		<legis-type>A BILL</legis-type>
		<official-title>To amend the Federal Food, Drug, and Cosmetic Act to
		  require that genetically engineered food and foods that contain genetically
		  engineered ingredients be labeled accordingly.</official-title>
	</form>
	<legis-body>
		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Genetically Engineered Food
			 Right-to-Know Act</short-title></quote>.</text>
		</section><section id="iddc19aa21dfc0481fbe57c6343c794428"><enum>2.</enum><header>Purpose and
			 findings</header>
			<subsection id="id4a76d307e7584a94a189ad36592918fe"><enum>(a)</enum><header>Purpose</header><text>The
			 purpose of this Act is to establish a consistent and enforceable standard for
			 labeling of foods produced using genetic engineering, including fish, thereby
			 providing consumers with knowledge of how their food is produced.</text>
			</subsection><subsection id="iddfba094def4e4d35a8370f40226a9ca1"><enum>(b)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="idf00eeec4b92d4b02b251fca3f0b9ab0e"><enum>(1)</enum><text>the process of
			 genetically engineering food organisms results in material changes to food
			 derived from those organisms;</text>
				</paragraph><paragraph id="id63069b1a754f437783a15c0af601c08a"><enum>(2)</enum><text>the Food and Drug
			 Administration requires the labeling of more than 3,000 ingredients, additives,
			 and processes;</text>
				</paragraph><paragraph id="idf2f775d229f84fb5a8a8e15ab8b0fdbd"><enum>(3)</enum><text>individuals in
			 the United States have a right to know if their food was produced with genetic
			 engineering for a variety of reasons, including health, economic,
			 environmental, religious, and ethical;</text>
				</paragraph><paragraph id="id02ef1c9c84cc4fda94349352f89d6710"><enum>(4)</enum><text>more than 60
			 countries, including the United Kingdom and all other countries of the European
			 Union, South Korea, Japan, Brazil, Australia, India, China, and other key
			 United States trading partners have laws or regulations mandating disclosure of
			 genetically engineered food on food labels;</text>
				</paragraph><paragraph id="id86c4083c9e034eb5bf78412aadb2ff88"><enum>(5)</enum><text>in 2011, Codex
			 Alimentarius, the food standards organization of the United Nations, adopted a
			 text that indicates that governments can decide on whether and how to label
			 foods produced with genetic engineering; and</text>
				</paragraph><paragraph id="id2383e1fa003b4741ab6fdabcb3b0f9f5"><enum>(6)</enum><text>mandatory
			 identification of food produced with genetic engineering can be a critical
			 method of preserving the economic value of exports or domestically sensitive
			 markets with labeling requirements for genetically engineered foods.</text>
				</paragraph></subsection></section><section id="id45cf82019a33404aa35a1c6d107c6ba8"><enum>3.</enum><header>Amendments to
			 the Federal Food, Drug, and Cosmetic Act</header>
			<subsection id="idef99fc8cf5f844d48dc4fb4fa11ec6e6"><enum>(a)</enum><header>In
			 general</header><text>Section 403 of the Federal Food, Drug, and Cosmetic Act
			 (21 U.S.C.
