 <section id="HA67EEB870E494AAB8972B2F7948D3A42" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Survivors’ Bill of Rights Act of 2016</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="H5AF912C44C004D7C895FE626DEFF88A7" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Sexual assault survivors’ rights</header> <subsection commented="no" display-inline="no-display-inline" id="H93A717D0559546428FF4F734020BD3EF"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Part II of title 18, United States Code, is amended by adding after chapter 237 the following:</text>

							<toc-entry bold="off" idref="H99DC8932967B4710B9760C908DE08B7B" level="section">3772. Sexual assault survivors' rights.</toc-entry></toc>
						<section commented="no" display-inline="no-display-inline" id="H99DC8932967B4710B9760C908DE08B7B" section-type="subsequent-section"><enum>3772.</enum><header display-inline="yes-display-inline">Sexual assault survivors' rights</header>
 <subsection commented="no" display-inline="no-display-inline" id="H89887D4FFF1848B48F54F7139E295106"><enum>(a)</enum><header display-inline="yes-display-inline">Rights of sexual assault survivors</header><text display-inline="yes-display-inline">In addition to those rights provided in section 3771, a sexual assault survivor has the following rights:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H09A6E466903746198F8116E782C133FB"><enum>(1)</enum><text display-inline="yes-display-inline">The right not to be prevented from, or charged for, receiving a medical forensic examination.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD5F9E7C61EF145B88BE34DCCB29D9D8E"><enum>(2)</enum><text display-inline="yes-display-inline">The right to—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H061639F08ECF4F6BB16F0CA119D9A832"><enum>(A)</enum><text display-inline="yes-display-inline">subject to paragraph (3), have a sexual assault evidence collection kit or its probative contents preserved, without charge, for the duration of the maximum applicable statute of limitations or 20 years, whichever is shorter;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8AF9EB00E09E4E919477D1E9554DB831"><enum>(B)</enum><text display-inline="yes-display-inline">be informed of any result of a sexual assault evidence collection kit, including a DNA profile match, toxicology report, or other information collected as part of a medical forensic examination, if such disclosure would not impede or compromise an ongoing investigation; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H56EA8FB1F635456BBA881ECE40A5F7D0"><enum>(C)</enum><text display-inline="yes-display-inline">be informed in writing of policies governing the collection and preservation of a sexual assault evidence collection kit.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H167AA4154DD54A13AF6CE5BCE92B8B9D"><enum>(3)</enum><text display-inline="yes-display-inline">The right to—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H51812A7A917D4544BE0412D9A25E4236"><enum>(A)</enum><text display-inline="yes-display-inline">upon written request, receive written notification from the appropriate official with custody not later than 60 days before the date of the intended destruction or disposal; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H09BB8109F7EC402F893CF24A9AE9744C"><enum>(B)</enum><text display-inline="yes-display-inline">upon written request, be granted further preservation of the kit or its probative contents.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1AB09D5AAAAF4455A06211ADFC99CA8C"><enum>(4)</enum><text display-inline="yes-display-inline">The right to be informed of the rights under this subsection.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8F286FD636C240E6B5625020942862C7"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">Subsections (b) through (f) of section 3771 shall apply to sexual assault survivors.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="H7184622A29CB4DABB07EE7F37CFFB870"><enum>(c)</enum><header display-inline="yes-display-inline">Definition of sexual assault</header><text display-inline="yes-display-inline">In this section, the term <term>sexual assault</term> means any nonconsensual sexual act proscribed by Federal, tribal, or State law, including when the victim lacks capacity to consent.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HFAA2482A79B6457EB549489B20B9DDA1"><enum>(d)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">This section, other than paragraphs (2)(A) and (3)(B) of subsection (a), shall be carried out using funds made available under section 1402(d)(3)(A)(i) of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/10601">42 U.S.C. 10601(d)(3)(A)(i)</external-xref>). No additional funds are authorized to be appropriated to carry out this section.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H84557C8D8A9D4EF5A896F5DC48211189"><enum>(b)</enum><header display-inline="yes-display-inline">Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of chapters for part II of title 18, United States Code, is amended by adding at the end the following:</text>

