<section id="HAF542A187884431FA081DB8712BBF2CA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Families with Disabilities Act of 2016</short-title></quote>.</text></section> <section id="HED158A369FAE4A0C81335A6F07067799"><enum>2.</enum><header>Clarification regarding application of Medicaid spousal impoverishment protections to recipients of home and community-based services</header> <subsection id="HE25030DF1B9C4800945A9048802E6431"><enum>(a)</enum><header>In general</header><text>Section 2404 of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-5">42 U.S.C. 1396r–5</external-xref> note) is amended—</text> 
<paragraph id="HA60F6DF1726545FD84D07D7EC823B5F7"><enum>(1)</enum><text>by striking <quote>During</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HB856204B0B8B4DC1869B592BBC1E61DF" style="OLC"> <subsection id="HC555CFDEF93B4563B4B813735D002F91"><enum>(a)</enum><header>In general</header><text>During</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HDD74F03CB5664C57BCBF326EF7FBD215"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H053075BDA43C4ED68457224A2B350B1F" style="OLC"> <subsection id="H5D937DDAE3664F2AB394DB31E8E980E7"><enum>(b)</enum><header>Rule of construction</header><text>During the period in which subsection (a) is in effect, nothing in subsection (a) or section 1924 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-5">42 U.S.C. 1396r–5</external-xref>) shall be construed as prohibiting a State that, as of January 1, 2014, had a home and community-based waiver approved under section 1915(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396n">42 U.S.C. 1396n(c)</external-xref>) under which the State disregarded the income and assets of the individual’s spouse in determining the initial and ongoing financial eligibility of an individual for services provided under such home and community-based waiver in place of the spousal impoverishment provisions applied under such section 1924, from continuing to disregard the individual’s spousal income and assets for purposes of making such determinations while such waiver remains in effect.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HBC1693C8B78B45E094197F804B45EC0E"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect as if enacted on January 1, 2014.</text></subsection></section> </legis-body> </bill>
