		<official-title>To amend title 9 of the United States Code with respect
		  to arbitration.</official-title>

		<section id="H57D9DA3BB5E74239A0CA326D49FF008B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Arbitration Fairness Act of
			 2011</short-title></quote>.</text>
		</section><section id="HF755B88C0BF9483CB8A9048E714BB080"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="ID60801c3d7bb646838c643cbfeca5a14a"><enum>(1)</enum><text>The Federal
			 Arbitration Act (now enacted as chapter 1 of title 9 of the United States Code)
			 was intended to apply to disputes between commercial entities of generally
			 similar sophistication and bargaining power.</text>
			</paragraph><paragraph id="IDb6c1748ea80e445d9a3440428df32262"><enum>(2)</enum><text>A series of
			 decisions by the Supreme Court of the United States have changed the meaning of
			 the Act so that it now extends to consumer disputes and employment
			 disputes.</text>
			</paragraph><paragraph id="IDc760135a62794f10b0d001eda47262ec"><enum>(3)</enum><text>Most consumers
			 and employees have little or no meaningful choice whether to submit their
			 claims to arbitration. Often, consumers and employees are not even aware that
			 they have given up their rights.</text>
			</paragraph><paragraph id="ID4518514829884a399a12d1971e6ba999"><enum>(4)</enum><text>Mandatory
			 arbitration undermines the development of public law because there is
			 inadequate transparency and inadequate judicial review of arbitrators'
			 decisions.</text>
			</paragraph><paragraph id="ID20aaacf21a2444b88b0041ec288ec4fc"><enum>(5)</enum><text>Arbitration can
			 be an acceptable alternative when consent to the arbitration is truly
			 voluntary, and occurs after the dispute arises.</text>
			</paragraph></section><section id="id14700B75A9774AD09669A77FE023CE2E"><enum>3.</enum><header>Arbitration of
			 employment, consumer, and civil rights disputes</header>
			<subsection id="id9B653957BEBC4BD29D471F899AD58137"><enum>(a)</enum><header>In
			 general</header><text>Title 9 of the United States Code is amended by adding at
			 the end the following:</text>

