				</toc></subsection></section><section id="idC93736239FD44B0BB85528180190918D"><enum>2.</enum><header>Definition of Administrator</header><text display-inline="no-display-inline">In this Act, the term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></section><title id="idD10DF26843FA461A9B522C7E24D5DFA0" style="OLC"><enum>I</enum><header>Conservation and efficiency</header><section id="id3034595BE36E4CC7ADFCBCDF3D60C258"><enum>101.</enum><header>Water efficiency,
		conservation, and adaptation</header><subsection id="id9B12647E782B45E086820E4251D25BAD"><enum>(a)</enum><header>WaterSense</header>
					<paragraph id="IDb134e328c0d44eeaa07f96f35b3e2b4b"><enum>(1)</enum><header>In
		general</header><text>There is established within the Environmental Protection
		Agency a WaterSense program to identify and promote water efficient products,
		buildings, landscapes, facilities, processes, and services so as—</text>
						<subparagraph id="IDc4b2789c15284c2a8753fd1f86b2022d"><enum>(A)</enum><text>to reduce water
		use;</text>
						</subparagraph><subparagraph id="IDe762060a3a15458db26a64a06cdff26b"><enum>(B)</enum><text>to reduce the
		strain on water, wastewater, and stormwater infrastructure;</text>
						</subparagraph><subparagraph id="ID5b743e34155940b0913697fb9ad9bc7d"><enum>(C)</enum><text>to conserve
		energy used to pump, heat, transport, and treat water; and</text>
						</subparagraph><subparagraph id="IDdd8928c7ab414ad6809bf8866ea005dc"><enum>(D)</enum><text>to preserve water
		resources for future generations, through voluntary labeling of, or other forms
		of communications about, products, buildings, landscapes, facilities,
		processes, and services that meet the highest water efficiency and performance
		criteria.</text>
						</subparagraph></paragraph><paragraph id="ID2f89fd4f444748d9b03db1861c529219"><enum>(2)</enum><header>Duties</header><text>The
		Administrator shall—</text>
						<subparagraph id="H9DCC2AD3F1BB4C2F99624AA8154A8E11"><enum>(A)</enum><text>establish—</text>
							<clause id="IDe4ed73c6485442539c4eed3480aa6f5b"><enum>(i)</enum><text>a
		WaterSense label to be used for certain items; and</text>
							</clause><clause id="IDc173ff4097b04e8f9bcc532237e8d267"><enum>(ii)</enum><text>the
		procedure by which an item may be certified to display the WaterSense
		label;</text>
							</clause></subparagraph><subparagraph id="id6CBF395DDA5245EA9451EA8FD19F6D52"><enum>(B)</enum><text>promote
		WaterSense-labeled products, buildings, landscapes, facilities, processes, and
		services in the marketplace as the preferred technologies and services
		for—</text>
							<clause id="ID938bd7fb0c8049c8a8cdc51029c65995"><enum>(i)</enum><text>reducing water
		use; and</text>
							</clause><clause id="IDf8f92c5383fb4c20b485e30d809fa89f"><enum>(ii)</enum><text>ensuring product
		and service performance;</text>
							</clause></subparagraph><subparagraph id="ID178bf0455543402b81832cb2bfab720f"><enum>(C)</enum><text>work to enhance
		public awareness of the WaterSense label through public outreach, education,
		and other means;</text>
						</subparagraph><subparagraph id="ID14ef125c4c554303895e213bd70817c3"><enum>(D)</enum><text>preserve the
		integrity of the WaterSense label by—</text>
							<clause id="ID2b33726f3aa443c3bcc7deff863abab7"><enum>(i)</enum><text>establishing and
		maintaining performance criteria so that products, buildings, landscapes,
		facilities, processes, and services labeled with the WaterSense label perform
		as well or better than less water-efficient counterparts;</text>
							</clause><clause id="ID0081de3b0d09449ca81856bcf953aa4f"><enum>(ii)</enum><text>overseeing
		WaterSense certifications made by third parties;</text>
							</clause><clause id="ID3e6f63c5ffde4b548e02c4e2476cc887"><enum>(iii)</enum><text>conducting
		reviews of the use of the WaterSense label in the marketplace and taking
		corrective action in any case in which misuse of the label is identified;
		and</text>
							</clause><clause id="ID9c251d786e4645cd826f76376c9105d4"><enum>(iv)</enum><text>carrying out
		such other measures as the Administrator determines to be appropriate;</text>
							</clause></subparagraph><subparagraph id="IDc7c061aabf5045cb947c3e726238caed"><enum>(E)</enum><text>regularly review
		and, if appropriate, update WaterSense criteria for categories of products,
		buildings, landscapes, facilities, processes, and services, at least once every
		6 years;</text>
						</subparagraph><subparagraph id="ID4c0060c8c6884111a7f39aaf9e21d441"><enum>(F)</enum><text>to the maximum
		extent practicable, regularly estimate and make available to the public the
		production and relative market shares of, and the savings of water, energy, and
		capital costs of water, wastewater, and stormwater infrastructure attributable
		to the use of WaterSense-labeled products, buildings, landscapes, facilities,
		processes, and services, at least annually;</text>
						</subparagraph><subparagraph id="ID2664ca2c237a486186421b93fa2ebe3b"><enum>(G)</enum><text>solicit comments
		from interested parties and the public prior to establishing or revising a
		WaterSense category, specification, installation criterion, or other criterion;</text>
						</subparagraph><subparagraph id="ID27b3738cced048829a729c5d2a444a3b"><enum>(H)</enum><text>provide
		reasonable notice to interested parties and the public of any changes
		(including effective dates), on the adoption of a new or revised category,
		specification, installation criterion, or other criterion, along with—</text>
							<clause id="IDe67b86c2765e47cfb29482ab8f3ef737"><enum>(i)</enum><text>an
		explanation of the changes; and</text>
							</clause><clause id="IDb33c97c8d55b4f1c960f9b0fb54fdc6b"><enum>(ii)</enum><text>as
		appropriate, responses to comments submitted by interested parties and the
		public;</text>
							</clause></subparagraph><subparagraph id="ID7a6809ecbb684118b9fe3d969e54883e"><enum>(I)</enum><text>provide
		appropriate lead time (as determined by the Administrator) prior to the
		applicable effective date for a new or significant revision to a category,
		specification, installation criterion, or other criterion, taking into account
		the timing requirements of the manufacturing, marketing, training, and
		distribution process for the specific product, building and landscape, or
		service category addressed;</text>
						</subparagraph><subparagraph id="IDec5bfe7cd9964fc19a5527951a973386"><enum>(J)</enum><text>identify and, if
		appropriate, implement other voluntary approaches in commercial, institutional,
		residential, industrial, and municipal sectors to encourage recycling and reuse
		technologies to improve water efficiency or lower water use; and</text>
						</subparagraph><subparagraph id="IDa98886b648fa401b832dc7e47fe888a8"><enum>(K)</enum><text>if appropriate,
		authorize  the WaterSense label for use on   products that are labeled by the
		Energy Star program implemented by the Administrator and the Secretary of
		Energy.</text>
						</subparagraph></paragraph><paragraph id="IDcdd07b619df046aab3ba5f0676cc043a"><enum>(3)</enum><header>Authorization
		of appropriations</header><text>There are authorized to be appropriated to
		carry out this section—</text>
						<subparagraph id="id053BC97A193742F19A8A7FBADE1F58DC"><enum>(A)</enum><text>$5,000,000 for
		fiscal year 2015;</text>
						</subparagraph><subparagraph id="id9294440A97B74FBFB689E02416F1B6AA"><enum>(B)</enum><text>$10,000,000 for
		fiscal year 2016;</text>
						</subparagraph><subparagraph id="id068C17F460F548E0823EB149125FA063"><enum>(C)</enum><text>$15,000,000 for
		fiscal year 2017;</text>
						</subparagraph><subparagraph id="idC131B9B318D8408CB0D2DD3AB86118AA"><enum>(D)</enum><text>$20,000,000 for
		fiscal year 2018; and</text>
						</subparagraph><subparagraph id="idF52AA5C6A51743C6A818E4C48A92FA3B"><enum>(E)</enum><text>for each
		subsequent fiscal year, the applicable amount for the preceding fiscal year, as
		adjusted to reflect changes for the 12-month period ending the preceding
		November 30 in the Consumer Price Index for All Urban Consumers published by
		the Bureau of Labor Statistics of the Department of Labor.</text>
						</subparagraph></paragraph></subsection><subsection id="id10391E7845D648E2AD16C5003E4F38BD"><enum>(b)</enum><header>State
		residential water efficiency and conservation incentives program</header>
					<paragraph id="ID61100c148ae84ff1838c6c3c0edf6b6b"><enum>(1)</enum><header>Definitions</header><text>In
		this subsection:</text>
						<subparagraph id="HCD65F98E75CE4B029C8051B8A7ABB276"><enum>(A)</enum><header>Eligible
		entity</header><text>The term <term>eligible entity</term> means a State
		government, local or county government, tribal government, wastewater or
		sewerage utility, municipal water authority, energy utility, water utility, or
		nonprofit organization that meets the requirements of paragraph (2).</text>
						</subparagraph><subparagraph id="HBC5C2275459742FD8175B593D7F66084"><enum>(B)</enum><header>Incentive
		program</header><text>The term <term>incentive program</term> means a program
		for administering financial incentives for consumer purchase and installation
		of water-efficient products, buildings (including new water-efficient homes),
		landscapes, processes, or services described in paragraph (2)(A).</text>
						</subparagraph><subparagraph id="ID5b332fd7456d4b6ab5839c8c620368eb"><enum>(C)</enum><header>Residential
		water-efficient product, building, landscape, process, or service</header>
							<clause id="idEF7D12B15EBA4587AC3029792ED34F78"><enum>(i)</enum><header>In
		general</header><text>The term <term>residential water-efficient product,
		building, landscape, process, or service</term> means a product, building,
		landscape, process, or service for a residence or its landscape that is rated
		for water efficiency and performance—</text>
								<subclause id="IDcf9a0909f3b547849bcd3502a0518aab"><enum>(I)</enum><text>by
		the WaterSense program; or</text>
								</subclause><subclause id="idF05166D2AA3349209D91E055AD490466"><enum>(II)</enum><text>if
		a WaterSense specification does not exist, by the Energy Star program or an
		incentive program approved by the Administrator.</text>
								</subclause></clause><clause id="IDb346a412dfc647789f50b639b1aebc25"><enum>(ii)</enum><header>Inclusions</header><text>The
		term <term>residential water-efficient product, building, landscape, process,
		or service</term> includes—</text>
								<subclause id="id35A4B8EA15AE41D1AE3ADC2AEA403605"><enum>(I)</enum><text>faucets;</text>
								</subclause><subclause id="id5885F25249CC4A5AABCC6C3442C5890D"><enum>(II)</enum><text>irrigation
		technologies and services;</text>
								</subclause><subclause id="idA5DF563BBB7E46E996886CD9BE2E1931"><enum>(III)</enum><text>point-of-use
		water treatment devices;</text>
								</subclause><subclause id="id66C8E97A7B0E41F3BD187986924DBB9D"><enum>(IV)</enum><text>reuse and
		recycling technologies;</text>
								</subclause><subclause id="id67363C09A7774F69BD60F495AB2E0690"><enum>(V)</enum><text>toilets;</text>
								</subclause><subclause id="idE93566EA563A4BACB02C6DFD78AB6F8A"><enum>(VI)</enum><text>clothes
		washers;</text>
								</subclause><subclause id="idBA5767449198421EBC0E6BB1C78C95B9"><enum>(VII)</enum><text>dishwashers;</text>
								</subclause><subclause id="idC11D811C87C74D8EB0EC5EA8C224387B"><enum>(VIII)</enum><text>showerheads;</text>
								</subclause><subclause id="id094CA6106EB347A1B1D5F911307757AC"><enum>(IX)</enum><text>xeriscaping and
		other landscape conversions that replace irrigated turf;</text>
								</subclause><subclause id="id2D3357D998E248DBBBBD78BCAF929535"><enum>(X)</enum><text>new
		water efficient homes certified under the WaterSense program;</text></subclause><subclause id="id8056f272231e44e1abcea26c8b422328"><enum>(XI)</enum><text>green stormwater installations such as permeable pavement, rain gardens, rain barrels, and green
			 roofs;</text></subclause><subclause id="iddf34600c7de14f65b47fc341f716a3be"><enum>(XII)</enum><text>composting solutions complementary to water use and water quality; and</text></subclause><subclause id="id20e82ed80cfa431b84cb2603d6086051"><enum>(XIII)</enum><text>other water-efficient products, services, processes, or behavioral water efficiency solutions that
			 address the objectives of the WaterSense program.</text></subclause></clause></subparagraph><subparagraph id="ID41f035fa7f51401da3b942c9423c14fa"><enum>(D)</enum><header>WaterSense
