			 materials CA–20139 and CA–22901, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Soledad Canyon Settlement
			 Act</short-title></quote>.</text></section><section id="id74BE5EAC11D1405BB43A5D3F21109173"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id255FCD67B5EC462CBB248A7E3678AAE5"><enum>(1)</enum><header>City of Santa
			 Clarita</header><text>The term <term>City of Santa Clarita</term> means the
			 City of Santa Clarita, California.</text></paragraph><paragraph id="idc32dc28e87384f49bb4b91cc7c39ff8b"><enum>(2)</enum><header>City of
			 Victorville</header><text>The term <term>City of Victorville</term> means the
			 City of Victorville, California.</text></paragraph><paragraph id="idD1FB82D9828C4DCFA4F826F3C1A2885A"><enum>(3)</enum><header>Contracts</header><text>The
			 term <term>contracts</term> means the Bureau of Land Management mineral
			 contracts numbered CA–20139 and CA–22901.</text></paragraph><paragraph id="id955036E60EBB4864B7F75DF43913BDD7"><enum>(4)</enum><header>Contract
			 holder</header><text>The term <term>contract holder</term> means the private
			 party to the contracts, and any successors that hold legal interests in
			 the
			 contracts.</text></paragraph><paragraph id="idA054318FC5D94FFCB014B1E0FE96D56D"><enum>(5)</enum><header>County of San
			 Bernardino</header><text>The term <term>County of San Bernardino</term> means
			 the County of San Bernardino, California.</text></paragraph><paragraph id="id00F4CFFA47044A22AE7D35E4D7A39F75"><enum>(6)</enum><header>Map</header><text>The
			 term <term>Map</term> means the map entitled <quote>Victorville disposal area,
			 California</quote> and dated March 2011.</text></paragraph><paragraph id="idF21EF89B7C6C4ADFA3D76A1A48D19A24"><enum>(7)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="idBC1FEAABD87F4639BC427409CBBFBF4C"><enum>(8)</enum><header>Victorville
			 disposal area</header><text>The term <term>Victorville disposal area</term>
			 means the 10,206.05 acres of land identified for disposal in the West
			 Mojave
			 Land Management Plan (2006) of the Bureau of Land Management and depicted
			 on
			 the Map.</text></paragraph></section><section id="id3A1D816C804C42EFA844F3186C303E55"><enum>3.</enum><header>Appraisal;
			 compensation to contract holder</header><subsection id="id3022AD4FE92E466BB8759F5D2E6C50BE"><enum>(a)</enum><header>Appraisals</header><paragraph id="id5EBB0217A3B74F91BF1D0E7514FAFF76"><enum>(1)</enum><header>Contract
			 appraisal</header><subparagraph id="id31942203514C411B8DF48315B3F87A6E"><enum>(A)</enum><header>In
			 general</header><text>Not later than 90 days after the date of enactment of
			 this Act, the Secretary shall determine by mineral appraisal, using the
			 discounted cash flow method of appraisal (in accordance with the appraisal
			 guidelines for appraisals of large quantities of mineral materials
			 contained in
			 section IV(E) of BLM Mineral Material Appraisal Handbook H–3630)—</text><clause id="id78ACD96132D641F9B0582D66B32C9748"><enum>(i)</enum><text>the
			 fair market value of the contracts; and</text></clause><clause id="id6C970042919343309A4964C42FE73887"><enum>(ii)</enum><text>the amount of
			 royalties the Federal Government would receive under the contracts over
			 the
			 10-year period beginning on the date of enactment of this Act.</text></clause></subparagraph><subparagraph id="idFB0604478DBE41CFBEA641C4B0ABB0AD"><enum>(B)</enum><header>Considerations</header><text>In
			 making the determination under subparagraph (A), the Secretary shall
			 assume
			 that—</text><clause id="id6F0FCB51035245ED8E1DFF1FEAEE5628"><enum>(i)</enum><text>the
			 contract holder has obtained all the permits and entitlements necessary to
			 mine, produce, and sell sand and gravel under the contract; and</text></clause><clause id="id2d330abb6c2b4287944d706bedfa337c"><enum>(ii)</enum><text>mining
			 operations under the contract have commenced at the time of the
			 determination,
			 with maximum annual production volumes that—</text><subclause id="id5e1c3ed90ffa496abb611bc9a7a83533"><enum>(I)</enum><text>are based on the
			 projected supply and demand outlook at the time of determination; and</text></subclause><subclause id="idcb48e31f43cd4cd9b6cf5e9a485355bb"><enum>(II)</enum><text>reflect
			 depletion of the reserves that are subject to the contract within the
			 effective
