 <section id="H5E24A78780BA4A6AA7E034AEC38090C8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Commercial UAS Modernization Act</short-title></quote>.</text> </section><section id="H5630FFB55DB64B479C648E70832FE97E" section-type="subsequent-section"><enum>2.</enum><header>Interim rule for the operation of small unmanned aircraft for commercial purposes</header> <subsection id="H6101599C39F345A092F44C6FFBCEDABF"><enum>(a)</enum><header>In general</header><text>Subtitle B of title III of the <short-title>FAA Modernization and Reform Act of 2012</short-title> (<external-xref legal-doc="public-law" parsable-cite="pl/112/95">Public Law 112–95</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H4030B060AF844347940D15D8A61DDF5D" style="OLC">
					<section id="HC35495D803264D469A83C58627614F6D"><enum>337.</enum><header>Operation of small unmanned aircraft for commercial purposes</header>
 <subsection id="H47713818383A4986B287B897A3CC68DA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An individual may operate a small unmanned aircraft for commercial purposes without an airworthiness certificate within the United States, subject to the requirements under subsection (b) and the operating restrictions under subsection (c) during the period beginning on the date of the enactment of the <short-title>Commercial UAS Modernization Act</short-title> and ending on the effective date of a final rule based on the notice of proposed rulemaking issued on February 23, 2015, entitled <quote>Operation and Certification of Small Unmanned Aircraft Systems</quote> (80 Fed. Reg. 9544).</text>
						</subsection><subsection id="H610A49CD77A143209DAE79CBF92529B1"><enum>(b)</enum><header>General requirements</header>
 <paragraph id="HDAE0E05173DD4F0A96AC8E99DE5C8B6D"><enum>(1)</enum><header>Liability insurance</header><text>A small unmanned aircraft may not be operated for commercial purposes during the period set forth in subsection (a) unless the Administrator receives an attestation that the owner of such aircraft has a liability insurance policy covering the operation of such aircraft.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCB72BBFC299A407A8CDF8BD77FCCAAFC"><enum>(2)</enum><header>Registration</header><text>A small unmanned aircraft may not be operated for commercial purposes unless the owner has registered the aircraft as required by the Federal Aviation Administration.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFE2911BFF7274D9DBCC5DC74ED9DAAEB"><enum>(3)</enum><header>Testing requirements</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="H662C8BAAD72B43278DC5982C71574384"><enum>(A)</enum><header>Exam development</header><text>Not later than 30 days after the date of the enactment of the <short-title>Commercial UAS Modernization Act</short-title>, the Administrator of the Federal Aviation Administration shall develop an initial aeronautical knowledge test that meets the requirements set forth in the notice of proposed rulemaking referred to in subsection (a).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4E73789DE3DF409D9D4947400247A6A8"><enum>(B)</enum><header>Requirements</header><text>An individual may not operate a small unmanned aircraft for commercial purposes unless such individual has—</text>
 <clause commented="no" display-inline="no-display-inline" id="H59C97E7AB25540409436B7163D54B4EC"><enum>(i)</enum><text>received a passing grade on the test developed under subparagraph (A);</text> </clause><clause commented="no" display-inline="no-display-inline" id="H8D42101C49EE4C36B82783392CE70862"><enum>(ii)</enum><text>passed a proficiency test administered by a test site selected pursuant to section 332(c); and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H8C76796D7B8F4947B4D9F73548868708"><enum>(iii)</enum><text>demonstrated the ability to fly the aircraft in accordance with the operating restrictions set forth in subsection (c).</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE82AE2F44086479CB0D06909A1F9C6E3"><enum>(4)</enum><header>Certification</header><text>A small unmanned aircraft may not be operated for commercial purposes until the operator of a test site selected pursuant to section 332(c), in collaboration with a designated airworthiness representative, certifies that the small unmanned aircraft—</text>
 <subparagraph id="H73605C74383F4839A207C63536067F87"><enum>(A)</enum><text>meets the requirements for small unmanned aircraft set forth in the notice of proposed rulemaking referred to in subsection (a); and</text>
 </subparagraph><subparagraph id="H0CEFE898C80A405AB97ED15D31A0305A"><enum>(B)</enum><text>is capable of operating within the limits described in subsection (c).</text> </subparagraph></paragraph></subsection><subsection id="H5C5920433DCB42AD879E19C36261F28C"><enum>(c)</enum><header>Operating restrictions</header><text>During the period set forth in subsection (a), small unmanned aircraft operated for commercial purposes—</text>
