		<official-title>To reauthorize and improve programs related to mental
		  health and substance use disorders.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Mental Health Awareness and
			 Improvement Act of 2013</short-title></quote>.</text>
		</section><title id="id907DFE6011D749779B20620B2219B6CC"><enum>I</enum><header>Education
			 programs</header>
			<section id="id985CCB7280594442876616D2E3AAC50B"><enum>101.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Achievement Through Prevention
			 Act</short-title></quote>.</text>
			</section><section id="id33276B0525254B5F9F9B9DF510D94698"><enum>102.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this title is to expand the
			 use of positive behavioral interventions and supports and early intervening
			 services in schools in order to improve student academic achievement, reduce
			 overidentification of individuals with disabilities, and reduce disciplinary
			 problems in schools.</text>
			</section><section id="idEA4962439EFD4A18A1AC419326FD41CA"><enum>103.</enum><header>Amendments to
			 the Elementary and Secondary Education Act of 1965</header>
				<subsection id="ID51ad8f4040d640919cd8fd029b85e2d1"><enum>(a)</enum><header>Title I State
			 plans</header><text>Section 1111(b) of the Elementary and Secondary Education
			 Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)</external-xref>) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idAD83CF458D914E658A0E0C3485A2FF66" style="OLC">
						<paragraph id="ID2a352155529d4c33a105aa579c5a2296"><enum>(11)</enum><header>Positive
				behavioral interventions and supports</header><text>In the case of a State that
				proposes to use funds under this part to support positive behavioral
				interventions and supports, the State plan shall describe how the State
				educational agency will—</text>
							<subparagraph id="IDfacf70debf4843598def393fbc195e42"><enum>(A)</enum><text>assist local
				educational agencies in implementing positive behavioral interventions and
				supports in schools served by the local educational agency on a whole-school
				basis;</text>
							</subparagraph><subparagraph id="IDadeb951dd1654e62b6a54b69cc99b9a1"><enum>(B)</enum><text>provide technical
				assistance and training to local educational agencies to improve and support
				the development, implementation, and coordination of comprehensive positive
				behavioral interventions and supports carried out under this Act with
				activities carried out under the Individuals with Disabilities Education Act;
				and</text>
							</subparagraph><subparagraph id="ID9ac33f0842a9430bbfe7bbd99b2c1c8b"><enum>(C)</enum><text>evaluate the
				effects of providing positive behavioral interventions and supports for all
				students, including improvement of the learning environment, academic
				achievement, disciplinary problems such as incidents of suspensions,
				expulsions, referrals to law enforcement, and other actions that remove
				students from instruction, and any other effects the State chooses to
				evaluate.</text>
							</subparagraph></paragraph><paragraph id="IDf5d10031d6164be6b2ce0a266b913c4a"><enum>(12)</enum><header>Early
				intervening services</header><text>In the case of a State that proposes to use
				funds under this part to support early intervening services, the State plan
				shall describe how the State educational agency will—</text>
							<subparagraph id="ID371d52b178e148de80fe0cd6c16ad8ed"><enum>(A)</enum><text>assist local
				educational agencies in implementing early intervening services in schools
				served by the local educational agency to reduce the need to label children as
				children with disabilities in order to address the learning and behavioral
				needs of such children;</text>
							</subparagraph><subparagraph id="ID0b83b4750f7c46608f6234307bb1a43b"><enum>(B)</enum><text>provide technical
				assistance and training to local educational agencies to improve coordination
				of early intervening services provided under this Act with early intervening
				services carried out under the Individuals with Disabilities Education Act;
				and</text>
							</subparagraph><subparagraph id="ID6f0365a784114d7c984257d06e588a91"><enum>(C)</enum><text>evaluate the
				effects of providing early intervening services.</text>
							</subparagraph></paragraph><paragraph id="id7d45873d5852437aa4ebd464b3b5337f"><enum>(13)</enum><header>Crisis
				management plans</header><text>In the case of a State that proposes to use
				funds under this part to assist local educational agencies in the State in
				periodically updating the crisis management plans, as described in section
				4114(d)(7)(D), of such local educational agencies, the State plan shall
				describe how the State educational agency will assist local educational
				agencies in updating such crisis management
				plans.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id98857DC24F6641B8B7E693B1CE4C65FA"><enum>(b)</enum><header>Title I State
			 reports</header><text>Section 1111(h)(1)(C) of the Elementary and Secondary
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(h)(1)(C)</external-xref>) is amended—</text>
					<paragraph id="id79E9BB7907844A1A89D932D862F279E5"><enum>(1)</enum><text>in clause (vii),
			 by striking <quote>and</quote> after the semicolon;</text>
					</paragraph><paragraph id="id2729903F90814FFC853E402A1093FDBB"><enum>(2)</enum><text>in clause (viii),
			 by striking the period and inserting a semicolon; and</text>
					</paragraph><paragraph id="idC7C2BA18AC0B476388EBD8A8AEF9F2D1"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idBE1AD48C440445D48F29369B95ACFD0D" style="OLC">
							<clause id="IDd575ad2235be4220a5d57fb7e1b68dc4"><enum>(ix)</enum><text>the number of
				local educational agencies in the State that implement positive behavioral
				interventions and supports;</text>
							</clause><clause id="ID593d5ccf4fcc4c78b56f61efe5b498dc"><enum>(x)</enum><text>the number of
				students—</text>
								<subclause id="ID06855f0761cc4888b11818f46a23c776"><enum>(I)</enum><text>who are served
				through the use of early intervening services; and</text>
								</subclause><subclause id="IDad9d1261f7574ed681e6f1875b551f4e"><enum>(II)</enum><text>who, in the
				preceding 2-year period, received early intervening services and who, after
				receiving such services, have been identified as eligible for, and receive,
				special education and related services under part B of the Individuals with