			 343) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idacd38e0c21014256b99d854e1b17c4d6" style="OLC">
					<subsection id="id302ce43665434d928ae7a5295f182570"><enum>(z)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id2FCD09CC345B4338A31FB4E458F85147"><enum>(1)</enum><text>If it is a food that
				has been genetically engineered or contains 1 or more genetically engineered
				ingredients, unless such information is clearly disclosed, as determined by the
				Secretary.</text>
						</paragraph><paragraph id="idE1261615F9064B8D860EDA67150E6F79" indent="up1"><enum>(2)</enum><text>This paragraph does not apply to food
				that—</text>
							<subparagraph id="id89a54f298dea4c0b86c5698f2c80a066"><enum>(A)</enum><text>is served in restaurants or other
				similar eating establishments, such as cafeterias and carryouts;</text>
							</subparagraph><subparagraph id="id7b890d49c7814f789f2893391361b7d1"><enum>(B)</enum><text>is a medical food (as defined in
				section 5(b) of the Orphan Drug Act);</text>
							</subparagraph><subparagraph id="id69929ef4210e4877b971c22c409cb264"><enum>(C)</enum><text>is a food that would be subject to
				this paragraph solely because it was produced using a genetically engineered
				vaccine; or</text>
							</subparagraph><subparagraph id="id2ebac52b54c742e290ceaef5a95a5e7d"><enum>(D)</enum><text>is a food or processed food that would
				be subject to this paragraph solely because it includes the use of a
				genetically engineered processing aid (including yeast) or enzyme.</text>
							</subparagraph></paragraph><paragraph id="idbb062d418af74943b4873930226a5339" indent="up1"><enum>(3)</enum><text>In this paragraph:</text>
							<subparagraph id="id2f4db71eb66c4aaeb657e17e685787c1"><enum>(A)</enum><text>The term <term>genetic
				engineering</term> means a process involving the application of—</text>
								<clause id="id3be4c69fcd5647c1adffe4ddc840d0a2"><enum>(i)</enum><text>in vitro nucleic acid techniques,
				including recombinant deoxyribonucleic acid (DNA) and direct injection of
				nucleic acid into cells or organelles; or</text>
								</clause><clause id="idd0a983300fd24150b49d8486cad50d18"><enum>(ii)</enum><text>fusion of cells beyond the
				taxonomic family that—</text>
									<subclause id="idaf190b32905b4696bfd3cb69727de933"><enum>(I)</enum><text>overcome natural physiological
				reproductive or recombinant barriers; and</text>
									</subclause><subclause id="idcff0d3183a86486b8a4b432922599be1"><enum>(II)</enum><text>are not techniques used in traditional
				breeding and selection.</text>
									</subclause></clause></subparagraph><subparagraph id="id806b7b5fa9554f18bfeb8ddbcc33cea2"><enum>(B)</enum><text>The term <term>genetically
				engineered</term>, used with respect to a food, means a material intended for
				human consumption that is—</text>
								<clause id="id7b3b67ae2cd14cbb8f2a8839759ec5b1"><enum>(i)</enum><text>an organism that is produced
				through the intentional use of genetic engineering; or</text>
								</clause><clause id="idf37fed24aac1404bb80631ab75e42e5f"><enum>(ii)</enum><text>the progeny of intended sexual or
				asexual reproduction (or both) of 1 or more organisms that is the product of
				genetic engineering.</text>
								</clause></subparagraph><subparagraph id="id2a59a34b9ea749048fb6395d309f3d89"><enum>(C)</enum><text>The term <term>genetically engineered
				ingredient</term> means a material that is an ingredient in a food that is
				derived from any part of an organism that has been genetically engineered,
				without regard to whether—</text>
								<clause id="idfbf15213c59d4769bf645d0c37da7294"><enum>(i)</enum><text>the altered molecular or cellular
				characteristics of the organism are detectable in the material; and</text>
								</clause><clause id="id741001385478404b8eec6dde130a84d4"><enum>(ii)</enum><text>the organism is capable for use as
				human
				food.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idbdcc20c8a66b42698f7a6347b272b936"><enum>(b)</enum><header>Guaranty</header>
				<paragraph id="id350b7e1d584c46b989263b355199443c"><enum>(1)</enum><header>In
			 general</header><text>Section 303(d) of the Federal Food, Drug, and Cosmetic
			 Act (21 U.S.C.
			 333(d)) is amended—</text>
					<subparagraph id="id500fc6e405284fed947f75f23ce95f66"><enum>(A)</enum><text>by striking
			 <quote>(d)</quote> and inserting <quote>(d)(1)</quote>; and</text>
					</subparagraph><subparagraph id="iddea1f5fe4e4d425caf58aa1c92089f92"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id2f82ab1ca6a94281a9a6ed45d1d17896" style="OLC">
							<paragraph id="ideff473bfa3094f8ea0e192ba3b1d8417"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id7C05103CD23A4B99BC4361EDC8A30B97"><enum>(A)</enum><text>No person shall be
				subject to the penalties of subsection (a)(1) for a violation of subsection
				(a), (b), or (c) of section 301 involving food that is misbranded within the
				meaning of section 403(z) if such person (referred to in this paragraph as the
