which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on the <committee-name committee-id="HJU00">Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To repeal certain provisions of the Communications Act of 1934, title 17 of the United States Code, and the regulations of the Federal Communications Commission that intervened in the television marketplace, and for other purposes.</official-title></form><legis-body id="H7702BF849EEB4E3599FB1CE882CCFFF6" style="OLC"><section id="HD0DC7F73B69A43E68102F4FE560BEAE2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Next Generation Television Marketplace Act</short-title></quote>.</text></section><section id="H1A0D1A24D3F24F56ABED218E5033CF76" section-type="subsequent-section"><enum>2.</enum><header>Repeal of regulatory intervention in the television marketplace under the Communications Act of 1934</header><subsection id="HDE471E6C29204A0AA054159BA908E5C9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The following sections of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) are hereby repealed:</text><paragraph id="HBADB475EB1BF4ABC923D91242047C44D"><enum>(1)</enum><text>Section 339 (<external-xref legal-doc="usc" parsable-cite="usc/47/339">47 U.S.C. 339</external-xref>).</text></paragraph><paragraph id="HC8EEC4A25A4745B9B332D8904EE7B91F"><enum>(2)</enum><text>Section 340 (<external-xref legal-doc="usc" parsable-cite="usc/47/340">47 U.S.C. 340</external-xref>).</text></paragraph><paragraph commented="no" id="H2A1C4292A3A84B568C48B0E533D642BB"><enum>(3)</enum><text>Section 341 (<external-xref legal-doc="usc" parsable-cite="usc/47/341">47 U.S.C. 341</external-xref>).</text></paragraph><paragraph commented="no" id="HCB9C91CA709F4FE4B5D59CFFCC38E4AF"><enum>(4)</enum><text>Section 342 (<external-xref legal-doc="usc" parsable-cite="usc/47/342">47 U.S.C. 342</external-xref>).</text></paragraph><paragraph id="HC8D18F1CCCBA44E089809CA33F091BFB"><enum>(5)</enum><text>Section 612 (<external-xref legal-doc="usc" parsable-cite="usc/47/532">47 U.S.C. 532</external-xref>).</text></paragraph><paragraph id="H2C5BCCAFD3044BABBC4BCAFE2D0A8964"><enum>(6)</enum><text>Section 614 (<external-xref legal-doc="usc" parsable-cite="usc/47/534">47 U.S.C. 534</external-xref>).</text></paragraph><paragraph id="H64A704DA7D96448F9DBCCE588DCA51E2"><enum>(7)</enum><text>Section 712 (<external-xref legal-doc="usc" parsable-cite="usc/47/612">47 U.S.C. 612</external-xref>).</text></paragraph></subsection><subsection id="H08039913D4544D6A89CBE36D1468E156"><enum>(b)</enum><header>Additional repeal</header><text>Section 325 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/325">47 U.S.C. 325</external-xref>) is amended—</text><paragraph id="HD15FC20DEE3846FBA044151E0A7C3F73"><enum>(1)</enum><text>by striking subsections (b) and (e); and</text></paragraph><paragraph id="H6943A2392EF5472899150A5A1E97446E"><enum>(2)</enum><text>by redesignating subsections (c) and (d) as subsections (b) and (c), respectively.</text></paragraph></subsection><subsection id="HCA98F57BB7B84DA0AA68997C7CDB4D12"><enum>(c)</enum><header>Amendments</header><paragraph id="H9CEBF6C44DFC476F8B759EB493228319"><enum>(1)</enum><header>Section 338</header><text display-inline="yes-display-inline">Section 338 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/338">47 U.S.C. 338</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H72BF5C3394D34708B0AB7CB2C874FDFC" style="OLC"><section id="HA1A8AD39FD4E4EC289262689CD957706"><enum>338.</enum><header>CARRIAGE OF LOCAL TELEVISION SIGNALS BY SATELLITE CARRIERS</header><subsection id="H6A65DA37DF9A480D9255CC8817F2EDDB"><enum>(a)</enum><header>Carriage Obligations</header><paragraph commented="no" id="H8D42F997BD3F4F6995321A7E2B7353A3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each satellite carrier providing signals of a qualified noncommercial educational television station in that station’s local market shall carry upon request the signals of all qualified noncommercial educational television stations located within that local market.</text></paragraph><paragraph id="HC98C408082EF49388D778CDFDA88EC7E"><enum>(2)</enum><header>Low power station carriage optional</header><text>No low power television station shall be entitled to insist on carriage under this section, nor shall any such carriage be considered in connection with the requirements of subsection (c).