		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
			<text display-inline="no-display-inline">This Act may be cited as the 
						<quote><short-title>FOIA Improvement Act of 2014</short-title></quote>.</text>
		</section><section id="idD435F1EA697D466DB83E6D5987445944"><enum>2.</enum><header>Amendments to FOIA</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/552">Section 552</external-xref> of title 5, United States Code, is amended—</text><paragraph id="idD869853A6FCE4B2EA031A23DCAF6C529"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id8442A06BF0FC4696B37B265A924788CB"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="idB15926A993C541E09E7B95730F3EE68A"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>for public inspection and copying</quote> and inserting <quote>for public inspection in an electronic format</quote>;</text></clause><clause id="id8BE8E46C6C504388BBAD38DBE711184C"><enum>(ii)</enum><text>by striking subparagraph (D) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="idD24A259A7FE34175B9D10393C445674D" style="OLC"><subparagraph id="id1B1FCF1C81FD47F49414F5EB359765AB" indent="up1"><enum>(D)</enum><text>copies of all records, regardless of form or format—</text><clause id="idEF00D4563B344F92917AFBE98FA0D3BD"><enum>(i)</enum><text>that have been released to any person under paragraph (3); and</text></clause><clause id="id4A768952735140E5A8FB866F02C10DBC"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id7F5E31141DDC41D796BB2B877C04FA19"><enum>(I)</enum><text>that because of the nature of their subject matter, the agency determines have become or are likely
			 to become the subject of subsequent requests for substantially the same
			 records; or</text></subclause><subclause id="id6A2AE8B7903F45E5931D20C5EE3F5D31" indent="up1"><enum>(II)</enum><text>that have been requested not less than 3 times; and</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idA652DF7E60C34E339299BDAA133CC99E"><enum>(iii)</enum><text>in the undesignated matter following subparagraph (E), by striking <quote>public inspection and copying current</quote> and inserting <quote>public inspection in an electronic format, and current</quote>;</text></clause></subparagraph><subparagraph id="id9891964898024587BCD90A9C702CBE08"><enum>(B)</enum><text>in paragraph (4)(A), by striking clause (viii) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id9CDE8A9615954D1394ED82E7CC7B1386" style="OLC"><clause id="id14B2DED273DF455CA96ED050EEC97C99" indent="up2"><enum>(viii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id43988A49EDBF4CB7B8E434690BD2B289"><enum>(I)</enum><text>Except as provided in subclause (II), an agency shall not assess any search fees (or in the case of
			 a requester described under clause (ii)(II) of this subparagraph,
			 duplication fees) under this subparagraph if the agency has failed to
			 comply with any time limit under paragraph (6).</text></subclause><subclause id="id2F2F284092E549CB9D60B270A52729E1" indent="up1"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="idFC44FCBDD28F4412A765AE86ACE5BDA2"><enum>(aa)</enum><text>If an agency determines that unusual circumstances apply (as the term is defined
			 in paragraph (6)(B)) and the agency provides a timely written notice to
			 the
			 requester in accordance with paragraph (6)(B), a failure described in
			 subclause (I) is excused for an additional 10 days. If the agency fails to
			 comply with the extended time limit, the agency may not assess any search
			 fees (or in the case of a requester described under clause (ii)(II) of
			 this subparagraph, duplication fees).</text></item><item id="id44384E5EB19647488F06636F3031F926" indent="up1"><enum>(bb)</enum><text>If a court determines that exceptional circumstances exist (as that term is defined in paragraph
			 (6)(C)), a failure described in subclause (I) shall be excused for the
