)</enum><text display-inline="yes-display-inline">An identification card issued under this section shall not serve as proof of any benefits that the veteran may be entitled to under this title.</text></paragraph> <paragraph display-inline="no-display-inline" id="HC6320C5C1EB6466B8CC6F53F1794848A" indent="up1"><enum>(2)</enum><text>A veteran who is issued an identification card under this section shall not be entitled to any benefits under this title by reason of possessing such card.</text></paragraph></subsection>
<subsection id="H13CDB9F2CFA24CB895B021C66883A6D6"><enum>(e)</enum><header>Administrative measures</header>
<paragraph commented="no" display-inline="yes-display-inline" id="H62B5EF9B638249379E31D5EA5BE8F2B7"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that any information collected or used with respect to an identification card issued under this section is appropriately secured.</text></paragraph> <paragraph id="H7E52B2C7D01841D1B70AAF7260C01DE4" indent="up1"><enum>(2)</enum><text>The Secretary may determine any appropriate procedures with respect to issuing a replacement identification card.</text></paragraph>
<paragraph display-inline="no-display-inline" id="H3FCB3C219B5C4E319EB4B3AB4461D0B7" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall coordinate with the National Personnel Records Center.</text></paragraph> <paragraph id="H544A5E41FEC642CE80D678DE7B30A9B1" indent="up1"><enum>(4)</enum><text>The Secretary may conduct such outreach to advertise the identification card under this section as the Secretary considers appropriate.</text></paragraph></subsection>
<subsection id="H62B2DC97B708462287CD12A44EF6FBB7"><enum>(f)</enum><header>Construction</header><text display-inline="yes-display-inline">This section shall not be construed to affect identification cards otherwise provided by the Secretary to veterans enrolled in the health care system established under section 1705(a) of this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H2AEBAD86ECC44ABD97F23DF6C3FF55F6"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 5705 the following new item:</text>

<subsection id="HF220615DECD8491DBC630D3147134B38"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this Act shall take effect on the date that is 60 days after the date of the enactment of this Act.</text></subsection></section> </legis-body> <attestation><attestation-group><role>Speaker of the House of Representatives.</role></attestation-group><attestation-group><role>Vice President of the United States and President of the Senate.</role></attestation-group></attestation> </bill>