				Disabilities Education Act; and</text>
								</subclause></clause><clause id="ide30082bdbf2b4e5298aedfef6a8609df"><enum>(xi)</enum><text>the number of
				local educational agencies in the State that implement school-based mental
				health
				programs.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="ID11b5c520665f476eb7cdd898d7f6c523"><enum>(c)</enum><header>Title I local
			 educational agency plans</header><text>Section 1112(b)(1) of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6312">20 U.S.C. 6312(b)(1)</external-xref>) is amended—</text>
					<paragraph id="id6D6F929B9C0B43D9B1AFBBEE0220ACDE"><enum>(1)</enum><text>in subparagraph
			 (P), by striking <quote>and</quote> after the semicolon;</text>
					</paragraph><paragraph id="id9DBC29D4FAFB4DB59AB42BEE1F278AD4"><enum>(2)</enum><text>in subparagraph
			 (Q), by striking the period and inserting a semicolon; and</text>
					</paragraph><paragraph id="id0A8AA756B8A9414CA0AE2278D1FFC4AB"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idF55708FBC3E2402DA5AD8123A07E44D9" style="OLC">
							<subparagraph id="ID5404625650294194818cffbb04f85456"><enum>(R)</enum><text>if the local
				educational agency proposes to use subgrant funds under this part for positive
				behavioral interventions and supports, a description of the actions the local
				educational agency will take to provide positive behavioral interventions and
				supports and coordinate those activities with activities carried out under the
				Individuals with Disabilities Education Act;</text>
							</subparagraph><subparagraph id="ID99f3b46fdff04c2ba300fb4630c72402"><enum>(S)</enum><text>if the local
				educational agency proposes to use subgrant funds under this part for early
				intervening services, a description of the actions the local educational agency
				will take to provide early intervening services and coordinate those services
				with early intervening services carried out under the Individuals with
				Disabilities Education Act;</text>
							</subparagraph><subparagraph id="id9b8a10a52321473ba4ecd959a0daf877"><enum>(T)</enum><text>if the local
				educational agency proposes to use subgrant funds under this part for
				school-based mental health programs, a description of the actions the local
				educational agency will take to provide school-based mental health programs and
				coordinate those activities with activities carried out under the Individuals
				with Disabilities Education Act; and</text>
							</subparagraph><subparagraph id="id6afafce3a615492d808b23798af024ef"><enum>(U)</enum><text>if the local
				educational agency proposes to use subgrant funds under this part for
				periodically updating the crisis management plan of the local educational
				agency, as described in section 4114(d)(7)(D), a description of the actions the
				local educational agency will take to develop and implement an updated crisis
				management
				plan.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="ID9c0cf53f36404884bd0305a74cc2908b"><enum>(d)</enum><header>Title I
			 schoolwide programs</header>
					<paragraph id="idAFF7B183351C49729C746FF89C24B09B"><enum>(1)</enum><header>Schoolwide
			 programs</header><text>Section 1114(b)(1)(B)(iii)(I) of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6314">20 U.S.C. 6314(b)(1)(B)(iii)(I)</external-xref>) is
			 amended—</text>
						<subparagraph id="id35066d17ef384c39b521340f3a8b6ab9"><enum>(A)</enum><text>in item (aa), by
			 inserting <quote>and school-based mental health programs</quote> after
			 <quote>services</quote>;</text>
						</subparagraph><subparagraph id="id6ED44177FFF4439B922625B7FDA5196B"><enum>(B)</enum><text>by redesignating
			 items (bb) and (cc) as items (dd) and (ee), respectively; and</text>
						</subparagraph><subparagraph id="ID7308695756cf4b3fb17a0e6c755f1d74"><enum>(C)</enum><text>by inserting
			 after item (aa) the following:</text>
							<quoted-block display-inline="no-display-inline" id="idCCC8DFB5715F4E85AA5B612D940D09BD" style="OLC">
								<item id="IDdcccfea8db084db1b6b65ce7d95927b0" indent="up1"><enum>(bb)</enum><text>implementation of schoolwide positive
				behavioral interventions and supports, including through coordination with
				activities carried out under the Individuals with Disabilities Education Act,
				in order to improve academic outcomes for students and reduce the need for
				suspensions, expulsions, and other actions that remove students from
				instruction;</text>
								</item><item id="IDae2007283d2740219ccd1bb0bb0d7e3b" indent="up1"><enum>(cc)</enum><text>implementation of early intervening
				services, including through coordination with early intervening services
				carried out under the Individuals with Disabilities Education
				Act;</text>
								</item><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="ID676664b0ca8747659f7b6f32f2f64cb4"><enum>(2)</enum><header>Technical
			 assistance</header><text>Section 1116(b)(4)(B) of the Elementary and Secondary
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316(b)(4)(B)</external-xref>) is amended—</text>
						<subparagraph id="ID1d86ff81dbf84367962239665df54f51"><enum>(A)</enum><text>by redesignating
			 clauses (iii) and (iv) as clauses (iv) and (v), respectively; and</text>
						</subparagraph><subparagraph id="ID77304c6ed8a04e38a725c03b29eb618f"><enum>(B)</enum><text>by inserting
			 after clause (ii) the following:</text>
							<quoted-block display-inline="no-display-inline" id="id6C73078DC9C44C98B2DD0F86D0D96D83" style="OLC">
								<clause id="IDd157f397ee264d38b65bfcea1f7ad1cb"><enum>(iii)</enum><text>shall include
				assistance in the implementation of schoolwide positive behavior supports,
				school-based mental health programs, and other approaches with evidence of
				effectiveness for improving the learning environment in the school and reducing
				the need for suspensions, expulsions, and other actions that remove students
				from instruction, including effective strategies for improving coordination of
				community
				resources;</text>
								</clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="ID454a81147764404a960ddfe0a8e89e31"><enum>(e)</enum><header>Title I
			 assessments and school improvement</header>
					<paragraph id="ID680afd9bf15648af850a4b24b298578e"><enum>(1)</enum><header>School
			 improvement plan</header><text>Section 1116(b)(3)(A) of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316(b)(3)(A)</external-xref>) is amended—</text>
