		<official-title>To amend the Federal Water Pollution Control Act to
		  establish a grant program to support the restoration of San Francisco
		  Bay.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>San Francisco Bay Restoration
			 Act</short-title></quote>.</text>
		</section><section id="idBD13A9E973584D44B57C46ADAE30A106"><enum>2.</enum><header>San Francisco
			 Bay restoration grant program</header><text display-inline="no-display-inline">Title I of the Federal Water Pollution
			 Control Act (33 U.S.C. 1251 et seq.) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id5B81025A3C9E415792BD753139EF0C6D" style="OLC">
				<section id="ID44a2fed422eb43869f886012d25e26b9"><enum>123.</enum><header>San Francisco
				Bay restoration grant program</header>
					<subsection id="ID6780cecf2b674d21b77cdb2088a95e2e"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="ID51e7a22fe4c24a2d85094f6ebbcc2267"><enum>(1)</enum><header>Annual priority
				list</header><text>The term <term>annual priority list</term> means the annual
				priority list compiled under subsection (b).</text>
						</paragraph><paragraph id="ID7f4adb44706f4083a624479f9342fefc"><enum>(2)</enum><header>Comprehensive
				plan</header><text>The term <term>comprehensive plan</term> means—</text>
							<subparagraph id="ID7e6c50ebedf041ba8354a3d0e6a5dbae"><enum>(A)</enum><text>the comprehensive
				conservation and management plan approved under section 320 for the San
				Francisco Bay estuary; and</text>
							</subparagraph><subparagraph id="IDdc40d8d62a7542e5b1f3929be0034264"><enum>(B)</enum><text>any amendments to
				that plan.</text>
							</subparagraph></paragraph><paragraph id="ID63a02c01a4a84f2285be47f88bbea518"><enum>(3)</enum><header>Estuary
				partnership</header><text>The term <term>Estuary Partnership</term> means the
				San Francisco Estuary Partnership, the entity that is designated as the
				management conference under section 320.</text>
						</paragraph></subsection><subsection id="ID947d05ef75b54f708e0fb50730218795"><enum>(b)</enum><header>Annual priority
				list</header>
						<paragraph id="ID7cbe2d5567b84793981de06288400c71"><enum>(1)</enum><header>In
				general</header><text>After providing public notice, the Administrator shall
				annually compile a priority list identifying and prioritizing the activities,
				projects, and studies intended to be funded with the amounts made available
				under subsection (c).</text>
						</paragraph><paragraph id="IDdddc5791eec647a08ce478aed5bee410"><enum>(2)</enum><header>Inclusions</header><text>The
				annual priority list compiled under paragraph (1) shall include—</text>
							<subparagraph id="ID92ca43ffd8434e35925c3b5159db2a71"><enum>(A)</enum><text>activities,
				projects, or studies, including restoration projects and habitat improvement
				for fish, waterfowl, and wildlife, that advance the goals and objectives of the
				approved comprehensive plan;</text>
							</subparagraph><subparagraph id="IDafbc824f4cdb4dac9f16888ee028ac40"><enum>(B)</enum><text>information on
				the activities, projects, programs, or studies specified under subparagraph
				(A), including a description of—</text>
								<clause id="ID25dd7402427c436dab3295811f0eb7a1"><enum>(i)</enum><text>the identities of
				the financial assistance recipients; and</text>
								</clause><clause id="ID5aa43129f60b490e8c00d2d4144c965d"><enum>(ii)</enum><text>the communities
				to be served; and</text>
								</clause></subparagraph><subparagraph id="IDf7b0b11ddb614187ad8017c8c8deb33a"><enum>(C)</enum><text>the criteria and
				methods established by the Administrator for selection of activities, projects,
				and studies.</text>
							</subparagraph></paragraph><paragraph id="IDa2dfd361b9e34fa68a4a449f78bd81d5"><enum>(3)</enum><header>Consultation</header><text>In
				developing the priority list under paragraph (1), the Administrator shall
				consult with and consider the recommendations of—</text>
