		<section id="H76604542DD1C45EA959D29DD00D185F1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Domestic Fuels Protection Act of
			 2013</short-title></quote>.</text>
		</section><section id="H9D1DF926B9064E21A44694C43156C6E1"><enum>2.</enum><header>Fuel
			 compatibility</header>
			<subsection id="H14EAE5F640344D70A256D1FF17645EEA"><enum>(a)</enum><header>Compatibility</header><text>Subtitle
			 I of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6991">42 U.S.C. 6991 et seq.</external-xref>) is amended—</text>
				<paragraph id="H4AA3697334D5415E809D6E10B9B81C7F"><enum>(1)</enum><text>by redesignating
			 section 9014 as section 9015; and</text>
				</paragraph><paragraph id="H39994D21A53A4CD992BB7BD7EE7EDECC"><enum>(2)</enum><text>by inserting after
			 section 9013 the following:</text>
					<quoted-block id="H4D37B94B134645A9930A257018AD2BFE" style="OLC">
						<section id="H5D618174DB5740DFA44F6721494A3EDF"><enum>9014.</enum><header>Compatibility</header>
							<subsection id="H2B854AC9EBEE40D8B2B2E8A0F3A588EB"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph commented="no" id="H50B59B6A8E714FA290294621E4DC2CD6"><enum>(1)</enum><header>Associated
				dispensing equipment</header><text>The term <term>associated dispensing
				equipment</term> means equipment, at a stationary facility, that is—</text>
									<subparagraph commented="no" id="H8A8B7DC1709F4E9B98ACDC4AB2E79785"><enum>(A)</enum><text display-inline="yes-display-inline">used for—</text>
										<clause commented="no" id="HBAD78B233A234486B0D35E289A617BCE"><enum>(i)</enum><text display-inline="yes-display-inline">the storage of any fuel or fuel additive
				described in subsection (b)(3)(A); or</text>
										</clause><clause commented="no" id="H8300EBE6F524401989B01BCA4E7D2747"><enum>(ii)</enum><text>the dispensing of
				any fuel or fuel additive described in subsection (b)(3)(A) into any fuel tank
				of any motor vehicle, motor vehicle engine, nonroad vehicle, nonroad engine, or
				nonroad equipment; and</text>
										</clause></subparagraph><subparagraph commented="no" id="H4203ED75C97E46CE894C0B529495200C"><enum>(B)</enum><text display-inline="yes-display-inline">subject to regulation under section
				1910.106 or 1926.152 of title 29, Code of Federal Regulations (as in effect on
				the date of enactment of the Domestic Fuels Protection Act of 2013).</text>
									</subparagraph></paragraph><paragraph commented="no" id="H61AF0A5A2BE34B5EBDE2F17B9D6A32BA"><enum>(2)</enum><header>Compatible</header><text>The
				term <term>compatible</term> has the meaning given the term in section 280.12
				of title 40, Code of Federal Regulations (as in effect on the date of enactment
				of the Domestic Fuels Protection Act of 2013).</text>
								</paragraph><paragraph id="HC08F6B6551234FC7ACE47F73EF8ACAAD"><enum>(3)</enum><header>Motor
				vehicle</header><text>The term <term>motor vehicle</term> has the meaning given
				the term in section 216 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7550">42 U.S.C. 7550</external-xref>).</text>
								</paragraph><paragraph id="H677A2F7DD30C437C8395C26EC0CCD1D1"><enum>(4)</enum><header>Motor vehicle
				engine</header><text>The term <term>motor vehicle engine</term> means an engine
				in a motor vehicle.</text>
								</paragraph><paragraph id="HD7C94FA162704C24822F541113E4955B"><enum>(5)</enum><header>Nonroad
				engine</header><text>The term <term>nonroad engine</term> has the meaning given
				the term in section 216 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7550">42 U.S.C. 7550</external-xref>).</text>
								</paragraph><paragraph commented="no" id="H81709D4DB47F4FA583F55BF3B87FF787"><enum>(6)</enum><header>Nonroad
				equipment</header><text>The term <term>nonroad equipment</term> means any
				recreational, construction, industrial, agricultural, logging, residential,
				commercial lawn and garden, or other equipment that is powered by a nonroad
				engine.</text>
								</paragraph><paragraph commented="no" id="H77709795821D4BF787D99944ECD75A11"><enum>(7)</enum><header>Nonroad
				vehicle</header><text display-inline="yes-display-inline">The term
				<term>nonroad vehicle</term> has the meaning given the term in section 216 of
				the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7550">42 U.S.C. 7550</external-xref>).</text>
								</paragraph><paragraph id="H30751E4E9BA242C188071E46767972FF"><enum>(8)</enum><header>Provider of