 <paragraph id="HD9255F814D184C4BBAF68802D6098E66"><enum>(1)</enum><text>may only be operated under visual line of sight rules;</text> </paragraph><paragraph id="H8B0D97686E6C442191928AAED125E7BB"><enum>(2)</enum><text>may not be operated higher than 500 feet above ground level;</text>
 </paragraph><paragraph id="H0C14BE0F34994412A274497EA152EDC2"><enum>(3)</enum><text>may not be operated unless the operator has prior authorization from the air traffic control facility having jurisdiction over that airspace—</text>
 <subparagraph id="H42A84CD3A81C4CB7AEC60A073270DDC3"><enum>(A)</enum><text>in Class B, Class C, or Class D airspace; or</text> </subparagraph><subparagraph id="H93656E68CB584BE38550F39CCD0D18EB"><enum>(B)</enum><text>within the lateral boundaries of the surface area of Class E airspace designated for an airport;</text>
 </subparagraph></paragraph><paragraph id="H02F7C0B75E974AC8AB30538E8C5974AF"><enum>(4)</enum><text>may only be operated in daylight conditions;</text> </paragraph><paragraph id="H14A88BC7D62240699983BA8753FC5DF0"><enum>(5)</enum><text>shall yield right of way to all other users of the National Airspace System;</text>
 </paragraph><paragraph id="H60A6512D6DD24D419BB7DD9027CC8392"><enum>(6)</enum><text>may not be operated by any individual with any physical or mental condition that the individual knows, or has reason to know, would interfere with the safe operation of the aircraft; and</text>
 </paragraph><paragraph id="HE22586D3882C4073BB6A5F74BE02BB56"><enum>(7)</enum><text>may only be operated after a preflight inspection (as described in the notice of proposed rulemaking referred to in subsection (a)).</text>
 </paragraph></subsection><subsection id="H9A50A5725CC1451B81C2790AC19DE477"><enum>(d)</enum><header>Accident reporting</header><text>The operator of a small unmanned aircraft that is involved in any accident causing personal injury or property damage, other than to the small unmanned aircraft, shall report such accident to the Federal Aviation Administration not later than 2 days after such accident.</text>
						</subsection></section><section id="HA6B3418B1F5B44C0BEB47C8016947712"><enum>338.</enum><header>Micro UAS operations</header>
 <subsection id="HD34A6FE8993A45799B378DEF078E021B"><enum>(a)</enum><header>Micro UAS classification</header><text>The Administrator of the Federal Aviation Administration shall provide for a micro UAS classification of unmanned aircraft systems, the aircraft component of which may not weigh more than 4.4 pounds, including payload.</text>
 </subsection><subsection id="HD008D7520DDB4D6C83D9F09B69D17D2C"><enum>(b)</enum><header>Micro UAS operational limitations</header><text>The operation of a micro UAS shall be subject to the exemptions under subsection (c) only if the micro UAS is operated—</text>
 <paragraph id="H480A3E4D3C084F3C91B3E75454A8632C"><enum>(1)</enum><text>less than 400 feet above ground level;</text> </paragraph><paragraph id="H23BFB92DDA794645A4D67C89F93D15BE"><enum>(2)</enum><text>at an airspeed of not greater than 40 knots;</text>
 </paragraph><paragraph id="HC5C5F5B328A048B6A3DB19F92C8E15D0"><enum>(3)</enum><text>within the visual line of sight of the operator;</text> </paragraph><paragraph id="H7A58FC8EECF647D685A93C2CFFBFF3D0"><enum>(4)</enum><text>during daylight; and</text>
 </paragraph><paragraph id="H65B32399253C401485A969CCAC13C910"><enum>(5)</enum><text>at least 5 statute miles from the geographic center of an airport as denoted on a current aeronautical chart published by the Federal Aviation Administration, except that upon notice to the airport operator and air traffic control tower, such airport operator may allow an individual to operate a micro UAS within 5 statute miles of a tower-controlled airport.</text>
							</paragraph></subsection><subsection id="H74F157EA847442B4AEBF1CF7815AD61E"><enum>(c)</enum><header>Micro UAS exemptions</header>
 <paragraph id="HC901DE92DAA64ACC873CD0C65AFC8039"><enum>(1)</enum><text>An operator of a micro UAS that complies with the limitations of operation under subsection (b) shall not be required to pass any aeronautical knowledge test or meet any age or experience requirement, including any requirements under section 44703 of title 49, United States Code, part 61 of title 14, Code of Federal Regulations, and any other rule or regulation pertaining to airman certification.</text>
