Effective date.</toc-entry></toc></subsection></section><section id="H4F652A14941A4E5FB7318849B73BAADD"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HEE67D6C0366E4F02B2F2ACDA44F006A0"><enum>(1)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1C6D014B2FEB4CA1BD783BB7E1D24FDC"><enum>(2)</enum><header>Office</header><text display-inline="yes-display-inline">The term <term>Office</term> means the United States Patent and Trademark Office.</text></paragraph></section><section id="idc2cbc1b6282447d2ad3efe917bba902e"><enum>3.</enum><header>Transparency of patent ownership</header><subsection id="id1a78a5b090624b75b80693b3f837b83d"><enum>(a)</enum><header>Judicial proceedings</header><paragraph id="id43E0BF5BD44F4E1FAB7847090958EE21"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/281">Section 281</external-xref> of title 35, United States Code,  is amended—</text><subparagraph id="id9c6787fa56574241873be65064fe0fcc"><enum>(A)</enum><text>by striking <quote>A patentee</quote> and inserting  <quote>(a) <header-in-text level="subsection" style="USC">In general</header-in-text>.—A patentee</quote>; and</text></subparagraph><subparagraph id="idaaef643bb4a947d79c9904d27fb6f1ad"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idb305e9c3186e457fa299ef2a643c29f6" style="USC"><subsection id="id64de7afa1b284ff4b348ed52626a98e8"><enum>(b)</enum><header>Initial disclosure</header><text>The court shall require a patentee who has filed a civil action under subsection (a) to disclose to the court and to all adverse parties, any persons, associations of persons, firms, partnerships, corporations (including parent corporations), or other entities other than the patentee itself known by the patentee to have—</text><paragraph id="idb1d357e835e74597a760be3b25455d3b"><enum>(1)</enum><text>a financial interest (of any kind) in the subject matter in controversy or in a party to the proceeding; or</text></paragraph><paragraph id="idd83097859aed482e89ecf8039a167edd"><enum>(2)</enum><text>any other kind of interest that could be substantially affected by the outcome of the proceeding.</text></paragraph></subsection><subsection id="id4e2d241488db4a11a2d023a17432b246"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section, the terms <term>proceeding</term> and <term>financial interest</term> have the meaning given those terms in <external-xref legal-doc="usc" parsable-cite="usc/28/455">section 455(d)</external-xref> of title 28.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idBDEB3178CEEC4576A3F428F4AF02EB69"><enum>(2)</enum><header>Technical and conforming amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/290">Section 290</external-xref> of title 35, United States Code, is amended  in the first sentence by inserting after <quote>inventor,</quote> the following:  <quote>any information that a patentee has publicly disclosed under section 281(b),</quote>.</text></paragraph></subsection><subsection id="id6df7a6a88c004cbebd324efeb935d166"><enum>(b)</enum><header>Patent and Trademark Office proceedings</header><paragraph id="id7F4DC827089F43609E9A4E79BFD0C4F6"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/26">Chapter 26</external-xref> of title 35, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idc5893c0b5e754dc1b20f81c5701d37f2" style="USC"><section id="id3c27b4b6afb543ac942ce642eb4ec0bf"><enum>263.</enum><header>Disclosure of information relating to patent ownership</header><subsection id="id954cf40482234fb09bd60e151c345ec1"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idA678BB72D91E4C9D968B366A8B4DDA65"><enum>(1)</enum><text>the term <term>period of noncompliance</term> refers to a period of time during which the ultimate parent entity of an assignee of a patent has not been disclosed to the United States Patent and Trademark Office in accordance with this section; and</text></paragraph><paragraph id="id91c9312c4194491da7b78757c69428ae"><enum>(2)</enum><text>the term <term>ultimate parent entity</term> has the meaning given the term in <external-xref legal-doc="regulation" parsable-cite="cfr/16/801.1">section 801.1(a)(3)</external-xref> of title 16, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection><subsection id="id922c7957feb34469b61a805e769a8e17"><enum>(b)</enum><header>Requirement To disclose assignment</header><text>An assignment of all substantial rights in an issued patent that results in a change to the ultimate parent entity shall be recorded in the Patent and Trademark Office within 3 months of the assignment.