		<section id="H8748EB5B825549C7B51E28E2BBC3B1CE" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Affordable Coverage for Employees Act</short-title></quote>.</text> </section><section id="H8E12EA917FD447B48D96406163337AA3"><enum>2.</enum><header>Revision of definition of small employer under health insurance market provisions</header> <subsection id="HEE7E4CB806D6445A82B2577AA67BBD9D"><enum>(a)</enum><header>PPACA amendments</header><text display-inline="yes-display-inline">Section 1304(b) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18024">42 U.S.C. 18024(b)</external-xref>) is amended—</text>
 <paragraph id="HB54CDD48CCB746C49F972530F37C946D"><enum>(1)</enum><text>in paragraph (1), by striking <quote>101</quote> and inserting <quote>51</quote>;</text> </paragraph><paragraph id="HA87D31510947474DBB294467C8A1591E"><enum>(2)</enum><text>in paragraph (2), by striking <quote>100</quote> and inserting <quote>50</quote>; and</text>
 </paragraph><paragraph id="H0BC2764961184D6A84F73280CA2A0AD0"><enum>(3)</enum><text>by amending paragraph (3) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H0CDBF4B41C36450BAE34DA7605B47725" style="OLC"> <paragraph id="H3E466F1947DA4BA6911CB9A77746BE0F"><enum>(3)</enum><header>State option to extend definition of small employer</header><text display-inline="yes-display-inline">Notwithstanding paragraphs (1) and (2), <italic></italic>nothing in this section shall prevent a State from applying this subsection by treating as a small employer, with respect to a calendar year and a plan year, an employer who employed an average of at least 1 but not more than 100 employees on business days during the preceding calendar year and who employs at least 1 employee on the first day of the plan year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HC9BD39FB158247DDB3F7D9F58675827E"><enum>(b)</enum><header>PHSA amendments</header><text display-inline="yes-display-inline">Section 2791(e) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-91">42 U.S.C. 300gg–91(e)</external-xref>) is amended—</text> <paragraph id="H737D5B3E3F38425EB47AF8512947DB37"><enum>(1)</enum><text>in paragraph (2), by striking <quote>101</quote> and inserting <quote>51</quote>;</text>
 </paragraph><paragraph id="H81917E65DB0047A5BE21D12507B30399"><enum>(2)</enum><text>in paragraph (4), by striking <quote>100</quote> and inserting <quote>50</quote>; and</text> </paragraph><paragraph id="HB21467384EDD45A085A4ED79620C40A7"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

 <paragraph id="HA37FFDE7681946BE963C044D4CF1B64A"><enum>(7)</enum><header>State option to extend definition of small employer</header><text display-inline="yes-display-inline">Notwithstanding paragraphs (2) and (4), <italic></italic>nothing in this section shall prevent a State from applying this subsection by treating as a small employer, with respect to a calendar year and a plan year, an employer who employed an average of at least 1 but not more than 100 employees on business days during the preceding calendar year and who employs at least 1 employee on the first day of the plan year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HBE5EA2836DDD4D779C7509D9873F2DFC"><enum>(c)</enum><header>Deposit of savings into Medicare Improvement Fund</header><text>Section 1898(b)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395iii">42 U.S.C. 1395iii(b)(1)</external-xref>) is amended by striking <quote>$0</quote> and inserting <quote>$205,000,000</quote>.</text> </subsection></section></legis-body> <attestation><attestation-group><attestation-date chamber="House" date="20150928">Passed the House of Representatives September 28, 2015.</attestation-date><attestor display="yes">Karen L.
