		<official-title display="yes">To promote the production of molybdenum-99
		  in the United States for medical isotope production, and to condition and phase
		  out the export of highly enriched uranium for the production of medical
		  isotopes.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="id5c3244a0-72b3-4318-be24-3bab78819617" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>American Medical Isotopes Production
			 Act of 2011</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id44579a5f-9359-47dc-b1df-edd0b92eb702" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id5E2ACB2471FF4DBB99B28099F39C5E49"><enum>(1)</enum><header display-inline="yes-display-inline">Department</header><text display-inline="yes-display-inline">The term <term>Department</term> means the
			 Department of Energy.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id85e79612-2a17-4f21-9a4b-93db15a02e05"><enum>(2)</enum><header display-inline="yes-display-inline">Highly enriched uranium</header><text display-inline="yes-display-inline">The term <term>highly enriched
			 uranium</term> means uranium enriched to 20 percent or greater in the isotope
			 U–235.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd0717fb9-0040-4a52-ba6d-38612a024186"><enum>(3)</enum><header display-inline="yes-display-inline">Low enriched uranium</header><text display-inline="yes-display-inline">The term <term>low enriched uranium</term>
			 means uranium enriched to less than 20 percent in the isotope U–235.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6DC5919AB57041BD9A4EDA46DD9562C6"><enum>(4)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Energy.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id84dba3c6-7e69-48d0-9a9e-b420a8357de3" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Improving the reliability of domestic
			 medical isotope supply</header>
			<subsection commented="no" display-inline="no-display-inline" id="id92042d5f-ac0a-4f1d-89df-64926e6d8e4d"><enum>(a)</enum><header display-inline="yes-display-inline">Medical isotope development
			 projects</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ide5d4eff8-b49b-465a-8a43-d6d167f3e32f"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall carry out a
			 technology-neutral program—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id62748736-508e-470c-a601-78801b11ec28"><enum>(A)</enum><text display-inline="yes-display-inline">to evaluate and support projects for the
			 production in the United States, without the use of highly enriched uranium, of
			 significant quantities of molybdenum-99 for medical uses;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idafb4e50e-7f8a-4c8e-a65c-ee5e2a40f78f"><enum>(B)</enum><text display-inline="yes-display-inline">to be carried out in cooperation with
			 non-Federal entities; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd732025e-fb78-4efe-ae82-d59ee6837f9e"><enum>(C)</enum><text display-inline="yes-display-inline">the costs of which shall be shared in
			 accordance with section 988 of the Energy Policy Act of 2005 (42 U.S.C.
			 16352).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a356c95-eeb8-4590-a3d1-8121aacf1996"><enum>(2)</enum><header display-inline="yes-display-inline">Criteria</header><text display-inline="yes-display-inline">Projects shall be judged against the
			 following primary criteria:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id038e1166-a6f4-48f3-b7b6-a8ea943f520f"><enum>(A)</enum><text display-inline="yes-display-inline">The length of time necessary for the
			 proposed project to begin production of molybdenum-99 for medical uses within
			 the United States.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcae65de3-1df6-42f4-9855-927e12cf5e05"><enum>(B)</enum><text display-inline="yes-display-inline">The capability of the proposed project to
			 produce a significant percentage of United States demand for molybdenum-99 for
			 medical uses.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7966ae05-ba9a-4ec4-ad8d-033ea64e05b1"><enum>(C)</enum><text display-inline="yes-display-inline">The cost of the proposed project.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13a5f872-f66a-4db6-a76e-2f9041764e7c"><enum>(3)</enum><header display-inline="yes-display-inline">Exemption</header><text display-inline="yes-display-inline">An existing reactor in the United States
			 fueled with highly enriched uranium shall not be disqualified from the program
			 if the Secretary determines that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id0292505a-7ba7-4cc8-a03c-ae502a3a3bbe"><enum>(A)</enum><text display-inline="yes-display-inline">there is no alternative nuclear reactor
			 fuel, enriched in the isotope U–235 to less than 20 percent, that can be used