</text></subsection><subsection id="idc7aa42b85c4742b49e030adda2615d49"><enum>(c)</enum><header>Disclosure requirements</header><text>A disclosure under subsection (b) shall include the name of the assignee and the ultimate parent entity of the assignee.</text></subsection><subsection id="id0e44f556200a40b59d4c565a48bcdde7"><enum>(d)</enum><header>Failure To comply</header><text>If subsection (b) has not been complied with with respect to a patent, in a civil action in which a party asserts a claim for infringement of the patent—</text><paragraph id="id151dabcb03d14378ace83cf54ec7d86f"><enum>(1)</enum><text>the party asserting infringement of the patent may not recover increased damages under section 284 or attorney fees under section 285 with respect to infringing activities taking place during any period of noncompliance; and</text></paragraph><paragraph id="id609b8f77a00144e898a52ce3ca8d3414"><enum>(2)</enum><text>the court shall award a prevailing accused infringer reasonable attorney fees and expenses incurred in discovering any previously undisclosed ultimate parent entities in the chain of title.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id8ff48d49c0044d108892d3db6084efc2"><enum>(2)</enum><header>Applicability</header><text>The amendment made by paragraph (1) shall apply to any patent issued on or after the date of enactment of this Act.</text></paragraph><paragraph commented="no" id="id67AFB99A8B0A46CC81FF83ABB61C4C9F"><enum>(3)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/26">chapter 26</external-xref> of title 35, United States Code, is amended by adding at the end the following new item:</text><quoted-block display-inline="no-display-inline" id="idA2E056CE80DA415699D426C6C895E294" style="USC"><toc regeneration="no-regeneration"><toc-entry level="item">263. Disclosure of information relating to patent ownership.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id2B3503167CDE471D942B219E27C0638C"><enum>4.</enum><header>Customer stay</header><subsection commented="no" id="H2CA8D8BE2C0D4FD5A0464507C9FDEB49"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/29">Chapter 29</external-xref> of title 35, United States Code, is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H4F6CD21875BD42E5A12A3CF3FF118E5B" style="USC"><section commented="no" id="H3C0623383C1148E8A9EC64A07A5ABDCD"><enum>299A.</enum><header>Customer stay</header><subsection id="idf154a5d9a48a4a1db8fde1894f31abae"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id4d70bf18fa764d20b851f9fff246ef37"><enum>(1)</enum><text>the term <term>covered customer</term> means a party accused of infringing a patent or patents in dispute based on a covered product or process;</text></paragraph><paragraph id="id3bc9aed13cec488bb3681acfaf0e34ca"><enum>(2)</enum><text>the term <term>covered manufacturer</term> means a person who manufactures or supplies, or causes the manufacture or supply of, a covered product or process, or a relevant part thereof; and</text></paragraph><paragraph id="id9891c970bfba412693fbe9ca5d5e7ec9"><enum>(3)</enum><text>the term  <term>covered product or process</term> means a component, product, process, system, service, method, or a relevant part thereof, that—</text><subparagraph id="iddd573b6cb20b44d28dae8084a0c8006b"><enum>(A)</enum><text>is alleged to infringe the patent or patents in dispute; or</text></subparagraph><subparagraph id="id6d87b172ce8344dbbc3509a4e04509dc"><enum>(B)</enum><text>implements a process alleged to infringe the patent or patents in dispute.</text></subparagraph></paragraph></subsection><subsection id="id656424a787894feab9016070b0a081f2"><enum>(b)</enum><header>Motion for stay</header><text>In a civil action in which a party asserts a claim for relief arising under any Act of Congress relating to patents (other than an action that includes a cause of action described in section 271(e) of this title), the court shall grant a motion to stay at least the portion of the action against a covered customer that relates to infringement of a patent involving a covered product or process if—</text><paragraph id="id369d61c7e24f40f3b03dc9bfdb4894d9"><enum>(1)</enum><text>the covered manufacturer and the covered customer consent in writing to the