			 authorizations</header><section commented="no" display-inline="no-display-inline" id="idecb8773aa7564c19bd285b429c470ee9" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">Funds are
			 hereby authorized to be appropriated for fiscal year 2014 for the conduct of
			 the intelligence and intelligence-related activities of the following elements
			 of the United States Government:</text><paragraph commented="no" display-inline="no-display-inline" id="idf1ec30827dd94f8c9b2d40ea6ffd32da"><enum>(1)</enum><text display-inline="yes-display-inline">The Office of the Director of National

			 Authorizations</header><subsection commented="no" display-inline="no-display-inline" id="HC70857E08601425285ADAA73B1F07DDF"><enum>(a)</enum><header display-inline="yes-display-inline">Specifications of amounts and personnel
			 levels</header><text display-inline="yes-display-inline">The amounts authorized
			 to be appropriated under section 101 and the authorized personnel ceilings as
			 of September 30, 2014, for the conduct of the intelligence activities of the
			 elements listed in paragraphs (1) through (16) of section 101, are those
			 specified in the classified Schedule of Authorizations prepared to accompany
			 the bill S. ___ of the One Hundred Thirteenth Congress.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H8984558D352841818B08B14FA74B29D9"><enum>(b)</enum><header display-inline="yes-display-inline">Availability of classified Schedule of
			 Authorizations</header><paragraph commented="no" display-inline="no-display-inline" id="H6FD5A7B58CF84248B3ABE56849CBB86D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The classified Schedule of Authorizations
			 referred to in subsection (a) shall be made available to the Committee on
			 Appropriations of the Senate, the Committee on Appropriations of the House of
			 Representatives, and to the President.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCC639173C0784F439F4D4C3776E3D5BB"><enum>(2)</enum><header display-inline="yes-display-inline">Distribution by the President</header><text display-inline="yes-display-inline">Subject to paragraph (3), the President
			 shall provide for suitable distribution of the classified Schedule of
			 Authorizations, or of appropriate portions of the Schedule, within the
			 executive branch.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8BEBBB9D94AF42F1B4CE4F26B4C46AF5"><enum>(3)</enum><header display-inline="yes-display-inline">Limits on disclosure</header><text display-inline="yes-display-inline">The President shall not publicly disclose
			 the classified Schedule of Authorizations or any portion of such Schedule
			 except—</text><subparagraph commented="no" display-inline="no-display-inline" id="H451CECF644E84F6F96308AE061A851A3"><enum>(A)</enum><text display-inline="yes-display-inline">as provided in section 601(a) of the
			 Implementing Recommendations of the 9/11 Commission Act of 2007 (50 U.S.C.
			 3306);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1AB62760935745C499B870584A4E650C"><enum>(B)</enum><text display-inline="yes-display-inline">to the extent necessary to implement the
			 budget; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H427AA666BA5E4E7EA905231A98524AE4"><enum>(C)</enum><text display-inline="yes-display-inline">as otherwise required by law.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idab379026aebf443ca51c4071add8dd79" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Personnel ceiling adjustments</header><subsection commented="no" display-inline="no-display-inline" id="id4612d92ec1d44a258ab9feb9881736c9"><enum>(a)</enum><header display-inline="yes-display-inline">Authority for increases</header><text display-inline="yes-display-inline">The Director of National Intelligence may
			 authorize the employment of civilian personnel in excess of the number of
			 positions for fiscal year 2014 authorized by the classified Schedule of
			 Authorizations referred to in section 102(a) if the Director of National
			 Intelligence determines that such action is necessary to the performance of
			 important intelligence functions, except that the number of personnel employed
			 in excess of the number authorized under such section may not, for any element
			 of the intelligence community, exceed 3 percent of the number of civilian
			 personnel authorized under such section for such element.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id61b452fc751a4932b330d332f841ba17"><enum>(b)</enum><header display-inline="yes-display-inline">Treatment of certain
			 personnel</header><text display-inline="yes-display-inline">The Director of
			 National Intelligence shall establish guidelines that govern, for each element
			 of the intelligence community, the treatment under the personnel levels
			 authorized under section 102(a), including any exemption from such personnel
			 levels, of employment or assignment in—</text><paragraph commented="no" display-inline="no-display-inline" id="id43020c81a86748f8be7392ca725aa7af"><enum>(1)</enum><text display-inline="yes-display-inline">a student program, trainee program, or
			 similar program;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3be4646953c04a68bbfa158ba08b9598"><enum>(2)</enum><text display-inline="yes-display-inline">a reserve corps or as a reemployed
			 annuitant; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6ef69b8e7c1b436ba13949aeeeacc08b"><enum>(3)</enum><text display-inline="yes-display-inline">details, joint duty, or long term,
			 full-time training.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id442555cd7c89451fa2f112f540dab877"><enum>(c)</enum><header display-inline="yes-display-inline">Notice to congressional intelligence
			 committees</header><text display-inline="yes-display-inline">The Director of
			 National Intelligence shall notify the congressional intelligence committees in
			 writing at least 15 days prior to the initial exercise of an authority
			 described in subsection (a).</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H1C46F9B778ED48ACA475A80FA07AECF6" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Intelligence Community Management
			 Account</header><subsection commented="no" display-inline="no-display-inline" id="H8A84CF08BE7F49F79B72D0A75A4BEA4E"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated for the Intelligence Community Management Account
			 of the Director of National Intelligence for fiscal year 2014 the sum of $568,736,000.
			 Within such amount, funds identified in the classified Schedule of
			 Authorizations referred to in section 102(a) for advanced research and
			 development shall remain available until September 30, 2015.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HA1734F78F2E4490E9D8347CD5AE6DA3D"><enum>(b)</enum><header display-inline="yes-display-inline">Authorized personnel levels</header><text display-inline="yes-display-inline">The elements within the Intelligence
			 Community Management Account of the Director of National Intelligence are
			 authorized 855 positions as of September 30, 2014. Personnel serving in such
			 elements may be permanent employees of the Office of the Director of National
			 Intelligence or personnel detailed from other elements of the United States
			 Government.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HE96DF3A7621C4EADB86C3808892680AB"><enum>(c)</enum><header display-inline="yes-display-inline">Classified authorizations</header><paragraph commented="no" display-inline="no-display-inline" id="H3CC50E706094434F8BADA6E5040F4CFD"><enum>(1)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">In addition to
			 amounts authorized to be appropriated for the Intelligence Community Management
			 Account by subsection (a), there are authorized to be appropriated for the
			 Community Management Account for fiscal year 2014 such additional amounts as
			 are specified in the classified Schedule of Authorizations referred to in
			 section 102(a). Such additional amounts for advanced research and development
			 shall remain available until September 30, 2015.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9E20B553FF0D4EA580A6F1E66FE4621C"><enum>(2)</enum><header display-inline="yes-display-inline">Authorization of personnel</header><text display-inline="yes-display-inline">In addition to the personnel authorized by
			 subsection (b) for elements of the Intelligence Community Management Account as
			 of September 30, 2014, there are authorized such additional personnel for the
			 Community Management Account as of that date as are specified in the classified
			 Schedule of Authorizations referred to in section 102(a).</text></paragraph></subsection></section></title><title commented="no" id="id7a5d9d3ea4f54f75bfedebc1bbb471e3" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Central Intelligence Agency Retirement and
			 Disability System</header><section commented="no" display-inline="no-display-inline" id="id1543b45b90b9452089baff7a1a129f1c" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated for the Central Intelligence Agency Retirement
			 and Disability Fund for fiscal year 2014 the sum of $514,000,000.</text></section><section id="ida86774b475af412992c013454ea727c9"><enum>202.</enum><header>CIARDS and FERS special retirement credit for service on detail to another agency</header><subsection id="id61A9B34A143F4479940FFAFC69FBE420"><enum>(a)</enum><header>In general</header><text>Section 203(b) of the Central Intelligence Retirement Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2013">50 U.S.C. 2013(b)</external-xref>)  is amended by striking <quote>For purposes of this Act,</quote> and all that follows through the end and inserting “For purposes of this chapter, qualifying service is service performed by an Agency employee in carrying out duties that are determined by the Director—</text><quoted-block display-inline="no-display-inline" id="id59baa442d8f346a0bc7d016e6cb87494" style="OLC"><paragraph id="idb302c245bbae442e9290e80e7f569e11"><enum>(1)</enum><text>to be in support of intelligence activities abroad hazardous to life or health; or</text></paragraph><paragraph id="ida1eabab5757b488e81112602184e1cf7"><enum>(2)</enum><text>to be so specialized because of security requirements as to be clearly distinguishable from normal government employment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id2aa74fb5b9724e3d8360c842c787377b"><enum>(b)</enum><header>Application</header><text>The amendment made by subsection (a) shall  be applied to retired or deceased officers of the Central Intelligence Agency who were designated at any time under section 203(b) or 302(a) of the Central Intelligence Retirement Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2013">50 U.S.C. 2013(b)</external-xref> and 2152(a)) prior to the date of the enactment of this Act.</text></subsection></section></title><title commented="no" id="id62a69b91cea0496b9184d47ac6d851e2" level-type="subsequent"><enum>III</enum><header display-inline="yes-display-inline">General intelligence community
			 matters</header><subtitle id="idBC05A6EC4ECA4C58AB25CB4DB4BFA9AD" style="OLC"><enum>A</enum><header>General matters</header><section commented="no" display-inline="no-display-inline" id="id4A39212AD60C497FA19DEDFA318FA988" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Restriction on conduct of intelligence
			 activities</header><text display-inline="no-display-inline">The authorization
			 of appropriations by this Act shall not be deemed to constitute authority for
			 the conduct of any intelligence activity which is not otherwise authorized by
			 the Constitution or the laws of the United States.</text></section><section commented="no" display-inline="no-display-inline" id="id6E13D4C14C7E42ECA17DBB202F4FC7C7" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Increase in employee compensation and
			 benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for
			 salary, pay, retirement, and other benefits for Federal employees may be
			 increased by such additional or supplemental amounts as may be necessary for
			 increases in such compensation or benefits authorized by law.</text></section><section id="id3eeb5c9f3e0e4b4ead8dc64fe770c7aa"><enum>303.</enum><header>Open FOIA
			 protections</header><text display-inline="no-display-inline">Section
			 103H(g)(3)(A) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3033">50 U.S.C. 3033(g)(3)(A)</external-xref>) is
			 amended by striking <quote>undertaken;</quote> and inserting <quote>undertaken,
			 and this provision shall qualify as a withholding statute pursuant to
			 subsection (b)(3) of <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code (commonly known
			 as the <quote>Freedom of Information Act</quote>);</quote>.</text></section><section id="id918E563C6AED47C18847469993C61666"><enum>304.</enum><header>Functional
			 managers</header><subsection id="id0523f76b7c8944e9afadfab4062bd7a6"><enum>(a)</enum><header>In
			 general</header><text>The President shall designate officers or employees of
			 the United States to serve as functional managers for signals intelligence,
			 human intelligence, geospatial intelligence, and such other intelligence
			 disciplines as the President determines necessary. Unless the President directs
			 otherwise—</text><paragraph id="idF0E32A11F7C5413B84E55F98D9409723"><enum>(1)</enum><text>the Director of
			 the National Security Agency shall be designated the functional manager for
			 signals intelligence;</text></paragraph><paragraph id="id38E140CA872548B6ACC4A27844ECDDAB"><enum>(2)</enum><text>the Director of
			 the Central Intelligence Agency shall be designated the functional manager for
			 human intelligence; and</text></paragraph><paragraph id="id36F3A0F76E0040079CC6F5BF1B752319"><enum>(3)</enum><text>the Director of
			 the National Geospatial-Intelligence Agency shall be designated the functional
			 manager for geospatial intelligence.</text></paragraph></subsection><subsection id="ida63e96ff022846f1a9305ca8ec5f5ed1"><enum>(b)</enum><header>Duties</header><text>Each
			 functional manager designated under subsection (a) shall act as the principal
			 adviser to the Director of National Intelligence and the Secretary of Defense
			 for their respective intelligence function.</text></subsection><subsection id="id7e55475f1df945c0aa4876f795bf9d45"><enum>(c)</enum><header>Annual reports
			 to Congress</header><text>Each year, on a date not later than 2 weeks after the
			 date on which the President submits to Congress the budget for the next fiscal
			 year under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105</external-xref> of title 31, United States Code, each functional
			 manager shall report to the congressional intelligence committees and
			 congressional armed services committees concerning the performance of the
			 function. In addition to such other information as the functional manager
			 elects to include in a report, each report shall—</text><paragraph id="id0ac228ea64604bb18940d1e0b4f61713"><enum>(1)</enum><text>identify all
			 programs, projects, and activities that fall within the intelligence discipline
			 for which the functional manager is responsible;</text></paragraph><paragraph id="id4e4e1e143e33471da1ed96eca5f2ce8c"><enum>(2)</enum><text>identify any
			 issues related to the application of technical and interoperability standards
			 in such programs, projects, and activities;</text></paragraph><paragraph id="id74096f2a1ccf4477884e5a3a8ab7d1e6"><enum>(3)</enum><text>identify any
			 concerns the functional manager has regarding the allocation of resources among
			 such programs, projects, and activities within the intelligence discipline for
			 which the functional manager is responsible;</text></paragraph><paragraph id="id4CED15BD2F774CD38520C05098A5B861"><enum>(4)</enum><text>assess the
			 sufficiency of resources included in the President's budget request for the
			 next fiscal year to meet requirements within the intelligence discipline for
			 which the functional manager is responsible;</text></paragraph><paragraph id="idc017a8deb1474f409b0eee7018c7ac41"><enum>(5)</enum><text>identify the
			 operational overlap and need for de-confliction within the intelligence
			 discipline for which the functional manager is responsible; and</text></paragraph><paragraph id="id6bad9f4fd2e1443bb381ef1767621a94"><enum>(6)</enum><text>identify any
			 concerns the functional manager has related to compliance within the
			 intelligence discipline for which the functional manager is responsible.</text></paragraph></subsection><subsection id="id0F12229C787747948C53DA08DF03A93F"><enum>(d)</enum><header>Congressional
			 armed services committees defined</header><text>In this section, the term
			 <quote>congressional armed services committees</quote> means—</text><paragraph id="id01AE2098CFF84EF1B041DAD1112B3D32"><enum>(1)</enum><text>the Committee on
			 Armed Services and the Subcommittee on Defense of the Committee on
			 Appropriations of the Senate; and</text></paragraph><paragraph id="id0DE5B0EB80EB4302BDAF6CF9FEFA5FF7"><enum>(2)</enum><text>the Committee on
			 Armed Services and the Subcommittee on Defense of the Committee on
			 Appropriations of the House of Representatives.</text></paragraph></subsection></section><section id="id52d589f8738f4e0bb898abec4834c436"><enum>305.</enum><header>Auditability</header><subsection id="idfa59747333004710a4bfa39277b9126c"><enum>(a)</enum><header>Requirement for
			 annual audits</header><text>Each covered entity shall undergo a full financial
			 audit each year beginning with each covered entity's fiscal year 2014 financial
			 statements. Such audits may be conducted by an internal or external independent
			 accounting or auditing organization.</text></subsection><subsection id="id3C4B90D47F444FBDBD3EA69E799F7116"><enum>(b)</enum><header>Requirement for
			 unqualified opinion</header><text>Not later than the audit required by
			 subsection (a) of fiscal year 2016 financial statements, each covered entity
			 shall obtain an audit with an unqualified opinion on its financial statements
			 for each fiscal year.</text></subsection><subsection id="idA021897510AE4C0788E0CAFF0BE099D1"><enum>(c)</enum><header>Covered entity
			 defined</header><text display-inline="yes-display-inline">In this section, the
			 term <quote>covered entity</quote> means the Office of the Director of National
			 Intelligence, the Central Intelligence Agency, the Defense Intelligence Agency,
			 the National Security Agency, the National Reconnaissance Office, and the
			 National Geospatial-Intelligence Agency.</text></subsection><subsection id="idE0DA84E4D80149AD9A908F5CA37B873C"><enum>(d)</enum><header>Reports to
			 Congress</header><text display-inline="yes-display-inline">The chief financial
			 executive of each covered entity shall provide to the congressional
			 intelligence committees an annual audit report from an accounting or auditing
			 organization on each audit of the covered entity conducted pursuant to
			 subsection (a).</text></subsection></section><section id="id5458a27149104088a4d768bd007b75a8"><enum>306.</enum><header>Software
			 licensing</header><subsection commented="no" id="id01be67c051ec439db0bceb907db40b09"><enum>(a)</enum><header>Requirement for
			 inventories of software licenses</header><paragraph commented="no" id="idCB22D1D4C5FE49EABD07C12AB01F90CE"><enum>(1)</enum><header>Inventories by
			 elements of the intelligence community</header><text>Not later than 120 days
			 after the date of the enactment of this Act, and once every 2 years thereafter,
			 the chief information officer of each element of the intelligence community, in
			 consultation with the Chief Information Officer of the Intelligence Community,
			 shall—</text><subparagraph commented="no" id="idd8c82f2ff3b84fa9a1807a6d382963f3"><enum>(A)</enum><text>conduct an
			 inventory of all existing software licenses of such element, including utilized
			 and unutilized licenses;</text></subparagraph><subparagraph commented="no" id="id55141adf696a4da8b0ceb47dceee794b"><enum>(B)</enum><text>assess the
			 actions that could be carried out by such element to achieve the greatest
			 possible economies of scale and associated cost savings in software procurement
			 and usage; and</text></subparagraph><subparagraph commented="no" id="ideb72f5c872de45dbbd00e45eb58057c1"><enum>(C)</enum><text>submit to the
			 Chief Information Officer of the Intelligence Community each inventory required
			 by subparagraph (A) and each assessment required by subparagraph (B).</text></subparagraph></paragraph><paragraph commented="no" id="id6729EDEA4A074EA8A1204C3F2EB6E2BF"><enum>(2)</enum><header>Initial
			 inventory</header><text>The initial inventory conducted for each element of the
			 intelligence community under paragraph (1)(A) shall be based on the inventory
			 of software licenses conducted pursuant to section 305 of the Intelligence
			 Authorization Act for Fiscal Year 2013 (<external-xref legal-doc="public-law" parsable-cite="pl/112/277">Public Law 112–277</external-xref>; 126 Stat. 2472) for
			 such element.</text></paragraph></subsection><subsection commented="no" id="id1662c6a6547d499aa7741c47e70bf144"><enum>(b)</enum><header>Inventories by
			 the Chief Information Officer of the Intelligence Community</header><text>Not
			 later than 180 days after the enactment of this Act, and once every 2 years
			 thereafter, the Chief Information Officer of the Intelligence Community shall,
			 based on the inventories and assessments required by subsection (a)—</text><paragraph commented="no" id="id594aabd3642d4665b2846848f95018fe"><enum>(1)</enum><text>compile an
			 inventory of all existing software licenses of the intelligence community,
			 including utilized and unutilized licenses; and</text></paragraph><paragraph commented="no" id="id1D07DE88DA544520B9F7D2552AEB87EA"><enum>(2)</enum><text>assess the
			 actions that could be carried out by the intelligence community to achieve the
			 greatest possible economies of scale and associated cost savings in software
			 procurement and usage.</text></paragraph></subsection><subsection commented="no" id="id23b59bf560c7424aabc592193440fe3c"><enum>(c)</enum><header>Reports to
			 Congress</header><text>The Chief Information Officer of the Intelligence
			 Community shall submit to the congressional intelligence committees a copy of
			 each inventory compiled under subsection (b)(1).</text></subsection></section><section id="idD06D68527ACB4B998860EF032CCEC0C9"><enum>307.</enum><header>Public
			 Interest Declassification Board</header><text display-inline="no-display-inline">Section 710(b) of the Public Interest
			 Declassification Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/567">Public Law 106–567</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/3161">50 U.S.C. 3161</external-xref> note) is
			 amended by striking <quote>2014.</quote> and inserting
			 <quote>2018.</quote>.</text></section><section id="id08C3EFA7E57E4C4283A2D49643413EDE"><enum>308.</enum><header>Reports of
			 fraud, waste, and abuse</header><text display-inline="no-display-inline">Section 8H(a) of the Inspector General Act
			 of 1978 (5 U.S.C. App.) is amended in paragraph (1)—</text><paragraph id="id30789A960C814A1BAB90F2D34DD4B930"><enum>(1)</enum><text>by redesignating
			 subparagraphs (B) and (C) as subparagraphs (C) and (D), respectively;</text></paragraph><paragraph id="id20460BFCEE4D43FC8A359382EB2A3813"><enum>(2)</enum><text>by inserting
			 after subparagraph (A) the following:</text><quoted-block display-inline="no-display-inline" id="idF34E6E0A8D8F4963A256C0D3D05057EB" style="OLC"><subparagraph id="id67D01A0EAC45411084549F4806375CA0" indent="up2"><enum>(B)</enum><text>An employee of an element of the

