1.Short title; reconciliation of funds; table of contents
(a)This Act may be cited as the Surface Transportation Extension Act of 2015
. (b)The Secretary of Transportation shall reduce the amount apportioned or allocated for a program, project, or activity under this Act in fiscal year 2016 by amounts apportioned or allocated pursuant to the Surface Transportation and Veterans Health Care Choice Improvement Act of 2015, including the amendments made by that Act, for the period beginning on October 1, 2015, and ending on October 29, 2015.

<subsection id="HF3E7459FACFE4E7BA88CB9F34BFB8168"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote>Positive Train Control Enforcement and Implementation Act of 2015</quote>. </text></subsection> <subsection id="HA6DC04E5B36B48CC87BB582449E6F74F"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">Section 20157 of title 49, United States Code, is amended—</text>

<subclause id="H84D0B4CD3FE8491DB76AF8584D197FEE"><enum>(II)</enum><text>how, to the extent practical, the positive train control system will be implemented in a manner that addresses areas of greater risk before areas of lesser risk;</text></subclause></clause> <clause id="H88AE0E04FACF4D4BA1A11E2ABA822C0F"><enum>(ii)</enum><text>comply with the positive train control system implementation plan content requirements under section 236.1011 of title 49, Code of Federal Regulations; and</text></clause>
<clause id="HE782364195CB4A36B213EEA3E2284D1E"><enum>(iii)</enum><text>provide—</text> <subclause id="H5275A34C245947ACAA9F4FCEECA437CC"><enum>(I)</enum><text>the calendar year or years in which spectrum will be acquired and will be available for use in each area as needed for positive train control system implementation, if such spectrum is not already acquired and available for use;</text></subclause>
<subclause id="HB5BC2FA801234FA491DCF5B4CD6AEBA4"><enum>(II)</enum><text display-inline="yes-display-inline">the total amount of positive train control system hardware that will be installed for implementation, with totals separated by each major hardware category;</text></subclause> <subclause id="HDA8AB155200946D28F8C1DDCC6D2FD22"><enum>(III)</enum><text display-inline="yes-display-inline">the total amount of positive train control system hardware that will be installed by the end of each calendar year until the positive train control system is implemented, with totals separated by each hardware category;</text></subclause>
<subclause id="H3BF59D7B7733476C9B4B1AD5EC14C495"><enum>(IV)</enum><text>the total number of employees required to receive training under the applicable positive train control system regulations;</text></subclause> <subclause id="HBA5CEE93237543EF8ECBDB4B3D3274D2"><enum>(V)</enum><text>the total number of employees that will receive the training, as required under the applicable positive train control system regulations, by the end of each calendar year until the positive train control system is implemented;</text></subclause>
<subclause id="HD9BC422A39F848CEA3BEA4F85793655D"><enum>(VI)</enum><text>a summary of any remaining technical, programmatic, operational, or other challenges to the implementation of a positive train control system, including challenges with—</text> <item id="HB70B8C2993574F59997CB22F7E706E07"><enum>(aa)</enum><text>availability of public funding;</text></item>
<item id="H063D905CEAD0429C92CBD6A02B11B27F"><enum>(bb)</enum><text>interoperability;</text></item> <item id="HC276099BB5294E85A10017429ACD2770"><enum>(cc)</enum><text>spectrum;</text></item>
<item id="HC5664049A5F341B4A5D8AC199018DE88"><enum>(dd)</enum><text>software;</text></item> <item id="HD632EF548CF84945A8EDB71794D5F27B"><enum>(ee)</enum><text>permitting; and</text></item>
<item id="H686506324C9148A9AC99894D85E057C4"><enum>(ff)</enum><text>testing, demonstration, and certification; and</text></item></subclause> <subclause id="HB6469846AADC4613A7928E9E31377195"><enum>(VII)</enum><text>a schedule and sequence for implementing a positive train control system by the deadline established under paragraph (1).</text></subclause></clause></subparagraph>
