 </subsection></section><section id="H7DC808A8609D4755ACDC3B6391845828"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2602">15 U.S.C. 2602</external-xref>) is amended—</text> <paragraph id="H73F3ACCE544346258B092285A8A50971"><enum>(1)</enum><text>by redesignating paragraphs (7) through (14) as paragraphs (8) through (10) and (12) through (16), respectively;</text>
 </paragraph><paragraph id="HDCAEFB59102D47419F4ECFF602FAD85C"><enum>(2)</enum><text>by inserting after paragraph (6) the following:</text> <quoted-block display-inline="no-display-inline" id="HDC929F573F934B33A3F88A33B47F038C" style="OLC"> <paragraph id="H6E481BFC49DB4F7898EBA688AD37EDF7" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">The term <term>intended conditions of use</term> means the circumstances under which a chemical substance is intended, known, or reasonably foreseeable to be manufactured, processed, distributed in commerce, used, and disposed of.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H3E4A222698D449C7B121AB6D8ED957D9"><enum>(3)</enum><text>by inserting after paragraph (10), as so redesignated, the following:</text> <quoted-block display-inline="no-display-inline" id="H2AB405CF4F11460B934C603429B3437F" style="OLC"> <paragraph id="HDCA2CBEF94C1496BB28E438D56EF2525" indent="up1"><enum>(11)</enum><text display-inline="yes-display-inline">The term <term>potentially exposed subpopulation</term> means a group of individuals within the general population who, due to either greater susceptibility or greater potential exposure, are likely to be at greater risk than the general population of adverse health effects from exposure to a chemical substance.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section commented="no" id="H536A63BEEA3A4A0B8B92D98B8C3DC4E1"><enum>3.</enum><header>Testing of chemical substances and mixtures</header><text display-inline="no-display-inline">Section 4 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2603">15 U.S.C. 2603</external-xref>) is amended—</text> <paragraph commented="no" id="HA43285CE250646BB97393CF61B55E3D8"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)—</text>
 <subparagraph commented="no" id="HDD697DB16FFB4CD59CB305404DCEE6DC"><enum>(A)</enum><text>in subparagraph (A)(iii), by striking <quote>; or</quote> and inserting a semicolon;</text> </subparagraph><subparagraph commented="no" id="HAB597EF85EBA4104B2E17F41069FF3DD"><enum>(B)</enum><text>in subparagraph (B)(iii), by striking <quote>; and</quote> and inserting <quote>; or</quote>; and</text>
 </subparagraph><subparagraph commented="no" id="H5972FE51311C4BD8BCD8DFAE284100B5"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H66F12ADD11794E4FAF1D00632E17050C" style="OLC"> <subparagraph commented="no" id="HA7AE4CEEFB4140D4900A92D96D0A3883" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">testing of a chemical substance is necessary to conduct a risk evaluation under section 6(b); and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph commented="no" id="HDC3387EF99BC4ED9ABAF85F1D99D7279"><enum>(2)</enum><text>in the matter following subsection (a)(2), by inserting <quote>, order, or consent agreement</quote> after <quote>by rule</quote>.</text> </paragraph></section><section id="HE2002FE0476B4A88BA67B896DF6063E8"><enum>4.</enum><header>Regulation of hazardous chemical substances and mixtures</header> <subsection id="HD1BA7F70ECB44F3B85DB7E3202852FE1"><enum>(a)</enum><header>Scope of regulation</header><text display-inline="yes-display-inline">Section 6(a) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(a)</external-xref>) is amended—</text>
 <paragraph id="HD0B79EC42B874556A9F6D5CBF3C8BE38"><enum>(1)</enum><text>by striking <quote>finds that there is a reasonable basis to conclude</quote> and inserting <quote>determines under subsection (b)</quote>;</text> </paragraph><paragraph commented="no" id="HFC50584C79484173BA7B883AB2445D34"><enum>(2)</enum><text>by inserting <quote>or designates a chemical substance under subsection (i)(2),</quote> before <quote>the Administrator shall by rule</quote>; and</text>
 </paragraph><paragraph id="HD411B9413E6C43ABBE604349AE302958"><enum>(3)</enum><text>by striking <quote>to protect adequately against such risk using the least burdensome requirements</quote> and inserting <quote>so that the chemical substance or mixture no longer presents or will present an unreasonable risk, including an identified unreasonable risk to a potentially exposed subpopulation</quote>.</text>
 </paragraph></subsection><subsection id="HCDC7FE24C5A844F3A88C5DBCDFA821AD"><enum>(b)</enum><header>Risk evaluations</header><text display-inline="yes-display-inline">Section 6(b) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(b)</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H1892F606FA1B42A78E21369C695A0590" style="OLC"> <subsection id="HFF750AB6732D4DC980440268E57E60C3"><enum>(b)</enum><header>Risk evaluations</header> <paragraph id="H6617B61C81AB4FDB87B9827CEA5D73BB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall conduct risk evaluations pursuant to this subsection to determine whether or not a chemical substance presents or will present, in the absence of requirements under subsection (a), an unreasonable risk of injury to health or the environment.</text>
 </paragraph><paragraph commented="no" id="HB7C5CC9A811C497DAC96884C4FF1148C"><enum>(2)</enum><header>Applying requirements</header><text display-inline="yes-display-inline">The Administrator shall apply requirements with respect to a chemical substance through a rule under subsection (a) only if the Administrator determines through a risk evaluation under this subsection that the chemical substance presents or will present, in the absence of such requirements, an unreasonable risk of injury to health or the environment.</text>
						</paragraph><paragraph commented="no" id="H11106D7C69F7499C8C424BA5558B9FE3"><enum>(3)</enum><header>Conducting risk evaluation</header>
 <subparagraph commented="no" id="H4314AF6411D644268894BA04E2EDC16E"><enum>(A)</enum><header>Required risk evaluations</header><text>The Administrator shall conduct and publish the results of a risk evaluation under this subsection for a chemical substance if—</text>
 <clause commented="no" id="H32D274C7D49A48589254E80AC6AA0A3A"><enum>(i)</enum><text>the Administrator determines that the chemical substance may present an unreasonable risk of injury to health or the environment because of potential hazard and a potential route of exposure under the intended conditions of use; or</text>
