		<section changed="deleted" committee-id="SSJU00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Preventing Real Online Threats to
			 Economic Creativity and Theft of Intellectual Property Act of
			 2011</short-title></quote> or the <quote><short-title>PROTECT IP Act of 2011</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSJU00" id="IDe3c91e3a2d654f8fbadf560ab1fcddc6" reported-display-style="strikethrough"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text>
			<paragraph id="IDf0dc80242aab4edba715bef2f5a08f8a"><enum>(1)</enum><text>the term
			 <term>domain name</term> has the same meaning as in section 45 of the Lanham
			 Act (15 U.S.C. 1127);</text>
			</paragraph><paragraph id="ID3ca99b2f98c44d7f8c4458390a1008a6"><enum>(2)</enum><text>the term
			 <term>domain name system server</term> means a server or other mechanism used
			 to provide the Internet protocol address associated with a domain name;</text>
			</paragraph><paragraph id="ID2fcd43944bcf4527adb615b9efac0269"><enum>(3)</enum><text>the term
			 <term>financial transaction provider</term> has the same meaning as in section
			 5362(4) of title 31, United States Code;</text>
			</paragraph><paragraph id="ID1138fc71a9bc4e7288ffaff2c4db584d"><enum>(4)</enum><text>the term
			 <term>information location tool</term> has the same meaning as described in
			 subsection (d) of section 512 of title 17, United States Code;</text>
			</paragraph><paragraph id="ID64699779cfcc47448ea74ea8c5ba7eac"><enum>(5)</enum><text>the term
			 <term>Internet advertising service</term> means a service that for compensation
			 sells, purchases, brokers, serves, inserts, verifies, or clears the placement
			 of an advertisement, including a paid or sponsored search result, link, or
			 placement that is rendered in viewable form for any period of time on an
			 Internet site;</text>
			</paragraph><paragraph id="IDdb53bbfd87904062a756203db3feb56f"><enum>(6)</enum><text>the term
			 <term>Internet site</term> means the collection of digital assets, including
			 links, indexes, or pointers to digital assets, accessible through the Internet
			 that are addressed relative to a common domain name;</text>
			</paragraph><paragraph id="IDd4bfe5d2ade347eaae3cb20f30c1cfb4"><enum>(7)</enum><text>the term
			 <term>Internet site dedicated to infringing activities</term> means an Internet
			 site that—</text>
				<subparagraph id="ID1c243e466be0410989788eb2075d595c"><enum>(A)</enum><text>has no significant
			 use other than engaging in, enabling, or facilitating the—</text>
					<clause id="ID1e4ad53525614e68a795ff12f9b0c501"><enum>(i)</enum><text>reproduction,
			 distribution, or public performance of copyrighted works, in complete or
			 substantially complete form, in a manner that constitutes copyright
			 infringement under section 501 of title 17, United States Code;</text>
					</clause><clause id="ID2ab54499fe71497287abbe7c58b21141"><enum>(ii)</enum><text>violation of
			 section 1201 of title 17, United States Code; or</text>
					</clause><clause id="ID2c6a2db44126406d99335acbdeac00c1"><enum>(iii)</enum><text>sale,
			 distribution, or promotion of goods, services, or materials bearing a
			 counterfeit mark, as that term is defined in section 34(d) of the Lanham Act;
			 or</text>
					</clause></subparagraph><subparagraph id="IDe32f85957a894bf0a332d20004bcbfe3"><enum>(B)</enum><text>is designed,
			 operated, or marketed by its operator or persons operating in concert with the
			 operator, and facts or circumstances suggest is used, primarily as a means for
			 engaging in, enabling, or facilitating the activities described under clauses
			 (i), (ii), or (iii) of subparagraph (A);</text>
				</subparagraph></paragraph><paragraph id="IDc75a2867b81e4dadb630bb90ad1be013"><enum>(8)</enum><text>the term
			 <term>Lanham Act</term> means the Act entitled <quote>An Act to provide for the
			 registration and protection of trademarks used in commerce, to carry out the
			 provisions of certain international conventions, and for other
			 purposes</quote>, approved July 5, 1946 (commonly referred to as the
			 <quote>Trademark Act of 1946</quote> or the <quote>Lanham Act</quote>);</text>
			</paragraph><paragraph id="ID1bd43ff0d28c4885b835454357cd04be"><enum>(9)</enum><text>the term
			 <term>nondomestic domain name</term> means a domain name for which the domain
			 name registry that issued the domain name and operates the relevant top level
			 domain, and the domain name registrar for the domain name, are not located in
			 the United States;</text>
			</paragraph><paragraph id="ID1abcac1abfd14e889d1e849671bbfd73"><enum>(10)</enum><text>the term
			 <term>owner</term> or <term>operator</term> when used in connection with an
			 Internet site shall include, respectively, any owner of a majority interest in,
			 or any person with authority to operate, such Internet site; and</text>
			</paragraph><paragraph id="ID6f47216683974c8ba6f460d2438fdc8c"><enum>(11)</enum><text>the term
			 <term>qualifying plaintiff</term> means—</text>
				<subparagraph id="IDe97ef4df3a964203a6e4fe0e0f2a25c6"><enum>(A)</enum><text>the Attorney
			 General of the United States; or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd5c24c24050a488ab7c7e7c62ae24df6"><enum>(B)</enum><text>an owner of an
			 intellectual property right, or one authorized to enforce such right, harmed by
			 the activities of an Internet site dedicated to infringing activities occurring
			 on that Internet site.</text>
				</subparagraph></paragraph></section><section changed="deleted" committee-id="SSJU00" id="IDd4a210b016674f77ba2a1aa9494b3d2c" reported-display-style="strikethrough"><enum>3.</enum><header>Enhancing
			 enforcement against rogue websites operated and registered overseas</header>
			<subsection id="ID0af9a126820f4eda9593ac74f59026b7"><enum>(a)</enum><header>Commencement of
			 an action</header>
				<paragraph id="id7A87B64D88C442ADBFA36B477620D78F"><enum>(1)</enum><header>In
			 personam</header><text>The Attorney General may commence an in personam action
			 against—</text>
					<subparagraph id="ID81259d496a2d4517a969df39b21965d7"><enum>(A)</enum><text>a registrant of a
			 nondomestic domain name used by an Internet site dedicated to infringing
			 activities; or</text>
					</subparagraph><subparagraph id="ID27d05855d24c435eb76a98a997a360a0"><enum>(B)</enum><text>an owner or
			 operator of an Internet site dedicated to infringing activities accessed
			 through a nondomestic domain name.</text>
					</subparagraph></paragraph><paragraph id="id8B03A3DC6AD244ACA10AE431C547EA39"><enum>(2)</enum><header>In
			 rem</header><text>If through due diligence the Attorney General is unable to
			 find a person described in subparagraphs (A) or (B) of paragraph (1), or no
			 such person found has an address within a judicial district of the United
			 States, the Attorney General may commence an in rem action against a
			 nondomestic domain name used by an Internet site dedicated to infringing
			 activities.</text>
				</paragraph></subsection><subsection id="ID798cf2685790488b822869970860eb37"><enum>(b)</enum><header>Orders of the
			 court</header>
				<paragraph id="idA593C857042F43E0AF508E64008CE653"><enum>(1)</enum><header>In
			 general</header><text>On application of the Attorney General following the
			 commencement of an action under this section, the court may issue a temporary
			 restraining order, a preliminary injunction, or an injunction, in accordance
			 with rule 65 of the Federal Rules of Civil Procedure, against the nondomestic
			 domain name used by an Internet site dedicated to infringing activities, or
			 against a registrant of such domain name, or the owner or operator of such
			 Internet site dedicated to infringing activities, to cease and desist from
			 undertaking any further activity as an Internet site dedicated to infringing
			 activities, if—</text>
					<subparagraph id="ID9714a92cc55142d9bdad8fff7e87a2f6"><enum>(A)</enum><text>the domain name is
			 used within the United States to access such Internet site; and</text>
					</subparagraph><subparagraph id="ID1aa9ee235c194f5c811d7efef513bd91"><enum>(B)</enum><text>the Internet
			 site—</text>
						<clause id="ID0400c7ecc77d4bb9b415cbac6fab901a"><enum>(i)</enum><text>conducts business
			 directed to residents of the United States; and</text>
						</clause><clause id="ID83461e93bf744cb99a065b0853e97e81"><enum>(ii)</enum><text>harms holders of
			 United States intellectual property rights.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" id="IDf83bac1e894c42faa0ec6ce4b66ec015"><enum>(2)</enum><header>Determination by
			 the court</header><text>For purposes of determining whether an Internet site
			 conducts business directed to residents of the United States under paragraph
			 (1)(B)(i), a court may consider, among other indicia, whether—</text>
					<subparagraph commented="no" id="ID57b2c324a5eb4376814e1c7837f74248"><enum>(A)</enum><text>the Internet site
			 is providing goods or services described in section 2(7) to users located in
			 the United States;</text>
					</subparagraph><subparagraph commented="no" id="ID19961719b96245818cf4f3a6cd13797b"><enum>(B)</enum><text>there is evidence
			 that the Internet site is not intended to provide—</text>
						<clause commented="no" id="ID562999918a6a49b8a3c16d8054630401"><enum>(i)</enum><text>such goods and
			 services to users located in the United States;</text>
						</clause><clause commented="no" id="ID9df469a0db814f3694a79aed25d62f64"><enum>(ii)</enum><text>access to such
			 goods and services to users located in the United States; and</text>
						</clause><clause commented="no" id="ID01dfb88807ea4f7985fa1d6bce9119ce"><enum>(iii)</enum><text>delivery of such
			 goods and services to users located in the United States;</text>
						</clause></subparagraph><subparagraph commented="no" id="IDbeaf80cb73ec44b68a8f771d9ba4a76d"><enum>(C)</enum><text>the Internet site
			 has reasonable measures in place to prevent such goods and services from being
			 accessed from or delivered to the United States;</text>
					</subparagraph><subparagraph commented="no" id="IDc354fb5536cb44ebb137a969ff4612cc"><enum>(D)</enum><text>the Internet site
			 offers services obtained in the United States; and</text>
					</subparagraph><subparagraph commented="no" id="ID1c182cab15014b39a13c84371958e186"><enum>(E)</enum><text>any prices for
			 goods and services are indicated in the currency of the United States.</text>
					</subparagraph></paragraph></subsection><subsection id="IDfc66456226b6424084a4cf8e19b7ba04"><enum>(c)</enum><header>Notice and
			 service of process</header>
				<paragraph id="id748F428CD2DE4C8BA0F7834EE3C2C750"><enum>(1)</enum><header>In
			 general</header><text>Upon commencing an action under this section, the
			 Attorney General shall send a notice of the alleged violation and intent to
			 proceed under this Act to the registrant of the domain name of the Internet
			 site—</text>
					<subparagraph id="ID3e4bd0b126e64520836f8cf172630458"><enum>(A)</enum><text>at the postal and
			 e-mail address appearing in the applicable publicly accessible database of
			 registrations, if any and to the extent such addresses are reasonably
			 available;</text>
					</subparagraph><subparagraph id="ID32a79b1fc3fd4ba390260f679bdcfa11"><enum>(B)</enum><text>via the postal and
			 e-mail address of the registrar, registry, or other domain name registration
			 authority that registered or assigned the domain name, to the extent such
			 addresses are reasonably available; and</text>
					</subparagraph><subparagraph id="ID493bc49faece4a8aa221cffde0341eb5"><enum>(C)</enum><text>in any other such
			 form as the court finds necessary, including as may be required by Rule 4(f) of
			 the Federal Rules of Civil Procedure.</text>
					</subparagraph></paragraph><paragraph id="idF5448182A90A4DCD9375500A9D510503"><enum>(2)</enum><header>Rule of
			 construction</header><text>For purposes of this section, the actions described
			 in this subsection shall constitute service of process.</text>
				</paragraph></subsection><subsection id="ID0e47a161008b4e7c837cf0ec5f197781"><enum>(d)</enum><header>Required actions
			 based on court orders</header>
				<paragraph id="IDbb1e25b27aa6457c9ca78d2badc84d17"><enum>(1)</enum><header>Service</header><text>A
			 Federal law enforcement officer, with the prior approval of the court, may
			 serve a copy of a court order issued pursuant to this section on similarly
			 situated entities within each class described in paragraph (2). Proof of
