which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 39, United States Code, to provide that the payment of a bill, invoice, or statement of account due, if made by mail, shall be considered to have been made on the date as of which the envelope which is used to transmit such payment is postmarked.</official-title></form><legis-body id="H90FE405747B746B192E23D85BA1B16F0" style="OLC"><section id="H66FAEC612B324445A17B745EC38CA38F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Postmark Payment Act of 2014</short-title></quote>.</text></section><section id="HD6CA5A149C004E98982DE8E7CD486BF5"><enum>2.</enum><header>Date of postmark to be treated as date of payment of a bill, invoice, or statement of account due</header><subsection id="HB8E1BF8272A6450FA3DB89C1F70B2469"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/26">Chapter 26</external-xref> of title 39, United States Code, is amended by adding at the end the following:</text><quoted-block id="HF8BC4EB0446849B29ACBC2F82D672FC4" style="USC"><section id="HA1C6830821864E7AB6AD7FAB49388B94"><enum>2606.</enum><header>Date of postmark to be treated as date of payment of a bill, invoice, or statement of account due</header><subsection id="H35E8CEB847EC43449B7D5474D7B0E559"><enum>(a)</enum><text>If any payment required to be made on or before a prescribed date is, after such date, delivered by the Postal Service to the payee, such payment shall be deemed received by the payee on the date of the United States postmark stamped on the envelope or other cover in which such payment is mailed.</text></subsection><subsection id="H9F9DAC844D634177A1EA08B11C359BE5"><enum>(b)</enum><text>Subsection (a) shall not apply with respect to any payment—</text><paragraph id="HC5E18C7E475A49A3A97B78563D71B261"><enum>(1)</enum><text>other than a payment on a bill, invoice, or statement of account due;</text></paragraph><paragraph id="HBC0AA547DF8C4DC9918EDE21006EFCA2"><enum>(2)</enum><text>which is required, by law, regulation, or contract, to be delivered by any method other than by mail; or</text></paragraph><paragraph id="H7361ABA13705418288E0AB66273AAED3"><enum>(3)</enum><text>which is subject to any other provision of Federal law specifying how a postmark date shall be used in determining the date on which such payment shall be deemed to have been delivered or made.</text></paragraph></subsection><subsection id="H83610B135E6D485A8355443EE42F8358"><enum>(c)</enum><text>Subsection (a) shall apply only if—</text><paragraph id="H6A0FC16D874143B087BCE19F9D219D03"><enum>(1)</enum><text>the postmark date falls on or before the prescribed date for making the payment; and</text></paragraph><paragraph id="H694D261D9616453982344AF4BA2E5FD0"><enum>(2)</enum><text>the payment was, on or before such date, deposited in the mail in the United States in an envelope or under other appropriate cover, postage prepaid, properly addressed to the payee.</text></paragraph></subsection><subsection id="H8973BF63D9404D2596413BA148CC3F2F"><enum>(d)</enum><text>Subsection (a) shall not apply in the case of a postmark not made by the Postal Service.</text></subsection><subsection id="HAF67AA89C6D9480C8D518EC9BA9281FF"><enum>(e)</enum><text>For purposes of this section—</text><paragraph id="H5B28EF572AFB42048D3DE8DCAA225711"><enum>(1)</enum><text>the term <term>payee</term>, as used with respect to a payment, includes any person duly authorized to receive such payment; and</text></paragraph><paragraph id="H852572FD719340B3834F34C7204DCC65"><enum>(2)</enum><text>the term <term>United States</term> means the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, and any territory or possession of the United States.</text></paragraph></subsection><subsection id="H9B7F9516BE41498C90A11BEF84F411F9"><enum>(f)</enum><text>Regulations to carry out this section may be prescribed by the Postal Service.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1D5912D354624FD78118840B36F27908"><enum>(b)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/26">chapter 26</external-xref> of title 39, United States Code, is amended by adding at the end the following:</text><quoted-block id="H8713833499A647059D27B5AB17A9EF88" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">2606. Date of postmark to be treated as date of payment of a bill, invoice, or statement of account due.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H03519CF80D0D4386A0C67E3029BCE0CE"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to any mailing postmarked after the end of the 3-month period beginning on the date of enactment of this Act.</text></section></legis-body></bill>
