		<official-title>To amend the National Labor Relations Act to establish an efficient system to enable employees to
			 form, join, or assist labor organizations, to provide for mandatory
			 injunctions for unfair labor practices during organizing efforts, and for
			 other purposes.</official-title>

 <section display-inline="no-display-inline" id="HAE95E2B41FA242479DF16A35C5CE36BB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Employee Free Choice Act</short-title> of 2016</quote>.</text> </section><section id="H4E2A29EC01DC48D6BD12B70FF27D35E4"><enum>2.</enum><header>Streamlining union certification</header> <subsection id="H2864D05686AF43569C1891028AA647A4"><enum>(a)</enum><header>In general</header><text>Section 9(c) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/159">29 U.S.C. 159(c)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block id="H28350ACE4BBE416D8B8414831A360F58">
 <paragraph id="H32D8FAC50CBA43599E3AB60C7FEB6F9F" indent="up1"><enum>(6)</enum><text>Notwithstanding any other provision of this section, whenever a petition shall have been filed by an employee or group of employees or any individual or labor organization acting in their behalf alleging that a majority of employees in a unit appropriate for the purposes of collective bargaining wish to be represented by an individual or labor organization for such purposes, the Board shall investigate the petition. If the Board finds that a majority of the employees in a unit appropriate for bargaining has signed valid authorizations designating the individual or labor organization specified in the petition as their bargaining representative and that no other individual or labor organization is currently certified or recognized as the exclusive representative of any of the employees in the unit, the Board shall not direct an election but shall certify the individual or labor organization as the representative described in subsection (a).</text>
 </paragraph><paragraph id="H8634F1E2AB5E47DE8D42AFE76E4EED98" indent="up1"><enum>(7)</enum><text>The Board shall develop guidelines and procedures for the designation by employees of a bargaining representative in the manner described in paragraph (6). Such guidelines and procedures shall include—</text>
 <subparagraph id="H79E411FB7F934C7B9CD85D93CB69AFFF"><enum>(A)</enum><text>model collective bargaining authorization language that may be used for purposes of making the designations described in paragraph (6); and</text>
 </subparagraph><subparagraph id="H67F2E3C31EB345AC8577FF723726CE08"><enum>(B)</enum><text>procedures to be used by the Board to establish the validity of signed authorizations designating bargaining representatives.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H77E5579AE9BB47A2A2C55BD72B1FAEF5"><enum>(b)</enum><header>Conforming amendments</header>
 <paragraph id="HE25D655909E5441CB66AB5FE9614469B"><enum>(1)</enum><header>National labor relations Board</header><text>Section 3(b) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/153">29 U.S.C. 153(b)</external-xref>) is amended, in the second sentence—</text>
 <subparagraph id="H46D010692E4B49B797C963D460DBE0D8"><enum>(A)</enum><text>by striking <quote>and to</quote> and inserting <quote>to</quote>; and</text> </subparagraph><subparagraph id="H67471A9FF21445AF93A7FC83E0598C93"><enum>(B)</enum><text>by striking <quote>and certify the results thereof,</quote> and inserting <quote>, and to issue certifications as provided for in that section,</quote>.</text>
 </subparagraph></paragraph><paragraph id="H4249B7DA01394A27899E79B00126133E"><enum>(2)</enum><header>Unfair labor practices</header><text>Section 8(b) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158(b)</external-xref>) is amended—</text> <subparagraph id="H8CCC0B7A2A7E4EB6A54B24694C26DB29"><enum>(A)</enum><text>in paragraph (7)(B) by striking <quote>, or</quote> and inserting <quote>or a petition has been filed under section 9(c)(6), or</quote>; and</text>