			 service shall be filed with the court.</text>
				</paragraph><paragraph id="IDecde195fccc2433482c447d20918ec70"><enum>(2)</enum><header>Reasonable
			 measures</header><text>After being served with a copy of an order pursuant to
			 this subsection:</text>
					<subparagraph id="ID7894d97938484bffbfc102c955986b32"><enum>(A)</enum><header>Operators</header>
						<clause id="id806103C90B32466B851FDBC34C020C34"><enum>(i)</enum><header>In
			 general</header><text>An operator of a nonauthoritative domain name system
			 server shall take the least burdensome technically feasible and reasonable
			 measures designed to prevent the domain name described in the order from
			 resolving to that domain name’s Internet protocol address, except that—</text>
							<subclause id="ID92f120166747420fbdeec22dfac19aaa"><enum>(I)</enum><text>such operator
			 shall not be required—</text>
								<item id="IDa83264e5470e4dcaaefc19d19b9f8a12"><enum>(aa)</enum><text>other than as
			 directed under this subparagraph, to modify its network, software, systems, or
			 facilities;</text>
								</item><item id="ID52f15ed243384405a2f3298abc603914"><enum>(bb)</enum><text>to take any
			 measures with respect to domain name lookups not performed by its own domain
			 name server or domain name system servers located outside the United States;
			 or</text>
								</item><item id="ID33cb791ca6884baba0b2bf764293288f"><enum>(cc)</enum><text>to continue to
			 prevent access to a domain name to which access has been effectively disable by
			 other means; and</text>
								</item></subclause><subclause id="IDab4c1e54bde743f1bcff73a2f96a3033"><enum>(II)</enum><text>nothing in this
			 subparagraph shall affect the limitation on the liability of such an operator
			 under section 512 of title 17, United States Code.</text>
							</subclause></clause><clause id="id6318767DB9B34777984C5D3FC91F0D75"><enum>(ii)</enum><header>Text of
			 notice</header><text>The Attorney General shall prescribe the text of the
			 notice displayed to users or customers of an operator taking an action pursuant
			 to this subparagraph. Such text shall specify that the action is being taken
			 pursuant to a court order obtained by the Attorney General.</text>
						</clause></subparagraph><subparagraph id="IDddc80e3a0a694cf38d83dd5d9b56ee68"><enum>(B)</enum><header>Financial
			 transaction providers</header><text>A financial transaction provider shall take
			 reasonable measures, as expeditiously as reasonable, designed to prevent,
			 prohibit, or suspend its service from completing payment transactions involving
			 customers located within the United States and the Internet site associated
			 with the domain name set forth in the order.</text>
					</subparagraph><subparagraph id="ID676c2dc000c449679557814afb26085e"><enum>(C)</enum><header>Internet
			 advertising services</header><text>An Internet advertising service that
			 contracts with the Internet site associated with the domain name set forth in
			 the order to provide advertising to or for that site, or which knowingly serves
			 advertising to or for such site, shall take technically feasible and reasonable
			 measures, as expeditiously as reasonable, designed to—</text>
						<clause id="id71BF5ED74AB345B0973632D30B62A347"><enum>(i)</enum><text>prevent its
			 service from providing advertisements to the Internet site associated with such
			 domain name; or</text>
						</clause><clause id="idB317D4DAEB614C3B8792256B82F84F19"><enum>(ii)</enum><text>cease making
			 available advertisements for that site, or paid or sponsored search results,
			 links or other placements that provide access to the domain name.</text>
						</clause></subparagraph><subparagraph id="IDcd4fcde95fd349a79053b61f5e58072f"><enum>(D)</enum><header>Information
			 location tools</header><text>An information location tool shall take
			 technically feasible and reasonable measures, as expeditiously as possible,
			 to—</text>
						<clause id="id36687C7C157F48CBB581C6983F331BA3"><enum>(i)</enum><text>remove or disable
			 access to the Internet site associated with the domain name set forth in the
			 order; or</text>
						</clause><clause id="id62D80B95297B48A6ABDD3322DC44D097"><enum>(ii)</enum><text>not serve a
			 hypertext link to such Internet site.</text>
						</clause></subparagraph></paragraph><paragraph id="ID14e6a920ea3541f5b3497deb8948e68d"><enum>(3)</enum><header>Communication
			 with users</header><text>Except as provided under paragraph (2)(A)(ii), an
			 entity taking an action described in this subsection shall determine whether
			 and how to communicate such action to the entity's users or customers.</text>
				</paragraph><paragraph id="ID87d3812655fe48f1bee9e60e8760ee80"><enum>(4)</enum><header>Rule of
			 construction</header><text>For purposes of an action commenced under this
			 section, the obligations of an entity described in this subsection shall be
			 limited to the actions set out in each paragraph or subparagraph applicable to
			 such entity, and no order issued pursuant to this section shall impose any
			 additional obligations on, or require additional actions by, such
			 entity.</text>
				</paragraph><paragraph id="ID66db898e91a646e3bf25d23b1e4b99a6"><enum>(5)</enum><header>Actions pursuant
			 to court order</header>
					<subparagraph id="idE677F9E1F00F4F799703B664469FDB43"><enum>(A)</enum><header>Immunity from
			 suit</header><text>No cause of action shall lie in any Federal or State court
			 or administrative agency against any entity receiving a court order issued
			 under this subsection, or against any director, officer, employee, or agent
			 thereof, for any act reasonably designed to comply with this subsection or
			 reasonably arising from such order, other than in an action pursuant to
			 subsection (e).</text>
					</subparagraph><subparagraph id="idAC4233C59BF14D00870548D129C4711F"><enum>(B)</enum><header>Immunity from
			 liability</header><text>Any entity receiving an order under this subsection,
			 and any director, officer, employee, or agent thereof, shall not be liable to
			 any party for any acts reasonably designed to comply with this subsection or
			 reasonably arising from such order, other than in an action pursuant to
			 subsection (e), and any actions taken by customers of such entity to circumvent
			 any restriction on access to the Internet domain instituted pursuant to this
			 subsection or any act, failure, or inability to restrict access to an Internet
			 domain that is the subject of a court order issued pursuant to this subsection
			 despite good faith efforts to do so by such entity shall not be used by any
			 person in any claim or cause of action against such entity, other than in an
			 action pursuant to subsection (e).</text>
					</subparagraph></paragraph></subsection><subsection id="IDb418c27340564ffebd86ee9f006408b8"><enum>(e)</enum><header>Enforcement of
			 orders</header>
				<paragraph id="IDc992b18b8c5a4e939accca38fab8152f"><enum>(1)</enum><header>In
			 general</header><text>In order to compel compliance with this section, the
			 Attorney General may bring an action for injunctive relief against any party
			 receiving a court order issued pursuant to this section that knowingly and
			 willfully fails to comply with such order.</text>
				</paragraph><paragraph id="ID3af8bcec5c534e2d9882811ac03d6a51"><enum>(2)</enum><header>Rule of
			 construction</header><text>The authority granted the Attorney General under
			 paragraph (1) shall be the sole legal remedy for enforcing the obligations
			 under this section of any entity described in subsection (d).</text>
				</paragraph><paragraph id="ID6eecee2d69134a328eaa32464e4b2e4f"><enum>(3)</enum><header>Defense</header><text>A
			 defendant in an action under paragraph (1) may establish an affirmative defense
			 by showing that the defendant does not have the technical means to comply with
			 the subsection without incurring an unreasonable economic burden, or that the
			 order is inconsistent with this Act. This showing shall serve as a defense only
			 to the extent of such inability to comply or to the extent of such
			 inconsistency.</text>
				</paragraph></subsection><subsection id="ID20675a7c12904e4aade3f0254162838e"><enum>(f)</enum><header>Modification or
			 vacation of orders</header>
				<paragraph id="IDc4a426a03422470f97b6c48b0ccaee39"><enum>(1)</enum><header>In
			 general</header><text>At any time after the issuance of an order under
			 subsection (b), a motion to modify, suspend, or vacate the order may be filed
			 by—</text>
					<subparagraph id="IDa093af76ad4446db9ac783d851739623"><enum>(A)</enum><text>any person, or
			 owner or operator of property, bound by the order;</text>
					</subparagraph><subparagraph id="IDffbf235d235e40d4b384b9461132e3c7"><enum>(B)</enum><text>any registrant of
			 the domain name, or the owner or operator of the Internet site subject to the
			 order;</text>
					</subparagraph><subparagraph id="ID4f024ca727fd4c90aeaaf1e5b329c2be"><enum>(C)</enum><text>any domain name
			 registrar or registry that has registered or assigned the domain name of the
			 Internet site subject to the order; or</text>
					</subparagraph><subparagraph id="ID37bd0e3d71f049a9ac7a40adf9b7ae13"><enum>(D)</enum><text>any entity that
			 has received a copy of an order pursuant to subsection (d) requiring such
			 entity to take action prescribed in that subsection.</text>
					</subparagraph></paragraph><paragraph id="IDeda8a4924aa6434788df5493eb81e9d5"><enum>(2)</enum><header>Relief</header><text>Relief
			 under this subsection shall be proper if the court finds that—</text>
					<subparagraph id="IDb93fe3ea4102450eb5310e0bca13750f"><enum>(A)</enum><text>the Internet site
			 associated with the domain name subject to the order is no longer, or never
			 was, an Internet site dedicated to infringing activities; or</text>
					</subparagraph><subparagraph id="IDd6cfe64e698b4898b5db6de5c221a146"><enum>(B)</enum><text>the interests of
			 justice require that the order be modified, suspended, or vacated.</text>
					</subparagraph></paragraph><paragraph id="ID5d4b9d49210c49178c31d390fccc37f5"><enum>(3)</enum><header>Consideration</header><text>In
			 making a relief determination under paragraph (2), a court may consider whether
			 the domain name has expired or has been re-registered by a different
			 party.</text>
				</paragraph></subsection><subsection id="IDf437d986b9bb4272b0f7dc1e4f911059"><enum>(g)</enum><header>Related
			 actions</header><text>The Attorney General, if alleging that an Internet site
			 previously adjudicated to be an Internet site dedicated to infringing
			 activities is accessible or has been reconstituted at a different domain name,
			 may commence a related action under this section against the additional domain
			 name in the same judicial district as the previous action.</text>
			</subsection></section><section changed="deleted" committee-id="SSJU00" id="ID0fa0c9998eea43b5a7946b32bc5473ee" reported-display-style="strikethrough"><enum>4.</enum><header>Eliminating the
			 financial incentive to steal intellectual property online</header>
			<subsection id="ID0045d4ff423d4ea5908a0c1b80d8bb52"><enum>(a)</enum><header>Commencement of
			 an action</header>
				<paragraph id="idE7ECB6CA3FE74DB28C1592C5118F01C3"><enum>(1)</enum><header>In
			 personam</header><text>A qualifying plaintiff may commence an in personam
			 action against—</text>
					<subparagraph id="ID7833b26c0eb84448b34b07bc7e56557c"><enum>(A)</enum><text>a registrant of a
			 domain name used by an Internet site dedicated to infringing activities;
			 or</text>
					</subparagraph><subparagraph id="ID331b2b37590042cd9c553c58d2cee438"><enum>(B)</enum><text>an owner or
			 operator of an Internet site dedicated to infringing activities accessed
			 through a domain name.</text>
					</subparagraph></paragraph><paragraph id="id067A142C8939415A823BBBADA209F786"><enum>(2)</enum><header>In
			 rem</header><text>If through due diligence a qualifying plaintiff is unable to
			 find a person described in subparagraphs (A) or (B) of paragraph (1), or no
			 such person found has an address within a judicial district of the United
			 States, the Attorney General may commence an in rem action against a domain
			 name used by an Internet site dedicated to infringing activities.</text>
				</paragraph></subsection><subsection id="IDf7d6029186be4b4fb1b3a66c36783cee"><enum>(b)</enum><header>Orders of the
			 court</header>
				<paragraph id="id9E1156BC2D96495D9E6035F7DFE955D7"><enum>(1)</enum><header>In