		program</header><text>The term <term>WaterSense program</term> means the
		program established by subsection (a).</text>
						</subparagraph></paragraph><paragraph id="IDdbcd295bdb0f4fada7868f826ae97131"><enum>(2)</enum><header>Eligible
		entities</header><text>An entity shall be eligible to receive an allocation
		under paragraph (3) if the entity—</text>
						<subparagraph id="IDaba2cda3a8e24c50980dda432bb168e3"><enum>(A)</enum><text>establishes (or
		has established) an incentive program to provide financial incentives to
		residential consumers for the purchase of residential water-efficient products,
		buildings, landscapes, processes, or services;</text>
						</subparagraph><subparagraph id="ID3994637a9a3a45ac8d60b36d2f14a6d1"><enum>(B)</enum><text>submits an
		application for the allocation at such time, in such form, and containing such
		information as the Administrator may require; and</text>
						</subparagraph><subparagraph id="ID20f06f9cdbf44e7d80b63afbf6dd60d7"><enum>(C)</enum><text>provides
		assurances satisfactory to the Administrator that the entity will use the
		allocation to supplement, but not supplant, non-Federal funds made available to
			 carry out
		the incentive program.</text>
						</subparagraph></paragraph><paragraph id="ID1c8f22471e5a4f20a85237c2b625f4aa"><enum>(3)</enum><header>Amount of
		allocations</header><text>For each fiscal year, the Administrator shall
		determine the amount to allocate to each eligible entity to carry out paragraph
		(4), taking into consideration—</text>
						<subparagraph id="IDed3f9a96c7744e87861fb5acac156596"><enum>(A)</enum><text>the population
		served by the eligible entity during the most recent calendar year for which
		data are available;</text>
						</subparagraph><subparagraph id="IDf863e89ad34a4960adf9a29c068f4308"><enum>(B)</enum><text>the targeted
		population of the incentive program of the eligible entity, such as general
		households, low-income households, or first-time homeowners, and the probable
		effectiveness of the incentive program for that population;</text>
						</subparagraph><subparagraph id="ID39f67a12b52f4538b7605d231901277d"><enum>(C)</enum><text>for existing
		programs, the effectiveness of the program in encouraging the adoption of
		water-efficient products, buildings, landscapes, facilities, processes, and
		services;</text>
						</subparagraph><subparagraph id="IDdb33243af08145b5b25524dfecdfdd8d"><enum>(D)</enum><text>any allocation to
		the eligible entity for a preceding fiscal year that remains unused; and</text>
						</subparagraph><subparagraph id="id2BB8FF222D6B42DD9A48D007B25071DC"><enum>(E)</enum><text>the per capita
		water demand of the population served by the eligible entity during the most
		recent calendar year for which data are available and the availability or
			 reliability of
		water supplies to the eligible entity.</text>
						</subparagraph></paragraph><paragraph id="ID50734ac87af24806998c296380016b48"><enum>(4)</enum><header>Use of
		allocated funds</header><text>Funds allocated to an eligible entity under
		paragraph (3) may be used to pay up to 50 percent of the cost of establishing
		and carrying out an incentive program.</text>
					</paragraph><paragraph id="ID96e27f8ade614805a8f4ffdbc8ad90b2"><enum>(5)</enum><header>Issuance of
		incentives</header>
						<subparagraph id="id149C6E17672041309C7B95C52DB050A2"><enum>(A)</enum><header>In
		general</header><text>Financial incentives may be provided to residential
		consumers that meet the requirements of the applicable incentive
		program.</text>
						</subparagraph><subparagraph id="idDD62157CE3F744D5BEA34E2F25BB0E82"><enum>(B)</enum><header>Manner of
		issuance</header><text>An eligible entity may—</text>
							<clause id="idA1FF62A4C0C24B26A3FC98807A2928ED"><enum>(i)</enum><text>issue
		all financial incentives directly to residential consumers; or</text>
							</clause><clause id="idF5EE604029494BB5826003BD4BB61931"><enum>(ii)</enum><text>with
		approval of the Administrator, delegate all or part of financial incentive
		administration to other organizations, including local governments, municipal
		water authorities, water utilities, and nonprofit organizations.</text>
							</clause></subparagraph><subparagraph id="idDA58B3081475471E8BECAF05C8F0E51F"><enum>(C)</enum><header>Amount</header><text>The
		amount of a financial incentive shall be determined by the eligible entity,
		taking into consideration—</text>
							<clause id="IDf58d2cab4c6842f7ab424716cd5c21d5"><enum>(i)</enum><text>the
		amount of any Federal or State tax incentive available for the purchase of the
		residential water-efficient product or service;</text>
							</clause><clause id="ID6de55c5463ac4cca932d21fb8bc898a1"><enum>(ii)</enum><text>the
		amount necessary to change consumer behavior to purchase water-efficient
		products and services; and</text>
							</clause><clause id="IDd56a8a08a1be4f9c8c9ec162940d0685"><enum>(iii)</enum><text>the
		consumer expenditures for onsite preparation, assembly, and original
		installation of the product.</text>
							</clause></subparagraph></paragraph><paragraph id="idDD802340C0D84B11A576620D123013D6"><enum>(6)</enum><header>Authorization
		of appropriations</header><text>There are authorized to be appropriated to the
		Administrator to carry out this subsection—</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id276A028D1DE24FCB82F5B77466CCDAA8"><enum>(C)</enum><text display-inline="yes-display-inline">$200,000,000 for fiscal year 2017;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id05A8CD48C4AD41D8A59D2D48B812C5C1"><enum>(D)</enum><text display-inline="yes-display-inline">$150,000,000 for fiscal year 2018;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id689C76215FB3458194B57581E3B308DD"><enum>(E)</enum><text>$100,000,000 for
		fiscal year 2019; and</text>
						</subparagraph><subparagraph id="idFBDA7E38B9504D2A9B7E9D8DF0BC2D30"><enum>(F)</enum><text>for each
		subsequent fiscal year, the applicable amount for the preceding fiscal year, as
		adjusted to reflect changes for the 12-month period ending the preceding
		November 30 in the Consumer Price Index for All Urban Consumers published by
		the Bureau of Labor Statistics of the Department of Labor.</text>
						</subparagraph></paragraph></subsection><subsection id="idE74F80917CC34BF3876627462BB5D010"><enum>(c)</enum><header>Water system mitigation and adaptation grants</header>
					<paragraph id="ID6f621a61ac044aef8508882803e72476"><enum>(1)</enum><header>Definitions</header><text>In
		this subsection:</text>
						<subparagraph id="ID9721832e4498407ea701cc17b33d75b6"><enum>(A)</enum><header>Owner or
		operator</header>
							<clause id="id86C9E74049204B23B0F41B58550645AF"><enum>(i)</enum><header>In
		general</header><text>The term <term>owner or operator</term> means a person
		(including a regional, State, local, municipal, or private entity) that owns or
		operates a water system.</text>
							</clause><clause id="id9C735A57487F4EBE9E1DEB5AB94616AE"><enum>(ii)</enum><header>Inclusion</header><text>The
		term <term>owner or operator</term> includes a non-Federal entity that has
		operational responsibilities for a federally owned water system.</text>
							</clause></subparagraph><subparagraph id="IDdc6925dd06fc4449ae4dfb7d867bca2b"><enum>(B)</enum><header>Water
		system</header><text>The term <term>water system</term> means—</text>
							<clause id="id2ED11EDC1AC44861B10A69E50104CAB3"><enum>(i)</enum><text>a
		community water system (as defined in section 1401 of the Safe Drinking Water
		Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>));</text>
							</clause><clause id="idC09F4EB427B04763BBCB3F6EEF71C5A4"><enum>(ii)</enum><text>a
		publicly owned treatment works (as defined in section 212 of the Federal Water
		Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>)), including a municipal separate storm
		sewer system;</text>
							</clause><clause id="id9280C103CAEB4F8F9CB543387E8891CE"><enum>(iii)</enum><text>a
		decentralized wastewater treatment system for domestic sewage;</text>
							</clause><clause id="ID1409903c089c4560a131ad59ffa8542e"><enum>(iv)</enum><text>a
		groundwater storage and replenishment system; or</text>
							</clause><clause id="IDc95d5e20ad674054ae21e11a6e0d7f4d"><enum>(v)</enum><text>a
		system for transport and delivery of water for irrigation or
		conservation.</text>
							</clause></subparagraph></paragraph><paragraph id="IDc22baf777d2f46b2a4e25794abd9584e"><enum>(2)</enum><header>Grants</header><text>Beginning
		in fiscal year 2015, the Administrator shall make grants to owners or operators
		of water systems to address any ongoing or forecasted (based on the best
		available research and data) climate-related impact on the water quality or
		quantity of a region of the United States, for the purposes of mitigating or
		adapting to the impacts of climate change.</text>
					</paragraph><paragraph id="IDd479716a0af8452298f9d36a744304d1"><enum>(3)</enum><header>Eligible
		uses</header><text>In carrying out this subsection, the Administrator shall
		make grants to assist in the planning, design, construction, implementation, or
		maintenance of any program or project to increase the resilience of a water
		system to climate change by—</text>
						<subparagraph id="ID50794b877d66465ab280ae5f28d86547"><enum>(A)</enum><text>conserving water
		or enhancing water use efficiency, including through the use of water metering
		to measure the effectiveness of a water efficiency program;</text>
						</subparagraph><subparagraph id="id4FF30D51CE65442797A61608C3C34A22"><enum>(B)</enum><text>modifying or
		relocating existing water system infrastructure made or projected to be made
		inoperable by climate change impacts;</text>
						</subparagraph><subparagraph id="ID65b9926ea68d42dfa45a28dad20e1605"><enum>(C)</enum><text>preserving or
		improving water quality, including through measures to manage, reduce, treat,
		or reuse municipal stormwater, wastewater, or drinking water;</text>
						</subparagraph><subparagraph id="ID7b33846d981244859493850d24a9fa3f"><enum>(D)</enum><text>investigating,
		designing, or constructing groundwater remediation, recycled water, or
		desalination facilities or systems;</text>
						</subparagraph><subparagraph id="IDd679e4abe9fd4056a92b17f4d7d8417a"><enum>(E)</enum><text>enhancing water
		management by increasing watershed preservation and protection, such as through
		the use of natural or engineered green infrastructure in the management,
		conveyance, or treatment of water, wastewater, or stormwater;</text>
						</subparagraph><subparagraph id="IDcf576566bca54fb5989533640f434322"><enum>(F)</enum><text>enhancing energy
		efficiency or the use and generation of renewable energy in the management,
		conveyance, or treatment of water, wastewater, or stormwater;</text>
						</subparagraph><subparagraph id="IDac55aa79c53b47d6bf6f1cfd8f569faa"><enum>(G)</enum><text>supporting the
		adoption and use of advanced water treatment, water supply management (such as
		reservoir reoperation), or water demand management technologies, projects, or
		processes (such as water reuse and recycling or adaptive conservation pricing)
		that maintain or increase water supply or improve water quality;</text>
						</subparagraph><subparagraph id="IDabef70bdecb048a38c5982cb35936b64"><enum>(H)</enum><text>modifying or
		replacing existing systems or constructing new systems for existing communities
		or land currently in agricultural production to improve water availability,
		storage, or conveyance in a manner that—</text>
							<clause id="id4D46BEEB12C54224AD162FD8C4DB2FC1"><enum>(i)</enum><text>promotes more
		efficient use of available water supplies; and</text>
							</clause><clause id="id219D03F27FD4405C94A9659779CB4EA8"><enum>(ii)</enum><text>does
		not further exacerbate stresses on ecosystems;</text>
							</clause></subparagraph><subparagraph id="id059BDC69650F4878914355F07224688E"><enum>(I)</enum><text>supporting
		practices and projects, such as improved irrigation systems, water banking and
		other forms of water transactions, groundwater recharge, stormwater capture,
		and reuse or recycling of drainage water, to improve water quality or promote
		more efficient water use, including on land currently in agricultural
		production;</text>
						</subparagraph><subparagraph id="ID5f0edf6cdee4466bba3baf6a17859796"><enum>(J)</enum><text>conducting and