stay;</text></paragraph><paragraph id="idd0d12af265704bd691ac3545bba05bb9"><enum>(2)</enum><text>the covered manufacturer is a party to the action or  a separate action involving  the same patent or patents  relating to the same covered product or process;</text></paragraph><paragraph id="idc9d497b8cd0d430fb926035baf577546"><enum>(3)</enum><text>the covered customer agrees to be bound under the principles of collateral estoppel by any issues finally decided as to the covered manufacturer in an action described in paragraph (2) that the covered customer has in common with the covered manufacturer; and</text></paragraph><paragraph id="id377f27011dd94322a4671ed0eb0ed750"><enum>(4)</enum><text>the motion is filed after the first pleading in the action but not later than the later of—</text><subparagraph id="ida27c13618fe742bfbe8eb3eaa532866e"><enum>(A)</enum><text>120 days after service of the first pleading in the action that specifically identifies  the covered product or process as a basis for the alleged infringement of the patent by the covered customer, and specifically identifies  how the covered product or process is alleged to infringe the patent; or</text></subparagraph><subparagraph id="idfb19a575dea24d569020777094564237"><enum>(B)</enum><text>the date on which the first scheduling order in the case is entered.</text></subparagraph></paragraph></subsection><subsection id="id0bd3e4e180ed4696a7d2a23867b8b588"><enum>(c)</enum><header>Applicability</header><text>A stay issued under subsection (b) shall apply only to those asserted patents and products, systems, methods, or components accused of infringement in the action.</text></subsection><subsection id="id2323447b5b344da590219d62a2309fc3"><enum>(d)</enum><header>Lift of stay</header><paragraph id="id6F67053499A04667986748A38BA20E8C"><enum>(1)</enum><header>In general</header><text>A stay entered under this section may be lifted upon grant of a motion based on a showing that—</text><subparagraph id="idef7f6fe98496471c9550b36c8da9a272"><enum>(A)</enum><text>the action involving the covered manufacturer will not resolve a major issue in suit against the covered customer; or</text></subparagraph><subparagraph id="id6fea2a85ce4e42f98e681514c4dc9126"><enum>(B)</enum><text>the stay unreasonably prejudices and would be manifestly unjust to the party seeking to lift the stay.</text></subparagraph></paragraph><paragraph id="idbe78b1870c3b4b71b4d654d4e1a2dfac"><enum>(2)</enum><header>Separate actions</header><text>In the case of a stay entered under this section based on the participation of the covered manufacturer in a separate action described in subsection (b)(2), a motion under paragraph (1) may only be granted if the court in such separate action determines that the showing required under paragraph (1) has been made.</text></paragraph></subsection><subsection id="id99b959aab0894372ad73f7fdc16e36eb"><enum>(e)</enum><header>Waiver of estoppel effect</header><text>If, following the grant of a motion to stay under this section, the covered manufacturer in an action described in subsection (b)(2)—</text><paragraph id="id4e78d10f6c274a798ecb906598166ba0"><enum>(1)</enum><text>seeks or consents to entry of a consent judgment involving one or more of the common issues that gave rise to the stay; or</text></paragraph><paragraph id="id15dd2c806d7441bf83f7e63e9d138b18"><enum>(2)</enum><text>fails to prosecute, to a final, non-appealable judgment, a final decision as to one or more of the common issues that gave rise to the stay,</text></paragraph><continuation-text continuation-text-level="subsection">the court may, upon motion, determine that such consent judgment or unappealed final decision shall not be binding on the covered customer with respect to one or more of such common issues based on a showing that such an outcome would unreasonably prejudice and be manifestly unjust to the covered customer in light of the circumstances of the case.</continuation-text></subsection><subsection id="ida174b74763d84cdabf8c04d5bb34c741"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to limit the ability of a court to grant any stay, expand any stay granted pursuant to this section, or grant any motion to intervene, if otherwise permitted by law.