			 general</header><text>On application of a qualifying plaintiff following the
			 commencement of an action under this section, the court may issue a temporary
			 restraining order, a preliminary injunction, or an injunction, in accordance
			 with rule 65 of the Federal Rules of Civil Procedure, against the domain name
			 used by an Internet site dedicated to infringing activities, or against a
			 registrant of such domain name, or the owner or operator of such Internet site
			 dedicated to infringing activities, to cease and desist from undertaking any
			 further activity as an Internet site dedicated to infringing activities,
			 if—</text>
					<subparagraph id="IDfc43e970716e44c3ae9f919b1fbd61b3"><enum>(A)</enum><text>the domain name is
			 registered or assigned by a domain name registrar or domain name registry that
			 located or doing business in the United States; or</text>
					</subparagraph><subparagraph id="ID840797e89a224b6ba99ea44591d24779"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id6DE0E31A9682407CB5C2AEF525CAC005"><enum>(i)</enum><text>the domain name is used
			 within the United States to access such Internet site; and</text>
						</clause><clause changed="deleted" committee-id="SSJU00" id="IDf9ec7c2cd1a34bf8ae65b6ce3d2fd84a" indent="up1" reported-display-style="strikethrough"><enum>(ii)</enum><text>the Internet
			 site—</text>
							<subclause id="IDa8b873862b6d4ac09c21e991a0279557"><enum>(I)</enum><text>conducts business
			 directed to residents of the United States; and</text>
							</subclause><subclause id="ID947b9f27b160451d92f1273f25a343ec"><enum>(II)</enum><text>harms holders of
			 United States intellectual property rights.</text>
							</subclause></clause></subparagraph></paragraph><paragraph commented="no" id="ID96b7931d396444e98832e8eef959b28a"><enum>(2)</enum><header>Determination by
			 the court</header><text>For purposes of determining whether an Internet site
			 conducts business directed to residents of the United States under paragraph
			 (1)(B)(ii)(I), a court may consider, among other indicia, whether—</text>
					<subparagraph commented="no" id="IDd94ec4d988214932ba3e475ef1b12ddc"><enum>(A)</enum><text>the Internet site
			 is providing goods or services described in section 2(7) to users located in
			 the United States;</text>
					</subparagraph><subparagraph commented="no" id="ID75b7b04156194b6198154ce485c3cb65"><enum>(B)</enum><text>there is evidence
			 that the Internet site is not intended to provide—</text>
						<clause commented="no" id="IDe0353e7d86984c55a595d9fa37d5deed"><enum>(i)</enum><text>such goods and
			 services to users located in the United States;</text>
						</clause><clause commented="no" id="ID9cb6927317314617bf2a47cab850f0c5"><enum>(ii)</enum><text>access to such
			 goods and services to users located in the United States; and</text>
						</clause><clause commented="no" id="ID871905ad45e34b4a9ea1110775b8ed2b"><enum>(iii)</enum><text>delivery of such
			 goods and services to users located in the United States;</text>
						</clause></subparagraph><subparagraph commented="no" id="ID78c7584b4d8d4feb8626a778ff1253e3"><enum>(C)</enum><text>the Internet site
			 has reasonable measures in place to prevent such goods and services from being
			 accessed from or delivered to the United States;</text>
					</subparagraph><subparagraph commented="no" id="IDcbf42b50afba41129bb76892bd9d30f0"><enum>(D)</enum><text>the Internet site
			 offers services obtained in the United States; and</text>
					</subparagraph><subparagraph commented="no" id="ID332a897c05c3461f8fc71d80645178f9"><enum>(E)</enum><text>any prices for
			 goods and services are indicated in the currency of the United States.</text>
					</subparagraph></paragraph></subsection><subsection id="ID299f8dfd6e204f68ae19431a2c6d18bd"><enum>(c)</enum><header>Notice and
			 service of process</header>
				<paragraph id="idCFB5CECE3D8E49118EB4C52A5EBAD639"><enum>(1)</enum><header>In
			 general</header><text>Upon commencing an action under this section, the
			 qualifying plaintiff shall send a notice of the alleged violation and intent to
			 proceed under this Act to the registrant of the domain name of the Internet
			 site—</text>
					<subparagraph id="ID9b99a391904944f59505111285d05cf1"><enum>(A)</enum><text>at the postal and
			 e-mail address appearing in the applicable publicly accessible database of
			 registrations, if any and to the extent such addresses are reasonably
			 available;</text>
					</subparagraph><subparagraph id="ID22eb4451c0af4bd7a088eed1d2c7aace"><enum>(B)</enum><text>via the postal and
			 e-mail address of the registrar, registry, or other domain name registration
			 authority that registered or assigned the domain name, to the extent such
			 addresses are reasonably available; and</text>
					</subparagraph><subparagraph id="IDe7e1a1d3b9ff42bc95ec5116d3872612"><enum>(C)</enum><text>in any other such
			 form as the court finds necessary, including as may be required by Rule 4(f) of
			 the Federal Rules of Civil Procedure.</text>
					</subparagraph></paragraph><paragraph id="id720F45DDAA7846EC8CDC41A7B16ED9EA"><enum>(2)</enum><header>Rule of
			 construction</header><text>For purposes of this section, the actions described
			 in this subsection shall constitute service of process.</text>
				</paragraph></subsection><subsection id="ID526ee3b55fd2452290d54f5c79a2dc7d"><enum>(d)</enum><header>Required actions
			 based on court orders</header>
				<paragraph id="IDc5a85320a9b54c03af3dd83bf53cde11"><enum>(1)</enum><header>Service</header><text>A
			 qualifying plaintiff, with the prior approval of the court, may, serve a copy
			 of a court order issued pursuant to this section on similarly situated entities
			 within each class described in paragraph (2). Proof of service shall be filed
			 with the court.</text>
				</paragraph><paragraph id="IDa059f60e54b7454da65803049cddc259"><enum>(2)</enum><header>Reasonable
			 measures</header><text>After being served with a copy of an order pursuant to
			 this subsection:</text>
					<subparagraph id="IDa6db36cfb9ed45b4bf2c89b4b802600a"><enum>(A)</enum><header>Financial
			 transaction providers</header><text>A financial transaction provider shall take
			 reasonable measures, as expeditiously as reasonable, designed to prevent,
			 prohibit, or suspend its service from completing payment transactions involving
			 customers located within the United States and the Internet site associated
			 with the domain name set forth in the order.</text>
					</subparagraph><subparagraph id="ID3201017a103f46ee82161825688d31e2"><enum>(B)</enum><header>Internet
			 advertising services</header><text>An Internet advertising service that
			 contracts with the Internet site associated with the domain name set forth in
			 the order to provide advertising to or for that site, or which knowingly serves
			 advertising to or for such site, shall take technically feasible and reasonable
			 measures, as expeditiously as reasonable, designed to—</text>
						<clause id="idD5FAEE1834D74943A8A078D0EF805DBE"><enum>(i)</enum><text>prevent its
			 service from providing advertisements to the Internet site associated with such
			 domain name; or</text>
						</clause><clause id="id3A8C1C7D9E744B908A5E985A0D1F3167"><enum>(ii)</enum><text>cease making
			 available advertisements for that site, or paid or sponsored search results,
			 links, or placements that provide access to the domain name.</text>
						</clause></subparagraph></paragraph><paragraph id="IDea15dce08c8c463ab652db818ae3a1d6"><enum>(3)</enum><header>Communication
			 with users</header><text>An entity taking an action described in this
			 subsection shall determine how to communicate such action to the entity's users
			 or customers.</text>
				</paragraph><paragraph id="IDdfaf490f8b964c2baeacaf90646a7a74"><enum>(4)</enum><header>Rule of
			 construction</header><text>For purposes of an action commenced under this
			 section, the obligations of an entity described in this subsection shall be
			 limited to the actions set out in each paragraph or subparagraph applicable to
			 such entity, and no order issued pursuant to this section shall impose any
			 additional obligations on, or require additional actions by, such
			 entity.</text>
				</paragraph><paragraph id="ID8ba15efc182a491eac4d16823f3aea3d"><enum>(5)</enum><header>Actions pursuant
			 to court order</header>
					<subparagraph id="idD1BA41D5D3AD472AA6F3D8617034CCF6"><enum>(A)</enum><header>Immunity from
			 suit</header><text>No cause of action shall lie in any Federal or State court
			 or administrative agency against any entity receiving a court order issued
			 under this subsection, or against any director, officer, employee, or agent
			 thereof, for any act reasonably designed to comply with this subsection or
			 reasonably arising from such order, other than in an action pursuant to
			 subsection (e).</text>
					</subparagraph><subparagraph id="idE36B3EE73BDC4449A6169F785031C309"><enum>(B)</enum><header>Immunity from
			 liability</header><text>Any entity receiving an order under this subsection,
			 and any director, officer, employee, or agent thereof, shall not be liable to
			 any party for any acts reasonably designed to comply with this subsection or
			 reasonably arising from such order, other than in an action pursuant to
			 subsection (e), and any actions taken by customers of such entity to circumvent
			 any restriction on access to the Internet domain instituted pursuant to this
			 subsection or any act, failure, or inability to restrict access to an Internet
			 domain that is the subject of a court order issued pursuant to this subsection
			 despite good faith efforts to do so by such entity shall not be used by any
			 person in any claim or cause of action against such entity, other than in an
			 action pursuant to subsection (e).</text>
					</subparagraph></paragraph></subsection><subsection id="ID00ba6a6a469f4e14b23646078a43b3d0"><enum>(e)</enum><header>Enforcement of
			 orders</header>
				<paragraph id="ID38ece15f74e349d1b55a1a998b5e842f"><enum>(1)</enum><header>In
			 general</header><text>In order to compel compliance with this section, the
			 qualifying plaintiff may bring an action for injunctive relief against any
			 party receiving a court order issued pursuant to this section that knowingly
			 and willfully fails to comply with such order.</text>
				</paragraph><paragraph id="ID0d137a6343564ed6bde21ad701ce44c7"><enum>(2)</enum><header>Rule of
			 construction</header><text>The authority granted a qualifying plaintiff under
			 paragraph (1) shall be the sole legal remedy for enforcing the obligations
			 under this section of any entity described in subsection (d).</text>
				</paragraph><paragraph id="ID750546b3e9b3404eaf6b25111f84841f"><enum>(3)</enum><header>Defense</header><text>A
			 defendant in an action commenced under paragraph (1) may establish an
			 affirmative defense by showing that the defendant does not have the technical
			 means to comply with the subsection without incurring an unreasonable economic
			 burden, or that the order is inconsistent with this Act. This showing shall
			 serve as a defense only to the extent of such inability to comply or to the
			 extent of such inconsistency.</text>
				</paragraph></subsection><subsection id="IDc2994968c55a4ed4bd44e194b7ae0b40"><enum>(f)</enum><header>Modification or
			 vacation of orders</header>
				<paragraph id="id88C8001103744002A26EE565BACEB9A0"><enum>(1)</enum><header>In
			 general</header><text>At any time after the issuance of an order under
			 subsection (b), a motion to modify, suspend, or vacate the order may be filed
			 by—</text>
					<subparagraph id="IDefd3899ef70a424da267936f21bf35ed"><enum>(A)</enum><text>any person, or
			 owner or operator of property, bound by the order;</text>
					</subparagraph><subparagraph id="ID5ff06b9ec64b413ab2e49f31941e3e1e"><enum>(B)</enum><text>any registrant of
			 the domain name, or the owner or operator of the Internet site subject to the
			 order;</text>
					</subparagraph><subparagraph id="IDee00df7e095a466799885f4f70f4c76f"><enum>(C)</enum><text>any domain name
			 registrar or registry that has registered or assigned the domain name of the
			 Internet site subject to the order; or</text>
					</subparagraph><subparagraph id="ID41d82d3ae4504e35a536fe9cabd4d7e0"><enum>(D)</enum><text>any entity that
			 has received a copy of an order pursuant to subsection (d) requiring such
			 entity to take action prescribed in that subsection.</text>