 </subsection><subsection commented="no" display-inline="no-display-inline" id="HEFE6B595E0824CA5B35423CE8BC55E7F"><enum>(c)</enum><header display-inline="yes-display-inline">Amendment to Victims of Crime Act of 1984</header><text display-inline="yes-display-inline">Section 1402(d)(3)(A)(i) of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/10601">42 U.S.C. 10601(d)(3)(A)(i)</external-xref>) is amended by inserting after <quote>section 3771</quote> the following: <quote>or section 3772, as it relates to direct services,</quote>.</text>
 </subsection></section><section commented="no" display-inline="no-display-inline" id="HE6CCB2A83EA94B078D134B354185AC30" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Sexual assault survivors’ notification grants</header><text display-inline="no-display-inline">The Victims of Crime Act of 1984 is amended by adding after section 1404E (<external-xref legal-doc="usc" parsable-cite="usc/42/10603e">42 U.S.C. 10603e</external-xref>) the following:</text>
			<quoted-block display-inline="no-display-inline" id="HEDC3329BE23B4BF28D8EB037E8CC6E94" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="H30D0A2DB82D34DA5B59AB2FC3FA42212" section-type="subsequent-section"><enum>1404F.</enum><header display-inline="yes-display-inline">Sexual assault survivors’ notification grants</header>
 <subsection commented="no" display-inline="no-display-inline" id="HE7AEB0F99DEF425B95D5CCE811878F5C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General may make grants as provided in section 1404(c)(1)(A) to States to develop and disseminate to entities described in subsection (c)(1) of this section written notice of applicable rights and policies for sexual assault survivors.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HC9875B87808145C7A0163AB015012A42"><enum>(b)</enum><header display-inline="yes-display-inline">Notification of rights</header><text display-inline="yes-display-inline">Each recipient of a grant awarded under subsection (a) shall make its best effort to ensure that each entity described in subsection (c)(1) provides individuals who identify as a survivor of a sexual assault, and who consent to receiving such information, with written notice of applicable rights and policies regarding—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HEA915AE9B1574424924FD85F10EFF17C"><enum>(1)</enum><text display-inline="yes-display-inline">the right not to be charged fees for or otherwise prevented from pursuing a sexual assault evidence collection kit;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC85B453B435A407D873A6638346A439B"><enum>(2)</enum><text display-inline="yes-display-inline">the right to have a sexual assault medical forensic examination regardless of whether the survivor reports to or cooperates with law enforcement;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2BE47138BB6843769E28AEB014D50684"><enum>(3)</enum><text display-inline="yes-display-inline">the availability of a sexual assault advocate;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCCF057A7D43449E18AE5DB77D4C96F5D"><enum>(4)</enum><text display-inline="yes-display-inline">the availability of protective orders and policies related to their enforcement;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2584CAE2DE524FE0827891DA33F17B4B"><enum>(5)</enum><text display-inline="yes-display-inline">policies regarding the storage, preservation, and disposal of sexual assault evidence collection kits;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDF24770182574BFCB39E50B17BAB521E"><enum>(6)</enum><text display-inline="yes-display-inline">the process, if any, to request preservation of sexual assault evidence collection kits or the probative evidence from such kits; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD265FCE83CAC49BB94996A2CA7D2B614"><enum>(7)</enum><text display-inline="yes-display-inline">the availability of victim compensation and restitution.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAA68600C816B47F69589560502370AF0"><enum>(c)</enum><header display-inline="yes-display-inline">Dissemination of written notice</header><text display-inline="yes-display-inline">Each recipient of a grant awarded under subsection (a) shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H084CF9E1BD384119A07F1EECBE7572BC"><enum>(1)</enum><text display-inline="yes-display-inline">provide the written notice described in subsection (b) to medical centers, hospitals, forensic examiners, sexual assault service providers, State and local law enforcement agencies, and any other State agency or department reasonably likely to serve sexual assault survivors; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H04744CB5AC7F46689D3F5B0118EF3454"><enum>(2)</enum><text display-inline="yes-display-inline">make the written notice described in subsection (b) publicly available on the Internet website of the attorney general of the State.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEB898545002A4426A2E9C84B3CCEC205"><enum>(d)</enum><header display-inline="yes-display-inline">Provision To promote compliance</header><text display-inline="yes-display-inline">The Attorney General may provide such technical assistance and guidance as necessary to help recipients meet the requirements of this section.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H9F88E435555B4BF49C1927181F0A328A"><enum>(e)</enum><header display-inline="yes-display-inline">Integration of systems</header><text display-inline="yes-display-inline">Any system developed and implemented under this section may be integrated with an existing case management system operated by the recipient of the grant if the system meets the requirements listed in this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="HBF27124D58BD4954A7AF74B4FEDA9624" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Working group</header>
