			 discipline Federal employees, and for other purposes.</official-title></form>
	<legis-body id="HAE26DC6069214FDFA4AD31BEA6C48BE5" style="OLC">
 <section id="id2F25400E8198408E8689A5B7028642CA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Employee Accountability Act of 2016</short-title></quote> or <quote><short-title>FEAA</short-title></quote>.</text> </section><section id="H7C0A7E8424C94CC1AB8874570BFE4C7F" section-type="subsequent-section"><enum>2.</enum><header>Reduction in grade or pay or removal for misconduct or performance of employees in the civil service</header> <subsection id="HFE507CDD3DEB4123B854422177302601"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">Chapter 75</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H1FDEF6F2594F477E8832DE9CDC92CF60" style="USC">
					<subchapter id="H05484902B8854AD3A4D04D10A101CFA7"><enum>VI</enum><header>Reduction in grade or pay or removal for misconduct or performance </header>
 <section id="HA4070CD84578429691A901509CBB23BC"><enum>7551.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this subchapter—</text> <paragraph id="HD4A0801BE87C43A9AB7971EF8A3A71EF"><enum>(1)</enum><text><quote>employee</quote> means an individual occupying a position within the civil service, but does not include any individual—</text>
 <subparagraph id="H86EE858E108244DCA96A944B49662445"><enum>(A)</enum><text display-inline="yes-display-inline">employed in a position described under sections 5312 through 5316 (relating to the Executive Schedule);</text>
 </subparagraph><subparagraph id="HF55F4FC887D14816B5D929B92BB9C667"><enum>(B)</enum><text display-inline="yes-display-inline">employed as a limited term appointee, limited emergency appointee, or noncareer appointee in the Senior Executive Service, as defined under paragraphs (5), (6), and (7), respectively, of section 3132(a); or</text>
 </subparagraph><subparagraph id="HD2A5F1FACA814CBDB179BFFF9A7522FE"><enum>(C)</enum><text display-inline="yes-display-inline">employed in a position of a confidential or policy-determining character under schedule C of subpart C of part 213 of title 5 of the Code of Federal Regulations;</text>
 </subparagraph></paragraph><paragraph id="H47327DBAE9424674AE455229CD7FF4A7"><enum>(2)</enum><text display-inline="yes-display-inline"><quote>grade</quote> means a level of classification under a position classification system;</text> </paragraph><paragraph id="HB91CEF45AD884D93A1B269A8B05B1BE4"><enum>(3)</enum><text display-inline="yes-display-inline"><quote>misconduct</quote> includes neglect of duty, malfeasance, or failure to accept a directed reassignment or to accompany a position in a transfer of function; and</text>
 </paragraph><paragraph id="HC0CCAD96C3904AB08B9884AEC8B60DC8"><enum>(4)</enum><text display-inline="yes-display-inline"><quote>pay</quote> means the rate of basic pay fixed by law or administrative action for the position held by an employee.</text>
 </paragraph></section><section id="H6B75DD27AB7E4596847E7F3A18B6CC85"><enum>7552.</enum><header>Actions covered</header><text display-inline="no-display-inline">This subchapter applies to a reduction in grade or pay or removal, but does not apply to—</text> <paragraph id="H7C48F474A5C6455DB0DFE94FF7F78F7C"><enum>(1)</enum><text>a reduction in grade or pay or removal under section 7512;</text>
 </paragraph><paragraph id="H380273E442234058B2FCEDF94D453A92"><enum>(2)</enum><text>a reduction in grade or pay or removal under section 7521;</text> </paragraph><paragraph id="HE92C17E9C01247789F60F267743AFB60"><enum>(3)</enum><text display-inline="yes-display-inline">a removal under section 7532;</text>
 </paragraph><paragraph id="H78DEDC461FAC4B3D9B5288A1F230D773"><enum>(4)</enum><text>a removal under section 3592, 3595, or 7543; or</text> </paragraph><paragraph id="HB5CE9756AB494BB4923F9E0C5C0F1F08"><enum>(5)</enum><text>a removal from the Senior Executive Service under section 713 of title 38.</text>
							</paragraph></section><section id="H1D0AECFC82EA4A49B15D60609F29326A"><enum>7553.</enum><header>Cause and procedure</header>
 <subsection id="H0629A8446F344CF68A3165E30A465162"><enum>(a)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law, under regulations prescribed by the Office of Personnel Management, the head of an agency may—</text>