				and</after-quoted-block></quoted-block></paragraph><paragraph id="idB27527410D6E4CCFAA0FAC3A8D60A672"><enum>(3)</enum><text>in subparagraph
			 (D), as redesignated by paragraph (1)—</text><subparagraph id="idB37C214B89944D40BC4CF137AF076D75"><enum>(A)</enum><text>by striking
			 <quote>Act or section 17</quote> and inserting <quote>Act, section 17</quote>;

			 Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3033">50 U.S.C. 3033(k)</external-xref>).</quote>.</text></subparagraph></paragraph></section></subtitle><subtitle id="idF5641ED8E5D24A06B01DBFCEE996C09A" style="OLC"><enum>B</enum><header>Targeted lethal force oversight</header><section id="id6423402E34684F41898197574C472CA6"><enum>311.</enum><header>Targeted lethal force oversight reform</header><subsection id="idCE4447C0D6B64956B9D7865C7FEACD2E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id9499A28F082744E4A0646B483E7A6E2F"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Director of National Intelligence.</text></paragraph><paragraph id="id7460B12E45364539AF2FA49AA946DFCD"><enum>(2)</enum><header>United States person</header><text>The term <term>United States person</term> means a citizen of the United States or an alien lawfully admitted for permanent residence (as defined in section 101(a)(20) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(20)</external-xref>)).</text></paragraph></subsection><subsection id="id14C1E648252C475D989D4491EEEE2287"><enum>(b)</enum><header>Alternative analysis</header><paragraph id="id7A09A2CFF33A475FBB298003B5FC25B7"><enum>(1)</enum><header>Notification of director</header><text>Upon a determination by the head of an element of the intelligence community that a particular, known United States person is knowingly engaged in acts of international terrorism against the United States, such that the United States Government is considering the legality or the use of targeted lethal force against that United States person, the head of the  element shall, as soon as practicable, notify the Director of the determination.</text></paragraph><paragraph id="idC68A064349934B249E4DE530A08917ED"><enum>(2)</enum><header>Independent alternative analysis</header><subparagraph id="id8FA1C3DEB0A14D8C89270C02AACA7E39"><enum>(A)</enum><header>Requirement for alternative analysis</header><text>Not later than 15 days after the date the Director receives a notification under paragraph (1), the Director shall complete an independent alternative analysis (commonly referred to as <quote>red-team analysis</quote>) of the information relied on to support the determination made under paragraph (1).</text></subparagraph><subparagraph id="idEED6F82D82C04F219235B15616DC6F92"><enum>(B)</enum><header>Independent leadership</header><text>In completing the independent alternative analysis required by subparagraph (A), the Director shall ensure that the  individual appointed to lead such alternative analysis does not report to the  head of the element of the intelligence community who made the determination under paragraph (1).</text></subparagraph></paragraph><paragraph id="id18FA6634F03A448FAA1C5346ACDD82F8"><enum>(3)</enum><header>Notification of the Inspector General of the Intelligence Community</header><text>As soon  as practicable, the Director shall notify the Inspector General of the Intelligence Community of the receipt of a notification under paragraph (1).</text></paragraph><paragraph id="idFAE80800EED04F29A1DDE6A9BF0C1A14"><enum>(4)</enum><header>Notification to Congress</header><text>As soon as practicable, the Director shall notify the congressional intelligence committees, in writing, of the receipt of a notification under paragraph (1), including the identity of the United States person, and the results of the independent alternative analysis performed under paragraph (2), including any written product containing the alternative analysis, or if no product has been created, a summary of such analysis.</text></paragraph><paragraph id="id8AD3F8CDBCA54D73BF2FF9A8720E3D9E"><enum>(5)</enum><header>Construction with other law</header><text>Nothing in this section shall be construed to impede the ability of the United States Government to conduct any operation consistent with otherwise applicable law.</text></paragraph></subsection><subsection id="id183E6BBB6ABE44C2BDE24B439FFA9CD1"><enum>(c)</enum><header>Inspector General of the Intelligence Community review</header><text>On an annual basis the Inspector General of the Intelligence Community shall—</text><paragraph id="id61C9614AA4FA4A42A06A0B8262CEB9C4"><enum>(1)</enum><text>conduct a review of any notifications received under subsection (b)(3) with respect to the element of the intelligence community’s compliance with all appropriate policies and procedures related to consideration of the use of targeted lethal force against a particular, known United States person; and</text></paragraph><paragraph id="id838B92C1B195470590D2E9CB4005EBAE"><enum>(2)</enum><text>submit to the Director and the congressional intelligence committees a report on the findings of such review.</text></paragraph></subsection><subsection id="id397374A8850A4042B8BA48E7A9BC0276"><enum>(d)</enum><header>Construction</header><text>Nothing in this section may be
construed to authorize the use of targeted lethal force
against a United States person.</text></subsection></section><section id="id691F6D19A6154C8C8EDA74AB8E0E28C5" section-type="subsequent-section"><enum>312.</enum><header>Unclassified annual report on the use of targeted lethal force outside the United States</header><subsection id="ideaa717191c17498480034132763288c8"><enum>(a)</enum><header>Requirement for annual report</header><text>For each year, the President shall prepare and make public an annual report that sets forth the following:</text><paragraph id="ide4547e4cce9045c89aa6dcbc75f2e0c0"><enum>(1)</enum><text>The total number of combatants killed or injured during the preceding year by the use of targeted lethal force outside the United States by remotely piloted aircraft.</text></paragraph><paragraph id="idec4acca281264a5386d5b15f3260ea7e"><enum>(2)</enum><text>The total number of noncombatant civilians killed or injured during the preceding year by such use of targeted lethal force outside the United States.</text></paragraph></subsection><subsection id="ideb59b19d30ae44cabe2099ae94e90136"><enum>(b)</enum><header>Targeted lethal force defined</header><text>In this section, the term <term>targeted lethal force</term> means the act of directing lethal force at a particular person or group with the specific intent of killing those persons.</text></subsection><subsection id="id6b713a3ae66d49c48630d02aa55f3c62"><enum>(c)</enum><header>Exception</header><text>A report required by subsection (a) shall not include—</text><paragraph id="id82E30088220D41AA94BE032F80B40F72"><enum>(1)</enum><text>any use of targeted lethal force in Afghanistan prior to the end of combat operations by the United States; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id655D07164E644B9F9951501BE04359BD"><enum>(2)</enum><text>any use of targeted lethal force in a foreign country described by a future declaration of war or authorization for the use of military force.</text></paragraph></subsection></section></subtitle><subtitle id="idD4C3E905B4554FA08C6FB030FC45D091" style="OLC"><enum>C</enum><header>Reporting</header><section id="idFE6C458C49344A0A9AEF5AE141F38152"><enum>321.</enum><header>Opinions of
			 the Office of Legal Counsel concerning intelligence activities</header><subsection id="idd972098fb06b4f12b13dd4115f8adc5f"><enum>(a)</enum><header>Annual
			 submission</header><paragraph id="ida8956a75de444b2ab5ab23d2941c6b13"><enum>(1)</enum><header>Requirement to
			 provide list of opinions to Congress</header><text>Except as provided in
			 subsections (b) and (c), not later than 180 days after the date of the
			 enactment of this Act and annually thereafter, the Attorney General, in
			 coordination with the Director of National Intelligence, shall provide to the
			 congressional intelligence committees a listing of every opinion of the Office
			 of Legal Counsel of the Department of Justice that has been provided to an
			 element of the intelligence community.</text></paragraph><paragraph id="id74752F1F9FC74A0ABD57E8C0D3BB1BC2"><enum>(2)</enum><header>Content</header><text>Each
			 listing submitted under paragraph (1) shall include—</text><subparagraph id="id226C85A4B12649DA818BE9142E228764"><enum>(A)</enum><text>as much detail as
			 possible about the subject of each opinion;</text></subparagraph><subparagraph id="id74cf287855bd4b43a6588a83991a88f9"><enum>(B)</enum><text>the date the
			 opinion was issued;</text></subparagraph><subparagraph id="id90bbfa74ff3443a29419f425cb6dedbe"><enum>(C)</enum><text>a listing of each
			 recipient agency;</text></subparagraph><subparagraph id="id2d315f1d2d3e40858c3ecf362aea2a2e"><enum>(D)</enum><text>whether the
			 opinion has been made available to Congress or a specific committee of
			 Congress, including the identity of each such committee; and</text></subparagraph><subparagraph id="id0726f1de181f4524a7a548d8d511ddf4"><enum>(E)</enum><text>for any opinion
			 that has not been made available to Congress or a specific committee of
			 Congress, the basis for such withholding.</text></subparagraph></paragraph></subsection><subsection id="id23ec522b9485463b968016096e39bb52"><enum>(b)</enum><header>Exception for
			 covert action</header><text>If the President determines that it is essential to
			 limit access to a covert action finding under section 503(c)(2) of the National
			 Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3093">50 U.S.C. 3093(c)(2)</external-xref>), the President may limit access to
			 information concerning such finding that is subject to disclosure under
			 subsection (a) to those members of Congress who have been granted access to the
			 relevant finding under such section 503(c)(2).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd4688dea6cbf478f973a33017acda4dd"><enum>(c)</enum><header>Exception for
			 information subject to executive privilege</header><text>If the President
			 determines that a particular listing subject to disclosure under subsection (a)
			 is subject to an executive privilege that protects against such disclosure, the
			 Attorney General shall not be required to disclose such opinion or listing if
			 the Attorney General notifies the congressional intelligence committees, in
			 writing, of the legal justification for such assertion of executive privilege
			 prior to the date by which the opinion or listing is required to be
			 disclosed.</text></subsection></section><section id="id8F2DEB4B1CB4471183C8A1B7A001FC7B"><enum>322.</enum><header>Submittal to Congress by heads of elements of intelligence community of plans for orderly shutdown in event of absence of appropriations</header><subsection id="id1B76DE8815EE4E84BA7E5EB3B6D8F43F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Whenever the head of an applicable agency submits a plan to the Director of the Office of Management and Budget in accordance with  section 124 of Office of Management and Budget Circular A–11, pertaining to agency operations in the absence of appropriations, or any successor circular of the Office that requires the head of an applicable agency to submit to the Director a plan for an orderly shutdown in the event of the absence of appropriations, such head shall submit a copy of such plan to the following:</text><paragraph id="idDE009851583B47E9808B90E898501867"><enum>(1)</enum><text display-inline="yes-display-inline">The congressional intelligence committees.</text></paragraph><paragraph id="idDCF01BE288E042A59363DF1C3E4051E4"><enum>(2)</enum><text>The Committee on Armed Services of the Senate.</text></paragraph><paragraph id="id416B3C8750D541189248512F2D51AACD"><enum>(3)</enum><text>The Subcommittee on Defense of the Committee on Appropriations of the Senate.</text></paragraph><paragraph id="idF19382BC51D9406FBD7477060D604E71"><enum>(4)</enum><text>The Committee on Armed Services of the House of Representatives.</text></paragraph><paragraph id="id8CEEFC3696144850BA1682C311246845"><enum>(5)</enum><text>The Subcommittee on Defense of the Committee on Appropriations of the House of Representatives.</text></paragraph></subsection><subsection id="id25AACB23849547539204FD2813511F2F"><enum>(b)</enum><header>Head of an applicable agency defined</header><text>In this section, the term <term>head of an applicable agency</term> includes the following:</text><paragraph id="id102E834A2DE9421FB526EF7342353A76"><enum>(1)</enum><text>The Director of National Intelligence.</text></paragraph><paragraph id="id8A2C760C4C4D4398826DF30378ADBB5F"><enum>(2)</enum><text>The Director of the Central Intelligence Agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAB62AC7FDA7D4F6A962B6E954846AD38"><enum>(3)</enum><text>Each head of each element of the intelligence community that is within the Department of Defense.</text></paragraph></subsection></section><section id="idEAC420D0618A469AADBDBB3F757E701C"><enum>323.</enum><header>Reports on chemical weapons in Syria</header><subsection id="id51D12F10BE4546A99DA24D4530FDE59B"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the appropriate congressional committees a report on the Syrian chemical weapons program.</text></subsection><subsection id="idA58E6AAB96CD4F098C8536C2DADAD2C9"><enum>(b)</enum><header>Elements</header><text>The report required under subsection (a) shall include the following elements:</text><paragraph id="id6bc22e4fea964f5a90f043af0b4b792a"><enum>(1)</enum><text>A comprehensive assessment of chemical weapon stockpiles in Syria, including names, types, and quantities of chemical weapons agents, types of munitions, and location and form of storage, production, and research and development facilities.