		<official-title display="yes">To prohibit the Federal Communications Commission from regulating the rates charged for broadband
			 Internet access service.</official-title>

 <section id="H3D6C860A85004529B54E964A6D160259" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Rate Regulation of Broadband Internet Access Act</short-title></quote>.</text> </section><section id="H6A86139220C94FE192C3782F456AC71C"><enum>2.</enum><header>Regulation of broadband rates prohibited</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the Federal Communications Commission may not regulate the rates charged for broadband Internet access service.</text>
 </section><section id="HFA8C68C8965F40F5AA26D8B5801B8D08"><enum>3.</enum><header>Exceptions</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to affect the authority of the Commission to—</text> <paragraph id="H19B05AAE25DE4B3DAB60C57EE089F821"><enum>(1)</enum><text>condition receipt of universal service support under section 254 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254</external-xref>) by a provider of broadband Internet access service on the regulation of the rates charged by such provider for the supported service;</text>
 </paragraph><paragraph id="HD7DAFE5F4E3541F0B9DB441B6BF82A1C"><enum>(2)</enum><text>enforce subpart Y of part 64 of title 47, Code of Federal Regulations (relating to truth-in-billing requirements); or</text>
 </paragraph><paragraph id="HDED6170265AA4B9FACEC08D696D89A29"><enum>(3)</enum><text>enforce section 8.9 of title 47, Code of Federal Regulations (relating to paid prioritization).</text> </paragraph></section><section id="HF64328A785C54A5CA4B031D3A1DE3095"><enum>4.</enum><header>Additional rule of construction</header><text display-inline="no-display-inline">For purposes of this Act, broadband Internet access service shall not be construed to include data roaming or interconnection.</text>
 </section><section id="HB2095CB964C245E4B8C94CB1683C6F75"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HF79D58A48AF24D9FAE332932EDE0C62D"><enum>(1)</enum><header>Broadband Internet access service</header><text display-inline="yes-display-inline">The term <quote>broadband Internet access service</quote> has the meaning given such term in the rules adopted in the Report and Order on Remand, Declaratory Ruling, and Order that was adopted by the Commission on February 26, 2015 (FCC 15–24).</text>
 </paragraph><paragraph id="HC5045CC81FA041D8A35D7EE4178975F5"><enum>(2)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Communications Commission.</text> </paragraph><paragraph id="HD1746FE05FAF405D9526BEFF06665AEF"><enum>(3)</enum><header>Rate</header><text display-inline="yes-display-inline">The term <quote>rate</quote> means the amount charged by a provider of broadband Internet access service for the delivery of broadband Internet traffic.</text>
 </paragraph><paragraph id="H9FFA9DA942FD4A12808D6729BE944AEE"><enum>(4)</enum><header>Regulation</header><text>The term <quote>regulation</quote> or <quote>regulate</quote> means, with respect to a rate, the use by the Commission of rulemaking or enforcement authority to establish, declare, or review the reasonableness of such rate.</text>
			</paragraph></section></legis-body>