			 periods of the contract.</text></subclause></clause></subparagraph><subparagraph id="id339883D1D738402FBFA10B632AE1C2A6"><enum>(C)</enum><header>Donation</header><text>The Secretary shall provide to the contract holder and the City of Santa Clarita a list of approved
			 appraisers from which the parties shall select and provide the funding to
			 cover the costs of the appraisal under subparagraph (A).</text></subparagraph></paragraph><paragraph id="idB4D46FBD917B42D09871E30C4DA56DBF"><enum>(2)</enum><header>Land
			 appraisal</header><subparagraph id="id872BA3C448024C869F972D699BBA9D9A"><enum>(A)</enum><header>In
			 general</header><text>Not later than 90 days after the date of enactment of
			 this Act, the Secretary shall determine by appraisal standards under
			 existing
			 laws and regulations, the fair market value of the Victorville disposal
			 area on
			 a net present value basis.</text></subparagraph><subparagraph id="idAA4C992224AC4FC9ABC0FA8D53842239"><enum>(B)</enum><header>Donation</header><text>The
			 Secretary shall provide to the contract holder and the City of Santa
			 Clarita a list of approved appraisers from which the parties shall select
			 and provide the funding to cover the costs of
			 the
			 appraisal under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="idA92D4292AEEA4FDF8227A960E866971D"><enum>(b)</enum><header>Compensation</header><paragraph id="id43BD284207994D2A9BA1AA7767DCD000"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), not later than 30 days after
			 completion of the appraisals under subsection (a), the Secretary shall
			 offer
			 the contract holder compensation for the cancellation of the contracts.</text></paragraph><paragraph id="id8F32DDE56D56405CB268BFA04505EC37"><enum>(2)</enum><header>Conditions on
			 offer</header><text>An offer made by the Secretary under paragraph (1) shall be
			 subject to the following conditions:</text><subparagraph id="id1BF9EC60051B441DAB5E5868DD2CEEAA"><enum>(A)</enum><text>The cancellation
			 of the contracts and the provision of compensation shall be contingent on
			 the
			 availability of funds from the sale of the Victorville disposal area under
			 section 4, and any additional compensation provided under subparagraph
			 (D), as
			 determined necessary by the Secretary.</text></subparagraph><subparagraph id="idAA7AEE39BF694A2994BCA1AE9B48E0BE"><enum>(B)</enum><text>The amount of
			 compensation offered by the Secretary under this subsection shall be equal
			 to
			 or less than the fair market value of the contracts, as determined under
			 subsection (a)(1)(A)(i).</text></subparagraph><subparagraph commented="no" id="idC077434DF9C148A5BD922499BBD2C302"><enum>(C)</enum><text>The amount of
			 compensation offered by the Secretary under this subsection shall be equal
			 to
			 or less than the projected revenues generated by the sale of the
			 Victorville
			 disposal area under section 4, less the projected lost royalties to the
			 Federal
			 Government over the 10-year period beginning on the date of enactment of
			 this
			 Act, as determined under subsection (a)(1)(A)(ii).</text></subparagraph><subparagraph id="ide48538ccb28042dca8a9b95cf885f928"><enum>(D)</enum><text>If the amount of
			 projected revenues described in subparagraph (C) is less than the fair
			 market
			 value determined under subsection (a)(1)(A)(i), the Secretary shall, not
			 later
			 than 60 days after the date on which the Director of the Bureau of Land
			 Management determines the projected revenues under subparagraph (C),
			 negotiate
			 an agreement with the contract holder and the City of Santa Clarita to
			 provide
			 to the Secretary amounts equal to the difference, in the form of—</text><clause id="ideb8e0ed4dc7d4c9dac5da0e438685b85"><enum>(i)</enum><text>compensation to
			 be received by the contract holder; and</text></clause><clause id="ide2702161122848bcbdb029665bba7489"><enum>(ii)</enum><text>compensation in
			 a form acceptable to the Secretary to be provided by the City of Santa
			 Clarita.</text></clause></subparagraph></paragraph><paragraph id="id86F50F9526A947FDA1E3646D1ECAAB95"><enum>(3)</enum><header>Acceptance of
			 offer</header><subparagraph id="idFE1B15935A4C4E6DB55B73AEC18BAB68"><enum>(A)</enum><header>In general</header><text>The contract holder shall have 60 days from the later of