 <paragraph id="H5B69003EF5A04A5CAC11ED8F89C9F858"><enum>(1)</enum><text>remove an employee of the agency from the civil service;</text> </paragraph><paragraph id="HAEE25124352343B0A50DFB43C00F981F"><enum>(2)</enum><text display-inline="yes-display-inline">reduce the grade of an employee of the agency; or</text>
 </paragraph><paragraph id="HF380815DF0C14A68A3CE63337BAFEFB0"><enum>(3)</enum><text display-inline="yes-display-inline">reduce the pay of an employee of the agency.</text> </paragraph></subsection><subsection id="H833975645ECD47F2AB800C0154D9A62A"><enum>(b)</enum><text display-inline="yes-display-inline">An employee subject to a reduction in grade under subsection (a)(2) shall, beginning on the date that the reduction takes effect, receive the annual rate of pay applicable to such grade.</text>
							</subsection><subsection id="HA6F506E140A9439B8F692DC7C0B67008"><enum>(c)</enum>
 <paragraph commented="no" display-inline="yes-display-inline" id="HD55FCE591933412D9C9D0B04C220E103"><enum>(1)</enum><text>Subject to paragraph (2) and subsection (d), any reduction in grade or pay or removal under this subchapter may be appealed to the Merit Systems Protection Board under section 7701.</text>
 </paragraph><paragraph id="HCF23E884A53046B1A0271B6D141A1AA6" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">An appeal under paragraph (1) may only be made if such appeal is made not later than seven days after the date of such reduction in grade or pay or removal.</text>
								</paragraph></subsection><subsection id="H23F0C7BAC7454855A8C6D164B05CAE9D"><enum>(d)</enum>
 <paragraph commented="no" display-inline="yes-display-inline" id="HC5BBCE4365114815BA8C4D0C7CEF5569"><enum>(1)</enum><text>Upon receipt of an appeal under subsection (c), the Merit Systems Protection Board shall refer the appeal to an administrative judge pursuant to section 7701(b)(1). The administrative judge shall expedite any such appeal under such section and, in any such case, shall issue a decision not later than 45 days after the date that the Board receives the appeal.</text>
 </paragraph><paragraph id="H18D03B1C94694536A34B1DC5348207A6" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">To the maximum extent practicable, the agency shall provide to the Merit Systems Protection Board, and to any administrative judge to whom an appeal under this section is referred, such information and assistance as may be necessary to ensure an appeal under this subsection is expedited.</text>
 </paragraph><paragraph id="H397C1625047F429487FD1C18217A81D4" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law, including section 7703, the decision of an administrative judge under paragraph (1) shall be final and shall not be subject to any further appeal.</text>
 </paragraph><paragraph commented="no" id="H6B7491A03A1344B0B0078C37BE44BED0" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">In any case in which the administrative judge cannot issue a decision in accordance with the 45-day requirement under paragraph (3), the reduction in grade or pay or removal is final. In such a case, the Merit Systems Protection Board shall, within 14 days after the date that such reduction in grade or pay or removal is final, submit to Congress a report that explains the reasons why a decision was not issued in accordance with such requirement.</text>
 </paragraph><paragraph id="HA8B0428C3C404D069777B71DC05AC96C" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The Merit Systems Protection Board or administrative judge may not stay any reduction in grade or pay or removal action under this section.</text>
 </paragraph><paragraph id="HEF07EF881D344601A634742C8BFC134E" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">During the period beginning on the date on which an employee appeals a removal from the civil service under this subsection and ending on the date that the administrative judge issues a final decision on such appeal, such employee may not receive any pay, awards, bonuses, incentives, allowances, differentials, student loan repayments, special payments, or benefits.</text>