						<subparagraph id="id8DEF90A76B6B4A7FA5F2B84E0F5F74FA"><enum>(A)</enum><text>in clause (ix),
			 by striking <quote>and</quote> after the semicolon;</text>
						</subparagraph><subparagraph id="id05F11A14388A453596F2BA4280FE81B9"><enum>(B)</enum><text>in clause (x), by
			 striking the period and inserting a semicolon; and</text>
						</subparagraph><subparagraph id="id5F58F180A44F40FC8A44F545F3C32627"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idF160041B0EC844F4AC04A14B906195C7" style="OLC">
								<clause id="IDc5431c95c0cd48fea1ed30b8f067f123"><enum>(xi)</enum><text>specify whether
				the local educational agency or the school will adopt and implement policies or
				practices to implement or improve positive behavioral interventions and
				supports and enhance coordination with activities carried out under the
				Individuals with Disabilities Education Act;</text>
								</clause><clause id="ID4d8340d4fb074480a7169b9b3bb7c17f"><enum>(xii)</enum><text>specify whether
				the local educational agency or the school will adopt and implement policies or
				practices to implement or improve early intervening services and coordinate
				with early intervening services carried out under such Act; and</text>
								</clause><clause id="id8bd88dd77d874ac486c58b053a5447b0"><enum>(xiii)</enum><text>specify
				whether the local educational agency or school will adopt and implement
				school-based mental health programs and coordinate with programs carried out
				under such
				Act.</text>
								</clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="IDae46a40324f84d23966b5368001472f7"><enum>(2)</enum><header>Local
			 educational agency improvement plans</header><text>Section 1116(c)(10) of the
			 Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316(c)(10)</external-xref>) is
			 amended—</text>
						<subparagraph id="id539FC170D15D4ECEB6E4923DB6000869"><enum>(A)</enum><text>in subparagraph
			 (B), by striking <quote>subparagraph (E)</quote> and inserting
			 <quote>subparagraph (F)</quote>;</text>
						</subparagraph><subparagraph id="id31050928BAFB43219AE17DD907EFBCE8"><enum>(B)</enum><text>by redesignating
			 subparagraphs (D) through (F) as subparagraphs (E) through (G), respectively;
			 and</text>
						</subparagraph><subparagraph id="idEA463487B79948E794CAF1D161E2756C"><enum>(C)</enum><text>by inserting
			 after subparagraph (C) the following:</text>

								<subparagraph id="id5D517A4748094A79A10C5A88911A5FEE"><enum>(D)</enum><header>Additional
				activities</header><text>In addition to carrying out 1 or more of the
				corrective actions required under subparagraph (C) for a local educational
				agency, the State educational agency may also carry out 1 or more of the
				following activities:</text>
									<clause id="ID46b1010be13943f29f97f04ae2cb17d7"><enum>(i)</enum><text>Improving or
				expanding positive behavioral interventions and supports and enhancing
				coordination with activities under the Individuals with Disabilities Education
				Act.</text>
									</clause><clause id="ID50efc9a103b3436dafd9cf75405e23b6"><enum>(ii)</enum><text>Improving or
				expanding early intervening services and coordinating such services with early
				intervening services carried out under the Individuals with Disabilities
				Education
				Act.</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="IDc0a8e077ae5b4d52b6d266da5941fd6d"><enum>(f)</enum><header>Title I school
			 support and recognition</header>
					<paragraph id="ID1319e6acd75149399ac4e97394d89d15"><enum>(1)</enum><header>Regional
			 centers</header><text>Section 1117(a)(3) of the Elementary and Secondary
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6317">20 U.S.C. 6317(a)(3)</external-xref>) is amended—</text>
						<subparagraph id="idD384C998D0A6473FA7F471AD70B6E391"><enum>(A)</enum><text>by striking
			 <quote>of 2002 and comprehensive</quote> and inserting <quote>of 2002,
			 comprehensive</quote>;</text>
						</subparagraph><subparagraph id="id69E31BE9237942F4BA2BF75BA9B51C6D"><enum>(B)</enum><text>by striking
			 <quote>and the comprehensive</quote> and inserting <quote>, the
			 comprehensive</quote>; and</text>
						</subparagraph><subparagraph id="idA61A89701A2C43C1AC4D96990F228BCA"><enum>(C)</enum><text>by inserting
			 <quote>and any technical assistance center on schoolwide positive behavioral
			 interventions and supports funded under section 665(b) of the Individuals with
			 Disabilities Education Act,</quote> after <quote>2002),</quote>.</text>
						</subparagraph></paragraph><paragraph id="ID065ade12a66e4af48fa6086fbf02ce1c"><enum>(2)</enum><header>Statewide
			 systems for support</header><text>Section 1117(a)(5)(B) of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6317">20 U.S.C. 6317(a)(5)(B)</external-xref>) is amended—</text>
						<subparagraph id="idD8038463DA9D4339BE1F8B1104E1921A"><enum>(A)</enum><text>in clause (i), by
			 striking the semicolon at the end and inserting the following: “, including by
			 improving or expanding the use of positive behavioral interventions and
			 supports aligned with activities carried out under the Individuals with
			 Disabilities Education Act;”;</text>
						</subparagraph><subparagraph id="id5184686E3B884F5FB6F1C8994FED8743"><enum>(B)</enum><text>in clause (iii),
			 by striking <quote>and</quote> after the semicolon;</text>
						</subparagraph><subparagraph id="id68DCFA0CBA874CE58957B0C11E2E4170"><enum>(C)</enum><text>in clause (iv),
			 by striking the period and inserting a semicolon; and</text>
						</subparagraph><subparagraph id="ID2a8eab9342d44eb5b80c0b06fc0bcf6e"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block display-inline="no-display-inline" id="id88BE0BB384CD424FBF80EDB9A971F8CC" style="OLC">
								<clause id="ID54682c06bb914febb2dcc8ddfb31e308"><enum>(v)</enum><text>review and
				analyze the school’s efforts to identify and assist students with poor academic
				achievement and students who are children with disabilities, and assist the
				school in developing or improving early intervening services that are
				coordinated with activities carried out under the Individuals with Disabilities
				Education Act;</text>
								</clause><clause id="ID60e595f958d24354a8a98cf5de53dfda"><enum>(vi)</enum><text>review and
				analyze the school’s efforts to address behavioral or disciplinary problems,
