<section id="d168379e62" identifier="/us/bill/113/s/157/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Denali National Park Improvement Act</shortTitle>”.</content></section>
<section id="d168379e72" identifier="/us/bill/113/s/157/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>KANTISHNA HILLS MICROHYDRO PROJECT; LAND EXCHANGE.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d168379e76" identifier="/us/bill/113/s/157/s2/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e84" identifier="/us/bill/113/s/157/s2/a/1" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Appurtenance</inline>.—</heading><chapeau>The term “<term>appurtenance</term>” includes—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e92" identifier="/us/bill/113/s/157/s2/a/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>transmission lines;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e96" identifier="/us/bill/113/s/157/s2/a/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>distribution lines;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e100" identifier="/us/bill/113/s/157/s2/a/1/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>signs;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e104" identifier="/us/bill/113/s/157/s2/a/1/D" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="D">(D) </num><content>buried communication lines;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e108" identifier="/us/bill/113/s/157/s2/a/1/E" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="E">(E) </num><content>necessary access routes for microhydro project construction, operation, and maintenance; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e112" identifier="/us/bill/113/s/157/s2/a/1/F" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="F">(F) </num><content>electric cables.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e116" identifier="/us/bill/113/s/157/s2/a/2" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Kantishna hills area</inline>.—</heading><content>The term “<term>Kantishna Hills area</term>” means the area of the Park located within 2 miles of Moose Creek, as depicted on the map.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e124" identifier="/us/bill/113/s/157/s2/a/3" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Map</inline>.—</heading><content>The term “<term>map</term>” means the map entitled “Kantishna Hills Micro-Hydro Area”, numbered 184/80,276, and dated August 27, 2010.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e132" identifier="/us/bill/113/s/157/s2/a/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><heading><inline class="smallCaps">Microhydro project</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e139" identifier="/us/bill/113/s/157/s2/a/4/A" role="definitions" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The term “<term>microhydro project</term>” means a hydroelectric power generating facility with a maximum power generation capability of 100 kilowatts.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e147" identifier="/us/bill/113/s/157/s2/a/4/B" role="definitions" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><heading><inline class="smallCaps">Inclusions</inline>.—</heading><chapeau>The term “<term>microhydro project</term>” includes—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d168379e155" identifier="/us/bill/113/s/157/s2/a/4/B/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>intake pipelines, including the intake pipeline located on Eureka Creek, approximately ½ mile upstream from the Park Road, as depicted on the map;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d168379e159" identifier="/us/bill/113/s/157/s2/a/4/B/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>each system appurtenance of the microhydro projects; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d168379e163" identifier="/us/bill/113/s/157/s2/a/4/B/iii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">(iii) </num><content>any distribution or transmission lines required to serve the Kantishna Hills area.</content></clause></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e167" identifier="/us/bill/113/s/157/s2/a/5" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">(5) </num><heading><inline class="smallCaps">Park</inline>.—</heading><content>The term “<term>Park</term>” means the Denali National Park and Preserve.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e175" identifier="/us/bill/113/s/157/s2/a/6" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="6">(6) </num><heading><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d168379e183" identifier="/us/bill/113/s/157/s2/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Permits for Microhydro Projects</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e190" identifier="/us/bill/113/s/157/s2/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary may issue permits for microhydro projects in the Kantishna Hills area.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e198" identifier="/us/bill/113/s/157/s2/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Terms and conditions</inline>.—</heading><chapeau>Each permit under paragraph (1) shall be—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e206" identifier="/us/bill/113/s/157/s2/b/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>issued in accordance with such terms and conditions as are generally applicable to rights-of-way within units of the National Park System; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e210" identifier="/us/bill/113/s/157/s2/b/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>subject to such other terms and conditions as the Secretary determines to be necessary.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e214" identifier="/us/bill/113/s/157/s2/b/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Completion of environmental analysis</inline>.—</heading><content>Not later than 180 days after the date on which an applicant submits an application for the issuance of a permit under this subsection, the Secretary shall complete any analysis required by the National Environment Policy Act of 1969 (<ref href="/us/usc/t42/s4321/etseq">42 U.S.C. 4321 et seq.</ref>) of any proposed or existing microhydro projects located in the Kantishna Hills area.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d168379e226" identifier="/us/bill/113/s/157/s2/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Land Exchange</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e233" identifier="/us/bill/113/s/157/s2/c/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>For the purpose of consolidating ownership of Park and Doyon Tourism, Inc. lands, including those lands affected solely by the Doyon Tourism microhydro project, and subject to paragraph (4), the Secretary may exchange Park land near or adjacent to land owned by Doyon Tourism, Inc., located at the mouth of Eureka Creek in sec. 13, T.16 S., R. 18 W., Fairbanks Meridian, for approximately 18 acres of land owned by Doyon Tourism, Inc., within the Galena patented mining claim.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e241" identifier="/us/bill/113/s/157/s2/c/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Map availability</inline>.—</heading><content>The map shall be on file and available for public inspection in the appropriate offices of the National Park Service.