			 in that reactor;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7e1de0e4-e8a8-48fd-87e7-ffb45a2a78fa"><enum>(B)</enum><text display-inline="yes-display-inline">the reactor operator has provided
			 assurances that, whenever an alternative nuclear reactor fuel, enriched in the
			 isotope U–235 to less than 20 percent, can be used in that reactor, it will use
			 that alternative in lieu of highly enriched uranium; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id16ca7da3-6c9d-49a9-91c3-9029d13dd794"><enum>(C)</enum><text display-inline="yes-display-inline">the reactor operator has provided a current
			 report on the status of its efforts to convert the reactor to an alternative
			 nuclear reactor fuel enriched in the isotope U–235 to less than 20 percent, and
			 an anticipated schedule for completion of conversion.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida58a8d07-0726-4b3d-b031-f1e4b4268916"><enum>(4)</enum><header display-inline="yes-display-inline">Public participation and
			 review</header><text display-inline="yes-display-inline">The Secretary
			 shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id40c96d9f-1f74-4c98-adef-f9b3cc051428"><enum>(A)</enum><text display-inline="yes-display-inline">develop a program plan and annually update
			 the program plan through public workshops; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida51c36a0-f792-404c-9ea6-2efb001d1b70"><enum>(B)</enum><text display-inline="yes-display-inline">use the Nuclear Science Advisory Committee
			 to conduct annual reviews of the progress made in achieving the program
			 goals.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2720c83c-2751-416a-a59a-363e00cf00ad"><enum>(b)</enum><header display-inline="yes-display-inline">Development assistance</header><text display-inline="yes-display-inline">The Secretary shall carry out a program to
			 provide assistance for—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id7a591e46-2a24-4a54-a3aa-f120d9ac58bd"><enum>(1)</enum><text display-inline="yes-display-inline">the development of fuels, targets, and
			 processes for domestic molybdenum-99 production that do not use highly enriched
			 uranium; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9bf729e5-04d7-440b-a2ae-5cadfd891e95"><enum>(2)</enum><text display-inline="yes-display-inline">commercial operations using the fuels,
			 targets, and processes described in paragraph (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3f0a26bf-4017-4d33-86fc-acf88fcfe980"><enum>(c)</enum><header display-inline="yes-display-inline">Uranium lease and take-back</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id9C3C16A6BF2745EFA188897DFD2B4AFF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program to
			 make low-enriched uranium available, through lease contracts, for irradiation
			 for the production of molybdenum-99 for medical uses.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4cbe0ad2f75e48e1a65cc7e5e7c1e385"><enum>(2)</enum><header display-inline="yes-display-inline">Title</header><text display-inline="yes-display-inline">The lease contracts shall provide for the
			 producers of the molybdenum-99 to take title to and be responsible for the
			 molybdenum-99 created by the irradiation, processing, or purification of
			 uranium leased under this section.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54B3FC9C61C443D3837FAF51738C4672"><enum>(3)</enum><header display-inline="yes-display-inline">Duties</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id8A9AE3FBBD384963B3BD646B4A63A665"><enum>(A)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The lease contracts shall require the
			 Secretary—</text>
						<clause commented="no" display-inline="no-display-inline" id="idD3E25037740D4C4FBB554CC3DC265826"><enum>(i)</enum><text display-inline="yes-display-inline">to retain responsibility for the final
			 disposition of spent nuclear fuel created by the irradiation, processing, or
			 purification of uranium leased under this section for the production of medical
			 isotopes; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id48DA0EAA93624B70943E0A17776155AF"><enum>(ii)</enum><text display-inline="yes-display-inline">to take title to and be responsible for the
			 final disposition of radioactive waste created by the irradiation, processing,
			 or purification of uranium leased under this section for which the Secretary
			 determines the producer does not have access to a disposal path.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id15A59B87E4984D32B7B6F61F601816B0"><enum>(B)</enum><header display-inline="yes-display-inline">Producer</header><text display-inline="yes-display-inline">The producer of the spent nuclear fuel and
			 radioactive waste shall accurately characterize, appropriately package, and