</text></paragraph><paragraph id="id283d9b4970754eb0bc585276c7913813"><enum>(2)</enum><text>A listing of key personnel associated with the Syrian chemical weapons program.</text></paragraph><paragraph id="id2692d0e29c3347b0a33ef900e478c727"><enum>(3)</enum><text>An assessment of undeclared chemical weapons stockpiles, munitions, and facilities.</text></paragraph><paragraph id="id4061ef942f444b4789ad855b8e1e4ccf"><enum>(4)</enum><text>An assessment of how these stockpiles, precursors, and delivery systems were obtained.</text></paragraph><paragraph id="id0a9bc955fd5d4790a255bcd45cf0d191"><enum>(5)</enum><text>A description of key intelligence gaps related to the Syrian chemical weapons program.</text></paragraph><paragraph id="id567850501d6c4d84a82024d0c7f2366e"><enum>(6)</enum><text>An assessment of any denial and deception efforts on the part of the Syrian regime related to its chemical weapons program.</text></paragraph></subsection><subsection id="ide90c277ddc1448189f454cdca45a5c65"><enum>(c)</enum><header>Progress reports</header><text>Every 90 days until the Director of National Intelligence makes the certification described in subsection (d) or 18 months after the date of the enactment of this Act, whichever is earlier, the Director of National Intelligence shall submit to the appropriate congressional committees a progress report providing any material updates to the report required under subsection (a).</text></subsection><subsection commented="no" id="id4328A829D71B4D3B9D75E4026327616C"><enum>(d)</enum><header>Certification</header><text>The certification described in this subsection is a certification by the Director of National Intelligence to the appropriate congressional committees that the Syrian regime has completely and verifiably destroyed all components of its chemical weapons program.</text></subsection><subsection id="idF51478AAAF1E4806B00C160CC5076720"><enum>(e)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text><paragraph id="idA137BD5F6F5849118C47B98CDFBB4EE9"><enum>(1)</enum><text>the Select Committee on Intelligence, the Committee on Armed Services, the Committee on Foreign Relations, and the Committee on Appropriations of the Senate; and</text></paragraph><paragraph id="id1EE8E3FA80D048C3863AE36A4E7AD4AD"><enum>(2)</enum><text>the Permanent Select Committee on Intelligence, the Committee on Armed Services, the Committee on Foreign Affairs, and the Committee on Appropriations of the House of Representatives.</text></paragraph></subsection></section><section id="id5BA865B373714737B41E8BCD88090BF0"><enum>324.</enum><header>Reports to the
		intelligence community on penetrations of networks and information systems of
		certain contractors</header><subsection id="HE3EC5C963A0A4126B3DDB7844B607907"><enum>(a)</enum><header>Procedures for
		reporting penetrations</header><text>The Director of National Intelligence
		shall establish procedures that require each cleared intelligence contractor to
		report to an element of the intelligence community designated by the Director
		for purposes of such procedures when a network or information system of such
		contractor that meets the criteria established pursuant to subsection (b) is
		successfully penetrated.</text></subsection><subsection id="id654A26C22FBE4195839AB2E5303E578B"><enum>(b)</enum><header>Networks and
		information systems subject to reporting</header><text>The Director of National
		Intelligence shall, in consultation with appropriate officials, establish
		criteria for covered networks to be subject to the procedures for reporting
		system penetrations under subsection (a).</text></subsection><subsection id="id26497617C1824CB69C3CFCB1D196B892"><enum>(c)</enum><header>Procedure
		requirements</header><paragraph id="id3670740002A5443DAFACD5ADFEE23AF5"><enum>(1)</enum><header>Rapid
		reporting</header><text>The procedures established pursuant to subsection (a)
		shall require each cleared intelligence contractor to rapidly report to an
		element of the intelligence community designated pursuant to subsection (a) of
		each successful penetration of the network or information systems of such
		contractor that meet the criteria established pursuant to subsection (b). Each
		such report shall include the following:</text><subparagraph id="idDC3585DD805546F899EA11117E13B958"><enum>(A)</enum><text>A
		description of the technique or method used in such penetration.</text></subparagraph><subparagraph id="idBBFC005FDA874BBA8ED89AEF9CAAA6F0"><enum>(B)</enum><text>A
		sample of the malicious software, if discovered and isolated by the contractor,
		involved in such penetration.</text></subparagraph><subparagraph id="id6736941595F0446D9582E63D1CF4CD4A"><enum>(C)</enum><text>A
		summary of information created by or for such element in connection with any
		program of such element that has been potentially compromised due to such
		penetration.</text></subparagraph></paragraph><paragraph id="id1879D702E54442A79256C90DA7E58435"><enum>(2)</enum><header>Access to
		equipment and information by intelligence community personnel</header><text display-inline="yes-display-inline">The procedures established pursuant to
		subsection (a) shall—</text><subparagraph id="id52297B433AD54C14A54C5A6D97FE318D"><enum>(A)</enum><text display-inline="yes-display-inline">include mechanisms for intelligence
		community personnel to, upon request, obtain access to equipment or information
		of a cleared intelligence contractor necessary to conduct forensic analysis in
		addition to any analysis conducted by such contractor;</text></subparagraph><subparagraph id="id90C6E93980A8457F9306F604CCC4D9BB"><enum>(B)</enum><text display-inline="yes-display-inline">provide that a cleared intelligence
		contractor is only required to provide access to equipment or information as
		described in subparagraph (A) to determine whether information created by or
		for an element of the intelligence community in connection with any
		intelligence community program was successfully exfiltrated from a network or
		information system of such contractor and, if so, what information was
		exfiltrated; and</text></subparagraph><subparagraph id="id58B5628ED43A4B35AC1601D028E8900E"><enum>(C)</enum><text>provide for the
		reasonable protection of trade secrets, commercial or financial information,
		and information that can be used to identify a specific person.</text></subparagraph></paragraph><paragraph id="id8B10FB93928D43B69EB0CED31F8DE06A"><enum>(3)</enum><header>Limitation on
		dissemination of certain information</header><text>The procedures established
		pursuant to subsection (a) shall prohibit the dissemination outside the
		intelligence community of information obtained or derived through such
		procedures that is not created by or for the intelligence community except with
		the approval of the contractor providing such information.</text></paragraph></subsection><subsection id="idE318C53817D6446D910541232AAE886C"><enum>(d)</enum><header>Issuance of
		procedures and establishment of criteria</header><paragraph id="id459729936AF1484E81BCD4A3DE57BDFB"><enum>(1)</enum><header>In
		general</header><text>Not later than 90 days after the date of the enactment of
		this Act—</text><subparagraph id="idD8AB35A910414235A6DAC45813CAB5EB"><enum>(A)</enum><text>the Director of
		National Intelligence shall establish the procedures required under subsection
		(a); and</text></subparagraph><subparagraph id="idD1F4F4EF135E42A289437F5AF31624CE"><enum>(B)</enum><text>the senior
		official designated under subsection (b)(1) shall establish the criteria
		required under such subsection.</text></subparagraph></paragraph><paragraph id="id10CCE7FC490C40D6BD82B34D997F2142"><enum>(2)</enum><header>Applicability
		date</header><text>The requirements of this section shall apply on the date on
		which the Director of National Intelligence establishes the procedures required
		under this section.</text></paragraph></subsection><subsection id="id1C93E636EC184614903632AC396A79A3"><enum>(e)</enum><header>Coordination
		with the Secretary of Defense To prevent duplicate reporting</header><text>Not
		later than 180 days after the date of the enactment of this Act, the Director
		of National Intelligence and the Secretary of Defense shall establish
		procedures to permit a contractor that is a cleared intelligence contractor and
		a cleared defense contractor under section 941 of the National Defense
		Authorization Act for Fiscal Year 2013 (<external-xref legal-doc="usc" parsable-cite="usc/10/2224">10 U.S.C. 2224</external-xref> note) to submit a single
		report that satisfies the requirements of this section and such section 941 for
		an incident of penetration of network or information system.</text></subsection><subsection id="id8E18F26AFCBE49F286A6B4240C86C205"><enum>(f)</enum><header>Definitions</header><text>In
		this section:</text><paragraph id="id5E0C58A3330E4B6C97A49B997E6887DC"><enum>(1)</enum><header>Cleared
		intelligence contractor</header><text>The term <term>cleared intelligence
		contractor</term> means a private entity granted clearance by the Director of
		National Intelligence or the head of an element of the intelligence community
		to access, receive, or store classified information for the purpose of bidding
		for a contract or conducting activities in support of any program of an element
		of the intelligence community.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2DF9A6723F5C4B6B9935E4A40D063094"><enum>(2)</enum><header>Covered
		network</header><text display-inline="yes-display-inline">The term
		<quote>covered network</quote> means a network or information system of a
		cleared intelligence contractor that contains or processes information created
		by or for an element of the intelligence community with respect to which such
		contractor is required to apply enhanced protection.</text></paragraph></subsection></section><section id="idA69169D032824F24BF228C85012D451D"><enum>325.</enum><header>Repeal or
			 modification of certain reporting requirements</header><subsection id="id52BBDA5A471D4469A49CA7F91390F701"><enum>(a)</enum><header>Repeal of
			 certain reporting requirements</header><paragraph id="ida649c638462c439d9bfb5143e2ba94a6"><enum>(1)</enum><header>Annual report
			 on the threat of attack on the United States using weapons of mass
			 destruction</header><subparagraph id="id561689E917E148CEB841AA879BA94FAD"><enum>(A)</enum><header>Repeal</header><text>Section
			 114 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3050">50 U.S.C. 3050</external-xref>) is amended to read as
			 follows:</text><quoted-block display-inline="no-display-inline" id="idD8A45FE5B662429EBCE85377535157A4" style="OLC"><section id="idD9F04FCC58B948008410E1E055FC49C6"><enum>114.</enum><header>Annual report on hiring and retention of minority
		  employees</header><subsection id="id6C73E753D58E40B5A4EC1360486611D2"><enum>(a)</enum><header>Requirement for
				report</header><text>The Director of National Intelligence shall, on an annual
				basis, submit to Congress a report on the employment of covered persons within
				each element of the intelligence community for the preceding fiscal
				year.</text></subsection><subsection id="ID48E92178AF9E4C7FAB603E30C1F72E95"><enum>(b)</enum><header>Content</header><text>Each
				such report shall include disaggregated data by category of covered person from
				each element of the intelligence community on the following:</text><paragraph id="IDCFD66D33848F48A9825301803BF3321F"><enum>(1)</enum><text>Of all
				individuals employed in the element during the fiscal year involved, the
				aggregate percentage of such individuals who are covered persons.</text></paragraph><paragraph id="ID0308042BDC41441BBD6AC0EB98305C3B"><enum>(2)</enum><text>Of all
				individuals employed in the element during the fiscal year involved at the
				levels referred to in subparagraphs (A) and (B), the percentage of covered
				persons employed at such levels:</text><subparagraph id="ID65C8A1A76A8A487AA57A94CD124A5854"><enum>(A)</enum><text>Positions at
				levels 1 through 15 of the General Schedule.</text></subparagraph><subparagraph id="ID216EBD5AEA654283A01F4212664CF0D0"><enum>(B)</enum><text>Positions at
				levels above GS–15.</text></subparagraph></paragraph><paragraph id="ID55AE75F920C34861B3AEACC9025F6FF7"><enum>(3)</enum><text>Of all
				individuals hired by the element involved during the fiscal year involved, the
				percentage of such individuals who are covered persons.</text></paragraph></subsection><subsection id="ID1C4084D557BA4E0AA88F54E3ADE2F9B9"><enum>(c)</enum><header>Form of
				report</header><text>Each such report shall be submitted in unclassified form,
				but may contain a classified annex.</text></subsection><subsection id="ID1344FC040E504D80A80FAD4BF4B6AF55"><enum>(d)</enum><header>Construction</header><text>Nothing
				in this section shall be construed as providing for the substitution of any
				similar report required under another provision of law.</text></subsection><subsection id="IDBE8FC4B22A344063BB5224A8F5B595DC"><enum>(e)</enum><header>Covered persons
				defined</header><text>In this section, the term <term>covered persons</term>
				means—</text><paragraph id="ID939EF61F64414496B0C889D5AFD3475A"><enum>(1)</enum><text>racial and ethnic
				minorities;</text></paragraph><paragraph id="ID4BEDB8302BB5427CABA856BCAE1A6482"><enum>(2)</enum><text>women; and</text></paragraph><paragraph id="ID5AD61CC172EB44EA851979D3354F296C"><enum>(3)</enum><text>individuals with
				disabilities.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="id1434B32260CF4DB9AA26B61F7DE58893"><enum>(B)</enum><header>Table of
			 contents amendment</header><text>The table of contents in the first section of