				and assist the school in developing or improving schoolwide positive behavioral
				interventions and supports that are coordinated with activities carried out
				under the Individuals with Disabilities Education Act;</text>
								</clause><clause id="ID091dbbbb04f948ec9007fab55b743ca0"><enum>(vii)</enum><text>review the
				number of discipline incidents in the school and use that information to assist
				the school to implement schoolwide positive behavioral interventions and
				supports or other early intervening services, or both; and</text>
								</clause><clause id="id77fab0646fa54868a28807e51187c48e"><enum>(viii)</enum><text>review and
				analyze the school's efforts to address mental health needs among students and
				assist the school in developing or improving school-based mental health
				programs that are coordinated with activities carried out under the Individuals
				with Disabilities Education
				Act.</text>
								</clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="IDb16f1f12b25c435aa6c46a28a1ce075c"><enum>(g)</enum><header>Title I
			 parental involvement</header><text>Section 1118(e) of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6318">20 U.S.C. 6318(e)</external-xref>) is amended—</text>
					<paragraph id="id6639F68AD78E419995D05D6C46620220"><enum>(1)</enum><text>by redesignating
			 paragraphs (6) through (14) as paragraphs (7) through (15), respectively;
			 and</text>
					</paragraph><paragraph id="id1C5395C20B7E4438848CF0061FC17DEF"><enum>(2)</enum><text>by inserting
			 after paragraph (5) the following:</text>
						<quoted-block display-inline="no-display-inline" id="idEE85CAF60240453193CEBE970DE7B9AD" style="OLC">
							<paragraph id="IDfff2fc4c8f5f4cf487342f0c6f26d620"><enum>(6)</enum><text>shall provide
				information to school personnel, students, and parents about the school’s use
				of positive behavioral interventions and supports, school-based mental health
				programs, and the expectations of school personnel, students, and parents in
				supporting a safe learning environment for all
				students;</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="ID640321a792904cd2a00b2de269c30f7b"><enum>(h)</enum><header>Prevention and
			 intervention programs</header><text>Section 1414(c)(8) of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6434">20 U.S.C. 6434(c)(8)</external-xref>) is amended by inserting
			 “, including coordinating the use of positive behavioral interventions and
			 supports, early intervening services, and school-based mental health programs
			 to improve academic achievement and reduce disciplinary actions” before the
			 semicolon at the end.</text>
				</subsection><subsection id="ID44099f301c53441b9eb39c76d480a02d"><enum>(i)</enum><header>Technical
			 assistance</header><text>Section 1419 of the Elementary and Secondary Education
			 Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6439">20 U.S.C. 6439</external-xref>) is amended—</text>
					<paragraph id="id9C6FC9A0366A4176AC9FE26FC16E2555"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>and</quote> after the semicolon;</text>

			 health professional development</header><text>Section 2123 of the Elementary
			 and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6223">20 U.S.C. 6223</external-xref>) is amended—</text>
					<paragraph id="idE1A1043E2036443B8A861F3DCB47ACFE"><enum>(1)</enum><text>in subsection
			 (a), by inserting after paragraph (8) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id55BA1B274767438ABE2492183B1BC925" style="OLC">
							<paragraph id="id2f4cb0ec485e4a9fa02da801e42f24f0"><enum>(9)</enum><text>Carrying out
				in-service training for school personnel in—</text>
								<subparagraph id="idF1714713201D4524AC33939DE7D0C65C"><enum>(A)</enum><text>the techniques
				and supports needed to identify children with trauma histories, and children
				with, or at risk of, mental illness, early;</text>
								</subparagraph><subparagraph id="id53149F1B74004AD186C9E49A0E182041"><enum>(B)</enum><text>the use of
				referral mechanisms that effectively link such children to appropriate
				treatment and intervention services in the school and in the community where
				appropriate; and</text>
								</subparagraph><subparagraph id="id1E58F2EF662C440592DED95CEBAD5897"><enum>(C)</enum><text>forming
				partnerships between school-based mental health programs and public or private
				mental health organizations.</text>
								</subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id3645BE5637EF47B9849740D5881E0CB4"><enum>(2)</enum><text>by redesignating
			 subsection (b) as subsection (c); and</text>
					</paragraph><paragraph id="idDE626391976544139B0A1DDC5F49CA3D"><enum>(3)</enum><text>by inserting
			 after subsection (a) the following:</text>

			 mental health services partnership programs</header><text display-inline="yes-display-inline">Section 4121 of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7131">20 U.S.C. 7131</external-xref>) is amended—</text>
					<paragraph id="id25AEE6C0ED77458AAB8FB2DA67B98C1D"><enum>(1)</enum><text>in subsection
			 (a)—</text>
						<subparagraph id="idB1A84838316740029B0FA401EB699A81"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1), by inserting <quote>, health (including mental
			 health),</quote> after <quote>promote safety</quote>;</text>
						</subparagraph><subparagraph id="id9E4CB4E7F9CC4950960DC6B0299A6F72"><enum>(B)</enum><text>by redesignating
			 paragraphs (3) through (8) and (9) as paragraphs (4) through (9) and (11),

										</clause><clause commented="no" display-inline="no-display-inline" id="id09D9931899CE4BA8B925BD1F4D3DB1CB" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">making available to students mental health
				services, conflict resolution programs, and other school-based violence
				prevention
				strategies;</text>
										</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="id7DC210AEFE0D4B0BA89ED3B8C7FC4B75"><enum>(E)</enum><text>in paragraph (9),
			 as redesignated by subparagraph (B), by striking <quote>and</quote> after the
			 semicolon; and</text>
						</subparagraph><subparagraph id="idF7628B2190034355849B26060982BFB1"><enum>(F)</enum><text>by inserting
			 after such paragraph (9) the following:</text>
							<quoted-block display-inline="no-display-inline" id="id2A83DE13A1694DCE809BF0F49E52BF4F" style="OLC">
								<paragraph id="ide081e07b9ebe4c1998f56b796219c5ca"><enum>(10)</enum><text>assistance to
