		<official-title>To establish clear regulatory standards for mortgage
		  servicers, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Regulation of Mortgage Servicing
			 Act of 2011</short-title></quote>.</text>
		</section><section id="id14F7C485B99B47DA80A607B1164118CA"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions shall
			 apply:</text>
			<paragraph id="id4B8A9B57A2414CF8844D7D61A661CE8E"><enum>(1)</enum><header>Alternative to
			 foreclosure</header><text>The term <term>alternative to
			 foreclosure</term>—</text>
				<subparagraph id="id35033A27A4F943519ABE4748E3358EC6"><enum>(A)</enum><text>means a course of
			 action with respect to a mortgage offered by a servicer to a borrower as an
			 alternative to a covered foreclosure action; and</text>
				</subparagraph><subparagraph id="id9B010E601E75422992EF193BAC2D376A"><enum>(B)</enum><text>includes a short
			 sale and a deed in lieu of foreclosure.</text>
				</subparagraph></paragraph><paragraph id="id48B5EA60A20241EDAF95A215E8958333"><enum>(2)</enum><header>Borrower</header><text>The
			 term <term>borrower</term> means a mortgagor under a mortgage who is in default
			 or at risk of imminent default, as determined by the Director, by rule.</text>
			</paragraph><paragraph id="id8F8028BABD5A4CF5BA1137B61F83657C"><enum>(3)</enum><header>Covered
			 foreclosure action</header><text>The term <term>covered foreclosure
			 action</term> means a judicial or nonjudicial foreclosure.</text>
			</paragraph><paragraph id="idB10A1B5F917B44A48CEC756F01BD7C40"><enum>(4)</enum><header>Director</header><text>The
			 term <term>Director</term> means the Director of the Bureau of Consumer
			 Financial Protection.</text>
			</paragraph><paragraph id="idDEF76413E7B74D77B4E1C444A0B2369F"><enum>(5)</enum><header>Independent
			 reviewer</header><text>The term <term>independent reviewer</term>—</text>
				<subparagraph id="id4DA6CA88C7684F39AA8404CFA9BED2AC"><enum>(A)</enum><text>means an entity
			 that has the expertise and capacity to determine whether a borrower is eligible
			 to participate in a loan modification program; and</text>
				</subparagraph><subparagraph id="id8582F15C0E9B45E8BACE6C3D77FAB72E"><enum>(B)</enum><text>includes—</text>
					<clause id="idB6909034475E4964B9493ABD540C1096"><enum>(i)</enum><text>an
			 entity that is not a servicer; and</text>
					</clause><clause id="idE309F63A6CB44118B90F060512F073BF"><enum>(ii)</enum><text>a
			 division within a servicer that is independent of, and not under the same
			 immediate supervision as, any division that makes determinations with respect
			 to applications for loan modifications or alternatives to foreclosure.</text>
					</clause></subparagraph></paragraph><paragraph id="id91F5B2617306484DBDC2276DF283B628"><enum>(6)</enum><header>Loan
			 modification program</header><text>The term <term>loan modification
			 program</term>—</text>
				<subparagraph id="id9854585537FA41B8A84D533BF9BCD678"><enum>(A)</enum><text>means a program
			 or procedure designed to change the terms of a mortgage in the case of the
			 default, delinquency, or imminent default or delinquency of a mortgagor;
			 and</text>
				</subparagraph><subparagraph id="idF8AD135FF21B405590A76B002F3BEF90"><enum>(B)</enum><text>includes—</text>
					<clause id="id1958CFEE05DD4333BD5FBFB435FB765C"><enum>(i)</enum><text>a
			 loan modification program established by the Federal Government, including the
			 Home Affordable Modification Program of the Department of the Treasury;
			 and</text>
					</clause><clause id="id43FE210AF0B145D8BDE9DED22BA3B929"><enum>(ii)</enum><text>a
			 loan modification program established by a servicer.</text>
					</clause></subparagraph></paragraph><paragraph id="id9526700E2F074A6BAC302CBA7F74BF95"><enum>(7)</enum><header>Mortgage</header><text>The
			 term <term>mortgage</term> means a federally related mortgage loan, as defined
			 in section 3 of the Real Estate Settlement Procedures Act of 1974 (12 U.S.C.