				reasons for a determination by the Director under section 4(b)(3) of the

			 the matter preceding paragraph (1) by striking <quote>2015,</quote> and

			 Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3343">50 U.S.C. 3343(c)(4)</external-xref>) is amended to read as
			 follows:</text><quoted-block display-inline="no-display-inline" id="id903DB9BCE2C04D67A6A7376D5FCFA1C3" style="OLC"><paragraph id="idca71c49a1c2e4d97be0b96769fc86c01"><enum>(4)</enum><header>Waivers of
				conditions for disqualification for security clearances</header><subparagraph id="id3C75CA2BC2A34D3083C8CF84BFC19993"><enum>(A)</enum><header>Notification</header><text>The
				head of a Federal agency shall notify the appropriate committees of Congress if
				such agency employs or employed a person for whom a waiver was granted in
				accordance with paragraph (2) within 15 days of granting such waiver. Such
				notification shall not reveal the identity of such person, but shall include
				the disqualifying factor under paragraph (1) and the reasons for the waiver of
				the disqualifying factor.</text></subparagraph><subparagraph id="id49b5fea9a97f49afbee2b59fd649e9c0"><enum>(B)</enum><header>Definitions</header><text>In

				Oversight and Government Reform of the House of Representatives; and</text></subclause><subclause id="id3cdfa213f89a45e3833faadb28f1a39b"><enum>(V)</enum><text>each Committee of
				the Senate or the House of Representatives with oversight authority over such

