 <section id="HF8E367A590C3481C8B6A397490BA6736" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Overreach Within the Executive Rulemaking System Act of 2016</short-title></quote> or the <quote>POWERS Act of 2016</quote>.</text> </section><section id="HEB800819E32A402ABD1411C6A22BA046"><enum>2.</enum><header>Requiring agency response to comments from congressional committees about proposed rulemaking</header> <subsection id="HD4DE47E98F1C4C47A564E76E91FC515A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 553(c) of title 5, United States Code, is amended—</text>
 <paragraph id="HBE1E83AC242F4060B51AC1867E2ECABD"><enum>(1)</enum><text>by striking <quote>After notice</quote> and inserting <quote>(1) After notice</quote>; and</text> </paragraph><paragraph id="HDDFA376A20EB4E5CB0E1342ED87D1920"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HCA273DEC0A6D4C0184DCA7DF107353AD" style="OLC">
 <paragraph id="H37131DDAD9034C08B072FB1794C0E17C" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">No publication or service of a rule may be made during the period beginning on the date of the publication of a notice of proposed rulemaking under subsection (b) with respect to such rule and ending on the date that is 60 days after such date of publication, subject to paragraph (3).</text>
 </paragraph><paragraph id="HD0073DB4431B4B5C931B474F34864E0E" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id5CFDE616135941ECABADA904AB82B64E"><enum>(A)</enum><text>With respect to a rule, if a committee of the House of Representatives or the Senate that has jurisdiction under the Rules of the House of Representatives or the Senate, respectively, over the provision of law that authorizes the agency to issue the rule submits written data, views, or arguments to the head of the agency through electronic mail and physical mail during the period described in paragraph (2), not later than 10 days after the date of such submission, the head of the agency shall publish in the Federal Register a response that addresses the content of such submission and answers any questions posed in such submission.</text>
 </subparagraph><subparagraph id="H9832FB2270A64437AD278F0320EEF3F1" indent="up1"><enum>(B)</enum><text>The period beginning on the date of such submission and ending on the date of such publication (or a notification under paragraph (4)(B)) shall not count as part of the period described in paragraph (2).</text>
 </subparagraph></paragraph><paragraph id="H1D1D94AA0D5E444DB0707EA29724E726" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Paragraph (3)(A) shall not apply with respect to a subsequent submission with respect to a rule to the head of an agency under such paragraph by a committee that has made an initial submission to such head and received a response under such paragraph if the head—</text>
 <subparagraph id="H5BB9D1127EA9423E81461B58AA6A03A6"><enum>(A)</enum><text>determines that such subsequent submission—</text> <clause id="HE6175D286F3A4583B9CCAA8CEB2E4DEE"><enum>(i)</enum><text>fails to address the content of such response; or</text>
 </clause><clause id="H6432BC78F1664678ADED1171C3FE1DA1"><enum>(ii)</enum><text>raises issues that were not raised in the initial submission or the response; and</text> </clause></subparagraph><subparagraph id="H7605279E1E474D348AF2BCAC26BEBFD7"><enum>(B)</enum><text>notifies the committee of such determination.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HE1246899A93E4CBBABFC704F0C54FD9F"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to a rule for which the notice of proposed rulemaking is published under section 553(b) of title 5, United States Code, on or after the date of enactment of this Act.</text>