				<quote>recipient</quote>) establishes a guaranty or undertaking that—</text>
									<clause id="id5d11bca916ea49d7ad7282f0e034630e" indent="up1"><enum>(i)</enum><text>is signed by, and contains the name
				and address of, a person residing in the United States from whom the recipient
				received in good faith the food (including the receipt of seeds to grow raw
				agricultural commodities); and</text>
									</clause><clause id="id4f23514a540e4e2e947e37547ad908a8" indent="up1"><enum>(ii)</enum><text>contains a statement to the effect
				that the food is not genetically engineered or does not contain a genetically
				engineered ingredient.</text>
									</clause></subparagraph><subparagraph id="idbcb17bbc45e74a63a750d258bf1f9842" indent="up1"><enum>(B)</enum><text>In the case of a recipient who, with
				respect to a food, establishes a guaranty or undertaking in accordance with
				subparagraph (A), the exclusion under such subparagraph from being subject to
				penalties applies to the recipient without regard to the manner in which the
				recipient uses the food, including whether the recipient is—</text>
									<clause id="idc1f9c355ad52417289e2177baf7b6218"><enum>(i)</enum><text>processing the food;</text>
									</clause><clause id="ida701c34b0605443cbf050bc87c2c0828"><enum>(ii)</enum><text>using the food as an ingredient in
				a food product;</text>
									</clause><clause id="ida208a2f50fe340dcab9f2abeb5f93cba"><enum>(iii)</enum><text>repacking the food; or</text>
									</clause><clause id="id9efa2def0356435b90d1de3cfc4a93ab"><enum>(iv)</enum><text>growing, raising, or otherwise
				producing the food.</text>
									</clause></subparagraph><subparagraph id="id76bd48335e2f411a9fc632a59bf10fc7" indent="up1"><enum>(C)</enum><text>No person may avoid responsibility or
				liability for a violation of subsection (a), (b), or (c) of section 301
				involving food that is misbranded within the meaning of section 403(z) by
				entering into a contract or other agreement that specifies that another person
				shall bear such responsibility or liability, except that a recipient may
				require a guaranty or undertaking as described in this subsection.</text>
								</subparagraph><subparagraph id="idd57a5c462e9b4ae0a66e07a4b8ecc788" indent="up1"><enum>(D)</enum><text>In this subsection, the terms
				<quote>genetically engineered</quote> and <quote>genetically engineered
				ingredient</quote> have the meanings given the terms in section
				403(z).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="id9f2e4b28d3e042fda9744f3a387506b1"><enum>(2)</enum><header>False
			 guaranty</header><text>Section 301(h) of the Federal Food, Drug, and Cosmetic
			 Act (21 U.S.C.
			 331(h)) is amended by inserting <quote>or 303(d)(2)</quote>
			 after <quote>section 303(c)(2)</quote>.</text>
				</paragraph></subsection><subsection id="ideaff6fd853d24adfa295f242d1167f62"><enum>(c)</enum><header>Unintended
			 contamination</header><text>Section 303(d) of the Federal Food, Drug, and
			 Cosmetic Act (21
			 U.S.C. 333(d)), as amended by subsection (b), is further
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idfa133e685de44b5ba8546bc03ad903b5" style="OLC">
					<paragraph id="ida76d576758d94b4f87a53e7a582684bf"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idBC1A93338F4A44BDA2CF9D2D612738B7"><enum>(A)</enum><text>No person shall be
				subject to the penalties of subsection (a)(1) for a violation of subsection
				(a), (b), or (c) of section 301 involving food that is misbranded within the
				meaning of section 403(z) if—</text>
							<clause id="id6aee535b3ced484bad53687149db2eac" indent="up1"><enum>(i)</enum><text>such person is an agricultural
				producer and the violation occurs because food that is grown, raised, or
				otherwise produced by such producer, which food does not contain a genetically
				engineered material and was not produced with a genetically engineered
				material, is contaminated with a food that contains a genetically engineered
				material or was produced with a genetically engineered material; and</text>
							</clause><clause id="id14dc3e696e2d4459a1b40d66e47ed490" indent="up1"><enum>(ii)</enum><text>such contamination is not intended
				by the agricultural producer.</text>
							</clause></subparagraph><subparagraph id="id7352fe69a3a341458a88cbe6b1feaf42" indent="up1"><enum>(B)</enum><text>Subparagraph (A) does not apply to an
				agricultural producer to the extent that the contamination occurs as a result
				of the negligence of the
				producer.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id2eee60bb30984d0d81357335e095e2bb"><enum>(d)</enum><header>Promulgation of
			 regulations</header><text>Not later than 1 year after the date of enactment of
			 this Act, the Secretary shall promulgate proposed regulations establishing
			 labeling requirements for compliance in accordance with section 403(z) of the
			 Federal Food, Drug, and Cosmetic Act, as added by subsection (a).</text>
			</subsection></section></legis-body>
