 <section commented="no" display-inline="no-display-inline" id="H9285B42683B1424DA33DCA79E1339228" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing Education Through Technology Act of 2015</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="H75080DD04D9647C99331236E9CFFFBC4" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Achievement through technology and innovation</header> <subsection commented="no" display-inline="no-display-inline" id="H734B275EB70144959B32679B5B8323E1"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Part D of title II of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6751">20 U.S.C. 6751 et seq.</external-xref>) is amended to read as follows:</text>

					<part commented="no" id="H6A895DE7DBF04A278D90F5F6C5759383" level-type="subsequent"><enum>D</enum><header display-inline="yes-display-inline">Achievement through technology and innovation</header>
 <section commented="no" display-inline="no-display-inline" id="HCFA35DF543FB480E809EA6E016C7CBDA" section-type="subsequent-section"><enum>2401.</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="no-display-inline">The purposes of this part are—</text> <paragraph commented="no" display-inline="no-display-inline" id="HA45476180F1A4D028BFA93E83E0C226B"><enum>(1)</enum><text display-inline="yes-display-inline">to improve the achievement, academic growth, and college and career readiness of students who have developed the ability to think critically, apply knowledge to solve complex problems, work collaboratively, communicate effectively, be self-directed, and be responsible digital citizens;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H46EF3D3CD5844504B398969DB80B956E"><enum>(2)</enum><text display-inline="yes-display-inline">to ensure all students have access to personalized, rigorous, and engaging digital learning experiences;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3E005B4AC41246AAA1C6E919CD4B3C4B"><enum>(3)</enum><text display-inline="yes-display-inline">to ensure that educators have the knowledge and skills needed to develop and implement digital content and authentic learning experiences, use technology effectively in order to personalize and enhance learning, strengthen instruction, and effectively deliver and utilize assessments to measure and analyze student outcomes to support student success;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE2FA4D54A4644E34A9418F20D73C7655"><enum>(4)</enum><text display-inline="yes-display-inline">to ensure that administrators have the leadership, management, knowledge, and skills to design, develop, implement, and sustain a school or local educational agencywide digital age learning environment that promotes a shared vision of purposeful change among stakeholders and maximizes the use of digital age resources to meet and exceed learning goals and support effective instructional practice;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H799A40595DC0492C85EAAAE357D3E456"><enum>(5)</enum><text display-inline="yes-display-inline">to ensure that educators and administrators develop effective media and data literacy skills so that they can continuously curate, analyze, communicate multiple types of data to inform instruction, and personalize student learning;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H090FFECF6A194C4BB232CE6E354719AE"><enum>(6)</enum><text display-inline="yes-display-inline">to ensure that students in rural, remote, and underserved areas have the resources to take advantage of high-quality digital learning experiences;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD5BD0EA534F04B86B52F37E3007181C9"><enum>(7)</enum><text display-inline="yes-display-inline">to improve the efficiency and productivity of education through technology;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H539D7CC7F06141748D776DFB0F2EE833"><enum>(8)</enum><text display-inline="yes-display-inline">to ensure that students have increased access to dual and concurrent enrollment opportunities, career and technical courses, and programs leading to an industry recognized credential; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3B67EE6BB2654BB58F66B72D50040995"><enum>(9)</enum><text display-inline="yes-display-inline">to ensure that State educational agencies, local educational agencies, elementary schools, and secondary schools have the technological capacity, infrastructure, and technical support necessary to meet purposes described in paragraphs (1) through (7).</text>
 </paragraph></section><section commented="no" display-inline="no-display-inline" id="H9BF49DED3C6248B98459E6E3EEF5C93F" section-type="subsequent-section"><enum>2402.</enum><header display-inline="yes-display-inline">E-rate restriction</header><text display-inline="no-display-inline">Funds awarded under this part to a State may be used to address the networking needs of an entity that is eligible to receive support under the E-rate program, except that such funds may not be duplicative of support received by the entity under the E-rate program.</text>
 </section><section commented="no" display-inline="no-display-inline" id="HC726896930454E9B9DBF7675BA212DA1" section-type="subsequent-section"><enum>2403.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this part:</text> <paragraph commented="no" display-inline="no-display-inline" id="HE217BB55C97240A7972ED273EA5AD1F4"><enum>(1)</enum><header display-inline="yes-display-inline">Digital learning</header><text display-inline="yes-display-inline">The term <term>digital learning</term> means any instructional practice that effectively uses technology to strengthen a student’s learning experience and encompasses a wide spectrum of tools and practices, including—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H6549DD175338484F831B43B05B1AF334"><enum>(A)</enum><text display-inline="yes-display-inline">interactive learning resources that engage students in academic content;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE1CA8309985F48C8BEE277907B85832D"><enum>(B)</enum><text display-inline="yes-display-inline">access to online databases and other primary source documents;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3F302349A4C046F9A61A091B0D18A214"><enum>(C)</enum><text display-inline="yes-display-inline">the use of data, data analytics, and information to personalize learning and provide targeted supplementary instruction;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBF3F15C6836C42F88B599AB6695DCAA7"><enum>(D)</enum><text display-inline="yes-display-inline">student collaboration with content experts and peers;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H992BB9B8B9314296B1A6F508A44F6B56"><enum>(E)</enum><text display-inline="yes-display-inline">online and computer-based assessments;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBD9D28A89410416F8680738624C77CDE"><enum>(F)</enum><text display-inline="yes-display-inline">digital content, adaptive, and simulation software or courseware;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1022946181EE43019361FAB09050E8D7"><enum>(G)</enum><text display-inline="yes-display-inline">online courses, online instruction, or digital learning platforms;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6048C1C08C384BAAB3CA8FCEF3CBC566"><enum>(H)</enum><text display-inline="yes-display-inline">mobile