			 2602), that is secured by a first or subordinate lien on residential real
			 property.</text>
			</paragraph><paragraph id="id57C4F456B4AD467E91D50BB20FB016F9"><enum>(8)</enum><header>Servicer</header><text>The
			 term <term>servicer</term>—</text>
				<subparagraph id="idDB5F28A227BB45058B591361EA431217"><enum>(A)</enum><text>has the same
			 meaning as in section 6(i) of the Real Estate Settlement Procedures Act of 1974
			 (12 U.S.C. 2605(i)); and</text>
				</subparagraph><subparagraph id="id497AAE662D99483ABECC3E86654D3014"><enum>(B)</enum><text>includes a person
			 responsible for servicing a pool of mortgages.</text>
				</subparagraph></paragraph></section><section id="id1D8F40D707564A3E8200289E33CB9FCB"><enum>3.</enum><header>Single point of
			 contact</header>
			<subsection id="idE7243C6760DF4F62A61260A2111AF19D"><enum>(a)</enum><header>Case manager
			 required</header><text>A servicer shall assign 1 case manager to each borrower
			 that seeks a loan modification or an alternative to foreclosure.</text>
			</subsection><subsection id="idF443DB2EC1A8401BB4D60FD02C97AF25"><enum>(b)</enum><header>Duties of case
			 manager</header><text>The case manager assigned under subsection (a) shall be
			 an individual who—</text>
				<paragraph id="id0603468F82EF464AA41F1080BD6B741C"><enum>(1)</enum><text>manages the
			 communications between the servicer and the borrower;</text>
				</paragraph><paragraph id="idE9943F4E3D8341F0941D026296EEAC13"><enum>(2)</enum><text>has the authority
			 to make decisions about the eligibility of the borrower for a loan modification
			 or an alternative to foreclosure;</text>
				</paragraph><paragraph id="id76DF8FBFD8974CAD97AC069DB73C8409"><enum>(3)</enum><text>is available to
			 communicate with the borrower by telephone and email during business hours;
			 and</text>
				</paragraph><paragraph id="idF4F3EC8B7A144A35BE9D7A0D4C08A1AE"><enum>(4)</enum><text>remains assigned
			 to the borrower until the earliest of—</text>
					<subparagraph id="id52858D9B8890436E920966977C7E98CC"><enum>(A)</enum><text>the date on which
			 the borrower accepts a loan modification or an alternative to
			 foreclosure;</text>
					</subparagraph><subparagraph id="id54598972F72C47BE9C36F057FA802069"><enum>(B)</enum><text>the date on which
			 the servicer forecloses on the mortgage of the borrower; and</text>
					</subparagraph><subparagraph id="idEB2EFA8FD36D42B2B668F6E021411972"><enum>(C)</enum><text>the date on which
			 a release of the mortgage of the borrower is recorded in the appropriate land
			 records office, as determined by the Director, by rule.</text>
					</subparagraph></paragraph></subsection><subsection id="idEAB7BA60DB624E348E0B844A6F19BF47"><enum>(c)</enum><header>Assistance for
			 case managers</header><text>A servicer may assign an employee to assist a case
			 manager assigned under subsection (a), if the case manager remains available to
			 communicate with the borrower by telephone and email.</text>
			</subsection></section><section id="idE073638EDE784179B6820C74A48CEF94"><enum>4.</enum><header>Determination of
			 eligibility for loan modification program or alternative to foreclosure
			 required before foreclosure</header>
			<subsection id="id7190ED7BA2D349DC89145CF89BC61D82"><enum>(a)</enum><header>Initiation of
			 covered foreclosure actions</header><text>A servicer may not initiate a covered
			 foreclosure action against a borrower unless the servicer has—</text>
				<paragraph id="id247632010BBD442BAD47B88621B27855"><enum>(1)</enum><text>completed a full
			 review of the file of the borrower to determine whether the borrower is
			 eligible for a loan modification or an alternative to foreclosure;</text>
				</paragraph><paragraph id="id0C44C55B7A6B46C1AE1F0C6E4DD0E2B5"><enum>(2)</enum><text>made a reasonable
			 effort to obtain the information necessary to determine whether the borrower is
			 eligible for a loan modification or an alternative to foreclosure, as described
			 in subsection (c); and</text>
				</paragraph><paragraph id="idCD01C75E6A0944E98692050867E30AD1"><enum>(3)</enum><text>offered the
			 borrower a loan modification or an alternative to foreclosure, if the borrower
			 is eligible for the loan modification or alternative to foreclosure.</text>
				</paragraph></subsection><subsection id="id314133BB0AD64AF0909A21CA4FEC00DE"><enum>(b)</enum><header>Suspension of
			 covered foreclosure actions</header>