			 the date on which the Secretary makes the offer under paragraph (1) or an
			 agreement is negotiated under paragraph (2)(D) to accept the offer or
			 agreement.</text></subparagraph><subparagraph id="id070249286C294D66A2E245D6DECAAECF"><enum>(B)</enum><header>Failure to accept offer</header><text>If the contract holder does not accept the offer under paragraph (1) or if an agreement is not
			 negotiated under paragraph (2)(D) within the time period described in
			 subparagraph (A), the contracts shall remain in effect and no further
			 actions shall taken be taken pursuant to this Act.</text></subparagraph></paragraph></subsection></section><section id="id338EC067051C4CB9BF168E155CCD72EE"><enum>4.</enum><header>Sale of land
			 near Victorville, California</header><subsection id="id1CCAB9B8770F4402A6B18D4C7044EA78"><enum>(a)</enum><header>In
			 general</header><text>Notwithstanding sections 202 and 203 of the Federal Land
			 Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1713) and subject to
			 subsections (b) through (f), not later than 2 years after the date of
			 enactment of
			 this Act, the Secretary shall place on the market and offer for sale by
			 competitive
			 bidding and in a manner designed to obtain the highest price possible, all
			 right, title, and interest of the United States in and to the Victorville
			 disposal area.</text></subsection><subsection id="id69c789ed6aac48cdb30481fc25a46687"><enum>(b)</enum><header>Availability of
			 Map</header><text>The Secretary shall keep the Map on file and available for
			 public inspection in—</text><paragraph id="id6c390bdbd02845199e9be6143293d0b3"><enum>(1)</enum><text>the office of the
			 Director of the Bureau of Land Management; and</text></paragraph><paragraph id="id554c6857fac6454db720a2c5f297ff94"><enum>(2)</enum><text>the district
			 office of the Bureau of Land Management located in Barstow, California.</text></paragraph></subsection><subsection id="idae872ab9d7eb4e2c88e8602a717b0da5"><enum>(c)</enum><header>Right of Local
			 Land Use Authority To Purchase Certain Land</header><paragraph id="idec83e0c30b6548cb86e403de52769132"><enum>(1)</enum><header>In
			 general</header><text>Before a sale of land under subsection (a), the Secretary
			 shall provide to the applicable local land use authority an exclusive
			 preemptive right, as determined under State law, to purchase any right,
			 title,
			 or interest of the United States in and to any portion of the parcels of
			 land
			 identified as <quote>Area A</quote> and <quote>Area B</quote> on the Map that
			 is located within the jurisdiction of the local land use authority.</text></paragraph><paragraph id="id1738a4dbac554b3a8c3d92459bd7b0d4"><enum>(2)</enum><header>Timing</header><text>A
			 preemptive right under paragraph (1) shall be in effect for a period of 30
			 days
			 before the land is sold under subsection (a).</text></paragraph><paragraph id="id2c5650dddcc0424f927766c2c91b71e6"><enum>(3)</enum><header>Authority</header><text>During
			 the period described in paragraph (2), the local land use authority may
			 purchase some or all of the right, title, and interest of the United
			 States, as
			 provided in subsection (a), in and to the land to be offered for sale at
			 fair
			 market value, as determined by an appraisal conducted by the Secretary.</text></paragraph><paragraph id="id895eaf22646b40fa92695f4dc590aef2"><enum>(4)</enum><header>Exercising
			 right</header><text>If the local land use authority exercises the preemptive
			 right under paragraph (1), the Secretary shall convey the land to the
			 local
			 land use authority immediately on payment by the local land use authority
			 of
			 the entire purchase price of the applicable parcel of land.</text></paragraph><paragraph id="id83f6c04c333b444ebf1c0ebe8b91428c"><enum>(5)</enum><header>Failure to
			 pay</header><text>Failure by the local land use authority to purchase and pay
			 for the right, title, and interest of the United States in and to the land
			 described in paragraph (1) within the time period described in paragraph
			 (2)
			 and to comply with any other terms and conditions as the Secretary may
			 require
			 shall terminate the preemptive right of the local land use authority with
			 respect to the right, title, and interest offered for sale.</text></paragraph></subsection><subsection id="id4badd581a7d5460481cdd31e1aed1b57"><enum>(d)</enum><header>Withdrawal and