and wireless technologies for learning in school and at home;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC419981BBDA64FB0A720CFB42DF44CE7"><enum>(I)</enum><text display-inline="yes-display-inline">learning environments that allow for rich collaboration and communication;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0312DB69C6E4457E82E0B5002CBB3AE7"><enum>(J)</enum><text display-inline="yes-display-inline">authentic audiences for learning in a relevant, real world experience;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H42A31807D2FF433EB4E6E815DA5DE23B"><enum>(K)</enum><text display-inline="yes-display-inline">teacher participation in virtual professional communities of practice;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1430D83EE8A54037B78B57DFC3BF7D9A"><enum>(L)</enum><text display-inline="yes-display-inline">hybrid or blended learning, which occurs under direct instructor supervision at a school or other location away from home and, at least in part, through online delivery of instruction with some element of student control over time, place, path, or pace; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H421EB3CF5D5D414F857FE6034CE4C5A8"><enum>(M)</enum><text display-inline="yes-display-inline">access to online course opportunities for students in rural or remote areas.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H43F6459212BC49EA9511E1375495D1DA"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible technology</header><text display-inline="yes-display-inline">The term <term>eligible technology</term> means modern information, computer, and communication technology hardware, software, services, or tools, including computer or mobile hardware devices and other computer and communications hardware, software applications, systems and platforms, and digital and online content, courseware, and online instruction and other online services and supports.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAEAF9255A7E247188778742CDC5D4206"><enum>(3)</enum><header display-inline="yes-display-inline">E-rate program</header><text display-inline="yes-display-inline">The term <term>E-rate program</term> means the Schools and Libraries Universal Service Support Mechanism established under section 254(h)(1)(B) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254(h)(1)(B)</external-xref>).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF2E3E42947F84383AA68FDA51CFCBD02"><enum>(4)</enum><header display-inline="yes-display-inline">Professional learning</header><text display-inline="yes-display-inline">The term <term>professional learning</term> is a process of continuous improvement for teachers and school leaders that improves educator knowledge, skills, and practice toward the goal of increased student achievement and—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HB3F65490FBA3427E8DB217BC5D399CEA"><enum>(A)</enum><text display-inline="yes-display-inline">is intensive, ongoing, connected to practice, and virtual or on-site where allowable;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H47D3A7A5C6724D7A9D62F58F16EC54F1"><enum>(B)</enum><text display-inline="yes-display-inline">is focused on student learning and addresses the teaching of specific curriculum content;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF6965FC00E3342CEA5750233BDCFB09C"><enum>(C)</enum><text display-inline="yes-display-inline">is aligned with school improvement priorities, goals of the school and local educational agency, and the individual needs of the educator;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE13470E908744510A362910A8C1841CE"><enum>(D)</enum><text display-inline="yes-display-inline">is designed to help school leaders provide and promote leadership in the use of educational technology to ensure a digital age learning environment; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA7F2E029524C4F73B47520E254D9D4C8"><enum>(E)</enum><text display-inline="yes-display-inline">builds strong working relationships among teachers and school leaders that—</text> <clause commented="no" display-inline="no-display-inline" id="HD734BF0DC1FF46FC8AB1BF25474AD3CE"><enum>(i)</enum><text display-inline="yes-display-inline">may be built around active professional communities of learning;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="HC7E3972CB1064B4DACF977B587C37738"><enum>(ii)</enum><text display-inline="yes-display-inline">may contain on-demand components, such as instructional videos, training documents, or learning modules; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H68BE000EA05640A39940416F4B396515"><enum>(iii)</enum><text display-inline="yes-display-inline">may involve the use of in-service technology coaches.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H645D63D41A3A47AD8FF706C8EBD09728"><enum>(5)</enum><header display-inline="yes-display-inline">School leader</header><text display-inline="yes-display-inline">The term <term>school leader</term> means a principal, assistant principal, or other individual who is—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H85639182014D4121814B15100C708C2E"><enum>(A)</enum><text display-inline="yes-display-inline">an employee or officer of an elementary school or secondary school, local educational agency, or other entity operating the elementary school or secondary school; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4B8CBA715386469A97253471346203DB"><enum>(B)</enum><text display-inline="yes-display-inline">responsible for the daily instructional leadership and managerial operations in the building of the elementary school or secondary school.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4DF50FA2CA114B22AC588678EEA81F07"><enum>(6)</enum><header display-inline="yes-display-inline">Student digital literacy</header><text display-inline="yes-display-inline">The term <term>student digital literacy</term> means student knowledge and skills in using contemporary information, communication, and learning technologies in a manner necessary for successful employment, lifelong learning, and citizenship in the knowledge-based, digital, and global 21st century, including, at a minimum, the ability to—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H0122DCE8FE6B4BD5AC795C2CAB15ECD6"><enum>(A)</enum><text display-inline="yes-display-inline">effectively communicate and collaborate;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H94894ECE654444D2B36E799A85BDFF22"><enum>(B)</enum><text display-inline="yes-display-inline">analyze and solve problems;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7A770A9030BB4CC3BCBBCD0397986B4E"><enum>(C)</enum><text display-inline="yes-display-inline">access, evaluate, manage, and create information and otherwise gain information literacy;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0D77AD1FE584432294589EA694B4514F"><enum>(D)</enum><text display-inline="yes-display-inline">demonstrate creative thinking, construct knowledge, and develop innovative products and processes;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6BA064F8DE294E1FA0C93F2824CA892D"><enum>(E)</enum><text display-inline="yes-display-inline">understand and use technology systems, including applications, and troubleshoot systems and applications; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB3E825BC76964420AB06BEB58E3B3D98"><enum>(F)</enum><text display-inline="yes-display-inline">carry out the activities described in subparagraphs (A) through (D) in a safe and ethical manner.