 </clause><clause commented="no" id="H3A9EA694DB5E4092AC8C6FF991887A86"><enum>(ii)</enum><text>a manufacturer of the chemical substance requests such a risk evaluation.</text> </clause></subparagraph><subparagraph commented="no" id="H5E1617A02BB3460582E1037DB28DE1A5"><enum>(B)</enum><header>TSCA Work Plan chemicals</header><text display-inline="yes-display-inline">The Administrator may, without making a determination under subparagraph (A)(i), conduct and publish the results of a risk evaluation under this subsection for a chemical substance that, on the date of enactment of the <short-title>TSCA Modernization Act of 2015</short-title>, is listed in the TSCA Work Plan for Chemical Assessments published by the Administrator.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HDABDB521CD784F5094668C86E7A096D7"><enum>(4)</enum><header>Requirements</header><text>In conducting a risk evaluation under this subsection, the Administrator shall—</text> <subparagraph commented="no" id="H875D47ABD0F948439489230E6143AA33"><enum>(A)</enum><text display-inline="yes-display-inline">integrate and assess information on hazards and exposures for all of the intended conditions of use of the chemical substance, including information that is relevant to specific risks of injury to health or the environment and information on potentially exposed subpopulations;</text>
 </subparagraph><subparagraph commented="no" id="H64E8A21963F1488296B63301F7E051A0"><enum>(B)</enum><text display-inline="yes-display-inline">not include information on cost and other factors not directly related to health or the environment;</text>
 </subparagraph><subparagraph commented="no" id="HD762F6FB456B4C5B9BD09EA06988838E"><enum>(C)</enum><text>take into account, where relevant, the likely duration, intensity, frequency, and number of exposures under the intended conditions of use of the chemical substance;</text>
 </subparagraph><subparagraph commented="no" id="HB24155CF4AE842F1875B32DA97C2B252"><enum>(D)</enum><text>describe the weight of the scientific evidence for identified hazard and exposure;</text> </subparagraph><subparagraph commented="no" id="H0D178C0A5B334EA88ED1BA5B24BD235E"><enum>(E)</enum><text>consider whether the weight of the scientific evidence supports the identification of doses of the chemical substance below which no adverse effects can be expected to occur; and</text>
 </subparagraph><subparagraph id="H0A7F34ADFD19401BB1080254B692F9F4"><enum>(F)</enum><text>in the case of a risk evaluation requested by a manufacturer under paragraph (3)(A)(ii), ensure that the costs to the Environmental Protection Agency, including contractor costs, of conducting the risk evaluation are paid for by the manufacturer.</text>
							</subparagraph></paragraph><paragraph id="HC625168348874AF481D942FA1130387A"><enum>(5)</enum><header>Deadlines</header>
 <subparagraph id="H0CB4E41FE1DA49F093B0BC94A491DD89"><enum>(A)</enum><header>Risk evaluations</header><text display-inline="yes-display-inline">The Administrator shall conduct and publish a risk evaluation under this subsection for a chemical substance as soon as reasonably possible, subject to the availability of resources, but not later than 3 years after the date on which—</text>
 <clause commented="no" id="H679FE9A741B042A19BCC5CD7C98D7747"><enum>(i)</enum><text display-inline="yes-display-inline">the Administrator—</text> <subclause commented="no" id="H89CD5887ECD3414F9BB61DB9BAD98359"><enum>(I)</enum><text>makes a determination under paragraph (3)(A)(i); or</text>
 </subclause><subclause commented="no" id="HBEDB890450474BC5BAAE544264FDC5A2"><enum>(II)</enum><text>begins the risk evaluation under paragraph (3)(B); or</text> </subclause></clause><clause id="H4F2D614DB6D1452E8B5A4F910E9DD84E"><enum>(ii)</enum><text>a manufacturer requests the risk evaluation under paragraph (3)(A)(ii).</text>
 </clause></subparagraph><subparagraph commented="no" id="HF18F8C07C9EB4A7CAF0D559EEF46E2DB"><enum>(B)</enum><header>Subsection <enum-in-header>(a)</enum-in-header> rules</header><text display-inline="yes-display-inline">If, based on a risk evaluation conducted under this subsection, the Administrator determines that a chemical substance presents or will present, in the absence of a rule under subsection (a), an unreasonable risk of injury to health or the environment, the Administrator shall—</text>
 <clause commented="no" id="HFE6EA1EE15BC436189D8ACC6F77B48FD"><enum>(i)</enum><text>propose a rule under subsection (a) for the chemical substance not later than 90 days after the date on which the risk evaluation regarding such chemical substance is published under subparagraph (A); and</text>
 </clause><clause commented="no" id="H487A5945886C4E3C8D5CD77B866E9F73"><enum>(ii)</enum><text display-inline="yes-display-inline">publish in the Federal Register a final rule not later than 180 days after the date on which the risk evaluation regarding such chemical substance is published under subparagraph (A).</text>
 </clause></subparagraph><subparagraph id="H14B283C246E5432888CE547C0D6A4E97"><enum>(C)</enum><header>Extension</header><text>If the Administrator determines that additional information is necessary to make a risk evaluation determination under this subsection, the Administrator may extend the deadline under subparagraph (A) accordingly, except that the deadline may not be extended to a date that is later than—</text>
 <clause id="HDA45E7A288ED4D47918D0405AFF104E2"><enum>(i)</enum><text>90 days after receipt of such additional information; or</text> </clause><clause id="H39F560576A224F34BC93F72996A113CB"><enum>(ii)</enum><text>2 years after the original deadline.</text>
								</clause></subparagraph></paragraph><paragraph id="H6C55D7DD49B84ACD80C491CF252B3ED4"><enum>(6)</enum><header>Determinations of no unreasonable risk</header>
 <subparagraph commented="no" id="HAA94111A320D4B2CBFFC6BA9B882617C"><enum>(A)</enum><header>Notice and comment</header><text display-inline="yes-display-inline">Not later than 30 days before publishing a final determination under this subsection that a chemical substance will not present an unreasonable risk of injury to health or the environment, the Administrator shall make a preliminary determination to such effect and provide public notice of, and an opportunity for comment regarding, such preliminary determination.</text>
 </subparagraph><subparagraph id="H45DCC5A2EB6B4DCEA55075AAD38399B5"><enum>(B)</enum><header>Potentially exposed subpopulations</header><text display-inline="yes-display-inline">The Administrator shall not make a determination under this subsection that a chemical substance will not present an unreasonable risk of injury to health or the environment if the Administrator determines that the chemical substance, under the intended conditions of use, poses an unreasonable risk of injury to 1 or more potentially exposed subpopulations.</text>