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="id6DDC0406CF854DDF9E3467F68C46E50F"><enum>(b)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/29">chapter 29</external-xref> of title 35, United States Code, is amended by adding at the end the following new item:</text><quoted-block display-inline="no-display-inline" id="id9DD06F041B8A4AF3881FB97627FDCEAE" style="USC"><toc regeneration="no-regeneration"><toc-entry level="item">299A. Customer stay.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idf18b32d2a5b24eaf9c2c838039c93ccc"><enum>5.</enum><header>Bad-faith demand letters</header><subsection id="id28c47526d6ba40d0865e3b3b7ef8f21b"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/29">Chapter 29</external-xref> of title 35, United States Code, as amended by section 4 of this Act, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id1a542e34f89c4127a01faad64a71051f" style="OLC"><section id="idf3f46adb05e94a08a5b2d0c76d9c5387"><enum>299B.</enum><header>Bad-faith demand letters</header><subsection id="id431fd8a9f35e4dc2af7044902e61807d"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>affiliated person</term>  means a person affiliated with the intended recipient of a written communication.</text></subsection><subsection id="id56F8B30C14D0453EB622DCD66D92EE03"><enum>(b)</enum><header>Unfair or deceptive acts or practices</header><text>It shall be an unfair or deceptive act or practice within the meaning of section 5(a)(1) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)(1)</external-xref>) for a person, in connection with the assertion of a United States patent, to engage in the widespread sending of written communications that state that the intended recipients or any affiliated persons are infringing or have infringed the patent and bear liability or owe compensation to another, if—</text><paragraph id="id61b126869670451c99b29765370cd1bc"><enum>(1)</enum><text>the communications falsely threaten that administrative or judicial relief will be sought if compensation is not paid or the infringement issue is not otherwise resolved;</text></paragraph><paragraph id="id13911eeee0de45b1b351f438abb3571a"><enum>(2)</enum><text>the assertions contained in the communications lack a reasonable basis in fact or law, including, for example, because—</text><subparagraph id="id067ae6c395b8463ea1a33635347115de"><enum>(A)</enum><text>the person asserting the patent is not a person, or does not represent a person, with the current right to license the patent to, or to enforce the patent against, the intended recipients or any affiliated persons; or</text></subparagraph><subparagraph id="id2dde1e592453480ba8294eb4317a95da"><enum>(B)</enum><text>the communications seek compensation on account of activities undertaken after the patent has expired; or</text></subparagraph></paragraph><paragraph id="idcf481c2b7bb641399655f7c347204f39"><enum>(3)</enum><text>the content of the written communications is likely to materially mislead a reasonable recipient, including, for example, because the content fails to include such facts reasonably necessary to inform the recipient of—</text><subparagraph id="id2d3fe546c495449ebbba334897d47e1b"><enum>(A)</enum><text>the identity of the person asserting a right to license the patent to, or enforce the patent against, the intended recipient or any affiliated person;</text></subparagraph><subparagraph id="id22cd3c65ae3b4aebb237e3435397389c"><enum>(B)</enum><text>the patent issued by the United States Patent and Trademark Office alleged to have been infringed; and</text></subparagraph><subparagraph id="idf95a2b9ead2b4e43a33c793f1de4dacb"><enum>(C)</enum><text>the reasons for the assertion that the patent may be or may have been infringed.</text></subparagraph></paragraph></subsection><subsection id="ide527dbf37c004ab4b1f16a0808b60685"><enum>(c)</enum><header>Enforcement by Federal Trade Commission</header><paragraph id="id751f6aac63724ac8bdae3df9c0eb9eb6"><enum>(1)</enum><header>Violation of rule</header><text>The engaging of a person in an act or practice described in subsection (b) shall be treated as a violation of a rule defining an unfair or deceptive act or practice described under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="id440a59fe1cbd47b7b4f58cfa207ddf8c"><enum>(2)</enum><header>Powers of commission</header><text>The Federal Trade Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section.