				States to help local educational agencies develop and implement comprehensive
				emergency management plans; and</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="id1685A1811CA1423FBE32C2C484BAF31C"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id46C022F05A934335AE2119F81852E828" style="OLC">
							<subsection id="idA12B71E67A9B4DEBA281357D6B9565DD"><enum>(c)</enum><header>School-Based
				mental health services partnership programs</header>
								<paragraph id="id82B61BF09EA04C7C85C4EB5D29155F79"><enum>(1)</enum><header>In
				general</header><text>Each grant, contract, or cooperative agreement awarded or
				entered into under subsection (a)(3) shall meet the requirements of this
				subsection.</text>
								</paragraph><paragraph id="id162CF303D1834273BF7C07B573516AF9"><enum>(2)</enum><header>Eligibility</header>
									<subparagraph id="idFD4E7E1854684E39AFD2B7D390166140"><enum>(A)</enum><header>In
				general</header><text>To be eligible to receive a grant, contract, or
				cooperative agreement under this subsection, a local educational agency shall
				enter into a school-based mental health partnership that—</text>
										<clause id="id67BF8D1823B44F66858C72747ED8BC05"><enum>(i)</enum><text>shall include a
				public or private mental health entity or health care entity; and</text>
										</clause><clause id="idE1D43576C71E4D2F9777997B8FEB7E1E"><enum>(ii)</enum><text>may include a
				child welfare agency, family-based mental health entity, family organization,
				trauma network, or other community-based entity.</text>
										</clause></subparagraph><subparagraph id="idF245F8CDFEEB4059AACD11C275C346C0"><enum>(B)</enum><header>Flexibility for
				certain local educational agencies</header><text>Notwithstanding subparagraph
				(A), a local educational agency that is eligible for services under subpart 1
				or 2 of part B of title VI, as determined by the Secretary, and that is unable
				to partner with a public or private mental health entity or health care entity
				shall be eligible for a grant under this subsection if the local educational
				agency can demonstrate to the Secretary, in its application for a grant under
				this subsection, that the local educational agency can otherwise build the
				capacity to carry out the requirements of this subsection.</text>
									</subparagraph></paragraph><paragraph id="idc542c0591f954389a1965300177d50b2"><enum>(3)</enum><header>Application</header><text>A
				local educational agency that desires a grant, contract, or cooperative
				agreement under this subsection shall include, in the application required by
				the Secretary, a description of how the local educational agency will—</text>
									<subparagraph id="id605ba99f98804a79817440e6bb6fb842"><enum>(A)</enum><text>assist schools
				served by the local educational agency to provide, through the school-based
				mental health services partnership program, comprehensive school-based mental
				health services and supports and comprehensive staff development for school and
				community service personnel working in the school;</text>
									</subparagraph><subparagraph id="id8f1dba90c7d84c008ed348d9872e05b1"><enum>(B)</enum><text>provide technical
				assistance and training to improve and support the development, implementation,
				and coordination of school-based mental health programs and ensure such
				programs are coordinated with activities carried out under the Individuals with
				Disabilities Education Act; and</text>
									</subparagraph><subparagraph id="idd74ac0c4d2a34eb39cc0600316ab753a"><enum>(C)</enum><text>evaluate the
				effects of providing school-based mental health programs.</text>
									</subparagraph></paragraph><paragraph id="id87E2B03D38D842A2A7964C7E69A46F03"><enum>(4)</enum><header>Use of
				funds</header><text>A local educational agency receiving a grant, contract, or
				cooperative agreement under this subsection shall use funds provided under such
				grant, contract, or cooperative agreement to provide school-based mental health
				services and supports that—</text>
									<subparagraph id="id009C57AFB8464C04972CCBD89323017F"><enum>(A)</enum><text>may
				include—</text>
										<clause id="idd322307117d94719b625f150bc0c8014"><enum>(i)</enum><text>the early
				identification of social, emotional, or behavioral problems, or substance use
				disorders, and the provision of early intervening services;</text>
										</clause><clause id="id660b7ad33c864593843ff8cad5f84a21"><enum>(ii)</enum><text>not withstanding
				section 4154, the treatment or referral for treatment of students with social,
				emotional, or behavioral health problems, or substance use disorders;</text>
										</clause><clause id="idccd163c0fe7748eb883fa2a0bc062d24"><enum>(iii)</enum><text>the development
				and implementation of programs to assist children in dealing with trauma and
				violence; and</text>
										</clause><clause id="id2281f750b171430f910c07090cc1d99c"><enum>(iv)</enum><text>the development
				of mechanisms, based on best practices, for children to report incidents of
				violence or plans by other children or adults to commit violence;</text>
										</clause></subparagraph><subparagraph id="id7f309a97e9824cf38348c7b80335219b"><enum>(B)</enum><text>are based on
				trauma-informed and evidence-based practices;</text>
									</subparagraph><subparagraph id="id75cf2fa2a809414a8670d519879436d7"><enum>(C)</enum><text>are coordinated,
				where appropriate, with early intervening services carried out under the
				Individuals with Disabilities Education Act; and</text>
									</subparagraph><subparagraph id="id08bd37800c27465c8fd1be5572391f82"><enum>(D)</enum><text>are provided by
				qualified mental and behavioral health professionals who are certified or
				licensed by the State involved and practicing within their area of
				expertise.</text>
									</subparagraph></paragraph><paragraph commented="no" id="id09969398071f4db087e5f399c32c69ed"><enum>(5)</enum><header>General
				requirements</header>
									<subparagraph commented="no" id="id5A021434957346469A27BCD69BB6BDCF"><enum>(A)</enum><header>Parental
				consent</header>
										<clause commented="no" id="id4E2955C4578C41C395960DEB9B6486AF"><enum>(i)</enum><header>In
				general</header><text>Each local educational agency receiving a grant,
				contract, or cooperative agreement under this subsection shall obtain prior