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H35FB89572CAA4E498B0F2120F2145B4B"><enum>(7)</enum><header display-inline="yes-display-inline">Technology readiness survey</header><text display-inline="yes-display-inline">The term <term>technology readiness survey</term> means a survey completed by a local educational agency that provides standardized information comparable to the information collected through the survey administered under the Race to the Top Assessment program under section 14006 of division A of the American Recovery and Reinvestment Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref>) on the quantity and types of technology infrastructure and access available to the students served by the local educational agency, including computer devices, Internet connectivity, operating systems, related network infrastructure, data systems, and—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H4285B96DAE37431A91D75C0AAC300611"><enum>(A)</enum><text display-inline="yes-display-inline">requiring—</text> <clause commented="no" display-inline="no-display-inline" id="H8C8BC0437E474AB1BF7BC5020ACC65D0"><enum>(i)</enum><text display-inline="yes-display-inline">an internal review of the degree to which instruction, additional student support, and professional learning is delivered in digital formats, media, and platforms and is available to students and educators at any time;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="HF0F71C34687F4321B2370D7EFE301470"><enum>(ii)</enum><text display-inline="yes-display-inline">an internal review of the ability of educators to use assessments and other student data to personalize and strengthen instruction and identify professional learning needs and priorities; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H33347D29535541048B581DD4ADCC101A"><enum>(iii)</enum><text display-inline="yes-display-inline">any other information required by the State educational agency serving the local educational agency;</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDC7455D803014091AB188FD514AE62EA"><enum>(B)</enum><text display-inline="yes-display-inline">may include an assessment of local community needs to ensure students have adequate online access and access to devices for school-related work during out-of-school time; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H182345A2510048A19226E3525B9FBD77"><enum>(C)</enum><text display-inline="yes-display-inline">may include a security assessment to ensure that necessary security controls are integrated into the design, management, and oversight of the State or local education agency’s computer network, with proper documentation and gap analysis between policy, procedures, and current practice.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4503911043204246B3D7981F0F92BCC5"><enum>(8)</enum><header display-inline="yes-display-inline">Universal design for learning</header><text display-inline="yes-display-inline">The term <term>universal design for learning</term> has the meaning given the term in section 103 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003</external-xref>).</text>
							</paragraph></section><section commented="no" display-inline="no-display-inline" id="HFAD579CCB4F749BCA48314177DE36187" section-type="subsequent-section"><enum>2404.</enum><header display-inline="yes-display-inline">Technology grants program authorized</header>
 <subsection commented="no" display-inline="no-display-inline" id="H106367430B574104AFC453F5415B65A7"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">From the amounts appropriated under section 2409, the Secretary shall award State grants for technology readiness and access (in this part referred to as <quote>grants</quote>) to State educational agencies to strengthen State and local technological infrastructure and professional learning that supports digital learning through State activities under section 2406(c) and local activities under section 2407(c).</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="HC2CD30314D8E4DFCB6BBAB9CDBECBE5C"><enum>(b)</enum><header display-inline="yes-display-inline">Grants to State educational agencies</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H72BB4989C6574588BEDAC266C7BCA3BA"><enum>(1)</enum><header display-inline="yes-display-inline">Reservations</header><text display-inline="yes-display-inline">From the amounts appropriated under section 2409 for any fiscal year, the Secretary shall reserve—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H238E9FCBC48B44BC9928ED8326A75B42"><enum>(A)</enum><text display-inline="yes-display-inline">three-fourths of 1 percent for the Secretary of the Interior to provide assistance under this part for schools operated or funded by the Bureau of Indian Education; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFB188D9DC16F4C32A00D4947F147D95B"><enum>(B)</enum><text display-inline="yes-display-inline">1 percent to provide assistance under this part to the outlying areas.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA80E8B66E133499E81E91BE50223BA7A"><enum>(2)</enum><header display-inline="yes-display-inline">Grant allotments</header><text display-inline="yes-display-inline">From the amounts appropriated under section 2409 for any fiscal year and remaining after the Secretary makes reservations under paragraph (1), the Secretary shall make a grant for the fiscal year to each State educational agency with an approved application under section 2405 in an amount that bears the same relationship to such remainder as the amount the State educational agency received under part A of title I for such year bears to the amount all State educational agencies with an approved application under section 2405 received under such part for such year.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD948117B23874022ACD3780333580828"><enum>(c)</enum><header display-inline="yes-display-inline">Minimum</header><text display-inline="yes-display-inline">The amount of a grant to a State educational agency under subsection (b)(2) for a fiscal year shall not be less than one-half of 1 percent of the total amount made available for grants to all State educational agencies under such subsection for such year.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H98B6C8F344AC4BCE8DD68D2E574BD0F1"><enum>(d)</enum><header display-inline="yes-display-inline">Reallotment of unused funds</header><text display-inline="yes-display-inline">If any State educational agency does not apply for a grant under section 2405 for a fiscal year, or does not use the State educational agency's entire grant allotment under subsection (b)(2) for such year, the Secretary shall reallot the amount of the State educational agency’s grant, or the unused portion of the grant allotment, to the remaining State educational agencies that use their entire grant amounts under subsection (b)(2) for such year.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="HF46BFCA77A3D45BDBFD971EB7CD7A590"><enum>(e)</enum><header display-inline="yes-display-inline">Matching funds</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H70BDCAF90B25400D856FF498B25ECE49"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State educational agency that receives a grant under subsection (b)(2) shall provide matching funds, from non-Federal sources, in an amount equal to 10 percent of the amount of grant funds provided to the State educational agency to carry out the activities supported by the grant. Such matching funds may be provided in cash or in-kind, except that any such in-kind contributions shall be provided for the purpose of supporting the State educational agency’s activities under section 2406(c).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H55888C57D5024302ACE1433C1184CC2C"><enum>(2)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">The Secretary may waive the matching requirement under paragraph (1) for a State educational agency that demonstrates that such requirement imposes an undue financial hardship on the State educational agency.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H6F2B6752A0D643CBA4082E3748E50218" section-type="subsequent-section"><enum>2405.</enum><header display-inline="yes-display-inline">State applications</header>
