which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HED00">Education and the Workforce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To stop exploitation through trafficking.</official-title></form><legis-body id="HE3A9B1119A1D4B9E8B17E980DE11F41C" style="OLC"><section id="H6A95FBB6C85141F7B0EA51267D2323C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Exploitation Through Trafficking Act of 2013</short-title></quote>.</text></section><section id="H4C69B7999229459497ACC77A2A201D5E"><enum>2.</enum><header>National safe harbor law</header><subsection id="H45DEE95095B74C5886C450095FC7CF36"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="HD1E694A492F04F7BA16DE52170589986"><enum>(1)</enum><text>the term <term>commercial sex act</term> shall have the meaning given the term in section 103 of the Victims of Trafficking and Violence Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>);</text></paragraph><paragraph id="H88E1B0B9976C40C2835AB10D1F20F1E1"><enum>(2)</enum><text>the term <term>minor</term> means an individual who has not attained the age of 18 years;</text></paragraph><paragraph id="HE07F1C7DF5CE4D4BA22129693EDE8E77"><enum>(3)</enum><text>the term <term>severe form of trafficking in persons</term> shall have the meaning given the term in section 103 of the Victims of Trafficking and Violence Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>); and</text></paragraph><paragraph id="H8507293674A34340B6046214AE443343"><enum>(4)</enum><text>the term <term>State</term> shall have the meaning given the term in section 901 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3791">42 U.S.C. 3791</external-xref>).</text></paragraph></subsection><subsection id="H5EC2CE3DC4EC458AAD73D189347F1706"><enum>(b)</enum><header>Enactment of safe harbor law</header><text>On or after the date that is 3 years after the date of enactment of this Act, each State shall have in effect legislation that—</text><paragraph id="H55533A6BF1FE4700BA64243AA8057340"><enum>(1)</enum><text>treats a minor who has engaged in, or has attempted to engage in, a commercial sex act as a victim of a severe form of trafficking in persons;</text></paragraph><paragraph id="HACE416F7E9594E60954C9C03D9708002"><enum>(2)</enum><text>discourages the charging or prosecution of an individual described in paragraph (1) for a prostitution or sex trafficking offense, based on the conduct described in paragraph (1); and</text></paragraph><paragraph id="H68E3A0C19F3643E9B915A9785E2A9053"><enum>(3)</enum><text>encourages the diversion of an individual described in paragraph (1) to child protection services.</text></paragraph></subsection><subsection id="HC7F1E05C1A474F6C91B9F430BBF5B875"><enum>(c)</enum><header>Eligibility for Byrne Justice Assistance Grant Funds</header><paragraph id="H8AD8D6F570A84172B304BFFA78BB22B9"><enum>(1)</enum><header>In general</header><text>If a State fails to comply with subsection (b), the Attorney General may withhold—</text><subparagraph id="H1FCAA0CC6B224105B21E90429F3D88EF"><enum>(A)</enum><text>during the 2 fiscal years beginning after the 3-year period subsequent to the date of enactment of this Act, 3 percent of the amount that would otherwise be allocated to the State under section 505 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3755">42 U.S.C. 3755</external-xref>);</text></subparagraph><subparagraph id="H95702D7D29B24927BB715EBA606F3358"><enum>(B)</enum><text>during the fiscal year subsequent to the expiration of the period referred to in subparagraph (A), 4 percent of the amount that would otherwise be allocated to the State under section 505 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3755">42 U.S.C. 3755</external-xref>); and</text></subparagraph><subparagraph id="HD6E31797C93C4D8C8F503C22B8552829"><enum>(C)</enum><text>during any fiscal year subsequent to the expiration of the period referred to in subparagraph (B), 5 percent of the amount that would otherwise be allocated to the State under section 505 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3755">42 U.S.C. 3755</external-xref>).</text></subparagraph></paragraph><paragraph id="H6C93E7EE14BB485B930127A8818A2F64"><enum>(2)</enum><header>Reallocation</header><text>Any funds under section 505 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3755">42 U.S.C. 3755</external-xref>) that are not allocated to a State because of the failure of the State to comply with subsection (b) shall be reallocated to States that comply with subsection (b).</text></paragraph></subsection></section><section id="H4A8204D60EF847DA90A781D491B0D821"><enum>3.</enum><header>Civil remedies</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1595">Section 1595(a)</external-xref> of title 18, United States Code, is amended by inserting <quote>treble</quote> before <quote>damages</quote>.