			 transport the spent nuclear fuel and radioactive waste prior to acceptance by
			 the Department.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBC823BAE9C4440FCABA2CD573363CD53"><enum>(4)</enum><header display-inline="yes-display-inline">Compensation</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id4EC01425299A42878ACB903830280AAA"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the lease
			 contracts shall provide for compensation in cash amounts equivalent to
			 prevailing market rates for the sale of comparable uranium products and for
			 compensation in cash amounts equivalent to the net present value of the cost to
			 the Federal Government for—</text>
						<clause commented="no" display-inline="no-display-inline" id="id238CB403962E4B89ACF74339593228AE"><enum>(i)</enum><text display-inline="yes-display-inline">the final disposition of spent nuclear fuel
			 and radioactive waste for which the Department is responsible under paragraph
			 (3); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idD9EA2075756B4159B55E8E5708D668CA"><enum>(ii)</enum><text display-inline="yes-display-inline">other costs associated with carrying out
			 the uranium lease and take-back program authorized by this subsection.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0190970E60394B18A57F043E99D037D9"><enum>(B)</enum><header display-inline="yes-display-inline">Discount rate</header><text display-inline="yes-display-inline">The discount rate used to determine the net
			 present value of costs described in subparagraph (A)(ii) shall be not greater
			 than the average interest rate on marketable Treasury securities.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDce7c5fbd27ec49068dd54e5c9bdf964e"><enum>(5)</enum><header display-inline="yes-display-inline">Authorized use of funds</header><text display-inline="yes-display-inline">The Secretary may obligate and expend funds
			 received under leases entered into under this subsection, which shall remain
			 available until expended, for the purpose of carrying out the activities
			 authorized by this Act, including activities related to the final disposition
			 of spent nuclear fuel and radioactive waste for which the Department is
			 responsible under paragraph (3).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFBFB4F13AA504D7E99BF552AC6EC28DB"><enum>(6)</enum><header display-inline="yes-display-inline">Exchange of uranium for
			 services</header><text display-inline="yes-display-inline">The Secretary shall
			 not barter or otherwise sell or transfer uranium in any form in exchange
			 for—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idAA746CF798DC4585AC75ED99E0A11928"><enum>(A)</enum><text display-inline="yes-display-inline">services related to the final disposition
			 of the spent nuclear fuel and radioactive waste for which the Department is
			 responsible under paragraph (3); or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6943601DA63246D28FFB136FC3BE0197"><enum>(B)</enum><text display-inline="yes-display-inline">any other services associated with carrying
			 out the uranium lease and take-back program authorized by this
			 subsection.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID051cb5d36dcb4c86ac68c713cba73bdd"><enum>(d)</enum><header display-inline="yes-display-inline">Coordination of environmental
			 reviews</header><text display-inline="yes-display-inline">The Department and
			 the Nuclear Regulatory Commission shall ensure to the maximum extent
			 practicable that environmental reviews for the production of the medical
			 isotopes shall complement and not duplicate each review.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID16e95f14d9e443d5a6383e306284cb49"><enum>(e)</enum><header display-inline="yes-display-inline">Operational date</header><text display-inline="yes-display-inline">The Secretary shall establish a program as
			 described in subsection (c)(3) not later than 3 years after the date of
			 enactment of this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDe8038db4266340e78afa276372b0f083"><enum>(f)</enum><header display-inline="yes-display-inline">Radioactive waste</header><text display-inline="yes-display-inline">Notwithstanding section 2 of the Nuclear
			 Waste Policy Act of 1982 (42 U.S.C. 10101), radioactive material resulting from
			 the production of medical isotopes that has been permanently removed from a
			 reactor or subcritical assembly and for which there is no further use shall be
			 considered low-level radioactive waste if the material is acceptable under
			 Federal requirements for disposal as low-level radioactive waste.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id459c89a1-f48f-4ba8-a1cc-c986bf3ef748" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Exports</header><text display-inline="no-display-inline">Section 134 of the Atomic Energy Act of 1954