 <subsection commented="no" display-inline="no-display-inline" id="H3DE555385EF144D8893349938179B680"><enum>(a)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">To receive a grant under section 2404(b)(2), a State educational agency shall submit to the Secretary an application at such time and in such manner as the Secretary may require and containing the information described in subsection (b).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H22E14F795DE14D0E9705B91B8DE131EA"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each application submitted under subsection (a) shall include the following:</text> <paragraph commented="no" display-inline="no-display-inline" id="H52627ED70A5F4568A7DD97D064975B01"><enum>(1)</enum><text display-inline="yes-display-inline">A description of how the State educational agency will meet the following goals:</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H0E89799E383941AF93391951BD0F8F27"><enum>(A)</enum><text display-inline="yes-display-inline">Use technology to ensure all students achieve college and career readiness and student digital literacy, including by providing high-quality education opportunities to economically or geographically isolated student populations.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC993E90C51E040F585DB1C2AF3DD07A9"><enum>(B)</enum><text display-inline="yes-display-inline">Provide educators with the professional learning, tools, devices, content, and resources to—</text> <clause commented="no" display-inline="no-display-inline" id="H429CBA616E5E4BE295F04B9498B6AA86"><enum>(i)</enum><text display-inline="yes-display-inline">personalize learning to increase student digital literacy; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="HCF61FFA47CD9497791B66655ADE6FD7F"><enum>(ii)</enum><text display-inline="yes-display-inline">develop and use high-quality assessments consistent with the principles of universal design for learning.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5C16729CD6E747B6A507C5B31F9E559B"><enum>(C)</enum><text display-inline="yes-display-inline">Ensure administrators and school leaders have the flexibility and capacity to develop and manage systems to carry out activities described in subparagraphs (A) and (B).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD84F885E56AC447A9E1C65A73414A1DF"><enum>(D)</enum><text display-inline="yes-display-inline">Enable local educational agencies to build the technological capacity and infrastructure (including through local purchasing of eligible technology), necessary for the full implementation of online assessments for all students (including students who are children with disabilities and children who are limited English proficient).</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAACED3BDFDEA4BA1A8AEB943932CD8C5"><enum>(2)</enum><text display-inline="yes-display-inline">A description of the technology readiness in the State, as determined by local educational agency responses to the technology readiness survey.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HED8407597E164158BA5BABA6C8EBE183"><enum>(3)</enum><text display-inline="yes-display-inline">A description of the plan for the State educational agency to support each local educational agency in meeting the goals described in section 2407(b)(1) not later than 3 years after the local educational agency completes the technology readiness survey by addressing the readiness gaps identified in such survey.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H124EE4B6CF984A7FBABFDAA5A6526AD4"><enum>(4)</enum><text display-inline="yes-display-inline">A description of the State’s process for the vetting, adoption, acquisition, distribution, and use of content.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFD48D2E63E2C423CBEEDBD634EF46051"><enum>(5)</enum><text display-inline="yes-display-inline">A description of how the State educational agency will ensure that the State educational agency's data systems and eligible technology are interoperable.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEDF607B49F874A2591DD873C290C2570"><enum>(6)</enum><text display-inline="yes-display-inline">An assurance that the State educational agency will consider making content widely available through open educational resources when making purchasing decisions with funds received under this part.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF0A18CE177D14B1DBF664BD86F046F66"><enum>(7)</enum><text display-inline="yes-display-inline">A description of the State’s student digital literacy standards and the technology standards for teachers and administrators, and an assurance that the State’s student digital literacy standards meet the requirements of section 2403(5).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA6A1301DCFEF49A5A89D51907F932B70"><enum>(8)</enum><text display-inline="yes-display-inline">An assurance that subgrant awards under section 2407 will be carried out by the State educational agency staff with responsibility for leadership, coordination, and implementation of instructional and other classroom technologies.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBA33A677A23B478EAF967145AB607435"><enum>(9)</enum><text display-inline="yes-display-inline">A description of how the State educational agency will award subgrants to local educational agencies under section 2407.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB7A2450495424CA6A594F7335CA2A284"><enum>(10)</enum><text display-inline="yes-display-inline">A description of the process, activities, and performance measures that the State educational agency will use to evaluate the impact and effectiveness of the grant and subgrant funds awarded under this part across the State and in each local educational agency.