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e249" identifier="/us/bill/113/s/157/s2/c/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Timing</inline>.—</heading><content>The Secretary shall seek to complete the exchange under this subsection by not later than February 1, 2015.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e257" identifier="/us/bill/113/s/157/s2/c/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><heading><inline class="smallCaps">Applicable laws; terms and conditions</inline>.—</heading><chapeau>The exchange under this subsection shall be subject to—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e265" identifier="/us/bill/113/s/157/s2/c/4/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>the laws (including regulations) and policies applicable to exchanges of land administered by the National Park Service, including the laws and policies concerning land appraisals, equalization of values, and environmental compliance; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e269" identifier="/us/bill/113/s/157/s2/c/4/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>such terms and conditions as the Secretary determines to be necessary.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e273" identifier="/us/bill/113/s/157/s2/c/5" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">(5) </num><heading><inline class="smallCaps">Equalization of values</inline>.—</heading><content>If the tracts proposed for exchange under this subsection are determined not to be equal in value, an equalization of values may be achieved by adjusting the quantity of acres described in paragraph (1).</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e281" identifier="/us/bill/113/s/157/s2/c/6" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="6">(6) </num><heading><inline class="smallCaps">Administration</inline>.—</heading><content>The land acquired by the Secretary pursuant to the exchange under this subsection shall be administered as part of the Park.</content></paragraph></subsection></section>
<section id="d168379e290" identifier="/us/bill/113/s/157/s3" style="-uslm-lc:I650141"><num value="3">SEC. 3. </num><heading>DENALI NATIONAL PARK AND PRESERVE NATURAL GAS PIPELINE.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d168379e294" identifier="/us/bill/113/s/157/s3/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e302" identifier="/us/bill/113/s/157/s3/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Appurtenance</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e309" identifier="/us/bill/113/s/157/s3/a/1/A" role="definitions" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The term “<term>appurtenance</term>” includes cathodic protection or test stations, valves, signage, and buried communication and electric cables relating to the operation of high-pressure natural gas transmission.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e317" identifier="/us/bill/113/s/157/s3/a/1/B" role="definitions" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><heading><inline class="smallCaps">Exclusions</inline>.—</heading><content>The term “<term>appurtenance</term>” does not include compressor stations.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e325" identifier="/us/bill/113/s/157/s3/a/2" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Park</inline>.—</heading><content>The term “<term>Park</term>” means the Denali National Park and Preserve in the State of Alaska.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e333" identifier="/us/bill/113/s/157/s3/a/3" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d168379e341" identifier="/us/bill/113/s/157/s3/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Permit</inline>.—</heading><chapeau>The Secretary may issue right-of-way permits for—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e349" identifier="/us/bill/113/s/157/s3/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>a high-pressure natural gas transmission pipeline (including appurtenances) in nonwilderness areas within the boundary of Denali National Park within, along, or near the approximately 7-mile segment of the George Parks Highway that runs through the Park; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e353" identifier="/us/bill/113/s/157/s3/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>any distribution and transmission pipelines and appurtenances that the Secretary determines to be necessary to provide natural gas supply to the Park.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d168379e357" identifier="/us/bill/113/s/157/s3/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Terms and Conditions</inline>.—</heading><chapeau>A permit authorized under subsection (b)—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e365" identifier="/us/bill/113/s/157/s3/c/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>may be issued only—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e369" identifier="/us/bill/113/s/157/s3/c/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>if the permit is consistent with the laws (including regulations) generally applicable to utility rights-of-way within units of the National Park System;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e373" identifier="/us/bill/113/s/157/s3/c/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>in accordance with section 1106(a) of the Alaska National Interest Lands Conservation Act (<ref href="/us/usc/t16/s3166/a">16 U.S.C. 3166(a)</ref>); and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168379e381" identifier="/us/bill/113/s/157/s3/c/1/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>if, following an appropriate analysis prepared in compliance with the National Environmental Policy Act of 1969 (<ref href="/us/usc/t42/s4321/etseq">42 U.S.C. 4321 et seq.</ref>), the route of the right-of-way is the route through the Park with the least adverse environmental effects for the Park; and</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168379e389" identifier="/us/bill/113/s/157/s3/c/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>shall be subject to such terms and conditions as the Secretary determines to be necessary.</content></paragraph></subsection></section>
<section id="d168379e395" identifier="/us/bill/113/s/157/s4" style="-uslm-lc:I650141"><num value="4">SEC. 4. </num><heading>DESIGNATION OF THE WALTER HARPER TALKEETNA RANGER STATION.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d168379e399" identifier="/us/bill/113/s/157/s4/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Designation</inline>.—</heading><content>The Talkeetna Ranger Station located on B Street in Talkeetna, Alaska, approximately 100 miles south of the entrance to Denali National Park, shall be known and designated as the “Walter Harper Talkeetna Ranger Station”.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d168379e407" identifier="/us/bill/113/s/157/s4/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">References</inline>.—</heading><content>Any reference in a law, map, regulation, document, paper, or other record of the United States to the Talkeetna Ranger Station referred to in subsection (a) shall be deemed to be a reference to the “Walter Harper Talkeetna Ranger Station”.</content></subsection></section>