 </subparagraph><subparagraph id="H1F0994B6F85C44ED89FCE921C6F24803"><enum>(C)</enum><header>Final action</header><text>A final determination under this subsection that a chemical substance will not present an unreasonable risk of injury to health or the environment shall be considered a final agency action.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H0E0A6776D7A94098A8C4E818D281A61A"><enum>(7)</enum><header>Minimum number</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, the Administrator shall initiate 10 or more risk evaluations under paragraphs (3)(A)(i) or (3)(B) in each fiscal year beginning in the fiscal year of the date of enactment of the <short-title>TSCA Modernization Act of 2015</short-title>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HA8C9E2A07C8D446E8A98A0F9AF5B007C"><enum>(c)</enum><header>Promulgation of subsection <enum-in-header>(a) </enum-in-header>rules</header><text display-inline="yes-display-inline">Section 6(c) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(c)</external-xref>) is amended—</text> <paragraph id="H5EA7E1B33BFE4E65BF25EA57F1F41A3F"><enum>(1)</enum><text>by amending paragraph (1) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HCDD56D3EC5EA4AAFBF2C44195BC4FA2A" style="OLC">
 <paragraph id="HB6AD930EB6114DF3B84B4083C3898BCE"><enum>(1)</enum><header>Requirements for rule</header><text display-inline="yes-display-inline">In promulgating any rule under subsection (a) with respect to a chemical substance or mixture, the Administrator shall—</text>
 <subparagraph id="HEB3B1546D4A74989BCAB81B69214BC2C"><enum>(A)</enum><text>consider and publish a statement with respect to—</text> <clause id="H3AAD12C90597463F875581AC4C54927E"><enum>(i)</enum><text display-inline="yes-display-inline">the effects of the chemical substance or mixture on health and the magnitude of the exposure of human beings to the chemical substance or mixture;</text>
 </clause><clause id="H8E630697A108455A9AF94B6975E3E6FE"><enum>(ii)</enum><text display-inline="yes-display-inline">the effects of the chemical substance or mixture on the environment and the magnitude of the exposure of the environment to the chemical substance or mixture;</text>
 </clause><clause id="H036D06978E5340F0BC10D0FE2724580C"><enum>(iii)</enum><text display-inline="yes-display-inline">the benefits of the chemical substance or mixture for various uses; and</text> </clause><clause id="H1DC8D4B273024149B902E9C3C3D465FE"><enum>(iv)</enum><text>the reasonably ascertainable economic consequences of the rule, including consideration of the likely effect of the rule on the national economy, small business, technological innovation, the environment, and public health;</text>
 </clause></subparagraph><subparagraph commented="no" id="H9B7CCC27E0B5423F965297773CA7A046"><enum>(B)</enum><text display-inline="yes-display-inline">impose requirements under the rule that the Administrator determines, consistent with the information published under subparagraph (A), are cost-effective, except where the Administrator determines that additional or different requirements described in subsection (a) are necessary to protect against the identified risk;</text>
 </subparagraph><subparagraph id="H62569C89BF7947ECAA18F510FC83D876"><enum>(C)</enum><text display-inline="yes-display-inline">based on the information published under subparagraph (A), in deciding whether to prohibit or restrict in a manner that substantially prevents a specific use of a chemical substance or mixture and in setting an appropriate transition period for such action, determine whether technically and economically feasible alternatives that benefit health or the environment, compared to the use so proposed to be prohibited or restricted, will be reasonably available as a substitute when the proposed prohibition or restriction takes effect;</text>
 </subparagraph><subparagraph commented="no" id="H95C56FBB4422466FA7C46823C3CEABD0"><enum>(D)</enum><text display-inline="yes-display-inline">exempt replacement parts designed prior to the date of publication in the Federal Register of the rule unless the Administrator finds such replacement parts contribute significantly to the identified risk, including identified risk to identified potentially exposed subpopulations; and</text>
 </subparagraph><subparagraph commented="no" id="HECE0FA46B3E34DB8A074B596ECFEAE80"><enum>(E)</enum><text display-inline="yes-display-inline">in selecting among prohibitions and restrictions to address an identified risk, apply prohibitions or restrictions to articles on the basis of a chemical substance or mixture contained in the article only to the extent necessary to mitigate the identified risk.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H0E511FD06F9D4CDE83916C835A4D1F06"><enum>(2)</enum><text>in paragraph (2)—</text> <subparagraph id="HABE171243E4747A9A5ECBAD74A5CCD9F"><enum>(A)</enum><text>by inserting <quote><header-in-text level="paragraph" style="OLC">Procedures.</header-in-text>—</quote> before <quote>When prescribing a rule</quote>;</text>
 </subparagraph><subparagraph id="H0032E9FAF4064EDE9C0077A8F6A222FC"><enum>(B)</enum><text>by striking <quote>provide an opportunity for an informal hearing in accordance with paragraph (3); (D)</quote>;</text> </subparagraph><subparagraph id="H62E05A3D040849FE89498483F9190FA3"><enum>(C)</enum><text>by striking <quote>, and (E)</quote> and inserting <quote>; and (D)</quote>; and</text>
 </subparagraph><subparagraph commented="no" id="H9D7C4C3131FB413FBDDEF3C4AC32BEA8"><enum>(D)</enum><text>by moving such paragraph 2 ems to the right;</text> </subparagraph></paragraph><paragraph commented="no" id="H3CB8C93D40644E69AF70CEBC7448CBBC"><enum>(3)</enum><text>by striking paragraphs (3) and (4) and redesignating paragraph (5) as paragraph (3); and</text>
 </paragraph><paragraph id="HAFCDF88FE78E48119B7C34F916A8726F"><enum>(4)</enum><text>in paragraph (3) (as so redesignated)—</text> <subparagraph commented="no" id="H222EBAAAC300455CB2BD11173E04A255"><enum>(A)</enum><text>by striking <quote>Paragraphs (1), (2), (3), and (4)</quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Application.—</header-in-text>Paragraphs (1) and (2)</quote>; and</text>
 </subparagraph><subparagraph id="HB42CCD20B24E4789A9AC8B5F838D93DD"><enum>(B)</enum><text display-inline="yes-display-inline">by moving such paragraph 2 ems to the right.</text> </subparagraph></paragraph></subsection><subsection id="HB8F49CAF44B04522BB3E5B4DC4FBC79F"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">Section 6(d)(2)(B) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(d)(2)(B)</external-xref>) is amended by adding at the end the following: <quote>Any rule promulgated under subsection (a) shall provide for a reasonable transition period.</quote>.</text>
 </subsection><subsection commented="no" id="HBF62213DBF754E0A97ADFD8528867D8A"><enum>(e)</enum><header>Non-Risk factors; critical use exemptions; PBT chemicals</header><text display-inline="yes-display-inline">Section 6 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H700AF27CAD934D57AAE9826EDEC8F7F6" style="OLC">
 <subsection commented="no" id="HBF8B08B78B6E4BB9B57D6EA4F40DE463"><enum>(g)</enum><header>Non-Risk factors</header><text display-inline="yes-display-inline">The Administrator shall not consider costs or other non-risk factors when deciding whether to initiate a rulemaking under subsection (a).</text>
					</subsection><subsection commented="no" id="H2418F72C5F584AEC9344D84BD7D82F45"><enum>(h)</enum><header>Critical use exemptions</header>