 <subsection commented="no" display-inline="no-display-inline" id="H4C37E162F3CD4D9292A6C836CBE31DA4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General, in consultation with the Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>), shall establish a joint working group (referred to in this section as the <quote>Working Group</quote>) to develop, coordinate, and disseminate best practices regarding the care and treatment of sexual assault survivors and the preservation of forensic evidence.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HC02F295F4C7E446EA827D14C96DB43D7"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation with stakeholders</header><text display-inline="yes-display-inline">The Working Group shall consult with—</text> <paragraph commented="no" display-inline="no-display-inline" id="H47A4B2F8E09040D4A19D6C9277557FBC"><enum>(1)</enum><text display-inline="yes-display-inline">stakeholders in law enforcement, prosecution, forensic laboratory, counseling, forensic examiner, medical facility, and medical provider communities; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2235581096B14C399689141290D525F2"><enum>(2)</enum><text display-inline="yes-display-inline">representatives of not less than 3 entities with demonstrated expertise in sexual assault prevention, sexual assault advocacy, or representation of sexual assault victims, of which not less than 1 representative shall be a sexual assault victim.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H66DC5258DFCA417EBCFDEA93C7CC2F4A"><enum>(c)</enum><header display-inline="yes-display-inline">Membership</header><text display-inline="yes-display-inline">The Working Group shall be composed of governmental or nongovernmental agency heads at the discretion of the Attorney General, in consultation with the Secretary.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HF964DB848D2F4A0BBB21F4DF6889A413"><enum>(d)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Working Group shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="HE82663D073854F45B07A4383038E7BDC"><enum>(1)</enum><text display-inline="yes-display-inline">develop recommendations for improving the coordination of the dissemination and implementation of best practices and protocols regarding the care and treatment of sexual assault survivors and the preservation of evidence to hospital administrators, physicians, forensic examiners, and other medical associations and leaders in the medical community;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEFFE34C4D01B4620886DAE2D8B08D213"><enum>(2)</enum><text display-inline="yes-display-inline">encourage, where appropriate, the adoption and implementation of best practices and protocols regarding the care and treatment of sexual assault survivors and the preservation of evidence among hospital administrators, physicians, forensic examiners, and other medical associations and leaders in the medical community;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7D3BCF37500648CC904759252C86C675"><enum>(3)</enum><text display-inline="yes-display-inline">develop recommendations to promote the coordination of the dissemination and implementation of best practices regarding the care and treatment of sexual assault survivors and the preservation of evidence to State attorneys general, United States attorneys, heads of State law enforcement agencies, forensic laboratory directors and managers, and other leaders in the law enforcement community;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H75384B76C221424AB4C70235C739A1F2"><enum>(4)</enum><text display-inline="yes-display-inline">develop and implement, where practicable, incentives to encourage the adoption or implementation of best practices regarding the care and treatment of sexual assault survivors and the preservation of evidence among State attorneys general, United States attorneys, heads of State law enforcement agencies, forensic laboratory directors and managers, and other leaders in the law enforcement community;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF6614596984B4006AABC1D19C16D53B8"><enum>(5)</enum><text display-inline="yes-display-inline">collect feedback from stakeholders, practitioners, and leadership throughout the Federal and State law enforcement, victim services, forensic science practitioner, and health care communities to inform development of future best practices or clinical guidelines regarding the care and treatment of sexual assault survivors; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBAB230D21AE74FD081950B5C1E835FE4"><enum>(6)</enum><text display-inline="yes-display-inline">perform other activities, such as activities relating to development, dissemination, outreach, engagement, or training associated with advancing victim-centered care for sexual assault survivors.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H95A116577F7D481D928C90584AE8D2DA"><enum>(e)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Working Group shall submit to the Attorney General, the Secretary, and Congress a report containing the findings and recommended actions of the Working Group.</text>