					</subparagraph></paragraph><paragraph id="IDc2eb4636f0754e3fb5ad5a1d96457dae"><enum>(2)</enum><header>Relief</header><text>Relief
			 under this subsection shall be proper if the court finds that—</text>
					<subparagraph id="ID283caeb5dbb44c2bb68c86b2ff52f2c1"><enum>(A)</enum><text>the Internet site
			 associated with the domain name subject to the order is no longer, or never
			 was, dedicated to infringing activities as defined in this Act; or</text>
					</subparagraph><subparagraph id="ID83c16f63d7b74f1394f0e51660725319"><enum>(B)</enum><text>the interests of
			 justice require that the order be modified, suspended, or vacated.</text>
					</subparagraph></paragraph><paragraph id="ID69b55eb4075a4314b2eb6ac0f8eb6be6"><enum>(3)</enum><header>Consideration</header><text>In
			 making a relief determination under paragraph (2), a court may consider whether
			 the domain name has expired or has been re-registered by a different
			 party.</text>
				</paragraph></subsection><subsection id="ID9cc67cc403794089817a03e4ea64d12f"><enum>(g)</enum><header>Related
			 actions</header><text>A qualifying plaintiff, if alleging that an Internet site
			 previously adjudicated to be an Internet site dedicated to infringing
			 activities is accessible or has been reconstituted at a different domain name,
			 may commence a related action under this section against the additional domain
			 name in the same judicial district as the previous action.</text>
			</subsection></section><section changed="deleted" committee-id="SSJU00" id="IDd06ad1e1e3ca4be398e45198c33096fe" reported-display-style="strikethrough"><enum>5.</enum><header>Voluntary action
			 against websites stealing American intellectual property</header>
			<subsection id="ID23a8df6ab94644ed9b7eff56f6b2b140"><enum>(a)</enum><header>In
			 general</header><text>No financial transaction provider or Internet advertising
			 service shall be liable for damages to any person for voluntarily taking any
			 action described in section 3(d) or 4(d) with regard to an Internet site if the
			 entity acting in good faith and based on credible evidence has a reasonable
			 belief that the Internet site is an Internet site dedicated to infringing
			 activities.</text>
			</subsection><subsection id="ID831b1c5da0524376bd9c2faea531e6bc"><enum>(b)</enum><header>Internet sites
			 engaged in infringing activities that endanger the public health</header>
				<paragraph id="ID3fcbb2c5e13847c787e3d76a4e571f62"><enum>(1)</enum><header>Refusal of
			 service</header><text>A domain name registry, domain name registrar, financial
			 transaction provider, information location tool, or Internet advertising
			 service, acting in good faith and based on credible evidence, may stop
			 providing or refuse to provide services to an infringing Internet site that
			 endangers the public health.</text>
				</paragraph><paragraph id="IDd3b2dc9373f0413cb1af94f306a6fd2a"><enum>(2)</enum><header>Immunity from
			 liability</header><text>An entity described in paragraph (1), including its
			 directors, officers, employees, or agents, that ceases or refused to provide
			 services under paragraph (1) shall not be liable to any party under any Federal
			 or State law for such action.</text>
				</paragraph><paragraph id="IDa2e786b2e59a42f3a431bddb4dd61809"><enum>(3)</enum><header>Definitions</header><text>For
			 purposes of this subsection—</text>
					<subparagraph id="ID0809a0312c464223a4cf3c9f162a9eca"><enum>(A)</enum><text>the term
			 <term>adulterated</term> has the same meaning as in section 501 of the Federal
			 Food, Drug, and Cosmetic Act (21 U.S.C. 351);</text>
					</subparagraph><subparagraph id="ID8d7ddd82377e47d8a9bbd5e9c711e470"><enum>(B)</enum><text>an
			 <term>infringing Internet site that endangers the public health</term>
			 means—</text>
						<clause id="IDcd7bffbec2524917af452f4a0328e064"><enum>(i)</enum><text>an Internet site
			 dedicated to infringing activities for which the counterfeit products that it
			 offers, sells, dispenses, or distributes are controlled or non-controlled
			 prescription medication; or</text>
						</clause><clause id="IDab5c58c8b19b468da4e92bbb1cd2e1ec"><enum>(ii)</enum><text>an Internet site
			 that has no significant use other than, or is designed, operated, or marketed
			 by its operator or persons operating in concert with the operator, and facts or
			 circumstances suggest is used, primarily as a means for—</text>
							<subclause id="IDe4303e94a2b344be87d7a332d4519a72"><enum>(I)</enum><text>offering, selling,
			 dispensing, or distributing any controlled or non-controlled prescription
			 medication, and does so regularly without a valid prescription; or</text>
							</subclause><subclause id="ID0091782485a0481aa2c857ad8cd3c987"><enum>(II)</enum><text>offering,
			 selling, dispensing, or distributing any controlled or non-controlled
			 prescription medication, and does so regularly for medication that is
			 adulterated or misbranded;</text>
							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd2222669b1ae4ec9a70be6eca5f86915"><enum>(C)</enum><text>the term
			 <term>misbranded</term> has the same meaning as in section 502 of the Federal
			 Food, Drug, and Cosmetic Act (21 U.S.C. 352); and</text>
					</subparagraph><subparagraph id="IDdb5cadd62534492babefc38df36003a8"><enum>(D)</enum><text>the term
			 <term>valid prescription</term> has the same meaning as in section 309(e)(2)(A)
			 of the Controlled Substances Act (21 U.S.C. 829(e)(2)(A)).</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSJU00" id="ID5c5862118a8d4394abb7e0b6c1682b86" reported-display-style="strikethrough"><enum>6.</enum><header>Savings
			 clauses</header>
			<subsection id="ID15f35f2d11f04c319f85e13552cc09be"><enum>(a)</enum><header>Rule of
			 construction relating to civil and criminal remedies</header><text>Nothing in
			 this Act shall be construed to limit or expand civil or criminal remedies
			 available to any person (including the United States) for infringing activities
			 on the Internet pursuant to any other Federal or State law.</text>
			</subsection><subsection id="IDf679bb83d09e4b77a53b693f1ba66a90"><enum>(b)</enum><header>Rule of
			 construction relating to vicarious or contributory
			 liability</header><text>Nothing in this Act shall be construed to enlarge or
			 diminish vicarious or contributory liability for any cause of action available
			 under title 17, United States Code, including any limitations on liability
			 under section 512 of such title 17, or to create an obligation to take action
			 pursuant to section 5 of this Act.</text>
			</subsection><subsection id="ID72da0029a057456c8f5f3293542c0245"><enum>(c)</enum><header>Relationship
			 with section 512 of title 17</header><text>Nothing in this Act, and no order
			 issued or served pursuant to sections 3 or 4 of this Act, shall serve as a
			 basis for determining the application of section 512 of title 17, United States
			 Code.</text>
			</subsection></section><section changed="deleted" committee-id="SSJU00" id="ID5f72fbc93d1e439187d4a7882b804ce2" reported-display-style="strikethrough"><enum>7.</enum><header>Guidelines and
			 studies</header>
			<subsection id="ID65272eed7ba64d80a4ddb69f7b4d6ecf"><enum>(a)</enum><header>Guidelines</header><text>The
			 Attorney General shall—</text>
				<paragraph id="IDedb0f99893a14beda15a779b3ab23429"><enum>(1)</enum><text>publish procedures
			 developed in consultation with other relevant law enforcement agencies,
			 including the United States Immigration and Customs Enforcement, to receive
			 information from the public about Internet sites dedicated to infringing
			 activities;</text>
				</paragraph><paragraph id="IDf2ad77760833421bb8e4a6f16f8cd6cb"><enum>(2)</enum><text>provide guidance
			 to intellectual property rights holders about what information such rights
			 holders should provide law enforcement agencies to initiate an investigation
			 pursuant to this Act;</text>
				</paragraph><paragraph id="ID31a4d72bccdc4f2c96abf8aadadfa713"><enum>(3)</enum><text>provide guidance
			 to intellectual property rights holders about how to supplement an ongoing
			 investigation initiated pursuant to this Act;</text>
				</paragraph><paragraph id="ID64adf8d467a048029fb2f631e3b257ec"><enum>(4)</enum><text>establish
			 standards for prioritization of actions brought under this Act;</text>
				</paragraph><paragraph id="ID2e94fbe4fa874685896dcd215b10ad92"><enum>(5)</enum><text>provide
			 appropriate resources and procedures for case management and development to
			 affect timely disposition of actions brought under this Act; and</text>
				</paragraph><paragraph id="IDf30ca2c6a77f43f1a12fe38889771a07"><enum>(6)</enum><text>develop a
			 deconfliction process in consultation with other law enforcement agencies,
			 including the United States Immigration and Customs Enforcement, to coordinate
			 enforcement activities brought under this Act.</text>
				</paragraph></subsection><subsection id="ID27cd7193f2df46078368a4a5784d9db8"><enum>(b)</enum><header>Reports</header>
				<paragraph id="IDde5b1c27692f49e9a87a10614b71a6f0"><enum>(1)</enum><header>Report on
			 effectiveness of certain measures</header><text>Not later than 1 year after the
			 date of enactment of this Act, the Secretary of Commerce, in coordination with
			 the Attorney General, the Secretary of Homeland Security, and the Intellectual
			 Property Enforcement Coordinator, shall conduct a study and report to the
			 Committee on the Judiciary of the Senate and the Committee on the Judiciary of
			 the House of Representatives on the following:</text>
					<subparagraph id="ID0c610fbd5a4a47d5a617c91df2403d1a"><enum>(A)</enum><text>An assessment of
			 the effects, if any, of the implementation of section 3(d)(2)(A) on the
			 accessibility of Internet sites dedicated to infringing activity.</text>
					</subparagraph><subparagraph id="IDb08efc62d708420da6d27d1b798971c6"><enum>(B)</enum><text>An assessment of
			 the effects, if any, of the implementation of section 3(d)(2)(A) on the
			 deployment, security, and reliability of the domain name system and associated
			 Internet processes, including Domain Name System Security Extensions.</text>
					</subparagraph><subparagraph id="ID17d2cd3fcb394ab18e6c030df1378032"><enum>(C)</enum><text>Recommendations,
			 if any, for modifying or amending this Act to increase effectiveness or
			 ameliorate any unintended effects of section 3(d)(2)(A).</text>
					</subparagraph></paragraph><paragraph id="IDf37873c699df46f084c122da20c7fd32"><enum>(2)</enum><header>Report on
			 overall effectiveness</header><text>The Register of Copyrights shall, in
			 consultation with the appropriate departments and agencies of the United States
			 and other stakeholders—</text>
					<subparagraph id="ID6a1b3fb8dbbe4112bba9c04939488091"><enum>(A)</enum><text>conduct a study
			 on—</text>
						<clause id="idE4B73AC796404C979F6D573E8E5DF557"><enum>(i)</enum><text>the enforcement
			 and effectiveness of this Act; and</text>
						</clause><clause id="id93BD44DE96B54D8F8F99487B87D0CF36"><enum>(ii)</enum><text>the need to
			 modify or amend this Act to apply to emerging technologies; and</text>
						</clause></subparagraph><subparagraph id="ID6417c1eaeb55435a9d165c83a80dcc8c"><enum>(B)</enum><text>not later than 2
			 years after the date of enactment of this Act, submit a report to the Committee
			 on the Judiciary of the Senate and the Committee on the Judiciary of the House
			 of Representatives on—</text>
						<clause id="id690F7B8C1DCB4C79B061BA4F8AFFBBB8"><enum>(i)</enum><text>the results of the
			 study conducted under subparagraph (A); and</text>
						</clause><clause id="id440B816A5FE544C996ADB65240100E89"><enum>(ii)</enum><text>any
			 recommendations that the Register may have as a result of the study.</text>
						</clause></subparagraph></paragraph></subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSJU00" id="ide5c076d2-b600-41fd-a65a-58aebfc23b33" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Preventing Real Online Threats to
			 Economic Creativity and Theft of Intellectual Property Act of
			 2011</short-title></quote> or the <quote><short-title>PROTECT IP Act of 2011</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSJU00" id="id9f440618-70a6-40b3-b788-c6d03d21bd59" reported-display-style="italic"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text>
			<paragraph id="ide11cf5eb-cd1c-4e8d-9002-d917ef2405ea"><enum>(1)</enum><text>the term <term>domain
			 name</term> has the same meaning as in section 45 of the Lanham Act (15 U.S.C.
