		<section id="S1" section-type="section-one"><enum>1.</enum><header>Criminal infringement of a
			 copyright</header>
			<subsection id="idA5F81A5C1CEC4E5EA87C4E0B0F061B60"><enum>(a)</enum><header>Amendments to
			 section 2319 of title 18</header><text>Section 2319 of title 18, United States
			 Code, is amended—</text>
				<paragraph id="idAEA52BFCC0CA4E57B7ED056AB865DF5C"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="id72690A39AE034E1CBD571A936CE866E1"><enum>(A)</enum><text>by redesignating
			 paragraphs (2) and (3) as paragraphs (3) and (4), respectively; and</text>
					</subparagraph><subparagraph id="idBE359720C5AA45C1A8B6F245B076E619"><enum>(B)</enum><text>by inserting
			 after paragraph (1) the following:</text>
						<quoted-block display-inline="no-display-inline" id="idE318F930CAD5463486CEE82C4CBFB5C9" style="OLC">
							<paragraph id="IDe1a52276719e408fbfe6842ebb52ea63"><enum>(2)</enum><text>shall be
				imprisoned not more than 5 years, fined in the amount set forth in this title,
				or both, if—</text>
								<subparagraph id="id2BCC6B0F39184D80B51FD850AA585DF6"><enum>(A)</enum><text>the offense
				consists of 10 or more public performances by electronic means, during any
				180-day period, of 1 or more copyrighted works; and</text>
								</subparagraph><subparagraph id="id1591226FC7F04690A62CDF3747A6E2AC"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id3EF17214C29E4909A58A791E1ED5FE3D"><enum>(i)</enum><text>the total retail value
				of the performances, or the total economic value of such public performances to
				the infringer or to the copyright owner, would exceed $2,500; or</text>
									</clause><clause id="id50CF321D279D48CB98ADA7F61468F439" indent="up1"><enum>(ii)</enum><text>the total fair market value of
				licenses to offer performances of those works would exceed
				$5,000;</text>
									</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="idB9CDCEF3957B47C98BB7D4E8337B27CA"><enum>(2)</enum><text>in subsection
			 (f), by striking paragraph (2) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id95E3E6E11EC041F39D68B2B45EFB81DD" style="OLC">
						<paragraph id="id8D738CD1D6DC40899EA294CCB479F6A9"><enum>(2)</enum><text>the terms
				<quote>reproduction</quote>, <quote>distribution</quote>, and <quote>public
				performance</quote> refer to the exclusive rights of a copyright owner under
				clauses (1), (3), (4), and (6), respectively of section 106 (relating to
				exclusive rights in copyrighted works), as limited by sections 107 through 122,
				of title
				17;</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id70F48D11FC2F48A08760C314BF63B5D5"><enum>(b)</enum><header>Amendment to
			 section 506 of title 17</header><text>Section 506(a) of title 17, United States
			 Code, is amended—</text>
				<paragraph id="id8FC85E1C641640C3B6F81E62C81E1831"><enum>(1)</enum><text>in paragraph
			 (1)(C), by inserting <quote>or public performance</quote> after
			 <quote>distribution</quote> the first place it appears; and</text>
				</paragraph><paragraph id="id3301D515C71E4F14958214A8A4A911AC"><enum>(2)</enum><text>in paragraph
			 (3)—</text>
					<subparagraph id="idC63243B50274452D94CF198B4B0211E0"><enum>(A)</enum><text>in subparagraph
			 (A), by inserting <quote>or public performance</quote> after
			 <quote>unauthorized distribution</quote>; and</text>
					</subparagraph><subparagraph id="idE06699AB811446FE8628BE893039523F"><enum>(B)</enum><text>in subparagraph
			 (B), by inserting <quote>or public performance</quote> after
			 <quote>distribution</quote>.</text>