				<paragraph id="idA42081D9AD294FD6A579B789D18491F8"><enum>(1)</enum><header>In
			 general</header><text>A servicer shall suspend a covered foreclosure action
			 that was initiated before the date of enactment of this Act until the
			 servicer—</text>
					<subparagraph id="id5A871029DAAA4FA1B327700D95936440"><enum>(A)</enum><text>completes a full
			 review of the file of the borrower to determine whether the borrower is
			 eligible for a loan modification or an alternative to foreclosure;</text>
					</subparagraph><subparagraph id="id41EBA954E886499BBDA233CC6B8F8CF0"><enum>(B)</enum><text>notifies the
			 borrower of the determination under subparagraph (A); and</text>
					</subparagraph><subparagraph commented="no" id="idBF50B90A3BC9401F884B1A92A43B9006"><enum>(C)</enum><text>offers the
			 borrower a loan modification or an alternative to foreclosure, if the borrower
			 is eligible for a loan modification or an alternative to foreclosure.</text>
					</subparagraph></paragraph><paragraph id="id470A5823CF7646B1BCB0B4FE8E80C00C"><enum>(2)</enum><header>Suspension</header><text>During
			 the period of the suspension under paragraph (1), a servicer may not—</text>
					<subparagraph id="id49BEB1D25F29454988A9700A3E788F56"><enum>(A)</enum><text>send a notice of
			 foreclosure to a borrower;</text>
					</subparagraph><subparagraph id="idD6F47C0422AF49D19096E186CCF086BF"><enum>(B)</enum><text>conduct or
			 schedule a sale of the real property securing the mortgage of the borrower;
			 or</text>
					</subparagraph><subparagraph id="idF2531B68314D40CC844EAE9A91A19539"><enum>(C)</enum><text>cause final
			 judgment to be entered against the borrower.</text>
					</subparagraph></paragraph><paragraph id="idE9059D18C31E433DBE61BA81027F1991"><enum>(3)</enum><header>Reasonable
			 efforts</header><text>A servicer is not required to suspend a covered
			 foreclosure action under paragraph (1) if the servicer—</text>
					<subparagraph id="idE5363A35F7264FAF9204F9B68AC8FCE7"><enum>(A)</enum><text>makes a
			 reasonable effort to obtain information necessary to determine whether the
			 borrower is eligible for a loan modification or an alternative to foreclosure,
			 as described in subsection (c); and</text>
					</subparagraph><subparagraph id="id6BE96E219C9E44878F7D52E921C77524"><enum>(B)</enum><text>documents that
			 the servicer has not received information necessary to determine whether the
			 borrower is eligible for a loan modification or an alternative to foreclosure
			 before the end of the applicable period under subsection (c).</text>
					</subparagraph></paragraph><paragraph id="idD9B267007DB14445BE27512DB392BA28"><enum>(4)</enum><header>Rule of
			 construction</header><text>Nothing in this section may be construed to require
			 a servicer to delay an unavoidable foreclosure, such as foreclosure that
			 results from a borrower abandoning the residential real property securing a
			 mortgage.</text>
				</paragraph></subsection><subsection id="idE31A4D6F945D44A5AFB0A02D95C92E51"><enum>(c)</enum><header>Reasonable
			 effort To obtain necessary information</header><text>A servicer shall be deemed
			 to have made a reasonable effort to obtain information necessary to determine
			 whether the borrower is eligible for a loan modification or an alternative to
			 foreclosure if—</text>
				<paragraph id="idD32B10483C204C4AABBD3EB6C19F012C"><enum>(1)</enum><text>during the 30-day
			 period beginning on the date of delinquency of the borrower, the servicer
			 attempts to establish contact with the borrower by—</text>
					<subparagraph id="idE5AA51E216CE48F88CA35904F1E5D098"><enum>(A)</enum><text>making not fewer
			 than 4 telephone calls to the telephone number on record for the borrower, at
			 different times of the day; and</text>
					</subparagraph><subparagraph id="idAF1839A3354D49E5BBC4FB82C251EDFC"><enum>(B)</enum><text>sending not fewer
			 than 2 written notices to the borrower at the address on record for the
			 borrower, at least 1 of which shall be delivered by certified mail, requesting
			 that the borrower contact the servicer;</text>
					</subparagraph></paragraph><paragraph id="id543E8F32FCCC47788160D2A27207F4A8"><enum>(2)</enum><text>in the case that
			 the borrower responds in writing or by telephone to an attempt to establish
			 contact under paragraph (1), the servicer—</text>
					<subparagraph id="idF49B2B6C294149FDA437D2A5158A36B2"><enum>(A)</enum><text>notifies the