			 length of time provided by the court order.</text></item></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id5BAAAFAE99BE45D5B852F349B660F088"><enum>(C)</enum><text>in paragraph (6)—</text><clause id="id1E4F02E0069946F0A618DAE1105CC140"><enum>(i)</enum><text>in subparagraph (A)(i), by striking <quote>making such request</quote> and all that follows through <quote>determination; and</quote> and inserting the following: <quote>making such request of—</quote></text><quoted-block display-inline="no-display-inline" id="idC80C878ECD7B4155AFBFACA1993F298B" style="OLC"><subclause id="id461CE036A67F4C679274AB78DD8AAF72" indent="up1"><enum>(I)</enum><text>such determination and the reasons therefore;</text></subclause><subclause id="id23C90FDE42D94A66A4CCD6668C23986B" indent="up1"><enum>(II)</enum><text>the right of such person to seek assistance from the FOIA Public Liaison of the agency; and</text></subclause><subclause id="idF5F552F5E94746639254F6E7C314DD99" indent="up1"><enum>(III)</enum><text>in the case of an adverse determination—</text><item id="idC3AF84DAADF74F10B6A171DB04036D91"><enum>(aa)</enum><text>the right of such person to appeal to the head of the agency, within a period determined by the
			 head of the agency that is not less than 90 days after the receipt of such
			 adverse determination; and</text></item><item id="id96A10C9DC5484887AE9F1DC2A97F4B5D"><enum>(bb)</enum><text>the right of such person to seek dispute resolution services from the FOIA Public Liaison  of the
			 agency or the Office of Government Information Services; and</text></item></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id6FC0958FBAF748B586D7681B3925328F"><enum>(ii)</enum><text>in subparagraph (B)(ii), by striking <quote>the agency.</quote> and inserting <quote>the agency,  and notify the requester of the right of the requester to seek dispute resolution
			 services from the Office of Government Information Services.</quote>; and</text></clause></subparagraph><subparagraph id="id5F40CF446EEC4444A04BE3CEDE9C0E44"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idE1B053AA38514B8C829D37CECFEE971E" style="OLC"><paragraph id="id6BC0EBE83E0B4603B88058562AE11260" indent="up1"><enum>(8)</enum><text>An agency—</text><subparagraph id="id8C238BEA2C744CBF9629802135D7BC80"><enum>(A)</enum><text>shall—</text><clause id="id7B5AE353AD7F484FA44B8FC27FC3E9F0"><enum>(i)</enum><text>withhold information under this section  only if—</text><subclause id="idEC4183915EAC48F9A48482406C0B0413"><enum>(I)</enum><text>the agency reasonably foresees that disclosure would harm an interest protected by an exemption
			 described in subsection (b) or other provision of law; or</text></subclause><subclause id="idF61B9EAC45E0469E8AA635A2A1FD30CB"><enum>(II)</enum><text>disclosure is prohibited by law; and</text></subclause></clause><clause id="id854E86490B21416EA26695B099FADA63"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idE45F06E835EC473A9B0B028C698963F6"><enum>(I)</enum><text>consider whether partial disclosure of information is possible whenever the agency determines that
			 a full disclosure of a requested record is not possible; and</text></subclause><subclause id="id093680A981D14ECAA778E7CE3A21C88C" indent="up1"><enum>(II)</enum><text>take reasonable steps necessary to segregate and release nonexempt information; and</text></subclause></clause></subparagraph><subparagraph id="id9FCE99D76F37424397F42170D264F3A4"><enum>(B)</enum><text>may not—</text><clause commented="no" id="id62A979B693824B6188D2F0FCBC92CB60"><enum>(i)</enum><text>withhold information requested under this section merely because the agency can demonstrate, as a
			 technical matter, that the records fall within the scope of  an exemption
			 described in subsection (b); or</text></clause><clause id="idF0CCFA6AF25647DEB38AE2AFBC212405"><enum>(ii)</enum><text>withhold information requested under this section because the information may be embarrassing to