 </paragraph><paragraph id="HE6F5E1162A0E4BC3ABB3107F300FF183"><enum>(2)</enum><text>A micro UAS and the component parts and equipment of such micro UAS shall not be required to meet airworthiness certification standards or to obtain certificates of airworthiness.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H7DBD080E21F84C51B6723AD54E017DDD"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the <short-title>FAA Modernization and Reform Act of 2012</short-title> is amended by inserting after the item relating to section 336 the following:</text> <quoted-block id="H37E6B3DCA51347999DDE4EB117C0580F" style="OLC"> <toc> <toc-entry idref="HC35495D803264D469A83C58627614F6D" level="section">Sec. 337. Operation of small unmanned aircraft for commercial purposes.</toc-entry> <toc-entry level="section">Sec. 338. Micro UAS operations.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section><section id="HD44F33ADDC5E4217A938A8062BE1ECF3"><enum>3.</enum><header>Deputy Associate Administrator for Unmanned Aircraft</header> <subsection commented="no" display-inline="no-display-inline" id="HFA70D33C7C044C3489B4629370E485E3"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subtitle B of title III of the <short-title>FAA Modernization and Reform Act of 2012</short-title> (<external-xref legal-doc="public-law" parsable-cite="pl/112/95">Public Law 112–95</external-xref>), as amended by section 2(a), is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H1040151316054A558438A91EDB1DB015" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="H9DCC622BAFC64357B6CD9A41A934F6D4"><enum>339.</enum><header>Deputy Associate Administrator for Unmanned Aircraft</header>
 <subsection id="HFC0F44E0DFE6475EA5F6454978F20B37"><enum>(a)</enum><header>Appointment</header><text>The Administrator of the Federal Aviation Administration (referred to in this section as the <quote>Administrator</quote>) shall appoint a Deputy Associate Administrator for Unmanned Aircraft (referred to in this section as the <quote>Deputy Associate Administrator</quote>), who shall report to the Administrator and to the Secretary of Transportation.</text>
 </subsection><subsection id="H764484FF51D84674AB48122B2F47C9DC"><enum>(b)</enum><header>Principal duties</header><text>The Deputy Associate Administrator shall create an achievable comprehensive research and development plan for the safe integration of unmanned aircraft into the National Airspace System that—</text>
 <paragraph id="H37D2819AE73B4DF98FC96ABDF4E9AEF8"><enum>(1)</enum><text>takes into account work being done at other Federal agencies, in conjunction with their industry collaborators;</text>
 </paragraph><paragraph id="H1A404BB17B484E7A83CFCB1413ECEE91"><enum>(2)</enum><text>is based on an initial audit of current unmanned aircraft activity across the Federal Government in order to identify gaps and overlaps; and</text>
 </paragraph><paragraph id="HAE80883851FA425B8B7357FAF8A87869"><enum>(3)</enum><text>allows for programmatic exemptions based on previous analysis.</text> </paragraph></subsection><subsection id="H67AEB1198C7045F39A7FB782FB673814"><enum>(c)</enum><header>Other issues</header><text>The Deputy Associate Administrator, in consultation with the Administrator, shall develop strategies for resolving—</text>
 <paragraph id="H6521F7073B3547909EB8A3A479928BD0"><enum>(1)</enum><text>unmanned aircraft spectrum issues;</text> </paragraph><paragraph id="HE0C899BC8B1C46DFB42E0BAD5A76026D"><enum>(2)</enum><text>barriers to unmanned aircraft operating beyond line of sight;</text>
 </paragraph><paragraph id="HB2A6E9AFAC46416398774CF72224F658"><enum>(3)</enum><text display-inline="yes-display-inline">barriers to allowing payload carriage and the feasibility of developing a classification of small UAS air carriers; and</text>
 </paragraph><paragraph id="H9F09630562424DC5AA9ACEBDD86B4564"><enum>(4)</enum><text>barriers to utilizing automated unmanned aircraft systems.</text> </paragraph></subsection><subsection id="HDAD0D54020504D3CB63EF6BE952ECB7E"><enum>(d)</enum><header>Exemptions</header> <paragraph id="H3D0BCAF2BF4A42D49894B3D517E8C934"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of the <short-title>Commercial UAS Modernization Act</short-title>, the Deputy Associate Administrator, in consultation with the Administrator, shall expedite and expand exemptions from the interim operating restrictions otherwise applicable to unmanned aircraft under section 337.</text>
 </paragraph><paragraph id="H6B54D0BF666D44D58FFAB83245A1F3A1"><enum>(2)</enum><header>Exemptions</header><text>The exemptions authorized under paragraph (1) may include—</text> <subparagraph id="H4A0314CFCB0D468AA8184ADA972A2AE7"><enum>(A)</enum><text>beyond line of sight operations;</text>