 <paragraph commented="no" id="H59968532D5A7462F8B31DC1A6ED60D71"><enum>(1)</enum><header>Criteria for exemption</header><text display-inline="yes-display-inline">The Administrator may grant an exemption from a requirement of a subsection (a) rule for a specific use of a chemical substance or mixture, if—</text>
 <subparagraph commented="no" id="HD2996B966B5F42CEB6747F2ECB90416E"><enum>(A)</enum><text>the requirement is not cost-effective with respect to the specific use, as determined by the Administrator pursuant to subsection (c)(1)(B); and</text>
 </subparagraph><subparagraph commented="no" id="HE7E5790382764F18A15AF96990965F2F"><enum>(B)</enum><text>the Administrator finds that—</text> <clause commented="no" id="H84687FEF7EDD46399DC8B9B5B9746558"><enum>(i)</enum><text>the specific use is a critical or essential use; or</text>
 </clause><clause commented="no" id="H4FBCEBC00A914C989786D1F25718897D"><enum>(ii)</enum><text display-inline="yes-display-inline">the requirement, as applied with respect to the specific use, would significantly disrupt the national economy, national security, or critical infrastructure.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" id="H5849D2B9CF444431A298A4F1CEE92959"><enum>(2)</enum><header>Procedure</header><text display-inline="yes-display-inline">An exemption granted under paragraph (1) shall be—</text> <subparagraph commented="no" id="HCCFAE29A76E94F3C87A3470B11FA7E0A"><enum>(A)</enum><text>supported by clear and convincing evidence;</text>
 </subparagraph><subparagraph commented="no" id="HEEC016145A744E8FAF65C75EC15DE310"><enum>(B)</enum><text>preceded by public notice of the proposed exemption and an opportunity for comment; and</text> </subparagraph><subparagraph commented="no" id="H3D4CDC736A574E83A3E72C32041B0650"><enum>(C)</enum><text>followed by notice of the granted exemption—</text>
 <clause commented="no" id="HF2D6433FFE264F41A2EC7995771A2951"><enum>(i)</enum><text>to the public, by the Administrator; and</text> </clause><clause commented="no" id="H00ECA24D226E47388D418E31E2F982F0"><enum>(ii)</enum><text display-inline="yes-display-inline">to known commercial purchasers of the chemical substance or mixture with respect to which the exemption applies, by the manufacturers and processors of such chemical substance or mixture.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" id="HCF2941007046414BAF023D0066D4C4A1"><enum>(3)</enum><header>Period of exemption</header><text display-inline="yes-display-inline">An exemption granted under paragraph (1) shall expire after a period not to exceed 5 years, but may be renewed for one or more additional 5-year periods if the Administrator finds that the requirements of paragraph (1) continue to be met.</text>
 </paragraph><paragraph commented="no" id="HD3E5EE6522794226ACF6F59780B75FAB"><enum>(4)</enum><header>Conditions</header><text display-inline="yes-display-inline">The Administrator shall impose conditions on any use for which an exemption is granted under paragraph (1) to reduce risk from the chemical substance or mixture to the greatest extent feasible.</text>
						</paragraph></subsection><subsection id="HD94A75F733614631BAAEF1A7A1C3A9F7"><enum>(i)</enum><header>Chemicals that are persistent, bioaccumulative, and toxic</header>
 <paragraph id="HC312BF51CD164B79B90FE920596692D0"><enum>(1)</enum><header>Identification</header><text display-inline="yes-display-inline">Not later than 9 months after the date of enactment of the <short-title>TSCA Modernization Act of 2015</short-title>, the Administrator shall publish a list of those chemical substances that the Administrator has a reasonable basis to conclude are persistent, bioaccumulative, and toxic, not including any chemical substance that is a metal, a metal compound, or subject to subsection (e).</text>
 </paragraph><paragraph commented="no" id="HE4FDBE7DF51A4EB098CC8AA8CE281769"><enum>(2)</enum><header>Confirmation of concern</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of the <short-title>TSCA Modernization Act of 2015</short-title>, the Administrator shall designate as a PBT chemical of concern each chemical substance on the list published under paragraph (1)—</text>
 <subparagraph commented="no" id="HF031E4A2220B4CE7AB4392985BA6B5DC"><enum>(A)</enum><text display-inline="yes-display-inline">that, with respect to persistence and bioaccumulation, scores high for one and either high or moderate for the other, pursuant to the TSCA Work Plan Chemicals Methods Document published by the Administrator in February 2012; and</text>
 </subparagraph><subparagraph commented="no" id="H2B16E016E063466DB9A4B82CDE455A81"><enum>(B)</enum><text>exposure to which is likely to the general population or to a potentially exposed subpopulation identified by the Administrator.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H1A97EDBD90F54E0CA84ADACB3F0C36AA"><enum>(3)</enum><header>Expedited action</header><text display-inline="yes-display-inline">Notwithstanding subsection (b)(2), subject to the availability of appropriations, not later than 2 years after designating a chemical substance under paragraph (2), the Administrator shall promulgate a rule under subsection (a) with respect to the chemical substance to reduce likely exposure to the extent practicable.</text>
 </paragraph><paragraph commented="no" id="H791BDA1A90AD4284813131A49B95C210"><enum>(4)</enum><header>Relationship to subsection <enum-in-header>(b)</enum-in-header></header><text display-inline="yes-display-inline">If, at any time prior to the date that is 90 days after the date on which the Administrator publishes the list under paragraph (1), the Administrator makes a finding under subsection (b)(3)(A)(i), or a manufacturer requests a risk evaluation under subsection (b)(3)(A)(ii), with respect to a chemical substance, such chemical substance shall not be subject to this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section commented="no" id="H779A080496AA42EF8191AFDCF6076D71"><enum>5.</enum><header>Relationship to other Federal laws</header><text display-inline="no-display-inline">Section 9(b) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2608">15 U.S.C. 2608(b)</external-xref>) is amended—</text> <paragraph commented="no" id="HAFC37049B85A4CD19AF7D3ED63E3FFE6"><enum>(1)</enum><text>by striking <quote>The Administrator shall coordinate</quote> and inserting <quote>(1) The Administrator shall coordinate</quote>; and</text>