			 clearance reform</header><section id="idc123a3ffbb654a2da96e2f7e626d2d99"><enum>501.</enum><header>Appropriate
			 committees of Congress defined</header><text display-inline="no-display-inline">In this title, the term <term>appropriate
			 committees of Congress</term> means—</text><paragraph id="id3A5765A7D1B543648A15411AE9656C6B"><enum>(1)</enum><text>the congressional
			 intelligence committees;</text></paragraph><paragraph id="idBEEB0035B0C44C8FAC48E0285585CB17"><enum>(2)</enum><text>the Committee on
			 Armed Services and the Committee on Homeland Security and Governmental Affairs
			 of the Senate; and</text></paragraph><paragraph id="id0155B7D93E1348C2BA07C3E0C6023166"><enum>(3)</enum><text>the Committee on
			 Armed Services and the Committee on Homeland Security of the House of
			 Representatives.</text></paragraph></section><section id="idA7B8D933B51149FABE0737E901526A7A"><enum>502.</enum><header>Technology
			 improvements to security clearance processing</header><subsection id="id84a8f1d8bd604747a605a9c62220d218"><enum>(a)</enum><header>In
			 general</header><text>The Director of National Intelligence, in consultation
			 with the Secretary of Defense and the Director of the Office of Personnel
			 Management, shall conduct an analysis of the relative costs and benefits of
			 potential improvements to the process for investigating persons who are
			 proposed for access to classified information and adjudicating whether such
			 persons satisfy the criteria for obtaining and retaining access to such
			 information.</text></subsection><subsection id="id4e2b98a9f7834bb8ad8cf60e6f93b771"><enum>(b)</enum><header>Contents of
			 analysis</header><text>In conducting the analysis required by subsection (a),
			 the Director of National Intelligence shall evaluate the costs and benefits
			 associated with—</text><paragraph id="id7f86c1110860428083005f5f355166d9"><enum>(1)</enum><text>the elimination
			 of manual processes in security clearance investigations and adjudications, if
			 possible, and automating and integrating the elements of the investigation
			 process, including—</text><subparagraph id="id43f9aedb9f1d492389d8c3fac5d97ebd"><enum>(A)</enum><text>the clearance
			 application process;</text></subparagraph><subparagraph id="id0cbb4b14937e42d099060cc05eeb0e9b"><enum>(B)</enum><text>case
			 management;</text></subparagraph><subparagraph id="id0d7b8fe58493444c9f0b29eba54370b6"><enum>(C)</enum><text>adjudication
			 management;</text></subparagraph><subparagraph id="id7fd4a8be163a49288a6b95f8049fabad"><enum>(D)</enum><text>investigation
			 methods for the collection, analysis, storage, retrieval, and transfer of data
			 and records; and</text></subparagraph><subparagraph id="idb3c7ad0c82d34fc9a6df65c046ec9140"><enum>(E)</enum><text>records
			 management for access and eligibility determinations;</text></subparagraph></paragraph><paragraph id="id17e5d9b0bf7f45d0a066151b69b00a08"><enum>(2)</enum><text>the elimination
			 or reduction, if possible, of the use of databases and information sources that
			 cannot be accessed and processed automatically electronically, or modification
			 of such databases and information sources, to enable electronic access and
			 processing;</text></paragraph><paragraph id="idc0fd8a095b29404898e7fef76a10340a"><enum>(3)</enum><text>the use of
			 government-developed and commercial technology for continuous monitoring and
			 evaluation of government and commercial data sources that can identify and flag
			 information pertinent to adjudication guidelines and eligibility
			 determinations;</text></paragraph><paragraph id="id34e26fc427bf419a80219ff3cb01ac09"><enum>(4)</enum><text>the
			 standardization of forms used for routine reporting required of cleared
			 personnel (such as travel, foreign contacts, and financial disclosures) and use
			 of continuous monitoring technology to access databases containing such
			 reportable information to independently obtain and analyze reportable data and
			 events;</text></paragraph><paragraph id="idfb87646cf56b4d8e8728671738afbdfe"><enum>(5)</enum><text>the establishment
			 of an authoritative central repository of personnel security information that
			 is accessible electronically at multiple levels of classification and
			 eliminates technical barriers to rapid access to information necessary for
			 eligibility determinations and reciprocal recognition thereof;</text></paragraph><paragraph id="id9a9ae53752554f68b31421af2da2ab0c"><enum>(6)</enum><text>using digitally
			 processed fingerprints, as a substitute for ink or paper prints, to reduce
			 error rates and improve portability of data;</text></paragraph><paragraph id="idde1bac922ca14e0ab45464467f6e6d4a"><enum>(7)</enum><text>expanding the use
			 of technology to improve an applicant’s ability to discover the status of a
			 pending security clearance application or reinvestigation; and</text></paragraph><paragraph id="idfedfd4862e4f4ba995c86ea7cfb37ee9"><enum>(8)</enum><text>using government
			 and publicly available commercial data sources, including social media, that
			 provide independent information pertinent to adjudication guidelines to improve
			 quality and timeliness, and reduce costs, of investigations and
			 reinvestigations.</text></paragraph></subsection><subsection id="idb6e961d069c6411e9acdf09d11b3f3d3"><enum>(c)</enum><header>Report to
			 Congress</header><text>Not later than 6 months after the date of the enactment
			 of this Act, the Director of National Intelligence shall submit to the
			 appropriate committees of Congress a report on the analysis required by
			 subsection (a).</text></subsection></section><section id="id7f5ca8e2cd474a748b453205fed86eff"><enum>503.</enum><header>Enhanced
			 reciprocity of security clearances</header><text display-inline="no-display-inline">Section 3001(d) of the Intelligence Reform
			 and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341(d)</external-xref>) is amended by adding
			 at the end the following:</text><quoted-block display-inline="no-display-inline" id="id56730254404140A5AC50DF6C4891678F" style="OLC"><paragraph id="idb5202927bfb94040b801a9aa68ee7237" indent="up1"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idE7A4EF2F15DE4FB092E311089F8092C6"><enum>(A)</enum><text>No agency may reject
				another agency's determination that an individual is eligible for access to
				classified information on the basis that such eligibility determination is
				out-of-scope, unless the head of the entity selected pursuant to subsection (b)
				certifies to the appropriate committees of Congress that the rejecting agency
				does not employ any personnel who have background investigations that are
				out-of-scope.</text></subparagraph><subparagraph id="id157051F8C779483185248229C8733524" indent="up1"><enum>(B)</enum><text>In this paragraph, the term
				<quote>out-of-scope</quote> means a background investigation or reinvestigation
				that is more than—</text><clause id="id022DA819EAF7477FAF8ACBA7F0CD2C01"><enum>(i)</enum><text>7 years old in the case of a top
				secret clearance;</text></clause><clause id="id85943BE047544242BA687D8665E9680B"><enum>(ii)</enum><text>10 years old in the case of a secret
				clearance; or</text></clause><clause id="idDB8FDFECB76D40A0BD43620698E30FEC"><enum>(iii)</enum><text>15 years old in the case of a
				confidential clearance.</text></clause></subparagraph></paragraph><paragraph id="id15aac987919e4fb982cdd4056b49c31f" indent="up1"><enum>(8)</enum><text>All personnel who have been
				determined to be eligible for access to classified information shall be
				presumed to be suitable for employment, unless and until the head of an agency
				determines on a case-by-case basis that an individual is not suitable for
				employment, in which case the individual shall be notified of such suitability
				determination in writing within 15
				days.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id293cda061b02499c9f9cc4e3d78aebd6"><enum>504.</enum><header>Report on
			 reciprocity of security clearances</header><text display-inline="no-display-inline">The head of the entity selected pursuant to
			 section 3001(b) of the Intelligence Reform and Terrorism Prevention Act of 2004
			 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341(b)</external-xref>) shall submit to the appropriate committees of Congress a
			 report each year through 2017 that describes for the preceding year—</text><paragraph id="idab0b6f2a1ce842c1b373a60f578adcc3"><enum>(1)</enum><text>the periods of
			 time required by authorized adjudicative agencies for accepting background
			 investigations and determinations completed by an authorized investigative
			 entity or authorized adjudicative agency;</text></paragraph><paragraph id="idfc753c5825524d3f9df443f8a11f509a"><enum>(2)</enum><text>the total number
			 of cases in which a background investigation or determination completed by an
			 authorized investigative entity or authorized adjudicative agency is accepted
			 by another agency;</text></paragraph><paragraph id="id335045493be542659016d827e164d4cf"><enum>(3)</enum><text>the total number
			 of cases in which a background investigation or determination completed by an
			 authorized investigative entity or authorized adjudicative agency is not
			 accepted by another agency; and</text></paragraph><paragraph id="id6981573e6f394fd1a558c32403902869"><enum>(4)</enum><text>such other
			 information or recommendations as the head of the entity selected pursuant to
			 such section 3001(b) considers appropriate.</text></paragraph></section><section id="idd3412a0c6912467fabf8748f06ec06aa"><enum>505.</enum><header>Improving the
			 periodic reinvestigation process</header><subsection id="id60bf902b8ad94efd90b95622b5b6411e"><enum>(a)</enum><header>In
			 general</header><text>Not later than 6 months after the date of the enactment
			 of this Act, and annually thereafter until 2017, the Director of National
			 Intelligence, in consultation with the Secretary of Defense and the Director of
			 the Office of Personnel Management, shall transmit to the appropriate
			 committees of Congress a strategic plan for improving the process for periodic
			 reinvestigations.</text></subsection><subsection id="idb9f38892671144a987f98c1fef41565c"><enum>(b)</enum><header>Contents</header><text>The
			 plan required by subsection (a) shall include—</text><paragraph id="id14e2d1c931df43e0bdb72e61f9b36ce7"><enum>(1)</enum><text>an analysis of
			 the costs and benefits associated with conducting more frequent or less
			 frequent periodic reinvestigations; and</text></paragraph><paragraph id="idf6ebcefb9ebb4bee85fd9e64d907583e"><enum>(2)</enum><text>an analysis of
			 the potential benefits of expanding the Government's use of continuous
			 evaluation tools as a means of improving the effectiveness and efficiency of
			 procedures for confirming the eligibility of personnel for continued access to
			 classified information.</text></paragraph></subsection><subsection commented="no" id="id164BF4F923B345BC8318FFDCB83335AE"><enum>(c)</enum><header>Periodic
			 reinvestigations defined</header><text>In this section, the term <term>periodic
			 reinvestigations</term> has the meaning given that term in section 3001(a) of
			 the Intelligence Reform and Terrorism Prevention Act of 2004 (50 U.S.C.
			 3341(a)).</text></subsection></section></title><title commented="no" id="id9731C88860C34E3B86AF7570D98084E7" level-type="subsequent"><enum>VI</enum><header display-inline="yes-display-inline">Intelligence community whistleblower

				intelligence community</header><subsection commented="no" display-inline="no-display-inline" id="idE7125788A13944BF9EEEF749AD93010C"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id6ED8FE9FAEBC4F368A795251F47D413E"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> means an
				executive department or independent establishment, as defined under sections
				101 and 104, that contains an intelligence community element, except the
				Federal Bureau of Investigation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6D45ACE7E48440569AC2C3DA20F3E587"><enum>(2)</enum><header display-inline="yes-display-inline">Congressional intelligence
			 committees</header><text display-inline="yes-display-inline">The term
			 <quote>congressional intelligence committees</quote> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3A36FB5335AC4C178DD99F07D565AF7E"><enum>(A)</enum><text display-inline="yes-display-inline">the Select Committee on Intelligence of the
			 Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDC76709208AD42A897502404A0C7C360"><enum>(B)</enum><text display-inline="yes-display-inline">the Permanent Select Committee on
			 Intelligence of the House of Representatives.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBE76F774493244D58E237DAF171B7CA4"><enum>(3)</enum><header>Intelligence community element</header><text display-inline="yes-display-inline">The term <term>intelligence community
				element</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idB274456071124CA7BCB10310C532DC24"><enum>(A)</enum><text display-inline="yes-display-inline">means—</text><clause commented="no" display-inline="no-display-inline" id="id7CF34FC1296D43C181004A858A0A69AD"><enum>(i)</enum><text display-inline="yes-display-inline">the Central Intelligence Agency, the
				Defense Intelligence Agency, the National Geospatial-Intelligence Agency, the
				National Security Agency, the Office of the Director of National Intelligence,
				and the National Reconnaissance Office; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idD1D68731AA384957A975A7A2B9C64E60"><enum>(ii)</enum><text display-inline="yes-display-inline">any executive agency or unit thereof
				determined by the President under section 2302(a)(2)(C)(ii) to have as its
				principal function the conduct of foreign intelligence or counterintelligence
				activities; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0A951D5915EA41E78F6BC99DA45E6705"><enum>(B)</enum><text display-inline="yes-display-inline">does not include the Federal Bureau of
				Investigation; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3AB89A3C64F44BE798866732267AA936"><enum>(4)</enum><header>Personnel action</header><text display-inline="yes-display-inline">The term <term>personnel action</term>
				means any action described in clauses (i) through (x) of section 2302(a)(2)(A)
				with respect to an employee in a position in an intelligence community element
				(other than a position of a confidential, policy-determining, policymaking, or
				policy-advocating character).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id605AFC29296148EE8823582A3EAD4624"><enum>(b)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any employee of an agency who has authority
				to take, direct others to take, recommend, or approve any personnel action,
				shall not, with respect to such authority, take or fail to take a personnel
				action with respect to any employee of an intelligence community element as a
				reprisal for a disclosure of information by the employee to the Director of
				National Intelligence (or an employee designated by the Director of National
				Intelligence for such purpose), the Inspector General of the Intelligence Community, the head of the employing agency (or an
				employee designated by the head of that agency for such purpose), the appropriate inspector general of the employing agency, a congressional intelligence committee, or a member of a congressional intelligence committee, which the
				employee reasonably believes evidences—</text><paragraph commented="no" display-inline="no-display-inline" id="id9941D52D321748209419710EBA97BECD"><enum>(1)</enum><text display-inline="yes-display-inline">a violation of any law, rule, or
				regulation; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id22FFC499D92346EDB0BC1447BEA04EF8"><enum>(2)</enum><text display-inline="yes-display-inline">mismanagement, a gross waste of funds, an
				abuse of authority, or a substantial and specific danger to public health or
				safety.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id107E3D3489E3419FAEBF37B17412A513"><enum>(c)</enum><header display-inline="yes-display-inline">Enforcement</header><text display-inline="yes-display-inline">The President shall provide for the
				enforcement of this section in a manner consistent with applicable provisions
				of sections 1214 and 1221.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id8B4C3180DA1E44F082A2A7846FACF9C6"><enum>(d)</enum><header display-inline="yes-display-inline">Existing rights preserved</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
				to—</text><paragraph commented="no" display-inline="no-display-inline" id="idDF3D852823BB4F498ED3C9C1BA6C34FA"><enum>(1)</enum><text display-inline="yes-display-inline">preempt or preclude any employee, or
				applicant for employment, at the Federal Bureau of Investigation from
				exercising rights currently provided under any other law, rule, or regulation,
				including section 2303;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0F1AE13B6B004B21B2BDBE132297D274"><enum>(2)</enum><text display-inline="yes-display-inline">repeal section 2303; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0427D4854ED941B0A7615DB4F3861477"><enum>(3)</enum><text display-inline="yes-display-inline">provide the President or Director of
				National Intelligence the authority to revise regulations related to section
				2303, codified in part 27 of the Code of Federal
				Regulations.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id8B93F19E91AC4F9DAA02127DCC446E0E"><enum>(b)</enum><header display-inline="yes-display-inline">Technical and conforming
			 amendment</header><text display-inline="yes-display-inline">The table of

