		<official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/329">chapter 329</external-xref> of title 49, United States Code, to
		  ensure that new vehicles enable fuel competition so as to reduce the strategic
		  importance of oil to the United States.</official-title>

	<legis-body id="H9B0E5C380C3E453486E6DA4AF3B8E583" style="OLC">
		<section id="H4BF32B82B1F84B56BB25426A0C14351D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Open Fuel Standard Act of
			 2013</short-title></quote>.</text>
		</section><section id="H266229A2EAF74CF5BD6EAE65E98326F8"><enum>2.</enum><header>Open fuel
			 standard for motor vehicles</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/329">Chapter 329</external-xref> of title 49, United States Code,
			 is amended by inserting after section 32905 the following new section:</text>
			<quoted-block display-inline="no-display-inline" id="H0F53341E7FDB4492AC4D2B5BDE2778F8" style="USC">
				<section id="HF46FD43062424794978FD90FE9B2D96E"><enum>32905A.</enum><header>Open fuel
				standard for motor vehicles.</header>
					<subsection id="H7A92EEFC25BC4855AA41DF916BB5DA69"><enum>(a)</enum><header>Requirements</header><text display-inline="yes-display-inline">Except as provided in subsection (c), each
				manufacturer’s fleet of covered vehicles for a particular model year shall be
				comprised of—</text>
						<paragraph id="HF417378E3B08476F83C0B9FB86ABAA1E"><enum>(1)</enum><text display-inline="yes-display-inline">not less than 30 percent qualified vehicles
				beginning in model year 2016; and</text>
						</paragraph><paragraph id="H506D88D14FE447EA9090BDF195DBA961"><enum>(2)</enum><text display-inline="yes-display-inline">not less than 50 percent qualified vehicles
				beginning in model year 2017 and each subsequent year.</text>
						</paragraph></subsection><subsection id="H6C0DC97563FA4F87932D434681EE1A50"><enum>(b)</enum><header>Additional
				definitions</header><text display-inline="yes-display-inline">As used in this
				section—</text>
						<paragraph id="HD3D22243C27844608784FA7B94E2B8BB"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>covered vehicle</term> means
				a passenger automobile, and includes a light-duty motor vehicle;</text>
						</paragraph><paragraph id="H10D57898DFC048B6AF3AA5E046D25521"><enum>(2)</enum><text>the term
				<term>qualified vehicle</term> means covered vehicle that—</text>
							<subparagraph id="H915C9D293CD74A1AAD35D86D50C7E318"><enum>(A)</enum><text>has been warranted
				by its manufacturer to operate on natural gas, hydrogen, or biodiesel;</text>
							</subparagraph><subparagraph id="H3D8B2D1E0E584B1EA080515E44A14325"><enum>(B)</enum><text display-inline="yes-display-inline">is a flexible fuel vehicle;</text>
							</subparagraph><subparagraph id="HB48700F5CE184EE9B197DC0381E248A3"><enum>(C)</enum><text display-inline="yes-display-inline">is a plug-in electric drive vehicle;</text>
							</subparagraph><subparagraph id="HDF23B344026A4ED79FA154B0B69A8F19"><enum>(D)</enum><text display-inline="yes-display-inline">is propelled solely by fuel cell that
				produces power without the use of petroleum or a petroleum-based fuel;
				or</text>
							</subparagraph><subparagraph id="H3C078B9500ED43888D5567A02D251E18"><enum>(E)</enum><text display-inline="yes-display-inline">is propelled solely by something other than
				an internal combustion engine, and produces power without the use of petroleum
				or a petroleum-based fuel;</text>
							</subparagraph></paragraph><paragraph id="H02467A475A044E25BB5EFC0D75D96F8E"><enum>(3)</enum><text>the term
				<term>flexible fuel vehicle</term> means a vehicle that has been warranted by
				its manufacturer to operate on gasoline, E85, and M85;</text>
						</paragraph><paragraph id="H224148DE497A48F495727F696836F3C4"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>E85</term> means a fuel
				mixture containing up to 85 percent ethanol and meets the standards of ASTM
				D5798;</text>
						</paragraph><paragraph id="H31F6A12D54E64F20A7CC5F97E12EC50D"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>M85</term> means a fuel
				mixture containing up to 85 percent methanol and meets the standards of ASTM
				D5797;</text>
						</paragraph><paragraph id="H0A6797FC47B54B0F911AC60A024EFE1C"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>biodiesel</term> means