 </paragraph><paragraph commented="no" id="HC956F5EF7AE64B7D934C1A418A7A2265"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H9D2090A514054975AAEBA2C7DF3C6D69" style="OLC"> <paragraph commented="no" id="H0A216EDF3B3A44618B9C0A7A286C77CE" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In making a determination under paragraph (1) that it is in the public interest for the Administrator to take an action under this title with respect to a chemical substance or mixture rather than under another law administered in whole or in part by the Administrator, the Administrator shall compare the relevant risks, estimated costs, and efficiencies of the action to be taken under this title and an action to be taken under such other law to protect against such risk.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H22EE5F5A063A46309DDE7997A1EC86C2"><enum>6.</enum><header>Disclosure of data</header><text display-inline="no-display-inline">Section 14 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2613">15 U.S.C. 2613</external-xref>) is amended—</text> <paragraph id="HDCAB6218D6DA4770B9F10270C4F2BE1D"><enum>(1)</enum><text>in subsection (a)—</text>
 <subparagraph id="H99B91ADF38724F51BB7DF96270AE8DD7"><enum>(A)</enum><text>by striking <quote>or</quote> at the end of paragraph (3);</text> </subparagraph><subparagraph id="H6C3D11FB2C174FA6B23AB8F4C03E76A1"><enum>(B)</enum><text>by striking the period at the end of paragraph (4) and inserting a semicolon; and</text>
 </subparagraph><subparagraph id="HA05B291AED3D4A9A84E3962EA01EB99A"><enum>(C)</enum><text>by adding after paragraph (4) the following new paragraphs:</text> <quoted-block display-inline="no-display-inline" id="H9318039832DB49418D31E593C1F882E4" style="OLC"> <paragraph id="H16B80252F0AF47ADBBEB8B0AE32CEA13"><enum>(5)</enum><text display-inline="yes-display-inline">may be disclosed to a State, local, or tribal government official upon request of the official for the purpose of administration or enforcement of a law; and</text>
 </paragraph><paragraph commented="no" id="HF943BE4ADB344BBBA606C0DABC9822E9"><enum>(6)</enum><text>shall be disclosed upon request—</text> <subparagraph commented="no" id="H76A4BE9074A34511926DD363BF3BEB23"><enum>(A)</enum><text display-inline="yes-display-inline">to a health or environmental professional employed by a Federal or State agency in response to an environmental release; or</text>
 </subparagraph><subparagraph commented="no" id="H86711E53BFF94AFEBBAB2F60F7C31178"><enum>(B)</enum><text>to a treating physician or other health care professional to assist in the diagnosis or treatment of 1 or more individuals.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HAA11D4682803460DB19A97790C572F51"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(1), in the matter following subparagraph (B)—</text> <subparagraph commented="no" id="HDBB2A05D63664303BB55F462C09BF467"><enum>(A)</enum><text>by striking <quote>data which discloses</quote> and inserting <quote>data that disclose formulas (including molecular structures) of a chemical substance or mixture,</quote>;</text>
 </subparagraph><subparagraph id="HAD4784AD6F4043578530B0FAB0B063C7"><enum>(B)</enum><text>by striking <quote>mixture or,</quote> and inserting <quote>mixture, or,</quote>; and</text> </subparagraph><subparagraph id="HEF9008D798B44748B37EC6154D8C56E5"><enum>(C)</enum><text>by striking <quote>the release of data disclosing</quote>;</text>
 </subparagraph></paragraph><paragraph id="H5BCB162C4FE3420FAF9EF460AE1F2C49"><enum>(3)</enum><text>in subsection (c)—</text> <subparagraph id="H55D3AA409B3749268A5E5E5858D2BA53"><enum>(A)</enum><text>by striking the subsection heading and inserting <quote><header-in-text level="subsection" style="OLC">Designating and substantiating confidentiality.—</header-in-text></quote>; and</text>
 </subparagraph><subparagraph id="H2B7BB72F7A9A4EA1995B27C46665F83F"><enum>(B)</enum><text>by amending paragraph (1) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HF13EBB94214D4C989C842F810A42BBAD" style="OLC"> <paragraph id="H98D0D4036C6140358A81EF4ED552605C" indent="up1"><enum>(1)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H75607720B544444BB77B40B081C0C985"><enum>(A)</enum><text>In submitting information under this Act after the date of enactment of the <short-title>TSCA Modernization Act of 2015</short-title>, a manufacturer, processor, or distributor in commerce shall designate the information which such person believes is entitled to protection under this section, and submit such designated information separately from other information submitted under this Act. A designation under this subparagraph shall be made in writing and in such manner as the Administrator may prescribe, and shall include—</text>
 <clause id="H51A10D7DD4534E6AA9EC140F73955BC1" indent="up1"><enum>(i)</enum><text>justification for each designation of confidentiality;</text> </clause><clause id="HAF124DA45F3045B29F920DEDABCDB8C4" indent="up1"><enum>(ii)</enum><text>a certification that the information is not otherwise publicly available; and</text>
 </clause><clause id="H810945189118420A9D71B7B304EBF248" indent="up1"><enum>(iii)</enum><text>separate copies of all submitted information, with 1 copy containing and 1 copy excluding the information to which the request applies.</text>
 </clause></subparagraph><subparagraph id="HA09AD24399D148C3A8364368B3393690" indent="up1"><enum>(B)</enum><text>Designations made under subparagraph (A) after the date of enactment of the <short-title>TSCA Modernization Act of 2015</short-title> shall expire after 10 years, at which time the information shall be made public unless the manufacturer, processor, or distributor in commerce has submitted a request for renewal, made in writing and in such manner as the Administrator may prescribe, including all of the elements required for the initial submission.</text>
 </subparagraph><subparagraph id="H21434347FB5242DFBE23E63EADB79108" indent="up1"><enum>(C)</enum><text>Not later than 60 days prior to making information public under subparagraph (B), the Administrator shall notify, as appropriate and practicable, the manufacturer, processor, or distributor in commerce who designated the information under subparagraph (A) of the date on which such information will be made public unless a request for renewal is granted under subparagraph (B).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H498AB9F932154DFE9CCD2E07B4C03E73"><enum>(4)</enum><text>by adding at the end the following new subsections:</text> <quoted-block display-inline="no-display-inline" id="H2A84D4D443FD41968D4DE70EF2BDBDB4" style="OLC"> <subsection id="HF0BB234B37B34D6D8623165AAF511226"><enum>(f)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No person who receives information as permitted under subsection (a) may use such information for any purpose not specified in such subsection, nor disclose such information to any person not authorized to receive such information.</text>
 </subsection><subsection id="HEE41D6920CF24BBDBD1A1224ADF3823D"><enum>(g)</enum><header>Savings</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to affect the applicability of State or Federal rules of evidence or procedure in any judicial proceeding.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HA5DFA57760264987B8A2783FB33AA2DC"><enum>7.</enum><header>Effect on State law</header>