				written, informed consent from the parent of each child who is under 18 years
				of age to participate in any assessment service, program, activity, or
				treatment that is—</text>
											<subclause commented="no" id="id11B23DAA75054508B390108E98885B7C"><enum>(I)</enum><text>funded under this
				subsection; and</text>
											</subclause><subclause commented="no" id="id2C92FE26EDBD4FFCBCE3120CA057F2D1"><enum>(II)</enum><text>conducted in
				connection with an elementary school or secondary school under the grant,
				contract, or cooperative agreement.</text>
											</subclause></clause><clause commented="no" id="id9CBE1DB010294625BC5C5F5E22C6043D"><enum>(ii)</enum><header>Exception</header><text>Notwithstanding
				clause (i), the written, informed consent described in such clause shall not be
				required in—</text>
											<subclause commented="no" id="idb733afbd94674d828aa6b91e01b125df"><enum>(I)</enum><text>an emergency,
				where it is necessary to protect the immediate health and safety of the
				student, other students, or school personnel; or</text>
											</subclause><subclause commented="no" id="id3b4431d172064a55876d4c7f2d87154a"><enum>(II)</enum><text>other instances
				where parental consent cannot reasonably be obtained, as defined by the
				Secretary.</text>
											</subclause></clause></subparagraph><subparagraph id="idc95927c044654e9fafde467d68f8966d"><enum>(B)</enum><header>Prohibition on
				mandatory medication</header><text>No child shall be required to obtain a
				prescription for a substance covered by the Controlled Substances Act (21
				U.S.C. 801 et seq.) as a condition of receiving an evaluation under this
				subsection, receiving services under this subsection, or attending a school
				receiving assistance under this subsection.</text>
									</subparagraph><subparagraph id="id68BB7A53A377458580A463D99C1DC710"><enum>(C)</enum><header>Privacy</header><text>Each
				eligible entity receiving a grant under this subsection shall ensure that
				student mental health records are accorded the privacy protections provided
				under the regulations promulgated under section 264(c) of the Health Insurance
				Portability and Accountability Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/191">Public Law 104–191</external-xref>; 110 Stat. 2033)
				and section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>)
				(commonly referred to as the <quote>Federal Educational Rights and Privacy Act
				of 1974</quote>).</text>
									</subparagraph></paragraph><paragraph id="id2e772b4214fe40a4b466857277a30321"><enum>(6)</enum><header>Liability
				protection for school personnel</header><text>Section 2366 shall apply to
				school personnel providing services under a grant, contract, or cooperative
				agreement under this subsection in the same manner as such section applies to
				teachers.</text>
								</paragraph><paragraph commented="no" id="idfd52c744f9714ca1a63bfb4afa496235"><enum>(7)</enum><header>Prohibition
				against Federal mandates, direction, or control or Federal
				regulation</header><text>In addition to the prohibition of Federal Government
				control of a State, local educational agency, or school's curriculum or program
				of instruction that is provided under section 9527(a), nothing in this
				subsection shall be construed to authorize an officer or employee of the
				Federal Government to mandate, direct, or control a State, local educational
				agency, or school's specific instructional content or academic achievement
				standards and
				assessments.</text>

			 recovery from trauma</header><text display-inline="no-display-inline">Section
			 582 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290hh-1">42 U.S.C. 290hh–1</external-xref>) is amended—</text>
				<paragraph commented="no" id="idF59A842DA1184E4798181A18A2BEA7E4"><enum>(1)</enum><text>in subsection
			 (a), by striking <quote>developing programs</quote> and all that follows and
			 inserting “developing and maintaining programs that provide for—</text>
					<quoted-block display-inline="no-display-inline" id="id746C34D4D1284F5C8711AB9BAD6B9965" style="OLC">
						<paragraph id="idc3a0ba4ef6124a93aaa40529baccb054"><enum>(1)</enum><text>the continued
				operation of the National Child Traumatic Stress Initiative (referred to in
				this section as the <term>NCTSI</term>), which includes a coordinating center,
				that focuses on the mental, behavioral, and biological aspects of psychological
				trauma response; and</text>
						</paragraph><paragraph id="id3744afc98eee48dcb8ad8ca2c76011e9"><enum>(2)</enum><text>the development
				of knowledge with regard to evidence-based practices for identifying and
				treating mental, behavioral, and biological disorders of children and youth
				resulting from witnessing or experiencing a traumatic
				event.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="id6DF6AF08996B4E12926A49A77B349ADD"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph commented="no" id="id5BF28F0029CF4EB0AAB5AD6199C20494"><enum>(A)</enum><text>by striking

			 subsections (c) through (g) as subsections (g) through (k),
			 respectively;</text>
				</paragraph><paragraph commented="no" id="idF9D06264215C4CFDA16132CD4155C0B7"><enum>(4)</enum><text>by inserting
			 after subsection (b), the following:</text>
					<quoted-block display-inline="no-display-inline" id="idF6A5ED92C9674E50B7CC3843C991D57E" style="OLC">
						<subsection id="idd0d3b9339e1b4b89b9560ba4a3265ff5"><enum>(c)</enum><header>Child outcome
				data</header><text>The NCTSI coordinating center shall collect, analyze, and
				report NCTSI-wide child treatment process and outcome data regarding the early
				identification and delivery of evidence-based treatment and services for
				children and families served by the NCTSI grantees.</text>
						</subsection><subsection id="id21bfd778868e4bf19605ef3b3b56e453"><enum>(d)</enum><header>Training</header><text>The
				NCTSI coordinating center shall facilitate the coordination of training
				initiatives in evidence-based and trauma-informed treatments, interventions,
				and practices offered to NCTSI grantees, providers, and partners.</text>
						</subsection><subsection id="id2510d4fc54764a78b5e7c24e98fd3b4f"><enum>(e)</enum><header>Dissemination</header><text>The
				NCTSI coordinating center shall, as appropriate, collaborate with the Secretary
				in the dissemination of evidence-based and trauma-informed interventions,
