		<official-title>To make an attack on a police officer a hate crime, and for other purposes.</official-title>

 <section id="H0D05FAC6298842FA9452A44A78A94025" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Blue Lives Matter Act of 2016</short-title></quote>.</text> </section><section id="H8BBDB6208F3E437DBF9140DB08437CC0" section-type="subsequent-section"><enum>2.</enum><header>Hate crime against police officers</header> <subsection id="H0B77E5E8B92E4FFF9EEA426B5BF60E7A"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/13">Chapter 13</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H9A2B9F12A3B649E2A5A9CCB261AA6D06" style="USC">
					<section id="H74DCFFE28F5848A0B34D841E4892CBE4"><enum>250.</enum><header>Hate crimes against police officers</header>
 <subsection id="H57F2D118167C479AB11BC6F708146208"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever, in any circumstance described in section 249(a)(2)(B) of this title, knowingly causes bodily injury to any person, or attempts to do so, because of the actual or perceived status of the person as a police officer—</text>
 <paragraph commented="no" id="HCCB4127947D54A47B4BD43764C202478"><enum>(1)</enum><text>shall be imprisoned not more than 10 years, fined in accordance with this title, or both; and</text> </paragraph><paragraph id="HF873695ED3DA4415B1DBE548B821A33A"><enum>(2)</enum><text display-inline="yes-display-inline">shall be imprisoned for any term of years or for life, fined in accordance with this title, or both, if—</text>
								<subparagraph id="HC0EA0199F7D548CEAFB45340901F2DCD">
									<enum>(A)</enum>
 <text>death results from the offense; or</text> </subparagraph><subparagraph commented="no" id="H07F37C037D3946BFA462FDD42E9FD681"> <enum>(B)</enum> <text display-inline="yes-display-inline">the offense includes kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" id="HCE837B85F7B1478D97E4A9BB5654FFA4"><enum>(b)</enum><header>Certification requirement</header>
 <paragraph commented="no" id="H7F275615DF514974ACD40D8A1A9442AB"><enum>(1)</enum><header>In general</header><text>No prosecution of any offense described in this section may be undertaken by the United States, except under the certification in writing of the Attorney General, or a designee, that—</text>
 <subparagraph commented="no" id="HA23425F951EA4D33BF0747E0451D74CD"><enum>(A)</enum><text display-inline="yes-display-inline">the State does not have jurisdiction;</text> </subparagraph><subparagraph commented="no" id="H8CC0FCE0C6094792B1AEE5C27D74A808"><enum>(B)</enum><text display-inline="yes-display-inline">the State has requested that the Federal Government assume jurisdiction;</text>
 </subparagraph><subparagraph commented="no" id="HAF2338E5D38B4C1BBFA6EA6C08B11445"><enum>(C)</enum><text display-inline="yes-display-inline">the verdict or sentence obtained pursuant to State charges left demonstratively unvindicated the Federal interest in eradicating bias-motivated violence; or</text>
 </subparagraph><subparagraph commented="no" id="H02820A744FB34BA7933AD35D8E77B730"><enum>(D)</enum><text display-inline="yes-display-inline">a prosecution by the United States is in the public interest and necessary to secure substantial justice.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H9D357236385C4369A6531302155DDA81"><enum>(2)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to limit the authority of Federal officers, or a Federal grand jury, to investigate possible violations of this section.</text>
 </paragraph></subsection><subsection commented="no" id="HF8220E84E63D4B8E83432B6D1F94FA03"><enum>(c)</enum><header>Guidelines</header><text>All prosecutions conducted by the United States under this section shall be undertaken pursuant to guidelines issued by the Attorney General, or the designee of the Attorney General, to be included in the United States Attorneys' Manual that shall establish neutral and objective criteria for determining whether a crime was committed because of the actual or perceived status of any person.</text>
						</subsection><subsection id="HC29653E5EE8240B2B0F68A4CBA18BCD1"><enum>(d)</enum><header>Statute of limitations</header>
 <paragraph id="H7E9C76143F794D8387182EB04CCFE77C"><enum>(1)</enum><header>Offenses not resulting in death</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), no person shall be prosecuted, tried, or punished for any offense under this section unless the indictment for such offense is found, or the information for such offense is instituted, not later than 7 years after the date on which the offense was committed.</text>
 </paragraph><paragraph id="H39C359B484BF4DE685617C0843480CB1"><enum>(2)</enum><header>Offenses resulting in death</header><text display-inline="yes-display-inline">An indictment or information alleging that an offense under this section resulted in death may be found or instituted at any time without limitation.</text>
 </paragraph></subsection><subsection id="H491C352CE77748F280EF253AFEAF4076"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HDB81F9236C0545E5A483A915C13697B4"><enum>(1)</enum><header>Police officer</header><text display-inline="yes-display-inline">The term <quote>police officer</quote> means any officer or employee of the United States, any State, or any political subdivision of a State, while engaged in the enforcement or prosecution of any of the criminal laws of the United States, a State, or any political subdivision of a State.</text>
 </paragraph><paragraph id="HA81EA77BFDD8495C8DA7D78FD2776AE6"><enum>(2)</enum><header>State</header><text>The term <quote>State</quote> includes the District of Columbia, Puerto Rico, and any other territory or possession of the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H3F4E0618EEDE4FBDA9C529B7BB1FEFFE"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>