			 1127);</text>
			</paragraph><paragraph id="idbdc5e557-82b9-403d-b521-a1ecaea12e73"><enum>(2)</enum><text>the term <term>domain
			 name system server</term> means a server or other mechanism used to provide the
			 Internet protocol address associated with a domain name;</text>
			</paragraph><paragraph id="idefd4d986-eb78-4346-9c43-ab787e6a97fd"><enum>(3)</enum><text>the term <term>financial
			 transaction provider</term> has the same meaning as in section 5362(4) of title
			 31, United States Code;</text>
			</paragraph><paragraph id="ida867b411-1f41-4917-bae8-9e1f54237605"><enum>(4)</enum><text>the term
			 <term>information location tool</term> has the same meaning as described in
			 subsection (d) of section 512 of title 17, United States Code;</text>
			</paragraph><paragraph id="idae3d5904-a5de-4e6d-abd8-c999a328967c"><enum>(5)</enum><text>the term <term>Internet
			 advertising service</term> means a service that for compensation sells,
			 purchases, brokers, serves, inserts, verifies, or clears the placement of an
			 advertisement, including a paid or sponsored search result, link, or placement
			 that is rendered in viewable form for any period of time on an Internet
			 site;</text>
			</paragraph><paragraph id="idaf781493-7475-4b81-89d5-aeaa91a33bf2"><enum>(6)</enum><text>the term <term>Internet
			 site</term> means the collection of digital assets, including links, indexes,
			 or pointers to digital assets, accessible through the Internet that are
			 addressed relative to a common domain name;</text>
			</paragraph><paragraph id="id70aabade-1c5a-4fe5-94a2-0c914e6ae929"><enum>(7)</enum><text>the term <term>Internet
			 site dedicated to infringing activities</term> means an Internet site
			 that—</text>
				<subparagraph id="idcb894e78-7fdf-4055-b5fa-8a9a1189e739"><enum>(A)</enum><text>has no significant use
			 other than engaging in, enabling, or facilitating the—</text>
					<clause id="idb7608615-4e4d-4d8f-a91a-a06f2670206b"><enum>(i)</enum><text>reproduction,
			 distribution, or public performance of copyrighted works, in complete or
			 substantially complete form, in a manner that constitutes copyright
			 infringement under section 501 of title 17, United States Code;</text>
					</clause><clause id="id24406035-a80f-4a78-baa1-d9968db355b8"><enum>(ii)</enum><text>violation of section
			 1201 of title 17, United States Code; or</text>
					</clause><clause id="id267acf08-559f-4390-b706-ce26466f12ae"><enum>(iii)</enum><text>sale, distribution, or
			 promotion of goods, services, or materials bearing a counterfeit mark, as that
			 term is defined in section 34(d) of the Lanham Act; or</text>
					</clause></subparagraph><subparagraph id="id450a687c-5970-4a13-be6f-93748c717a6a"><enum>(B)</enum><text>is designed, operated, or
			 marketed by its operator or persons operating in concert with the operator, and
			 facts or circumstances suggest is used, primarily as a means for engaging in,
			 enabling, or facilitating the activities described under clauses (i), (ii), or
			 (iii) of subparagraph (A);</text>
				</subparagraph></paragraph><paragraph id="id78d2a08f-a49b-4eea-8a03-b322baa9da06"><enum>(8)</enum><text>the term <term>Lanham
			 Act</term> means the Act entitled <quote>An Act to provide for the registration
			 and protection of trademarks used in commerce, to carry out the provisions of
			 certain international conventions, and for other purposes</quote>, approved
			 July 5, 1946 (commonly referred to as the <quote>Trademark Act of 1946</quote>
			 or the <quote>Lanham Act</quote>);</text>
			</paragraph><paragraph id="id846bb7fc-06c7-48f3-8c96-66467061f06a"><enum>(9)</enum><text>the term
			 <term>nondomestic domain name</term> means a domain name for which the domain
			 name registry that issued the domain name and operates the relevant top level
			 domain, and the domain name registrar for the domain name, are not located in
			 the United States;</text>
			</paragraph><paragraph id="iddb7d63eb-9bce-49c4-bc0c-208c5e4c1961"><enum>(10)</enum><text>the term
			 <term>owner</term> or <term>operator</term> when used in connection with an
			 Internet site shall include, respectively, any owner of a majority interest in,
			 or any person with authority to operate, such Internet site; and</text>
			</paragraph><paragraph id="id9f8a30d0-5588-448d-8b93-1b7f8fc08a70"><enum>(11)</enum><text>the term
			 <term>qualifying plaintiff</term> means—</text>
				<subparagraph id="id26eb450a-a07c-46ed-9dc6-b7a2f76d68bb"><enum>(A)</enum><text>the Attorney General of
			 the United States; or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2b4daeb3-677f-4646-b4d9-ade58faa434a"><enum>(B)</enum><text>an owner of an
			 intellectual property right, or one authorized to enforce such right, harmed by
			 the activities of an Internet site dedicated to infringing activities occurring
			 on that Internet site.</text>
				</subparagraph></paragraph></section><section changed="added" committee-id="SSJU00" id="id86e33b5d-2fc4-4482-9f7d-7a06d22d32ec" reported-display-style="italic"><enum>3.</enum><header>Enhancing enforcement
			 against rogue websites operated and registered overseas</header>
			<subsection id="id383327e8-2df1-4255-8580-a371f9d75ff3"><enum>(a)</enum><header>Commencement of an
			 action</header>
				<paragraph id="id8f7d36b0-e5c6-4570-b2c3-cf2bca18e632"><enum>(1)</enum><header>In
			 personam</header><text>The Attorney General may commence an in personam action
			 against—</text>
					<subparagraph id="id0227c466-bf48-4b21-8128-fa6cf73faf26"><enum>(A)</enum><text>a registrant of a
			 nondomestic domain name used by an Internet site dedicated to infringing
			 activities; or</text>
					</subparagraph><subparagraph id="id2f23b896-91df-4d62-9476-d260b95380eb"><enum>(B)</enum><text>an owner or operator of
			 an Internet site dedicated to infringing activities accessed through a
			 nondomestic domain name.</text>
					</subparagraph></paragraph><paragraph id="id0878b61f-9aa3-486b-b609-42cbe18b3e9a"><enum>(2)</enum><header>In rem</header><text>If
			 through due diligence the Attorney General is unable to find a person described
			 in subparagraphs (A) or (B) of paragraph (1), or no such person found has an
			 address within a judicial district of the United States, the Attorney General
			 may commence an in rem action against a nondomestic domain name used by an
			 Internet site dedicated to infringing activities.</text>
				</paragraph><paragraph id="id82AC2FE0C7AD4BBA9A00614B3161BFAC"><enum>(3)</enum><header>Identification of
			 entities</header><text>Any action commenced by the Attorney General under this
			 section shall identify the entities which may be required to take actions
			 pursuant to subsection (d) if an order issues pursuant to subsection
			 (b).</text>
				</paragraph></subsection><subsection id="id9f7aefa8-a869-402c-ad62-8706ed4eac13"><enum>(b)</enum><header>Orders of the
			 court</header>
				<paragraph id="idfc5e91bb-59d5-472b-b638-bd4bed1c8fc0"><enum>(1)</enum><header>In
			 general</header><text>On application of the Attorney General following the
			 commencement of an action under this section, the court may issue a temporary
			 restraining order, a preliminary injunction, or an injunction, in accordance
			 with rule 65 of the Federal Rules of Civil Procedure, against the nondomestic
			 domain name used by an Internet site dedicated to infringing activities, or
			 against a registrant of such domain name, or the owner or operator of such
			 Internet site dedicated to infringing activities, to cease and desist from
			 undertaking any further activity as an Internet site dedicated to infringing
			 activities, if—</text>
					<subparagraph id="idc2977d0b-a889-4d44-872b-086b0d6e2b3d"><enum>(A)</enum><text>the domain name is used
			 within the United States to access such Internet site; and</text>
					</subparagraph><subparagraph id="id6c4289d4-7ab9-411b-b9b8-30251ba7b334"><enum>(B)</enum><text>the Internet site—</text>
						<clause id="ide46d273e-6020-4232-9a73-f59c7888c96a"><enum>(i)</enum><text>conducts business
			 directed to residents of the United States; and</text>
						</clause><clause id="id2005598a-f3d2-4033-933d-efab98e42e2a"><enum>(ii)</enum><text>harms holders of United
			 States intellectual property rights.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" id="idf51e4fdc-8cac-4a4c-99fb-02f216407b37"><enum>(2)</enum><header>Determination by the
			 court</header><text>For purposes of determining whether an Internet site
			 conducts business directed to residents of the United States under paragraph
			 (1)(B)(i), a court may consider, among other indicia, whether—</text>
					<subparagraph commented="no" id="id20e0dcf0-3b6d-4cef-a622-292a11a37a17"><enum>(A)</enum><text>the Internet site is
			 providing goods or services described in section 2(7) to users located in the
			 United States;</text>
					</subparagraph><subparagraph commented="no" id="id4a69c93a-37a3-470d-a6e0-4886bf5fe03a"><enum>(B)</enum><text>there is evidence that
			 the Internet site is not intended to provide—</text>
						<clause commented="no" id="id1fc0fa64-4b44-4ff0-ae20-9db9e8985318"><enum>(i)</enum><text>such goods and services
			 to users located in the United States;</text>
						</clause><clause commented="no" id="idce7d57c6-7f9f-47ab-b997-290ad3cd2b66"><enum>(ii)</enum><text>access to such goods and
			 services to users located in the United States; and</text>
						</clause><clause commented="no" id="ida0a48462-154d-43cf-b37e-155400aee814"><enum>(iii)</enum><text>delivery of such goods
			 and services to users located in the United States;</text>
						</clause></subparagraph><subparagraph commented="no" id="id9e61a2b3-285c-409f-9177-78012e72df16"><enum>(C)</enum><text>the Internet site has
			 reasonable measures in place to prevent such goods and services from being
			 accessed from or delivered to the United States;</text>
					</subparagraph><subparagraph commented="no" id="id3eb048af-57ab-4e05-9695-4fc2d94a9385"><enum>(D)</enum><text>the Internet site offers
			 services obtained in the United States; and</text>
					</subparagraph><subparagraph commented="no" id="id9d66686f-c840-4b05-89e5-69649d1d21dc"><enum>(E)</enum><text>any prices for goods and
			 services are indicated in the currency of the United States.</text>
					</subparagraph></paragraph></subsection><subsection id="id47f2d58e-a7ec-41b9-b333-7c848b062546"><enum>(c)</enum><header>Notice and service of
			 process</header>
				<paragraph id="idd2e56747-b318-49fe-b89e-3d7ff0b2c3ef"><enum>(1)</enum><header>In
			 general</header><text>Upon commencing an action under this section, the
			 Attorney General shall send a notice of the alleged violation and intent to
			 proceed under this Act to the registrant of the domain name of the Internet
			 site—</text>
					<subparagraph id="id8b6bd654-fe3a-4048-983a-287a186a934d"><enum>(A)</enum><text>at the postal and e-mail
			 address appearing in the applicable publicly accessible database of
			 registrations, if any and to the extent such addresses are reasonably
			 available;</text>
					</subparagraph><subparagraph id="id63efe0c3-d40b-4a73-a2ca-bf0174d78d95"><enum>(B)</enum><text>via the postal and e-mail
			 address of the registrar, registry, or other domain name registration authority
			 that registered or assigned the domain name, to the extent such addresses are
			 reasonably available; and</text>
					</subparagraph><subparagraph id="id74fc4f2c-615c-41b6-956e-bde76f955fa0"><enum>(C)</enum><text>in any other such form as
			 the court finds necessary, including as may be required by Rule 4(f) of the
			 Federal Rules of Civil Procedure.</text>
					</subparagraph></paragraph><paragraph id="id97f5f625-1294-449f-b701-bf11a523c6c4"><enum>(2)</enum><header>Rule of
			 construction</header><text>For purposes of this section, the actions described
			 in this subsection shall constitute service of process.</text>
				</paragraph><paragraph id="id5EB1ED1F05FA41D9AAC04A93A8CBA4AC"><enum>(3)</enum><header>Other
			 notice</header><text>Upon commencing an action under this section, the Attorney
			 General shall also provide notice to entities identified in the complaint, or
			 any amendments thereto, which may be required to take action pursuant to
			 subsection (d).</text>
				</paragraph></subsection><subsection id="ided28498d-a2af-4b0a-9ee6-da03247e9718"><enum>(d)</enum><header>Required actions based
			 on court orders</header>
				<paragraph id="ide42d37c4-8f60-4dbc-8335-386fcb7f9f46"><enum>(1)</enum><header>Service</header><text>A
			 Federal law enforcement officer, with the prior approval of the court, may
			 serve a copy of a court order issued pursuant to this section on similarly
			 situated entities within each class described in paragraph (2), which have been
			 identified in the complaint, or any amendments thereto, pursuant to subsection
			 (a). Proof of service shall be filed with the court.</text>
				</paragraph><paragraph id="idf50ab937-946f-4c97-aeed-c10ac5376a86"><enum>(2)</enum><header>Reasonable
			 measures</header><text>After being served with a copy of an order pursuant to
			 this subsection:</text>
					<subparagraph id="id435369e1-9ec7-42a2-8478-11beb9e3a9c6"><enum>(A)</enum><header>Operators</header>
						<clause id="idc6c60f5f-466c-466c-80a4-4532fed198f5"><enum>(i)</enum><header>In
			 general</header><text>An operator of a nonauthoritative domain name system
			 server shall take the least burdensome technically feasible and reasonable
			 measures designed to prevent the domain name described in the order from
			 resolving to that domain name’s Internet protocol address, except that—</text>
							<subclause id="idbff00f56-4912-44b3-b91f-45f319df53b7"><enum>(I)</enum><text>such operator shall not
			 be required—</text>
								<item id="id975577f7-c6db-4040-a25a-05401699b1fd"><enum>(aa)</enum><text>other than as directed
			 under this subparagraph, to modify its network, software, systems, or
			 facilities;</text>
								</item><item id="idfe769775-52ad-4c51-850b-b7e56c910b3d"><enum>(bb)</enum><text>to take any measures
			 with respect to domain name lookups not performed by its own domain name server
			 or domain name system servers located outside the United States; or</text>
								</item><item id="id9abba77e-28a2-491c-b031-47c4aadfe455"><enum>(cc)</enum><text>to continue to prevent