 </subparagraph><subparagraph id="HC55290ED01694F6BBF44F6F61458C8DD"><enum>(B)</enum><text>programmatic exemptions based on previous analysis;</text> </subparagraph><subparagraph id="H728965321582423A87BE5D8ECE67A54A"><enum>(C)</enum><text>extended visual line of sight and marginal visual flight rules weather conditions; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H69AD6F47367145D3964C30B5E178B367"><enum>(D)</enum><text>heavier unmanned vehicles.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection commented="no" display-inline="no-display-inline" id="H54493FA60D854D6C83C7E088BD897A21"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the <short-title>FAA Modernization and Reform Act of 2012</short-title> is amended by inserting after the item relating to section 338, as added by section 2(b), the following:</text>

						<toc-entry idref="H9DCC622BAFC64357B6CD9A41A934F6D4" level="section">Sec. 339. Deputy Associate Administrator for Unmanned Aircraft.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H7D8CC22E2F7946878A4326A251DDC004"><enum>4.</enum><header>Joint Aircraft System Research and Development Data Collection and Analysis Program</header>
 <subsection id="H91C37D53690840BC83FD7DA6D0744664"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator of the Federal Aviation Administration shall establish a joint aircraft system research and development data collection and analysis program at the William J. Hughes Technical Center (referred to in this section as the <quote>Center</quote>).</text>
 </subsection><subsection id="H03A4F902EF5048ECB79C65551F4DC382"><enum>(b)</enum><header>Research and development priorities</header><text display-inline="yes-display-inline">The Director of the Center shall set priorities for data collection, analysis, and research under the program established under subsection (a), including identifying safety standards for detect and avoid, command and control, autonomous aircraft systems, and air traffic management for beyond visual line of sight operations for such aircraft.</text>
 </subsection><subsection id="H3D923993B1D542A0BE7BD9E34CCC5542"><enum>(c)</enum><header>Use of test sites</header><text display-inline="yes-display-inline">The program established under subsection (a) shall utilize the 6 unmanned aircraft system test sites of the Federal Aviation Administration to—</text>
 <paragraph id="H39BFD048CA56491DBDDCD5C97DE0843B"><enum>(1)</enum><text display-inline="yes-display-inline">conduct research;</text> </paragraph><paragraph id="H83CCAA2608FA42C4BBC34F431D963AC7"><enum>(2)</enum><text display-inline="yes-display-inline">collect data;</text>
 </paragraph><paragraph id="H6EAB238E480C44FABA298183A936C635"><enum>(3)</enum><text display-inline="yes-display-inline">develop quarterly milestones to expedite commercial unmanned aircraft system operations; and</text> </paragraph><paragraph id="H29766CD662954B84AA3AF530E991AC0C"><enum>(4)</enum><text display-inline="yes-display-inline">work with other Federal agencies, the Center of Excellence for Unmanned Aircraft Systems, federally funded research and development centers, industry, academia, and others, as appropriate, to implement commercial unmanned aircraft system operations.</text>
				</paragraph></subsection><subsection id="HD1942EE472EB40F3930EE25EF5B6A6AE"><enum>(d)</enum><header>Air Traffic Management Pilot Program</header>
 <paragraph id="HE5A783F6B43C4ACE9F701F0CE6E5C331"><enum>(1)</enum><header>Implementation</header><text>The Administrator of the Federal Aviation Administration, acting through the Center, and the Administrator of the National Aeronautics and Space Administration, shall implement an air traffic management pilot program to research and test a new regulatory structure for commercial and other operations of small unmanned aircraft in controlled and uncontrolled airspace below 1,200 feet above ground level.</text>
 </paragraph><paragraph id="HFA8D6FE8B8B144DEB3E79B840E944BC2"><enum>(2)</enum><header>Management testing</header><text>The Center shall partner with a neutral third party to test the management of small unmanned aircraft in the airspace described in paragraph (1).</text>
 </paragraph></subsection><subsection id="H278A864D0FEA48DCBB765F3C97C30E7E"><enum>(e)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, and every 180 days thereafter, the Director of the Center shall submit a report that summarizes the actions taken under subsections (b), (c), and (d) to—</text>
 <paragraph id="HE8B224D15AEC4F098958E0E55426E703"><enum>(1)</enum><text>the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>;</text> </paragraph><paragraph id="HB876D56DCE264DE393AF25AF0FB5247C"><enum>(2)</enum><text>the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>;</text>
 </paragraph><paragraph id="HBB2325DEA9714AF1BD13D9066842A6BE"><enum>(3)</enum><text>the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name>; and</text> </paragraph><paragraph id="HFED1637F42E2455B826680888D279C62"><enum>(4)</enum><text>the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>.</text>
				</paragraph></subsection></section></legis-body>