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H902234611F664F628EB0B7ECB9D55457"><enum>(11)</enum><text display-inline="yes-display-inline">A description of how the State educational agency will, in providing technical and other assistance to local educational agencies, give priority to the local educational agencies proposing to target services to—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HF9F0DC580F9244E6B405EFD069C70AB1"><enum>(A)</enum><text display-inline="yes-display-inline">students in schools in need of improvement and persistently low-achieving schools;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2FC1257E61ED4E228AE7396840E0C258"><enum>(B)</enum><text display-inline="yes-display-inline">schools with a high percentage of students who are eligible for a free or reduced price lunch under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4AC17B34C308404790EC8FE9002B7DE6"><enum>(C)</enum><text display-inline="yes-display-inline">schools that meet the census definition of rural.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H446B45E3F59A46A986C3FAD341D1054F"><enum>(12)</enum><text display-inline="yes-display-inline">A description of how the State educational agency consulted with local educational agencies in the development of the State educational agency’s application under this subsection.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9913FD850EA9424790B504882C4DF4B8"><enum>(13)</enum><text display-inline="yes-display-inline">An assurance that the State educational agency will provide matching funds as required under section 2404(e).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H22956B29F3D84ECBB011F2F30470EE5F"><enum>(14)</enum><text display-inline="yes-display-inline">A description of how the State educational agency will ensure that funds received under this part do not duplicate support received under the E-rate program.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H43310AD5D08C43AFA0176AB73D701FCE"><enum>(15)</enum><text display-inline="yes-display-inline">An assurance that the State educational agency will protect the privacy and safety of students and teachers, consistent with requirements of section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>) (commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>), the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501 et seq.</external-xref>), and section 445 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232h">20 U.S.C. 1232h</external-xref>).</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HB2A54B12C4384B35A7FB0CEEE8960567" section-type="subsequent-section"><enum>2406.</enum><header display-inline="yes-display-inline">State use of grant funds</header>
 <subsection commented="no" display-inline="no-display-inline" id="H55AAF1300EC9484D9345DE61B1D2B943"><enum>(a)</enum><header display-inline="yes-display-inline">Reservation for subgrants To support technology infrastructure</header><text display-inline="yes-display-inline">Each State educational agency that receives a grant under section 2404(b)(2) shall expend not less than 90 percent of the grant amount for each fiscal year to award subgrants to local educational agencies in accordance with section 2407.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H8734EC65C3404203BD783B1478D1D649"><enum>(b)</enum><header display-inline="yes-display-inline">Reservation for State activities</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H5801361192D8489893A9AC1B76E2D82F"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State educational agency shall reserve not more than 10 percent of the grant received under section 2404(b)(2) for the State activities described in subsection (c).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC6786E1346AD418ABB2C6B1D327B31B2"><enum>(2)</enum><header display-inline="yes-display-inline">Grant administration</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="HED19AFE8A71C4B6BBB2A685D9795E12B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), of the amount reserved by a State educational agency under paragraph (1), the State educational agency may reserve for the administration of the grant under this part not more than—</text>
 <clause commented="no" display-inline="no-display-inline" id="HC0B5CAA004BE42E5A7182E9F7A021DCC"><enum>(i)</enum><text display-inline="yes-display-inline">1 percent in the case of a State educational agency awarding subgrants under section 2407(a)(1); or</text> </clause><clause commented="no" display-inline="no-display-inline" id="H7CC3510E5CC44C4D8B100479AEDFCCEF"><enum>(ii)</enum><text display-inline="yes-display-inline">3 percent in the case of a State educational agency awarding subgrants under section 2407(a)(2).</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFA18045A0F824114AF703A2D59B57D41"><enum>(B)</enum><header display-inline="yes-display-inline">Special rule</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), a State educational agency that forms a State purchasing consortium under subsection (d)—</text>
 <clause commented="no" display-inline="no-display-inline" id="H198267D587694FBA989B8E02C48EFBDE"><enum>(i)</enum><text display-inline="yes-display-inline">may reserve an additional 1 percent to carry out the activities described in subsection (d)(1); and</text> </clause><clause commented="no" display-inline="no-display-inline" id="HFDBFF37BEF6E4437970B7D79E38F9A4F"><enum>(ii)</enum><text display-inline="yes-display-inline">may reserve amounts in addition to the percentage described in clause (i) if the State purchasing consortium receives direct approval from the local educational agencies receiving subgrants under section 2407(a) from the State educational agency prior to reserving more than the additional percentage authorized under clause (i).</text>
 </clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAB4B01983CAD46A4B70F5A55AC52B970"><enum>(c)</enum><header display-inline="yes-display-inline">State activities</header><text display-inline="yes-display-inline">A State educational agency shall use funds described in subsection (b) to carry out each of the following:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HA54604E01DC6466E8A022151925D2A27"><enum>(1)</enum><text display-inline="yes-display-inline">Except for the awarding of subgrants in accordance with section 2407, activities described in the State educational agency’s application under section 2405(b).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4A77E191E1BB47D98A5DB4BCB9FCDE09"><enum>(2)</enum><text display-inline="yes-display-inline">Providing technical assistance to local educational agencies to—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H14812E0D0C9142CC9347FEB2B281EDDA"><enum>(A)</enum><text display-inline="yes-display-inline">identify and address technology readiness needs;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8923D35354E249B59B4487A4988B26E2"><enum>(B)</enum><text display-inline="yes-display-inline">redesign curriculum and instruction, improve educational productivity, and deliver computer-based and online assessment;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7457EB592649427FB05DE36F662FDAE8"><enum>(C)</enum><text display-inline="yes-display-inline">use technology, consistent with the principles of universal design for learning, to support the learning needs of all students, including students who are children with disabilities and children who are limited English proficient;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H71F3A73DA63C4EDF9293789462E664CF"><enum>(D)</enum><text display-inline="yes-display-inline">build capacity for principals and local educational agency administrators to support teachers with data literacy and in infusing digital tools to empower teaching and personalize learning;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H246A8F1DFB8C49CE83D8A3AFE4DB5868"><enum>(E)</enum><text display-inline="yes-display-inline">promote data literacy and transparency in the collection, analysis, and utilization of student data; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD2A90215A3A845F99CB7FB8D9BACCE6B"><enum>(F)</enum><text display-inline="yes-display-inline">identify expectations and standards for third-party vendors that have access to, store, or provide analytics on student data.