			 (42 U.S.C. 2160d) is amended by striking subsection c. and inserting the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="ida126b2ed-19e3-487a-9bb2-4f40d069ab0b" other-style="nuclear" style="other">
				<subsection commented="no" display-inline="no-display-inline" id="idef576ea9-9d55-45c0-9c7f-8d58d16987dc"><enum>c.</enum><text display-inline="yes-display-inline">Effective 7 years after the date of
				enactment of the <short-title>American Medical Isotopes
				Production Act of 2011</short-title>, the Commission may not issue a license
				for the export of highly enriched uranium from the United States for the
				purposes of medical isotope production.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idc0f17f2c-bd73-4d34-86c1-649594dd1efd"><enum>d.</enum><text display-inline="yes-display-inline">The period referred to in subsection b. may
				be extended for no more than 6 years if, no earlier than 6 years after the date
				of enactment of the <short-title>American Medical Isotopes
				Production Act of 2011</short-title>, the Secretary of Energy certifies to the
				Committee on Energy and Commerce of the House of Representatives and the
				Committee on Energy and Natural Resources of the Senate that—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idc041cf4d-3229-41d5-9fd7-77c1a0bd0c85"><enum>(1)</enum><text display-inline="yes-display-inline">there is insufficient global supply of
				molybdenum-99 produced without the use of highly enriched uranium available to
				satisfy the domestic United States market; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3be37175-421a-43dd-8ff2-2e64a3f0aa06"><enum>(2)</enum><text display-inline="yes-display-inline">the export of United States-origin highly
				enriched uranium for the purposes of medical isotope production is the most
				effective temporary means to increase the supply of molybdenum-99 to the
				domestic United States market.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id012261b3-86d3-4db4-8a37-3c2c492dec23"><enum>e.</enum><text display-inline="yes-display-inline">To ensure public review and comment, the
				development of the certification described in subsection c. shall be carried
				out through announcement in the Federal Register.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idaafa58aa-070c-4be3-ab75-8ca9b2dca94c"><enum>f.</enum><text display-inline="yes-display-inline">At any time after the restriction of export
				licenses provided for in subsection b. becomes effective, if there is a
				critical shortage in the supply of molybdenum-99 available to satisfy the
				domestic United States medical isotope needs, the restriction of export
				licenses may be suspended for a period of no more than 12 months, if—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id6009dc5c-0417-4c0d-8d01-80cc7ea20318"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of Energy certifies to the
				Congress that the export of United States-origin highly enriched uranium for
				the purposes of medical isotope production is the only effective temporary
				means to increase the supply of molybdenum-99 necessary to meet United States
				medical isotope needs during that period; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd278c4d4-0d38-4f94-a9e5-0ec57708b863"><enum>(2)</enum><text display-inline="yes-display-inline">the Congress enacts a Joint Resolution
				approving the temporary suspension of the restriction of export
				licenses.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idacedd009-151d-4ece-a01e-ca9d163d2c88"><enum>g.</enum><text display-inline="yes-display-inline">As used in this section—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id084274db-ce11-4597-85c4-999637271874"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>alternative nuclear reactor
				fuel or target</quote> means a nuclear reactor fuel or target which is enriched
				to less than 20 percent in the isotope U–235;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide2cd7eba-8fae-491d-a7d3-13d97a4355aa"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>highly enriched
				uranium</quote> means uranium enriched to 20 percent or more in the isotope
				U–235;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide38884bb-2aa9-4c03-87e4-1607c76d020a"><enum>(3)</enum><text display-inline="yes-display-inline">a fuel or target <quote>can be used</quote>
				in a nuclear research or test reactor if—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id66eeec37-a58a-4838-8bbe-5c4fc4ca52b5"><enum>(A)</enum><text display-inline="yes-display-inline">the fuel or target has been qualified by
				the Reduced Enrichment Research and Test Reactor Program of the Department of
