<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d100051e62" identifier="/us/bill/113/s/330/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">HIV Organ Policy Equity Act</shortTitle>”.</content></section>
<section id="d100051e72" identifier="/us/bill/113/s/330/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>AMENDMENTS TO THE PUBLIC HEALTH SERVICE ACT.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d100051e76" identifier="/us/bill/113/s/330/s2/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Standards of Quality for the Acquisition and Transportation of Donated Organs</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d100051e83" identifier="/us/bill/113/s/330/s2/a/1" role="instruction" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Organ procurement and transplantation network</inline>.—</heading><chapeau>Section 372(b) of the Public Health Service Act (<ref href="/us/usc/t42/s274/b">42 U.S.C. 274(b)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d100051e98" identifier="/us/bill/113/s/330/s2/a/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>in paragraph (2)(E), by <amendingAction type="delete">striking</amendingAction> “<quotedText>, including standards for preventing the acquisition of organs that are infected with the etiologic agent for acquired immune deficiency syndrome</quotedText>”; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d100051e106" identifier="/us/bill/113/s/330/s2/a/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><heading><inline class="smallCaps">Clarification</inline>.—</heading><chapeau>In adopting and using standards of quality under paragraph (2)(E), the Organ Procurement and Transplantation Network may adopt and use such standards with respect to organs infected with human immunodeficiency virus (in this paragraph referred to as ‘HIV’), provided that any such standards ensure that organs infected with HIV may be transplanted only into individuals who—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>are infected with HIV before receiving such organ; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B)</num><clause class="inline"><num value="i">(i) </num><content>are participating in clinical research approved by an institutional review board under the criteria, standards, and regulations described in subsections (a) and (b) of section 377E; or</content></clause><clause class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>if the Secretary has determined under section 377E(c) that participation in such clinical research, as a requirement for such transplants, is no longer warranted, are receiving a transplant under the standards and regulations under section 377E(c).”</content></clause></subparagraph></paragraph></quotedContent>.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d100051e139" identifier="/us/bill/113/s/330/s2/a/2" role="instruction" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Conforming amendment</inline>.—</heading><content>Section 371(b)(3)(C) of the Public Health Service Act (<ref href="/us/usc/t42/s273/b/3/C">42 U.S.C. 273(b)(3)(C)</ref>; relating to organ procurement organizations) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>including arranging for testing with respect to preventing the acquisition of organs that are infected with the etiologic agent for acquired immune deficiency syndrome</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>including arranging for testing with respect to identifying organs that are infected with human immunodeficiency virus (HIV)</quotedText>”.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d100051e160" identifier="/us/bill/113/s/330/s2/a/3" role="instruction" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Technical amendments</inline>.—</heading><chapeau>Section 371(b)(1) of the Public Health Service Act (<ref href="/us/usc/t42/s273/b/1">42 U.S.C. 273(b)(1)</ref>) <amendingAction type="amend">is amended</amendingAction> by—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d100051e175" identifier="/us/bill/113/s/330/s2/a/3/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content><amendingAction type="delete">striking</amendingAction> subparagraph (E);</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d100051e182" identifier="/us/bill/113/s/330/s2/a/3/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content><amendingAction type="redesignate">redesignating</amendingAction> subparagraphs (F) and (G) as subparagraphs (E) and (F), respectively;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d100051e189" identifier="/us/bill/113/s/330/s2/a/3/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content><amendingAction type="delete">striking</amendingAction> “<quotedText>(H) has a director</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(G) has a director</quotedText>”; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d100051e199" identifier="/us/bill/113/s/330/s2/a/3/D" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="D">(D) </num><chapeau>in subparagraph (H)—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d100051e203" identifier="/us/bill/113/s/330/s2/a/3/D/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>in clause (i) (V), by <amendingAction type="delete">striking</amendingAction> “<quotedText>paragraph (2)(G)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>paragraph (3)(G)</quotedText>”; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d100051e214" identifier="/us/bill/113/s/330/s2/a/3/D/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>in clause (ii), by <amendingAction type="delete">striking</amendingAction> “<quotedText>paragraph (2)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>paragraph (3)</quotedText>”.</content></clause></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d100051e225" identifier="/us/bill/113/s/330/s2/b" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Publication of Research Guidelines</inline>.—</heading><content>Part H of title III of the Public Health Service Act (<ref href="/us/usc/t42/s273/etseq">42 U.S.C. 273 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after section 377D the following:<quotedContent><section style="-uslm-lc:I650144"><num class="bold " value="377E">“SEC. 377E. </num><heading class="bold ">CRITERIA, STANDARDS, AND REGULATIONS WITH RESPECT TO ORGANS INFECTED WITH HIV.</heading><subsection class="indentDown2 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">“(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>Not later than 2 years after the date of the enactment of the HIV Organ Policy Equity Act, the Secretary shall develop and publish criteria for the conduct of research relating to transplantation of organs from donors infected with human immunodeficiency virus (in this section referred to as ‘HIV’) into individuals who are infected with HIV before receiving such organ.</content></subsection><subsection class="indentDown2 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">“(b) </num><heading><inline class="smallCaps">Corresponding Changes to Standards and Regulations Applicable to Research</inline>.—</heading><chapeau>Not later than 2 years after the date of the enactment of the HIV Organ Policy Equity Act, to the extent determined by the Secretary to be necessary to allow the conduct of research in accordance with the criteria developed under subsection (a)—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>the Organ Procurement and Transplantation Network shall revise the standards of quality adopted under section 372(b)(2)(E); and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>the Secretary shall revise <ref href="/us/cfr/t42/s121.6">section 121.6 of title 42, Code of Federal Regulations</ref> (or any successor regulations).</content></paragraph></subsection><subsection class="indentDown2 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">“(c) </num><heading><inline class="smallCaps">Revision of Standards and Regulations Generally</inline>.—</heading><chapeau>Not later than 4 years after the date of the enactment of the HIV Organ Policy Equity Act, and annually thereafter, the Secretary, shall—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>review the results of scientific research in conjunction with the Organ Procurement and Transplantation Network to determine whether the results warrant revision of the standards of quality adopted under section 372(b)(2)(E) with respect to donated organs infected with HIV and with respect to the safety of transplanting an organ with a particular strain of HIV into a recipient with a different strain of HIV;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>if the Secretary determines under paragraph (1) that such results warrant revision of the standards of quality adopted under section 372(b)(2)(E) with respect to donated organs infected with HIV and with respect to transplanting an organ with a particular strain of HIV into a recipient with a different strain of HIV, direct the Organ Procurement and Transplantation Network to revise such standards, consistent with section 372 and in a way that ensures the changes will not reduce the safety of organ transplantation; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><content>in conjunction with any revision of such standards under paragraph (2), revise <ref href="/us/cfr/t42/s121.6">section 121.6 of title 42, Code of Federal Regulations</ref> (or any successor regulations).”</content></paragraph></subsection></section>

<section id="d100051e304" identifier="/us/bill/113/s/330/s3" role="instruction" style="-uslm-lc:I650141"><num value="3">SEC. 3. </num><heading>CONFORMING AMENDMENT TO <ref href="/us/usc/t18">TITLE 18 OF THE UNITED STATES CODE</ref>.</heading><content style="-uslm-lc:I650120">  <ref href="/us/usc/t18/s1122/a">Section 1122(a) of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or in accordance with all applicable guidelines and regulations made by the Secretary of Health and Human Services under section 377E of the Public Health Service Act</quotedText>” after “<quotedText>research or testing</quotedText>”.</content></section>