			 the agency or because of speculative or abstract concerns.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA1B3C53FF7C5420897F7CD31CD6EC495"><enum>(2)</enum><text>in subsection (b), by amending paragraph (5) to read as follows:</text><quoted-block display-inline="no-display-inline" id="idE376F606709D4546B0BA9126718759ED" style="OLC"><paragraph id="id6A75FB4DFAE146F9B59112286BE506B3"><enum>(5)</enum><text>inter-agency or intra-agency memorandums or letters that would not be available by law to a party
			 other than an agency in litigation with the agency, if—</text><subparagraph id="idF12573C2ED434159BE6C76CB7EA98927"><enum>(A)</enum><text>in the case of deliberative process privilege or attorney work-product privilege, the agency
			 interest in protecting the records or information is not outweighed by a
			 public interest in disclosure;</text></subparagraph><subparagraph id="idFE6E7C7D17154006A33D2ED14DC7EA4E"><enum>(B)</enum><text>in the case of attorney-client privilege, the agency interest in protecting the records or
			 information is not outweighed by a compelling public interest in
			 disclosure; and</text></subparagraph><subparagraph id="idB6278E0A755F4BC59E44B23280C8AD16"><enum>(C)</enum><text>the requested record or information was created less than 25 years before the date on which the
			 request was made;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id27120A8BE42742698FE0E24A52149535"><enum>(3)</enum><text>in subsection (e)</text><subparagraph id="id019B5809E14B4F788707C4A74676339E"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id9D9460AD976041D9B43D75E8D896E63D"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>and to the Director of the Office of Government Information Services</quote> after <quote>United States</quote>;</text></clause><clause id="id15DC0C07A5ED45A5A971A36C97F34666"><enum>(ii)</enum><text>in subparagraph (N), by striking <quote>and</quote> at the end;</text></clause><clause id="id2C756F96C0864D12ACED4F85B57A81CC"><enum>(iii)</enum><text>in subparagraph (O), by striking the period at the end and inserting a semicolon; and</text></clause><clause id="id7CC53A4D09E14F9D8E885569388FA54F"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id1322BEDED59C4F959E78DB214E51888D" style="OLC"><subparagraph id="id0876BB2CD53E4763B302DEAB09918660" indent="up1"><enum>(P)</enum><text>the number of times the agency denied a request for records under subsection (c); and</text></subparagraph><subparagraph id="id6EECBD856E7D46BA9668DC47E62F4FF7" indent="up1"><enum>(Q)</enum><text>the number of records that were made available for public inspection in an electronic format under
			 subsection (a)(2).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id37EC628DF250411FAC5B2E55106E942C"><enum>(B)</enum><text>by striking paragraph (3) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idB331AF166ECF4366B72F77BC71AA5144" style="OLC"><paragraph id="idBAE25A10C77D46CBAB92152D8E5630D6" indent="up1"><enum>(3)</enum><text>Each agency shall make each such report available for public inspection in an electronic format. In
			 addition, each agency shall make the raw statistical data used in each
			 report available in a timely manner for public inspection in an
			 electronic format, which shall be made available—</text><subparagraph id="id4C6B653BE240406BBBD46F2875778EDE"><enum>(A)</enum><text>without charge, license, or registration requirement;</text></subparagraph><subparagraph id="id2A32508B86BA4DA68357E54E44A75010"><enum>(B)</enum><text>in an aggregated, searchable format; and</text></subparagraph><subparagraph id="idCEA5981299514C37AB807A4139D41F0A"><enum>(C)</enum><text>in a format that may be downloaded in bulk.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="id448BCB90029842FCABBF70892A97AC98"><enum>(C)</enum><text>in paragraph (4)—</text><clause id="id90FA6B1F0765418CBFAD1BDDDA0AC1D5"><enum>(i)</enum><text>by striking <quote>Government Reform and Oversight</quote> and inserting <quote>Oversight and Government Reform</quote>;</text></clause><clause id="id1085A665F19341BAB4032068D548EC2E"><enum>(ii)</enum><text>by inserting <quote>Homeland Security and</quote> before <quote>Governmental Affairs</quote>; and</text></clause><clause id="idA301078EA4054FD2BD87EC7B324F8229"><enum>(iii)</enum><text>by striking <quote>April</quote> and inserting <quote>March</quote>; and</text></clause></subparagraph><subparagraph id="idCC150CC3E4144A9FAF0A9329042874CE"><enum>(D)</enum><text>by striking paragraph (6) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id4A53C1A4037444C29BA593FA9F6222C1" style="OLC"><paragraph id="id68FA9419D6BF4F1F8583976D9FA94455" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id24BAAE594DA247C5B19A09259D9FF08B"><enum>(A)</enum><text>The Attorney General of the United States shall submit to the Committee on Oversight and Government