		completing studies or assessments to project how climate change may impact the
		future operations and sustainability of water systems;</text>
						</subparagraph><subparagraph id="idB22302C03208430FACF60D1C108CB538"><enum>(K)</enum><text>developing and
		implementing mitigation measures to rapidly address impacts on water systems
		most susceptible to abrupt climate change, including those in the Colorado
		River Basin and coastal regions at risk from rising sea levels; or</text></subparagraph><subparagraph id="id6fdae1284df84ae09869986452fcf4e9"><enum>(L)</enum><text>funding of transactions costs and credit enhancement for pay-for-performance-based public-private
			 initiatives intended to advance the eligible uses of the program or
			 project.</text></subparagraph></paragraph><paragraph id="IDc08e7e5cba184ed3ba75a9339be78919"><enum>(4)</enum><header>Application</header><text>To
		be eligible to receive a grant from the Administrator under paragraph (2), the
		owner or operator of a water system shall submit to the Administrator an
		application that—</text>
						<subparagraph id="IDeafbbabab16c42e68f5c25ee4233b8a8"><enum>(A)</enum><text>includes a
		proposal of the program, strategy, or infrastructure improvement to be planned,
		designed, constructed, implemented, or maintained by the water system;</text>
						</subparagraph><subparagraph id="ID5734395f1d824eb2aebf944981ae0df8"><enum>(B)</enum><text>cites the best
		available research or data that demonstrates—</text>
							<clause id="IDc733e9dc17484dbbb4a609ae0cfed501"><enum>(i)</enum><text>the
		risk to the water resources or infrastructure of the water system as a result
		of ongoing or forecasted changes to the hydrological system brought about by
		factors arising from climate change, including rising sea levels and changes in
		precipitation levels; and</text>
							</clause><clause id="ID3eb2ecc4345d405f81d2b612e5a7f1ed"><enum>(ii)</enum><text>how
		the proposed program, strategy, or infrastructure improvement would perform
		under the anticipated climate conditions;</text>
							</clause></subparagraph><subparagraph id="ID57d43341a7e14e9aba0c2bc7931cd315"><enum>(C)</enum><text>explains how the
		proposed program, strategy, or infrastructure improvement is expected to
		enhance the resiliency of the water system, including source water protection
		for community water systems, to these risks or reduce the direct or indirect
		greenhouse gas emissions of the water system; and</text>
						</subparagraph><subparagraph id="IDbd2fc496a7f74579a547ca8719a2d1b9"><enum>(D)</enum><text>demonstrates that
		the program, strategy, or infrastructure improvement is—</text>
							<clause id="idB8569B50CD9F45C685E52FAAB8C044CF"><enum>(i)</enum><text>consistent with
		any approved State and tribal climate adaptation plan; and</text>
							</clause><clause id="idF04134A04B5E4FF39ACD526C56766C14"><enum>(ii)</enum><text>not
		inconsistent with any approved natural resources plan.</text>
							</clause></subparagraph></paragraph><paragraph id="IDb01ae4bb16784b559aa57d97e6e5b9cf"><enum>(5)</enum><header>Competitive
		process</header>
						<subparagraph id="id8E24A3E25AED4FFDA03E358A2E3EC2EA"><enum>(A)</enum><header>In
		general</header><text>Each calendar year, the Administrator shall conduct a
		competitive process to select and fund applications under this
		subsection.</text>
						</subparagraph><subparagraph id="id0FC4D28118484539831DC6D7C4014420"><enum>(B)</enum><header>Priority
		requirements and weighting</header><text>In carrying out the process, the
		Administrator shall—</text>
							<clause id="ID7ca01c918b7d4b05b83014e47092276b"><enum>(i)</enum><text>prioritize
		funding of applications that are submitted by the owners or operators of water
		systems that are, based on the best available research and data, at the
		greatest and most immediate risk of facing significant climate-related negative
		impacts on water quality or quantity;</text>
							</clause><clause id="id576C104B695241F2855B297FAAF1FDF4"><enum>(ii)</enum><text>in
		selecting among the priority applications determined under clause (i), ensure
		that the final list of applications funded for each year includes a substantial
		number that, to the maximum extent practicable, includes each eligible use
		described in paragraph (3);</text>
							</clause><clause id="IDb0e19ab5581a40fd90d79302f0842748"><enum>(iii)</enum><text>solicit
		applications from water systems that are—</text>
								<subclause id="IDbc9736436476458c9912e9bf9a2a3cab"><enum>(I)</enum><text>located in all
		regions of the United States; and</text>
								</subclause><subclause id="IDfa6273dded19467fb119f5dac864c276"><enum>(II)</enum><text>facing varying
		risks as a result of climate change; and</text>
								</subclause></clause><clause id="ID5c483a5d49a441a2afed252cb92cbd2f"><enum>(iv)</enum><text>provide for
		solicitation and consideration of public input in the development of criteria
		used in evaluating applications.</text>
							</clause></subparagraph></paragraph><paragraph id="IDae609bdffb6144b681e30b95117040df"><enum>(6)</enum><header>Cost
		sharing</header>
						<subparagraph id="ID29af94e7d5f14e8eaaf410a95d06336f"><enum>(A)</enum><header>Federal
		share</header><text>The Federal share of the cost of any program, strategy, or
		infrastructure improvement that is the subject of a grant awarded by the
		Administrator to a water system under paragraph (2) shall not exceed 50 percent
		of the cost of the program, strategy, and infrastructure improvement.</text>
						</subparagraph><subparagraph id="ID6498d5e9e03b4b899c1ed1e9d5595e79"><enum>(B)</enum><header>Calculation of
		non-Federal share</header><text>In calculating the non-Federal share of the
		cost of a program, strategy, or infrastructure improvement proposed by a water
		system through an application submitted by the water system under paragraph
		(4), the Administrator shall—</text>
							<clause id="ID13c5d1a58ba54bf9a939220a43b16352"><enum>(i)</enum><text>include
		the value of any in-kind services that are integral to the completion of the
		program, strategy, or infrastructure improvement, as determined by the
		Administrator; and</text>
							</clause><clause id="IDdeb4190823284da0bde621706ce67e5b"><enum>(ii)</enum><text>not
		include any other amount that the water system receives from a Federal
		agency.</text>
							</clause></subparagraph></paragraph><paragraph id="IDe4e9d1a33e174b6a984ac6e18463b749"><enum>(7)</enum><header>Labor
		standards</header>
						<subparagraph id="id49F62926D54A4105915B06DC58112E8B"><enum>(A)</enum><header>In
		general</header><text>All laborers and mechanics employed on infrastructure
		improvements funded directly by or assisted in whole or in part by this
		subsection shall be paid wages at rates not less than those prevailing for the
		same type of work on similar construction in the immediate locality, as
		determined by the Secretary of Labor in accordance with subchapter IV of
		chapter 31 of part A of subtitle II of title 40, United States Code.</text>
						</subparagraph><subparagraph id="id9237BF21A9E84CAABF4C37EB5380AAE0"><enum>(B)</enum><header>Authority and
		functions</header><text>With respect to the labor standards in this paragraph,
		the Secretary of Labor shall have the authority and functions set forth in
		Reorganization Plan Numbered 14 of 1950 (64 Stat. 1267; 5 U.S.C. App.) and
		<external-xref legal-doc="usc" parsable-cite="usc/40/3145">section 3145</external-xref> of title 40, United States Code.</text></subparagraph></paragraph><paragraph id="ide07fdb556b09434fa8187b4cd65414a3"><enum>(8)</enum><header>Local hiring</header><subparagraph id="id68de63a2f43f4e93a281f4379a768f3d"><enum>(A)</enum><header>In general</header><text>The recipient of assistance may advertise and award a contract for construction containing
			 requirements for the employment of individuals residing in or adjacent to
			 any of the areas in which the work is to be performed under the contract,
			 if—</text><clause id="idd1e30fc0c86241c297f5859e6ecc93e9"><enum>(i)</enum><text>all or part of the construction work performed under the contract occurs in an area that has—</text><subclause id="id1ebfb85e6cc542aab051f26a950dd501"><enum>(I)</enum><text>a per capita income of 80 percent or less of the national average per capita income; or</text></subclause><subclause id="id809a6643f2d14791a21970effda5bcd0"><enum>(II)</enum><text>an unemployment rate that is, for the most recent 24-month period for which data are available, at
			 least 1 percent greater than the national average unemployment rate;</text></subclause></clause><clause id="id9836f1d26be74cfe8b7d4c27a3f35e5d"><enum>(ii)</enum><text>the estimated cost of the project of which the contract is a part is greater than $1,000,000; and</text></clause><clause id="id11dfbccc405346bba72fd06f2111c600"><enum>(iii)</enum><text>the recipient does not hire individuals who do not have the necessary skills to
			 perform work in the applicable craft or trade, except for individuals who
			 are subject
			 to an apprenticeship program or other training program meeting, as
			 determined by the Secretary.</text></clause></subparagraph><subparagraph id="id997434cb80504e5aa333c7e9cc052696"><enum>(B)</enum><header>Advertisement</header><text>In advertising and awarding a contract under this subsection, the Secretary or recipient of
			 assistance shall ensure that the requirements contained in the
			 advertisement would not—</text><clause id="id84cbc57b1dfb499b84ed2f45c75383af"><enum>(i)</enum><text>compromise the quality of the project;</text></clause><clause id="id2b5f6b4d97f5426d93cc1a61b8ee5d5a"><enum>(ii)</enum><text>unreasonably delay the completion of the project; or</text></clause><clause id="id7ec497a41d3947f49aef9294ef58c2f7"><enum>(iii)</enum><text>unreasonably increase the cost of the project.</text></clause></subparagraph></paragraph><paragraph id="id9901bedf3c2e4eef831fe83fc5da00ac"><enum>(9)</enum><header>Efficient, integrated procurement for programs jointly funded with the Department of Housing and
			 Urban Development</header><subparagraph id="id5f677351044547aea6a6cc9a647b20c5"><enum>(A)</enum><header>Definition of eligible project</header><text>In this paragraph, the term <term>eligible project</term> means a project for which the amount of funding provided by the Department of Housing and Urban
			 Development is
			 10 percent or more of the amount of funding provided under this
			 subsection.</text></subparagraph><subparagraph id="idb165770516cc46fab7dbbd81072ca091"><enum>(B)</enum><header>Preferences</header><text>Notwithstanding the competitive bidding requirements of this section (including regulations),
			 in the case of an eligible project funded jointly with funding provided by
			 the
			 Department of Housing and Urban Development that is covered by section 3
			 of the Housing and Urban Development Act of 1968 (82 Stat. 846; 12 U.S.C.
			 1701u), a contracting agency
			 may apply the preferences required for the funding by the Department of
			 Housing and Urban Development under section 3 of that Act (including
			 regulations) with respect to the funding,
			 to the elements of the project funded in any part under this subsection.</text></subparagraph><subparagraph id="id3a54bebd539e4d0692746f489576dbf5"><enum>(C)</enum><header>Permissible restrictions</header><text>A State or local law governing contracting practices that prohibits the awarding of contracts to
			 businesses that have solicited or made contributions to political
			 candidates, political parties, and holders of public office shall not be
			 considered a violation of this section.</text></subparagraph></paragraph><paragraph id="ID183bf334c5ae4a0ba4de40bd359dcee2"><enum>(10)</enum><header>Regulations</header>
						<subparagraph id="ID7e8934d1257f4cf2bc79ef833c61fa08"><enum>(A)</enum><header>In
		general</header><text>Not later than 1 year after the date of enactment of this
		Act, the Administrator shall promulgate final regulations to carry out this
		subsection.</text>
						</subparagraph><subparagraph id="IDabf9f72bdc604c80ab2f324d7cedbd4e"><enum>(B)</enum><header>Special rule
		for the construction of treatment works</header><text>In carrying out this
		paragraph, the Administrator shall incorporate all relevant and appropriate
		requirements of title VI of the Federal Water Pollution Control Act (33 U.S.C.
