			 private, visual depiction of a person’s intimate parts or of a person
			 engaging in sexually explicit conduct, with reckless disregard for the
			 person’s lack of consent to the distribution, and for other purposes.</official-title></form>
	<legis-body id="HF2A1E44CDF8C4076BE1CE211B866DDD7" style="OLC">
 <section id="H1736A51EECD741B1AE60B439B3208384" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Intimate Privacy Protection Act of 2016</short-title></quote>.</text> </section><section id="HE6AD7B9243CC4C59ABEA14072AED51F3"><enum>2.</enum><header>Certain activities relating to visual depictions of the intimate parts of an individual or of an individual engaged in sexually explicit conduct</header> <subsection id="HD802A357EFEE48E39F7CA4F7D40A1C53"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/88">Chapter 88</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7D8D9B680FE343C6A964326DAE43CD7D" style="USC">
					<section id="H222DD333F928441B8BCDAF359EFEAD77"><enum>1802.</enum><header>Certain activities relating to visual depictions of the intimate parts of an individual or of an
			 individual engaged in sexually explicit conduct</header>
 <subsection id="H514EA6F775534241A1AB6E4F7D1DB71F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever knowingly uses the mail, any interactive computer service or electronic communication service or electronic communication system of interstate commerce, or any other facility of interstate or foreign commerce to distribute a visual depiction of a person who is identifiable from the image itself or information displayed in connection with the image and who is engaging in sexually explicit conduct, or of the naked genitals or post-pubescent female nipple of the person, with reckless disregard for the person’s lack of consent to the distribution, shall be fined under this title or imprisoned not more than 5 years, or both.</text>
						</subsection><subsection id="H4174CCE84A0D4960B681A99540B4DCA9"><enum>(b)</enum><header>Exceptions</header>
 <paragraph id="HBFD9D33F068F43D38AC8434C1C5166E7"><enum>(1)</enum><header>Law Enforcement and other legal proceedings</header><text>This section—</text> <subparagraph id="H5DD8781064884BF9BABBB801BA67214E"><enum>(A)</enum><text>does not prohibit any lawful law enforcement, correctional, or intelligence activity;</text>
 </subparagraph><subparagraph id="H58CEC0C7A3BF482F8586AF3AF3ABBCC3"><enum>(B)</enum><text>shall not apply in the case of an individual reporting unlawful activity; and</text> </subparagraph><subparagraph id="HFBDA23298DBE44A2BA120676EE26BB3D"><enum>(C)</enum><text>shall not apply to a subpoena or court order for use in a legal proceeding.</text>
 </subparagraph></paragraph><paragraph id="H81EA382370314409BA15A0AB3B4819D4"><enum>(2)</enum><header>Voluntary public or commercial exposure</header><text display-inline="yes-display-inline">This section does not apply to a visual depiction of a voluntary exposure of an individual’s own naked genitals or post-pubescent female nipple or an individual’s voluntary engagement in sexually explicit conduct if such exposure takes place in public or in a lawful commercial setting.</text>
 </paragraph><paragraph id="H1637C214489E4F45A3AA7CAC6C19BD4D"><enum>(3)</enum><header>Certain categories of visual depictions excepted</header><text>This section shall not apply in the case of a visual depiction, the disclosure of which is in the bona fide public interest.</text>
 </paragraph><paragraph commented="no" id="H6B5698C3CC6643BFA00A6AC36106F25F"><enum>(4)</enum><header>Telecommunications and Internet service providers</header><text display-inline="yes-display-inline">This section shall not apply to any provider of an interactive computer service as defined in section 230(f)(2) of the Communications Act of 1934 (47 U.S.C. 230 (f)(2)) with regard to content provided by another information content provider, as defined in section 230(f)(3) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)(3)</external-xref>) unless such provider of an interactive computer service intentionally promotes or solicits content that it knows to be in violation of this section.</text>
 </paragraph></subsection><subsection id="H45A05A77276D44E9A4E85CC70D347529"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HF6599F68CEBD419F9E6D52CA17AAB07C"><enum>(1)</enum><text>Except as otherwise provided, any term used in this section has the meaning given that term in section 1801.</text>
 </paragraph><paragraph id="H0664F98DE52E46578920A48D7370940B"><enum>(2)</enum><text>The term <term>visual depiction</term> means any photograph, film, or video, whether produced by electronic, mechanical, or other means.</text> </paragraph><paragraph id="H6449714624BE4BCEB7CF1F22CD066036"><enum>(3)</enum><text>The term <term>sexually explicit conduct</term> has the meaning given that term in section 2256(2)(A).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H72EE146703F1497A8DD86E7FBD217BC5"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/88">chapter 88</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/1801">section 1801</external-xref> the following:</text>