</text></section><section id="H2D9AA1620B8C4C19986C786AD518CCE8"><enum>4.</enum><header>Restitution</header><subsection id="H09EB1F996F0547DFBD7A4D9754E62FDF"><enum>(a)</enum><header>Establishment of process for data collection</header><text>Not later than 180 days after the date of enactment of this Act, the Attorney General shall establish a process to collect and analyze data relating to the issuance and enforcement of mandatory restitution orders under <external-xref legal-doc="usc" parsable-cite="usc/18/1593">section 1593</external-xref> of title 18, United States Code.</text></subsection><subsection id="HA446D81FBF3548FCAA66DD2C03BA267F"><enum>(b)</enum><header>Requirements</header><text>The process required to be established under subsection (a) shall—</text><paragraph id="HBEB4D19B791240E2B3157645B5AD325E"><enum>(1)</enum><text>ensure that data is collected for each offense charged under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/77">chapter 77</external-xref> of title 18, United States Code; and</text></paragraph><paragraph id="HD83C1C11989A4B539B03DE83E394FDAA"><enum>(2)</enum><text>allow for the tracking of enforcement of each restitution order under <external-xref legal-doc="usc" parsable-cite="usc/18/1593">section 1593</external-xref> of title 18, United States Code.</text></paragraph></subsection><subsection id="HB3FF62825BC94193A54BA8D84704DD33"><enum>(c)</enum><header>Annual report</header><text>Section 105(d)(7) of the Victims Trafficking and Violence Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(d)(7)</external-xref>) is amended—</text><paragraph id="HDA20D615A28D4F078E025F29348E67F2"><enum>(1)</enum><text>in subparagraph (Q)(v), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H9B86325879654B4FB18B646A61A738CA"><enum>(2)</enum><text>in subparagraph (R), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="H580B8038AD7C4948BD72B7AF4775898D"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HEB418CA793CD4B97BC05D88A1653B870" style="OLC"><subparagraph id="H37506D4407814DCD9BD9993F623D89E5"><enum>(S)</enum><text>for the first report submitted under this paragraph on or after January 1, 2015, and each report thereafter, the data collected under section 4 of the <short-title>Stop Exploitation Through Trafficking Act of 2013</short-title>;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HC6C3DE7E5CD2402FA64F5FA4E476B0B2"><enum>5.</enum><header>National human trafficking hotline</header><text display-inline="no-display-inline">Section 107(b)(2) of the Victims of Trafficking and Violence Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105(b)(2)</external-xref>) is amended—</text><paragraph id="HD16649141DAC41B790B42D7425B1B9D2"><enum>(1)</enum><text>by redesignating subparagraphs (B) and (C) as subparagraphs (C) and (D), respectively; and</text></paragraph><paragraph id="H38358E9691FD414DA7061C62EF686F2C"><enum>(2)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block display-inline="no-display-inline" id="H6977ACFC73B54F6EBCAC59F194C68EDD" style="OLC"><subparagraph id="H9D9B6482985145AB86EB324736BBA018"><enum>(B)</enum><header>National human trafficking hotline</header><text>Beginning in fiscal year 2017 and each fiscal year thereafter, of amounts made available for grants under this paragraph, the Secretary of Health and Human Services shall make grants for a national communication system to assist victims of severe forms of trafficking in persons in communicating with service providers. The Secretary shall give priority to grant applicants that have experience in providing telephone services to victims of severe forms of trafficking in persons.</text></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section><section id="HD28048B965CB4751BAB0509E19A13A7B"><enum>6.</enum><header>Job Corps eligibility</header><text display-inline="no-display-inline">Section 144(3) of the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2884">29 U.S.C. 2884(3)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H8604C20ACAB645E3A9ED3DCA67E2C612" style="OLC"><subparagraph id="HBD7DE10CAC144EE483B09A256DC0A397"><enum>(F)</enum><text>A victim of a severe form of trafficking in persons (as defined in section 103 of the Victims of Trafficking and Violence Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>)). Notwithstanding paragraph (2), an individual described in this subparagraph shall not be required to demonstrate eligibility under such paragraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H581C982CFCEA4E72A50B5FF0E323F450"><enum>7.