</text></paragraph></subsection><subsection id="H1383F4D2587745B7910BC19D5AE11F88"><enum>(b)</enum><header>Good Signal Required</header><text display-inline="yes-display-inline">A qualified noncommercial educational television station asserting its right to carriage under subsection (a) shall be required to bear the costs associated with delivering a good quality signal to the designated local receive facility of the satellite carrier or to another facility that is acceptable to at least one-half the stations asserting the right to carriage in the local market.</text></subsection><subsection id="H81D55573C6D94E379F73FFE6C87DBABC"><enum>(c)</enum><header>Duplication Not Required</header><text display-inline="yes-display-inline">The Commission shall prescribe regulations limiting the carriage requirements under subsection (a) of satellite carriers with respect to the carriage of multiple qualified noncommercial educational television stations. To the extent possible, such regulations shall provide the same degree of carriage by satellite carriers of such multiple stations as is provided by cable systems under section 615.</text></subsection><subsection id="HFE82E92B796540B2BE44C1BDB87A44C3"><enum>(d)</enum><header>Channel Positioning</header><text display-inline="yes-display-inline">No satellite carrier shall be required to provide the signal of a qualified noncommercial educational television station to subscribers in that station’s local market on any particular channel number or to provide the signals in any particular order, except that the satellite carrier shall retransmit the signal of the qualified noncommercial educational television station to subscribers in the station’s local market on channels reasonably contiguous with other television broadcast channels and provide access to such station’s signals at a nondiscriminatory price and in a nondiscriminatory manner on any navigational device, on-screen program guide, or menu.</text></subsection><subsection id="H674B5BE9ED89413CBB46347A1FE5E1AF"><enum>(e)</enum><header>Compensation for Carriage</header><text display-inline="yes-display-inline">A satellite carrier shall not accept or request monetary payment or other valuable consideration in exchange either for carriage of qualified noncommercial educational television stations in fulfillment of the requirements of this section or for channel positioning rights provided to such stations under this section, except that any such station may be required to bear the costs associated with delivering a good quality signal to the local receive facility of the satellite carrier.</text></subsection><subsection id="H75A25B7B7CB84B1B9F25C40F9970C564"><enum>(f)</enum><header>Remedies</header><paragraph id="H4859016A31FE4E3781A2B0BBE3FB3E24"><enum>(1)</enum><header>Complaints by broadcast stations</header><text display-inline="yes-display-inline">Whenever a qualified noncommercial educational television station believes that a satellite carrier has failed to meet its obligations under subsections (b) through (e), such station shall notify the carrier, in writing, of the alleged failure and identify its reasons for believing that the satellite carrier failed to comply with such obligations. The satellite carrier shall, within 30 days after such written notification, respond in writing to such notification and comply with such obligations or state its reasons for believing that it is in compliance with such obligations. A qualified noncommercial educational television station that disputes a response by a satellite carrier that it is in compliance with such obligations may obtain review of such denial or response by filing a complaint with the Commission. Such complaint shall allege the manner in which such satellite carrier has failed to meet its obligations and the basis for such allegations.</text></paragraph><paragraph id="HCA10877DF40C4DF8AACFC1D31C1F23D6"><enum>(2)</enum><header>Opportunity to respond</header><text>The Commission shall afford the satellite carrier against which a complaint is filed under paragraph (1) an opportunity to present data and arguments to establish that there has been no failure to meet its obligations under this section.</text></paragraph><paragraph id="HDD2E6B0A3A314A998D4660BC9E09591F"><enum>(3)</enum><header>Remedial actions; dismissal</header><text>Within 120 days after the date a complaint is filed under paragraph (1), the Commission shall determine whether the satellite carrier has met its obligations under subsections (b) through (e). If the Commission determines that the satellite carrier has failed to meet such obligations, the Commission shall order the satellite carrier to take appropriate remedial action. If the Commission determines that the satellite carrier has fully met the requirements of such subsections, the Commission shall dismiss the complaint.