			 Reform of the House of Representatives, the Committee on Judiciary of the
			 Senate,  and the President a report on or before March 1 of each calendar
			 year, which shall include for the prior calendar year—</text><clause id="id6480E0E7A6D94DCE82417D1A645057EB" indent="up1"><enum>(i)</enum><text>a listing of the number of cases arising under this section;</text></clause><clause id="id6BBC42EA3DB543BD83BF25A7869E2E53" indent="up1"><enum>(ii)</enum><text>a listing of—</text><subclause id="id19217FEC3AC741F7B16999DD20AEA59D"><enum>(I)</enum><text>each subsection, and any exemption, if applicable, involved in each case arising under this
			 section;</text></subclause><subclause id="idD887100FADA34665AF130FE3F9383615"><enum>(II)</enum><text>the disposition of each case arising under this section; and</text></subclause><subclause id="id4AA64114772A43288F9FEA51E6AFF2A1"><enum>(III)</enum><text>the cost, fees, and penalties assessed under subparagraphs (E), (F), and (G) of subsection (a)(4);
			 and</text></subclause></clause><clause id="idEFC2C108F9CE44E88748CE05F275499D" indent="up1"><enum>(iii)</enum><text>a description of the efforts undertaken by the Department of Justice to encourage agency compliance
			 with this section.</text></clause></subparagraph><subparagraph id="id838EF1246CC64795B8C68550E05EF922" indent="up1"><enum>(B)</enum><text>The Attorney General of the United States shall make—</text><clause id="id828963F591104EB3B9CC9857A490813A"><enum>(i)</enum><text>each report submitted under subparagraph (A) available for public inspection in an electronic
			 format; and</text></clause><clause id="id54833CBA9B41418A9B9415BA00547318"><enum>(ii)</enum><text>the raw statistical data used in each report submitted under subparagraph (A) available for public
			 inspection in an electronic format, which shall be made available—</text><subclause id="id125EDD44294D4106B003791819AC872E"><enum>(I)</enum><text>without charge, license, or registration requirement;</text></subclause><subclause id="idE3DEF288364B4D13905D77C858FBD808"><enum>(II)</enum><text>in an aggregated, searchable format; and</text></subclause><subclause id="id154F1DA2007A44D4B4BF615A527C0E03"><enum>(III)</enum><text>in a format that may be downloaded in bulk.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idF7AEAE955B6B419CA124E93CC65C1004"><enum>(4)</enum><text>in subsection (g), in the matter preceding paragraph (1), by striking <quote>publicly available upon request</quote> and inserting <quote>available for public inspection in an electronic format</quote>;</text></paragraph><paragraph id="id136AA42DDED5472CBC37F786E83F33CC"><enum>(5)</enum><text>in subsection (h)—</text><subparagraph id="id2D29B372AC674991BD5808E34945FEC5"><enum>(A)</enum><text>in paragraph (1), by adding at the end the following: <quote>The head of the Office shall be the Director of the Office of Government Information Services.</quote>;</text></subparagraph><subparagraph id="idC75FC1E92F7B46A5B3038B588BD8C474"><enum>(B)</enum><text>in paragraph (2), by striking subparagraph (C) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id6C12AC1A9546482BB754AB66893400DF" style="OLC"><subparagraph id="idB2337D3FE948403CB3806E7FEF4C3E56" indent="up1"><enum>(C)</enum><text>identify procedures and methods for improving compliance under this section.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id0168F30F349A41F58BE31EFBE0071AA2"><enum>(C)</enum><text>by striking paragraph (3) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idCB465A5137BD4FC8BC39E02C258594AC" style="OLC"><paragraph id="id89A71531B39D4D1E9D4ECCC905699124" indent="up1"><enum>(3)</enum><text>The Office of Government Information Services shall offer mediation services to resolve disputes