			 Reservation</header><paragraph id="id5a9d7658512c4751b8c1f7390d3fc936"><enum>(1)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights, the land described in subsection (a) is
			 withdrawn
			 from—</text><subparagraph id="idb6de5e91d0a547e2ba6efe9da08b7785"><enum>(A)</enum><text>entry,
			 appropriation, or disposal under the public land laws;</text></subparagraph><subparagraph id="ida300a91eedd5490f86bfbe9535c8a55f"><enum>(B)</enum><text>location, entry,
			 and patent under the mining laws; and</text></subparagraph><subparagraph id="id600825257655445995fdf60e7eda13c4"><enum>(C)</enum><text>operation of the
			 mineral leasing, mineral materials, and geothermal leasing laws.</text></subparagraph></paragraph><paragraph commented="no" id="idc1f361a668574fcaae5c19ae0ed2acfb"><enum>(2)</enum><header>Reservation</header><text>In
			 any sale or other disposal of land under this section, there shall be
			 reserved
			 by the United States the right of the United States to prospect for, mine,
			 and
			 remove minerals from the conveyed land.</text></paragraph></subsection><subsection id="idcb8e6477960e44efa5136e05b6572e54"><enum>(e)</enum><header>Consultation</header><text>In
			 addition to any consultation otherwise required by law, before initiating
			 efforts to dispose of land under this section, the Secretary shall consult
			 with
			 the City of Victorville, the County of San Bernardino, and surface owners
			 in
			 the jurisdiction in which the land is located regarding the potential
			 impact of
			 the disposal and other appropriate aspects of the disposal.</text></subsection><subsection commented="no" id="idB2E3CB32EE5A4E8AAECE3F2669E1B94F"><enum>(f)</enum><header>Account</header><text>The
			 gross proceeds of a sale of land under subsection (a) shall be deposited
			 in an
			 account acceptable to the Secretary and available only for the purposes of
			 carrying out this Act.</text></subsection></section><section commented="no" id="id6340C3BC319B4B75A354C6A30E3128F5"><enum>5.</enum><header>Cancellation of
			 contracts</header><subsection id="idf47cc41ad3b44db5bf15d66e37ebeb0f"><enum>(a)</enum><header>In general</header><text>On completion of the compensation to the contract holder for the value of each contract in
			 accordance with subsection (b), the
			 Secretary shall cancel the contracts and withdraw those areas that were
			 subject to the contracts from further mineral entry under all mineral
			 leasing and sales authorities available to the Secretary.</text></subsection><subsection id="id97db79b85e1b4dcb8196fdc3074b2fe3"><enum>(b)</enum><header>Compensation; cancellation; retention of funds</header><paragraph id="idF4B5F86BF57641F4937F161D2793D455"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (3), the Secretary shall provide to the contract holder the compensation
			 agreed to under section 3(b)  by disbursement of
			 amounts from the account, in 4 equal payments, as funds are available;</text></paragraph><paragraph commented="no" id="id24d2a9821961410e8523cacc0dc8a20d"><enum>(2)</enum><header>Cancellation</header><subparagraph commented="no" id="id98AE399AD7CE41ACA75287D5A5D57DC1"><enum>(A)</enum><header>Contract CA–20139</header><text>On completion of the first 2 payments to the contract holder under paragraph (1), the Secretary 
			 shall cancel contract	 CA–20139.</text></subparagraph><subparagraph commented="no" id="idcf448d75c6cb49a9929093f1e283e403"><enum>(B)</enum><header>Contract CA–22901</header><text>On completion of the remaining 2 payments to the contract holder under paragraph (1), the Secretary
			 shall cancel contract CA–22901.</text></subparagraph></paragraph><paragraph commented="no" id="idac2d4edbdab747cc9f5e885fdabaecc5"><enum>(3)</enum><header>Retention of funds</header><text>The Secretary shall retain sufficient funds to cover the projected lost royalties determined under
			 section
			 3(a)(1)(A)(ii).</text></paragraph></subsection><subsection id="id25027678057f4aa39daf40c7b7e4f754"><enum>(c)</enum><header>Release and waiver</header><text>Upon acceptance and receipt of compensation under subsection (b), the contract holder shall waive
			 all claims
			 against the United States arising out of, or relating to, the cancellation
			 of the contracts.</text></subsection></section></legis-body></bill>