				financial assurance</header><text>The term <term>provider of financial
				assurance</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/40/280">section 280.92</external-xref> of title 40,
				Code of Federal Regulations (as in effect on the date of enactment of the
				Domestic Fuels Protection Act of 2013).</text>
								</paragraph><paragraph id="H9A31B685E3FF4592A869CAE373AD78AE"><enum>(9)</enum><header>Underground
				storage tank system</header><text>The term <term>underground storage tank
				system</term> means an underground storage tank, connected underground piping,
				underground ancillary equipment, and containment system, if any.</text>
								</paragraph></subsection><subsection id="H7B6000AC2697449A946C5E9B188B0B39"><enum>(b)</enum><header>Compatibility
				with fuels</header>
								<paragraph id="H2E32A95303F041B39DE15B621F650799"><enum>(1)</enum><header>Liability</header><text display-inline="yes-display-inline">No person shall be liable under any
				Federal, State, or local law (including common law) because an underground
				storage tank, underground storage tank system, or associated dispensing
				equipment is not compatible with a fuel or fuel additive described in paragraph
				(3)(A) if the tank, system, or equipment has been determined to be compatible
				with the fuel or fuel additive under the guidelines or regulations described in
				paragraph (3).</text>
								</paragraph><paragraph id="HCB803388DC704817A5E6998FA78C233E"><enum>(2)</enum><header>Financial
				assurance</header><text display-inline="yes-display-inline">A provider of
				financial assurance shall not deny payment for any claim on the basis that an
				underground storage tank, underground storage tank system, or associated
				dispensing equipment is not compatible with a fuel or fuel additive described
				in paragraph (3)(A) if the tank, system, or equipment has been determined to be
				compatible with the fuel or fuel additive under the guidelines or regulations
				described in paragraph (3).</text>
								</paragraph><paragraph id="HA09F18AD4C284D9D8FF102CE8708BA9F"><enum>(3)</enum><header>Guidelines and
				regulations</header>
									<subparagraph id="HD9E3289AE2844DB2B056FD51C110EF2A"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Paragraphs (1) and
				(2) apply to any underground storage tank, underground storage tank system, and
				associated dispensing equipment that meets any guidelines or regulations, which
				may be revised under subparagraph (B), issued by the Administrator and in
				effect on the date of enactment of the Domestic Fuels Protection Act of 2013,
				addressing compatibility of such tanks, systems, or equipment with any fuel or
				fuel additive that is authorized and registered, or for which an updated
				registration is accepted, by the Administrator or under any Federal law, for
				use in a motor vehicle, motor vehicle engine, nonroad vehicle, nonroad engine,
				or nonroad equipment.</text>
									</subparagraph><subparagraph id="H010832F5395340DB917699B448D7FD49"><enum>(B)</enum><header>Regulations</header>
										<clause id="HCE36B17EE2484ECEAE4735CAA43FA390"><enum>(i)</enum><header>In
				general</header><text>Not later than 1 year after the date of enactment of the
				Domestic Fuels Protection Act of 2013, the Administrator shall issue, or if
				applicable revise, regulations setting standards for determining whether an
				underground storage tank, underground storage tank system, or associated
				dispensing equipment is compatible with a fuel or fuel additive described in
				subparagraph (A).</text>
										</clause><clause id="H0940F2BD134E4817AB565850F2F69FAC"><enum>(ii)</enum><header>Minimum
				standards</header><text display-inline="yes-display-inline">The regulations
				issued under clause (i) shall include minimum standards and processes for
				certification by the Administrator or by an owner, operator, or manufacturer of
				underground storage tanks, underground storage tank systems, or associated
				dispensing equipment, to ensure compatibility.</text>
										</clause></subparagraph></paragraph><paragraph id="H99440A6C21A54F55950CCFA3B6CD0897"><enum>(4)</enum><header>Underground
				storage tanks, underground storage tank systems, and associated dispensing
				equipment previously listed as compatible</header><text>Any underground storage
				tank, underground storage tank system, or associated dispensing equipment that,