<subparagraph id="H97C55CAF03094B5DA630B21CCC9C5091"><enum>(B)</enum><header>Alternative schedule and sequence</header><text display-inline="yes-display-inline">Notwithstanding the implementation deadline under paragraph (1) and in lieu of a schedule and sequence under paragraph (2)(A)(iii)(VII), a railroad carrier or other entity subject to paragraph (1) may include in its revised plan an alternative schedule and sequence for implementing a positive train control system, subject to review under paragraph (3). Such schedule and sequence shall provide for implementation of a positive train control system as soon as practicable, but not later than the date that is 24 months after the implementation deadline under paragraph (1).</text></subparagraph> <subparagraph id="HECB6598F7358406EB2DC422E128A561B"><enum>(C)</enum><header>Amendments</header><text>A railroad carrier or other entity subject to paragraph (1) may file a request to amend a revised plan, including any alternative schedule and sequence, as applicable, in accordance with section 236.1021 of title 49, Code of Federal Regulations.</text></subparagraph>
<subparagraph id="HFA8AB2540D1F4533B2F98E144B15FAAD"><enum>(D)</enum><header>Compliance</header><text>A railroad carrier or other entity subject to paragraph (1) shall implement a positive train control system in accordance with its revised plan, including any amendments or any alternative schedule and sequence approved by the Secretary under paragraph (3).</text></subparagraph></paragraph> <paragraph id="H35D0A94D01DD487998D80B04939E74FE"><enum>(3)</enum><header>Secretarial review</header> <subparagraph id="HC9D9D9610D4C4B06BB6616D3B3C81898"><enum>(A)</enum><header>Notification</header><text>A railroad carrier or other entity that submits a revised plan under paragraph (1) and proposes an alternative schedule and sequence under paragraph (2)(B) shall submit to the Secretary a written notification when such railroad carrier or other entity is prepared for review under subparagraph (B).</text></subparagraph>
<subparagraph id="H3A96ABA43EF44F23A1AFD6BC13A9AAE5"><enum>(B)</enum><header>Criteria</header><text>Not later than 90 days after a railroad carrier or other entity submits a notification under subparagraph (A), the Secretary shall review the alternative schedule and sequence submitted pursuant to paragraph (2)(B) and determine whether the railroad carrier or other entity has demonstrated, to the satisfaction of the Secretary, that such carrier or entity has—</text> <clause id="H8065D2A9AC9F44CDB20AFD2C7CA2737E"><enum>(i)</enum><text display-inline="yes-display-inline">installed all positive train control system hardware consistent with the plan contents provided pursuant to paragraph (2)(A)(iii)(II) on or before the implementation deadline under paragraph (1);</text></clause>
<clause id="H4D0ED9C5670848C49103F38BA1A9C507"><enum>(ii)</enum><text display-inline="yes-display-inline">acquired all spectrum necessary for implementation of a positive train control system, consistent with the plan contents provided pursuant to paragraph (2)(A)(iii)(I) on or before the implementation deadline under paragraph (1);</text></clause> <clause id="H470BF7FA17FE4FAAA6EAD8D94CF7C6B3"><enum>(iii)</enum><text>completed employee training required under the applicable positive train control system regulations;</text></clause>
<clause id="H31C93807307949A49B03A853B79B5396"><enum>(iv)</enum><text display-inline="yes-display-inline">included in its revised plan an alternative schedule and sequence for implementing a positive train control system as soon as practicable, pursuant to paragraph (2)(B);</text></clause> <clause id="H8C4D4A145F3448C49ECB40BF54A268AB"><enum>(v)</enum><text>certified to the Secretary in writing that it will be in full compliance with the requirements of this section on or before the date provided in an alternative schedule and sequence, subject to approval by the Secretary;</text></clause>
<clause id="H44A7AF7DD59F4DFCB697308F04285244"><enum>(vi)</enum><text>in the case of a Class I railroad carrier and Amtrak, implemented a positive train control system or initiated revenue service demonstration on the majority of territories, such as subdivisions or districts, or route miles that are owned or controlled by such carrier and required to have operations governed by a positive train control system; and</text></clause> <clause id="HD2ACD414474640E2A49644F703E9B888"><enum>(vii)</enum><text>in the case of any other railroad carrier or other entity not subject to clause (vi)—</text>