		1381 et seq.) applicable to the construction of treatment works that are
		carried out under this subsection.</text>
						</subparagraph></paragraph><paragraph id="ID973a4e382b78401b8a9e115d7609cc6e"><enum>(11)</enum><header>Report to
		Congress</header><text>Not later than 3 years after the date of enactment of
		this Act, and every 3 years thereafter, the Administrator shall submit to Congress
			 a report on progress in implementing this subsection, including
		information on project applications received and funded annually.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9763ef260fcc4bf6a65bff4b9e78e3f5"><enum>(12)</enum><header>Authorization
		of appropriations</header><text>There are authorized to be appropriated to
		carry out this subsection such sums as are necessary.</text></paragraph></subsection></section></title><title id="id032CC06F2BE54D278A29B450B4F7E170" style="OLC"><enum>II</enum><header>Recycling, storage, and integrated water management</header><section id="H002714CF82DB4F5BB4384F1945980E9F"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="H2B1296D83BAB4F8B9B1D05B70C5D8641"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H51565597428E4DEF8FAF953AC5F4618C"><enum>(A)</enum><text>a corporation;</text>
					</subparagraph><subparagraph id="HA62E06E1DCF34FAC92A604610E808815"><enum>(B)</enum><text>a partnership;</text>
					</subparagraph><subparagraph id="HA250D7246AC74D0D8D8B5F5547B01712"><enum>(C)</enum><text>a joint venture;</text>
					</subparagraph><subparagraph id="H9D236185AB184EBC84EA83EC30E0D361"><enum>(D)</enum><text>a trust;</text>
					</subparagraph><subparagraph id="HF7CC127D1A164E87B821A8D6F2310CB8"><enum>(E)</enum><text>a Federal, State, or local governmental entity, agency, or instrumentality; and</text>
					</subparagraph><subparagraph id="HEE3E990AF76D4131BA74AD34EB9203B1"><enum>(F)</enum><text>a conservancy district, irrigation district, canal company, mutual water company, water users’
			 association, Indian tribe, agency created by interstate compact, or any
			 other entity that has the capacity to contract with the United States
			 under Federal reclamation law.</text></subparagraph></paragraph><paragraph id="idA119E5CBB95F41E89B7FDD1472B5CB6D"><enum>(2)</enum><header>Federal credit instrument</header><text>The term <term>Federal credit instrument</term> means a secured loan, loan guarantee, or other credit enhancement  authorized to be made available
			 under this title with
			 respect to a project.</text>
				</paragraph><paragraph id="H96EE65A68C764FA1BA96864F7386E5F9"><enum>(3)</enum><header>Investment-grade rating</header><text>The term <term>investment-grade rating</term> means a rating of BBB minus, Baa3, bbb minus, BBB (low), or higher as assigned by a rating agency
			 to project obligations.</text>
				</paragraph><paragraph id="H7D5927653923482B9DA6DC3F8520B99E"><enum>(4)</enum><header>Lender</header>
					<subparagraph id="H121B852C8D664986B4813BAB14D0CB81"><enum>(A)</enum><header>In general</header><text>The term <term>lender</term> means any non-Federal qualified institutional buyer (as defined in section 230.144A(a) of title
			 17, Code of Federal Regulations (or a successor regulation) (commonly
			 known as <quote>Rule
			 144A(a) of the Securities and Exchange Commission</quote> and issued under the
			 Securities Act of 1933 (<external-xref legal-doc="usc" parsable-cite="usc/15/77a">15 U.S.C. 77a et seq.</external-xref>))).</text>
					</subparagraph><subparagraph id="HBF65A439FC2B4DEAA168BAF81484BC69"><enum>(B)</enum><header>Inclusions</header><text>The term <term>lender</term> includes—</text>
						<clause id="HDCB4EB9F200643C1AF161BA522256677"><enum>(i)</enum><text>a qualified retirement plan (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/4974">section 4974</external-xref> of the Internal Revenue Code of 1986)
			 that is a qualified institutional buyer; and</text>
						</clause><clause id="H91B64499D9F746A48F9A9EB810BA629E"><enum>(ii)</enum><text>a governmental plan (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/414">section 414</external-xref> of the Internal Revenue Code of 1986) that is a
			 qualified institutional buyer.</text>
						</clause></subparagraph></paragraph><paragraph id="HAB14E7D05A734C579713BE11BA21724F"><enum>(5)</enum><header>Loan guarantee</header><text>The term <term>loan guarantee</term> means any guarantee or other pledge by the Secretary to pay all or part of the principal of, and
			 interest on, a loan or other debt obligation issued by an obligor and
			 funded by a lender.</text>
				</paragraph><paragraph id="H0914B67FDC5E48B2944F1FF5D5390AE3"><enum>(6)</enum><header>Obligor</header><text>The term <term>obligor</term> means an eligible entity that is primarily liable for payment of the principal of, or interest on,
			 a Federal credit instrument.</text>

					</subparagraph><subparagraph id="HC0396CBD2F734422AAC9EF2D3577F720"><enum>(B)</enum><header>Exclusion</header><text>The term <term>project obligation</term> does not include a Federal credit instrument.</text>
					</subparagraph></paragraph><paragraph id="H186EC7BA848748F08C940AD9F02062B8"><enum>(8)</enum><header>Rating agency</header><text>The term <term>rating agency</term> means a credit rating agency registered with the Securities and Exchange Commission as a
			 nationally recognized statistical rating organization (as defined in

			 connection with the financing of a project under subtitle A.</text>
				</paragraph><paragraph id="HDE25A0670F424C19A535B14445FEB008"><enum>(12)</enum><header>Subsidy amount</header><text>The term <term>subsidy amount</term> means the amount of budget authority sufficient to cover the estimated long-term cost to the
			 Federal Government of a Federal credit instrument, as calculated on a net
			 present value basis, excluding administrative costs and any incidental
			 effects on Governmental receipts or outlays in accordance with the Federal
			 Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661">2 U.S.C. 661 et seq.</external-xref>).</text>
				</paragraph><paragraph id="HDCD39FC9B8C941EFB3A7E3DF29284C98"><enum>(13)</enum><header>Substantial completion</header><text>The term <term>substantial completion</term>, with respect to a project, means the earliest date on which a project is considered to perform
			 the functions for which the project is designed.</text></paragraph></section><subtitle id="HBC32036BF9A64F4FA90237BED0B1AD4C"><enum>A</enum><header>Innovative financing</header>
				<section id="H251C572EE329485692326005A627172E"><enum>211.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this subtitle are—</text>
					<paragraph id="H54B432940E5D4CDDA41060B64F153097"><enum>(1)</enum><text>to promote increased development of critical water resources infrastructure by establishing
			 additional
			 opportunities for financing water resources projects;</text>
					</paragraph><paragraph id="H4A2B358DE28F4ECF9AE7A54C5E34E7DC"><enum>(2)</enum><text>to attract new investment capital to infrastructure projects that are capable of generating revenue
			 streams through user fees or other dedicated funding sources;</text>
					</paragraph><paragraph id="HCFEC241817D343E1ADD37868288AF252"><enum>(3)</enum><text>to complement existing Federal funding sources and address budgetary constraints on Bureau of
			 Reclamation programs; and</text>
					</paragraph><paragraph id="HF7944400D2DA42B69C08DF0DB24C39BA"><enum>(4)</enum><text>to leverage private investment in water resources infrastructure.</text>
					</paragraph></section><section id="HE8A1FF96D33B4C398BB6A3EA64CA00FB"><enum>212.</enum><header>Authority to provide assistance</header><subsection id="id51815B8B828F4D25B849466420319210"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may provide financial assistance under this subtitle to carry out projects within—</text><paragraph id="idF814CD4C22684FAAA7E3A1A8BADCA0B8"><enum>(1)</enum><text display-inline="yes-display-inline">any Reclamation State;</text></paragraph><paragraph id="idE47C3CF5372D4714ACCEBAA5869DC5FA"><enum>(2)</enum><text display-inline="yes-display-inline">any other State in which the Bureau of Reclamation is
			 authorized to provide project assistance; and</text></paragraph><paragraph commented="no" id="id86B5AE6FA7EE410D914BF163AE91C6C4"><enum>(3)</enum><text display-inline="yes-display-inline">the States of Alaska and Hawaii.</text></paragraph></subsection><subsection id="id571E02A992054310ABE0606C2E475203"><enum>(b)</enum><header>Selection</header><text display-inline="yes-display-inline">In selecting projects to receive financial assistance under subsection (a), the Secretary shall
			 ensure diversity with respect to—</text><paragraph id="idE0CA6324B3384B44B9A792D94536C982"><enum>(1)</enum><text display-inline="yes-display-inline">project types; and</text></paragraph><paragraph id="id4981B4041432466393FF2F12B558E42B"><enum>(2)</enum><text display-inline="yes-display-inline">geographical locations.</text>
						</paragraph></subsection></section><section id="H6901F92509FA49538E56275ABD340303"><enum>213.</enum><header>Applications</header><text display-inline="no-display-inline">To be eligible to receive assistance under this subtitle, an eligible entity shall submit to the
			 Secretary an
			 application at such time, in such manner, and containing such information
			 as the Secretary may require.</text>
				</section><section id="H5724FCC25B93437A953E30D727FC7DA3"><enum>214.</enum><header>Eligibility for assistance</header><subsection id="id3222E34990C249719BB3515CB202DABE"><enum>(a)</enum><header>Eligible projects</header><text display-inline="yes-display-inline">The following projects may be carried out using assistance made available under this subtitle:</text>
						<paragraph id="H4CC56AC74D664131B5D046D74A521060"><enum>(1)</enum><text>A project for the reclamation and reuse of municipal, industrial, domestic, and agricultural
			 wastewater, and naturally impaired ground and surface waters, which the
			 Secretary, acting through the Commissioner of Reclamation, is
			 authorized to undertake.</text>
						</paragraph><paragraph id="H4DFF36E5A06A4D91998380F5FA653D2F"><enum>(2)</enum><text>Any water infrastructure project not specifically authorized by law that—</text><subparagraph id="idEA43AA1EDD55458DAEB5BA2E919CC221"><enum>(A)</enum><text>the Secretary determines,
			 through the completion of an appraisal investigation and feasibility
			 study, would contribute to a safe, adequate water supply for domestic,
			 agricultural, environmental, or municipal and industrial use; and</text></subparagraph><subparagraph id="idF38634F04405409E839F394483CDDD05"><enum>(B)</enum><text>is
			 otherwise eligible for assistance under this title.</text>
							</subparagraph></paragraph><paragraph id="HF4E24D9F675D435FA745296ED48A27EF"><enum>(3)</enum><text>A project for enhanced energy efficiency in the operation of a water system.</text>
						</paragraph><paragraph id="H4B5AF2770E054C0780C065214A868A6D"><enum>(4)</enum><text>A project for accelerated repair and replacement of an aging water distribution facility.</text>
						</paragraph><paragraph id="HD6D24CD353DF4C3482B57F7FC9D6A2AB"><enum>(5)</enum><text>A brackish or sea water desalination project.</text>
						</paragraph><paragraph id="H8981562BAD9146AF8B5802376A6C89C7"><enum>(6)</enum><text>Acquisition of real property or an interest in real property for water storage, reclaimed or
			 recycled water, or wastewater, if the acquisition is integral to a project
			 described in paragraphs (1) through (5).</text>
						</paragraph><paragraph id="HDE5BDE4455C9455B9FF035A40FE811B1"><enum>(7)</enum><text>A combination of projects, each of which is eligible under paragraphs (1) through (6), for which an
			 eligible entity submits a single application.</text>
						</paragraph></subsection><subsection id="HB6E1C81BC8324F9B824ABEE590B65A95"><enum>(b)</enum><header>Activities eligible for assistance</header><text display-inline="yes-display-inline">For purposes of this subtitle, an eligible activity with respect to an eligible project under
			 subsection (a) includes the
			 cost of—</text>
						<paragraph id="HFED1416027404AC582EA1AEB10B31A51"><enum>(1)</enum><text>development-phase activities, including planning, feasibility analysis, revenue forecasting,
			 environmental review, permitting, transaction costs, preliminary
			 engineering and design work,
			 and other preconstruction activities;</text>
						</paragraph><paragraph id="H26B65E257AE14295963DAAC515066DF2"><enum>(2)</enum><text>construction, reconstruction, rehabilitation, and replacement activities;</text>
						</paragraph><paragraph id="H448504B202804B4CA45AD53C062E3358"><enum>(3)</enum><text>the acquisition of real property (including water rights, land relating to the project, and
			 improvements to land), environmental mitigation, construction
			 contingencies, and acquisition of equipment;</text>
						</paragraph><paragraph id="H555ECC61DFFB45DCAC8C2A222E1D9D4B"><enum>(4)</enum><text>capitalized interest necessary to meet market requirements, reasonably required reserve funds,
			 capital issuance expenses, and other carrying costs during construction;</text>
						</paragraph><paragraph id="H1C2F8D415A9646088DDECB4BC56C3C0B"><enum>(5)</enum><text>refinancing interim construction funding, long-term project obligations, or a secured loan, loan
			 guarantee, or other credit enhancement made under this subtitle;</text></paragraph><paragraph id="iddc3dbd2660f94e8589d28984d467b44f"><enum>(6)</enum><text>reimbursement or success payments to any public or private entity that achieves predetermined
			 outcomes on a pay-for-performance or pay-for-success basis;  and</text></paragraph><paragraph id="idb93d9ace83934f8b818f7929ac1f7802"><enum>(7)</enum><text>grants, loans, or credit enhancement for community development financial institutions, green banks,