			 between persons making requests under this section and administrative
			 agencies as a non-exclusive alternative to litigation and may issue
			 advisory opinions at the discretion of the Office or upon request of any
			 party to a dispute.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idB04697D481714D9B8B362304B58346CF"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idF264C93CB3D64758BFD61AAD4099B8F2" style="OLC"><paragraph id="id4DA19082F55E4A7F81AB0BF394CC903A" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idDD59635F02FF4629881497B4F3EF1955"><enum>(A)</enum><text>Not less frequently than annually, the Director of the Office of Government Information Services
			 shall submit to the Committee on Oversight and Government Reform of the
			 House of Representatives, the Committee on the Judiciary of the Senate,
			 and the President—</text><clause id="id372F173D8A154DADA7BFECD12F43770A" indent="up1"><enum>(i)</enum><text>a report on the findings of the information  reviewed and identified under paragraph (2);</text></clause><clause id="idBCD3F131945945338A2D48660F7EEC71" indent="up1"><enum>(ii)</enum><text>a summary of the activities of the Office of Government Information Services under paragraph (3),
			 including—</text><subclause id="id820975494FA74820A8FAC6FBF79CBBBB"><enum>(I)</enum><text>any advisory opinions
			 issued; and</text></subclause><subclause id="id8AE6CDC68D174F90B4F8778C806BFF65"><enum>(II)</enum><text>the number of times each agency engaged in dispute resolution with the assistance of the Office of
			 Government Information Services or the FOIA Public Liaison; and</text></subclause></clause><clause id="id8170140A3287480F837F6DF773CE8474" indent="up1"><enum>(iii)</enum><text>legislative and regulatory recommendations, if any, to improve the administration of this section.</text></clause></subparagraph><subparagraph id="id10C7FE46873B4B0587C0A8836ACCAA49" indent="up1"><enum>(B)</enum><text>The Director of the Office of Government Information Services shall make each report submitted
			 under subparagraph (A) available for public
			 inspection in an electronic format.</text></subparagraph><subparagraph id="id84A98BA33D4A477F8449F0B47037C0DE" indent="up1"><enum>(C)</enum><text>The Director of the Office of Government Information Services shall not be required to obtain the
			 prior approval, comment, or review of any officer or agency of the United
			 States, including the Department of Justice, the Archivist of the United
			 States, or the Office of Management and Budget before submitting to the
			 Congress, or any committee or subcommittee thereof, any reports,
			 recommendations, testimony, or comments, if such submissions include a
			 statement indicating that the views expressed therein are those of the
			 Director and do not necessarily represent the views of the President.</text></subparagraph></paragraph><paragraph id="id3D47121A98FA407F89C133D7DE5054D1" indent="up1"><enum>(5)</enum><text>The Director of the Office of Government Information Services may submit additional information to
			 Congress and the President as the Director determines to be appropriate.</text></paragraph><paragraph id="id2E47B7DA7874492ABC14ECC1E63C2333" indent="up1"><enum>(6)</enum><text>Not less frequently than annually, the Office of Government Information Services shall conduct a
			 meeting that is open to the public on the review and reports by the Office
			 and shall allow interested persons to appear and present oral or written