</text></paragraph></subsection><subsection id="HF4B8282BD8BA403F9A8B72D9E08213A1"><enum>(g)</enum><header>Privacy Rights of Satellite Subscribers</header><paragraph id="H5E02DAB2F8BA43B7A3C0C98ACC1AA5F5"><enum>(1)</enum><header>Notice</header><text>At the time of entering into an agreement to provide any satellite service or other service to a subscriber and at least once a year thereafter, a satellite carrier shall provide notice in the form of a separate, written statement to such subscriber that clearly and conspicuously informs the subscriber of—</text><subparagraph id="H314394AF195C4F1585C7FCBF0CF89803"><enum>(A)</enum><text>the nature of personally identifiable information collected or to be collected with respect to the subscriber and the nature of the use of such information;</text></subparagraph><subparagraph id="H9EC5BFC204404DAA856EB9B2B22B66FB"><enum>(B)</enum><text>the nature, frequency, and purpose of any disclosure which may be made of such information, including an identification of the types of persons to whom the disclosure may be made;</text></subparagraph><subparagraph id="H126B9638C5AD41D38110D7C2608A0773"><enum>(C)</enum><text>the period during which such information will be maintained by the satellite carrier;</text></subparagraph><subparagraph id="H05E3406D78EB4A5DB70676B10B44AD1C"><enum>(D)</enum><text>the times and place at which the subscriber may have access to such information in accordance with paragraph (5); and</text></subparagraph><subparagraph id="H1F3A29C5BF92451A930757EC894D6808"><enum>(E)</enum><text>the limitations provided by this subsection with respect to the collection and disclosure of information by a satellite carrier and the right of the subscriber under paragraphs (7) and (9) to enforce such limitations.</text></subparagraph><continuation-text continuation-text-level="paragraph">In the case of subscribers who have entered into such an agreement before February 6, 2005, such notice shall be provided within 180 days of such date and at least once a year thereafter.</continuation-text></paragraph><paragraph id="H64F58630E8E8420D9A66E40747E6699A"><enum>(2)</enum><header>Definitions</header><text>For purposes of this subsection, other than paragraph (9)—</text><subparagraph id="H5C425E0729964945B782664674264832"><enum>(A)</enum><text>the term <term>personally identifiable information</term> does not include any record of aggregate data which does not identify particular persons;</text></subparagraph><subparagraph id="HD35DC8A122CA44259C066E4F2F1020CC"><enum>(B)</enum><text>the term <term>other service</term> includes any wire or radio communications service provided using any of the facilities of a satellite carrier that are used in the provision of satellite service; and</text></subparagraph><subparagraph id="HEA98D41791C84656A5C9531E5F00F841"><enum>(C)</enum><text>the term <term>satellite carrier</term> includes, in addition to persons within the definition of satellite carrier, any person who—</text><clause id="HECBBE7FD5E7048CAB90BF8A6FF107655"><enum>(i)</enum><text>is owned or controlled by, or under common ownership or control with, a satellite carrier; and</text></clause><clause id="HAD7587580BCB4C3590A0506DF93AA8A2"><enum>(ii)</enum><text>provides any wire or radio communications service.</text></clause></subparagraph></paragraph><paragraph id="H63384E3A2AAF404CB3F1441EC7486879"><enum>(3)</enum><header>Prohibitions</header><subparagraph id="HD30EF04864CA4306B525FD622B31260F"><enum>(A)</enum><header>Consent to collection</header><text>Except as provided in subparagraph (B), a satellite carrier shall not use any facilities used by the satellite carrier to collect personally identifiable information concerning any subscriber without the prior written or electronic consent of the subscriber concerned.</text></subparagraph><subparagraph id="HFB8CECCDFC5448B596E236D246ED7B50"><enum>(B)</enum><header>Exceptions</header><text>A satellite carrier may use such facilities to collect such information in order to—</text><clause id="H36885FAD92CE41A2B8D404594A1BA214"><enum>(i)</enum><text>obtain information necessary to render a satellite service or other service provided by the satellite carrier to the subscriber; or</text></clause><clause id="HE381FFB68D5049C9AF0F77AAA2BBECCE"><enum>(ii)</enum><text>detect unauthorized reception of satellite communications.