							<subparagraph id="IDb020536290a9466dad0ae7d89334c86f"><enum>(A)</enum><text>the Estuary
				Partnership;</text>
							</subparagraph><subparagraph id="IDa15cce5e64ad4dc2b5c6ee22984d3694"><enum>(B)</enum><text>the State of
				California and affected local governments in the San Francisco Bay estuary
				watershed; and</text>
							</subparagraph><subparagraph id="IDbf2087dd785d44d4a86fc03b53ad2c5e"><enum>(C)</enum><text>any other
				relevant stakeholder involved with the protection and restoration of the San
				Francisco Bay estuary that the Administrator determines to be
				appropriate.</text>
							</subparagraph></paragraph></subsection><subsection id="IDe61c521296174e50abc39d8c322fac6c"><enum>(c)</enum><header>Grant
				program</header>
						<paragraph id="IDaed4ba45eaa640fdb3ad0b50b0879675"><enum>(1)</enum><header>In
				general</header><text>Pursuant to section 320, the Administrator may provide
				funding through cooperative agreements, grants, or other means to State and
				local agencies, special districts, and public or nonprofit agencies,
				institutions, and organizations, including the Estuary Partnership, for
				activities, studies, or projects identified on the annual priority list.</text>
						</paragraph><paragraph id="ID301b5cfa55054c448da78248ff659054"><enum>(2)</enum><header>Maximum amount
				of grants; non-Federal share</header>
							<subparagraph id="ID0e0494ab9ff04ad9b0cfd5b80b46bd8e"><enum>(A)</enum><header>Maximum amount
				of grants</header><text>Amounts provided to any individual or entity under this
				section for a fiscal year shall not exceed an amount equal to 75 percent of the
				total cost of any eligible activities that are to be carried out using those
				amounts.</text>
							</subparagraph><subparagraph id="ID13786534b1804d1b81473dad5f9ac7d2"><enum>(B)</enum><header>Non-Federal
				share</header><text>The non-Federal share of the total cost of any eligible
				activities that are carried out using amounts provided under this section shall
				be—</text>
								<clause id="id9976A90277F9430CA9809BA3A665365D"><enum>(i)</enum><text>not less than 25
				percent; and</text>
								</clause><clause id="IDc0514db644af44d49b7899f8c6376a44"><enum>(ii)</enum><text>provided from
				non-Federal sources.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="IDe44ee62b79f341acbe300dbae08adda0"><enum>(d)</enum><header>Funding</header>
						<paragraph changed="deleted" id="ID77766e4265dd457cbacd942085cf8a25" reported-display-style="strikethrough"><enum>(1)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to the
				Administrator to carry out this section such sums as are necessary for each of
				fiscal years 2012 through 2021.</text>
						</paragraph><paragraph changed="added" id="id753D297CB9FD41F6BF67E7F38FF192F5" reported-display-style="italic"><enum>(1)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to the
				Administrator to carry out this section $5,000,000 for each of fiscal years
				2012 through 2016.</text>
						</paragraph><paragraph id="idC654E17141A9447C8CE4ADE1BCFFDFEE"><enum>(2)</enum><header>Administrative
				expenses</header><text>Of the amount made available to carry out this section
				for a fiscal year, the Administrator shall use not more than 5 percent to pay
				administrative expenses incurred in carrying out this section.</text>
						</paragraph><paragraph id="IDfc62f96c1e69427f8ac3afb36ea4b9e2"><enum>(3)</enum><header>Relationship to
				other funding</header><text>Nothing in this section limits the eligibility of
				the Estuary Partnership to receive funding under section 320(g).</text>
						</paragraph><paragraph id="IDc39ebf3d1ef04b55b7aa4077dcae148c"><enum>(4)</enum><header>Prohibition</header><text>No
				amounts made available under subsection (c) may be used for the administration
				of a management conference under section
				320.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