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H26099C46776147A0B2036A94C7AB05FA"><enum>(3)</enum><text display-inline="yes-display-inline">Developing or utilizing research-based or innovative strategies for the delivery of specialized or rigorous academic courses and curricula through the use of technology, including digital learning technologies and assistive technology.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H27D8CB5A25B64B5B91DDC71E59AAEFE2"><enum>(4)</enum><text display-inline="yes-display-inline">Integrating and coordinating activities under this part with other educational resources and programs across the State.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H37BB800F56B54279A85A8B9368C2DC6D"><enum>(5)</enum><text display-inline="yes-display-inline">Disseminating information, including making publicly available on the website of the State educational agency, promising practices to improve technology instruction, and acquiring and implementing technology tools and applications.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0DF074BBA3414D1693EA14D0C669360E"><enum>(6)</enum><text display-inline="yes-display-inline">Ensuring that teachers, paraprofessionals, library and media personnel, specialized instructional support personnel, and administrators possess the knowledge and skills to use technology to meet the goals described in section 2405(b)(1).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H373B050E5D8C4B4F9C385BAE7FA64702"><enum>(7)</enum><text display-inline="yes-display-inline">Coordinating with teacher, principal, and school leader preparation programs to ensure that preservice teachers, principals, and school leaders have the skills to implement digital learning programs effectively.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFFDB93B29D8D484EAC091481FBC269AF"><enum>(8)</enum><text display-inline="yes-display-inline">Supporting schools that meet the census definition of rural to bring high-quality digital learning opportunities to rural and remote areas.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC84D1E84A8B94F8D8A996F0535AE7E0B"><enum>(d)</enum><header display-inline="yes-display-inline">Purchasing consortia</header>
 <paragraph commented="no" display-inline="no-display-inline" id="HC346560B941B4007AD40850631FA634F"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State educational agency receiving a grant under section 2404(b)(2) may—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H007C9F7BAF1A4D8BA0808E36B543C784"><enum>(A)</enum><text display-inline="yes-display-inline">form a State purchasing consortium with 1 or more State educational agencies receiving such a grant to carry out the State activities described in subsection (c), including purchasing eligible technology;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0CE954B4A132423D8E1CB88B21EF76FD"><enum>(B)</enum><text display-inline="yes-display-inline">encourage local educational agencies to form local purchasing consortia under section 2407(c)(4); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H73901C5C49FB48DEAE23E4C760E178CA"><enum>(C)</enum><text display-inline="yes-display-inline">promote pricing opportunities to local educational agencies for the purchase of eligible technology that are—</text>
 <clause commented="no" display-inline="no-display-inline" id="H563D52422A394050975D63AF760BA39E"><enum>(i)</enum><text display-inline="yes-display-inline">negotiated by the State educational agency or the State purchasing consortium of the State educational agency; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H6B76C3C3FF0D477E88537531D6ED5A1D"><enum>(ii)</enum><text display-inline="yes-display-inline">available to such local educational agencies.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6C9604D568A64B81A64E4D126FD8293F"><enum>(2)</enum><header display-inline="yes-display-inline">Restrictions</header><text display-inline="yes-display-inline">A State educational agency receiving a grant under section 2404(b)(2) shall not—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H83CB19B6DCF14F8290658D3CEAA2EE8C"><enum>(A)</enum><text display-inline="yes-display-inline">except for promoting the pricing opportunities described in paragraph (1)(C), make recommendations to local educational agencies for, or require, use of any specific commercial products and services by local educational agencies;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HACF36861EA9B4BCBA6A41277D36D541D"><enum>(B)</enum><text display-inline="yes-display-inline">require local educational agencies to participate in a State purchasing consortia or local purchasing consortia; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H64B4E8845AA34D478F4DEA1F3BECA460"><enum>(C)</enum><text display-inline="yes-display-inline">use more than the amount reserved under subsection (b) to carry out the activities described in paragraph (1), unless the State educational agency receives approval in accordance with subsection (b)(2)(B).</text>
									</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HCBB940D910F44C7388BBDA319A3D1963" section-type="subsequent-section"><enum>2407.</enum><header display-inline="yes-display-inline">Local subgrants</header>
							<subsection commented="no" display-inline="no-display-inline" id="H0FB2DDEFDF9441ED997ED01E0E8429EE"><enum>(a)</enum><header display-inline="yes-display-inline">Subgrants</header>
 <paragraph commented="no" display-inline="no-display-inline" id="HADD972822B214C3F8363D826EAE54E35"><enum>(1)</enum><header display-inline="yes-display-inline">Grants to local educational agencies</header><text display-inline="yes-display-inline">From the grant funds provided under section 2404(b)(2) to a State educational agency that are remaining after the State educational agency makes reservations under section 2406(b) for any fiscal year and subject to paragraph (2), the State educational agency shall award subgrants for the fiscal year to local educational agencies served by the State educational agency and with an approved application under subsection (b) by allotting to each such local educational agency an amount that bears the same relationship to the remainder as the amount received by the local educational agency under part A of title I for such year bears to the amount received by all such local educational agencies under such part for such year, except that no local educational agency may receive less than $3,000 for a year.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD53C4826B18E4E128B4606FB46ACB16F"><enum>(2)</enum><header display-inline="yes-display-inline">Competitive grants to local educational agencies</header><text display-inline="yes-display-inline">If the amount of funds appropriated under section 2404 is less than $300,000,000 for any fiscal year, a State educational agency—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H0E58C6966D0746CD8B8709FDE4940D9F"><enum>(A)</enum><text display-inline="yes-display-inline">shall not award subgrants under paragraph (1); and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA29DFA6450534EEDAB53111FD7EF7EBA"><enum>(B)</enum><text display-inline="yes-display-inline">shall—</text>