			 statements at the meeting.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id97A790C85F784B2691D3252121A11332"><enum>(6)</enum><text>by striking subsections (i), (j), and (k), and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id793E876E129B4AB09014E81B044A0349" style="OLC"><subsection id="id0D34F69DF3C84B48AAFA4160A96F1B33"><enum>(i)</enum><text>The Government Accountability Office shall—</text><paragraph id="id15CDA997E3A14F9295B086021D5189E4"><enum>(1)</enum><text>conduct audits of administrative agencies on
			 compliance with and implementation of the requirements of this section and
			 issue reports detailing the results of such audits; and</text></paragraph><paragraph id="id6AA8AD6D1D6B408AB6DE69C0C1B2BE6E"><enum>(2)</enum><text>catalog the number of exemptions described in subsection (b)(3) and the use of such exemptions by
			 each agency.</text></paragraph></subsection><subsection id="id4D8B6C9E54AB457A80653301989E26A1"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id35E7AFD37AF449A2998801FC55A3A869"><enum>(1)</enum><text>Each agency shall designate a Chief FOIA Officer who shall be a senior official of such agency (at
			 the Assistant Secretary or equivalent level).</text></paragraph><paragraph id="idECC73780A2244EBC9580FBA290C6499C" indent="up1"><enum>(2)</enum><text>The Chief FOIA Officer of each agency shall, subject to the authority of the head of the agency—</text><subparagraph id="idF9788E78E1D64DFC81C563D5190035EE"><enum>(A)</enum><text>have agency-wide responsibility for efficient and appropriate compliance with this section;</text></subparagraph><subparagraph id="id027ED1AC27ED4598A5B10AD006A50DF3"><enum>(B)</enum><text>monitor implementation of this section throughout the agency and keep the head of the agency, the
			 chief legal officer of the agency, and the Attorney General appropriately
			 informed of the agency’s performance in implementing this section;</text></subparagraph><subparagraph id="id6152227A61DD4891ABDCDF0C3F48F80A"><enum>(C)</enum><text>recommend to the head of the agency such adjustments to agency practices, policies, personnel, and
			 funding as may be necessary to improve its implementation of this section;</text></subparagraph><subparagraph id="id4B2B853B86924A6E9D081ABA3A813339"><enum>(D)</enum><text>review and report to the Attorney General, through the head of the agency, at such times and in
			 such formats as the Attorney General may direct, on the agency’s
			 performance in implementing this section;</text></subparagraph><subparagraph id="id6985F317DDCE42219F8492A5557AA24C"><enum>(E)</enum><text>facilitate public understanding of the purposes of the statutory exemptions of this section by
			 including concise descriptions of the exemptions in both the agency’s
			 handbook issued under subsection (g), and the agency’s annual report on
			 this section, and by providing an overview, where appropriate, of certain
			 general categories of agency records to which those exemptions apply;</text></subparagraph><subparagraph id="id0E02F09765B94DF6B4CE08A4CD277CF4"><enum>(F)</enum><text>offer training to agency staff regarding their responsibilities under this section;</text></subparagraph><subparagraph id="id5DA209CF2F894629B7B2D741E7358402"><enum>(G)</enum><text>serve as the primary agency liaison with the Office of Government Information Services and the
			 Office of Information Policy; and</text></subparagraph><subparagraph id="id63C7084CF1A44DD797FFD4F5340D9381"><enum>(H)</enum><text>designate 1 or more FOIA Public Liaisons.</text></subparagraph></paragraph><paragraph id="idBDAEFF15020C4B23866E6234EC71ED1C" indent="up1"><enum>(3)</enum><text>The Chief FOIA Officer of each agency shall review, not less frequently than annually, all aspects
			 of the administration of this section by the
			 agency to ensure compliance with the requirements of this section,
