		<official-title display="yes">To amend the Federal Insecticide, Fungicide, and Rodenticide Act and the Federal Water Pollution
			 Control Act to clarify Congressional intent regarding the regulation of
			 the use of pesticides in or near navigable waters, and for other purposes.</official-title>

 <section commented="no" id="HDD591FBF5CDB44B6BE265B635E040BEB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Zika Vector Control Act</short-title></quote>.</text> </section><section id="H5F044400D63A47E999FD143CA4595DC9"><enum>2.</enum><header>Use of authorized pesticides</header><text display-inline="no-display-inline">Section 3(f) of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136a">7 U.S.C. 136a(f)</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HF0E75927A38047C0A975ECF22D8DB5E0" style="OLC">
				<paragraph commented="no" id="HFB2CBDA63BD74E078DBA1D3EB7FBC66B"><enum>(5)</enum><header>Use of authorized pesticides</header>
 <subparagraph id="H47238385D38A441A9994A45FBCF79FB0"><enum>(A)</enum><header>In general</header><text>Except as provided in section 402(s) of the Federal Water Pollution Control Act, the Administrator or a State may not require a permit under such Act for a discharge from a point source into navigable waters of a pesticide authorized for sale, distribution, or use under this Act, or the residue of such a pesticide, resulting from the application of such pesticide.</text>
 </subparagraph><subparagraph id="HA796AE790E524EA687327899F19F62A6"><enum>(B)</enum><header>Sunset</header><text>This paragraph shall cease to be effective on September 30, 2018.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="H9725E24248384D0BA15B939A351991A7"><enum>3.</enum><header>Discharges of pesticides</header><text display-inline="no-display-inline">Section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended by adding at the end the following:</text>

				<subsection id="H4DEBC646B77844FF8EB0EB350012F185"><enum>(s)</enum><header>Discharges of pesticides</header>
 <paragraph id="HD08E3CB48C534F2FBDF9CE9D16C93D65"><enum>(1)</enum><header>No permit requirement</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a permit shall not be required by the Administrator or a State under this Act for a discharge from a point source into navigable waters of a pesticide authorized for sale, distribution, or use under the Federal Insecticide, Fungicide, and Rodenticide Act, or the residue of such a pesticide, resulting from the application of such pesticide.</text>
 </paragraph><paragraph id="HCEE140F5630A437492D358ECB2A14680"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) shall not apply to the following discharges of a pesticide or pesticide residue:</text> <subparagraph id="HDBEE84257E544341AF3FF804C4CD3934"><enum>(A)</enum><text display-inline="yes-display-inline">A discharge resulting from the application of a pesticide in violation of a provision of the Federal Insecticide, Fungicide, and Rodenticide Act that is relevant to protecting water quality, if—</text>
 <clause id="H7EC54DC4585B4521B4E682442C909025"><enum>(i)</enum><text display-inline="yes-display-inline">the discharge would not have occurred but for the violation; or</text> </clause><clause id="H4D2F5D2E4C9349519B21AC8DC6064DFB"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount of pesticide or pesticide residue in the discharge is greater than would have occurred without the violation.</text>
 </clause></subparagraph><subparagraph commented="no" id="HF96F587DB4C34D2C9627348D0252E7FB"><enum>(B)</enum><text display-inline="yes-display-inline">Stormwater discharges subject to regulation under subsection (p).</text> </subparagraph><subparagraph commented="no" id="HC3893197F7204AD688A5751A42581347"><enum>(C)</enum><text display-inline="yes-display-inline">The following discharges subject to regulation under this section:</text>
 <clause commented="no" id="HE6BA6160931C4CF7BA63B2F124B7D551"><enum>(i)</enum><text>Manufacturing or industrial effluent.</text> </clause><clause commented="no" id="HC355BCB3E28F4F55999E70D006100EAE"><enum>(ii)</enum><text>Treatment works effluent.</text>
 </clause><clause commented="no" id="H164E586DF4114676BDC24AD9E24DCE0B"><enum>(iii)</enum><text>Discharges incidental to the normal operation of a vessel, including a discharge resulting from ballasting operations or vessel biofouling prevention.</text>
