			 consideration of such provisions as fall within the jurisdiction of the

		<official-title>To amend <external-xref legal-doc="usc" parsable-cite="usc/17/1201">section 1201</external-xref> of title 17, United States Code, to
		  require the infringement of a copyright for a violation of such section, and
		  for other purposes.</official-title>

		<section id="HF0A098BCE3114853A0A8AD6F21D403FE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Unlocking Technology Act of
			 2013</short-title></quote>.</text>
		</section><section id="HC348F3FCD3084FF0A590E2510888B9D6"><enum>2.</enum><header>Infringement of a
			 copyright required for anticircumvention prohibition</header>
			<subsection id="H3F2F6B12105E4A0AAAF524403A535FA1"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/1201">Section 1201(a)</external-xref> of title 17, United States
			 Code, is amended—</text>
				<paragraph id="H3CC72D74D9204658AA6CB3356EA5531C"><enum>(1)</enum><text>in paragraph
			 (1)(A)—</text>
					<subparagraph id="HAE0B4C3997B44EDEB4B472C2879CF1AA"><enum>(A)</enum><text>by amending the
			 first sentence to read as follows: <quote>No person shall, in order to infringe
			 or facilitate infringement of a copyright in a work protected under this title,
			 circumvent a technological measure that effectively controls access to that
			 work.</quote>; and</text>
					</subparagraph><subparagraph id="H4270620351A040A899D5FB7898E76FA0"><enum>(B)</enum><text>by adding at the
			 end the following: <quote>It shall not be a violation of this section to
			 circumvent a technological measure in connection with a work protected under
			 this title if the purpose of such circumvention is to engage in a use that is
			 not an infringement of copyright under this title.</quote>;</text>
					</subparagraph></paragraph><paragraph id="H2EA88A4713DC45BFB7B273A4FD160F89"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="H61A721F2F22946DE95005DCE9516824F"><enum>(A)</enum><text>in subparagraph
			 (A), by inserting after <quote>for the purpose of</quote> the following:
			 <quote>facilitating the infringement of a copyright by</quote>;</text>
					</subparagraph><subparagraph id="H04AEFC7F1B114993977F20E330E70E5C"><enum>(B)</enum><text>in subparagraph
			 (B), by striking <quote>circumvent</quote> and inserting <quote>facilitate the
			 infringement of a copyright by circumventing</quote>; and</text>
					</subparagraph><subparagraph id="HE29FE71093D84F04A40F666A4671C4E4"><enum>(C)</enum><text>in subparagraph
			 (C), by inserting after <quote>for use in</quote> the following:
			 <quote>facilitating the infringement of a copyright by</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" id="H9B79C9C1325E425AB9ED99287EC214A4"><enum>(3)</enum><text>by redesignating
			 paragraph (3) as paragraph (4), and inserting after paragraph (2), the
			 following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HACFFE91B6B944C7385607488D3A49207" style="USC">
						<paragraph commented="no" id="H6DF259B8D7BC4D45A7A34A1AC19628EE" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">It is not a violation of this section to
				use, manufacture, import, offer to the public, provide, or otherwise traffic in
				any technology, product, service, device, component, or part thereof that is
				primarily designed or produced for the purpose of facilitating noninfringing
				uses of works protected under this title by circumventing a technological
				measure that effectively controls access to that work, unless it is the intent
				of the person that uses, manufactures, imports, offers to the public, provides,
				or traffics in the technology, product, service, device, component, or part to
				infringe copyright or to facilitate the infringement of a
				copyright.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HDFC5DCC5C4384C8589DC94D36C37F279"><enum>(b)</enum><header>Report
			 required</header>
				<paragraph id="H2B5ABFF59CBD487B89406DA609F8997B"><enum>(1)</enum><header>In
			 general</header><text>Not later than the end of the 9-month period beginning on