			 and other financial intermediaries providing ongoing finance for projects
			 that meet the purposes of this subtitle.</text></paragraph></subsection></section><section id="H2713CB0D3BAD4DE08F3EB490ED4CA7D6"><enum>215.</enum><header>Determination of eligibility and project selection</header>
					<subsection id="H403ABEA2663540219D39A285853D458F"><enum>(a)</enum><header>Eligibility requirements</header><text>To be eligible to receive financial assistance under this subtitle, a project shall meet the
			 following
			 criteria, as determined by the Secretary:</text>
						<paragraph id="H1010300D634B4F549A762EEEF3400920"><enum>(1)</enum><header>Creditworthiness</header>
							<subparagraph id="HAB662E1BF823406CA5810A1CB7717A59"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the project shall be creditworthy, as determined by the
			 Secretary, who shall ensure that any financing for the project has
			 appropriate security features, such as a rate covenant, to ensure
			 repayment.</text>
							</subparagraph><subparagraph id="H665E4652E2CC425C931691482DA7CF62"><enum>(B)</enum><header>Preliminary rating opinion letter</header><text>The Secretary shall require each applicant to provide a preliminary rating opinion letter
			 from at least 1 rating agency indicating that the senior obligations of
			 the project (which may be the Federal credit instrument) have the
			 potential to achieve an investment-grade rating.</text>
							</subparagraph></paragraph><paragraph id="H701D14D209584537BE4CC70F6DC9C03A"><enum>(2)</enum><header>Eligible project costs</header><text>The eligible project costs of a project and other projects in a watershed shall be reasonably
			 anticipated to be not less than
			 $10,000,000.</text>
						</paragraph><paragraph id="HC23C79A22CCC481FA6B79D099DB49E2D"><enum>(3)</enum><header>Dedicated revenue sources</header><text>The Federal credit instrument for the project shall be repayable, in whole or in part, from
			 dedicated revenue sources that also secure the project obligations.</text>
						</paragraph><paragraph id="H5FDD59C33626476DB35B638850ACB4A3"><enum>(4)</enum><header>Public sponsorship of private entities</header><text>In the case of a project carried out by an entity that is not a State or local government or an
			 agency or instrumentality of a State or local government, the project
			 shall be publicly sponsored.</text>
						</paragraph></subsection><subsection id="H8627947FDA944CC58B8E16E64F44BA9A"><enum>(b)</enum><header>Selection criteria</header>
						<paragraph id="H87BBF2D51E474B2DAD8CE3E48B934E43"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish criteria for the selection of projects that meet the eligibility
			 requirements of subsection (a), in accordance with paragraph (2).</text>
						</paragraph><paragraph id="HE0E97DB787C14463AC5171FA32219DAE"><enum>(2)</enum><header>Criteria</header><text>The selection criteria shall include the following:</text>
							<subparagraph id="HE89ED598BB5446C78B454E1FB7BC3F03"><enum>(A)</enum><text>The extent to which the project is nationally or regionally significant.</text>
							</subparagraph><subparagraph id="HF52164172B594476A7AB4FAC54ED851B"><enum>(B)</enum><text>The extent to which assistance under this section would foster innovative public-private
			 partnerships and attract private debt or equity investment.</text>
							</subparagraph><subparagraph id="HFB4CAE2D3FCE4EDEA3B1194A50258497"><enum>(C)</enum><text>The likelihood that assistance under this section would enable the project to proceed at an earlier
			 date than the project would otherwise be able to proceed.</text>
							</subparagraph><subparagraph id="HF5F18530920845A09C3A456BAF52C4A9"><enum>(D)</enum><text>The extent to which the project uses new or innovative approaches.</text></subparagraph><subparagraph id="id17deb5fa568546df9e80c01c000c249d"><enum>(E)</enum><text>The extent to which projects track evidence about the effectiveness of the 1 or more projects
			 financed and
			 the availability of the evidence and project information to the public to
			 facilitate replication.</text></subparagraph><subparagraph id="H891D98001BD64B2488597A7B4C05838D"><enum>(F)</enum><text>The amount of budget authority required to fund the Federal credit instrument made available under
			 this subtitle.</text>
							</subparagraph><subparagraph id="HF4C99CDC2BB84E3485A8CD12F17465AC"><enum>(G)</enum><text>The extent to which the project helps maintain or protect the environment.</text></subparagraph><subparagraph id="idb26989a5f3134b09b5bcbba86dc071be"><enum>(H)</enum><text>The extent to which the project supports the local economy and provides local jobs.</text></subparagraph></paragraph></subsection><subsection id="HC126315E246747B4B627C6CFA8A31CAF"><enum>(c)</enum><header>Receipt of other Federal funding</header><text>Receipt of a Federal grant or contract or other Federal funding to support an eligible project
			 shall not preclude the project from being eligible for assistance
			 under this subtitle.</text>
					</subsection><subsection id="H116141CF5ABF47E69285C4062505355C"><enum>(d)</enum><header>Federal requirements</header><paragraph id="idE44F0D5C82F34E1596279C17F8B9DE48"><enum>(1)</enum><header>Effect of section</header><text display-inline="yes-display-inline">Nothing in this section supersedes the applicability of other requirements of Federal law
			 (including regulations).</text></paragraph><paragraph id="id32A5ADBD4F4E4DE5926C1D486A54E48B"><enum>(2)</enum><header>NEPA</header><text display-inline="yes-display-inline">A Federal action carried out regarding a loan or loan
			 guarantee provided under this subtitle shall not be considered to be a
			 Federal action
			 for purposes of the National Environmental Policy Act of 1969
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text>
						</paragraph></subsection></section><section id="H12C62C3B21694E09B3B2B1087D3264AE"><enum>216.</enum><header>Secured loans</header>
					<subsection id="H37B12162F97D4326B1EDE2E476039EC4"><enum>(a)</enum><header>Agreements</header>
						<paragraph id="HD16F7E9BF7F64FDE93CACAA489BFB96D"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) through (4), the Secretary may enter into agreements with 1 or more
			 obligors to make secured loans, the proceeds of which shall be used—</text>
							<subparagraph id="H40796B5B4E2642E5B0A29EBABC55E03F"><enum>(A)</enum><text>to finance eligible project costs of any project selected under section 206;</text>
							</subparagraph><subparagraph id="H2C20D0E2D09E4C6F83A49984F9529802"><enum>(B)</enum><text>to refinance interim construction financing of eligible project costs of any project selected under
			 section 206; or</text>
							</subparagraph><subparagraph id="HACD9F66C5591431296495A3FEADACA78"><enum>(C)</enum><text>to refinance long-term project obligations or Federal credit instruments, if that refinancing
			 provides
			 additional funding capacity for the completion, enhancement, or expansion
			 of any project that—</text>
								<clause id="H358690D7E58748BE9B8DC70ACE061817"><enum>(i)</enum><text>is selected under section 206; or</text>
								</clause><clause id="HFDEFA799C43F4F8AB8AA00FE377407CB"><enum>(ii)</enum><text>otherwise meets the requirements of section 206.</text>
								</clause></subparagraph></paragraph><paragraph id="H1F9631D711CC4744850C49F6DD9DCCEE"><enum>(2)</enum><header>Limitation on refinancing of interim construction financing</header><text>A secured loan under paragraph (1) shall not be used to refinance interim construction financing
			 under paragraph (1)(B) later than 1 year after the date of substantial
			 completion of the applicable project.</text>
						</paragraph><paragraph id="HC4DD317117F3494EA23B1EA01612396A"><enum>(3)</enum><header>Risk assessment</header><text>Before entering into an agreement under this subsection for a secured loan, the Secretary, in
			 consultation with the Director of the Office of Management and Budget and
			 each rating agency providing a preliminary rating opinion letter under
			 section 206(a)(1)(B), shall determine an appropriate capital reserve
			 subsidy amount for the secured loan, taking into account each such
			 preliminary rating opinion letter.</text>
						</paragraph><paragraph id="H65ECC9698FD2466DA17E6F74D2867C37"><enum>(4)</enum><header>Investment-grade rating requirement</header><text>The execution of a secured loan under this section shall be contingent on receipt by the senior
			 obligations of the project of an investment-grade rating.</text>
						</paragraph></subsection><subsection id="HE39D09EE6FDE47969FCC079876D2C817"><enum>(b)</enum><header>Terms and limitations</header>
						<paragraph id="HFBA25086253D447E8A26D9355A9DF9C8"><enum>(1)</enum><header>In general</header><text>A secured loan provided for a project under this section shall be subject to such terms and
			 conditions, and contain such covenants, representations, warranties, and
			 requirements (including requirements for audits), as the Secretary
			 determines to be appropriate.</text>
						</paragraph><paragraph id="H0B09855BF2804AA08ABBFA5C8F6D359A"><enum>(2)</enum><header>Maximum amount</header><text>The amount of a secured loan under this section shall not exceed the lesser of—</text>
							<subparagraph id="H2F45F9BB26AF46F6BF64BD9DC73B7ACE"><enum>(A)</enum><text>an amount equal to 100 percent of the reasonably anticipated eligible project costs; and</text>
							</subparagraph><subparagraph id="H9C774E39007F497D951522FCB1E24995"><enum>(B)</enum><text>if the secured loan does not receive an investment-grade rating, the amount of the senior project
			 obligations of the project.</text>
							</subparagraph></paragraph><paragraph id="H5820D9671823425FBF0B73BA62CA746F"><enum>(3)</enum><header>Payment</header><text>A secured loan under this section—</text>
							<subparagraph id="HC57DC40D7E3E494784BBB4DFD5386986"><enum>(A)</enum><text>shall be payable, in whole or in part, from State or local taxes, user fees, or other dedicated
			 revenue sources that also secure the senior project obligations of the
			 relevant project;</text>
							</subparagraph><subparagraph id="HBD8665C76C154B34BBD119DF1836EF5C"><enum>(B)</enum><text>shall include a rate covenant, coverage requirement, or similar security feature supporting the
			 project obligations; and</text>
							</subparagraph><subparagraph id="H8D16B8F159A74576B7549CFD94B9B4CF"><enum>(C)</enum><text>may have a lien on revenues described in subparagraph (A), subject to any lien securing project
			 obligations.</text>
							</subparagraph></paragraph><paragraph id="H635B6690DECA4BF09D72F1849F9740E2"><enum>(4)</enum><header>Interest rate</header><text>The interest rate on a secured loan under this section shall be not more than the yield on United
			 States Treasury securities of a similar maturity to the maturity of the
			 secured loan on the date of execution of the loan agreement, as determined
			 by  the Secretary.</text></paragraph><paragraph id="HD9A46941555B43D18FEA3748402D8A44"><enum>(5)</enum><header>Maturity date</header><text>The final maturity date of a secured loan under this section shall be not later than 35 years after
			 the date of substantial completion of the relevant project.</text>
						</paragraph><paragraph id="H79B9D82F2D924ABD82F0792A6842E372"><enum>(6)</enum><header>Nonsubordination</header><text>A secured loan under this section shall not be subordinated to the claims of any holder of project
			 obligations in the event of bankruptcy, insolvency, or liquidation of the
			 obligor of the project.</text>
						</paragraph><paragraph id="H74BB516E5FFF4A6689609B858E46FF22"><enum>(7)</enum><header>Fees</header><text>The Secretary may establish fees at a level sufficient to cover all or a portion of the costs to
			 the Federal Government of making a secured loan under this section.</text>
						</paragraph><paragraph id="HF6EDDCEEB1BA4970BBABB26524411A92"><enum>(8)</enum><header>Non-Federal share</header><text>The proceeds of a secured loan under this section may be used to pay any non-Federal share of
			 project costs required if the loan is repayable from non-Federal funds.</text></paragraph></subsection><subsection id="H84E4A5E0CEBA4888B05ECE3FD0E66D33"><enum>(c)</enum><header>Repayment</header>
						<paragraph id="HD7AED525840E48D4AEF6AA52BF325FDD"><enum>(1)</enum><header>Schedule</header><text>The Secretary shall establish a repayment schedule for each secured loan provided under this
			 section, based on the projected cash flow from project revenues and other
			 repayment sources.</text>
						</paragraph><paragraph id="HFCBA346E17CE47259994FB0A9236A55D"><enum>(2)</enum><header>Commencement</header><text>Scheduled loan repayment of principal or interest on a secured loan under this section shall
			 commence not later than 5 years after the date of substantial
			 completion of the project.</text>
						</paragraph><paragraph id="H5AFE460273E8406BAD8C8346F0821261"><enum>(3)</enum><header>Deferred payments</header>
							<subparagraph id="HF0E31A0528ED441495060C51CEF82DCF"><enum>(A)</enum><header>Authorization</header><text>If, at any time after the date of substantial completion of a project for which a secured loan is
			 provided under this section, the project is unable to generate sufficient
			 revenues to pay the scheduled loan repayments of principal and interest on
			 the secured loan, the Secretary may allow the
			 obligor, subject to subparagraph (C), to add unpaid principal and interest
			 to the outstanding balance of
			 the secured loan.</text>