				on or before the date of enactment of the Domestic Fuels Protection Act of
				2013, is listed by a nationally recognized testing laboratory as compatible
				with a fuel or fuel additive described in paragraph (3)(A) shall be deemed
				compatible with such fuel or fuel additive under the regulations issued under
				this subsection.</text>
								</paragraph><paragraph commented="no" id="HA003AD7D0B4E47E39661E285D3A7766D"><enum>(5)</enum><header>Administration</header><text display-inline="yes-display-inline">Nothing in this section affects—</text>
									<subparagraph commented="no" id="H39A26893FA354B9584A7F0A82E06E298"><enum>(A)</enum><text>any other
				requirement respecting the introduction into commerce, offering for sale, or
				sale of any fuel or fuel additive;</text>
									</subparagraph><subparagraph commented="no" id="H97A2D9A52E3B4A8E9D9AFDF8DFA6A08F"><enum>(B)</enum><text display-inline="yes-display-inline">any requirement under section 211(o) of the
				Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)</external-xref>); or</text>
									</subparagraph><subparagraph commented="no" id="H2A6C68EB15B14BEA983CF72C245AF0D2"><enum>(C)</enum><text>any other
				requirement under this
				subtitle.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H3E2D4CE437274253A273DC1DA61EE047"><enum>(b)</enum><header>Conforming
			 amendments</header><text>The Solid Waste Disposal Act is amended—</text>
				<paragraph id="H88D9282E54AB47C99B204ADFC4A1D763"><enum>(1)</enum><text>in section
			 9003(h)(12)(A) (<external-xref legal-doc="usc" parsable-cite="usc/42/6991b">42 U.S.C. 6991b(h)(12)(A)</external-xref>), by striking <quote>section
			 9014(2)(B)</quote> and inserting <quote>section 9015(2)(B)</quote>;</text>
				</paragraph><paragraph id="H31CA079D7AC64980A0032EB1803CCC75"><enum>(2)</enum><text>in section
			 9004(f)(1)(A) (<external-xref legal-doc="usc" parsable-cite="usc/42/6991c">42 U.S.C. 6991c(f)(1)(A)</external-xref>), by striking <quote>section
			 9014(2)(A)</quote> and inserting <quote>section 9015(2)(A)</quote>; and</text>
				</paragraph><paragraph id="HB08C773E871E4DCCB0F6E45A52FDB35C"><enum>(3)</enum><text>in section 9011
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/6991j">42 U.S.C. 6991j</external-xref>), by striking <quote>section 9014(2)(D)</quote> and inserting
			 <quote>section 9015(2)(D)</quote>.</text>
				</paragraph></subsection><subsection id="H3AC9882A0B8B48E08053CEB5940B0177"><enum>(c)</enum><header>Table of
			 contents</header><text>The table of contents contained in section 1001 of the
			 Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901</external-xref>) is amended by striking the item
			 relating to section 9014 and inserting the following:</text>

			</subsection></section><section id="H2414E138EBBA4225A080D44C8541914B"><enum>3.</enum><header>Misfueling</header>
			<subsection id="HD68B9DD21CC64416B64DFB0793A0D0A4"><enum>(a)</enum><header>In
			 general</header><text>Section 211(g) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(g)</external-xref>)
			 is amended by adding at the end the following:</text>
				<quoted-block id="HE55A71BD5EB040BDAB77AD42C79A41D0" style="OLC">
					<paragraph id="H60E15E816CBE4A8D955C88C31E74714B" indent="up1"><enum>(3)</enum><header>Limitation on liability</header>
						<subparagraph commented="no" id="HE35B5A87C9314C7F90CDE86F6D798594"><enum>(A)</enum><header>Limitation</header>
							<clause commented="no" id="H97CEC2A55571469BA1A7487A0371DDCD"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), no
				person shall be liable under any provision of this Act or any Federal, State,
				or local law, including common law, if—</text>
								<subclause commented="no" id="HDF39337976224243B364279362F03AAA"><enum>(I)</enum><text display-inline="yes-display-inline">a self-service purchaser introduces any
				transportation fuel into any motor vehicle, motor vehicle engine, nonroad
				vehicle, or nonroad equipment for which the fuel has not been approved under
				subsection (f); or</text>
								</subclause><subclause commented="no" id="H42EFDE1D6C114CEFB012BB35CBAC321C"><enum>(II)</enum><text display-inline="yes-display-inline">the introduction of any transportation fuel
				voids the warranty of the manufacturer of the motor vehicle, motor vehicle
				engine, nonroad engine, nonroad vehicle, or nonroad equipment.</text>