			 and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id7F42FBA7E9D04F0A96B46DF2821F73A7"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by
			 striking <quote>Not</quote> and inserting <quote>Except as otherwise provided,
			 not</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id83077CC3EF5749E78B83F3C5A9AC5D76"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking
			 <quote>and</quote> after the semicolon;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE61AE054A75C4071A8F29BCAAFD4D75A"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking the period at

			 following:</text><quoted-block display-inline="no-display-inline" id="id34795BB3C53648DB9C801BE85E93385B" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="IDe5ef2452873d4f8f9d8802d914639d4b"><enum>(7)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of
				the enactment of the <short-title>Intelligence Authorization
				Act for Fiscal Year 2014</short-title>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idD4E3E7A5F5004C8AB7ABEC10FD85FDF1"><enum>(A)</enum><text display-inline="yes-display-inline">developing policies and procedures that
				permit, to the extent practicable, individuals who in good faith appeal a
				determination to suspend or revoke a security clearance or access to classified
				information to retain their government employment status while such challenge
				is pending; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2e06270839574c84996da733e75e58c0"><enum>(B)</enum><text display-inline="yes-display-inline">developing and implementing uniform and
				consistent policies and procedures to ensure proper protections during the
				process for denying, suspending, or revoking a security clearance or access to
				classified information, including the provision of a right to appeal such a
				denial, suspension, or revocation, except that there shall be no appeal of an
				agency’s suspension of a security clearance or access determination for
				purposes of conducting an investigation, if that suspension lasts no longer
				than 1 year or the head of the agency certifies that a longer suspension is
				needed before a final decision on denial or revocation to prevent imminent harm
				to the national security.</text></subparagraph></paragraph><subsection commented="no" display-inline="no-display-inline" id="idE910B3314E6D478DBEC86F172848ED5F"><enum></enum><text display-inline="yes-display-inline">Any limitation period applicable to an
				agency appeal under paragraph (7) shall be tolled until the head of the agency
				(or in the case of any component of the Department of Defense, the Secretary of
				Defense) determines, with the concurrence of the Director of National
				Intelligence, that the policies and procedures described in paragraph (7) have
				been established for the agency or the Director of National Intelligence
				promulgates the policies and procedures under paragraph (7). The policies and
				procedures for appeals developed under paragraph (7) shall be comparable to the
				policies and procedures pertaining to prohibited personnel practices defined
				under <external-xref legal-doc="usc" parsable-cite="usc/5/2302">section 2302(b)(8)</external-xref> of title 5, United States Code, and provide—</text><paragraph commented="no" display-inline="no-display-inline" id="IDba7e7a4b8bdc4a8188715473c5a0e863"><enum>(A)<?LEXA-Enum (A)?></enum><text display-inline="yes-display-inline">for an independent and impartial
				fact-finder;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID636949e73c8a4a8e8b7317f5553a1092"><enum>(B)<?LEXA-Enum (B)?></enum><text display-inline="yes-display-inline">for notice and the opportunity to be heard,
				including the opportunity to present relevant evidence, including witness
				testimony;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID63ff500b8113413db77d47ab7d39046c"><enum>(C)<?LEXA-Enum (C)?></enum><text display-inline="yes-display-inline">that the employee or former employee may be
				represented by counsel;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcdaa4a1eac6f41a7be347f3e189c246c"><enum>(D)<?LEXA-Enum (D)?></enum><text display-inline="yes-display-inline">that the employee or former employee has a
				right to a decision based on the record developed during the appeal;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID28d366da745f4262801192ec0426a793"><enum>(E)<?LEXA-Enum (E)?></enum><text display-inline="yes-display-inline">that not more than 180 days shall pass from
				the filing of the appeal to the report of the impartial fact-finder to the
				agency head or the designee of the agency head, unless—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6743CEF8A2D746D58966622D43C70AE0"><enum>(i)<?LEXA-Enum (i)?></enum><text display-inline="yes-display-inline">the employee and the agency concerned agree
				to an extension; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEFF4BF4CB8C14BA6AAA54CE9B89C2F89"><enum>(ii)<?LEXA-Enum (ii)?></enum><text display-inline="yes-display-inline">the impartial fact-finder determines in
				writing that a greater period of time is required in the interest of fairness
				or national security;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID161e55ab5ec3417f992f367dc0befb0d"><enum>(F)<?LEXA-Enum (F)?></enum><text display-inline="yes-display-inline">for the use of information specifically
				required by Executive order to be kept classified in the interest of national
				defense or the conduct of foreign affairs in a manner consistent with the
				interests of national security, including ex parte submissions if the agency
				determines that the interests of national security so warrant; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4C11A0FB370B43E3BCC504F890DA5F6C"><enum>(G)<?LEXA-Enum (G)?></enum><text display-inline="yes-display-inline">that the employee or former employee shall
				have no right to compel the production of information specifically required by
				Executive order to be kept classified in the interest of national defense or
				the conduct of foreign affairs, except evidence necessary to establish that the
				employee made the disclosure or communication such employee alleges was
				protected by subparagraphs (A), (B), and (C) of subsection
				(j)(1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id83267438C4284312BC7C8443EC4685BA"><enum>(b)</enum><header display-inline="yes-display-inline">Retaliatory revocation of security
			 clearances and access determinations</header><text display-inline="yes-display-inline">Section 3001 of the Intelligence Reform and
			 Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341</external-xref>) is amended by adding at the
			 end the following:</text><quoted-block display-inline="no-display-inline" id="id9A836018E1E9409B8D88D3052FF10A7B" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="IDdb5348fd350b47779992612e18c6d3f5"><enum>(j)</enum><header display-inline="yes-display-inline">Retaliatory revocation of security
				clearances and access determinations</header><paragraph commented="no" display-inline="no-display-inline" id="ID9246bf85f33b42adb84753c8ef85f008"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Agency personnel with authority over
				personnel security clearance or access determinations shall not take or fail to
				take, or threaten to take or fail to take, any action with respect to any
				employee's security clearance or access determination because of—</text><subparagraph commented="no" display-inline="no-display-inline" id="ID82a5afa40140469092f79a35c0928489"><enum>(A)</enum><text display-inline="yes-display-inline">any disclosure of information to the
				Director of National Intelligence (or an employee designated by the Director of
				National Intelligence for such purpose) or the head of the employing agency (or
				employee designated by the head of that agency for such purpose) by an employee
				that the employee reasonably believes evidences—</text><clause commented="no" display-inline="no-display-inline" id="ID71cccc807316479eacbb39d1c75d556d"><enum>(i)</enum><text display-inline="yes-display-inline">a violation of any law, rule, or
				regulation; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ID05afbdb0b10547159297195f76b3c122"><enum>(ii)</enum><text display-inline="yes-display-inline">gross mismanagement, a gross waste of
				funds, an abuse of authority, or a substantial and specific danger to public
				health or safety;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID36a8526b9a78479c865247bcabac289d"><enum>(B)</enum><text display-inline="yes-display-inline">any disclosure to the Inspector General of
				an agency or another employee designated by the head of the agency to receive
				such disclosures, of information which the employee reasonably believes
				evidences—</text><clause commented="no" display-inline="no-display-inline" id="ID7ed7d3127d904b5d8c7d7eca4122aaa8"><enum>(i)</enum><text display-inline="yes-display-inline">a violation of any law, rule, or
				regulation; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ID1fb136637e4a4fada225ad8a4a14531b"><enum>(ii)</enum><text display-inline="yes-display-inline">gross mismanagement, a gross waste of
				funds, an abuse of authority, or a substantial and specific danger to public
				health or safety;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID558b657e94c74018b9db744724dca9bf"><enum>(C)</enum><text display-inline="yes-display-inline">any communication that complies
				with—</text><clause commented="no" display-inline="no-display-inline" id="idCEEF3F1AC0E649C2A74F2E1AB84347DC"><enum>(i)</enum><text display-inline="yes-display-inline">subsections (a)(1), (d), and (h) of section
				8H of the Inspector General Act of 1978 (5 U.S.C. App.);</text></clause><clause commented="no" display-inline="no-display-inline" id="id33BEE217ACC7439CB18C3D747220F0B0"><enum>(ii)</enum><text display-inline="yes-display-inline">subparagraphs (A), (D), and
				(H) of section 17(d)(5) of the Central
				Intelligence Agency Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/50/3517">50 U.S.C. 3517(d)(5)</external-xref>); or</text></clause><clause commented="no" display-inline="no-display-inline" id="idD55AE7790D01475C95E14EFBCE53E43C"><enum>(iii)</enum><text display-inline="yes-display-inline">subparagraphs (A), (D), and (I) of section 103H(k)(5) of the National
				Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3033">50 U.S.C. 3033(k)(5)</external-xref>); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID30d113ab0efa4ce1a8c18675610c3f3d"><enum>(D)</enum><text display-inline="yes-display-inline">if the actions do not result in the employee or applicant
				unlawfully disclosing information specifically required by Executive order to
				be kept classified in the interest of national defense or the conduct of
				foreign affairs—</text><clause commented="no" display-inline="no-display-inline" id="id7C0BB315392D45728C416DC99A7C4086"><enum>(i)</enum><text display-inline="yes-display-inline">the exercise of any appeal, complaint, or
				grievance right granted by any law, rule, or regulation;</text></clause><clause commented="no" display-inline="no-display-inline" id="ID0887069dd1eb4b8c8cb734bdd706d537"><enum>(ii)</enum><text display-inline="yes-display-inline">testifying for or otherwise lawfully
				assisting any individual in the exercise of any right referred to in
				clause (i); or</text></clause><clause commented="no" display-inline="no-display-inline" id="ID1a542402984d42d1b50ef6735e873c87"><enum>(iii)</enum><text display-inline="yes-display-inline">cooperating with or disclosing information
				to the Inspector General of an agency, in accordance with applicable provisions
				of law in connection with an audit, inspection, or investigation conducted by
				the Inspector General.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71D87D537D8B4032A20A21973F39D7AD"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Consistent with the protection of sources
				and methods, nothing in paragraph (1) shall be construed to authorize the
				withholding of information from Congress or the taking of any personnel action
				against an employee who discloses information to Congress.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc26b1e103b6643048f7a0fa1d6c863d0"><enum>(3)</enum><header display-inline="yes-display-inline">Disclosures</header><subparagraph commented="no" display-inline="no-display-inline" id="id8223A94380E64B419A0AF1595DE3414F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A disclosure shall not be excluded from
				paragraph (1) because—</text><clause commented="no" display-inline="no-display-inline" id="IDb300b021f8514529874f33c09a7ca024"><enum>(i)</enum><text display-inline="yes-display-inline">the disclosure was made to a person,
				including a supervisor, who participated in an activity that the employee
				reasonably believed to be covered by paragraph (1)(A)(ii);</text></clause><clause commented="no" display-inline="no-display-inline" id="ID90efa8b323b84599a2fb2bfd7fcde83c"><enum>(ii)</enum><text display-inline="yes-display-inline">the disclosure revealed information that
				had been previously disclosed;</text></clause><clause commented="no" display-inline="no-display-inline" id="ID3a13ce912a084de8990282e6297f9f71"><enum>(iii)</enum><text display-inline="yes-display-inline">of the employee's motive for making the
				disclosure;</text></clause><clause commented="no" display-inline="no-display-inline" id="ID6299dae9fdc74299a286fd7fa952521d"><enum>(iv)</enum><text display-inline="yes-display-inline">the disclosure was not made in
				writing;</text></clause><clause commented="no" display-inline="no-display-inline" id="IDb2a84b159ec245359a30209b3ed8c550"><enum>(v)</enum><text display-inline="yes-display-inline">the disclosure was made while the employee
				was off duty; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ID71eb96fae8f2451f849587122528af8e"><enum>(vi)</enum><text display-inline="yes-display-inline">of the amount of time which has passed
				since the occurrence of the events described in the disclosure.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1d97d2102a024df991d25f8802af1d2c"><enum>(B)</enum><header display-inline="yes-display-inline">Reprisals</header><text display-inline="yes-display-inline">If a disclosure is made during the normal
				course of duties of an employee, the disclosure shall not be excluded from
				paragraph (1) if any employee who has authority to take, direct others to take,
				recommend, or approve any personnel action with respect to the employee making
				the disclosure, took, failed to take, or threatened to take or fail to take a
				personnel action with respect to that employee in reprisal for the
				disclosure.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID77f7d9bb7fba46e48e9f5a4d42c1f751"><enum>(4)</enum><header display-inline="yes-display-inline">Agency adjudication</header><subparagraph commented="no" display-inline="no-display-inline" id="idCE5A3DDCFF6F4B838A2B0EE49FFE503C"><enum>(A)</enum><header display-inline="yes-display-inline">Remedial procedure</header><text display-inline="yes-display-inline">An employee or former employee who believes
				that he or she has been subjected to a reprisal prohibited by paragraph (1) may, within 90 days after the issuance of notice of such
				decision, appeal that decision within the agency of that employee or former
				employee through proceedings authorized by subsection (b)(7), except that there
				shall be no appeal of an agency’s suspension of a security clearance or access
				determination for purposes of conducting an investigation, if that suspension
				lasts not longer than 1 year (or a longer period in accordance with a
				certification made under subsection (b)(7)).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID58118c2a523d48c5871a7a9c9cd0db71"><enum>(B)</enum><header display-inline="yes-display-inline">Corrective action</header><text display-inline="yes-display-inline">If, in the course of proceedings authorized