							<toc-entry idref="idB3C7C5AB27B84693A28E685C7C38E32F" level="section">401. Definitions.</toc-entry>
							<toc-entry idref="HADE8FF1CAFD649F19DFB0976BD64B852" level="section">402. Validity and enforceability.</toc-entry>
						</toc>
						<section id="idB3C7C5AB27B84693A28E685C7C38E32F"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter—</text>
							<paragraph id="id7C18B1F390FE4DEDA230BC8B1D518063"><enum>(1)</enum><text>the term
				<term>civil rights dispute</term> means a dispute—</text>
								<subparagraph id="idC3EBC156ADD84E33877844C8CC725CBB"><enum>(A)</enum><text>arising
				under—</text>
									<clause id="id298949215A0347B384A837347B48EEA1"><enum>(i)</enum><text>the Constitution
				of the United States or the constitution of a State; or</text>
									</clause><clause id="id1F10F8AEF50845EC8DAC0D270A8B04E7"><enum>(ii)</enum><text>a Federal or
				State statute that prohibits discrimination on the basis of race, sex,
				disability, religion, national origin, or any invidious basis in education,
				employment, credit, housing, public accommodations and facilities, voting, or
				program funded or conducted by the Federal Government or State government,
				including any statute enforced by the Civil Rights Division of the Department
				of Justice and any statute enumerated in section 62(e) of the Internal Revenue
				Code of 1986 (relating to unlawful discrimination); and</text>
									</clause></subparagraph><subparagraph id="id85CEDE8FE3344749889CAE86F2783E76"><enum>(B)</enum><text>in which at least
				1 party alleging a violation of the Constitution of the United States, a State
				constitution, or a statute prohibiting discrimination is an individual;</text>
								</subparagraph></paragraph><paragraph id="H38D1EEC818DC4FFAABEBF5F438A81636"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>consumer dispute</term>
				means a dispute between an individual who seeks or acquires real or personal
				property, services (including services relating to securities and other
				investments), money, or credit for personal, family, or household purposes and
				the seller or provider of such property, services, money, or credit;</text>
							</paragraph><paragraph id="H0F217196766B43B300088374ED7B8569"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>employment dispute</term>
				means a dispute between an employer and employee arising out of the
				relationship of employer and employee as defined in section 3 of the Fair Labor
				Standards Act of 1938 (29 U.S.C. 203); and</text>
							</paragraph><paragraph id="HE0464D0B9DA547CE945162C4497D0003"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>predispute arbitration
				agreement</term> means any agreement to arbitrate a dispute that had not yet
				arisen at the time of the making of the agreement.</text>
							</paragraph></section><section id="HADE8FF1CAFD649F19DFB0976BD64B852"><enum>402.</enum><header>Validity and
				enforceability</header>
							<subsection id="HF77063C269894076B0C3BF4F7680B5CD"><enum>(a)</enum><header>In
				general</header><text>Notwithstanding any other provision of this title, no
				predispute arbitration agreement shall be valid or enforceable if it requires
				arbitration of an employment dispute, consumer dispute, or civil rights
				dispute.</text>
							</subsection><subsection id="H6A257A8108CC4F7FABD6F02051FEF3A1"><enum>(b)</enum><header>Applicability</header>
								<paragraph id="id2E7DF65CF4784EFDBB212217A705791E"><enum>(1)</enum><header>In
				general</header><text>An issue as to whether this chapter applies to an
				arbitration agreement shall be determined under Federal law. The applicability
				of this chapter to an agreement to arbitrate and the validity and
				enforceability of an agreement to which this chapter applies shall be
				determined by a court, rather than an arbitrator, irrespective of whether the
				party resisting arbitration challenges the arbitration agreement specifically
				or in conjunction with other terms of the contract containing such
				agreement.</text>
								</paragraph><paragraph id="HC5402C937BA844518DBF6281AEE1A4BA"><enum>(2)</enum><header>Collective
				bargaining agreements</header><text display-inline="yes-display-inline">Nothing
				in this chapter shall apply to any arbitration provision in a contract between
				an employer and a labor organization or between labor organizations, except
				that no such arbitration provision shall have the effect of waiving the right
				of an employee to seek judicial enforcement of a right arising under a
				provision of the Constitution of the United States, a State constitution, or a
				Federal or State statute, or public policy arising
				therefrom.</text>
								</paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H945FB86F339E4187A927AA0066C31808"><enum>(b)</enum><header>Technical and
			 conforming amendments</header>
				<paragraph id="idC400BE5842A54D3DB02B19ED216EB933"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title 9 of the United
			 States Code is amended—</text>
					<subparagraph id="id300B482BBF044E289FE0CC1AB197E0EE"><enum>(A)</enum><text display-inline="yes-display-inline">in section 1, by striking <quote>of
			 seamen,</quote> and all that follows through <quote>interstate
			 commerce</quote>;</text>
					</subparagraph><subparagraph id="idCA9140F874254AC8B71D929253F16302"><enum>(B)</enum><text>in section 2, by
			 inserting <quote>or as otherwise provided in chapter 4</quote> before the
			 period at the end;</text>
					</subparagraph><subparagraph id="id4BB9A7A190B7403B83482D501CEF759F"><enum>(C)</enum><text>in section
			 208—</text>
						<clause id="idB462FBA021904AD68A499399802AB93D"><enum>(i)</enum><text>in
			 the section heading, by striking <quote><header-in-text level="section" style="USC">Chapter 1; residual application</header-in-text></quote> and
			 inserting <quote><header-in-text level="section" style="USC">Application</header-in-text></quote>; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id8E72ACC5DE3F48C7A9F2ECEB7A860B2B"><enum>(ii)</enum><text>by adding at the
			 end the following: <quote>This chapter applies to the extent that this chapter
			 is not in conflict with chapter 4.</quote>; and</text>
						</clause></subparagraph><subparagraph id="idB2E0E663B174449D92F0998B6C6D8CDF"><enum>(D)</enum><text>in section
			 307—</text>

			 Act and shall apply with respect to any dispute or claim that arises on or
			 after such date.</text>
