<official-title display="yes">To amend the Homeland Security Act of 2002 to authorize the Department of Homeland Security to establish a social media working group, and for other purposes.</official-title>

<section commented="no" display-inline="no-display-inline" id="H04E9EFA4977540FD90523893BD6F620E" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS Social Media Improvement Act of 2015</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="HB315CD2945BD43098E669445132F73BD" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Social media working group</header> <subsection commented="no" display-inline="no-display-inline" id="H2605C77B29F14170B72C30A9EBC9AF3C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title III of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/181">6 U.S.C. 181 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section commented="no" display-inline="no-display-inline" id="HF99F299BE18049C9B5EAEF1AFEC1B044" section-type="subsequent-section"><enum>318.</enum><header display-inline="yes-display-inline">Social media working group</header>
<subsection commented="no" display-inline="no-display-inline" id="HD25C97FEB42C4F8D8FB7280EB51DADD7"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish within the Department a social media working group (in this section referred to as the <quote>Group</quote>).</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H6F303655B5CC4A9685B73C450C4CB0D9"><enum>(b)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">In order to enhance the dissemination of information through social media technologies between the Department and appropriate stakeholders and to improve use of social media technologies in support of preparedness, response, and recovery, the Group shall identify, and provide guidance and best practices to the emergency preparedness and response community on, the use of social media technologies before, during, and after a natural disaster or an act of terrorism or other man-made disaster.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H7540E7E2BA564CF88928A186D29799C4"><enum>(c)</enum><header display-inline="yes-display-inline">Membership</header>
<paragraph commented="no" display-inline="no-display-inline" id="HD2D6FB03B6E342E8ABAEE7937E03BDC1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Membership of the Group shall be composed of a cross section of subject matter experts from Federal, State, local, tribal, territorial, and nongovernmental organization practitioners, including representatives from the following entities:</text> <subparagraph commented="no" display-inline="no-display-inline" id="HE7A7BF3002A04EA1926064BEDDA8A807"><enum>(A)</enum><text display-inline="yes-display-inline">The Office of Public Affairs of the Department.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H70713895CB444F3D8D4AAC4360222520"><enum>(B)</enum><text display-inline="yes-display-inline">The Office of the Chief Information Officer of the Department.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE40780D0C8CE4578B2AE7A87C199841A"><enum>(C)</enum><text display-inline="yes-display-inline">The Privacy Office of the Department.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H415E11B828C34B76A83BB9345BB5B595"><enum>(D)</enum><text display-inline="yes-display-inline">The Federal Emergency Management Agency.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC895A361ABF846DB8C08202A4AA97EA7"><enum>(E)</enum><text display-inline="yes-display-inline">The Office of Disability Integration and Coordination of the Federal Emergency Management Agency.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HFFEBFD7555C240939E774A80FDB445D2"><enum>(F)</enum><text display-inline="yes-display-inline">The American Red Cross.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HBA94339C0F594BF8A39492BB58E3281D"><enum>(G)</enum><text display-inline="yes-display-inline">The Forest Service.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H012F97C5EC4941FB8F610BF2A382613A"><enum>(H)</enum><text display-inline="yes-display-inline">The Centers for Disease Control and Prevention.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H42024A19C3D14DA3B399186C269DE9A8"><enum>(I)</enum><text display-inline="yes-display-inline">The United States Geological Survey.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H2513476CD68644239E1751CA5B1FD501"><enum>(J)</enum><text display-inline="yes-display-inline">The National Oceanic and Atmospheric Administration.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H00342E9988ED4F6E827EE75B765E91E3"><enum>(2)</enum><header display-inline="yes-display-inline">Chairperson; co-chairperson</header> <subparagraph commented="no" display-inline="no-display-inline" id="H33835F9A5A5B482CAFCC78815DC14213"><enum>(A)</enum><header display-inline="yes-display-inline">Chairperson</header><text display-inline="yes-display-inline">The Secretary, or a designee of the Secretary, shall serve as the chairperson of the Group.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H7B8EE378C4284709B4DD2AD7FE73899B"><enum>(B)</enum><header display-inline="yes-display-inline">Co-chairperson</header><text display-inline="yes-display-inline">The chairperson shall designate, on a rotating basis, a representative from a State or local government who is a member of the Group to serve as the co-chairperson of the Group.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HD1F080B34A4C4BDEAA859F9B826F2A8C"><enum>(3)</enum><header display-inline="yes-display-inline">Additional members</header><text display-inline="yes-display-inline">The chairperson shall appoint, on a rotating basis, qualified individuals to the Group. The total number of such additional members shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HEE57BFD7CF3242AC96660AAA44E01CF5"><enum>(A)</enum><text display-inline="yes-display-inline">be equal to or greater than the total number of regular members under paragraph (1); and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HF5FB18E2AF764D36AEFFDA6301FBA531"><enum>(B)</enum><text display-inline="yes-display-inline">include—</text>
<clause commented="no" display-inline="no-display-inline" id="HE707425B9E6F4EFAA9BA96C1E8ED4DE0"><enum>(i)</enum><text display-inline="yes-display-inline">not fewer than 3 representatives from the private sector; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H137F85470F99483D8830012775F04C77"><enum>(ii)</enum><text display-inline="yes-display-inline">representatives from—</text>
<subclause commented="no" display-inline="no-display-inline" id="H610BDDF99D704CC0B3F035CADC9E0116"><enum>(I)</enum><text display-inline="yes-display-inline">State, local, tribal, and territorial entities, including from—</text> <item commented="no" display-inline="no-display-inline" id="H37C352ED3A2F45928D71A3445D5BF3F1"><enum>(aa)</enum><text display-inline="yes-display-inline">law enforcement;</text></item>