				under subparagraph (A), it is determined that the adverse security clearance or
				access determination violated paragraph (1), the agency
				shall take specific corrective action to return the employee or former
				employee, as nearly as practicable and reasonable, to the position such
				employee or former employee would have held had the violation not occurred.
				Such corrective action shall include reasonable attorney's fees and any other
				reasonable costs incurred, and may include back pay and related benefits,
				travel expenses, and compensatory damages not to exceed $300,000.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID895d77eda66e4a2d911114872737d2b7"><enum>(C)</enum><header display-inline="yes-display-inline">Contributing factor</header><text display-inline="yes-display-inline">In determining whether the adverse security
				clearance or access determination violated paragraph (1),
				the agency shall find that paragraph (1) was violated if a
				disclosure described in paragraph (1) was a contributing factor in the adverse
				security clearance or access determination taken against the individual, unless
				the agency demonstrates by a preponderance of the evidence that it would have
				taken the same action in the absence of such disclosure, giving the utmost
				deference to the agency's assessment of the particular threat to the national
				security interests of the United States in the instant matter.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID65df63d994bb4eec9dcf85ebb0ed2c40"><enum>(5)</enum><header display-inline="yes-display-inline">Appellate review of security clearance
				access determinations by Director of National Intelligence</header><subparagraph commented="no" display-inline="no-display-inline" id="idAE5073322BBD40A9BFD108DD6DCEB043"><enum>(A)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this paragraph, the term
				<quote>Board</quote> means the appellate review board established under section
				604(b) of the <short-title>Intelligence Authorization Act
				for Fiscal Year 2014</short-title>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id841B7653D5FF4F6B9302BBBA23BF1CB5"><enum>(B)</enum><header display-inline="yes-display-inline">Appeal</header><text display-inline="yes-display-inline">Within 60 days after receiving notice of an
				adverse final agency determination under a proceeding under paragraph (4), an
				employee or former employee may appeal that determination to the Board.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1a4bad5568b243cea6859ef0c9544f4c"><enum>(C)</enum><header display-inline="yes-display-inline">Policies and procedures</header><text display-inline="yes-display-inline">The Board, in consultation with the
				Attorney General, Director of National Intelligence, and the Secretary of
				Defense, shall develop and implement policies and procedures for adjudicating
				the appeals authorized by subparagraph (B). The Director of National
				Intelligence and Secretary of Defense shall jointly approve any rules,
				regulations, or guidance issued by the Board concerning the procedures for the
				use or handling of classified information.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7c78214efb0a4786905435033ad37988"><enum>(D)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">The Board’s review shall be on the complete
				agency record, which shall be made available to the Board. The Board may not
				hear witnesses or admit additional evidence. Any portions of the record that
				were submitted ex parte during the agency proceedings shall be submitted ex
				parte to the Board.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1c805579b3874f5e80698b8659e72485"><enum>(E)</enum><header display-inline="yes-display-inline">Further fact-finding or improper
				denial</header><text display-inline="yes-display-inline">If the Board concludes
				that further fact-finding is necessary or finds that the agency improperly
				denied the employee or former employee the opportunity to present evidence
				that, if admitted, would have a substantial likelihood of altering the outcome,
				the Board shall remand the matter to the agency from which it originated for
				additional proceedings in accordance with the rules of procedure issued by the
				Board.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8c73a554268042fca1b24daff23ffe58"><enum>(F)</enum><header display-inline="yes-display-inline">De novo determination</header><text display-inline="yes-display-inline">The Board shall make a de novo
				determination, based on the entire record and under the standards specified in
				paragraph (4), of whether the employee or former employee received an adverse
				security clearance or access determination in violation of paragraph (1). In
				considering the record, the Board may weigh the evidence, judge the credibility
				of witnesses, and determine controverted questions of fact. In doing so, the
				Board may consider the prior fact-finder’s opportunity to see and hear the
				witnesses.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4ac593bd565a4e33be3f024f5c219032"><enum>(G)</enum><header display-inline="yes-display-inline">Adverse security clearance or access
				determination</header><text display-inline="yes-display-inline">If the Board
				finds that the adverse security clearance or access determination violated
				paragraph (1), the Board shall separately determine whether reinstating the
				security clearance or access determination is clearly consistent with the
				interests of national security, with any doubt resolved in favor of national
				security, under Executive Order 12968 (60 Fed. Reg. 40245; relating to access
				to classified information) or any successor thereto (including any adjudicative
				guidelines promulgated under such orders) or any subsequent Executive order,
				regulation, or policy concerning access to classified information.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf5221d8bde3744aba8c68ed486c1ec40"><enum>(H)</enum><header display-inline="yes-display-inline">Remedies</header><clause commented="no" display-inline="no-display-inline" id="ID78e17c4a496a48819fa617466ace31f7"><enum>(i)</enum><header display-inline="yes-display-inline">Corrective action</header><text display-inline="yes-display-inline">If the Board finds that the adverse
				security clearance or access determination violated paragraph (1), the Board shall
				order the agency head to take specific corrective action to return the employee
				or former employee, as nearly as practicable and reasonable, to the position
				such employee or former employee would have held had the violation not
				occurred. Such corrective action shall include reasonable attorney's fees and
				any other reasonable costs incurred, and may include back pay and related
				benefits, travel expenses, and compensatory damages not to exceed $300,000. The
				Board may recommend, but may not order, reinstatement or hiring of a former
				employee. The Board may order that the former employee be treated as though the
				employee were transferring from the most recent position held when seeking
				other positions within the executive branch. Any corrective action shall not
				include the reinstating of any security clearance or access determination. The
				agency head shall take the actions so ordered within 90 days, unless the
				Director of National Intelligence, the Secretary of Energy, or the Secretary of
				Defense, in the case of any component of the Department of Defense, determines
				that doing so would endanger national security.</text></clause><clause commented="no" display-inline="no-display-inline" id="ID982a72d8164f40aea6f1ff42b9d9bb06"><enum>(ii)</enum><header display-inline="yes-display-inline">Recommended action</header><text display-inline="yes-display-inline">If the Board finds that reinstating the
				employee or former employee's security clearance or access determination is
				clearly consistent with the interests of national security, the Board shall recommend
				such action to the head of the entity selected under subsection (b) and the
				head of the affected agency.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1371B484E42C49C3955F9BE236647206"><enum>(I)</enum><header display-inline="yes-display-inline">Congressional Notification</header><clause commented="no" display-inline="no-display-inline" id="idE567A5817B7846AA80360452B3C1FD65"><enum>(i)</enum><header display-inline="yes-display-inline">Orders</header><text display-inline="yes-display-inline">Consistent with the protection of sources
				and methods, at the time the Board issues an order, the Chairperson of the
				Board shall notify—</text><subclause commented="no" display-inline="no-display-inline" id="idD213D3AA2A764A9788161508FE5F8572"><enum>(I)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and
				Government Affairs of the Senate;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1C6A9BB976EA4211B0E8C5C9BFA7B537"><enum>(II)</enum><text display-inline="yes-display-inline">the Select Committee on Intelligence of the
				Senate;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9162D4EAD13B4AD5A1C12B31C309E259"><enum>(III)</enum><text display-inline="yes-display-inline">the Committee on Oversight and Government
				Reform of the House of Representatives;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9B82F931F5AA4FF7B1B1E8950802679F"><enum>(IV)</enum><text display-inline="yes-display-inline">the Permanent Select Committee on
				Intelligence of the House of Representatives; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ID54fc87a5c43d4c85942c66d5ecc4ca2e"><enum>(V)</enum><text display-inline="yes-display-inline">the committees of the Senate and the House
				of Representatives that have jurisdiction over the employing agency, including
				in the case of a final order or decision of the Defense Intelligence Agency,
				the National Geospatial-Intelligence Agency, the National Security Agency, or
				the National Reconnaissance Office, the Committee on Armed Services of the
				Senate and the Committee on Armed Services of the House of
				Representatives.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idA849EF4EC4E0437AA255068C8707C154"><enum>(ii)</enum><header display-inline="yes-display-inline">Recommendations</header><text display-inline="yes-display-inline">If the agency head and the head of the
				entity selected under subsection (b) do not follow the Board’s recommendation
				to reinstate a clearance, the head of the entity selected under subsection (b)
				shall notify the committees described in subclauses (I) through (V) of clause
				(i).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd30ca46da1f543dfb6de3df8e3a7b2e3"><enum>(6)</enum><header display-inline="yes-display-inline">Judicial review</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
				to permit or require judicial review of any—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1317A12C4D36475789D8E2E97B757926"><enum>(A)</enum><text display-inline="yes-display-inline">agency action under this section; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id74E2A758AE0A451FB13F8D9E55FA3751"><enum>(B)</enum><text display-inline="yes-display-inline">action of the appellate review board
				established under section 604(b) of the <short-title>Intelligence Authorization Act for Fiscal Year
				2014</short-title>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8C4A45B2B6D348F1A62082406868A143"><enum>(7)</enum><header display-inline="yes-display-inline">Private cause of action</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
				to permit, authorize, or require a private cause of action to challenge the
				merits of a security clearance
				determination.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idF126AC43297A4841BA0DEA958F89AB16"><enum>(c)</enum><header display-inline="yes-display-inline">Access determination defined</header><text display-inline="yes-display-inline">Section 3001(a) of the Intelligence Reform
			 and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341(a)</external-xref>) is amended by adding
			 at the end the following:</text><quoted-block display-inline="no-display-inline" id="id5FB2898294C84BF18BD54EC56DB801AF" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id35600A2CDAA348E8A742A16226776C5B"><enum>(9)</enum><text display-inline="yes-display-inline">The term <term>access determination</term>
				means the determination regarding whether an employee—</text><subparagraph commented="no" display-inline="no-display-inline" id="idD840CB124831452593C9EAE1274C034F"><enum>(A)</enum><text display-inline="yes-display-inline">is eligible for access to classified
				information in accordance with Executive Order 12968 (60 Fed. Reg. 40245;
				relating to access to classified information), or any successor thereto, and
				Executive Order 10865 (25 Fed. Reg. 1583; relating to safeguarding classified
				information with industry), or any successor thereto; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBD583ADB43DF4304AD47AB85491C6FA7"><enum>(B)</enum><text display-inline="yes-display-inline">possesses a need to know under such an
				Order.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idFF41DE86F21C4D0BBA9BC42F85E9025F"><enum>(d)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in section 3001 of the Intelligence
			 Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341</external-xref>), as amended by
			 this title, shall be construed to require the repeal or replacement of agency
			 appeal procedures implementing Executive Order 12968 (60 Fed. Reg. 40245;
			 relating to access to classified information), or any successor thereto, and
			 Executive Order 10865 (25 Fed. Reg. 1583; relating to safeguarding classified
			 information with industry), or any successor thereto, that meet the
			 requirements of paragraph (7) of section 3001(b) of such Act, as added by this
			 section.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id9C8E0B054B664B7287095A5B2960C445" section-type="subsequent-section"><enum>603.</enum><header display-inline="yes-display-inline">Revisions of other laws</header><subsection commented="no" display-inline="no-display-inline" id="id538890E4FF3E4320B06206103EAE7936"><enum>(a)</enum><header display-inline="yes-display-inline">Inspector General Act of 1978</header><text display-inline="yes-display-inline">Section 8H of the Inspector General Act of
			 1978 (5 U.S.C. App.) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idB368B58BA39442F79F6F7D51A509A4DC"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4B128DE3EFE54C439EA2E032C7D505A0"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> after

				that a complaint or information transmitted under paragraph (1) would create a
				conflict of interest for the head of the establishment, the head of the
				establishment shall return the complaint or information to the Inspector
				General with that determination and the Inspector General shall make the
				transmission to the Director of National Intelligence and, if the establishment
				is within the Department of Defense, to the Secretary of Defense. In such a
				case, the requirements of this section for the head of the establishment apply
				to each recipient of the Inspector General’s transmission. Each recipient of
				the Inspector General's transmission shall consult with the members of the
				appellate review board established under section 604(b) of the
				<short-title>Intelligence Authorization Act for Fiscal
				Year 2014</short-title> regarding all transmissions under this
				paragraph.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC1C8B4EB77B54FF2907AF723FF858379"><enum>(2)</enum><text display-inline="yes-display-inline">by designating subsection (h) as subsection
			 (i); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id16F0623DF4044F09BBFCC4B03F6C0383"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (g), the