 </subparagraph><subparagraph id="H2F5C814C53F144D6AC2230DD0895785D"><enum>(B)</enum><text>in paragraph (7)(C) by striking <quote>when such a petition has been filed</quote> and inserting <quote>when such a petition other than a petition under section 9(c)(6) has been filed</quote>.</text> </subparagraph></paragraph></subsection></section><section id="HB143E87928014DC08FBF11F724F6F45B"><enum>3.</enum><header>Facilitating initial collective bargaining agreements</header><text display-inline="no-display-inline">Section 8 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block id="H61FC6ACE63604774A3E604B065E2C010">
 <subsection id="H3D1CA8150BFE4B4BBAA0D26FE1EF70EA"><enum>(h)</enum><text>Whenever collective bargaining is for the purpose of establishing an initial agreement following certification or recognition, the provisions of subsection (d) shall be modified as follows:</text>
 <paragraph id="H42C67D264B4C426FB148E594DD1E9AD7"><enum>(1)</enum><text>Not later than 10 days after receiving a written request for collective bargaining from an individual or labor organization that has been newly organized or certified as a representative as defined in section 9(a), or within such further period as the parties agree upon, the parties shall meet and commence to bargain collectively and shall make every reasonable effort to conclude and sign a collective bargaining agreement.</text>
 </paragraph><paragraph id="HD1C7C009FC3642458B7099D07F407EB5"><enum>(2)</enum><text>If after the expiration of the 90-day period beginning on the date on which bargaining is commenced, or such additional period as the parties may agree upon, the parties have failed to reach an agreement, either party may notify the Federal Mediation and Conciliation Service of the existence of a dispute and request mediation. Whenever such a request is received, it shall be the duty of the Service promptly to put itself in communication with the parties and to use its best efforts, by mediation and conciliation, to bring them to agreement.</text>
 </paragraph><paragraph id="H543D32D537DE4C98B42F9B6445ED0A7E"><enum>(3)</enum><text>If after the expiration of the 30-day period beginning on the date on which the request for mediation is made under paragraph (2), or such additional period as the parties may agree upon, the Service is not able to bring the parties to agreement by conciliation, the Service shall refer the dispute to an arbitration board established in accordance with such regulations as may be prescribed by the Service. The arbitration panel shall render a decision settling the dispute and such decision shall be binding upon the parties for a period of 2 years, unless amended during such period by written consent of the parties.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HD9F3CB86E00C4132A981B29DA57911C1"><enum>4.</enum><header>Strengthening enforcement</header>
			<subsection id="HFA941348099F41E8BCB3C649979A42B5"><enum>(a)</enum><header>Injunctions against unfair labor practices during organizing drives</header>
 <paragraph id="HC4627546F7974F6EABFE6A0B74161C0C"><enum>(1)</enum><header>In general</header><text>Section 10(l) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/160">29 U.S.C. 160(l)</external-xref>) is amended—</text> <subparagraph id="H284204187EBD4B918CE7E7B6CF8D82FE"><enum>(A)</enum><text>in the second sentence, by striking <quote>If, after such</quote> and inserting the following:</text>
						<quoted-block id="H77210B5B4DA2411BBB0D5B7542493E7E">
 <paragraph id="HC67793BF7A1F4B3EBBC35ADC1D704702" indent="up1"><enum>(2)</enum><text>If, after such</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph><subparagraph id="HE3BC05C8FE8C4FD0A356F6CD70F8F3BD"><enum>(B)</enum><text>by striking the first sentence and inserting the following:</text>
						<quoted-block id="H507752D42276493E91C463BFDD9C3E99">
 <paragraph id="HFC37E965C8844AA6AC40C367C3F93A8D" indent="up1"><enum>(1)</enum><text>Whenever it is charged—</text> <subparagraph id="HB1A0DF0508C9495097B43B549E0F73B0"><enum>(A)</enum><text>that any employer—</text>
 <clause id="H7F75203EEE9D4D5695B46D30B21540D6"><enum>(i)</enum><text>discharged or otherwise discriminated against an employee in violation of subsection (a)(3) of section 8;</text>
 </clause><clause id="HF3B36C875779497E99B37A29EC020C46"><enum>(ii)</enum><text>threatened to discharge or to otherwise discriminate against an employee in violation of subsection (a)(1) of section 8; or</text>