</enum><header>Establishing a national strategy to combat human trafficking</header><subsection id="H8138ED963A564187897546D3AA3E8AE4"><enum>(a)</enum><header>In general</header><text>The Attorney General shall implement and maintain a National Strategy for Combating Human Trafficking (referred to in this section as the <term>National Strategy</term>) in accordance with this section.</text></subsection><subsection id="H1DA2E79BABA942B188D4926340BBB908"><enum>(b)</enum><header>Required contents of national strategy</header><text>The National Strategy shall include the following:</text><paragraph id="HC57F1BCE1F5D46B0B0A0F08FEDF393AB"><enum>(1)</enum><text>Integrated Federal, State, local, and tribal efforts to investigate and prosecute human trafficking cases, including—</text><subparagraph id="H69132B72BC674506BCA2241417F20568"><enum>(A)</enum><text>the partnership by each United States attorney with other Federal, State, local, and tribal law enforcement partners working in the district of such attorney to implement the National Strategy;</text></subparagraph><subparagraph id="H9ADCD0A551944E5899061C167522A05E"><enum>(B)</enum><text>the development by each United States attorney of a district-specific strategic plan to coordinate the investigation and prosecution of human trafficking crimes;</text></subparagraph><subparagraph id="H9A8577E87044490588DFFBE01053BC31"><enum>(C)</enum><text>the development and implementation of strategies to identify and rescue victims of human trafficking;</text></subparagraph><subparagraph id="H0681B6C8CB8E4686AF9E1DF3A2CA9022"><enum>(D)</enum><text>the appointment of not less than 1 assistant United States attorney in each district dedicated to the prosecution of human trafficking cases or responsible for implementing the National Strategy;</text></subparagraph><subparagraph id="HC8E463CF02CC466DBB01B8EA02094590"><enum>(E)</enum><text>the participation in local training, educational, and awareness programs of human trafficking crimes;</text></subparagraph><subparagraph id="H49C10E7FDA244B7AB7E6BF77839C7099"><enum>(F)</enum><text>the participation in any Federal, State, local, or tribal human trafficking task force operating in the district of the United States attorney; and</text></subparagraph><subparagraph id="H380389EB87A54D5B99D1854096C8AC41"><enum>(G)</enum><text>any other efforts intended to enhance the level of coordination and cooperation, as is to be determined by the Attorney General.</text></subparagraph></paragraph><paragraph id="H9F1686D2F1954AA4AA35482E137B6425"><enum>(2)</enum><text>Case coordination within the Department of Justice, including specific integration, coordination, and collaboration, as appropriate, on human trafficking investigations between and among the United States attorneys, the Human Trafficking Prosecution Unit, the Child Exploitation and Obscenity Section, and the Federal Bureau of Investigation, including—</text><subparagraph id="HE6D872F4B49D4F31B4E826A5E38953EC"><enum>(A)</enum><text>the regular and timely notification to the United States attorneys, the Human Trafficking Prosecution Unit, and the Child Exploitation and Obscenity Section of any sex or labor trafficking investigations opened by the Federal Bureau of Investigation, the Department of Homeland Security, the Department of Labor, or the Human Smuggling and Trafficking Center under section 1581, 1583, 1584, 1589, 1590, 1591, 1592, or 1594 of title 18, United States Code; and</text></subparagraph><subparagraph id="H4FEE35D5B8B842B0B7440E6861A206AC"><enum>(B)</enum><text>the reporting of the number of investigations described in subparagraph (A) in the annual report required under section 105(d)(7) of the Victims Trafficking and Violence Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(d)(7)</external-xref>).</text></subparagraph></paragraph><paragraph id="H619381CA205C4FC48C19B7616860828D"><enum>(3)</enum><text>Interagency coordination regarding the prevention, investigation, and apprehension of individuals targeting and exploiting adults and children for human trafficking, including collaboration and cooperation with—</text><subparagraph id="HD7C67829CE514E548DFCDF753A041C41"><enum>(A)</enum><text>the Department of Homeland Security;</text></subparagraph><subparagraph id="HF605DB9D22BA4443B9A75B04B4A738DD"><enum>(B)</enum><text>the Department of Labor;</text></subparagraph><subparagraph id="H5462E2B016A14BCAB8EB77AE9486F77B"><enum>(C)</enum><text>the Department of State;</text></subparagraph><subparagraph id="H3846541725964E1B873A8284F9E28829"><enum>(D)</enum><text>the Department of Health and Human Services;</text></subparagraph><subparagraph id="HB696791F7F7F41B6AB0A172A225B8498"><enum>(E)</enum><text>the Bureau of Indian Affairs; and</text></subparagraph><subparagraph id="HDDF9242059A44E07B0F6299D942DEA33"><enum>(F)</enum><text>other appropriate Federal agencies.