				treatments, products and other resources to appropriate stakeholders.</text>
						</subsection><subsection id="id7d0bd14225e64ac6a46e4c70be3f7b8b"><enum>(f)</enum><header>Review</header><text>The
				Secretary shall, consistent with the peer review process, ensure that NCTSI
				applications are reviewed by appropriate experts in the field as part of a
				consensus review process. The Secretary shall include review criteria related
				to expertise and experience in child trauma and evidence-based
				practices.</text>
						</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="idEBEBA51DAE80457D866A005BCCE902D9"><enum>(5)</enum><text>in subsection (g)
			 (as so redesignated), by striking <quote>with respect to centers of excellence
			 are distributed equitably among the regions of the country</quote> and
			 inserting <quote>are distributed equitably among the regions of the United
			 States</quote>;</text>
				</paragraph><paragraph commented="no" id="id2E748AF42F5140DFB0D18B1E48C4C0D4"><enum>(6)</enum><text>in subsection (i)
			 (as so redesignated), by striking <quote>recipient may not exceed 5
			 years</quote> and inserting <quote>recipient shall not be less than 4 years,
			 but shall not exceed 5 years</quote>; and</text>
				</paragraph><paragraph commented="no" id="id080322D3938A46678C59F368111486DC"><enum>(7)</enum><text>in subsection (j)
			 (as so redesignated), by striking <quote>$50,000,000</quote> and all that

				</paragraph></section><section id="id8D2EE9181FEE4FFD958D5F2A00E34BFB"><enum>204.</enum><header>Assessing
			 barriers to behavioral health integration</header>
				<subsection id="id01f00dd7811d461d9b2ba8c9377b5e85"><enum>(a)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of
			 this Act, the Comptroller General of the United States shall submit a report to
			 the Committee on Health, Education, Labor, and Pensions of the Senate and the
			 Committee on Energy and Commerce of the House of Representatives concerning
			 Federal requirements that impact access to treatment of mental health and
			 substance use disorders related to integration with primary care,
			 administrative and regulatory issues, quality measurement and accountability,
			 and data sharing.</text>
				</subsection><subsection id="id6edde51b7a094f1ab9decf6b6901b100"><enum>(b)</enum><header>Contents</header><text>The
			 report submitted under subsection (a) shall include the following:</text>
					<paragraph id="id17c89932b0e54f73921d7102be189a83"><enum>(1)</enum><text>An evaluation of
			 the administrative or regulatory burden on behavioral healthcare
			 providers.</text>
					</paragraph><paragraph id="idd3a65e9f7f2645019cfb9ae642555884"><enum>(2)</enum><text>The
			 identification of outcome and quality measures relevant to integrated health
			 care, evaluation of the data collection burden on behavioral healthcare
			 providers, and any alternative methods for evaluation.</text>
					</paragraph><paragraph id="id87d181f24de94a23a37e2ab7a1cebb9d"><enum>(3)</enum><text>An analysis of
			 the degree to which electronic data standards, including interoperability and
			 meaningful use includes behavioral health measures, and an analysis of
			 strategies to address barriers to health information exchange posed by part 2
			 of title 42, Code of Federal Regulations.</text>
					</paragraph><paragraph id="id3e8c564c99ad4153a16d3ad9e132568f"><enum>(4)</enum><text>An analysis of
			 the degree to which Federal rules and regulations for behavioral and physical
			 health care are aligned, including recommendations to address any identified
			 barriers.</text>
					</paragraph></subsection></section><section id="idB22A47B5198F40F8A236A1E77F3BCD32"><enum>205.</enum><header>Increasing
			 education and awareness of treatments for opioid use disorders</header>
				<subsection id="id40E91F0EB0E24C03BEFB1C37E6B8D8B4"><enum>(a)</enum><header>In
			 general</header><text>In order to improve the quality of care delivery and
			 treatment outcomes among patients with opioid use disorders, the Secretary of
			 Health and Human Services (referred to in this section as the
			 <term>Secretary</term>), acting through the Administrator for the Substance
			 Abuse and Mental Health Services Administration, may advance, through existing
			 programs as appropriate, the education and awareness of providers, patients,
			 and other appropriate stakeholders regarding all products approved by the Food
			 and Drug Administration to treat opioid use disorders.</text>
				</subsection><subsection id="id4DE9312264834F06BB408D9DF7842AE7"><enum>(b)</enum><header>Activities</header><text>The
			 activities described in subsection (a) may include—</text>
					<paragraph id="id72b24b1418ef41e0ae38d0fe6bfe9d52"><enum>(1)</enum><text>disseminating
			 evidence-based practices for the treatment of opioid use disorders;</text>
					</paragraph><paragraph id="idfe13a22fc47348338efe67e90e0e7b8d"><enum>(2)</enum><text>facilitating
			 continuing education programs for health professionals involved in treating
			 opioid use disorders;</text>
					</paragraph><paragraph id="idd54bca2e477a44e59ea933ce12b3c4f8"><enum>(3)</enum><text>increasing
			 awareness among relevant stakeholders of the treatment of opioid use
			 disorders;</text>
					</paragraph><paragraph id="id8f98123e07cc4635a40b75648b42c9e3"><enum>(4)</enum><text>assessing current
			 barriers to the treatment of opioid use disorders for patients and providers
			 and development and implementation of strategies to mitigate such barriers;
			 and</text>
					</paragraph><paragraph id="id0062f85a65c54de08bd1bbf289e6981a"><enum>(5)</enum><text>continuing
			 innovative approaches to the treatment of opioid use disorders in various
			 treatment settings, such as prisons, community mental health centers, primary
			 care, and hospitals.</text>
					</paragraph></subsection><subsection id="id498CD86C2D4C4B7C931E3D5A4C7FE885"><enum>(c)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, if the Secretary
			 carries out the activities under this section, the Secretary shall submit to
			 the Committee on Health, Education, Labor, and Pensions of the Senate and the
			 Committee on Energy and Commerce of the House of Representatives a report that
			 examines—</text>
					<paragraph id="id198f9dcb3d6c4fd29179fd72e50cce67"><enum>(1)</enum><text>the activities
			 the Substance Abuse and Mental Health Services Administration conducts under