			 borrower, in writing, that the servicer lacks information necessary to
			 determine whether the borrower is eligible for a loan modification or an
			 alternative to foreclosure; and</text>
					</subparagraph><subparagraph id="idB01B2043A162458BA664055DAA3CBA04"><enum>(B)</enum><text>sends the
			 borrower a written request that the borrower transmit to the servicer all
			 information necessary to determine whether the borrower is eligible for a loan
			 modification or an alternative to foreclosure, not later than 30 days after the
			 date on which the servicer sends the request;</text>
					</subparagraph></paragraph><paragraph id="id28C41AF569CA4B088A32E23007A4587D"><enum>(3)</enum><text>in the case that
			 the servicer does not receive from the borrower all information requested under
			 paragraph (2)(B) on or before the date that is 30 days after the date on which
			 the servicer sends the notice under paragraph (2), the servicer sends the
			 borrower a written request that the borrower transmit to the servicer all
			 information necessary to determine whether the borrower is eligible for a loan
			 modification or an alternative to foreclosure, not later than 15 days after the
			 date on which the servicer sends the request; and</text>
				</paragraph><paragraph id="id37EB9EE1CB1841079D316DAFB24B562B"><enum>(4)</enum><text>in the case that
			 the servicer does not receive from the borrower all information requested under
			 paragraph (3) on or before the date that is 15 days after the date on which the
			 servicer sends the request under paragraph (3), the servicer notifies the
			 borrower that the servicer intends to initiate or continue a covered
			 foreclosure action.</text>
				</paragraph></subsection></section><section id="idD6914F220B3D48708554CA7D42A788A7"><enum>5.</enum><header>Third party
			 review</header><text display-inline="no-display-inline">Before a servicer
			 notifies a borrower that the borrower is not eligible for a loan modification
			 or an alternative to foreclosure, the servicer shall obtain the services of an
			 independent reviewer to—</text>
			<paragraph id="id2D82DB26D2024A62A6D25FF542018F87"><enum>(1)</enum><text display-inline="yes-display-inline">review the file of the borrower; and</text>
			</paragraph><paragraph id="id73DBF071970E48D985EC388E8373AE4B"><enum>(2)</enum><text display-inline="yes-display-inline">determine whether the borrower is eligible
			 for a loan modification or an alternative to foreclosure.</text>
			</paragraph></section><section id="id0C6A5FD70CD74AE8AA8B462D0EDC6BB1"><enum>6.</enum><header>Bar to
			 foreclosure actions</header>
			<subsection id="idACB1E4A9461642259BCC293E0CA3A617"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to subsection
			 (b), a violation of this Act shall be a bar to a covered foreclosure
			 action.</text>
			</subsection><subsection id="idC3B9448EF48E445C8AC5589EFF76C45D"><enum>(b)</enum><header>Effect of
			 subsequent compliance</header><text display-inline="yes-display-inline">If a
			 servicer is in compliance with this Act, the servicer may bring or proceed with
			 a covered foreclosure action, without regard to a prior violation of this Act
			 by the servicer.</text>
			</subsection></section><section id="id379EB1275B504D938412C0E2E833D72F"><enum>7.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 90 days after the date of
			 enactment of this Act, the Director, in consultation with the Secretary of
			 Housing and Urban Development and the Secretary of the Treasury, shall issue
			 regulations to carry out this Act.</text>
		</section><section id="id9EFF63DC895D401CA7D5290B96D118D1"><enum>8.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Director shall submit to Congress a report that
			 contains—</text>
			<paragraph id="idBC11C7E448614EBB916432084B02FBED"><enum>(1)</enum><text display-inline="yes-display-inline">an evaluation of the effect of this Act
			 on—</text>
				<subparagraph id="idDA68E1E19F3F47A0B560D8FDCF47622E"><enum>(A)</enum><text display-inline="yes-display-inline">State law; and</text>
				</subparagraph><subparagraph id="id9C96A9E86F1A44478160FD37F348C102"><enum>(B)</enum><text display-inline="yes-display-inline">communication between servicers and
			 borrowers; and</text>
				</subparagraph></paragraph><paragraph id="id584F52F8D1F94C75AD7F35FD99084669"><enum>(2)</enum><text display-inline="yes-display-inline">a description of any problems concerning
			 the implementation of this Act.</text>