			 including—</text><subparagraph id="idF61624AE813D45D5AA6EE556660B9FB5"><enum>(A)</enum><text>agency regulations;</text></subparagraph><subparagraph id="id241C31EECB1D44A99E54B9DFAA4F28ED"><enum>(B)</enum><text>disclosure of records required under paragraphs (2) and (8) of subsection (a);</text></subparagraph><subparagraph id="id718BFD6F647E4B53B52B9084BDB354C3"><enum>(C)</enum><text display-inline="yes-display-inline">assessment of fees and determination of eligibility for fee waivers;</text></subparagraph><subparagraph id="idE79E493B9BED49DCBAF3236A0D31306D"><enum>(D)</enum><text display-inline="yes-display-inline">the timely processing of requests for information under this section;</text></subparagraph><subparagraph id="id768121AFE77B470BABAF73885D8C9A07"><enum>(E)</enum><text display-inline="yes-display-inline">the use of exemptions under subsection (b); and</text></subparagraph><subparagraph id="id4A6620EAF4F441D68E71643902FFFDC1"><enum>(F)</enum><text display-inline="yes-display-inline">dispute resolution services with the assistance of the Office of Government Information Services or
			 the FOIA Public Liaison.</text></subparagraph></paragraph></subsection><subsection id="id1B51065C64494FD3841EDE78A2736F49"><enum>(k)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id617115EE4F0041309BA074719DE370F4"><enum>(1)</enum><text>There is established in the executive branch the Chief FOIA Officers Council (referred to in this
			 subsection as the <term>Council</term>).</text></paragraph><paragraph id="id2D597BAE9574408F8B428FB90FAA7035" indent="up1"><enum>(2)</enum><text>The Council shall be comprised of the following members:</text><subparagraph id="idF7D8398039194A8DA6F87E376EEB88E3"><enum>(A)</enum><text>The Deputy Director for Management of the Office of Management and Budget.</text></subparagraph><subparagraph id="idF5FABBCA4D324F9194417AD5C1FEFECF"><enum>(B)</enum><text>The Director of the Office of Information Policy at the Department of Justice.</text></subparagraph><subparagraph id="id3EA2B23E8D914C469D6229B70AC33BBF"><enum>(C)</enum><text>The Director of the Office of Government Information Services.</text></subparagraph><subparagraph id="id8B520A3754B5446DA991E7128854B5C6"><enum>(D)</enum><text>The Chief FOIA Officer of each agency.</text></subparagraph><subparagraph id="idFCF3A0020A2341168961A0E575F0FCDF"><enum>(E)</enum><text>Any other officer or employee of the United States as designated by the Co-Chairs.</text></subparagraph></paragraph><paragraph id="id324817B26E6A43129F1E1053D13AA169" indent="up1"><enum>(3)</enum><text>The Director of the Office of Information Policy at the Department of Justice and the Director of
			 the Office of Government Information Services shall be the Co-Chairs of
			 the Council.</text></paragraph><paragraph id="idE409ABAA5677402C94B9162C442ED7BC" indent="up1"><enum>(4)</enum><text>The Administrator of General Services shall provide administrative and other support for the
			 Council.</text></paragraph><paragraph id="idF785550E434045788DFD280C198E288D" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id51094C5C68BF4CEE815014CB3A214393"><enum>(A)</enum><text>The duties of the Council shall include the following:</text><clause id="id911EC78771F047DEBFAE5533630523E7" indent="up1"><enum>(i)</enum><text>Develop recommendations for increasing compliance and efficiency under this section.</text></clause><clause id="idD79A32C7A35D4B1480874ACD677E5467" indent="up1"><enum>(ii)</enum><text>Disseminate information about agency experiences, ideas, best practices, and innovative approaches
			 related to this section.</text></clause><clause id="id0388412087C842CF9B7A8C6B22D52E39" indent="up1"><enum>(iii)</enum><text>Identify, develop, and coordinate initiatives to increase transparency and compliance with this
			 section.</text></clause><clause id="idCCBE205BC4E64EEA9ACD55EDDDE74A0B" indent="up1"><enum>(iv)</enum><text>Promote the development and use of common performance measures for agency compliance with this
			 section.</text></clause></subparagraph><subparagraph id="id068D5B5892754785BDEB8A4FB81CD123" indent="up1"><enum>(B)</enum><text>In performing the duties described in subparagraph (A), the Council shall consult on a regular