			 access to a domain name to which access has been effectively disable by other
			 means; and</text>
								</item></subclause><subclause id="id49db6af2-7183-4d62-890e-8d4dbcffc305"><enum>(II)</enum><text>nothing in this
			 subparagraph shall affect the limitation on the liability of such an operator
			 under section 512 of title 17, United States Code.</text>
							</subclause></clause><clause id="idfab7040e-4c73-475d-85d8-82e81ea4f9f2"><enum>(ii)</enum><header>Text of
			 notice</header><text>The Attorney General shall prescribe the text of the
			 notice displayed to users or customers of an operator taking an action pursuant
			 to this subparagraph. Such text shall specify that the action is being taken
			 pursuant to a court order obtained by the Attorney General.</text>
						</clause></subparagraph><subparagraph id="idcb433ab2-00a9-4b23-b2b1-a8ff616910be"><enum>(B)</enum><header>Financial transaction
			 providers</header><text>A financial transaction provider shall take reasonable
			 measures, as expeditiously as reasonable, designed to prevent, prohibit, or
			 suspend its service from completing payment transactions involving customers
			 located within the United States and the Internet site associated with the
			 domain name set forth in the order.</text>
					</subparagraph><subparagraph id="id89d2a384-ad97-473d-9c1d-2cf8bdcf18bd"><enum>(C)</enum><header>Internet advertising
			 services</header><text>An Internet advertising service that contracts with the
			 Internet site associated with the domain name set forth in the order to provide
			 advertising to or for that site, or which knowingly serves advertising to or
			 for such site, shall take technically feasible and reasonable measures, as
			 expeditiously as reasonable, designed to—</text>
						<clause id="id31fdd5eb-578b-44b1-bd71-007a62180489"><enum>(i)</enum><text>prevent its service from
			 providing advertisements to the Internet site associated with such domain name;
			 or</text>
						</clause><clause id="id05546720-df68-40f0-a15c-cba2c22e2dad"><enum>(ii)</enum><text>cease making available
			 advertisements for that site, or paid or sponsored search results, links or
			 other placements that provide access to the domain name.</text>
						</clause></subparagraph><subparagraph id="idb9bb5f03-ddc6-4586-9cda-cfedbc089d5b"><enum>(D)</enum><header>Information location
			 tools</header><text>An service provider of an information location tool shall
			 take technically feasible and reasonable measures, as expeditiously as
			 possible, to—</text>
						<clause id="id31f77d78-3e40-44cf-913b-ba56333daeaf"><enum>(i)</enum><text>remove or disable access
			 to the Internet site associated with the domain name set forth in the order;
			 or</text>
						</clause><clause id="id100d3af0-f56c-415f-afd7-a9f6b27eec54"><enum>(ii)</enum><text>not serve a hypertext
			 link to such Internet site.</text>
						</clause></subparagraph></paragraph><paragraph id="idcf3b8ac9-dbaf-43f3-b0d2-63e0f3046814"><enum>(3)</enum><header>Communication with
			 users</header><text>Except as provided under paragraph (2)(A)(ii), an entity
			 taking an action described in this subsection shall determine whether and how
			 to communicate such action to the entity's users or customers.</text>
				</paragraph><paragraph id="id8cb6a95d-3a71-4348-b8d2-26fa4686c1c7"><enum>(4)</enum><header>Rule of
			 construction</header><text>For purposes of an action commenced under this
			 section, the obligations of an entity described in this subsection shall be
			 limited to the actions set out in each paragraph or subparagraph applicable to
			 such entity, and no order issued pursuant to this section shall impose any
			 additional obligations on, or require additional actions by, such
			 entity.</text>
				</paragraph><paragraph id="id28d37939-6652-498d-8379-de66d2c3e90c"><enum>(5)</enum><header>Actions pursuant to
			 court order</header>
					<subparagraph id="id04b0a40c-423a-41c2-95ae-d7093a3e92d8"><enum>(A)</enum><header>Immunity from
			 suit</header><text>No cause of action shall lie in any Federal or State court
			 or administrative agency against any entity receiving a court order issued
			 under this subsection, or against any director, officer, employee, or agent
			 thereof, for any act reasonably designed to comply with this subsection or
			 reasonably arising from such order, other than in an action pursuant to
			 subsection (e).</text>
					</subparagraph><subparagraph id="id803e28f4-a82c-4022-b769-df9aea0a9106"><enum>(B)</enum><header>Immunity from
			 liability</header><text>Any entity receiving an order under this subsection,
			 and any director, officer, employee, or agent thereof, shall not be liable to
			 any party for any acts reasonably designed to comply with this subsection or
			 reasonably arising from such order, other than in an action pursuant to
			 subsection (e), and any actions taken by customers of such entity to circumvent
			 any restriction on access to the Internet domain instituted pursuant to this
			 subsection or any act, failure, or inability to restrict access to an Internet
			 domain that is the subject of a court order issued pursuant to this subsection
			 despite good faith efforts to do so by such entity shall not be used by any
			 person in any claim or cause of action against such entity, other than in an
			 action pursuant to subsection (e).</text>
					</subparagraph></paragraph></subsection><subsection id="id7caba8d8-1aed-4716-a0a0-09153210ad0a"><enum>(e)</enum><header>Enforcement of
			 orders</header>
				<paragraph id="id8e080062-1325-40aa-a0a1-4b2aa3e3801e"><enum>(1)</enum><header>In
			 general</header><text>In order to compel compliance with this section, the
			 Attorney General may bring an action for injunctive relief against any party
			 receiving a court order issued pursuant to this section that knowingly and
			 willfully fails to comply with such order.</text>
				</paragraph><paragraph id="ida5e613c2-4f83-47b0-a6db-0a3ce9f1ecc0"><enum>(2)</enum><header>Rule of
			 construction</header><text>The authority granted the Attorney General under
			 paragraph (1) shall be the sole legal remedy for enforcing the obligations
			 under this section of any entity described in subsection (d).</text>
				</paragraph><paragraph id="id35b01ac9-8ec9-41a5-afec-dda3ab7d1c32"><enum>(3)</enum><header>Defense</header><text>A
			 defendant in an action under paragraph (1) may establish an affirmative defense
			 by showing that the defendant does not have the technical means to comply with
			 the subsection without incurring an unreasonable economic burden, or that the
			 order is inconsistent with this Act. This showing shall serve as a defense only
			 to the extent of such inability to comply or to the extent of such
			 inconsistency.</text>
				</paragraph></subsection><subsection id="id9119c522-eed8-4b2e-aff6-2ae33a0a6996"><enum>(f)</enum><header>Modification or
			 vacation of orders</header>
				<paragraph id="id17f523b3-bf9a-4c02-8400-9dea8c2f8d00"><enum>(1)</enum><header>In
			 general</header><text>At any time after the issuance of an order under
			 subsection (b), a motion to modify, suspend, or vacate the order may be filed
			 by—</text>
					<subparagraph id="ide70ad848-3ae8-4da1-89ea-b67df0a71160"><enum>(A)</enum><text>any person, or owner or
			 operator of property, bound by the order;</text>
					</subparagraph><subparagraph id="idbc6e1509-550b-4ee6-953b-0ee4aa5e3602"><enum>(B)</enum><text>any registrant of the
			 domain name, or the owner or operator of the Internet site subject to the
			 order;</text>
					</subparagraph><subparagraph id="id5ddb4b19-3500-4972-a6de-d03e161740dc"><enum>(C)</enum><text>any domain name registrar
			 or registry that has registered or assigned the domain name of the Internet
			 site subject to the order; or</text>
					</subparagraph><subparagraph id="id34211cb1-b01d-409e-bc71-af86be721e0c"><enum>(D)</enum><text>any entity that has
			 received a copy of an order pursuant to subsection (d) requiring such entity to
			 take action prescribed in that subsection.</text>
					</subparagraph></paragraph><paragraph id="id1ae470d4-41ac-4a1f-9526-ee9597ec945c"><enum>(2)</enum><header>Relief</header><text>Relief
			 under this subsection shall be proper if the court finds that—</text>
					<subparagraph id="idb6fc76a3-daf6-4666-b0c0-57b434f23578"><enum>(A)</enum><text>the Internet site
			 associated with the domain name subject to the order is no longer, or never
			 was, an Internet site dedicated to infringing activities; or</text>
					</subparagraph><subparagraph id="id1d1d53f5-e810-415a-9520-90be60859850"><enum>(B)</enum><text>the interests of justice
			 require that the order be modified, suspended, or vacated.</text>
					</subparagraph></paragraph><paragraph id="id6cd83a28-f143-4fc8-a70b-7c98623746ca"><enum>(3)</enum><header>Consideration</header><text>In
			 making a relief determination under paragraph (2), a court may consider whether
			 the domain name has expired or has been re-registered by a different
			 party.</text>
				</paragraph><paragraph id="idF417519EEF7C45DABC60C80A02587B5B"><enum>(4)</enum><header>Intervention</header><text>An
			 entity identified pursuant to subsection (a) as an entity which may be required
			 to take action pursuant to subsection (d) if an order issues pursuant to
			 subsection (b) may intervene at any time in any action commenced under
			 subsection (a), or in any action to modify, suspend, or vacate an order
			 pursuant to this subsection. Failure to intervene in an action does not
			 prohibit an entity notified of the action from subsequently seeking an order to
			 modify, suspend, or terminate an order issued by the court under this
			 Act.</text>
				</paragraph></subsection><subsection id="id72fa7d2f-b3ba-4683-8b12-357c8e95cbc7"><enum>(g)</enum><header>Related
			 actions</header><text>The Attorney General, if alleging that an Internet site
			 previously adjudicated to be an Internet site dedicated to infringing
			 activities is accessible or has been reconstituted at a different domain name,
			 may commence a related action under this section against the additional domain
			 name in the same judicial district as the previous action.</text>
			</subsection></section><section changed="added" committee-id="SSJU00" id="id18f343c1-b9ea-46aa-a8e4-2032cf767a9e" reported-display-style="italic"><enum>4.</enum><header>Eliminating the
			 financial incentive to steal intellectual property online</header>
			<subsection id="id7bb7bfa1-da3c-4212-9293-bb7e2fca7534"><enum>(a)</enum><header>Commencement of an
			 action</header>
				<paragraph id="idc1acd500-bae4-4e8c-8f67-c0e0909564a8"><enum>(1)</enum><header>In
			 personam</header><text>A qualifying plaintiff may commence an in personam
			 action against—</text>
					<subparagraph id="id11a61967-35cf-485d-8efa-6c66eb62f24c"><enum>(A)</enum><text>a registrant of a domain
			 name used by an Internet site dedicated to infringing activities; or</text>
					</subparagraph><subparagraph id="id068cce3a-ddc1-450d-8c3f-aff7d4257f6e"><enum>(B)</enum><text>an owner or operator of
			 an Internet site dedicated to infringing activities accessed through a domain
			 name.</text>
					</subparagraph></paragraph><paragraph id="id8675a819-6e5a-42e5-ab7a-3082dcab5fda"><enum>(2)</enum><header>In rem</header><text>If
			 through due diligence a qualifying plaintiff is unable to find a person
			 described in subparagraphs (A) or (B) of paragraph (1), or no such person found
			 has an address within a judicial district of the United States, the qualifying
			 plaintiff may commence an in rem action against a domain name used by an
			 Internet site dedicated to infringing activities.</text>
				</paragraph><paragraph id="idD9542C0E07BD4222A9CCD021B1D6F3D8"><enum>(3)</enum><header>Identification of
			 entities</header><text>Any action commenced by a qualifying plaintiff under
			 this section shall identify the entities which may be required to take actions
			 pursuant to subsection (d) if an order issues pursuant to subsection
			 (b).</text>
				</paragraph></subsection><subsection id="idc157a298-0216-4817-a703-daae0ea10488"><enum>(b)</enum><header>Orders of the
			 court</header>
				<paragraph id="idab103cf4-72e0-40d3-bf9f-e3ad5d8c2973"><enum>(1)</enum><header>In
			 general</header><text>On application of a qualifying plaintiff following the
			 commencement of an action under this section, the court may issue a temporary
			 restraining order, a preliminary injunction, or an injunction, in accordance
			 with rule 65 of the Federal Rules of Civil Procedure, against the domain name
			 used by an Internet site dedicated to infringing activities, or against a
			 registrant of such domain name, or the owner or operator of such Internet site
			 dedicated to infringing activities, to cease and desist from undertaking any
			 further activity as an Internet site dedicated to infringing activities,
			 if—</text>
					<subparagraph id="idd3d29eb0-d826-49d9-be83-dd5a7f3613cd"><enum>(A)</enum><text>the domain name is
			 registered or assigned by a domain name registrar or domain name registry that
			 located or doing business in the United States; or</text>
					</subparagraph><subparagraph id="idf7a7051c-b72a-4c46-926b-afbc1f22060f"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idc1c90fa4-395d-4423-8d23-f90219a35cca"><enum>(i)</enum><text>the domain name is
			 used within the United States to access such Internet site; and</text>
						</clause><clause changed="added" committee-id="SSJU00" id="id5e73da78-d483-4312-87fa-61e2302292c2" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>the Internet
			 site—</text>
							<subclause id="id9e1a6799-1340-4605-9213-cc85f6b3d4a6"><enum>(I)</enum><text>conducts business
			 directed to residents of the United States; and</text>
							</subclause><subclause id="id32918f0c-0362-4b8e-ac39-d35ad295495b"><enum>(II)</enum><text>harms holders of United
			 States intellectual property rights.</text>
							</subclause></clause></subparagraph></paragraph><paragraph commented="no" id="idb3d65bdb-02d3-411c-bae0-14999c5748cc"><enum>(2)</enum><header>Determination by the
			 court</header><text>For purposes of determining whether an Internet site
			 conducts business directed to residents of the United States under paragraph
			 (1)(B)(ii)(I), a court may consider, among other indicia, whether—</text>