 <subsection id="HBFC12A6B63094A86ACDC6F817CCE04ED"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 18(a) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2617">15 U.S.C. 2617(a)</external-xref>) is amended—</text> <paragraph id="H06FA5047B77E496994A1931C3BF438EF"><enum>(1)</enum><text>in paragraph (2)(A), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </paragraph><paragraph id="H0F5E5F0C9EAB419F9184727F690DADB2"><enum>(2)</enum><text>by striking paragraph (2)(B) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H5B7A9E174A474BD79DD3608629EDC0EA" style="OLC"> <subparagraph commented="no" id="H488145E3309F4FB7826BC09E230491D2" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">if the Administrator makes a final determination under section 6(b) that a chemical substance will not present an unreasonable risk of injury to health or the environment under the intended condition of use, no State or political subdivision may, after the date of publication of such determination, establish or continue in effect any requirement that applies to such chemical substance under the intended conditions of use considered by the Administrator in the risk evaluation under section 6(b), and is designed to protect against exposure to such chemical substance under the intended conditions of use, unless the requirement of the State or political subdivision—</text>
 <clause id="HF605FF674DE04522998BDFACAB2FF2C2"><enum>(i)</enum><text>is adopted under the authority of a Federal law; or</text> </clause><clause id="H29BAB8D602D040F8AC16D30AC40EB030"><enum>(ii)</enum><text display-inline="yes-display-inline">is adopted to protect air or water quality or is related to waste treatment or waste disposal, except that this clause does not apply to such a requirement if a provision of this title, or an action or determination made by the Administrator under this title, actually conflicts with the requirement; and</text>
 </clause></subparagraph><subparagraph id="H26F74EFDF6EC4CFA9B081F6B39100B1F" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">if the Administrator imposes a requirement, through a rule or order under section 5 or 6, that applies to a chemical substance or mixture (other than a requirement described in section 6(a)(6)) and is designed to protect against a risk of injury to health or the environment associated with such chemical substance or mixture, no State or political subdivision may, after the effective date of such requirement, establish or continue in effect any requirement that applies to such chemical substance or mixture (including a requirement that applies to an article because the article contains the chemical substance or mixture) and is designed to protect against exposure to the chemical substance or mixture either under the intended conditions of use considered by the Administrator in the risk evaluation under section 6(b) or from a use identified in a notice received by the Administrator under section 5(a), or, in the case of a requirement imposed pursuant to section 6(i), is designed to protect against a risk of injury considered by the Administrator in imposing such requirement, unless the requirement of the State or political subdivision—</text>
 <clause id="H5BC3461A26914A1E98661FEEF548D41A"><enum>(i)</enum><text display-inline="yes-display-inline">is identical to the requirement imposed by the Administrator;</text> </clause><clause id="H6C54DCB9049A4BE8BDF200148A322626"><enum>(ii)</enum><text>is adopted under the authority of a Federal law; or</text>
 </clause><clause commented="no" id="H51FA693ECBE942E2A846699D7236097F"><enum>(iii)</enum><text display-inline="yes-display-inline">is adopted to protect air or water quality or is related to waste treatment or waste disposal, except that this clause does not apply to such a requirement if a provision of this title, or an action or determination made by the Administrator under this title, actually conflicts with the requirement.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H1E951598B42549F4BF86BE15EFB54A35"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HBC7CF379CF4543CB988E3415B99D8932" style="OLC"> <paragraph id="H8787FAFA426E4DAAB2E2356AF2C4680F" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In the case of an identical requirement described in paragraph (2)(C)(i)—</text>
 <subparagraph id="H6383293E28FC4258B4588AA4D5A0FEAF"><enum>(A)</enum><text>a State may not assess a penalty for a specific violation for which the Administrator has assessed a penalty under section 16; and</text>
 </subparagraph><subparagraph commented="no" id="H359611C89DCB4871B675E216AAA8CB1C"><enum>(B)</enum><text>if a State has assessed a penalty for a specific violation, the Administrator may not assess a penalty for that violation in an amount that would cause the total of the penalties assessed for the violation by the State and the Administrator combined to exceed the maximum amount that may be assessed for that violation by the Administrator under section 16.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H26164D3282D04046B7F1322C11DFF57E"><enum>(b)</enum><header>Savings</header><text display-inline="yes-display-inline">Section 18 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2617">15 U.S.C. 2617</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDA81E4AE888942C2AD913563AD451D8C" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="H9F92F09E0B274662906A8EA659CA4866"><enum>(c)</enum><header>Savings</header>
 <paragraph commented="no" id="HBFEA5142580A42D8B00C2CA97C3C4AEC"><enum>(1)</enum><header>Prior State actions</header><text display-inline="yes-display-inline">Nothing in this title, nor any risk evaluation, rule, order, standard, or requirement completed or implemented under this title, shall be construed to preempt or otherwise affect the authority of a State or political subdivision of a State to continue to enforce any action taken before August 1, 2015, under the authority of a State law that prohibits or otherwise restricts the manufacturing, processing, distribution in commerce, use, or disposal of a chemical substance, or any action taken pursuant to a State law that was in effect on August 31, 2003, unless an action or determination made by the Administrator under this title actually conflicts with the action taken pursuant to such a State law.</text>
 </paragraph><paragraph commented="no" id="HD425D83BC41545A8803D401D3E570E13"><enum>(2)</enum><header>Tort and contract law</header><text display-inline="yes-display-inline">Nothing in this title, nor any risk evaluation, rule, order, standard, or requirement completed or implemented under this title, shall be construed to preempt or otherwise affect either Federal or State tort law or the law governing the interpretation of contracts of any State, including any remedy for civil relief, whether under statutory or common law, including a remedy for civil damages, and any cause of action for personal injury, wrongful death, property damage, or other injury based on negligence, strict liability, products liability, failure to warn, or any other legal theory relating to tort law.</text>