</text></paragraph><paragraph id="idaa7cf2b504624a43a2d134bebf0d3e61"><enum>(3)</enum><header>Privileges and immunities</header><text>Any person who engages in an act or practice described in subsection (b) shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id7bb9c9824619438398fcb0f97eb9fb06"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/29">chapter 29</external-xref> of title 35, United States Code, as amended by section 4 of this Act, is amended by adding at the end the following:</text><quoted-block id="idce9783fd-8376-4544-91db-ce25385ca01b" style="OLC"><toc><toc-entry idref="idf3f46adb05e94a08a5b2d0c76d9c5387" level="section">Sec. 299B. Bad-faith demand letters.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id3c6034a386da469fb3e56c7df49371b7"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in any amendment made by this section shall be construed to limit the authority of the Federal Trade Commission under any other provision of law or to provide the Federal Trade Commission with any additional authority.</text></subsection></section><section commented="no" id="id166E7CA464CF4023AA6DE52E018B3D4E"><enum>6.</enum><header>Small business education, outreach, and information access</header><subsection id="HC6449EA7DF464639B34D5ED1C42B1ED7"><enum>(a)</enum><header>Small business education and outreach</header><paragraph id="H08E71635C30D4E21B45DBA4B20787CB7"><enum>(1)</enum><header>Resources for small business</header><text display-inline="yes-display-inline">Using existing resources, the Director shall develop educational resources for small businesses to address concerns arising from patent infringement.</text></paragraph><paragraph id="HAA23D58AB27A4EECA6D38C8DAB225409"><enum>(2)</enum><header>Small Business Patent Ombudsman</header><text>The Patent Ombudsman Program established under section 28 of the Leahy-Smith America Invents Act (<external-xref legal-doc="usc" parsable-cite="usc/35/2">35 U.S.C. 2</external-xref> note) shall coordinate with the existing small business outreach programs of the Office to provide education and awareness on abusive patent litigation practices.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H877EC5AEEA674DB099FB436A10401E3C"><enum>(b)</enum><header>Improving Information Transparency for Small Business and the United States Patent and Trademark Office users</header><paragraph id="HB9F649BD735B48B68216707F5B6BD09C"><enum>(1)</enum><header>Web site</header><text>Using existing resources, the Director shall create a user-friendly section on the official Web site of the Office to notify the public when a patent case is brought in Federal court and with respect to each patent at issue in such case, the Director shall include—</text><subparagraph id="HC3B74B5E058B44F39BEEF4D0CF3BFF8F"><enum>(A)</enum><text>information disclosed pursuant to <external-xref legal-doc="usc" parsable-cite="usc/35/290">section 290</external-xref> of title 35, United States Code, as amended by section 3(b) of this Act; and</quote>; and</text></subparagraph><subparagraph id="id0bc04515843c4adfa1ff3bce2d03416e"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="id685bc5d09c7847028bab9d17301022e5" style="OLC"><subparagraph id="id55a53aa5fb324e1a92d1779f70064522"><enum>(D)</enum><text>in the case of a trademark, service mark, or trade name, the trustee shall not be relieved of a contractual obligation to monitor and control the quality of a licensed product or service.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H90E8993BA0A24A7A873151F4A9DE495B"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on the date of the enactment of this Act and shall apply to any case that is pending on, or for which a petition or  complaint is filed on or after, such date of enactment.</text></subsection></section><section commented="no" id="HCC324395593A4A69B2E0F77F86146D06"><enum>9.</enum><header>Codification of the double-patenting doctrine for first-inventor-to-file patents</header><subsection commented="no" id="HE3246D0676A041F4B31A150FB3A0EEF8"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/10">Chapter 10</external-xref> of title 35, United States Code, is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H1A74A74D69E4432A94A1D25A70A01838" style="USC"><section commented="no" id="HAD2C837ED27E43B89E7C4474EC470348"><enum>106.