<subclause id="H434F14CD3D4F4070AC842465F377A200"><enum>(I)</enum><text>initiated revenue service demonstration on at least 1 territory that is required to have operations governed by a positive train control system; or</text></subclause> <subclause id="HF2D639E22176493FB4C7AD7E361D4B80"><enum>(II)</enum><text>met any other criteria established by the Secretary.</text></subclause></clause></subparagraph>
<subparagraph id="HC103075A6B314C008AA7EFFA2C36B416"><enum>(C)</enum><header>Decision</header>
<clause id="H22699228F7B14DFBA225C0ED4A2721CE"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the receipt of the notification from a railroad carrier or other entity under subparagraph (A), the Secretary shall—</text> <subclause id="HED676D269ACA4C6195CC3BF3BC3C0895"><enum>(I)</enum><text>approve an alternative schedule and sequence submitted pursuant to paragraph (2)(B) if the railroad carrier or other entity meets the criteria in subparagraph (B); and</text></subclause>
<subclause id="H0402A7781495419E989DB792CEF1F67D"><enum>(II)</enum><text>notify in writing the railroad carrier or other entity of the decision.</text></subclause></clause> <clause id="H08B2E7D385BB4277A75CA6D27904D29C"><enum>(ii)</enum><header>Deficiencies</header><text>Not later than 45 days after the receipt of the notification under subparagraph (A), the Secretary shall provide to the railroad carrier or other entity a written notification of any deficiencies that would prevent approval under clause (i) and provide the railroad carrier or other entity an opportunity to correct deficiencies before the date specified in such clause. </text></clause></subparagraph>
<subparagraph id="H46BE5D29A95E4E5F834FC77A0DBB2015" commented="no"><enum>(D)</enum><header>Revised deadlines</header>
<clause id="H83B0B12570EF4EEDA3847CF9F1FE7045" commented="no"><enum>(i)</enum><header>Pending reviews</header><text>For a railroad carrier or other entity that submits a notification under subparagraph (A), the deadline for implementation of a positive train control system required under paragraph (1) shall be extended until the date on which the Secretary approves or disapproves the alternative schedule and sequence, if such date is later than the implementation date under paragraph (1).</text></clause> <clause id="H3EA228EA62B9492693936112A31A173C" commented="no"><enum>(ii)</enum><header>Alternative schedule and sequence deadline</header><text display-inline="yes-display-inline">If the Secretary approves a railroad carrier or other entity’s alternative schedule and sequence under subparagraph (C)(i), the railroad carrier or other entity’s deadline for implementation of a positive train control system required under paragraph (1) shall be the date specified in that railroad carrier or other entity’s alternative schedule and sequence. The Secretary may not approve a date for implementation that is later than 24 months from the deadline in paragraph (1). </text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph id="HE12D037A0EE3479C8A5158D721F0AE04"><enum>(3)</enum><text>by striking subsections (c), (d), and (e) and inserting the following:</text> <quoted-block style="OLC" id="HE821DA37540B429387D10B2AB2C3BD3C" display-inline="no-display-inline"> <subsection id="H9DE72D39AE354A5388EBCF8EF129DDCF"><enum>(c)</enum><header>Progress reports and review</header> <paragraph id="H78516C82998442ECBE72C4457AD86AC3" display-inline="no-display-inline"><enum>(1)</enum><header>Progress reports</header><text>Each railroad carrier or other entity subject to subsection (a) shall, not later than March 31, 2016, and annually thereafter until such carrier or entity has completed implementation of a positive train control system, submit to the Secretary a report on the progress toward implementing such systems, including—</text>
<subparagraph id="H63E7C99544244FA893F9B51319F11562"><enum>(A)</enum><text>the information on spectrum acquisition provided pursuant to subsection (a)(2)(A)(iii)(I);</text></subparagraph> <subparagraph id="H273E72CEF4564097A6C17CAAE0A10317"><enum>(B)</enum><text>the totals provided pursuant to subclauses (III) and (V) of subsection (a)(2)(A)(iii), by territory, if applicable;</text></subparagraph>
