<congress display="no">114th CONGRESS</congress><session display="no">1st Session</session><legis-num display="no">H.R. 2617</legis-num><current-chamber display="yes">In the Senate of the United States,</current-chamber><action><action-date date="20150930">September 30, 2015.</action-date></action><legis-type display="yes">Amendments:</legis-type></engrossed-amendment-form><engrossed-amendment-body><section id="idfd90d0cdd0b94064aaac76b2d874a93e" section-type="resolved"><text>That the bill from the House of Representatives (H.R. 2617) entitled <quote>An Act to amend the Fair Minimum Wage Act of 2007 to postpone a scheduled increase in the minimum wage applicable to American Samoa.</quote>, do pass with the following</text></section><amendment><amendment-instruction blank-lines-after="0"><text>Strike all after the enacting clause and insert the following:</text></amendment-instruction><amendment-block blank-lines-after="1" changed="added" reported-display-style="italic"><section commented="no" display-inline="no-display-inline" id="HD2C13385A1504C4798E187C483B2BF1B" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Minimum wage for American Samoa</header><subsection id="id4211a53c8c244528a4e309766d770195"><enum>(a)</enum><header>Minimum wage</header><text>Paragraph (2) of section 8103(b) of the Fair Minimum Wage Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206</external-xref> note) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="idD8C7E4A2C4DF44EE8406008523E16575" style="OLC"><paragraph id="id32fee64bdaff45bcb8784c485c766bb9"><enum>(2)</enum><text>the minimum wage applicable to American Samoa under section 6(a)(1) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)(1)</external-xref>) shall be—</text><subparagraph id="idBDC8DAB921AF47759C58450DA45ECB1B"><enum>(A)</enum><text>the applicable wage rate in effect for each industry and classification as of September 29, 2015; and</text></subparagraph><subparagraph id="idE84153BC2F404883871682E800E4541D"><enum>(B)</enum><text>increased by $0.40 an hour (or such lesser amount as may be necessary to equal the minimum wage under section 6(a)(1) of such Act), beginning on September 30, 2015, and on September 30 of every third year thereafter, until the minimum wage applicable to American Samoa under this paragraph is equal to the minimum wage set forth in such section.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id3b8473a7234a49a9b80ab226aca82aae"><enum>(b)</enum><header>GAO reports</header><text>Section 8104 of the Fair Minimum Wage Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206</external-xref> note) is amended—</text><paragraph id="id70093a1f72bf40f98f3fbb8abe19dac5"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id2E8FDA95E9C64B3C8159943D0D784AFE"><enum>(A)</enum><text>by striking <quote>September 1, 2011</quote> and inserting <quote>April 1, 2017</quote>; and</text></subparagraph><subparagraph id="id222E1F669BBE498E944CB64C64526919"><enum>(B)</enum><text>by striking the second sentence and inserting the following: <quote>The Government Accountability Office shall submit a subsequent report not later than April 1, 2020.</quote>;</text></subparagraph></paragraph><paragraph id="id5CA0D496E9CA42CA9DD46A366516FD6B"><enum>(2)</enum><text>in subsection (b), by striking <quote>the study under subsection (a)</quote> and inserting <quote>any report under subsection (a)</quote>; and</text></paragraph><paragraph id="idf7f834ef659447d3af55dc6981b76d73"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idCBF08E1EF55A49A9A13CBB054575975B" style="OLC"><subsection id="id3C7B788308C740149CB0E867C9E8B8CE"><enum>(c)</enum><header>Report on alternative methods of increasing the minimum wage in American Samoa</header><text>Not later than 1 year after the date of enactment of <quote>An Act to amend the Fair Minimum Wage Act of 2007 to reduce a scheduled increase in the minimum wage applicable to American Samoa</quote>, the Government Accountability Office shall transmit to Congress a report on alternative ways of increasing the minimum wage in American Samoa to keep pace with the cost of living in American Samoa and to eventually equal the minimum wage set forth in section 6(a)(1) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)(1)</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id8952B5E7C3194CF7A3F56056A3E3B00F"><enum>(c)</enum><header>Effective date</header><text>This Act, and the amendments made by this Act, shall take effect as of September 29, 2015.</text></subsection></section></amendment-block></amendment></engrossed-amendment-body><title-amends><official-title-amendment>Amend the title so as to read: <quote>An Act to amend the Fair Minimum Wage Act of 2007 to reduce a scheduled increase in the minimum wage applicable to American Samoa.</quote>.</official-title-amendment></title-amends><attestation><attestation-group><attestor></attestor><role>Secretary</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