					<subparagraph commented="no" id="id3ffb0322-38eb-4881-88ea-0328146eb779"><enum>(A)</enum><text>the Internet site is
			 providing goods or services described in section 2(7) to users located in the
			 United States;</text>
					</subparagraph><subparagraph commented="no" id="ide262a85c-5672-4eb1-b1cc-12fe285da9dc"><enum>(B)</enum><text>there is evidence that
			 the Internet site is not intended to provide—</text>
						<clause commented="no" id="id86c09957-5b56-46b2-8a7e-48005407fc3d"><enum>(i)</enum><text>such goods and services
			 to users located in the United States;</text>
						</clause><clause commented="no" id="id16ab6419-2177-4cc0-bb9d-03747def476d"><enum>(ii)</enum><text>access to such goods and
			 services to users located in the United States; and</text>
						</clause><clause commented="no" id="id6f276e83-3dce-4c5a-8b93-4d00b0d22d8f"><enum>(iii)</enum><text>delivery of such goods
			 and services to users located in the United States;</text>
						</clause></subparagraph><subparagraph commented="no" id="id012095ac-2d5e-4fe7-9ddc-6a03b9622c98"><enum>(C)</enum><text>the Internet site has
			 reasonable measures in place to prevent such goods and services from being
			 accessed from or delivered to the United States;</text>
					</subparagraph><subparagraph commented="no" id="ida97c02c0-db5f-4ebe-a9b1-e24ad847ff21"><enum>(D)</enum><text>the Internet site offers
			 services obtained in the United States; and</text>
					</subparagraph><subparagraph commented="no" id="idda372c42-3d6c-42fc-a742-2716930a93a1"><enum>(E)</enum><text>any prices for goods and
			 services are indicated in the currency of the United States.</text>
					</subparagraph></paragraph></subsection><subsection id="idf6319aa2-d339-4f98-ac5f-38b446d39e65"><enum>(c)</enum><header>Notice and service of
			 process</header>
				<paragraph id="id9125e3a9-78c8-4dc8-9a4b-e45883cb0c62"><enum>(1)</enum><header>In
			 general</header><text>Upon commencing an action under this section, the
			 qualifying plaintiff shall send a notice of the alleged violation and intent to
			 proceed under this Act to the registrant of the domain name of the Internet
			 site—</text>
					<subparagraph id="idc6fdbc46-ae53-4e11-9f33-cc50bda3d0e7"><enum>(A)</enum><text>at the postal and e-mail
			 address appearing in the applicable publicly accessible database of
			 registrations, if any and to the extent such addresses are reasonably
			 available;</text>
					</subparagraph><subparagraph id="id1f7412cb-92c9-4d32-a4f1-2d8987588a6b"><enum>(B)</enum><text>via the postal and e-mail
			 address of the registrar, registry, or other domain name registration authority
			 that registered or assigned the domain name, to the extent such addresses are
			 reasonably available; and</text>
					</subparagraph><subparagraph id="idf2522ba6-3989-41e9-ab1f-241218c6ba9b"><enum>(C)</enum><text>in any other such form as
			 the court finds necessary, including as may be required by Rule 4(f) of the
			 Federal Rules of Civil Procedure.</text>
					</subparagraph></paragraph><paragraph id="id18c95c6b-97b5-450a-8685-75dffaef4dd2"><enum>(2)</enum><header>Rule of
			 construction</header><text>For purposes of this section, the actions described
			 in this subsection shall constitute service of process.</text>
				</paragraph><paragraph id="ID3ad3774517ad441f96d74d86ac21504c"><enum>(3)</enum><header>Other
			 notice</header><text>Upon commencing an action under this section, the
			 qualifying plaintiff shall also provide notice to entities identified in the
			 complaint, or any amendments thereto, which may be required to take action
			 pursuant to subsection (d).</text>
				</paragraph></subsection><subsection id="id3b6fb891-401d-4e6f-943b-d0f605186692"><enum>(d)</enum><header>Required actions based
			 on court orders</header>
				<paragraph id="idc994c96d-938b-405f-8384-5c1d27358e05"><enum>(1)</enum><header>Service</header><text>A
			 qualifying plaintiff, with the prior approval of the court, may, serve a copy
			 of a court order issued pursuant to this section on similarly situated entities
			 within each class described in paragraph (2), which have been identified in the
			 complaint, or any amendments thereto, pursuant to subsection (a). Proof of
			 service shall be filed with the court.</text>
				</paragraph><paragraph id="idcf8dba15-d1ee-45be-a571-2b1d22e2e01d"><enum>(2)</enum><header>Reasonable
			 measures</header><text>After being served with a copy of an order pursuant to
			 this subsection:</text>
					<subparagraph id="idc30f75a9-2a09-4ca4-a278-a7f4b692f064"><enum>(A)</enum><header>Financial transaction
			 providers</header><text>A financial transaction provider shall take reasonable
			 measures, as expeditiously as reasonable, designed to prevent, prohibit, or
			 suspend its service from completing payment transactions involving customers
			 located within the United States and the Internet site associated with the
			 domain name set forth in the order.</text>
					</subparagraph><subparagraph id="iddd044ba0-16a9-4bdb-9c89-c7af90470992"><enum>(B)</enum><header>Internet advertising
			 services</header><text>An Internet advertising service that contracts with the
			 Internet site associated with the domain name set forth in the order to provide
			 advertising to or for that site, or which knowingly serves advertising to or
			 for such site, shall take technically feasible and reasonable measures, as
			 expeditiously as reasonable, designed to—</text>
						<clause id="id21f547b4-b1d4-4b63-930a-4910060882c8"><enum>(i)</enum><text>prevent its service from
			 providing advertisements to the Internet site associated with such domain name;
			 or</text>
						</clause><clause id="id78ce51c7-07b7-4e27-9d9f-2fd553e56b3a"><enum>(ii)</enum><text>cease making available
			 advertisements for that site, or paid or sponsored search results, links, or
			 placements that provide access to the domain name.</text>
						</clause></subparagraph></paragraph><paragraph id="id71d01a63-b7da-4678-9969-bb77f325b9ec"><enum>(3)</enum><header>Communication with
			 users</header><text>An entity taking an action described in this subsection
			 shall determine how to communicate such action to the entity's users or
			 customers.</text>
				</paragraph><paragraph id="idd0ca6338-650e-45f1-a8eb-2890be4d9216"><enum>(4)</enum><header>Rule of
			 construction</header><text>For purposes of an action commenced under this
			 section, the obligations of an entity described in this subsection shall be
			 limited to the actions set out in each paragraph or subparagraph applicable to
			 such entity, and no order issued pursuant to this section shall impose any
			 additional obligations on, or require additional actions by, such
			 entity.</text>
				</paragraph><paragraph id="id9ac30996-635d-4dd2-a2db-57c9efed8691"><enum>(5)</enum><header>Actions pursuant to
			 court order</header>
					<subparagraph id="idb4a28f68-ef72-476b-9f7f-e9166faa4666"><enum>(A)</enum><header>Immunity from
			 suit</header><text>No cause of action shall lie in any Federal or State court
			 or administrative agency against any entity receiving a court order issued
			 under this subsection, or against any director, officer, employee, or agent
			 thereof, for any act reasonably designed to comply with this subsection or
			 reasonably arising from such order, other than in an action pursuant to
			 subsection (e).</text>
					</subparagraph><subparagraph id="id053cdc25-f919-4625-80ff-761be61735c9"><enum>(B)</enum><header>Immunity from
			 liability</header><text>Any entity receiving an order under this subsection,
			 and any director, officer, employee, or agent thereof, shall not be liable to
			 any party for any acts reasonably designed to comply with this subsection or
			 reasonably arising from such order, other than in an action pursuant to
			 subsection (e), and any actions taken by customers of such entity to circumvent
			 any restriction on access to the Internet domain instituted pursuant to this
			 subsection or any act, failure, or inability to restrict access to an Internet
			 domain that is the subject of a court order issued pursuant to this subsection
			 despite good faith efforts to do so by such entity shall not be used by any
			 person in any claim or cause of action against such entity, other than in an
			 action pursuant to subsection (e).</text>
					</subparagraph></paragraph></subsection><subsection id="id467ccd9d-30d1-486d-bff2-1a4d7c77b7c4"><enum>(e)</enum><header>Enforcement of
			 orders</header>
				<paragraph id="id983e714f-d9c2-4d6d-8630-92fdee93b4bc"><enum>(1)</enum><header>In
			 general</header><text>In order to compel compliance with this section, the
			 qualifying plaintiff may bring an action for injunctive relief against any
			 party receiving a court order issued pursuant to this section that knowingly
			 and willfully fails to comply with such order.</text>
				</paragraph><paragraph id="ida33c2125-ffab-43ed-a95d-b85eb7f08781"><enum>(2)</enum><header>Rule of
			 construction</header><text>The authority granted a qualifying plaintiff under
			 paragraph (1) shall be the sole legal remedy for enforcing the obligations
			 under this section of any entity described in subsection (d).</text>
				</paragraph><paragraph id="id1f30c782-22e0-4f8b-ba68-4077fcc25731"><enum>(3)</enum><header>Defense</header><text>A
			 defendant in an action commenced under paragraph (1) may establish an
			 affirmative defense by showing that the defendant does not have the technical
			 means to comply with the subsection without incurring an unreasonable economic
			 burden, or that the order is inconsistent with this Act. This showing shall
			 serve as a defense only to the extent of such inability to comply or to the
			 extent of such inconsistency.</text>
				</paragraph></subsection><subsection id="id6092cc44-e740-4b8d-bd56-f7fd6e5f5054"><enum>(f)</enum><header>Modification or
			 vacation of orders</header>
				<paragraph id="idfb01a2de-580d-4f2a-97d8-d368c4eb7d3f"><enum>(1)</enum><header>In
			 general</header><text>At any time after the issuance of an order under
			 subsection (b), a motion to modify, suspend, or vacate the order may be filed
			 by—</text>
					<subparagraph id="idf1e5a14e-1e4d-4b23-8cc9-9da743a16e80"><enum>(A)</enum><text>any person, or owner or
			 operator of property, bound by the order;</text>
					</subparagraph><subparagraph id="ide605fc84-07ff-4577-a286-720e4cb020c9"><enum>(B)</enum><text>any registrant of the
			 domain name, or the owner or operator of the Internet site subject to the
			 order;</text>
					</subparagraph><subparagraph id="id0b3c6284-2c89-4d6e-91fa-f66d3d0ffb36"><enum>(C)</enum><text>any domain name registrar
			 or registry that has registered or assigned the domain name of the Internet
			 site subject to the order; or</text>
					</subparagraph><subparagraph id="id774605ab-18f2-469f-8490-f5abda2ad280"><enum>(D)</enum><text>any entity that has
			 received a copy of an order pursuant to subsection (d) requiring such entity to
			 take action prescribed in that subsection.</text>
					</subparagraph></paragraph><paragraph id="id95a6d5f2-de1b-45a7-ab5d-291927bfbbb9"><enum>(2)</enum><header>Relief</header><text>Relief
			 under this subsection shall be proper if the court finds that—</text>
					<subparagraph id="idbfe91ca1-dc8a-4e32-ba59-d67db0487970"><enum>(A)</enum><text>the Internet site
			 associated with the domain name subject to the order is no longer, or never
			 was, dedicated to infringing activities as defined in this Act; or</text>
					</subparagraph><subparagraph id="idf7f7a248-25b2-44a4-826a-fb7156331b73"><enum>(B)</enum><text>the interests of justice
			 require that the order be modified, suspended, or vacated.</text>
					</subparagraph></paragraph><paragraph id="id334d9d0f-f050-4418-a1f0-eea78b431a1c"><enum>(3)</enum><header>Consideration</header><text>In
			 making a relief determination under paragraph (2), a court may consider whether
			 the domain name has expired or has been re-registered by a different
			 party.</text>
				</paragraph><paragraph id="idEA85D42789674422948A9FDE585181D7"><enum>(4)</enum><header>Intervention</header><text>An
			 entity identified pursuant to subsection (a) as an entity which may be required
			 to take action pursuant to subsection (d) if an order issues pursuant to
			 subsection (b) may intervene at any time in any action commenced under
			 subsection (a), or in any action to modify, suspend, or vacate an order
			 pursuant to this subsection. Failure to intervene in an action does not
			 prohibit an entity notified of the action from subsequently seeking an order to
			 modify, suspend, or terminate an order issued by the court under this
			 Act.</text>
				</paragraph></subsection><subsection id="idac772490-6a22-463c-94b0-5535939631d4"><enum>(g)</enum><header>Related
			 actions</header><text>A qualifying plaintiff, if alleging that an Internet site
			 previously adjudicated to be an Internet site dedicated to infringing
			 activities is accessible or has been reconstituted at a different domain name,
			 may commence a related action under this section against the additional domain
			 name in the same judicial district as the previous action.</text>
			</subsection></section><section changed="added" committee-id="SSJU00" id="id2bb81f74-b8c7-41e8-878a-f0a09e9088b6" reported-display-style="italic"><enum>5.</enum><header>Voluntary action against
			 websites stealing American intellectual property</header>
			<subsection id="id23aaba3a-11a8-4827-bfd9-982038221515"><enum>(a)</enum><header>In
			 general</header><text>No financial transaction provider or Internet advertising
			 service shall be liable for damages to any person for voluntarily taking any
			 action described in section 3(d) or 4(d) with regard to an Internet site if the
			 entity acting in good faith and based on credible evidence has a reasonable
			 belief that the Internet site is an Internet site dedicated to infringing
			 activities.</text>
			</subsection><subsection id="id34a80978-6523-4b82-a763-34f0c812f037"><enum>(b)</enum><header>Internet sites engaged
			 in infringing activities that endanger the public health</header>
				<paragraph id="ide8c2e0cd-4b63-4bd1-8257-fc02b46e7387"><enum>(1)</enum><header>Refusal of
			 service</header><text>A domain name registry, domain name registrar, financial