<subparagraph id="H9009B5A26CF9484E9A74139795C99643"><enum>(C)</enum><text>the extent to which the railroad carrier or other entity is complying with the implementation schedule under subsection (a)(2)(A)(iii)(VII) or subsection (a)(2)(B);</text></subparagraph> <subparagraph id="H8128FE86C38547A6BB6C306A41BAA1B5"><enum>(D)</enum><text>any update to the information provided under subsection (a)(2)(A)(iii)(VI);</text></subparagraph>
<subparagraph id="H4F8833E714F64E99BF53B13D12F63E79"><enum>(E)</enum><text>for each entity providing regularly scheduled intercity or commuter rail passenger transportation, a description of the resources identified and allocated to implement a positive train control system;</text></subparagraph> <subparagraph id="HF1CC1F823CEC4DAC91EF52E7D99E60FF"><enum>(F)</enum><text>for each railroad carrier or other entity subject to subsection (a), the total number of route miles on which a positive train control system has been initiated for revenue service demonstration or implemented, as compared to the total number of route miles required to have a positive train control system under subsection (a); and</text></subparagraph>
<subparagraph id="H3B910B8042144A9EA31265F17AF8E0EC"><enum>(G)</enum><text>any other information requested by the Secretary.</text></subparagraph></paragraph> <paragraph id="H6592E7662D624A25A16FB96D8C65EFC5"><enum>(2)</enum><header>Plan Review</header><text>The Secretary shall at least annually conduct reviews to ensure that railroad carriers or other entities are complying with the revised plan submitted under subsection (a), including any amendments or any alternative schedule and sequence approved by the Secretary. Such railroad carriers or other entities shall provide such information as the Secretary determines necessary to adequately conduct such reviews. </text></paragraph>
<paragraph id="HF4008328B01349D7BE958321B35E1643"><enum>(3)</enum><header>Public availability</header><text>Not later than 60 days after receipt, the Secretary shall make available to the public on the Internet Web site of the Department of Transportation any report submitted pursuant to paragraph (1) or subsection (d), but may exclude, as the Secretary determines appropriate—</text> <subparagraph id="H05ED94F00448404380D4FB2758EC2CE3"><enum>(A)</enum><text>proprietary information; and</text></subparagraph>
<subparagraph id="HC096E8F4C9AC4EBBB6D38358475DC246"><enum>(B)</enum><text>security-sensitive information, including information described in section 1520.5(a) of title 49, Code of Federal Regulations.</text></subparagraph></paragraph></subsection> <subsection id="H9E8CE599921649BE99D9A6021C62A682"><enum>(d)</enum><header>Report to Congress</header><text>Not later than July 1, 2018, the Secretary shall transmit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the progress of each railroad carrier or other entity subject to subsection (a) in implementing a positive train control system. </text></subsection>
<subsection id="H860F9C0A6CC24F2C93D31403CA7FF34B"><enum>(e)</enum><header>Enforcement</header><text>The Secretary is authorized to assess civil penalties pursuant to chapter 213 for—</text> <paragraph id="H78270B313FB6421586D780C784B2B200"><enum>(1)</enum><text>a violation of this section;</text></paragraph>
<paragraph id="H59960274117641118D0DEB817E5E11DF"><enum>(2)</enum><text>the failure to submit or comply with the revised plan required under subsection (a), including the failure to comply with the totals provided pursuant to subclauses (III) and (V) of subsection (a)(2)(A)(iii) and the spectrum acquisition dates provided pursuant to subsection (a)(2)(A)(iii)(I);</text></paragraph> <paragraph id="HC93968AC732D4E37A89223E52DB079B6"><enum>(3)</enum><text display-inline="yes-display-inline">failure to comply with any amendments to such revised plan pursuant to subsection (a)(2)(C); and</text></paragraph>
<paragraph id="HA2F38E74DC304EA5A046B02C08AB822C"><enum>(4)</enum><text>the failure to comply with an alternative schedule and sequence submitted under subsection (a)(2)(B) and approved by the Secretary under subsection (a)(3)(C).</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="HE884ECE133E34B8FA51A7C0CAAB4E340" commented="no"><enum>(4)</enum><text>in subsection (h)—</text>