</text></clause></subparagraph></paragraph><paragraph id="H2EE2FC890F0C47E6B4AF8B99F91FB8FA"><enum>(4)</enum><header>Disclosure</header><subparagraph id="HC2B5E626B90B41FE896D929B19A215A8"><enum>(A)</enum><header>Consent to disclosure</header><text>Except as provided in subparagraph (B), a satellite carrier shall not disclose personally identifiable information concerning any subscriber without the prior written or electronic consent of the subscriber concerned and shall take such actions as are necessary to prevent unauthorized access to such information by a person other than the subscriber or satellite carrier.</text></subparagraph><subparagraph id="HA2EDDFE417A04458825B4DF75587F27E"><enum>(B)</enum><header>Exceptions</header><text>A satellite carrier may disclose such information if the disclosure is—</text><clause id="H5ECD9065460648C193C5935C5956EA71"><enum>(i)</enum><text>necessary to render, or conduct a legitimate business activity related to, a satellite service or other service provided by the satellite carrier to the subscriber;</text></clause><clause id="H4A31FDF5368E401B8233688B704B9C51"><enum>(ii)</enum><text>subject to paragraph (9), made pursuant to a court order authorizing such disclosure, if the subscriber is notified of such order by the person to whom the order is directed;</text></clause><clause id="H5477ECF3ABEC478D98DBD35282AD00EA"><enum>(iii)</enum><text>a disclosure of the names and addresses of subscribers to any satellite service or other service, if—</text><subclause id="H965C554C3E9B4858833A9E3E55DFA1D6"><enum>(I)</enum><text>the satellite carrier has provided the subscriber the opportunity to prohibit or limit such disclosure; and</text></subclause><subclause id="H616F6E1457484D67ACF846DE7517D80F"><enum>(II)</enum><text>the disclosure does not reveal, directly or indirectly, the—</text><item id="H50BB1E8F26614606B62F962B1F33ABE4"><enum>(aa)</enum><text>extent of any viewing or other use by the subscriber of a satellite service or other service provided by the satellite carrier; or</text></item><item id="H95D6D25DF9794A0E95EEB7A086080301"><enum>(bb)</enum><text>the nature of any transaction made by the subscriber over any facilities used by the satellite carrier; or</text></item></subclause></clause><clause id="HB90B8597466E48E6BEE2B7C0E0134E85"><enum>(iv)</enum><text>to a government entity as authorized under chapter 119, 121, or 206 of title 18, United States Code, except that such disclosure shall not include records revealing satellite subscriber selection of video programming from a satellite carrier.</text></clause></subparagraph></paragraph><paragraph id="H5CBEE16041AF46BB96542D2CF14ADD67"><enum>(5)</enum><header>Access by subscriber</header><text>A satellite subscriber shall be provided access to all personally identifiable information regarding that subscriber which is collected and maintained by a satellite carrier. Such information shall be made available to the subscriber at reasonable times and at a convenient place designated by such satellite carrier. A satellite subscriber shall be provided reasonable opportunity to correct any error in such information.</text></paragraph><paragraph id="H551A847994214CE19BF1EFB30E5EFF09"><enum>(6)</enum><header>Destruction of information</header><text>A satellite carrier shall destroy personally identifiable information if the information is no longer necessary for the purpose for which it was collected and there are no pending requests or orders for access to such information under paragraph (5) or pursuant to a court order.</text></paragraph><paragraph id="HDE9296834A63465BA7D27B6A9268F65B"><enum>(7)</enum><header>Penalties</header><text>Any person aggrieved by any act of a satellite carrier in violation of this subsection may bring a civil action in a United States district court. The court may award—</text><subparagraph id="HF0FDB87FDC59434DA45446398F3EB037"><enum>(A)</enum><text>actual damages but not less than liquidated damages computed at the rate of $100 a day for each day of violation or $1,000, whichever is higher;</text></subparagraph><subparagraph id="HA42879C4361C4CFB9A0BE83FA6C1C778"><enum>(B)</enum><text>punitive damages; and</text></subparagraph><subparagraph id="H151A73B5EF9940ED9A4A0C7010A17665"><enum>(C)</enum><text>reasonable attorneys’ fees and other litigation costs reasonably incurred.