								</subclause></clause><clause commented="no" id="H2DE31B86966747838612B6D0532F105B"><enum>(ii)</enum><header>Exception</header><text>Clause
				(i) shall not apply to—</text>
								<subclause id="H8260CB2E292C4104A7E852368E227688"><enum>(I)</enum><text display-inline="yes-display-inline">a
				person who sells any transportation fuel and does not comply with the
				misfueling regulations adopted by the Administrator under section 80.1501 of
				title 40, Code of Federal Regulations (or successor regulations); or</text>
								</subclause><subclause id="HDE5B690075F7471AB2FBDB0E8F6A9DF9"><enum>(II)</enum><text>a person who intentionally
				misfuels.</text>
								</subclause></clause></subparagraph><subparagraph id="H508448CBD3BE4BBFAC10F2FA874F581C"><enum>(B)</enum><header>Definitions</header><text>In this
				paragraph:</text>
							<clause id="HAADC407362CC4B8F89902C8C9E60D741"><enum>(i)</enum><header>Nonroad equipment</header><text display-inline="yes-display-inline">The term <term>nonroad equipment</term>
				means any recreational, construction, industrial, agricultural, logging,
				residential, commercial lawn and garden, or other equipment that is powered by
				a nonroad engine.</text>
							</clause><clause id="H78360B03DE5049C190ACB4AA6F63CD8F"><enum>(ii)</enum><header>Transportation
				fuel</header><text>The term <term>transportation fuel</term> means any fuel
				that contains a fuel or a fuel additive, or a blend of a fuel and fuel
				additive, that is authorized after January 1, 2010, by the Administrator or
				under any Federal law, for use in any motor vehicle, motor vehicle engine,
				nonroad vehicle, nonroad engine, or nonroad
				equipment.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H85BEC1E439BC4BA89B09CE547BDB15F1"><enum>(b)</enum><header>Penalties</header><text>Section
			 211(d) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(d)</external-xref>) is amended—</text>
				<paragraph commented="no" id="HCD9504467A42443D876FEB2375A41944"><enum>(1)</enum><text>in paragraph (1),
			 in the first sentence, by inserting <quote>(g),</quote> after <quote>or the
			 regulations prescribed under subsection (c),</quote>; and</text>
				</paragraph><paragraph commented="no" id="H51FA396B7AB9421FB6699D526FFAE99E"><enum>(2)</enum><text>in paragraph (2),
			 in the first sentence, by inserting <quote>(g),</quote> after <quote>of the
			 regulations prescribed under subsections (c),</quote>.</text>
				</paragraph></subsection></section><section id="H6FBA4BE2710E44198D3529C91DECE94E"><enum>4.</enum><header>Limitation on
			 liability</header>
			<subsection id="H8638B0AAE6AB4B8EBE63B16A66B00A0E"><enum>(a)</enum><header>Qualified civil
			 liability actions in federal court and state court</header>
				<paragraph id="H69F8F51EDE754DD19470EB80E364994B"><enum>(1)</enum><header>In
			 general</header><text>No qualified civil liability action shall be filed or
			 maintained in any court of the United States or any State court.</text>
				</paragraph><paragraph id="HC620235BE9894B14BAEAE3E42AFBA145"><enum>(2)</enum><header>Dismissal of
			 pending actions</header><text>Any qualified civil liability action filed or
			 pending in any court of the United States or any State court on or after the
			 date of enactment of this Act shall be dismissed with prejudice.</text>
				</paragraph></subsection><subsection id="H99BFA3DA2FEA4414BA692E19F499A109"><enum>(b)</enum><header>Safe
			 harbor</header><text>Notwithstanding any Federal, State, or local law
			 (including common law), no qualified product shall be considered to be a
			 defective product, if the qualified product does not violate a control or
			 prohibition, respecting any characteristic or component of the qualified
			 product, imposed by the Administrator of the Environmental Protection Agency
			 under section 211 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545</external-xref>).</text>
			</subsection><subsection id="HCDC8ABD7465D450F801DFF9EE30B7A16"><enum>(c)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="HAD78A2A2511748629D3A76383B7823E3"><enum>(1)</enum><header>Covered
			 entity</header><text>The term <term>covered entity</term> means any entity
			 engaged in the design, manufacture, sale, or distribution of any—</text>
					<subparagraph id="HEE4F0085204A4946AFC957B963106563"><enum>(A)</enum><text>qualified product;
			 or</text>
					</subparagraph><subparagraph id="H1F2FAFFBD5D44170A044B86CD4C842D8"><enum>(B)</enum><text>motor vehicle,