							</subparagraph><subparagraph id="HD395CB1F47FC47D4967EFE79FD249EB0"><enum>(B)</enum><header>Interest</header><text>Any payment deferred under subparagraph (A) shall—</text>
								<clause id="H4FB3D0047D1545CF80AB0FAA24F2A951"><enum>(i)</enum><text>continue to accrue interest in accordance with subsection (b)(4) until fully repaid; and</text>
								</clause><clause id="H6D0600445DF04307B669674CD14B7775"><enum>(ii)</enum><text>be scheduled to be amortized over the remaining term of the secured loan.</text>
								</clause></subparagraph><subparagraph id="H40C622BE82154E008596E327221B79AC"><enum>(C)</enum><header>Criteria</header>
								<clause id="H503F2C8EA0D2450C818EE92BD0512CFE"><enum>(i)</enum><header>In general</header><text>Any payment deferral under subparagraph (A) shall be contingent on the project meeting such
			 criteria as the Secretary may establish.</text>
								</clause><clause id="HD8E66FCC863E4D9A974A5503E52C7174"><enum>(ii)</enum><header>Repayment standards</header><text>The criteria established under clause (i) shall include standards for reasonable assurance of
			 repayment.</text>
								</clause></subparagraph></paragraph><paragraph id="H775277C7EB4A400EBE4D2A3384A3275C"><enum>(4)</enum><header>Prepayment</header>
							<subparagraph id="HF9C67D0A1A5A4ADB88A54EF96134847C"><enum>(A)</enum><header>Use of excess revenues</header><text>Any excess revenues that remain after satisfying scheduled debt service requirements on the project
			 obligations and secured loan and all deposit requirements under the terms
			 of any trust agreement, bond resolution, or similar agreement securing
			 project obligations may be applied annually to prepay a secured loan under
			 this section without penalty.</text>
							</subparagraph><subparagraph id="H75CA312019EA4CA8BF8FCEDCDBCB3CBC"><enum>(B)</enum><header>Use of proceeds of refinancing</header><text>A secured loan under this section may be prepaid at any time without penalty from the proceeds of
			 refinancing from non-Federal funding sources.</text>
							</subparagraph></paragraph></subsection><subsection id="H3B059F3731D44320B5DEF08DD518B6C6"><enum>(d)</enum><header>Sale of secured loans</header>
						<paragraph id="H4338F224D3434631B9EBB51A0BE6FCE4"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), as soon as practicable after the date of substantial completion of a
			 project and after providing a notice to the obligor, the Secretary may
			 sell to another entity or reoffer into the capital markets a secured loan
			 for a project under this section, if the Secretary determines that the
			 sale or reoffering can be made on favorable terms.</text>
						</paragraph><paragraph id="H5F57CB3BB90E49F187813340A8DB30EC"><enum>(2)</enum><header>Consent of obligor</header><text>In making a sale or reoffering under paragraph (1), the Secretary may not change the original terms
			 and conditions of the secured loan without the written consent of the
			 obligor.</text>
						</paragraph></subsection><subsection id="H20EB8B65D59740418765964148EB00B1"><enum>(e)</enum><header>Loan guarantees</header>
						<paragraph id="H126210AD92C34A5FAD7A92BADCF57AC8"><enum>(1)</enum><header>In general</header><text>The Secretary may provide a loan guarantee to a lender in lieu of making a secured loan under this
			 section, if the Secretary determines that the budgetary cost of the loan
			 guarantee is substantially the same as that of a secured loan.</text>
						</paragraph><paragraph id="H1758B7B53204413792A2636B0A0050DD"><enum>(2)</enum><header>Terms</header><text>The terms of a loan guarantee provided under this subsection shall be consistent with the terms
			 established in this section for a secured loan, except that the rate on
			 the guaranteed loan and any prepayment features shall be negotiated
			 between the obligor and the lender, with the consent of the Secretary.</text>
						</paragraph></subsection></section><section id="H4D08CC96262546B5A4656DD98D68EBB6"><enum>217.</enum><header>Program administration</header>
					<subsection id="H49568ABE475345558EDC580C4325C6F9"><enum>(a)</enum><header>Requirement</header><text>The Secretary shall establish a uniform system to service the Federal credit instruments made
			 available under this subtitle.</text>
					</subsection><subsection id="H7DCD7081BDC640E9A7DC8AA531A2A22A"><enum>(b)</enum><header>Fees</header><text>The Secretary may collect and spend fees, contingent on authority being provided in appropriations
			 Acts, at a level that is sufficient to cover—</text>
						<paragraph id="HE1E2D2E60B7D458A90864E4D7799AFEA"><enum>(1)</enum><text>the costs of services of expert firms retained pursuant to subsection (d); and</text>
						</paragraph><paragraph id="H4BF45506297B441292016262A1277619"><enum>(2)</enum><text>all or a portion of the costs to the Federal Government of servicing the Federal credit instruments
			 provided under this subtitle.</text>
						</paragraph></subsection><subsection id="H8C081E1B544544818D009A07A04CB0C5"><enum>(c)</enum><header>Servicer</header>
						<paragraph id="HE4276FF9D801474B958864D51D6791D5"><enum>(1)</enum><header>In general</header><text>The Secretary may appoint a financial entity to assist the Secretary in servicing the Federal
			 credit instruments provided under this subtitle.</text>
						</paragraph><paragraph id="HEC66101961184E0E9986B643E5DE14CF"><enum>(2)</enum><header>Duties</header><text>A servicer appointed under paragraph (1) shall act as the agent for the Secretary.</text>
						</paragraph><paragraph id="HD739034D2DD94CEFBC8567A1D14B8A04"><enum>(3)</enum><header>Fee</header><text>A servicer appointed under paragraph (1) shall receive a servicing fee, subject to approval by the
			 Secretary.</text>
						</paragraph></subsection><subsection id="H9847B1A213114CD2A214027C1A69EC05"><enum>(d)</enum><header>Assistance from experts</header><text>The Secretary may retain the services, including counsel, of any organization or entity with
			 expertise in the field of municipal and project finance to assist in the
			 underwriting and servicing of Federal credit instruments provided under
			 this subtitle.</text></subsection><subsection id="idcfa9ec7fc0be4f7bb25a3e10fed4d6b5"><enum>(e)</enum><header>Loan coordination; interagency cooperation</header><text>The Secretary—</text><paragraph id="id112116D764BF4AF6ADF54C2A32A0E4FE"><enum>(1)</enum><text>shall coordinate implementation of loan guarantees under this section with the
			 Administrator to avoid duplication and enhance the effectiveness of
			 implementation of the
			 State revolving funds established  under the  <act-name parsable-cite="FWPCA">Federal
		Water Pollution Control Act</act-name> (33 U.S.C. 1251 et
		seq.) and the Safe Drinking Water Act (42 U.S.C. 300f
		et seq.);</text></paragraph><paragraph id="id6b5bb49f5e7b4917a0c1778aa0e88085"><enum>(2)</enum><text>shall consult with the Secretary of Agriculture before promulgating criteria with respect to
			 financial appraisal functions and loan guarantee administration for
			 activities carried out under this subtitle; and</text></paragraph><paragraph id="id8a2f131ebf8f4cd99c01a3930f50ecb8"><enum>(3)</enum><text>may enter into a memorandum of agreement providing for Department of Agriculture financial
			 appraisal functions and loan guarantee administration for activities
			 carried out under this subtitle.</text></paragraph></subsection></section><section id="H5055A798F2DE473F869AFB1E1BDBC224"><enum>218.</enum><header>State and local permits</header><text display-inline="no-display-inline">The provision of financial assistance for a project under this subtitle shall not—</text>
					<paragraph id="HF0574A08ACDC45F1B98B07B401BE97C4"><enum>(1)</enum><text>relieve any recipient of the assistance of any obligation to obtain any required State or local
			 permit or approval with respect to the project;</text>
					</paragraph><paragraph id="H46B1624EE0DF44C396E62B3249B2A265"><enum>(2)</enum><text>limit the right of any unit of State or local government to approve or regulate any rate of return
			 on private equity invested in the project; or</text>
					</paragraph><paragraph id="H9C058499C86947AC9C5950E92A9C703D"><enum>(3)</enum><text>otherwise supersede any State or local law (including any regulation) applicable to the
			 construction or operation of the project.</text>
					</paragraph></section><section id="H894440C4421C4ECA9E670305540D89E4"><enum>219.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary may promulgate such regulations as the Secretary determines to be appropriate to
			 carry out this subtitle.</text>
				</section><section id="H89B9055F1AEF4D1387C4DB494B798EA7"><enum>220.</enum><header>Funding</header>
					<subsection id="HDFFBF89C047947978D308D371B08AF27"><enum>(a)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary to carry out this subtitle $50,000,000 for
			 each of fiscal years 2015 through 2019, to remain available until
			 expended.</text>
					</subsection><subsection id="HB7E2D08689204D5181B619D077CDE4C2"><enum>(b)</enum><header>Administrative costs</header><text>Of the funds made available to carry out this subtitle, the Secretary may use for the
			 administration
			 of this subtitle not more than $2,200,000 for each of fiscal years 2015
			 through 2019.</text>
					</subsection></section><section id="H5FEE940F0AB34AD3B42619716D5459BB"><enum>221.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter,
			 the Secretary shall submit to the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Natural Resources of the
			 House of Representatives a report summarizing the financial performance
			 and on-the-ground outcomes of
			 the projects that are receiving, or have received, assistance under this
			 subtitle, including an assessment of whether the objectives of this
			 subtitle are being met.</text>
				</section></subtitle><subtitle id="H4175852391BA4144AD69F7CC07C19909"><enum>B</enum><header>Integrated regional water management, reclamation, and recycling projects</header>
				<section id="H7DA2AFB292AA4EE882CAF4EF7BD9D989"><enum>231.</enum><header>Water storage projects</header>
					<subsection id="HC62F7F2A0E1E4B8C819E212BE6684E35"><enum>(a)</enum><header>Agreements</header><text>The Secretary may enter into a cost-shared financial assistance agreement with any
			 non-Federal entity in a Reclamation State or the State of Hawaii to carry
			 out the
			 planning, design, and construction of any permanent water storage and
			 conveyance facility used solely to regulate and maximize the water supply
			 arising from a project that is eligible for assistance under this title or
			 any other provision of law—</text><paragraph id="idB7DA335BB785446995D0D98A3923C235"><enum>(1)</enum><text>to recycle wastewater, impaired surface
			 water, and ground water; or</text></paragraph><paragraph id="id169681CB37F04B7C81F0B09D50791649"><enum>(2)</enum><text>to use integrated and coordinated water
			 management on a watershed or regional scale.</text>
						</paragraph></subsection><subsection id="H7F1B976A5B954C4BA653373CF5A22AD6"><enum>(b)</enum><header>Financial assistance</header><text>In providing financial assistance under this section, the Secretary shall give priority to storage
			 and conveyance components that—</text>
						<paragraph id="H58477FC3C8F24BA5BD1143AD763959EB"><enum>(1)</enum><text>ensure the efficient and beneficial use of water or reuse of the recycled water;</text>
						</paragraph><paragraph id="idD6D8E5C4451948E3813D006EEC380B51"><enum>(2)</enum><text>make maximum use of natural systems;</text></paragraph><paragraph id="H296B695A6C6445B3A1FC93F9352FDB78"><enum>(3)</enum><text>consistent with Secretarial Order No. 3297, dated February 22,
			 2010, support sustainable water management practices and the water
			 sustainability objectives of 1 or more offices of the Department of the
			 Interior or any other Federal agency;</text>
						</paragraph><paragraph id="H127578008A3343208952C6FEAAE67B81"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idAE3FC6080856446D83A482A3D3B330C7"><enum>(A)</enum><text>increase the availability of usable water supplies in a watershed or region to benefit people,
			 the economy, and the environment; and</text></subparagraph><subparagraph id="id880BF559B8B0446B8EDE42C3A06AE3FF" indent="up1"><enum>(B)</enum><text>include adaptive measures needed to
			 address climate change and future demands;</text>
							</subparagraph></paragraph><paragraph id="H4B3E6DC0A44449258D556CE640414EB8"><enum>(5)</enum><text>where practicable—</text><subparagraph id="id1DA9500E8D4743DD80F4DAC82B65B807"><enum>(A)</enum><text>provide flood control or recreation benefits; and</text></subparagraph><subparagraph id="idB00682D413A14270B64BDC07F1473F0C"><enum>(B)</enum><text>include the development of
			 incremental hydroelectric power generation;</text>
							</subparagraph></paragraph><paragraph id="H59A3847846114C58AE4E5591B799B9D5"><enum>(6)</enum><text>include partnerships that go beyond political and institutional jurisdictions to support the
			 efficient use of the limited water resources of the United States and the
			 applicable region;</text>
						</paragraph><paragraph id="H627C47B162F74D45B79089E850E232E4"><enum>(7)</enum><text>generate environmental benefits, such as benefits to fisheries, wildlife and habitat, and
			 water quality and water-dependent ecological systems, as well as water
			 supply benefits to agricultural and urban water users; and</text></paragraph><paragraph id="idf65f4260c91a4231a495c1ad04d061d2"><enum>(8)</enum><text>the financing of which leverages private and other non-Federal resources.</text></paragraph></subsection><subsection id="H20BDE4CC54D24BBCA36BBBAD3FD99480"><enum>(c)</enum><header>Federal share</header><text>The Federal share of the cost of a project carried out under subsection (a) shall be—</text><paragraph id="idA3AC950D9BE5488D9FF414DA4B1B7E93"><enum>(1)</enum><text>equal to the lesser of—</text><subparagraph id="idD85145061FEC4ADF8A1534D91006BF36"><enum>(A)</enum><text>50