</text></subparagraph></paragraph><paragraph id="H5631B55C645E49339AE3832B1B93AD15"><enum>(4)</enum><text>Measurable objectives and long-term, quantifiable goals that the Attorney General determines may be achieved.</text></paragraph><paragraph id="HA8667F19FE8C4EB19AC6B0736E614681"><enum>(5)</enum><text>Annual budget priorities and Federal efforts dedicated to preventing and combating human trafficking, including resources dedicated to the Human Trafficking Prosecution Unit, the Child Exploitation and Obscenity Section, the Federal Bureau of Investigation, and all other entities that receive Federal support that have a goal or mission to combat the exploitation of adults and children.</text></paragraph><paragraph id="H555544E5FF604EBA821FF4470F947DE3"><enum>(6)</enum><text>An ongoing assessment of the future trends, challenges, and opportunities, including new investigative strategies, techniques, and technologies, that will enhance Federal, State, local, and tribal efforts to combat human trafficking.</text></paragraph><paragraph id="HFA43463AD79849F790735CEDC8CB19FA"><enum>(7)</enum><text>Encouragement of cooperation, coordination, and mutual support between private sector and other entities and organizations and Federal agencies to combat human trafficking, including the involvement of State, local, and tribal government agencies to the extent Federal programs are involved.</text></paragraph></subsection></section><section id="HB7B92CAC6ACC4902A64234E43EADB627"><enum>8.</enum><header>Enhancing law enforcement coordination</header><text display-inline="no-display-inline">Section 105(d)(7) of the Victims of Trafficking and Violence Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(d)(7)</external-xref>), as amended by section 4, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HFDE2E0AE969F4B6B8EEA76B7CF2CE382" style="OLC"><subparagraph commented="no" id="H8A428EDE48E54B39AD1A31A9AD7259B1"><enum>(T)</enum><text>the number of sex and labor trafficking investigations opened by the Federal Bureau of Investigation, the Department of Homeland Security, the Department of Labor, or the Human Smuggling and Trafficking Center under section 1581, 1583, 1584, 1589, 1590, 1591, 1592, or 1594 of title 18, United States Code, during the preceding fiscal year; and</text></subparagraph><subparagraph commented="no" id="H1ED8D0A1924B4F30A866E7A332F4B30E"><enum>(U)</enum><text>the number of the sex and labor trafficking investigations described in subparagraph (T) that were reported to the United States attorneys, the Human Trafficking Prosecution Unit in the Civil Rights Division of the Department of Justice, and the Child Exploitation and Obscenity Section in the Criminal Division of the Department of Justice.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HA292F4E8E3474749ABF6F255BC187DFE"><enum>9.</enum><header>Sex offender registry</header><text display-inline="no-display-inline">Section 111 of the Sex Offender Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16911">42 U.S.C. 16911</external-xref>) is amended—</text><paragraph id="H799911A9FC994BCA8B02E41CA713016E"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3)(A)—</text><subparagraph id="HBC12DF239D34472A8B32D589C7DE1CE0"><enum>(A)</enum><text display-inline="yes-display-inline">by striking clause (i); and</text></subparagraph><subparagraph id="H14915E592EA54BE38A8E8FC96BE8CDAF"><enum>(B)</enum><text>by redesignating clauses (ii), (iii), and (iv) as clauses (i), (ii), and (iii), respectively; and</text></subparagraph></paragraph><paragraph id="H223B0EC3BB2D4CED8347161D3504F169"><enum>(2)</enum><text>in paragraph (4)—</text><subparagraph id="HBA3DEE713F704093B0344276AE14991A"><enum>(A)</enum><text>by redesignating subparagraphs (B) and (C) as subparagraphs (C) and (D), respectively; and</text></subparagraph><subparagraph id="H0BBEEDDC29BE4AF082061AC4E4C525BC"><enum>(B)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block display-inline="no-display-inline" id="H02E214502DA6440088C5489399F60826" style="OLC"><subparagraph id="H72400E3B41D145928CC97906A748035B"><enum>(B)</enum><text>is comparable to or more severe than sex trafficking (as described in <external-xref legal-doc="usc" parsable-cite="usc/18/1591">section 1591</external-xref> of title 18, United States Code), when committed against a minor, or an attempt or conspiracy to commit such an offense against a minor;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="HA5BCCFBC808D43ADAB3CB6BC4B6F4C41"><enum>10.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or an amendment made by this Act, or the application of such provision to any person or circumstance, is held to be invalid, the remainder of this Act, or an amendment made by this Act, or the application of such provision to other persons or circumstances, shall not be affected.</text></section></legis-body></bill>