</enum><header>Prior art in cases of double patenting</header><text display-inline="no-display-inline">A claimed invention of a patent issued under section 151 (referred to in this section as the <term>first patent</term>) that is not prior art to a claimed invention of another patent (referred to in this section as the <term>second patent</term>) shall be considered prior art to the claimed invention of the second patent for the purpose of determining the nonobviousness of the claimed invention of the second patent under section 103 if—</text><paragraph commented="no" id="H325A3146302F4B0C9872521A1752E733"><enum>(1)</enum><text display-inline="yes-display-inline">the claimed invention of the first patent was effectively filed under section 102(d) on or before the effective filing date of the claimed invention of the second patent;</text></paragraph><paragraph commented="no" id="H3C5F29AF8A1C4B7D8ED1211CDD99EE9F"><enum>(2)</enum><text>either—</text><subparagraph commented="no" id="HF9E900FDC88B4D51A9689532743A5508"><enum>(A)</enum><text>the first patent and the second patent name the same inventor; or</text></subparagraph><subparagraph commented="no" id="HF7111BD6560F4A57A448A93CA423289B"><enum>(B)</enum><text display-inline="yes-display-inline">the claimed invention of the first patent would constitute prior art to the claimed invention of the second patent under section 102(a)(2) if an exception under section 102(b)(2) were deemed to be inapplicable and the claimed invention of the first patent was, or were deemed to be, effectively filed under section 102(d) before the effective filing date of the claimed invention of the second patent; and</text></subparagraph></paragraph><paragraph commented="no" id="H6C9104E724804DE887EE92F52DF1CE94"><enum>(3)</enum><text>the patentee of the second patent has not disclaimed the rights to enforce the second patent independently from, and beyond the statutory term of, the first patent.</text></paragraph></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection commented="no" id="H914B75F7E9A2446FA831B3231AFA1386"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Director shall promulgate regulations setting forth the form and content of any disclaimer required for a patent to be issued in compliance with <external-xref legal-doc="usc" parsable-cite="usc/35/106">section 106</external-xref> of title 35, United States Code, as added by subsection (a). Such regulations shall apply to any disclaimer filed after a patent has issued. A disclaimer, when filed, shall be considered for the purpose of determining the validity of the patent under <external-xref legal-doc="usc" parsable-cite="usc/35/106">section 106</external-xref> of title 35, United States Code.</text></subsection><subsection commented="no" id="HFF23EDB594374EEDB96FADD2BCB8626E"><enum>(c)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/10">chapter 10</external-xref> of title 35, United States Code, is amended by adding at the end the following new item:</text><quoted-block display-inline="no-display-inline" id="HF1D5E476EEAA4D5FA54311A6DE0508BB" style="USC"><toc regeneration="no-regeneration"><toc-entry level="item">106. id="id3C40F1DEE67B450484141989EB959E05"><enum>(A)</enum><header>Amendment</header><text>The fourth sentence of <external-xref legal-doc="usc" parsable-cite="usc/35/32">section 32</external-xref> of title 35, United States Code, is amended by striking <quote>1 year</quote> and inserting <quote>2 years</quote>.</text></subparagraph><subparagraph id="idf6bf1707d8634b3a9f20c4e1e39cc735"><enum>(B)</enum><header>Effective date</header><text>The amendment made by this paragraph shall apply to any action in which the Office files a complaint on or after the date of enactment of this Act.</text></subparagraph></paragraph></subsection></section><section id="id870FE679D11940AD98520CA134C43EC2"><enum>11.</enum><header>Reports</header><subsection id="H6305E39F621B479AA079AAA1F6B4E396"><enum>(a)</enum><header>Study on Secondary Market Oversight for Patent Transactions To Promote Transparency and Ethical Business Practices</header><paragraph id="HC226543EC6D9471A86F3B25C4F7EC103"><enum>(1)</enum><header>Study required</header><text display-inline="yes-display-inline">The Director, in consultation with the Secretary of Commerce, the Secretary of the Treasury, the Chairman of the Securities and Exchange Commission, the heads of other relevant agencies, and interested parties, shall, using existing resources of the Office, conduct a study—</text><subparagraph