 </clause><clause id="H1C3164AB6B374CF18C24B69FD2F35556"><enum>(iii)</enum><text>engaged in any other unfair labor practice within the meaning of subsection (a)(1) that significantly interferes with, restrains, or coerces employees in the exercise of the rights guaranteed in section 7;</text>
									</clause><continuation-text continuation-text-level="subparagraph">while employees of that employer were seeking representation by a labor organization or during the
			 period after a labor organization was recognized as a representative
			 defined in section 9(a) until the first collective bargaining contract is
 entered into between the employer and the representative; or</continuation-text></subparagraph><subparagraph id="H6AE56A5E9B7348C39D45680F4C091588"><enum>(B)</enum><text>that any person has engaged in an unfair labor practice within the meaning of subparagraph (A), (B), or (C) of section 8(b)(4), section 8(e), or section 8(b)(7);</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">the preliminary investigation of such charge shall be made forthwith and given priority over all
			 other cases except cases of like character in the office where it is filed
			 or to which it is referred.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H0D52AA2EF8E74C9EB4CE5EDB441073F0"><enum>(2)</enum><header>Conforming amendment</header><text>Section 10(m) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/160">29 U.S.C. 160(m)</external-xref>) is amended by inserting <quote>under circumstances not subject to section 10(l)</quote> after <quote>section 8</quote>.</text> </paragraph></subsection><subsection id="HADFFA35F3E6F44D1AC303A00564A42DC"><enum>(b)</enum><header>Remedies for violations</header> <paragraph id="HC068E428585B4280A8FC18829DFA63C1"><enum>(1)</enum><header>Backpay</header><text>Section 10(c) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/160">29 U.S.C. 160(c)</external-xref>) is amended by striking <quote><italic>And provided further,</italic></quote> and inserting <quote><italic>Provided further</italic>, That if the Board finds that an employer has discriminated against an employee in violation of subsection (a)(3) of section 8 while employees of the employer were seeking representation by a labor organization, or during the period after a labor organization was recognized as a representative defined in subsection (a) of section 9 until the first collective bargaining contract was entered into between the employer and the representative, the Board in such order shall award the employee back pay and, in addition, 2 times that amount as liquidated damages: <italic>Provided further</italic>,</quote>.</text>
 </paragraph><paragraph id="H6E9FC0B5E5BB48BDA25F69098DC22C43"><enum>(2)</enum><header>Civil penalties</header><text>Section 12 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/162">29 U.S.C. 162</external-xref>) is amended—</text> <subparagraph id="HFC3A0926073F46CFAB5568F0E87F03E6"><enum>(A)</enum><text>by striking <quote>Any</quote> and inserting <quote>(a) Any</quote>; and</text>
 </subparagraph><subparagraph id="HEE9B9963C24D402D9D72A51647382BEF"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block id="HDBC6E776F1CF4665908F9C9D5EAD0DFE"> <subsection id="H3F3F249813144968A40D1ADDD960DF59"><enum>(b)</enum><text>Any employer who willfully or repeatedly commits any unfair labor practice within the meaning of subsection (a)(1) or (a)(3) of section 8 while employees of the employer are seeking representation by a labor organization or during the period after a labor organization has been recognized as a representative defined in subsection (a) of section 9 until the first collective bargaining contract is entered into between the employer and the representative shall, in addition to any make-whole remedy ordered, be subject to a civil penalty of not to exceed $20,000 for each violation. In determining the amount of any penalty under this section, the Board shall consider the gravity of the unfair labor practice and the impact of the unfair labor practice on the charging party, on other persons seeking to exercise rights guaranteed by this Act, or on the public interest.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection></section></legis-body>
