		<section id="idD938ACDBD1774625991078692056C07D" section-type="section-one"><enum>1.</enum><header>Prohibition on unauthorized
			 earmarks</header>
			<subsection id="id5FAF3623B6AB4BDB8765F69668ACF18C"><enum>(a)</enum><header>In
			 general</header><text>It shall not be in order to consider a bill, joint
			 resolution, conference report, or amendment that provides an earmark.</text>
			</subsection><subsection id="id719A77E29A4E46CDA742C9B4C777AE1D"><enum>(b)</enum><header>Supermajority</header>
				<paragraph id="idB9E78B5AE84B4B799F8108452474579B"><enum>(1)</enum><header>Waiver</header><text>The
			 provisions of subsection (a) may be waived or suspended in the Senate only by
			 the affirmative vote of three-fourths of the Members, duly chosen and
			 sworn.</text>
				</paragraph><paragraph id="id66A8DE6A262544D89EA66F401B039230"><enum>(2)</enum><header>Appeal</header><text>Appeals
			 in the Senate from the decisions of the Chair relating to any provision of this
			 section shall be limited to 1 hour, to be equally divided between, and
			 controlled by, the appellant and the manager of the measure. An affirmative
			 vote of three-fourths of the Members of the Senate, duly chosen and sworn,
			 shall be required to sustain an appeal of the ruling of the Chair on a point of
			 order raised under this section.</text>
				</paragraph></subsection><subsection id="idC2408893EB1E43929B29C00CD1645D7C"><enum>(c)</enum><header>Earmark
			 defined</header><text>In this resolution, the term <term>earmark</term> means a
			 provision or report language included primarily at the request of a Senator or
			 Member of the House of Representatives providing or recommending a specific
			 amount of discretionary budget authority, credit authority, or other spending
			 authority for a contract, loan, loan guarantee, grant, loan authority, or other
			 expenditure with or to an entity, or targeted to a specific State, locality, or
			 congressional district unless the provision or language—</text>
				<paragraph id="idC4244B4723B14DA68B12E4BB06277F52"><enum>(1)</enum><text>is specifically
			 authorized by an appropriate congressional authorizing committee of
			 jurisdiction;</text>
				</paragraph><paragraph id="idDAB89F25287E403589A32CBC1AF4975B"><enum>(2)</enum><text>meets funding
			 eligibility criteria established by an appropriate congressional authorizing
			 committee of jurisdiction by statute; or</text>
				</paragraph><paragraph id="idD2998A42D29D4E92A452838FF451DABF"><enum>(3)</enum><text>is awarded
			 through a statutory or administrative formula-driven or competitive award
			 process.</text>