 </paragraph><paragraph commented="no" id="H66D69B44DD294961907A8B652C09CADB"><enum>(3)</enum><header>Intent of Congress</header><text display-inline="yes-display-inline">It is not the intent of Congress that this title, or rules, regulations, or orders issued pursuant to this title, be interpreted as influencing, in either a plaintiff’s or defendant’s favor, the disposition of any civil action for damages in a State court, or the authority of any court to make a determination in an adjudicatory proceeding under applicable State law with respect to the admissibility of evidence, unless a provision of this title actually conflicts with the State court action.</text>
 </paragraph><paragraph id="HF5A3833270F544A3BD316F39DE820160"><enum>(4)</enum><header>Application</header><text>For purposes of this title, the term <term>requirements</term> does not include civil tort actions for damages under State law.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection commented="no" id="H7B6130E562294FFC98102DEB1704DD65"><enum>(c)</enum><header>Effect of actions by Administrator</header><text display-inline="yes-display-inline">Nothing in this Act, or the amendments made by this Act, shall be construed as changing the preemptive effect of an action taken by the Administrator prior to the date of enactment of this Act or under section 6(e).</text>
 </subsection></section><section id="H372AA9CD23AE4824A4F18178820483DC"><enum>8.</enum><header>Administration of the Act</header><text display-inline="no-display-inline">Section 26 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2625">15 U.S.C. 2625</external-xref>) is amended—</text> <paragraph id="H87AA835EB7F54FC4A0FCE866391CA0C6"><enum>(1)</enum><text>in subsection (b)(1)—</text>
 <subparagraph id="HB72363383AAB427E8CA7B08B8A477C91"><enum>(A)</enum><text>by striking <quote>of a reasonable fee</quote>;</text> </subparagraph><subparagraph id="HD929C8C1B0AA4C7D9BE9BBD547E469DE"><enum>(B)</enum><text>by inserting <quote>of a fee that is sufficient and not more than reasonably necessary</quote> after <quote>section 4 or 5</quote>;</text>
 </subparagraph><subparagraph commented="no" id="HDD834DE40E9247D290A70176202A9E75"><enum>(C)</enum><text>by inserting <quote>, or who requests a risk evaluation under section 6(b)(3)(A)(ii),</quote> before <quote>to defray the cost</quote>;</text> </subparagraph><subparagraph commented="no" id="H59DEFECE9C364A55BD9694E301711394"><enum>(D)</enum><text>by striking <quote>this Act</quote> and inserting <quote>the provision of this title for which such fee is collected</quote>; and</text>
 </subparagraph><subparagraph id="HBE6ECE24747F43F3B406126EC3B241C3"><enum>(E)</enum><text>by striking <quote>Such rules shall not provide for any fee in excess of $2,500 or, in the case of a small business concern, any fee in excess of $100.</quote> and inserting <quote>Such rules shall provide for lower fees for small business concerns.</quote>;</text>
 </subparagraph></paragraph><paragraph id="H85A284CF1C04482CA03C1E839858BAAE"><enum>(2)</enum><text>by adding at the end of subsection (b) the following:</text> <quoted-block display-inline="no-display-inline" id="HC75E6754591D454EB9EEC8AE6512FCB5" style="OLC"> <paragraph commented="no" id="HCBB9A63F8F224B4AB181D6871B87053A" indent="up1"><enum>(3)</enum><header>Fund</header> <subparagraph commented="no" id="HBDA2AF7AD85847BE901B52A08179C242"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a revolving fund, to be known as the TSCA Service Fee Fund (in this paragraph referred to as the <quote>Fund</quote>), consisting of such amounts as are deposited in the Fund under this paragraph.</text>
 </subparagraph><subparagraph commented="no" id="H603521C89FAF4B9EBCA5623E0531971C"><enum>(B)</enum><header>Collection and deposit of fees</header><text display-inline="yes-display-inline">The Administrator shall collect the fees described in paragraph (1) and deposit those fees in the Fund.</text>
 </subparagraph><subparagraph commented="no" id="H95A03B7E00AD46C3B7566367994FF065"><enum>(C)</enum><header>Crediting and availability of fees</header><text display-inline="yes-display-inline">On request by the Administrator, the Secretary of the Treasury shall transfer from the Fund to the Administrator amounts appropriated to pay or recover the full costs incurred by the Environmental Protection Agency, including contractor costs, in carrying out the provisions of this title for which the fees are collected under paragraph (1).</text>
 </subparagraph><subparagraph commented="no" id="H98690B1BF98C4564B9E839AE93CA961A"><enum>(D)</enum><header>Use of funds by Administrator</header><text display-inline="yes-display-inline">Amounts equivalent to fees collected by the Administrator and deposited in the Fund under this section shall be available without fiscal year limitation to the Administrator, subject to the availability of appropriations, for use only in administering the provisions of this title for which the fees are collected.</text>
						</subparagraph><subparagraph commented="no" id="HBE1E8A60CC614EED9862762FB5E066C2"><enum>(E)</enum><header>Accounting and auditing</header>
 <clause commented="no" id="HEF5873CBB9DD4753A4451DE2C501495A"><enum>(i)</enum><header>Accounting</header><text display-inline="yes-display-inline">The Administrator shall biennially prepare and submit to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that includes an accounting of the fees paid to the Administrator under this paragraph and amounts disbursed from the Fund for the period covered by the report, as reflected by financial statements provided in accordance with sections 3515 and 3521 of title 31, United States Code.</text>
							</clause><clause commented="no" id="H20B08AC73CCF40DA970DFA0A1B4CED92"><enum>(ii)</enum><header>Auditing</header>
 <subclause commented="no" id="H1C59314A5EE943A0815028EC50D95B9C"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">For the purpose of section 3515(c) of title 31, United States Code, the Fund shall be considered a component of a covered executive agency.</text>
 </subclause><subclause commented="no" id="H7A500EF741FC428795F9462427AF5DD5"><enum>(II)</enum><header>Components of audit</header><text display-inline="yes-display-inline">The annual audit required in accordance with sections 3515 and 3521 of title 31, United States Code, of the financial statements of activities carried out using amounts from the Fund shall include an analysis of—</text>
 <item commented="no" id="H318FC8DD06D04BD28D09819D2A5D5383"><enum>(aa)</enum><text>the fees collected and amounts disbursed under this subsection;</text> </item><item commented="no" id="HF854DCEAF4364E5DAADFB72F157CC2CE"><enum>(bb)</enum><text>the reasonableness of the fees in place as of the date of the audit to meet current and projected costs of administering the provisions of the title for which the fees are collected; and</text>