 <clause commented="no" display-inline="no-display-inline" id="H651BFC743ADA480DBAC399141A1D7253"><enum>(i)</enum><text display-inline="yes-display-inline">award subgrants, on a competitive basis, to local educational agencies based on the quality of applications submitted under subsection (b), including—</text>
 <subclause commented="no" display-inline="no-display-inline" id="H802BC1211E71417191D6675AF5230015"><enum>(I)</enum><text display-inline="yes-display-inline">the level of technology readiness, as determined by the technology readiness surveys completed by local educational agencies submitting such applications; and</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="H68F0CF25535F4A22BD344F2C049B7954"><enum>(II)</enum><text display-inline="yes-display-inline">the technology plans described in subsection (b)(4) and how the local educational agencies with such plans will carry out the alignment and coordination described in such subsection;</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="H7CA8F4000E554401BB895C66FFC65907"><enum>(ii)</enum><text display-inline="yes-display-inline">ensure that such subgrants are of sufficient size and scope to carry out the local activities described in subsection (c);</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="HD1EC8433470741E5BE348127EFAD354D"><enum>(iii)</enum><text display-inline="yes-display-inline">give priority to local educational agencies that have demonstrated substantial need for assistance in acquiring and using technology, based on the agency's technology readiness survey; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H809CEE09600D4426AC5318829B3792F2"><enum>(iv)</enum><text display-inline="yes-display-inline">give priority to local educational agencies that meet the census definition of rural.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H789DA36764134D47B55CCDFCA16F4F10"><enum>(3)</enum><header display-inline="yes-display-inline">Definition of local educational agency for certain fiscal years</header><text display-inline="yes-display-inline">For purposes of awarding subgrants under paragraph (2), the term <term>local educational agency</term> means—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H6AC204986D194724BBE8F97DD6ADA432"><enum>(A)</enum><text display-inline="yes-display-inline">a local educational agency;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H54BA4AE6AC4045B1B32C87FCFBCF4677"><enum>(B)</enum><text display-inline="yes-display-inline">an educational service agency; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCE5E8336CEDF42F48993849A59B414CA"><enum>(C)</enum><text display-inline="yes-display-inline">a local educational agency and an educational service agency.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCF5708350A1846AAABBD53227EDD0D46"><enum>(b)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">A local educational agency that desires to receive a subgrant under subsection (a) shall submit an application to the State at such time, in such manner, and accompanied by such information as the State educational agency may require, including—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H33C29624264D4D8A8CB6A64D4A2CBC82"><enum>(1)</enum><text display-inline="yes-display-inline">a description of how the local educational agency will carry out the goals described in subparagraphs (A) through (D) of section 2405(b)(1);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0E68382A00C24B849FFBD9F34AF8560A"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the results of the technology readiness survey completed by the local educational agency and a description of the plan for the local educational agency to meet the goals described in paragraph (1) within 3 years of completing the survey;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB0268CEFE77248D5A8633DD3A1CDB716"><enum>(3)</enum><text display-inline="yes-display-inline">an assurance that the local educational agency’s student digital literacy standards meet the requirements of section 2403(5);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H87C88FD036DC487CA4F44585C32448A4"><enum>(4)</enum><text display-inline="yes-display-inline">a description of the local educational agency’s technology plan to carry out paragraphs (1) and (3) and how the agency will align and coordinate the activities under this section with other activities across the local educational agency;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H37B5B01913D449ADB6F20888BDCF2418"><enum>(5)</enum><text display-inline="yes-display-inline">a description of the team of educators who will coordinate and carry out the activities under this section, including individuals with responsibility and expertise in instructional technology, teachers that specialize in supporting students who are children with disabilities and children who are limited English proficient, school leaders, technology officers, and staff responsible for assessments and data;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE9431B0AC49B431AA19AB0886AF66853"><enum>(6)</enum><text display-inline="yes-display-inline">a description of how the local educational agency will build capacity for principals and local educational agency administrators to support teachers in developing data literacy skills and in implementing digital tools to support teaching and learning;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFA05F579BB3B48E8A9F462EA41CFCF9F"><enum>(7)</enum><text display-inline="yes-display-inline">a description of—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H404E125072C6455ABD0DF11C6AB30C96"><enum>(A)</enum><text display-inline="yes-display-inline">the local educational agency’s procurement process and process for the creation, acquisition, distribution, and use of content;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H971781D914F1448998540A946304BB9A"><enum>(B)</enum><text display-inline="yes-display-inline">how the local educational agency will ensure integrity of such processes;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H41F30213896C4CAE84FCD41A493ADC90"><enum>(C)</enum><text display-inline="yes-display-inline">how such processes support the goals described in paragraph (1) or how a local educational agency will change such processes to support such goals; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4D03A9AFA5274AB7BC8746E183B7A26F"><enum>(D)</enum><text display-inline="yes-display-inline">how the local educational agency will ensure content quality;</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H28B972EE13C2438AA1A407191FE6EA32"><enum>(8)</enum><text display-inline="yes-display-inline">a description of how the local educational agency will carry out activities under subsection (c);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE545C05D858D4E849D2D0D304D75835A"><enum>(9)</enum><text display-inline="yes-display-inline">a description of how the subgrant funds received under subsection (a) will be coordinated with and supported by other Federal, State, and local funds to support activities under this part;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB9E692B3F55C46F58A4C9B8336E5A70F"><enum>(10)</enum><text display-inline="yes-display-inline">a description of how the local educational agency will ensure that the subgrant received under subsection (a) is not duplicative of support received under the E-rate program; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1645137FB58943819E7A8F2F13A49932"><enum>(11)</enum><text display-inline="yes-display-inline">an assurance that the local educational agency will protect the privacy and safety of students and teachers, consistent with requirements section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>) (commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDD476B6E6B7C4926AAAFCF2BB83A2841"><enum>(c)</enum><header display-inline="yes-display-inline">Use of funds</header>
