<officialTitle class="centered fontsize8" style="-uslm-lc:I665511">To designate as wilderness certain land and inland water within the Sleeping Bear Dunes National Lakeshore in the State of Michigan, and for other purposes.<?GPOvSpace 08?></officialTitle>

<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d94237e62" identifier="/us/bill/113/s/23/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Sleeping Bear Dunes National Lakeshore Conservation and Recreation Act</shortTitle>”.</content></section>
<section id="d94237e72" identifier="/us/bill/113/s/23/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  In this Act:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d94237e78" identifier="/us/bill/113/s/23/s2/1" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Map</inline>.—</heading><content>The term “<term>map</term>” means the map consisting of 6 sheets entitled “Sleeping Bear Dunes National Lakeshore Proposed Wilderness Boundary”, numbered 634/80,083B, and dated November 2010.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d94237e86" identifier="/us/bill/113/s/23/s2/2" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph></section>
<section id="d94237e95" identifier="/us/bill/113/s/23/s3" style="-uslm-lc:I650141"><num value="3">SEC. 3. </num><heading>SLEEPING BEAR DUNES WILDERNESS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d94237e99" identifier="/us/bill/113/s/23/s3/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Designation</inline>.—</heading><content>In accordance with the Wilderness Act (<ref href="/us/usc/t16/s1131/etseq">16 U.S.C. 1131 et seq.</ref>), certain land and inland water within the Sleeping Bear Dunes National Lakeshore comprising approximately 32,557 acres along the mainland shore of Lake Michigan and on certain nearby islands in Benzie and Leelanau Counties, Michigan, as generally depicted on the map, is designated as wilderness and as a component of the National Wilderness Preservation System, to be known as the “Sleeping Bear Dunes Wilderness”.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d94237e111" identifier="/us/bill/113/s/23/s3/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Map</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d94237e118" identifier="/us/bill/113/s/23/s3/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Availability</inline>.—</heading><content>The map shall be on file and available for public inspection in appropriate offices of the National Park Service.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d94237e126" identifier="/us/bill/113/s/23/s3/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Corrections</inline>.—</heading><content>The Secretary may correct any clerical or typographical errors in the map.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d94237e134" identifier="/us/bill/113/s/23/s3/b/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Legal description</inline>.—</heading><content>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare a legal description of the wilderness boundary and submit a copy of the map and legal description to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d94237e142" identifier="/us/bill/113/s/23/s3/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Road Setbacks</inline>.—</heading><chapeau>The wilderness boundary shall be—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d94237e150" identifier="/us/bill/113/s/23/s3/c/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>100 feet from the centerline of adjacent county roads; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d94237e154" identifier="/us/bill/113/s/23/s3/c/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>300 feet from the centerline of adjacent State highways.</content></paragraph></subsection></section>
<section id="d94237e160" identifier="/us/bill/113/s/23/s4" style="-uslm-lc:I650141"><num value="4">SEC. 4. </num><heading>ADMINISTRATION.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d94237e164" identifier="/us/bill/113/s/23/s4/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><chapeau>Subject to valid existing rights, the wilderness area designated by section 3(a) shall be administered by the Secretary in accordance with the Wilderness Act (<ref href="/us/usc/t16/s1131/etseq">16 U.S.C. 1131 et seq.</ref>), except that—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d94237e176" identifier="/us/bill/113/s/23/s4/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>any reference in the Wilderness Act to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d94237e180" identifier="/us/bill/113/s/23/s4/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>any reference in the Wilderness Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d94237e184" identifier="/us/bill/113/s/23/s4/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Maintenance of Roads Outside Wilderness Boundary</inline>.—</heading><content>Nothing in this Act prevents the maintenance and improvement of roads that are located outside the boundary of the wilderness area designated by section 3(a).</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d94237e192" identifier="/us/bill/113/s/23/s4/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Fish and Wildlife</inline>.—</heading><content>Nothing in this Act affects the jurisdiction of the State of Michigan with respect to the management of fish and wildlife, including hunting and fishing within the national lakeshore in accordance with <ref href="/us/pl/91/479/s5">section 5 of Public Law 91–479</ref> (<ref href="/us/usc/t16/s460x–4">16 U.S.C. 460x–4</ref>).</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d94237e207" identifier="/us/bill/113/s/23/s4/d" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Savings Provisions</inline>.—</heading><chapeau>Nothing in this Act modifies, alters, or affects—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d94237e215" identifier="/us/bill/113/s/23/s4/d/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>any treaty rights; or</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d94237e219" identifier="/us/bill/113/s/23/s4/d/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>any valid private property rights in existence on the day before the date of enactment of this Act.</content></paragraph></subsection></section>