				diesel fuel which has been produced from a non-petroleum feedstock and which
				meets the standards of ASTM D6751–03;</text>
						</paragraph><paragraph id="HC8DB1F1161624E0FA1598B8C1DCE9BBD"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>plug-in electric drive
				vehicle</term> has the meaning given such term in section 508(a)(5) of the
				Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13258">42 U.S.C. 13258(a)(5)</external-xref>); and</text>
						</paragraph><paragraph id="H30C3D4EF44854D37AE29C301F37AF02B"><enum>(8)</enum><text>the term
				<term>light-duty motor vehicle</term> means a light-duty truck or light-duty
				vehicle as such terms are defined in section 216(7) of the Clean Air Act (42
				U.S.C. 7550(7)) of less than or equal to 8,500 pounds gross vehicle weight
				rating.</text>
						</paragraph></subsection><subsection id="H57D09BA38C854B8D9DB3BADAAA38155B"><enum>(c)</enum><header>Temporary
				Exemption from Requirements</header>
						<paragraph id="H7B37C1E94CD34A0F98A9DEB5A154E310"><enum>(1)</enum><header>Application</header><text display-inline="yes-display-inline">A manufacturer may request an exemption
				from the requirement described in subsection (a) by submitting an application
				to the Secretary, at such time, in such manner, and containing such information
				as the Secretary may require by regulation. Each such application shall specify
				the models, lines, and types of automobiles affected.</text>
						</paragraph><paragraph id="H3897DCB26A864977AE565F6350DE68A1"><enum>(2)</enum><header>Evaluation</header><text>After
				evaluating an application received from a manufacturer, the Secretary may at
				any time, under such terms and conditions, and to such extent as the Secretary
				considers appropriate, temporarily exempt, or renew the exemption of, a
				light-duty motor-vehicle from the requirement described in subsection (a) if
				the Secretary determines that unavoidable events not under the control of the
				manufacturer prevent the manufacturer of such automobile from meeting its
				required production volume of qualified automobiles, including—</text>
							<subparagraph id="H95E5F5FB3A7C45F58A48353A022FA772"><enum>(A)</enum><text>a disruption in
				the supply of any component required for compliance with the regulations;
				or</text>
							</subparagraph><subparagraph id="HC7B1E97EA8934496A034E1881413D3C6"><enum>(B)</enum><text>a disruption in
				the use and installation by the manufacturer of such component.</text>
							</subparagraph></paragraph><paragraph id="HF822D9DC88CD4D6280EB5D27B436E9B5"><enum>(3)</enum><header>Consolidation</header><text>The
				Secretary may consolidate applications received from multiple manufacturers
				under subparagraph (A) if they are of a similar nature.</text>
						</paragraph><paragraph id="HDEFAAEAD751D4F77861BBC741635E94F"><enum>(4)</enum><header>Conditions</header><text>Any
				exemption granted under paragraph (2) shall be conditioned upon the
				manufacturer’s commitment to recall the exempted automobiles for installation
				of the omitted components within a reasonable time proposed by the manufacturer
				and approved by the Secretary after such components become available in
				sufficient quantities to satisfy both anticipated production and recall volume
				requirements.</text>
						</paragraph><paragraph id="H7F97C36AE4DF489189008F89BD1B41EA"><enum>(5)</enum><header>Notice</header><text>The
				Secretary shall publish in the Federal Register—</text>
							<subparagraph id="H6FD0DA43EF01465E861AA2F360EC50F2"><enum>(A)</enum><text>notice of each
				application received from a manufacturer;</text>
							</subparagraph><subparagraph id="H7A2C98FE770A4201B84FB6EEA1BCE345"><enum>(B)</enum><text>notice of each
				decision to grant or deny a temporary exemption; and</text>
							</subparagraph><subparagraph id="HD0213AA4589448DABA4F382C7B38AE75"><enum>(C)</enum><text>the reasons for
				granting or denying such exemptions.</text>
							</subparagraph></paragraph></subsection><subsection id="HBF2BD1FC5D0148FE859FA31DBDCF69D5"><enum>(d)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this Act, the Secretary shall promulgate regulations as necessary
				to carry out this
				section.</text>