			 percent of total cost of the project; and</text></subparagraph><subparagraph id="idF65EE48A4B3A4B1DB86F990A99028FC2"><enum>(B)</enum><text>$15,000,000, adjusted for inflation; and</text></subparagraph></paragraph><paragraph id="idEB77FCF50D6D440CA4D963B0979A3425"><enum>(2)</enum><text>nonreimbursable.</text>
						</paragraph></subsection><subsection id="H52DBDE7DFF6142F08EC97AE9DF8FA787"><enum>(d)</enum><header>Non-Federal share</header><text>The non-Federal share of the cost of a project carried out under subsection (a) may include in-kind
			 contributions to the planning, design, and construction of a project.</text>
					</subsection><subsection id="H5AFEB8D750504F618257569C9BB7DCBA"><enum>(e)</enum><header>Title and costs</header><text>A non-Federal entity entering into a financial assistance agreement under this section shall—</text>
						<paragraph id="H4160454533BA445E9B60958A81750490"><enum>(1)</enum><text>hold title to all facilities constructed under this section; and</text>
						</paragraph><paragraph id="H159B9FE07E9C41CF91EAA0E6B1BFB4ED"><enum>(2)</enum><text>be solely responsible for the costs of operating and maintaining those facilities.</text>
						</paragraph></subsection></section><section id="H9A9E3B40EFD44D718E22722C0BA63108"><enum>232.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated $150,000,000 to carry out this subtitle.</text>
				</section></subtitle><subtitle id="H605B5288EB974316A1D28C574E0B33E6"><enum>C</enum><header>Title transfers</header>
				<section id="H4D17E594702C4B4ABA97CEB76201085F"><enum>241.</enum><header>Authorization to transfer title</header><text display-inline="no-display-inline">The Secretary may transfer to any non-Federal operating entity title to any Reclamation project or
			 facility, or any separable
			 element of such a project or facility, that is authorized before the date
			 of enactment of this Act, if—</text>
					<paragraph id="H3E09502F38414BE28A0CA8419F14CBDD"><enum>(1)</enum><text>all previous Federal construction contract obligations or other related repayment contracts or
			 agreements associated with the project have been paid out by a non-Federal
			 project beneficiary;</text>
					</paragraph><paragraph id="H1DBFD390669645D7A3742C2BF6B2822F"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idF73143E5E9A849C6BBD6923A5518E344"><enum>(A)</enum><text>a project facility or separable element of such a facility is in need of rehabilitation or
			 improvement, as determined by the Secretary;
			 and</text></subparagraph><subparagraph id="idBE51328C1F204D6AB787CB4E4DAF90A2" indent="up1"><enum>(B)</enum><text>the non-Federal operating entity is otherwise eligible for a loan
			 guarantee under this title;</text>
						</subparagraph></paragraph><paragraph id="H9D273F27A47745A881531A482F6519B4"><enum>(3)</enum><text>the title transfer meets all applicable Federal laws and regulations, as determined by the
			 Secretary; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3F06825D2E1C4311BE86ABB36FAF3BA1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD492987D513B418598C884B94D2A5703"><enum>(A)</enum><text>the Secretary notifies each  congressional committee of jurisdiction of the transfer by not later
			 than 60 days before the date of the transfer;
			 and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id085D6F22F85241F5B46C02EACD8BCC51" indent="up1"><enum>(B)</enum><text>no objection to the transfer is raised by any such committee.</text>
						</subparagraph></paragraph></section></subtitle></title><title id="idA0495640F054472FA8FAABBEAEB53B6A" style="OLC"><enum>III</enum><header>Innovation through research, data, and technology</header><section id="id0a27be9ee5ff4afe9943dd0e0a75264f"><enum>301.</enum><header>Open water data system</header><subsection id="id70d52ccf597945e6b15330793d49a021"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id3595ae8253034849a5034396dacf6ae7"><enum>(1)</enum><header>Educational institution</header><text>The term <term>educational institution</term> means—</text><subparagraph id="idA941F9C99AA448E1B2F346EACF5A7FBE"><enum>(A)</enum><text>a public or private elementary or secondary school;</text></subparagraph><subparagraph id="id51D36797BF6143A1B2E41F05820CD2B9"><enum>(B)</enum><text>an institution of vocational, professional, or higher education (including a junior college or
			 teachers' college); and</text></subparagraph><subparagraph id="id2D4A3BD00D6040B0B91E355AE0DA3601"><enum>(C)</enum><text>an association of schools or institutions described in subparagraphs (A) and (B).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8961367569a94154b967ecd8581ea35a"><enum>(2)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given that term in section 4 of the <act-name parsable-cite="ISDA">Indian
		Self-Determination and Education Assistance Act</act-name> (25 U.S.C.
		450b).</text></paragraph><paragraph id="idF93E4EBEE99448518D747368F686B285"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the United States
		Geological Survey.</text></paragraph><paragraph id="ID914346B62C5D497EA7E427F09091F8FA"><enum>(4)</enum><header>State</header><text>The
		term <term>State</term> means—</text><subparagraph id="ID1AA0C8024B5B488EA17F81A36FBC1821"><enum>(A)</enum><text>a
		State;</text></subparagraph><subparagraph id="ID792A8B98FE9C42679797E3F1D68FC25F"><enum>(B)</enum><text>the District of
		Columbia;</text></subparagraph><subparagraph id="ID28D43A31F3264D79A65D4436F400AF2F"><enum>(C)</enum><text>the Commonwealth
		of Puerto Rico; and</text></subparagraph><subparagraph id="ID4912258B462B4AAD8DC29F5610699D3D"><enum>(D)</enum><text>any other
		territory or possession of the United States.</text></subparagraph></paragraph><paragraph id="id8BAF66D3D1AF406286FDF4EC54C93806"><enum>(5)</enum><header>System</header><text>The term <term>system</term> means the open water data system established under subsection (b).</text></paragraph></subsection><subsection id="idd4dd43d33f254c5a925717b55944896b"><enum>(b)</enum><header>System</header><text>The Secretary shall establish and maintain an open water data system within the United States
		Geological Survey to advance the availability, timely distribution, and widespread
			 use of water data and information for water management, education,
			 research, assessment, and monitoring purposes.</text></subsection><subsection id="ide965fd71b6914a40af4da9e2141b95d0"><enum>(c)</enum><header>Purposes</header><text>The purposes of the system are—</text><paragraph id="id67d4063addfc40d4a5fa3cf0b554e3f7"><enum>(1)</enum><text>to advance the quantification of the availability, use of, and risks to, water resources throughout
			 the United States;</text></paragraph><paragraph id="id49f04c36bbf24436b30295d3eba15746"><enum>(2)</enum><text>to increase accessibility to, and expand the use of, water data and information in a standard,
			 easy-to-use format by Federal, State, local, and tribal governments,
			 communities, educational institutions, and the private sector; and</text></paragraph><paragraph id="id5869675f6d324b738742c4eab4aee7f3"><enum>(3)</enum><text>to facilitate the open exchange of water information particularly in the face of climate change and
			 unprecedented drought.</text></paragraph></subsection><subsection id="id3e30bde2cafe450892d4ed1357cf2ab1"><enum>(d)</enum><header>Activities</header><text>In carrying out this section, the Secretary shall—</text><paragraph id="idde271dda267549da800c9a0ca33c875f"><enum>(1)</enum><text>integrate water data and information into a interoperable, national, geospatially referenced water
			 data framework;</text></paragraph><paragraph id="id18e9a8c593aa419a8a43fa5e2f9441cd"><enum>(2)</enum><text>identify new water data and information needs, including data on surface and groundwater quality
			 and quantity, sediment, erosion, transport, water chemistry,
			 precipitation, reservoir storage, water cycle, landscape variables,
			 hydrography, climate and weather impacts, soil moisture, and human use;</text></paragraph><paragraph id="id1540ff71ff66411686537d4607390433"><enum>(3)</enum><text>leverage existing shared databases, infrastructure, and tools to provide a platform for water data
			 and information innovation, modeling and data sharing, and solution
			 development;</text></paragraph><paragraph id="id7af9070303b4470d8d7a20cf10a94540"><enum>(4)</enum><text>support water data and information sharing, applied research, and educational programs of State,
			 local, and tribal governments, communities, educational institutions, and
			 the private sector; and</text></paragraph><paragraph id="id5f1ee9a983e34c17894a524b55c61310"><enum>(5)</enum><text>promote cooperation and sharing of expertise regarding water data and information among State,
			 local, and tribal governments, communities, educational institutions, and
			 the private sector.</text></paragraph></subsection><subsection id="id4b8a1062d3984390b552ec3471137f38"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section such sums as are necessary.</text></subsection></section><section id="id47140A5729154F83A5FAA2B8E56FED7C"><enum>302.</enum><header>Water Resources Research Act
			 amendments</header><subsection commented="no" display-inline="no-display-inline" id="IDdc6b363c210b48f7b3b63f536ba7fe6e"><enum>(a)</enum><header display-inline="yes-display-inline">Congressional findings and
			 declarations</header><text display-inline="yes-display-inline">Section 102 of the Water Resources Research Act of
			 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/10301">42 U.S.C. 10301</external-xref>) is amended—</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id89B9F7962A8C452FA5CF631293C1A2A0"><enum>(b)</enum><header>Water resources research and technology institutes</header><text>Section 104 of the Water Resources Research Act of

				program</header>
								<paragraph commented="no" display-inline="no-display-inline" id="idD1AF7ACADDB14AF58E90CF042CEA9540"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall conduct a careful and
				detailed evaluation of each institute at least once every 3 years
			 to
				determine—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id0F726CE1174543B4B0BC0704A1234823"><enum>(A)</enum><text display-inline="yes-display-inline">the quality and relevance of the water
				resources research of the institute;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDA6F21CBADFF401CBED431D4D7A59328"><enum>(B)</enum><text display-inline="yes-display-inline">the effectiveness of the institute at
				producing measured results and applied water supply research; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1A433E87A94A400DAA94872B5CC2D30B"><enum>(C)</enum><text display-inline="yes-display-inline">whether the effectiveness of the institute
				as an institution for planning, conducting, and arranging for
			 research warrants
				continued support under this section.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD588A70708064372BCA117B4F1FB4461"><enum>(2)</enum><header display-inline="yes-display-inline">Prohibition on further
				support</header><text display-inline="yes-display-inline">If, as a result of an
				evaluation under paragraph (1), the Secretary determines that an
			 institute does
				not qualify for further support under this section, no further
			 grants to the
				institute may be provided until the qualifications of the institute
			 are
				reestablished to the satisfaction of the
				Secretary.</text>
								</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCE21C127B24E4EFF8D5CCF75E88676C7"><enum>(4)</enum><text>in subsection (f)(1), by striking <quote>$12,000,000 for each of fiscal years 2007 through
			 2011</quote> and inserting <quote>$7,500,000 for each of fiscal years 2015

					</paragraph></subsection></section><section id="id4D7AA1FB511D433C89D6D44EA4FC7B3E" section-type="subsequent-section"><enum>303.</enum><header>Reauthorization of Water Desalination Act of 1996</header><text display-inline="no-display-inline">Section 8 of the Water Desalination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/10301">42 U.S.C. 10301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/298">Public Law 104–298</external-xref>) is
			 amended—</text>
				<paragraph id="HF275D0C4209441B0B7983839806E5B65"><enum>(1)</enum><text>in the first sentence of subsection (a), by striking <quote>2013</quote> and inserting <quote>2020</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1EF172B82E1C48A58A3DAB0122CB4504"><enum>(2)</enum><text>in subsection (b), by striking <quote>for each of fiscal years 2012 through 2013</quote> and inserting <quote>for each of fiscal years 2015 through 2020</quote>.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idD0A9810DB556404B89537A43B8493367"><enum>304.</enum><header>Review of reservoir operations</header><subsection id="H42DFB3AD714C46CA83AC380AA982D0E5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after receiving a request of a non-Federal sponsor of a reservoir, the
			 Secretary of the
			 Army, in consultation with the Administrator of the National Oceanic and
			 Atmospheric Administration, shall review the operation of the reservoir,
			 including
			 the water control manual and rule curves, using improved weather forecasts
			 and run-off forecasting methods, including the Advanced Hydrologic
			 Prediction System of the National Weather Service and the Hydrometeorology