				Energy; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddae90125-230d-4211-8f0c-655a79872101"><enum>(B)</enum><text display-inline="yes-display-inline">use of the fuel or target will permit the
				large majority of ongoing and planned experiments and medical isotope
				production to be conducted in the reactor without a large percentage increase
				in the total cost of operating the reactor; and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7167fce9-e1a4-4cf2-8ca1-433d810446e1"><enum>(4)</enum><text display-inline="yes-display-inline">the term <quote>medical isotope</quote>
				includes molybdenum-99, iodine-131, xenon-133, and other radioactive materials
				used to produce a radiopharmaceutical for diagnostic or therapeutic procedures
				or for research and
				development.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="ida69aee79-474e-491d-a8e3-f229b9c4c248" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Report on disposition of
			 exports</header><text display-inline="no-display-inline">Not later than 1 year
			 after the date of the enactment of this Act, the Chairman of the Nuclear
			 Regulatory Commission, after consulting with other relevant agencies, shall
			 submit to the Congress a report detailing the current disposition of previous
			 United States exports of highly enriched uranium used as fuel or targets in a
			 nuclear research or test reactor, including—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id6b07482f-6b10-44ef-b651-df42dd8cd405"><enum>(1)</enum><text display-inline="yes-display-inline">their location;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id579e372a-2642-4279-a6dc-a465b69e4af5"><enum>(2)</enum><text display-inline="yes-display-inline">whether they are irradiated;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf8779d59-babb-4036-9d15-b3f1f3bd9725"><enum>(3)</enum><text display-inline="yes-display-inline">whether they have been used for the purpose
			 stated in their export license;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida259e456-b762-43e7-9a8d-60911cbb2277"><enum>(4)</enum><text display-inline="yes-display-inline">whether they have been used for an
			 alternative purpose and, if so, whether such alternative purpose has been
			 explicitly approved by the Commission;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida5b98db9-b366-4a1f-8271-c04057e2f3a6"><enum>(5)</enum><text display-inline="yes-display-inline">the year of export, and reimportation, if
			 applicable;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb4fe1cbb-a780-49b4-8775-d07f8aacf33e"><enum>(6)</enum><text display-inline="yes-display-inline">their current physical and chemical forms;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id003a64f5-4993-4a09-beac-b7fe8f565c52"><enum>(7)</enum><text display-inline="yes-display-inline">whether they are being stored in a manner
			 which adequately protects against theft and unauthorized access.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id52a030b3-7b15-4988-bfc7-65b30e017190" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Domestic medical isotope
			 production</header>
			<subsection commented="no" display-inline="no-display-inline" id="idafb3f59f-0eeb-4da8-94af-75b281ddd524"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 10 of the Atomic Energy Act of 1954
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/2131">42 U.S.C. 2131 et
			 seq.</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id24ddd244-08fb-470f-9bad-2c337b1c01d9" other-style="nuclear" style="other">
					<section commented="no" display-inline="no-display-inline" id="idda0b0a06-ccf5-4ce0-ba52-151ac0d604c9" section-type="subsequent-section"><enum>112.</enum><header display-inline="yes-display-inline">Domestic medical isotope
				production</header>
						<subsection commented="no" display-inline="no-display-inline" id="id434627cc-1f99-4b33-a525-6a75ec460a33"><enum>a.</enum><text display-inline="yes-display-inline">The Commission may issue a license, or
				grant an amendment to an existing license, for the use in the United States of
				highly enriched uranium as a target for medical isotope production in a nuclear
				reactor, only if, in addition to any other requirement of this Act—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id292ff79d-dabf-43f8-85e7-a9f25062acd2"><enum>(1)</enum><text display-inline="yes-display-inline">the Commission determines that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id4aef6711-efca-4ec4-8d15-87436130ead6"><enum>(A)</enum><text display-inline="yes-display-inline">there is no alternative medical isotope
				production target, enriched in the isotope U–235 to less than 20 percent, that
				can be used in that reactor; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id645be367-d42c-40e8-964d-03b33056fd82"><enum>(B)</enum><text display-inline="yes-display-inline">the proposed recipient of the medical