			 transaction provider, information location tool, or Internet advertising
			 service, acting in good faith and based on credible evidence, may stop
			 providing or refuse to provide services to an infringing Internet site that
			 endangers the public health.</text>
				</paragraph><paragraph id="idd7085861-d53e-47ea-a638-864c7d5d90aa"><enum>(2)</enum><header>Immunity from
			 liability</header><text>An entity described in paragraph (1), including its
			 directors, officers, employees, or agents, that ceases or refused to provide
			 services under paragraph (1) shall not be liable to any party under any Federal
			 or State law for such action.</text>
				</paragraph><paragraph id="id76c8bcb9-5902-4f9f-aba0-de4312b8530a"><enum>(3)</enum><header>Definitions</header><text>For
			 purposes of this subsection—</text>
					<subparagraph id="idec16eb13-cc1a-4d29-8b19-e5e5c3d25d93"><enum>(A)</enum><text>the term
			 <term>adulterated</term> has the same meaning as in section 501 of the Federal
			 Food, Drug, and Cosmetic Act (21 U.S.C. 351);</text>
					</subparagraph><subparagraph id="ida1148fe7-d933-4ba3-88ab-793d3120ec1e"><enum>(B)</enum><text>an <term>infringing
			 Internet site that endangers the public health</term> means—</text>
						<clause id="id9b53f63e-2b87-4b74-88f8-29e9f3c07342"><enum>(i)</enum><text>an Internet site
			 dedicated to infringing activities for which the counterfeit products that it
			 offers, sells, dispenses, or distributes are controlled or non-controlled
			 prescription medication; or</text>
						</clause><clause id="ide09e70a9-25d0-44e6-a73e-0a92959be90d"><enum>(ii)</enum><text>an Internet site that
			 has no significant use other than, or is designed, operated, or marketed by its
			 operator or persons operating in concert with the operator, and facts or
			 circumstances suggest is used, primarily as a means for—</text>
							<subclause id="id1dec8edf-8c0f-4a5a-9336-415c1993c788"><enum>(I)</enum><text>offering, selling,
			 dispensing, or distributing any controlled or non-controlled prescription
			 medication, and does so regularly without a valid prescription; or</text>
							</subclause><subclause id="id4baf65e9-f5de-485e-90de-7f7217eebfd0"><enum>(II)</enum><text>offering, selling,
			 dispensing, or distributing any controlled or non-controlled prescription
			 medication, and does so regularly for medication that is adulterated or
			 misbranded;</text>
							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb468f4f8-6cc8-4a39-b296-3c9fb9d3be1f"><enum>(C)</enum><text>the term
			 <term>misbranded</term> has the same meaning as in section 502 of the Federal
			 Food, Drug, and Cosmetic Act (21 U.S.C. 352); and</text>
					</subparagraph><subparagraph id="ide52c8b96-d0b6-4dfe-aafb-0b857770ed9c"><enum>(D)</enum><text>the term <term>valid
			 prescription</term> has the same meaning as in section 309(e)(2)(A) of the
			 Controlled Substances Act (21 U.S.C. 829(e)(2)(A)).</text>
					</subparagraph></paragraph></subsection></section><section changed="added" committee-id="SSJU00" id="idc78cb30d-3298-4096-b274-cc47728712d6" reported-display-style="italic"><enum>6.</enum><header>Savings clauses</header>
			<subsection id="idb8de3395-f36d-47ac-9310-de3b1e9ccaad"><enum>(a)</enum><header>Rule of construction
			 relating to civil and criminal remedies</header><text>Nothing in this Act shall
			 be construed to limit or expand civil or criminal remedies available to any
			 person (including the United States) for infringing activities on the Internet
			 pursuant to any other Federal or State law.</text>
			</subsection><subsection id="idc37b16fa-d515-4843-b481-a184b1ebe523"><enum>(b)</enum><header>Rule of construction
			 relating to vicarious or contributory liability</header><text>Nothing in this
			 Act shall be construed to enlarge or diminish vicarious or contributory
			 liability for any cause of action available under the Lanham Act or title 17,
			 United States Code, including any limitations on liability under section 512 of
			 such title 17, or to create an obligation to take action pursuant to section 5
			 of this Act.</text>
			</subsection><subsection id="id98b2b12b-159b-4903-bdf2-2d1d480b95e8"><enum>(c)</enum><header>Relationship with
			 section 512 of title 17</header><text>Nothing in this Act, no identification of
			 entities in section 3(a) or 4(a), no notice provided pursuant to section 3(c)
			 or 4(c), no order issued pursuant to sections 3(b) or 4(b), and no order issued
			 or served pursuant to sections 3(d) or 4(d), shall serve as a basis for
			 determining the application of section 512 of title 17, United States
			 Code.</text>
			</subsection></section><section changed="added" committee-id="SSJU00" id="id16b00ae6-0575-4f8a-9e1e-3335aa021ee0" reported-display-style="italic"><enum>7.</enum><header>Guidelines and
			 studies</header>
			<subsection id="id73e8486c-bf3e-49d3-9edf-e0ea578d24b7"><enum>(a)</enum><header>Guidelines</header><text>The
			 Attorney General shall—</text>
				<paragraph id="ide0418a9d-9fe1-4153-b19c-1b659d9dac89"><enum>(1)</enum><text>publish procedures
			 developed in consultation with other relevant law enforcement agencies,
			 including the United States Immigration and Customs Enforcement, to receive
			 information from the public about Internet sites dedicated to infringing
			 activities; and</text>
				</paragraph><paragraph id="idd7e9ac25-e430-4ef5-9f46-3cd69b352e8b"><enum>(2)</enum><text>develop a deconfliction
			 process in consultation with other law enforcement agencies, including the
			 United States Immigration and Customs Enforcement, to coordinate enforcement
			 activities brought under this Act.</text>
				</paragraph></subsection><subsection id="idb9f770c6-abbb-4dfc-b1ea-02cf427ebd34"><enum>(b)</enum><header>Reports</header>
				<paragraph id="id0a3c1248-286d-490c-b072-8c0058afb064"><enum>(1)</enum><header>Report on effectiveness
			 of certain measures</header><text>Not later than 1 year after the date of
			 enactment of this Act, the Secretary of Commerce, in coordination with the
			 Attorney General, the Secretary of Homeland Security, and the Intellectual
			 Property Enforcement Coordinator, shall conduct a study and report to the
			 Committee on the Judiciary of the Senate and the Committee on the Judiciary of
			 the House of Representatives on the following:</text>
					<subparagraph id="id1d61c451-48fb-42a5-8048-0c4972e27991"><enum>(A)</enum><text>An assessment of the
			 effects, if any, of the implementation of section 3(d)(2)(A) on the
			 accessibility of Internet sites dedicated to infringing activity.</text>
					</subparagraph><subparagraph id="id80dd501f-a937-405b-8251-d8c74dbafa92"><enum>(B)</enum><text>An assessment of the
			 effects, if any, of the implementation of section 3(d)(2)(A) on the deployment,
			 security, and reliability of the domain name system and associated Internet
			 processes, including Domain Name System Security Extensions.</text>
					</subparagraph><subparagraph id="id75c888c2-7691-4a8f-beea-a3788e02e6eb"><enum>(C)</enum><text>Recommendations, if any,
			 for modifying or amending this Act to increase effectiveness or ameliorate any
			 unintended effects of section 3(d)(2)(A).</text>
					</subparagraph></paragraph><paragraph id="id3685af31-3b34-4f37-9b5c-0226492da249"><enum>(2)</enum><header>Report on overall
			 effectiveness</header><text>The Register of Copyrights shall, in consultation
			 with the appropriate departments and agencies of the United States and other
			 stakeholders—</text>
					<subparagraph id="id7137d1e3-f08d-44c6-9868-5ab1f696bf04"><enum>(A)</enum><text>conduct a study
			 on—</text>
						<clause id="id878cc9a1-4c36-4582-9391-9a56f8f53b7b"><enum>(i)</enum><text>the enforcement and
			 effectiveness of this Act;</text>
						</clause><clause id="ID75d224c31dab4b24843eae66c9f1ba1c"><enum>(ii)</enum><text>the burden of carrying
			 out the requirements of this Act, if any, on intermediaries;</text>
						</clause><clause id="ID642a1ea2106e4d76bc7b6a0d36cf8759"><enum>(iii)</enum><text>the need for cost
			 reimbursement for intermediaries for carrying out the requirements of this Act;
			 and</text>
						</clause><clause id="id262ed69f-8ecb-463f-8673-16732f3239f8"><enum>(iv)</enum><text>the need to modify or
			 amend this Act to apply to emerging technologies; and</text>
						</clause></subparagraph><subparagraph id="id5779947a-edb2-4b62-b5c7-608c818c126d"><enum>(B)</enum><text>not later than 2 years
			 after the date of enactment of this Act, submit a report to the Committee on
			 the Judiciary of the Senate and the Committee on the Judiciary of the House of
			 Representatives on—</text>
						<clause id="id919c4c4b-b0ac-43b3-abb0-ea1a45a70aee"><enum>(i)</enum><text>the results of the study
			 conducted under subparagraph (A); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ide0b25157-455c-49bb-a3c4-7628c01b4980"><enum>(ii)</enum><text>any recommendations that
			 the Register may have as a result of the study.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC2783E0FCC5746A59C79C4983D9D2FA8"><enum>(3)</enum><header>Annual oversight
			 report</header><text>Not later than 1 year after the date of enactment of this
			 Act, and each year thereafter, the Attorney General shall report to the
			 Committee on the Judiciary of the Senate and the Committee on the Judiciary of
			 the House of Representatives the following information with respect to the
			 preceding year:</text>
					<subparagraph id="IDb9912ee5886b474cb1f8537b4cdbc843"><enum>(A)</enum><text>Each instance in which an
			 action was commenced under section 3(a)(1) or 3(a)(2), and each instance in
			 which an action was commenced by the Attorney General under section 4(a)(1) or
			 4(a)(2), including the name of any party against whom the action was
			 brought.</text>
					</subparagraph><subparagraph id="IDc5837f9bc98d4072830d7869172bbf1a"><enum>(B)</enum><text>Each instance in which a
			 temporary restraining order, preliminary injunction or injunction was issued
			 pursuant to section 3(b)(1), and each instance in which a temporary restraining
			 order, preliminary injunction or injunction was issued pursuant to section
			 4(b)(1) in an action commenced by the Attorney General, including the name of
			 any party against whom the order or injunction was issued.</text>
					</subparagraph><subparagraph id="ID05c51284f2564a688bf8c641c7776794"><enum>(C)</enum><text>Each instance in which an
			 action commenced under section 3(a)(1) or 3(a)(2), or an action commenced by
			 the Attorney General under section 4(a)(1) or 4(a)(2), was concluded without
			 the issuance of a temporary restraining order, preliminary injunction or
			 injunction, including the reason for the conclusion of the action.</text>
					</subparagraph><subparagraph id="ID18bf2cc4b54e40a5b759281350661ff6"><enum>(D)</enum><text>Each proof of service
			 filed with the court pursuant to section 3(d)(1), or filed pursuant to section
			 4(d)(1) in an action commenced by the Attorney General.</text>
					</subparagraph><subparagraph id="IDe42f5f6058374193ac2c291b6c6b99fd"><enum>(E)</enum><text>Each action for
			 injunctive relief brought pursuant to section 3(e), or brought pursuant to
			 section 4(e) in an action commenced by the Attorney General, including the name
			 of any party against whom the action for relief was brought.</text>
					</subparagraph><subparagraph id="ID91b436696133449e9249a92a2f8f3e75"><enum>(F)</enum><text>Each motion granted by a
			 court to modify, suspend or vacate an order that was filed under section
			 3(f)(1), or filed under section 4(f)(1) in an action commenced by the Attorney
			 General, including the relief obtained.</text>
					</subparagraph><subparagraph id="ID041c4e5c1633475e8f1e88c57416cb49"><enum>(G)</enum><text>Each related action
			 commenced pursuant to section 3(g), or commenced by the Attorney General
			 pursuant to section 4(g), including the name of any party against whom an
			 action was commenced.</text>
					</subparagraph></paragraph><paragraph id="idC250019F7F7541B7BC4412432B2C2329"><enum>(4)</enum><header>GAO report on private
			 actions</header><text>Not later than 1 year after the date of enactment of this
			 Act, and each year thereafter, the Comptroller General shall report to the
			 Committee on the Judiciary of the Senate and the Committee on the Judiciary of
			 the House of Representative each instance in the previous year in which an
			 action was commenced under sections 4(a)(1) or 4(a)(2) by a qualifying
			 plaintiff that is not the Attorney General, including the names of any parties
			 to each such action.</text>
				</paragraph></subsection></section><section changed="added" id="id69BCF8F5AE714E898A58054BAE26B9E9" reported-display-style="italic"><enum>8.</enum><header>Preventing the
			 importation of counterfeit products and infringing devices</header><text display-inline="no-display-inline">Notwithstanding section 1905 of title 18,
			 United States Code—</text>
			<paragraph id="IDbf6f14be29874bfb925d65c9473e99c5"><enum>(1)</enum><text>if United States Customs
			 and Border Protection suspects a product of being imported or exported in
			 violation of section 42 of the Lanham Act, and subject to any applicable
			 bonding requirements, the Secretary of Homeland Security is authorized to share
			 information on, and unredacted samples of, products and their packaging and
			 labels, or photos of such products, packaging and labels, with the rightholders
			 of the trademark suspected of being copied or simulated, for purposes of
			 determining whether the products are prohibited from importation pursuant to
			 such section; and</text>
			</paragraph><paragraph id="ID8108cb1c39d749a89f3aca8824baad8a"><enum>(2)</enum><text>upon seizure of material
			 by United States Customs and Border Protection imported in violation of
			 subsection (a)(2) or subsection (b) of section 1201 of title 17, United States
			 Code, the Secretary of Homeland Security is authorized to share information
			 about, and provide samples to affected parties, subject to any applicable
			 bonding requirements, as to the seizure of material designed to circumvent
			 technological measures or protection afforded by a technological measure that
			 controls access to or protects the owner’s work protected by copyright under
			 such title.</text>