			 Testbed program of the National Oceanic and Atmospheric Administration.</text></subsection><subsection id="H27D2EEFDAEDC4ABBA4AA759524C6368A"><enum>(b)</enum><header>Description of benefits</header><text display-inline="yes-display-inline">In conducting the review under subsection (a), the Secretary of the Army shall determine if a
			 change in
			 operations, including the use of improved weather forecasts and run-off
			 forecasting methods, will improve 1 or more of the core functions of the
			 Corps of Engineers, including—</text><paragraph id="H567B71BE26DB4A4C967986EA9A424D50"><enum>(1)</enum><text display-inline="yes-display-inline">reducing risks to human life, public safety, and property;</text></paragraph><paragraph id="HF11B8CDECA314F75ACD89C4C97E3D17F"><enum>(2)</enum><text>reducing the need for future disaster relief;</text></paragraph><paragraph id="HFA3B59EBFB914335ABDC0386F4853E84"><enum>(3)</enum><text display-inline="yes-display-inline">improving local water storage capability and reliability in coordination with the non-Federal
			 sponsor and other water users;</text></paragraph><paragraph id="H44B170B08EE1471E9CD70AB2FF115685"><enum>(4)</enum><text>restoring, protecting, or mitigating the impacts of a water resources development project on the
			 environment; and</text></paragraph><paragraph id="HA1D323680B7C47D08E421A2B03DE812A"><enum>(5)</enum><text>improving fish species habitat or population within the boundaries and downstream of a water
			 resources project.</text></paragraph></subsection><subsection id="H976C838A080E44B794612BD687D7FD18"><enum>(c)</enum><header>Results reported</header><text>Not later than 90 days after completion of a review under this section, the Secretary shall
			 submit a report to Congress regarding the results of the review.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H0E0DC0EB168046F7B33F9D11A40B9F44"><enum>(d)</enum><header>Manual update</header><text display-inline="yes-display-inline">As soon as practicable, but not later than 3 years after the date on which a report under
			 subsection (c) is submitted to Congress, pursuant to the procedures
			 required under existing
			 authorities, if the Secretary of the Army determines based on	that report
			 that using improved weather and run-off forecasting methods improves 1
			 or more core functions of the Corps of Engineers at a reservoir, the
			 Secretary of the Army shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id818EAE97CCCF47698FCE6F6FF92CB9F9"><enum>(1)</enum><text display-inline="yes-display-inline">incorporate those methods in the operation of the reservoir; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id519820B49F0A4C03AB80C3F388333BCB"><enum>(2)</enum><text display-inline="yes-display-inline">update the
			 water control manual.</text></paragraph></subsection></section></title><title id="id75777516E1F94C898125D1707F3ED1F6" style="OLC"><enum>IV</enum><header>Drought preparedness and resilience</header><section id="id7BA0C6C084F8466CA18970F11F927FB5"><enum>401.</enum><header>National drought resilience guidelines</header><subsection id="ideb2cbdd8253248219ecfdf2a979af653"><enum>(a)</enum><header>In general</header><text>The Administrator, in conjunction with the Secretary of the Interior, the Secretary of Agriculture,
			 the Director of the National Oceanic and Atmospheric Administration, and
			 other appropriate Federal agency heads along with State and local
			 governments, shall develop nonregulatory national drought resilience
			 guidelines relating
			 to drought preparedness planning and investments for communities, water
			 utilities, and other water users and providers.</text></subsection><subsection id="id1CC6D827BD8B4F0E823D553F640A52B6"><enum>(b)</enum><header>Consultation</header><text>In developing the national drought resilience guidelines, the Administrator and other Federal
			 agency heads referred to in subsection (a) shall consult with—</text><paragraph id="idA30A5C8FEE39477988DE6188BE88E9DC"><enum>(1)</enum><text>State and  local governments;</text></paragraph><paragraph id="idFCA68F210B8F448A9ABFA7BD90E6C2AA"><enum>(2)</enum><text>water utilities;</text></paragraph><paragraph id="idBD2EAEB64D9F43B3A834148A26EBC290"><enum>(3)</enum><text>scientists;</text></paragraph><paragraph id="id54B5BCE6ED174E9E95C1DD329FAE5308"><enum>(4)</enum><text>institutions of higher education;</text></paragraph><paragraph id="id5E5B2AB2F9984AD395632C06201FD9CE"><enum>(5)</enum><text>relevant private entities; and</text></paragraph><paragraph id="idD49CD3E748AB4C7C8AEF18814A6EC180"><enum>(6)</enum><text>other stakeholders.</text></paragraph></subsection><subsection id="id2BFB75E7CE7A4D44803396FD6DA01636"><enum>(c)</enum><header>Contents</header><text>The national drought resilience guidelines developed under this section  shall, to the maximum
			 extent practicable, provide  recommendations for a period of 10 years
			 that—</text><paragraph id="idB3432AF5AEE547089B5025FC7F277E22"><enum>(1)</enum><text>address a broad range of potential actions, including—</text><subparagraph id="id8D5E1FF84D594BEEAD22510F390DF642"><enum>(A)</enum><text>analysis of the impacts of climate change and drought on the future effectiveness of water
			 management tools;</text></subparagraph><subparagraph id="idE08035A47962437C84418706D34B7640"><enum>(B)</enum><text>the identification of drought-related water management challenges in a broad range of fields,
			 including—</text><clause id="idDB117D9E7F16435084394D55A045BA26"><enum>(i)</enum><text>public health and safety;</text></clause><clause id="id4AC9D10713CC4CE98D9E66B3AD782697"><enum>(ii)</enum><text>municipal and industrial water supply;</text></clause><clause id="id502D2162F6D944AA83BD9080EECE95DD"><enum>(iii)</enum><text>agricultural water supply;</text></clause><clause id="idBC9A926DD2D04714877B7C821D71B298"><enum>(iv)</enum><text>water quality;</text></clause><clause id="id679A09BE49774BA58C24A3BF6FF0DAAA"><enum>(v)</enum><text>ecosystem health; and</text></clause><clause id="id94E30E70A8ED41B1A6BF40AAFC46D84A"><enum>(vi)</enum><text>water supply planning;</text></clause></subparagraph><subparagraph id="id6C63C61DCFAA4F4DA7223DF441D918E7"><enum>(C)</enum><text>water management tools to reduce drought-related impacts, including—</text><clause id="idAE7E42B6EF544D83A396E647E3912F0E"><enum>(i)</enum><text>water use efficiency through gallons per capita reduction goals, appliance efficiency standards,
			 water pricing incentives, and other measures;</text></clause><clause id="idDC728E6071F449E696A48401F3D5E403"><enum>(ii)</enum><text>water recycling;</text></clause><clause id="idE39F0491263845F392FEB61816805081"><enum>(iii)</enum><text>groundwater clean-up and storage;</text></clause><clause id="id56A37833E7F04BAF88E169C235A25FBC"><enum>(iv)</enum><text>new technologies, such as behavioral water efficiency; and</text></clause><clause id="id15ACABD6BEB94BFA926A65CE90A34504"><enum>(v)</enum><text>stormwater capture and reuse;</text></clause></subparagraph><subparagraph id="id48FDED154AB1440FA0516E1706709EFB"><enum>(D)</enum><text>water-related energy and greenhouse gas reduction strategies; and</text></subparagraph><subparagraph id="idA23FF304FDF34D5E814794E76A209968"><enum>(E)</enum><text>public education and engagement; and</text></subparagraph></paragraph><paragraph id="id4681CE8FDFF84FF8803115C153B20CB8"><enum>(2)</enum><text>include recommendations relating to the processes that Federal, State, and local governments and
			 water
			 utilities should consider when developing drought resilience preparedness
			 and plans,
			 including—</text><subparagraph id="idDFDA3DBA315B4FDAB87520CCAD6F1F90"><enum>(A)</enum><text>the establishment of planning goals;</text></subparagraph><subparagraph id="id77F2E2505FC84001A1BEF2E29FF1FBB1"><enum>(B)</enum><text>the evaluation of institutional capacity;</text></subparagraph><subparagraph id="idF1B08EC99F3348A9BBDEC2F83FC65C0C"><enum>(C)</enum><text>the assessment of drought-related risks and vulnerabilities, including the integration of
			 climate-related impacts;</text></subparagraph><subparagraph id="id414319A92478491A852A65BD083D798B"><enum>(D)</enum><text>the establishment of a development process, including an evaluation of the cost-effectiveness of
			 potential strategies;</text></subparagraph><subparagraph id="id07DB801FF5D7454AA2918807C0BDFB5D"><enum>(E)</enum><text>the inclusion of private entities, technical advisors, and other stakeholders in the development
			 process;</text></subparagraph><subparagraph id="id00182BC390ED4AE2A7B1389E3AC2B832"><enum>(F)</enum><text>implementation and financing issues; and</text></subparagraph><subparagraph id="idB24666FA7CE54683971D409B1CCBE336"><enum>(G)</enum><text>evaluation of the plan, including any updates to the plan.</text></subparagraph></paragraph></subsection></section><section id="id8702E5ACAEF040FE8D453E5D21FBDD33"><enum>402.</enum><header>Drought preparedness for fisheries</header><subsection id="id908CCF1CA1614E8699D7422B51C7F581"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id5F69BDAE74FE4C1691145F58225C3BB2"><enum>(1)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education
			 Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text></paragraph><paragraph id="idEF3E9328AFBA45D5A38A27011789BD35"><enum>(2)</enum><header>Qualified tribal government</header><text>The term <term>qualified tribal government</term> means a governmental body of an Indian tribe that the Secretary of the Interior determines—</text><subparagraph id="id428E55F9B6104E62899D7F18EAC34AE5"><enum>(A)</enum><text>is involved in salmon management and recovery activities under the <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (16 U.S.C. 1531
		et seq.); and</text></subparagraph><subparagraph id="idB7C863FB1E624C8EAA3BB94CB922A4F8"><enum>(B)</enum><text>has the management and organizational capability to maximize the benefits of assistance provided
			 under this section.</text></subparagraph></paragraph></subsection><subsection id="id993400d328cd4c4ebac46f06121d0945"><enum>(b)</enum><header>Salmon drought plan</header><paragraph id="id962ACDA2F6FD4DBB982160FC62BB4F6C"><enum>(1)</enum><header>In general</header><text>Not later than January 1, 2016, the Director of the United States Fish and Wildlife Service shall,
			 in consultation with the Director of the National Marine Fisheries
			 Service, the Commissioner of Reclamation, the Chief  of Engineers, and the
			 head of the California Department of Fish and Wildlife, prepare a salmon
			 drought plan for the State of California.</text></paragraph><paragraph id="id86514ED85B634B0A8FB0B1BB764E3518"><enum>(2)</enum><header>Contents</header><text>The plan developed under paragraph (1) shall—</text><subparagraph id="id78EA530766E1435287801F6C29C27A26"><enum>(A)</enum><text>contribute—</text><clause id="id38634E493D6249FCBEAD23F029D50085"><enum>(i)</enum><text>to the recovery of populations listed as threatened or endangered under the Endangered Species Act
			 of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);  and</text></clause><clause id="id332819A843B544C290EA75148A9C93DD"><enum>(ii)</enum><text>to the goals of the Central Valley Project Improvement Act
		(title XXXIV of <external-xref legal-doc="public-law" parsable-cite="pl/102/575">Public Law 102–575</external-xref>; 106 Stat. 4706);  and</text></clause></subparagraph><subparagraph id="idCE27D073585A40C69F35CF827956ADCD"><enum>(B)</enum><text>include options to protect salmon populations originating in the State of California, with a
			 particular focus on actions that can be taken to aid salmon populations in
			 the State of California during the driest 12 years, such as—</text><clause id="idb5bc430ba4d5476885d53b3a8dc6c653"><enum>(i)</enum><text>relocating the release location and timing of hatchery fish to avoid predation and temperature
			 impacts;</text></clause><clause id="id429eafbeddb8438e906d9675857b175b"><enum>(ii)</enum><text>barging hatchery release fish to improve survival and reduce straying;</text></clause><clause id="id975499a294e142a2a40a761d3e46d833"><enum>(iii)</enum><text>coordinating with water users, the Commissioner of Reclamation, and the head of the California
			 Department of Water Resources regarding voluntary water transfers  to
			 determine if water released upstream to meet the needs of downstream or
			 South-of-Delta water users can be managed in a way that provides
			 additional benefits for salmon;</text></clause><clause id="idb1e05a7e8be24ad6afe2f068422bb7f8"><enum>(iv)</enum><text>hatchery management modifications, such as expanding hatchery production during the driest years of
			 fish listed as endangered or threatened under the Endangered Species Act
			 of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), if appropriate; and</text></clause><clause id="id96a13adb9e4541128857aad24175e0fa"><enum>(v)</enum><text>increasing rescue operations of upstream migrating fish.</text></clause></subparagraph></paragraph></subsection><subsection id="id3D23A34B86F04595AE6246FDB72A476C"><enum>(c)</enum><header>Funding</header><paragraph id="idB23A6E735C054F3B9204016DC3C00EA1"><enum>(1)</enum><header>In
		general</header><text>Out of any funds in the Treasury not otherwise
		appropriated, the Secretary of the Treasury shall transfer to the Director of the
			 United States Fish and Wildlife Service to
		carry out this section $3,000,000, to remain available until expended, for urgent
			 fish, stream, and hatchery activities relating to extreme drought
			 conditions, including work carried out in conjunction with the Director of
			 the National Marine Fisheries Service, the Commissioner of Reclamation,
			 the Chief of Engineers, the head of the California Department of Fish and
			 Wildlife, or a qualified tribal government.</text></paragraph><paragraph id="IDDDDB9AFAA4B2435EB9C6E3EA8D700BC2"><enum>(2)</enum><header>Receipt and