<subparagraph id="HB95853C0192D4795AC791957856AFBA8" display-inline="no-display-inline" commented="no"><enum>(A)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text> <quoted-block id="H2BC4F1CB38AC4C2388E3C04F30131BFE" style="OLC"> <paragraph id="H25271090ED4241DAACD3D3AEF7DF3700" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="HE06EC69124C040979A75CEE7CF91B2DB" commented="no"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H85E6749598C54704AD01AF16A6E8D592" display-inline="no-display-inline"> <paragraph id="H4DF645BA05B5433C8E5A34BB8123D0CC" commented="no"><enum>(2)</enum><header>Provisional operation</header><text display-inline="yes-display-inline">Notwithstanding the requirements of paragraph (1), the Secretary may authorize a railroad carrier or other entity to commence operation in revenue service of a positive train control system or component to the extent necessary to enable the safe implementation and operation of a positive train control system in phases.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H54D9BDF2350C43CDA3273CAB77CA6FFA"><enum>(5)</enum><text>in subsection (i)—</text> <subparagraph id="HEE9CD81160F84275AF0C03DAEE264268"><enum>(A)</enum><text>by redesignating paragraphs (1) through (3) as paragraphs (3) through (5), respectively; and</text></subparagraph>
<subparagraph id="HE582B86B23A54993A718DEEB77458490"><enum>(B)</enum><text>by inserting before paragraph (3) (as so redesignated) the following:</text> <quoted-block id="H140FBEE297F649D781D19FBDD1ED9C9B" style="OLC"> <paragraph id="H7A3A620C176A4808BE184F6AA39F9540"><enum>(1)</enum><header>Equivalent or greater level of safety</header><text>The term <quote>equivalent or greater level of safety</quote> means the compliance of a railroad carrier with—</text>
<subparagraph id="HD74CD640407D42D3A3D64E1953D3FAAE"><enum>(A)</enum><text>appropriate operating rules in place immediately prior to the use or implementation of such carrier’s positive train control system, except that such rules may be changed by such carrier to improve safe operations; and</text></subparagraph> <subparagraph id="H79E7D9DD26D7442AAFCB1C51650E6571"><enum>(B)</enum><text>all applicable safety regulations, except as specified in subsection (j).</text></subparagraph></paragraph>
<paragraph id="HC730989AA6A04693ADFF86AE977DD935"><enum>(2)</enum><header>Hardware</header><text>The term <quote>hardware</quote> means a locomotive apparatus, a wayside interface unit (including any associated legacy signal system replacements), switch position monitors needed for a positive train control system, physical back office system equipment, a base station radio, a wayside radio, a locomotive radio, or a communication tower or pole.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HCA9DAE8A908747EE940CE10EBE458EA7"><enum>(6)</enum><text>by adding at the end the following:</text>

<subsection id="H656A13FB6FE74A3CA5DB651B0351EA8F"><enum>(j)</enum><header>Early adoption</header>
<paragraph id="H9E66B9C27CDB493CACDA8BF73E592F3C" display-inline="no-display-inline"><enum>(1)</enum><header>Operations</header><text display-inline="yes-display-inline">From the date of enactment of the <short-title>Positive Train Control Enforcement and Implementation Act of 2015</short-title> through the 1-year period beginning on the date on which the last Class I railroad carrier’s positive train control system subject to subsection (a) is certified by the Secretary under subsection (h)(1) of this section and is implemented on all of that railroad carrier’s lines required to have operations governed by a positive train control system, any railroad carrier, including any railroad carrier that has its positive train control system certified by the Secretary, shall not be subject to the operational restrictions set forth in sections 236.567 and 236.1029 of title 49, Code of Federal Regulations, that would apply where a controlling locomotive that is operating in, or is to be operated in, a positive train control-equipped track segment experiences a positive train control system failure, a positive train control operated consist is not provided by another railroad carrier when provided in interchange, or a positive