			 basis with members of the public who make requests under this section.</text></subparagraph></paragraph><paragraph id="id324929E0A1E247208BD1CF4830556F13" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id04E54C4974034C1AB07907BD2D5FC646"><enum>(A)</enum><text>The Council shall meet regularly and such meetings shall be open to the public unless the Council
			 determines to close the meeting for reasons of national security or to
			 discuss information exempt under subsection (b).</text></subparagraph><subparagraph id="id44F74B49FDB44123AD9A8C8B780E9E0D" indent="up1"><enum>(B)</enum><text>Not less frequently  than annually, the Council shall hold a meeting that shall be open to the
			 public and permit interested persons to appear and present oral and
			 written statements to the Council.</text></subparagraph><subparagraph id="idD6A2598F7FE94E7A871CE806EECDE64A" indent="up1"><enum>(C)</enum><text>Not later than 10 business days before a meeting of the Council, notice of such meeting shall be
			 published in the Federal Register.</text></subparagraph><subparagraph id="id7B291C7DD1B043ECB3D5D6594FC494BF" indent="up1"><enum>(D)</enum><text>Except as provided in subsection (b), the records, reports, transcripts, minutes, appendixes,
			 working papers, drafts, studies, agenda, or other documents that were made
			 available to or prepared for or by the Council shall be made publicly
			 available.</text></subparagraph><subparagraph id="id90868EDF7D524F8CBEB464E9AAD588C6" indent="up1"><enum>(E)</enum><text>Detailed minutes of each meeting of the Council shall be kept and shall contain a record of the
			 persons present, a complete and accurate description of matters discussed
			 and conclusions reached, and copies of all reports received, issued, or
			 approved by the Council. The minutes shall be redacted as necessary and
			 made publicly available.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idFC4D4B809F96443395DC30B4C940AA89"><enum>3.</enum><header>Review and issuance of regulations</header><subsection id="id7613CD8C8C1845C5A836FAB3B9126881"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the head of each agency (as
			 defined in <external-xref legal-doc="usc" parsable-cite="usc/5/551">section 551</external-xref> of title 5, United States Code) shall review the
			 regulations of such agency and shall issue regulations on procedures for
			 the disclosure of records under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States
			 Code, in accordance with the amendments made by section 2.</text></subsection><subsection id="id45263DA7A8464F349B011C8212B072E6"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">The regulations of each agency shall include procedures for engaging in dispute resolution through
			 the FOIA Public Liaison and the Office of Government Information Services.</text></subsection></section><section id="id7023B14AF7F8483898B6BEA2BE307EFA"><enum>4.</enum><header>Proactive disclosure through records management</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/44/3102">Section 3102</external-xref> of title 44, United States Code, is amended—</text><paragraph id="idBCB8D7E8CBB4446994A9BB6C2A6FF32C"><enum>(1)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4); and</text></paragraph><paragraph id="idB24BEE93632541FBB1235C14DF755FCF"><enum>(2)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="idB6A53F1ED299493AA6E65D99200886E0" style="OLC"><paragraph id="idB0517FE0835242BFA63026CE835471F9"><enum>(2)</enum><text>procedures for identifying records of general interest or use to the public that are appropriate
			 for public disclosure, and for posting such records in a publicly
			 accessible electronic format;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id7A05320975F74D22B2CDDF033126E97B"><enum>5.</enum><header>No additional funds authorized</header><text display-inline="no-display-inline">No additional funds are authorized to carry out the requirements of this Act or the amendments made
			 by this Act.  The requirements of this Act and the amendments made by this
			 Act shall be carried out using amounts otherwise authorized or
			 appropriated.</text></section></legis-body>