id="H44823D6F12284D18AE7F5A50BC69D762"><enum>(A)</enum><text display-inline="yes-display-inline">to develop legislative recommendations to ensure greater transparency and accountability in patent transactions occurring on the secondary market;</text></subparagraph><subparagraph id="HD1EC1B5A9C3743A1A0EB20DCF7CB7841"><enum>(B)</enum><text>to examine the economic impact that the patent secondary market has on the United States;</text></subparagraph><subparagraph id="HBFE1EFF9B0D64B1C8789D51D4CFF4905"><enum>(C)</enum><text>to examine licensing and other oversight requirements that may be placed on the patent secondary market, including on the participants in such markets, to ensure that the market is a level playing field and that brokers in the market have the requisite expertise and adhere to ethical business practices; and</text></subparagraph><subparagraph id="H11955F72CEE642339763FFE2D0239F2A"><enum>(D)</enum><text>to examine the requirements placed on other markets.</text></subparagraph></paragraph><paragraph id="H924FAA070C4D4DD3816D58213A723D63"><enum>(2)</enum><header>Submission of study</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Director shall submit a report to the Committee on the Judiciary of the House of Representatives and the Committee on the Judiciary of the Senate on the findings and recommendations of the Director from the study required under paragraph (1).</text></paragraph></subsection><subsection id="H91AB3FB8506A4E379F346FF951ABF81B"><enum>(b)</enum><header>Study on patents owned by the United States Government</header><paragraph id="HB9DC5BBFA7ED410DB2BC52F7DF9AEE18"><enum>(1)</enum><header>Study required</header><text display-inline="yes-display-inline">The Director, in consultation with the heads of relevant agencies and interested parties, shall, using existing resources of the Office, conduct a study on patents owned by the United States Government that—</text><subparagraph id="HC1958B3D6DDF461BA985DD421987F3A1"><enum>(A)</enum><text display-inline="yes-display-inline">examines how such patents are licensed and sold, with reference to any litigation relating to the licensing or sale of such patents;</text></subparagraph><subparagraph id="HB6514D5549A04E40A5FE1625AA35D6FF"><enum>(B)</enum><text>provides legislative and administrative recommendations on whether there should be restrictions placed on patents acquired from the United States Government;</text></subparagraph><subparagraph id="HAC34635FE9214B78A9F219A241B595DF"><enum>(C)</enum><text>examines whether or not each relevant agency maintains adequate records on the patents owned by such agency, specifically whether such agency addresses licensing, assignment, and Government grants for technology related to such patents; and</text></subparagraph><subparagraph id="H38D9E3C537E744D796256CB3AC19F5B1"><enum>(D)</enum><text>provides recommendations to ensure that each relevant agency has an adequate point of contact that is responsible for managing the patent portfolio of the agency.</text></subparagraph></paragraph><paragraph id="H89B0F6F0B4D44E6B9D562C9455277661"><enum>(2)</enum><header>Report on study</header><text display-inline="yes-display-inline">Not later than 6 months after the date of the enactment of this Act, the Director shall submit to the Committee on the Judiciary of the House of Representatives and the Committee on the Judiciary of the Senate a report on the findings and recommendations of the Director from the study required under paragraph (1).</text></paragraph></subsection><subsection id="H34074D1466E44C6090EDABE3E31E06B6"><enum>(c)</enum><header>Study on Patent Quality and Access to the Best Information during Examination</header><paragraph id="H891FA64502104D158921E8843B4E46A2"><enum>(1)</enum><header>GAO study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study on patent examination at the Office and the technologies available to improve examination and improve patent quality.</text></paragraph><paragraph id="HDA7DCAEA06E94F21B3FD6BD679190B20"><enum>(2)</enum><header>Contents of the study</header><text>The study required under paragraph (1) shall include the following:</text><subparagraph id="H03979EB8AF1E411A96A3B1AC598F50DB"><enum>(A)</enum><text>An examination of patent quality at the Office.