train control system otherwise fails to initialize, cuts out, or malfunctions, provided that such carrier operates at an equivalent or greater level of safety than the level achieved immediately prior to the use or implementation of its positive train control system. </text></paragraph> <paragraph id="H991D590B172C42C795CE95EA7FE4325E"><enum>(2)</enum><header>Safety assurance</header><text>During the period described in paragraph (1), if a positive train control system that has been certified and implemented fails to initialize, cuts out, or malfunctions, the affected railroad carrier or other entity shall make reasonable efforts to determine the cause of the failure and adjust, repair, or replace any faulty component causing the system failure in a timely manner.</text></paragraph>
<paragraph id="H17DD60B5874D4A87AC163A530B8B0086"><enum>(3)</enum><header>Plans</header><text>The positive train control safety plan for each railroad carrier or other entity shall describe the safety measures, such as operating rules and actions to comply with applicable safety regulations, that will be put in place during any system failure.</text></paragraph> <paragraph id="HEC32C5F9465B4E89BFD939D08F1D591F"><enum>(4)</enum><header>Notification</header><text>During the period described in paragraph (1), if a positive train control system that has been certified and implemented fails to initialize, cuts out, or malfunctions, the affected railroad carrier or other entity shall submit a notification to the appropriate regional office of the Federal Railroad Administration within 7 days of the system failure, or under alternative location and deadline requirements set by the Secretary, and include in the notification a description of the safety measures the affected railroad carrier or other entity has in place.</text></paragraph></subsection>
<subsection id="H63DB70502A8B47E287FA0CBC6DCBD162"><enum>(k)</enum><header>Small railroads</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary shall amend section 236.1006(b)(4)(iii)(B) of title 49, Code of Federal Regulations (relating to equipping locomotives for applicable Class II and Class III railroads operating in positive train control territory) to extend each deadline under such section by 3 years.</text></subsection> <subsection id="HA1A36BDCAE6E44DDA27437F2B9F6D503"><enum>(l)</enum><header>Revenue service demonstration</header><text display-inline="yes-display-inline">When a railroad carrier or other entity subject to (a)(1) notifies the Secretary it is prepared to initiate revenue service demonstration, it shall also notify any applicable tenant railroad carrier or other entity subject to subsection (a)(1).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H5E3663C28967485893A9E894A2E21D21"><enum>(c)</enum><header>Conforming Amendment</header><text>Section 20157(g), is amended—</text> <paragraph id="HBD261214FDE14F69B21FECFC35058ADE"><enum>(1)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text>

<paragraph id="HBF117D3FDA2D4B08A6DA0BA762EF2552"><enum>(2)</enum><header>Conforming regulatory amendments</header><text>Immediately after the date of the enactment of the <short-title>Positive Train Control Enforcement and Implementation Act of 2015</short-title>, the Secretary—</text> <subparagraph id="H36C511F0BBE74DFC94A35647A605C566"><enum>(A)</enum><text>shall remove or revise the date-specific deadlines in the regulations or orders implementing this section to the extent necessary to conform with the amendments made by such Act; and</text></subparagraph>
<subparagraph id="H0EC547CE72074EECA7441141CCB00D9A"><enum>(B)</enum><text>may not enforce any such date-specific deadlines or requirements that are inconsistent with the amendments made by such Act.</text></subparagraph></paragraph> <paragraph id="H4DD5DD88E33846A7909626DF44584A5C"><enum>(3)</enum><header>Review</header><text>Nothing in the <short-title>Positive Train Control Enforcement and Implementation Act of 2015</short-title>, or the amendments made by such Act, shall be construed to require the Secretary to issue regulations to implement such Act or amendments other than the regulatory amendments required by paragraph (2) and subsection (k).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></subtitle>