 </paragraph></subsection><subsection id="H335DB4374514426186C126779529C876"><enum>(e)</enum><text display-inline="yes-display-inline">In the case of an employee seeking corrective action (or on behalf of whom corrective action is sought) from the Office of Special Counsel based on an alleged prohibited personnel practice described in section 2302(b), the head of the agency may not reduce the grade or pay or remove such employee under this subchapter without the approval of the Special Counsel under section 1214(f).</text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H8BF29AA085914F29A09912BDC4B23156"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">The authority provided by subsection (a) shall apply to any employee hired before, on, or after the date of enactment of this Act.</text>
 </subsection><subsection id="HAA2FEF290B59441AABBBDC19C05BEF73"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">chapter 75</external-xref> of title 5, United States Code, is amended by adding after the item relating to section 7543 the following:</text>

 </subsection><subsection id="HEFF1CDCBF79F4B76A827759C2853294E"><enum>(d)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Title 5, United States Code, is amended—</text> <paragraph id="H3812A924A10D4A92BA693ED66413838A"><enum>(1)</enum><text>in section 4303(f)—</text>
 <subparagraph id="H121FB0DA865C4A9685DF0BA6CE9FD2A6"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote> at the end of paragraph (2);</text> </subparagraph><subparagraph id="H09B23B6CC7C14DCC85ECB34B3433E4E7"><enum>(B)</enum><text display-inline="yes-display-inline">by striking the period at the end of paragraph (3) and inserting <quote>, or</quote>; and</text>
 </subparagraph><subparagraph id="H146EB46241DC4514A3D7FA794F2635FB"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HC7531B3B24794C13BC9127D6E2C38C31" style="USC"> <paragraph id="H7A38F084DD854FE78D83415A3D693F4A"><enum>(4)</enum><text display-inline="yes-display-inline">the reduction in grade or removal of an employee under subchapter VI of chapter 75.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H20920E15C68B44B7B76E99EAE1DFDEE2"><enum>(2)</enum><text>in section 7512—</text> <subparagraph id="HB6F8CE9F5EC24E9C84EF0F22F1283349"><enum>(A)</enum><text>by striking <quote>or</quote> at the end of subparagraph (D);</text>
 </subparagraph><subparagraph id="HC5747AE24DBE46109D6E99626521A9CB"><enum>(B)</enum><text display-inline="yes-display-inline">by striking the period at the end of subparagraph (E) and inserting <quote>, or</quote>; and</text> </subparagraph><subparagraph id="H14CD7E234C6A44EB9AD8601A04A245AA"><enum>(C)</enum><text>by adding at the end the following:</text>

 <subparagraph id="H554D9373C2BA43BFA585F16C0834570F" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">a reduction in grade or pay or removal under subchapter VI of this chapter.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="HBA3B1EE6FF914C968FC7BE0F50638FFE"><enum>(3)</enum><text>in section 7521(b), in the matter following paragraph (5)—</text>
 <subparagraph id="HA1A2964D1ADB4ED0AAF8F562B8EE2AC0"><enum>(A)</enum><text>by striking <quote>or</quote> at the end of subparagraph (B);</text> </subparagraph><subparagraph id="H5AF56D0B21624788990E6F543FB07370"><enum>(B)</enum><text>by striking the period at the end of subparagraph (C) and inserting <quote>, or</quote>; and</text>
 </subparagraph><subparagraph id="H3FC2D14DE4D244129C820969A936B68C"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HBE52A1264E084253BDD60693B7B2E071" style="OLC"> <subparagraph id="H6362CE67D3094890B8ABEB97B44EF8E2" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">a reduction in grade or pay or removal under subchapter VI of this chapter.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HEC8EC12F4822421C9208BBAB5C2F4B43"><enum>(4)</enum><text display-inline="yes-display-inline">in section 7542, by striking <quote>or to a removal under section 3592 or 3595 of this title</quote> and inserting <quote>to a removal under section 3592 or 3595 of this title, to an action under section 713 of title 38, or to a reduction in grade or pay or removal under subchapter VI of this chapter</quote> .</text>