			 Investigation.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4B6BE673A37741AF9F799DE4E3708C3F"><enum>(b)</enum><header display-inline="yes-display-inline">Regulations</header><paragraph commented="no" display-inline="no-display-inline" id="id619ABFE93B1D443C9CA565CECBE61613"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In consultation with the Secretary of

			 ensure that a personnel action shall not be taken against an employee of an

			 described in <external-xref legal-doc="usc" parsable-cite="usc/5/2303A">section 2303A(b)</external-xref> of title 5, United States Code, as added by this
			 title.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa5231233d4344b7988b7fba7d5a0801b"><enum>(2)</enum><header display-inline="yes-display-inline">Appellate review board</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Director of National Intelligence, in consultation
			 with the Secretary of Defense, the Attorney General, and the heads of
			 appropriate agencies, shall establish an appellate review board that is broadly
			 representative of affected Departments and agencies and is made up of
			 individuals with expertise in merit systems principles and national security
			 issues—</text><subparagraph commented="no" display-inline="no-display-inline" id="idDB1FB91BF33A4356832DAB4742047CD8"><enum>(A)</enum><text display-inline="yes-display-inline">to hear whistleblower appeals related to
			 security clearance access determinations described in subsection (j) of section
			 3001 of the Intelligence Reform and Terrorism Prevention Act of 2004 (50 U.S.C.
			 3341), as added by this title; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25C3A34D2EAD4C56A007C9DAC39BF547"><enum>(B)</enum><text display-inline="yes-display-inline">that shall include a subpanel that reflects
			 the composition of intelligence community elements, which shall—</text><clause commented="no" display-inline="no-display-inline" id="idC9BD3683C67444E1ACDD037A5C148279"><enum>(i)</enum><text display-inline="yes-display-inline">be composed of intelligence community
			 elements and inspectors general from intelligence community elements, for the
			 purpose of hearing cases that arise in intelligence community element;
			 and</text></clause><clause commented="no" display-inline="no-display-inline" id="id608E281E4D324E7487B27CE38F43894E"><enum>(ii)</enum><text display-inline="yes-display-inline">include the Inspector General of the
			 Intelligence Community and the Inspector General of the Department of
			 Defense.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID53639710efb94aaea2fae6921317f4e9"><enum>(c)</enum><header display-inline="yes-display-inline">Report on the status of implementation of
			 regulations</header><text display-inline="yes-display-inline">Not later than 2
			 years after the date of the enactment of this Act, the Director of National
			 Intelligence shall submit a report on the status of the implementation of the
			 regulations promulgated under subsection (b) to the congressional oversight
			 committees.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="IDfc5fab03a7ac41c6b61a64e689c9229f"><enum>(d)</enum><header display-inline="yes-display-inline">Nonapplicability to certain
			 terminations</header><text display-inline="yes-display-inline">Section 2303A of
			 title 5, United States Code, as added by this title, and section 3001 of the
			 Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341</external-xref>), as
			 amended by this title, shall not apply if the affected employee is concurrently
			 terminated under—</text><paragraph commented="no" display-inline="no-display-inline" id="ID6346a9315a6b401e8288298d2c4fc6ef"><enum>(1)</enum><text display-inline="yes-display-inline">section 1609 of title 10, United States
			 Code;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9e268a32b82c46e0b74a9844ef0aa6ab"><enum>(2)</enum><text display-inline="yes-display-inline">the authority of the Director of National
			 Intelligence under section 102A(m) of the National Security Act of 1947 (50
			 U.S.C. 3024(m)), if—</text><subparagraph commented="no" display-inline="no-display-inline" id="ID5d255ca1ea53471ca381ee08102a0612"><enum>(A)</enum><text display-inline="yes-display-inline">the Director personally summarily
			 terminates the individual; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0a4654af6fda47298de097daf8df7a66"><enum>(B)</enum><text display-inline="yes-display-inline">the Director—</text><clause commented="no" display-inline="no-display-inline" id="IDc45f00473f8e4bb3b6c16e7094a3deac"><enum>(i)</enum><text display-inline="yes-display-inline">determines the termination to be in the
			 interest of the United States;</text></clause><clause commented="no" display-inline="no-display-inline" id="IDead2b955386e4a63b84d8bb2aaa84bd4"><enum>(ii)</enum><text display-inline="yes-display-inline">determines that the procedures prescribed
			 in other provisions of law that authorize the termination of the employment of
			 such employee cannot be invoked in a manner consistent with the national
			 security; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ID54a4e2b4611d47fcbef56563e0c09f27"><enum>(iii)</enum><text display-inline="yes-display-inline">not later than 5 days after such
			 termination, notifies the congressional oversight committees of the
			 termination;</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5d5e037e9dd54afba6696dbb64898084"><enum>(3)</enum><text display-inline="yes-display-inline">the authority of the Director of the
			 Central Intelligence Agency under section 104A(e) of the National Security Act
			 of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3036">50 U.S.C. 3036(e)</external-xref>), if—</text><subparagraph commented="no" display-inline="no-display-inline" id="IDb1521e4c775d4fbd9a85edd94249f7cb"><enum>(A)</enum><text display-inline="yes-display-inline">the Director personally summarily
			 terminates the individual; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID78794faa14da4937afc01383364838b2"><enum>(B)</enum><text display-inline="yes-display-inline">the Director—</text><clause commented="no" display-inline="no-display-inline" id="ID34d6768f2153412da650bc8df92cbed2"><enum>(i)</enum><text display-inline="yes-display-inline">determines the termination to be in the
			 interest of the United States;</text></clause><clause commented="no" display-inline="no-display-inline" id="IDc9f928b4fef64ee7987c348215ef2929"><enum>(ii)</enum><text display-inline="yes-display-inline">determines that the procedures prescribed
			 in other provisions of law that authorize the termination of the employment of
			 such employee cannot be invoked in a manner consistent with the national
			 security; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ID229e990b171142068ca4bdfef483ef03"><enum>(iii)</enum><text display-inline="yes-display-inline">not later than 5 days after such
			 termination, notifies the congressional oversight committees of the
			 termination; or</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID136b61887c47464bac4ad76a397ec3f7"><enum>(4)</enum><text display-inline="yes-display-inline">section 7532 of title 5, United States
			 Code, if—</text><subparagraph commented="no" display-inline="no-display-inline" id="ID76fa208302ab4003bd37a540a0eb2b21"><enum>(A)</enum><text display-inline="yes-display-inline">the agency head personally terminates the
			 individual; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1f6c6fb07acd4cadabc7a3e5596fa6ac"><enum>(B)</enum><text display-inline="yes-display-inline">the agency head—</text><clause commented="no" display-inline="no-display-inline" id="ID0c326546dffc464c80c665c54797f817"><enum>(i)</enum><text display-inline="yes-display-inline">determines the termination to be in the
			 interest of the United States;</text></clause><clause commented="no" display-inline="no-display-inline" id="IDaa2b6b26664b4648bd33426ac5afadff"><enum>(ii)</enum><text display-inline="yes-display-inline">determines that the procedures prescribed
			 in other provisions of law that authorize the termination of the employment of
			 such employee cannot be invoked in a manner consistent with the national
			 security; and</text></clause><clause commented="no" display-inline="no-display-inline" id="IDc4cafbe51c05480baf6c12b33877993a"><enum>(iii)</enum><text display-inline="yes-display-inline">not later than 5 days after such
			 termination, notifies the congressional oversight committees of the
			 termination.</text></clause></subparagraph></paragraph></subsection></section></title><title commented="no" id="id9E160EC586304A2099411FEC3B818F82" level-type="subsequent"><enum>VII</enum><header display-inline="yes-display-inline">Other matters</header><section id="idE5DD227DB9274B008A6AA947B8C9C11A"><enum>701.</enum><header>Repeal of the
			 termination of notification requirements regarding the authorized disclosure of
			 national intelligence</header><text display-inline="no-display-inline">Section
			 504 of the Intelligence Authorization Act for Fiscal Year 2013 (Public Law
			 112–277; 126 Stat. 2477) is amended by striking subsection (e).</text></section><section id="id88f4b0df04f740c8885ce607b5add593"><enum>702.</enum><header>Gifts, devises, and bequests</header><text display-inline="no-display-inline">Section 12 of the Central Intelligence Agency Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/50/3512">50 U.S.C. 3512</external-xref>) is amended—</text><paragraph id="id4013cec649de482c90c3e57962f18b31"><enum>(1)</enum><text>by striking the section heading and inserting <quote><header-in-text level="section" style="appropriations">Gifts, devises, and bequests</header-in-text></quote>;</text></paragraph><paragraph id="ide6d0c0a5b1d4463e8529d3e6e2134e49"><enum>(2)</enum><text>in subsection (a)(2)—</text><subparagraph id="id3ED0B033E62C46BB8292507C8BCC7777"><enum>(A)</enum><text>by inserting <quote>by the Director as a gift to the Agency</quote> after <quote>accepted</quote>; and</text></subparagraph><subparagraph id="id6f6591e8b8204ee0880cc70646ad6956"><enum>(B)</enum><text>by striking <quote>this section,</quote> and inserting <quote>subsection (a),</quote>;</text></subparagraph></paragraph><paragraph id="id246b9ec7921c4b37bd00f81f6122d943"><enum>(3)</enum><text>in subsection (b), by striking <quote>this section,</quote> and inserting <quote>subsection (a),</quote>;</text></paragraph><paragraph id="idB974832D962F49DF99149B7FA799FA34"><enum>(4)</enum><text>in subsection (c), by striking <quote>this section,</quote> and inserting <quote>subsection (a),</quote>;</text></paragraph><paragraph id="id6545D89F096A4AE5A1B75B56FC480F7B"><enum>(5)</enum><text>in subsection (d), by striking <quote>this section</quote> and inserting <quote>subsection (a)</quote>;</text></paragraph><paragraph id="id2ff4d81f9ec24213ad9b89a676eeaea3"><enum>(6)</enum><text>by redesignating subsection (f) as subsection (g); and</text></paragraph><paragraph id="idACA9505D2A824B338987EAEE42C6F6F8"><enum>(7)</enum><text>by inserting after subsection (e) the following:</text><quoted-block display-inline="no-display-inline" id="id0D2E30D72780455282299B91941C9ABE" style="OLC"><subsection commented="no" id="ide0e9a51c28ef4291956c0b3b8960324d"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idF8DAB96F78C64D3CB5BE1B153F097AF8"><enum>(1)</enum><text>The Director may engage in fundraising in an official capacity for the benefit of nonprofit organizations that provide support to surviving family members of deceased Agency employees or that otherwise provide support for the welfare, education, or recreation of Agency employees, former Agency employees, or their family members.</text></paragraph><paragraph commented="no" id="id27BE200DC2084A9B946D56C97DFEF250" indent="up1"><enum>(2)</enum><text>In this subsection, the term <term>fundraising</term> means the raising of funds through the active participation in the promotion, production, or presentation of an event designed to raise funds and does not include the direct solicitation of money by any other means.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="id5fd43a6c7a45486dbff052450662009b" section-type="subsequent-section"><enum>703.</enum><header display-inline="yes-display-inline">Budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the
			 purpose of complying with the Statutory Pay-As-You-Go-Act of 2010, shall be
			 determined by reference to the latest statement titled <quote>Budgetary Effects
			 of PAYGO Legislation</quote> for this Act, submitted for printing in the
			 Congressional Record by the Chairman of the Senate Budget Committee, provided