			 motor vehicle engine, nonroad vehicle, nonroad engine, or nonroad
			 equipment.</text>
					</subparagraph></paragraph><paragraph id="HE4D9821492684B049696EADD6F5477B5"><enum>(2)</enum><header>Motor
			 vehicle</header><text>The term <term>motor vehicle</term> has the meaning given
			 the term in section 216 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7550">42 U.S.C. 7550</external-xref>).</text>
				</paragraph><paragraph id="H12608CFE5FCB4A6FBA2BCCC0A593E88B"><enum>(3)</enum><header>Motor vehicle
			 engine</header><text>The term <term>motor vehicle engine</term> means an engine
			 in a motor vehicle.</text>
				</paragraph><paragraph id="HE83A08563C12447396706B35C522AF47"><enum>(4)</enum><header>Nonroad
			 engine</header><text>The term <term>nonroad engine</term> has the meaning given
			 the term in section 216 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7550">42 U.S.C. 7550</external-xref>).</text>
				</paragraph><paragraph id="H71375D1641EF45E2B3BD408B38D1423F"><enum>(5)</enum><header>Nonroad
			 equipment</header><text>The term <term>nonroad equipment</term> means any
			 recreational, construction, industrial, agricultural, logging, residential,
			 commercial lawn and garden, or other equipment that incorporates a nonroad
			 engine.</text>
				</paragraph><paragraph id="H130FC7CB74114356982CFD0079FD95C8"><enum>(6)</enum><header>Nonroad
			 vehicle</header><text>The term <term>nonroad vehicle</term> has the meaning
			 given the term in section 216 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7550">42 U.S.C. 7550</external-xref>).</text>
				</paragraph><paragraph id="HE4D0A781C386499E9B4C3CD9EA09128F"><enum>(7)</enum><header>Person</header><text>The
			 term <term>person</term> has the meaning given the term in section 1 of title
			 1, United States Code, except that the term includes any governmental
			 entity.</text>
				</paragraph><paragraph id="HFBFB621B75774E11BC7DD77E2E587316"><enum>(8)</enum><header>Qualified civil
			 liability action</header><text>The term <term>qualified civil liability
			 action</term> means any civil action or proceeding brought by any person
			 against a covered entity for damages, punitive damages, injunctive or
			 declaratory relief, abatement, restitution, fines, penalties, or other relief,
			 resulting from the introduction of any qualified product into any motor
			 vehicle, motor vehicle engine, nonroad vehicle, nonroad engine, or nonroad
			 equipment.</text>
				</paragraph><paragraph id="HB84AB743F0A1448091701B4488A530E8"><enum>(9)</enum><header>Qualified
			 product</header><text>The term <term>qualified product</term> means—</text>
					<subparagraph id="H699DE22EA9014B92A4F451983D48B131"><enum>(A)</enum><text>any fuel or fuel
			 additive for which a registration is in effect under section 211(b) of the
			 Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(b)</external-xref>) or any other Federal law enacted on or after
			 October 13, 2010;</text>
					</subparagraph><subparagraph id="HF3919E8CF3394373A2E8A930B10653F3"><enum>(B)</enum><text>a transportation
			 fuel or transportation fuel additive that—</text>
						<clause id="H0E807423239142448A6120976A88945A"><enum>(i)</enum><text>contains any
			 renewable fuel (as defined in section 211(o)(1) of the Clean Air Act (42 U.S.C.
			 7545(o)(1))); and</text>
						</clause><clause id="H9F572874005140F6942E62958BB79415"><enum>(ii)</enum><text>is
			 designated for introduction into interstate commerce by the Administrator of
			 the Environmental Protection Agency or the Secretary of Energy under the Clean
			 Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>), the Energy Policy Act of 1992 (42 U.S.C.
			 13201 et seq.), or any other Federal law enacted on or after October 13,
			 2010;</text>
						</clause></subparagraph><subparagraph id="H4D9CBFB407574A72A48C26667B828EC0"><enum>(C)</enum><text>any component of a
			 fuel or fuel additive described in subparagraph (A) or (B); or</text>
					</subparagraph><subparagraph id="H07788E8B8D7A4CE6A5C434F65B4396F6"><enum>(D)</enum><text>any blend
			 stock.</text>
					</subparagraph></paragraph><paragraph id="H7A8A4934521743718627079F03417B7C"><enum>(10)</enum><header>State</header><text>The
			 term <term>State</term> means each of the several States of the United States;
			 the District of Columbia; and any territory, commonwealth, or possession of the
			 United States.</text>