 <paragraph commented="no" display-inline="no-display-inline" id="HAFB329CC02BD4362883DA5C6BA5A0BA2"><enum>(1)</enum><header display-inline="yes-display-inline">Technology infrastructure</header><text display-inline="yes-display-inline">Subject to paragraph (3), a local educational agency receiving a subgrant under subsection (a) shall use not less than 40 percent of such funds to support activities for the acquisition of eligible technology needed to—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HF7711EF865A2417C9C2A1B5EAD733E55"><enum>(A)</enum><text display-inline="yes-display-inline">except for the activities described in paragraph (2), carry out activities described in the application submitted under subsection (b), including purchasing devices, equipment, and software applications, and improving connectivity to and within schools; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H64633E48C3154FD2939644F4248154D8"><enum>(B)</enum><text display-inline="yes-display-inline">address readiness shortfalls identified under the technology readiness survey completed by the local educational agency.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H54ABA9E6A7F54F6C9453D126562737EB"><enum>(2)</enum><header display-inline="yes-display-inline">Professional learning for digital learning</header><text display-inline="yes-display-inline">Subject to paragraph (3), a local educational agency receiving a subgrant under subsection (a) shall use not less than 40 percent of such funds to carry out digital age professional learning opportunities for teachers, principals, school leaders, paraprofessionals, library and media personnel, specialized instructional support personnel, technology coordinators, and administrators.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H22E937A3742749B0B41FBC6713B56777"><enum>(3)</enum><header display-inline="yes-display-inline">Modification of funding allocations</header><text display-inline="yes-display-inline">A State educational agency may authorize a local educational agency to modify the percentage of the local educational agency’s subgrant funds required to carry out the activities described in paragraph (1) or (2) if the local educational agency demonstrates that such modification will assist the local educational agency in more effectively carrying out such activities.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H24AF525DA3324A8DA764913B560320B8"><enum>(4)</enum><header display-inline="yes-display-inline">Purchasing consortia</header><text display-inline="yes-display-inline">Local educational agencies receiving subgrants under subsection (a) may—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H364C8F804F8B40D5AE673F05321B9ED4"><enum>(A)</enum><text display-inline="yes-display-inline">form a local purchasing consortia with other such local educational agencies to carry out the activities described in this subsection, including purchasing eligible technology; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8A07850B8E6441A6AA7EAC862F534D27"><enum>(B)</enum><text display-inline="yes-display-inline">use such funds for purchasing eligible technology through a State purchasing consortia under section 2406(d).</text>
									</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H2244427B3D3E433FB93BF0E9FB28941A" section-type="subsequent-section"><enum>2408.</enum><header display-inline="yes-display-inline">Reporting</header>
 <subsection commented="no" display-inline="no-display-inline" id="HEA205BD038364AC99CF851629421DD35"><enum>(a)</enum><header display-inline="yes-display-inline">Local educational agencies</header><text display-inline="yes-display-inline">Each local educational agency receiving a subgrant under section 2407 shall submit to the State educational agency that awarded such subgrant an annual report the meets the requirements of subsection (c).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HDB167A5D190F4590B0CEF35F8F8809D7"><enum>(b)</enum><header display-inline="yes-display-inline">State educational agencies</header><text display-inline="yes-display-inline">Each State educational agency receiving a grant under section 2404(b)(2) shall submit to the Secretary an annual report that meets the requirements of subsection (c).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H1DE40FF130CE4D62A527DC0CCF1F26B4"><enum>(c)</enum><header display-inline="yes-display-inline">Report requirements</header><text display-inline="yes-display-inline">A report submitted under subsection (a) or (b) shall include, at a minimum, a description of—</text> <paragraph commented="no" display-inline="no-display-inline" id="H270AD1A5B873452ABA8D2137D622AD70"><enum>(1)</enum><text display-inline="yes-display-inline">the status of the State educational agency’s plan described in section 2405(b)(3) or the local education agency’s technology plan under section 2407(b)(4), as applicable;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF2A664E61D4C4F45A35D361EA00C30D0"><enum>(2)</enum><text display-inline="yes-display-inline">the categories of eligible technology acquired with funds under this part and how such technology is being used;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H786FADBC096B46DFB0D5347083C79B4E"><enum>(3)</enum><text display-inline="yes-display-inline">the professional learning activities funded under this part, including types of activities and entities involved in providing such professional learning to classroom teachers and other staff, such as school librarians;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H949103A3C8A34BB5ABBDA912FC1DDEC5"><enum>(4)</enum><text display-inline="yes-display-inline">the instruction, strategies, activities, and curricula used in the programs funded under this part; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H940149D00DE642FDBC58691B561F3735"><enum>(5)</enum><text display-inline="yes-display-inline">the types of programs funded under this part.</text> </paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H8E4204188F8E453F9E6C0A57382D4AE3" section-type="subsequent-section"><enum>2409.</enum><header display-inline="yes-display-inline">Authorization</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this part $1,000,000,000 for fiscal year 2016 and such sums as may be necessary for each of the 4 succeeding fiscal years.</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
