		<official-title>To amend the Surface Mining Control and Reclamation Act
		  of 1977 to stop the ongoing waste by the Department of the Interior of taxpayer
		  resources and implement the final rule on excess spoil, mining waste, and
		  buffers for perennial and intermittent streams, and for other
		  purposes.</official-title>

		<section id="H80F82FFF252B4AE2A1E287E12D8C6EDE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Preventing Government Waste and
			 Protecting Coal Mining Jobs in America</short-title></quote>.</text>
		</section><section id="HD29F2897FE44481FB6DA9B4244BCB2C9"><enum>2.</enum><header>Incorporation of
			 surface mining stream buffer zone rule into State programs</header>
			<subsection id="H0ABD9876FACE45C8A3C88247BDC8DA13"><enum>(a)</enum><header>In
			 general</header><text>Section 503 of the Surface Mining Control and Reclamation
			 Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1253">30 U.S.C. 1253</external-xref>) is amended by adding at the end the
			 following:</text>
				<quoted-block id="H64EEDCB6EF1C48A89F1819C5934BB301" style="OLC">
					<subsection id="HB1178B68BA9F41539DB482A7AE19B999"><enum>(e)</enum><header>Stream buffer
				zone management</header>
						<paragraph id="H94D90451F19841B691BBFB5E83521D04"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In addition to the
				requirements under subsection (a), each State program shall incorporate the
				necessary rule regarding excess spoil, coal mine waste, and buffers for
				perennial and intermittent streams published by the Office of Surface Mining
				Reclamation and Enforcement on December 12, 2008 (73 Fed. Reg. 75813 et
				seq.).</text>
						</paragraph><paragraph id="HAC266E3BDD1B4D44A199C9FC97428BD6"><enum>(2)</enum><header>Study of
				implementation</header><text>The Secretary shall—</text>
							<subparagraph id="H7A085EEE717C4EFA8E7F5E6EA9F74620"><enum>(A)</enum><text>at such time as
				the Secretary determines all States referred to in subsection (a) have fully
				incorporated the necessary rule referred to in paragraph (1) of this subsection
				into their State programs, publish notice of such determination;</text>
							</subparagraph><subparagraph id="H26EBC017960C421799908B075F10E3DB"><enum>(B)</enum><text>during the 5-year
				period beginning on the date of such publication, assess the effectiveness of
				implementation of such rule by such States; and</text>
							</subparagraph><subparagraph id="H0BFEB41517364A74A4FAFDA82D707C04"><enum>(C)</enum><text>upon the
				conclusion of such period, submit a comprehensive report on the impacts of such
				rule to the Committee on Natural Resources of the House of Representatives and
				the Committee on Energy and Natural Resources of the Senate, including—</text>
								<clause id="H8CDB8EBE186C4DA986149EE698F68307"><enum>(i)</enum><text>an
				evaluation of the effectiveness of such rule;</text>
								</clause><clause id="H52E1ED96B22045EC9258D35317765733"><enum>(ii)</enum><text>an evaluation of
				any ways in which the existing rule inhibits energy production; and</text>
								</clause><clause id="HA9789AA52BD74B08A60C37AFC9421D16"><enum>(iii)</enum><text>a description in
				detail of any proposed changes that should be made to the rule, the
				justification for such changes, all comments on such changes received by the
				Secretary from such States, and the projected costs and benefits of such
				changes.</text>
								</clause></subparagraph></paragraph><paragraph id="HBE037DF7042446D6AA162F6EFFC692E7"><enum>(3)</enum><header>Limitation on
				new regulations</header><text>The Secretary may not issue any regulations under
				this Act relating to stream buffer zones or stream protection before the date
				of the publication of the report under paragraph (2), other than a rule
				necessary to implement paragraph
				(1).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H01E808A2BA32461884A4F288E41D44D6"><enum>(b)</enum><header>Deadline for
			 State implementation</header><text display-inline="yes-display-inline">Not
			 later than 2 years after the date of the enactment of this Act, a State with a
			 State program approved under section 503 of the Surface Mining Control and
			 Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1253">30 U.S.C. 1253</external-xref>) shall submit to the Secretary of the
			 Interior amendments to such program pursuant to part 732 of title 30, Code of
			 Federal Regulations, incorporating the necessary rule referred to in subsection
			 (e)(1) of such section, as amended by this section.</text>