</text></subparagraph><continuation-text continuation-text-level="paragraph">The remedy provided by this subsection shall be in addition to any other lawful remedy available to a satellite subscriber.</continuation-text></paragraph><paragraph id="HCB0D70D9D8714578B33FB5B20C979356"><enum>(8)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to prohibit any State from enacting or enforcing laws consistent with this subsection for the protection of subscriber privacy.</text></paragraph><paragraph id="HF599B104A75D4CDB882FAFE34F9910F8"><enum>(9)</enum><header>Court orders</header><text>Except as provided in paragraph (4)(B)(iv), a governmental entity may obtain personally identifiable information concerning a satellite subscriber pursuant to a court order only if, in the court proceeding relevant to such court order—</text><subparagraph id="H1D75B7612C014E619DD4A47E5659D99B"><enum>(A)</enum><text>such entity offers clear and convincing evidence that the subject of the information is reasonably suspected of engaging in criminal activity and that the information sought would be material evidence in the case; and</text></subparagraph><subparagraph id="HFD9FE7BB8E124FEA80178F42B0D44113"><enum>(B)</enum><text>the subject of the information is afforded the opportunity to appear and contest such entity’s claim.</text></subparagraph></paragraph></subsection><subsection id="H0682853C9C7E4F48A8899571AB1D5BA5"><enum>(h)</enum><header>Regulations by Commission</header><text display-inline="yes-display-inline">The regulations prescribed under this section shall include requirements on satellite carriers that are comparable to the requirements on cable operators under paragraphs (1) and (2) of section 615(g).</text></subsection><subsection id="H59583B50CF8A47FFA6DEDA9B6155E2AA"><enum>(i)</enum><header>Definitions</header><text>As used in this section:</text><paragraph commented="no" id="H351D05BA0DBD41E593CBF25E4B1D41D8"><enum>(1)</enum><header>Distributor</header><text>The term <term>distributor</term> means an entity that contracts to distribute secondary transmissions from a satellite carrier and, either as a single channel or in a package with other programming, provides the secondary transmission either directly to individual subscribers or indirectly through other program distribution entities.</text></paragraph><paragraph id="H2EA231747A2D4F168F9D196B49AD2555"><enum>(2)</enum><header>Local receive facility</header><text>The term <term>local receive facility</term> means the reception point in each local market which a satellite carrier designates for delivery of the signal of the station for purposes of retransmission.</text></paragraph><paragraph commented="no" id="H4E2C08C0D9FF4B66A04C5FCCC01919E5"><enum>(3)</enum><header>Local market</header><subparagraph commented="no" id="H52050A44E00A4A86B18283111DC35FA8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>local market</term>, in the case of a qualified noncommercial educational television station, means the designated market area in which a station is located and includes any station that is licensed to a community within the same designated market area as such station.</text></subparagraph><subparagraph commented="no" id="H0362090347DB43D2B71E4E075FAFF46B"><enum>(B)</enum><header>County of license</header><text display-inline="yes-display-inline">In addition to the area described in subparagraph (A), a station’s local market includes the county in which the station’s community of license is located.</text></subparagraph><subparagraph commented="no" id="H9AB7E2588D41408D94A7F0C6C1139924"><enum>(C)</enum><header>Designated market area</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the term <term>designated market area</term> means a designated market area, as determined by Nielsen Media Research and published in the 1999–2000 Nielsen Station Index Directory and Nielsen Station Index United States Television Household Estimates or any successor publication.</text></subparagraph><subparagraph commented="no" id="HC1718D19EF8F4D09944ED5FB71BF8F5A"><enum>(D)</enum><header>Certain areas outside of any designated market area</header><text display-inline="yes-display-inline">Any census area, borough, or other area in the State of Alaska that is outside of a designated market area, as determined by Nielsen Media Research, shall be deemed to be part of one of the local markets in the State of Alaska. A satellite carrier may determine which local market in the State of Alaska will be deemed to be the relevant local market in connection with each subscriber in such census area, borough, or other area.