			 this section, including any potential impacts on health care costs associated
			 with such activities;</text>
					</paragraph><paragraph id="ide61aee278ad6463f99337ada2f3f8a34"><enum>(2)</enum><text>the role of
			 adherence in the treatment of opioid use disorders and methods to reduce opioid
			 use disorders; and</text>
					</paragraph><paragraph id="idcabaaaedcdcd4b5d9bc37a0b0eaa57ba"><enum>(3)</enum><text>recommendations
			 on priorities and strategies to address co-occurring substance use disorders
			 and mental illnesses.</text>
					</paragraph></subsection></section><section id="idDC2D001F6E694DBD82D42ADB7D462E16"><enum>206.</enum><header>Examining
			 mental health care for children</header>
				<subsection id="idf9787f91cc714f5ea0e519bc43bee7b0"><enum>(a)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Comptroller General of the United States shall conduct an independent
			 evaluation, and submit to the Committee on Health, Education, Labor, and
			 Pensions of the Senate and the Committee on Energy and Commerce of the House of
			 Representatives, a report concerning the utilization of mental health services
			 for children, including the usage of psychotropic medications.</text>
				</subsection><subsection id="id1d288bda8eca46f0977fdc654a5f8162"><enum>(b)</enum><header>Content</header><text>The
			 report submitted under subsection (a) shall review and assess—</text>
					<paragraph id="id632db3fd7c2446b7819d58d014fcdbfe"><enum>(1)</enum><text>the ways in which
			 children access mental health care, including information on whether children
			 are treated by primary care or specialty providers, what types of referrals for
			 additional care are recommended, and any barriers to accessing this
			 care;</text>
					</paragraph><paragraph id="id0699f6174c524393b053653cb7fbd00b"><enum>(2)</enum><text>the extent to
			 which children are prescribed psychotropic medications in the United States
			 including the frequency of concurrent medication usage; and</text>
					</paragraph><paragraph id="id6afe26537453490489d9d67d869ce568"><enum>(3)</enum><text>the tools,
			 assessments, and medications that are available and used to diagnose and treat
			 children with mental health disorders.</text>
					</paragraph></subsection></section><section id="idBA8589FB5D0341148EDFD8ADBD1D5C3B"><enum>207.</enum><header>Evidence based
			 practices for older adults</header>
				<subsection id="idad82b53addf7408190c2f24dd309ff85"><enum>(a)</enum><header>Geriatric
			 substance use disorders treatment</header><text>Section 509(e) of the Public
			 Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-2">42 U.S.C. 290bb–2(e)</external-xref>) is amended—</text>
					<paragraph id="idCD86AA5D1A2440A2BAC3593EE69ED9F7"><enum>(1)</enum><text>by striking

				nongrantees throughout the United
				States.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="idfb87c220c0a44d41a77f1ec12aaf61dc"><enum>(b)</enum><header>Geriatric
			 substance use disorders prevention</header><text>Section 516(e) of the Public
			 Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-22">42 U.S.C. 290bb–22(e)</external-xref>) is amended—</text>

					</paragraph></subsection><subsection id="iddfc28180159740a28f29391b1b5b7d61"><enum>(c)</enum><header>Geriatric
			 mental health disorders</header><text>Section 520A(e) of the Public Health
			 Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-32">42 U.S.C. 290bb–32(e)</external-xref>) is amended by adding at the end the
			 following:</text>

						<paragraph id="id80C28BD27B1849C5AE2F087B1D45A966"><enum>(3)</enum><header>Geriatric
				mental health disorders</header><text>The Secretary shall, as appropriate,
				provide technical assistance to grantees regarding evidence-based practices for
				the prevention and treatment of geriatric mental health disorders, as well as
				disseminate information about such evidence-based practices to States and
				nongrantees throughout the United
				States.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="id237F28BF66034ED4A629B9319AD9BFF0"><enum>208.</enum><header>National
			 violent death reporting system</header><text display-inline="no-display-inline">The Secretary of Health and Human Services,
			 acting through the Director of the Centers for Disease Control and Prevention,
			 is encouraged to improve, particularly through the inclusion of additional
			 States, the National Violent Death Reporting System as authorized by title III
			 of the Public Health Service Act. Participation in the system by the States
			 shall be voluntary.</text>
			</section><section id="idA7BC81A121BA4787814C2BFD44438178"><enum>209.</enum><header>GAO study on
			 Virginia Tech recommendations</header>
				<subsection id="idA92DBE6364CA4EB080FAD8472629F353"><enum>(a)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Comptroller General of the United States shall conduct an independent
			 evaluation, and submit to the appropriate committees of Congress a report
			 concerning the status of implementation of recommendations made in the report
			 to the President, On Issues Raised by the Virginia Tech Tragedy, by the
			 Secretaries of Health and Human Services and Education and the Attorney General
			 of the United States, submitted to the President on June 13, 2007.</text>
				</subsection><subsection id="idEFF0CCE26E2347CFB2C3F2461AE56CD0"><enum>(b)</enum><header>Content</header><text>The
			 report submitted to the committees of Congress under subsection (a) shall
			 review and assess—</text>
					<paragraph id="id4f1655ca71324feabf6ab9a3a4e84cac"><enum>(1)</enum><text>the extent to
			 which the recommendations in the report that include participation by the
			 Department of Health and Human Services were implemented;</text>
					</paragraph><paragraph id="ida15e45e5950843dc9033a72d89411dfe"><enum>(2)</enum><text>whether there are
			 any barriers to implementation of such recommendations; and</text>
					</paragraph><paragraph id="id77f272da9b3c44d5b028c251f55186d6"><enum>(3)</enum><text>identification of
			 any additional actions the Federal government can take to support States and
			 local communities and ensure that the Federal government and Federal law are
			 not obstacles to addressing at the community level—</text>
						<subparagraph id="id5A991F3EF2F94E8DB5A26BC8FE1DDED2"><enum>(A)</enum><text>school violence;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24D8123A05ED4769BBA1F300380F8F21"><enum>(B)</enum><text>mental
			 illness.</text>