<item commented="no" display-inline="no-display-inline" id="HBFF3A2E6F8D94FA6BE247592F51A5B6C"><enum>(bb)</enum><text display-inline="yes-display-inline">fire services;</text></item> <item commented="no" display-inline="no-display-inline" id="HED2D8E78A04845968743855B53B378B9"><enum>(cc)</enum><text display-inline="yes-display-inline">emergency management; and</text></item>
<item commented="no" display-inline="no-display-inline" id="HF286703C180649CA922501DF559D33D7"><enum>(dd)</enum><text display-inline="yes-display-inline">public health entities;</text></item></subclause> <subclause commented="no" display-inline="no-display-inline" id="H669EEDAEDE094A18B15557C36A40DAB5"><enum>(II)</enum><text display-inline="yes-display-inline">universities and academia; and</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H8369DEA0F6044D82A8658AA4D8B8B60C"><enum>(III)</enum><text display-inline="yes-display-inline">nonprofit disaster relief organizations.</text></subclause></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H00AF20BB65DA4D289A922C6D5185775B"><enum>(4)</enum><header display-inline="yes-display-inline">Term limits</header><text display-inline="yes-display-inline">The chairperson shall establish term limits for individuals appointed to the Group under paragraph (3).</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H029802C7C093402D8DF81E9563872067"><enum>(d)</enum><header display-inline="yes-display-inline">Consultation with non-members</header><text display-inline="yes-display-inline">To the extent practicable, the Group shall work with entities in the public and private sectors to carry out subsection (b).</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H3295A32454EC48EEBB51612FE3B711E2"><enum>(e)</enum><header display-inline="yes-display-inline">Meetings</header> <paragraph commented="no" display-inline="no-display-inline" id="HAB35FE14B8CA4BBEB32D8617E6B6BEA6"><enum>(1)</enum><header display-inline="yes-display-inline">Initial meeting</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this section, the Group shall hold its initial meeting.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD7D378EF0BD44D6791E810ACB5A06E93"><enum>(2)</enum><header display-inline="yes-display-inline">Subsequent meetings</header><text display-inline="yes-display-inline">After the initial meeting under paragraph (1), the Group shall meet—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H83BF55A52091459FBD51531CBDF37E29"><enum>(A)</enum><text display-inline="yes-display-inline">at the call of the chairperson; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H29ED0CE6170D44369A4979FBA96A81DC"><enum>(B)</enum><text display-inline="yes-display-inline">not less frequently than twice each year.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H09EB7FB640304FA3A6DF5BD5CE9515B2"><enum>(3)</enum><header display-inline="yes-display-inline">Virtual meetings</header><text display-inline="yes-display-inline">Each meeting of the Group may be held virtually.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H70595A9A32CC42219E07508B0ED07099"><enum>(f)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">During each year in which the Group meets, the Group shall submit to the appropriate congressional committees a report that includes the following:</text> <paragraph commented="no" display-inline="no-display-inline" id="H5E0517E9C0054795A6DC260DC62B6C47"><enum>(1)</enum><text display-inline="yes-display-inline">A review and analysis of current and emerging social media technologies being used to support preparedness and response activities related to natural disasters and acts of terrorism and other man-made disasters.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H099EE867A1A040BEA2EBF468FC52471F"><enum>(2)</enum><text display-inline="yes-display-inline">A review of best practices and lessons learned on the use of social media technologies during the response to natural disasters and acts of terrorism and other man-made disasters that occurred during the period covered by the report at issue.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HA205E33BE3FB4E598B04E0519031A623"><enum>(3)</enum><text display-inline="yes-display-inline">Recommendations to improve the Department’s use of social media technologies for emergency management purposes.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H9CAB9307B4E64E4EBCB7FBC440D134F5"><enum>(4)</enum><text display-inline="yes-display-inline">Recommendations to improve public awareness of the type of information disseminated through social media technologies, and how to access such information, during a natural disaster or an act of terrorism or other man-made disaster.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H563EFD7D18504F3ABB4824E6450B85A0"><enum>(5)</enum><text display-inline="yes-display-inline">A review of available training for Federal, State, local, tribal, and territorial officials on the use of social media technologies in response to a natural disaster or an act of terrorism or other man-made disaster.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H152D3DE849CB4A6BBD6C0860B16F53B2"><enum>(6)</enum><text display-inline="yes-display-inline">A review of coordination efforts with the private sector to discuss and resolve legal, operational, technical, privacy, and security concerns.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HDE3C91C2843D4D34B2681B721C9D5EA7"><enum>(g)</enum><header display-inline="yes-display-inline">Duration of Group</header> <paragraph commented="no" display-inline="no-display-inline" id="HEA79B86B3AB14FB69A565603F1AC3FA3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Group shall terminate on the date that is 5 years after the date of enactment of this section unless the chairperson renews the Group for a successive 5-year period, prior to the date on which the Group would otherwise terminate, by submitting to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives a certification that the continued existence of the Group is necessary to fulfill the purpose described in subsection (b).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD0F1F8C29E3B41CFBDC5F361F61447A1"><enum>(2)</enum><header display-inline="yes-display-inline">Continued renewal</header><text display-inline="yes-display-inline">The chairperson may continue to renew the Group for successive 5-year periods by submitting a certification in accordance with paragraph (1) prior to the date on which the Group would otherwise terminate.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" display-inline="no-display-inline" id="HB7C8000D1DF341A9AE05B44BE47F7DCE"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 317 the following:</text>