			 the date of the enactment of this Act, the Assistant Secretary for
			 Communications and Information of the Department of Commerce shall submit to
			 the committees described in paragraph (2) a report on—</text>
					<subparagraph id="H3FF2A1D340844B988306912F688CAED9"><enum>(A)</enum><text>the impact of
			 <external-xref legal-doc="usc" parsable-cite="usc/17/1201">section 1201</external-xref> of title 17, United States Code, on consumer choice, competition,
			 and free flow of information;</text>
					</subparagraph><subparagraph id="HD8B319D6AD2540FC87CF2C1AA2D01765"><enum>(B)</enum><text>whether section
			 1201 of such title should be reformed in part, reformed entirely, or repealed;
			 and</text>
					</subparagraph><subparagraph id="HB9CAC78EB2BA4F37981EDFCD09A8EB0E"><enum>(C)</enum><text>barriers and
			 challenges to such reform or repeal, including international trade agreements
			 and treaties.</text>
					</subparagraph></paragraph><paragraph id="H1CEE30DF20BD4F7C9780E614ADD53A82"><enum>(2)</enum><header>Committees</header><text>The
			 committees described in this paragraph are the following:</text>
					<subparagraph id="H5971576CA296416AB8F4432DE8FD3EB9"><enum>(A)</enum><text>The Committees on
			 the Judiciary and Energy and Commerce of the House of Representatives.</text>
					</subparagraph><subparagraph id="HCE241837BE284697A5D13C42CDE8B1A1"><enum>(B)</enum><text>The Committees on
			 the Judiciary and Commerce, Science, and Transportation of the Senate.</text>
					</subparagraph></paragraph></subsection></section><section id="H225CF29C2BFA40A1B3E8BC0F014C28F4"><enum>3.</enum><header>Network switching
			 not infringement</header><text display-inline="no-display-inline">Section 117
			 of title 17, United States Code, is amended by adding at the end of the
			 following new subsection:</text>
			<quoted-block id="HB301D43C2CEC4CC494E648665EBA4C6C" style="OLC">
				<subsection id="HB7685AFD7BFF4BF6ACBCA35EB61BBD80"><enum>(e)</enum><header>Network
				switching</header><text>Notwithstanding the provisions of section 106, it is
				not an infringement to copy or adapt the software or firmware of a
				user-purchased mobile communications device for the sole purpose of enabling
				the device to connect to a wireless communications network if—</text>
					<paragraph id="H44F3EB64304B4B13985BFA91132C15C6"><enum>(1)</enum><text>the copying or
				adapting is initiated by, or with the consent of, the owner of that device or
				the owner’s agent;</text>
					</paragraph><paragraph id="H51464055C8AA422C9BE19C5BE49AF2FA"><enum>(2)</enum><text>the owner of that
				device or the owner’s agent is in legal possession of the device; and</text>
					</paragraph><paragraph id="H30C9C783FEFB4637AB8C70678C2BEB0C"><enum>(3)</enum><text display-inline="yes-display-inline">the owner of that device has the consent
				of, or an agreement with, the authorized operator of such wireless
				communications network to make use of that wireless communications
				network.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H97C506CC10864B24A34C6BF7F41AB5B7"><enum>4.</enum><header>Harmonization of
			 trade agreements</header><text display-inline="no-display-inline">The President
			 shall take the necessary steps to secure modifications to applicable bilateral
			 and multilateral trade agreements to which the United States is a party in
			 order to ensure that such agreements are consistent with the amendments made by
			 this Act.</text>
		</section><section id="H267ECCEE59934CE8875708E56AA0F605"><enum>5.</enum><header>Effective
			 date</header>
			<subsection id="HF642CA96A62F4EB7BF4DF2C9E83A797D"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">The amendments made by this Act shall apply
			 to acts carried out after the expiration of the 9-month period beginning on the
			 date of the enactment of this Act.</text>
			</subsection><subsection id="HEBB925A9438C48A186477E4C41D0FFA5"><enum>(b)</enum><header>Report</header><text>Sections
			 2(b) and 4 shall take effect on the date of the enactment of this Act.</text>