</text></subparagraph><subparagraph id="H2B253001622D4C4C987D6B73F1519024"><enum>(B)</enum><text>An examination of ways to improve quality, specifically through technology, that shall include examining best practices at foreign patent offices and the use of existing off-the-shelf technologies to improve patent examination.</text></subparagraph><subparagraph id="H526DFAA873BE43ED9805F63A9BD2FA2C"><enum>(C)</enum><text>A description of how patents are classified.</text></subparagraph><subparagraph id="HAFD9894991064988851C8F196DA6B031"><enum>(D)</enum><text>An examination of procedures in place to prevent double patenting through filing by applicants in multiple art areas.</text></subparagraph><subparagraph id="H9A7B39AE63A340C29AEF8CF8D8E61F38"><enum>(E)</enum><text>An examination of the types of off-the-shelf prior art databases and search software used by foreign patent offices and governments, particularly in Europe and Asia, and whether those databases and search tools could be used by the Office to improve patent examination.</text></subparagraph><subparagraph id="H493A3352828A431A8CA275A5A9E23A8B"><enum>(F)</enum><text>An examination of any other areas the Comptroller General determines to be relevant.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF2AB11190CCA4C9FA2765367B56E5367"><enum>(3)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 6 months after the date of the enactment of this Act, the Comptroller General shall submit to the Committee on the Judiciary of the House of Representatives and the Committee on the Judiciary of the Senate a report on the findings and recommendations from the study required by this subsection, including recommendations for any changes to laws and regulations that will improve the examination of patent applications and patent quality.</text></paragraph></subsection><subsection id="idbd3e53a600ba4020b7557a768b046331"><enum>(d)</enum><header>Study on Patent Small Claims Court</header><paragraph id="id4d8ca63f141f43129172eae7a6c0d6ce"><enum>(1)</enum><header>Study required</header><subparagraph id="id4929F7E1070A49E2AE71F3FECE0A0BE1"><enum>(A)</enum><header>In general</header><text>The Director of the Administrative Office of the United States Courts, in consultation with the Director of the Federal Judicial Center, shall, using existing resources, conduct a study to examine the idea of developing a pilot program for patent small claims courts in certain judicial districts within the existing patent pilot program mandated by <external-xref legal-doc="public-law" parsable-cite="pl/111/349">Public Law 111–349</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/28/137">28 U.S.C. 137</external-xref> note).</text></subparagraph><subparagraph id="id190ce5a6b0a04b9fa2c7237c87143df9"><enum>(B)</enum><header>Contents of study</header><text>The study conducted under subparagraph (A) shall examine—</text><clause id="idED0692B219AA45FDA488B9A4FDB009BA"><enum>(i)</enum><text>the number and qualifications for judges that could serve on the courts described in subparagraph (A);</text></clause><clause id="id586A68DD3B144432BFE429BA83DD1F0A"><enum>(ii)</enum><text>how the courts described in subparagraph (A)  would be designated and the necessary criteria;</text></clause><clause id="id49DFCDBF369544E3944607BFCCC631FD"><enum>(iii)</enum><text>the costs that would be incurred for establishing, maintaining and operating the pilot program described in subparagraph (A); and</text></clause><clause id="id3333D7F0DC964F0BAA1B73FC5CF40BA6"><enum>(iv)</enum><text>the steps that would be taken to ensure that the pilot small claims courts are not misused for abusive patent litigation.</text></clause></subparagraph></paragraph><paragraph id="id1cec8f47b0b747c8a893c8b6ba7db101"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Director of  the Administrative Office of the United States Courts shall submit a report to the Committee on the Judiciary of the House of Representatives and the Committee on the Judiciary of the Senate on the findings and recommendations from the study required under paragraph (1).</text></paragraph></subsection></section><section id="H035FA945E23347E7A64579C43A427E41"><enum>12.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as otherwise provided in this Act, the provisions of this Act shall take effect on the date of the enactment of this Act, and shall apply to any patent issued, or any action filed, on or after that date.</text></section></legis-body></bill>