</text></subparagraph></paragraph><paragraph id="H84138E80B0E34274B844A6B3F38DADDA"><enum>(4)</enum><header>Low power television station</header><text>The term <term>low power television station</term> means a low power television station as defined under <external-xref legal-doc="regulation" parsable-cite="cfr/47/74.701">section 74.701(f)</external-xref> of title 47, Code of Federal Regulations, as in effect on June 1, 2004. and</text></subclause><subclause commented="no" id="HEAF8158AA32B4BF8AC63CE7AD639A7F3"><enum>(II)</enum><text>by striking <quote>111, 119, or</quote>.</text></subclause></clause></subparagraph></paragraph></subsection></section><section id="H222F4017529343B8ABE4CF47052C067A"><enum>4.</enum><header>Repeal of Commission’s rules related to regulatory intervention</header><text display-inline="no-display-inline">The Federal Communications Commission shall take all actions necessary to—</text><paragraph id="H786DC25BDD244BB88E671D21B974D9E2"><enum>(1)</enum><text>repeal section 73.658 of the Commission’s rules (47 CFR 73.658);</text></paragraph><paragraph id="HE2428907ABB0413E850814E4002524C4"><enum>(2)</enum><text>repeal subpart D of part 76 of the Commission’s rules, except to the extent such subpart relates to the carriage of qualified noncommercial educational television stations consistent with the amendments made by this Act;</text></paragraph><paragraph id="H49EDCEF2B3104565A6136C479F1BD8E9"><enum>(3)</enum><text display-inline="yes-display-inline">repeal subpart F of part 76 of the Commission’s rules;</text></paragraph><paragraph id="HE1B89F1B05CE4D89BB3DAE8E35612C2A"><enum>(4)</enum><text>modify subpart S of part 76 of the Commission’s rules by eliminating any requirements relating to network nonduplication, syndicated exclusivity, and sports blackout for open video systems; and</text></paragraph><paragraph commented="no" id="H38AAFCAD23874130893CAB3AE94BDCDC"><enum>(5)</enum><text>modify the broadcast ownership limitations set forth in section 73.3555 of the Commission’s rules (47 CFR 73.3555) by eliminating—</text><subparagraph commented="no" id="H22755E1D06814A0E82EAB931E87ACBC9"><enum>(A)</enum><text display-inline="yes-display-inline">the restrictions on the number of broadcast television stations that a person or entity may directly or indirectly own, operate, or control in the same designated market area (as such term is defined under <external-xref legal-doc="usc" parsable-cite="usc/17/501">section 501(f)(2)</external-xref> of title 17, United States Code), as described in paragraph (b) of such section 73.3555;</text></subparagraph><subparagraph commented="no" id="HFEECC35B77D94F38AFD79B8D1BA9CF5F"><enum>(B)</enum><text>the radio-television cross-ownership rule, as described in paragraph (c) of such section 73.3555; and</text></subparagraph><subparagraph commented="no" id="H4FBB83CCBA764C9FBFBC831B76C9E037"><enum>(C)</enum><text display-inline="yes-display-inline">the limitations on the direct or indirect ownership, operation, or control of a broadcast television station by a person or entity that directly or indirectly owns, operates, or controls a daily newspaper, as that term was defined in note 6 to section 73.3555 of the Commission’s rules (47 CFR 73.3555) in effect on October 1, 2011, as described in paragraph (d) of such section 73.3555.</text></subparagraph></paragraph></section><section id="H6C3E7E50E67948A0B25498E55C505FEC"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as provided in section 6, this Act, and the amendments made by this Act, shall take effect on January 1, 2018.</text></section><section id="H8E43BB97E3FB4116BE5F001312795797"><enum>6.</enum><header>Continued collection and distribution of previously due royalties</header><text display-inline="no-display-inline">Notwithstanding section 5, the collection and distribution of royalties due for secondary transmissions made pursuant to sections <external-xref legal-doc="usc" parsable-cite="usc/17/111">111</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/17/119">119</external-xref> of title 17, United States Code, prior to January 1, 2018, shall continue to be governed by such title and the rules of the Register of Copyrights and Copyright Royalty Judges as in effect prior to the date of enactment of this Act until such time as the Register certifies that all royalties collected pursuant to such provisions have been distributed.</text></section></legis-body></bill>