 </item><item commented="no" id="HB017C29491C245738C8CFF5E7F5AEB67"><enum>(cc)</enum><text>the number of requests for a risk evaluation made by manufacturers under section 6(b)(3)(A)(ii).</text> </item></subclause><subclause commented="no" id="HA1B69F58525F4048A3C5317F2F6C1AC2"><enum>(III)</enum><header>Federal responsibility</header><text display-inline="yes-display-inline">The Inspector General of the Environmental Protection Agency shall conduct the annual audit described in subclause (II) and submit to the Administrator a report that describes the findings and any recommendations of the Inspector General resulting from the audit.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H3D6D7AC0F26E4C5CB58EE242FE1E5F2A"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="H5E8094847C294241A942F65BD78BE2AE" style="OLC"> <subsection id="HA7C43B4446094AB784E747C9DD8B14EF"><enum>(h)</enum><header>Scientific standards</header><text>In carrying out sections 4, 5, and 6, to the extent that the Administrator makes a decision based on science, the Administrator shall consider, as applicable—</text>
 <paragraph id="HB2E88E665C9248EFBDAFDE3931975A92"><enum>(1)</enum><text>the extent to which the scientific and technical procedures, measures, methods, or models employed to generate the information are reasonable for and consistent with the use of the information;</text>
 </paragraph><paragraph id="H491E60630DDA48EDA3CB0289849B151C"><enum>(2)</enum><text>the extent to which the information is relevant for the Administrator’s use in making a decision about a chemical substance or mixture;</text>
 </paragraph><paragraph id="H9F01F56DD7E7463CB1DA29EDBA3E91CC"><enum>(3)</enum><text>the degree of clarity and completeness with which the data, assumptions, methods, quality assurance, and analyses employed to generate the information are documented;</text>
 </paragraph><paragraph id="H63093D2DAD7648CA917CD4661317A3B2"><enum>(4)</enum><text>the extent to which the variability and uncertainty in the information, or in the procedures, measures, methods, or models, are evaluated and characterized; and</text>
 </paragraph><paragraph id="H9DEC6927FE44417F9ADF6059805D5322"><enum>(5)</enum><text>the extent of independent verification or peer review of the information or of the procedures, measures, methods, or models.</text>
 </paragraph></subsection><subsection commented="no" id="H1B733FDD2A554CA49AF319A23764DC48"><enum>(i)</enum><header>Weight of scientific evidence</header><text>The Administrator shall make decisions under sections 4, 5, and 6 based on the weight of the scientific evidence.</text>
 </subsection><subsection commented="no" id="H0F2E6000B3C24489877F2C4CABEC4328"><enum>(j)</enum><header>Availability of information</header><text>Subject to section 14, the Administrator shall make available to the public all notices, determinations, findings, rules, and orders of the Administrator under this title.</text>
					</subsection><subsection id="H25BC3CDBB1B34DDF95B7812F84046FD5"><enum>(k)</enum><header>Policies, procedures, and guidance</header>
 <paragraph id="H78ED25548F444C73877E9EC8F92C7158"><enum>(1)</enum><header>Development</header><text>Not later than 2 years after the date of enactment of the <short-title>TSCA Modernization Act of 2015</short-title>, the Administrator shall develop any policies, procedures, and guidance the Administrator determines are necessary to carry out the amendments to this Act made by the <short-title>TSCA Modernization Act of 2015</short-title>.</text>
 </paragraph><paragraph id="H8D744609C8E2427681653DD7C190C01F"><enum>(2)</enum><header>Review</header><text>Not later than 5 years after the date of enactment of the <short-title>TSCA Modernization Act of 2015</short-title>, and not less frequently than once every 5 years thereafter, the Administrator shall—</text> <subparagraph id="H20E9F588B7884ACB936ADAB4D1ECA888"><enum>(A)</enum><text>review the adequacy of the policies, procedures, and guidance developed under paragraph (1), including with respect to animal, nonanimal, and epidemiological test methods and procedures for assessing and determining risk under this title; and</text>
 </subparagraph><subparagraph id="HED388BE36A3C471C8643026623BAFF68"><enum>(B)</enum><text>revise such policies, procedures, and guidance as the Administrator determines necessary to reflect new scientific developments or understandings.</text>
							</subparagraph></paragraph></subsection><subsection id="H330508B0E84C4E7DACF8C0DE1760C8F1"><enum>(l)</enum><header>Report to Congress</header>
 <paragraph id="H62546143A1E34EA4874D06A3B03C2EBE"><enum>(1)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of the <short-title>TSCA Modernization Act of 2015</short-title>, the Administrator shall submit to the Committees on Energy and Commerce and Appropriations of the House of Representatives and the Committees on Environment and Public Works and Appropriations of the Senate a report containing an estimation of—</text>
 <subparagraph id="HBB65EA3D47FF4B44A1B06B56D4039008"><enum>(A)</enum><text display-inline="yes-display-inline">the capacity of the Environmental Protection Agency to conduct and publish risk evaluations under subparagraphs (A)(i) and (B) of section 6(b)(3), and the resources necessary to initiate the minimum number of risk evaluations required under section 6(b)(7);</text>
 </subparagraph><subparagraph id="HC2E7B29D5714443A832A2BD169BA0ABA"><enum>(B)</enum><text display-inline="yes-display-inline">the capacity of the Environmental Protection Agency to conduct and publish risk evaluations under section 6(b)(3)(A)(ii), the likely demand for such risk evaluations, and the anticipated schedule for accommodating that demand;</text>
 </subparagraph><subparagraph id="HBA75962A3753402DB3CB667537BC150C"><enum>(C)</enum><text display-inline="yes-display-inline">the capacity of the Environmental Protection Agency to promulgate rules under section 6(a) as required based on risk evaluations conducted and published under section 6(b); and</text>
 </subparagraph><subparagraph id="HAD4B63FE50DC409298FCC62161F902CC"><enum>(D)</enum><text display-inline="yes-display-inline">the actual and anticipated efforts of the Environmental Protection Agency to increase the Agency’s capacity to conduct and publish risk evaluations under section 6(b).</text>
 </subparagraph></paragraph><paragraph id="H095513F730A44915B152B640D893F42D"><enum>(2)</enum><header>Subsequent reports</header><text display-inline="yes-display-inline">The Administrator shall update and resubmit the report described in paragraph (1) not less frequently than once every 5 years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H1C87B904817C4DD390499839F3AF0170"><enum>9.</enum><header>Conforming amendments</header>
 <subsection commented="no" id="H0746262DE2634B2AB70F4AE3E139DEE1"><enum>(a)</enum><header>Section 4</header><text display-inline="yes-display-inline">Section 4 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2603">15 U.S.C. 2603</external-xref>) is amended—</text> <paragraph commented="no" id="H06B7B3E0ABEB48C6B25EB90F559DC209"><enum>(1)</enum><text>in subsection (b)—</text>