				isotope production target has provided assurances that, whenever an alternative
				medical isotope production target can be used in that reactor, it will use that
				alternative in lieu of highly enriched uranium; and</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5dfcedfd-e06a-4cba-a555-cdd7c02af251"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of Energy has certified that
				the United States Government is actively supporting the development of an
				alternative medical isotope production target that can be used in that
				reactor.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id50ff0f5a-4889-4d90-af0d-ab7ee4cdac78"><enum>b.</enum><text display-inline="yes-display-inline">As used in this section—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id4315f650-8b95-4f8e-bc1c-e5169acea963"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>alternative medical isotope
				production target</quote> means a nuclear reactor target which is enriched to
				less than 20 percent of the isotope U–235;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc539e40c-3cf3-4ac1-8138-aed49f222320"><enum>(2)</enum><text display-inline="yes-display-inline">a target <quote>can be used</quote> in a
				nuclear research or test reactor if—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ida6ec1d78-3704-4907-8ae6-04de9aff02da"><enum>(A)</enum><text display-inline="yes-display-inline">the target has been qualified by the
				Reduced Enrichment Research and Test Reactor Program of the Department of
				Energy; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e08ddad-535f-4aa1-96be-f2cd1e5a955f"><enum>(B)</enum><text display-inline="yes-display-inline">use of the target will permit the large
				majority of ongoing and planned experiments and medical isotope production to
				be conducted in the reactor without a large percentage increase in the total
				cost of operating the reactor;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idddbf73be-4d17-4fef-a53d-b93402293b04"><enum>(3)</enum><text display-inline="yes-display-inline">the term <quote>highly enriched
				uranium</quote> means uranium enriched to 20 percent or more in the isotope
				U–235; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc6604e16-fc1c-4a18-8aa8-bd3b969dd2a4"><enum>(4)</enum><text display-inline="yes-display-inline">the term <quote>medical isotope</quote>
				includes molybdenum-99, iodine-131, xenon-133, and other radioactive materials
				used to produce a radiopharmaceutical for diagnostic or therapeutic procedures
				or for research and
				development.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ide3ce4843-0e2d-44f9-b00e-4bce5604191a"><enum>(b)</enum><header display-inline="yes-display-inline">Table of contents</header><text display-inline="yes-display-inline">The table of contents for the Atomic Energy
			 Act of 1954 is amended by inserting the following new item at the end of the
			 items relating to chapter 10 of title I:</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="id7e09af84-4d54-457c-8a59-4306cebeb35d" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Annual Department reports</header>
			<subsection commented="no" display-inline="no-display-inline" id="id649398B69B6D43A5B1C21840703482C5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, and annually thereafter for 5 years, the Secretary shall
			 report to Congress on Department actions to support the production in the
			 United States, without the use of highly enriched uranium, of molybdenum-99 for
			 medical uses.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id6C7EB9621724411A898805BC5F7117C5"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The reports shall include the
			 following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id4b4412ad-c1d6-4ff8-9491-650a1ca9d26f"><enum>(1)</enum><text display-inline="yes-display-inline">For medical isotope development
			 projects—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id4275a280-eac8-4d84-ad1b-d36d158a113b"><enum>(A)</enum><text display-inline="yes-display-inline">the names of any recipients of Department
			 support under section 3;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide7b8bb24-5891-4269-b863-1639258ca0c2"><enum>(B)</enum><text display-inline="yes-display-inline">the amount of Department funding committed
			 to each project;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6be40fbf-c548-4180-9b50-eb486c5048fb"><enum>(C)</enum><text display-inline="yes-display-inline">the milestones expected to be reached for
			 each project during the year for which support is provided;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66b411a2-a4df-46c1-8905-462c05cf390f"><enum>(D)</enum><text display-inline="yes-display-inline">how each project is expected to support the
