<section id="H7A92D45F8DE944BBA8041D5AC73CA50D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Affordable Coverage for Employees Act</short-title></quote>. </text></section> <section id="H49A2E57A275146FD8F7E4F8C68E7F6FE"><enum>2.</enum><header>Revision of definition of small employer under health insurance market provisions</header> <subsection id="HF18410F0C29D4E31A8BD193E0FD7B0A7"><enum>(a)</enum><header>PPACA amendments</header><text display-inline="yes-display-inline">Section 1304(b) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18024">42 U.S.C. 18024(b)</external-xref>) is amended—</text> 
<paragraph id="H192A12C5A4114FC9B3D4ABC99FEC9832"><enum>(1)</enum><text>in paragraph (1), by striking <quote>101</quote> and inserting <quote>51</quote>;</text></paragraph> <paragraph id="H5FA8841BB49C42EC93AE9B804D82322A"><enum>(2)</enum><text>in paragraph (2), by striking <quote>100</quote> and inserting <quote>50</quote>; and</text></paragraph> 
<paragraph id="HDC365CB8C6844D1385BE4D53266635FB"><enum>(3)</enum><text>by amending paragraph (3) to read as follows:</text> <quoted-block style="OLC" id="H18BD39C8CB8D4891AC823CB07D8E8485" display-inline="no-display-inline"> <paragraph id="HCB319E4613BC4FD683B8ABF01D476391"><enum>(3)</enum><header>State option to extend definition of small employer</header><text display-inline="yes-display-inline">Notwithstanding paragraphs (1) and (2), <italic></italic>nothing in this section shall prevent a State from applying this subsection by treating as a small employer, with respect to a calendar year and a plan year, an employer who employed an average of at least 1 but not more than 100 employees on business days during the preceding calendar year and who employs at least 1 employee on the first day of the plan year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H0B9A807EFD08460EBF42BBB3A1E1C67D"><enum>(b)</enum><header>PHSA amendments</header><text display-inline="yes-display-inline">Section 2791(e) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-91">42 U.S.C. 300gg–91(e)</external-xref>) is amended—</text> <paragraph id="H5E75197C90E24C3EA54898627534719D"><enum>(1)</enum><text>in paragraph (2), by striking <quote>101</quote> and inserting <quote>51</quote>; </text></paragraph> 
<paragraph id="H9190C207EF034C0CBFF3D7EEDC3E1243"><enum>(2)</enum><text>in paragraph (4), by striking <quote>100</quote> and inserting <quote>50</quote>; and</text></paragraph> <paragraph id="HFCF20B0E3BCB4E609AA259CB455DEFD4"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H799BF21AF24A4DC4BB4B121E2AE39261"><enum>(7)</enum><header>State option to extend definition of small employer</header><text display-inline="yes-display-inline">Notwithstanding paragraphs (2) and (4), <italic></italic>nothing in this section shall prevent a State from applying this subsection by treating as a small employer, with respect to a calendar year and a plan year, an employer who employed an average of at least 1 but not more than 100 employees on business days during the preceding calendar year and who employs at least 1 employee on the first day of the plan year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section> </legis-body> </bill>