			 increased production of molybdenum-99 for medical uses;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0f375e3c-d50a-4b8c-9886-c9317de2fd9c"><enum>(E)</enum><text display-inline="yes-display-inline">the findings of the evaluation of projects
			 under section 3(a)(2); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id170e4608-676b-4923-a51d-0c1bae2d7f45"><enum>(F)</enum><text display-inline="yes-display-inline">the ultimate use of any Department funds
			 used to support projects under section 3.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcadead6e-3d73-4201-b983-8577ba5c90b4"><enum>(2)</enum><text display-inline="yes-display-inline">A description of actions taken in the
			 previous year by the Secretary to ensure the safe disposition of spent nuclear
			 fuel and radioactive waste for which the Department is responsible under
			 section 3(c).</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id6ecacdea-bce0-4354-b6f9-2d6feae2f01e" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">National Academy of Sciences
			 report</header>
			<subsection commented="no" display-inline="no-display-inline" id="id396EB4B3EBB84E8DAE525C65C8ABC151"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall enter into an
			 arrangement with the National Academy of Sciences to conduct a study of the
			 state of molybdenum-99 production and utilization, to be provided to Congress
			 not later than 5 years after the date of enactment of this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id1B07891474E64B9BA424EF3A6A9787AE"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The report shall include the
			 following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id76288c48-dce2-424b-a2d8-e60612e54dc2"><enum>(1)</enum><text display-inline="yes-display-inline">For molybdenum-99 production—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id1cf2157a-cc61-47d5-ab1e-a410ddf9c539"><enum>(A)</enum><text display-inline="yes-display-inline">a list of all facilities in the world
			 producing molybdenum-99 for medical uses, including an indication of whether
			 these facilities use highly enriched uranium in any way;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2fa569d7-1bf2-4b59-a7e1-13a3072f08c1"><enum>(B)</enum><text display-inline="yes-display-inline">a review of international production of
			 molybdenum-99 over the previous 5 years, including—</text>
						<clause commented="no" display-inline="no-display-inline" id="idff203272-0e6d-4b60-957d-919dc1ae21fc"><enum>(i)</enum><text display-inline="yes-display-inline">whether any new production was brought
			 online;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id8ca17f7c-ffe0-43f7-a0e4-8c79d9b36b4a"><enum>(ii)</enum><text display-inline="yes-display-inline">whether any facilities halted production
			 unexpectedly; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id390b384a-06e6-412a-95a7-b6bf5cdbb6e0"><enum>(iii)</enum><text display-inline="yes-display-inline">whether any facilities used for production
			 were decommissioned or otherwise permanently removed from service; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id053052f8-7953-4f05-a5ff-2df5d27c1dc4"><enum>(C)</enum><text display-inline="yes-display-inline">an assessment of progress made in the
			 previous 5 years toward establishing domestic production of molybdenum-99 for
			 medical uses, including the extent to which other medical isotopes that have
			 been produced with molybdenum-99, such as iodine-131 and xenon-133, are being
			 used for medical purposes.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfe6c6d68-8283-40a3-b443-820faa324579"><enum>(2)</enum><text display-inline="yes-display-inline">An assessment of the progress made by the
			 Department and others to eliminate all worldwide use of highly enriched uranium
			 in reactor fuel, reactor targets, and medical isotope production
			 facilities.</text>
				</paragraph></subsection></section><section id="idCE103BF0D9194D9999C59FD1E3FA0603"><enum>9.</enum><header>Repeal</header><text display-inline="no-display-inline">The Nuclear Safety Research, Development,
			 and Demonstration Act of 1980 (42 U.S.C. 9701 et seq.) is repealed.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idcf990327-5dda-4375-a239-1fabadc74251" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the
			 purpose of complying with the Statutory Pay-As-You-Go-Act of 2010, shall be
			 determined by reference to the latest statement titled <quote>Budgetary Effects
			 of PAYGO Legislation</quote> for this Act, submitted for printing in the
			 Congressional Record by the Chairman of the Senate Budget Committee, provided
			 that such statement has been submitted prior to the vote on passage.</text>
